KwaDukuza Municipality (KDM) Mayor, Ricardo Mthembu has welcomed the court's judgement over a girl-child rape case in KwaDukuza. T h e KwaDukuza Regional Court recently handed down a maximum sentence to a man who was convicted of raping his 11-yearold step-daughter. He was sentenced to life imprisonment for raping the girl in August last year at Umhlali. Mthembu said, “I welcome the court's decision; after months on trial, a sentence has finally been handed down, this clearly indicates that no one is above the law in this country.” He added that this is good news not only to those who have been seeking closure but for many people in KwaDukuza, because we now have assurance that the rapist will remain behind bars for a long time.

“This victory serves as a warning to those faceless criminals who target vulnerable groups in society and get away with it; they will be brought to book and face the music,” said Mthembu. He further described the rape incident as thuggish and unacceptable in a country that struggled so hard to free itself. “I have also urged our Community Safety Unit to redouble their efforts and work closely with the Police to bring perpetrators of such crimes to book. We will continue to rally for harsher sentences for those who undermine the law,” he said.

Murder and double rape in Groutville stuns MEC By Xpress Reporter

The community of Groutville is in stunned disbelief after the murder and double rape that occurred on last week Monday, 12 August 2013. According to the South African Press Association (SAPA) the KwaZulu-Natal social development MEC Weziwe Thusi expressed shock at the rape of the two women in Groutville near KwaDukuza. “These attacks undermine our efforts to raise awareness about women's rights and

human rights in general,” she said. The MEC added that it was shocking that incidents such as this happened as the country celebrated women's month. In the early hours of Monday, a 72-year-old man was shot dead while his daughter and granddaughter were raped. The man was apparently trying to help the women when he was killed. Thusi urged police to leave no stone unturned to ensure the perpetrators were arrested and jailed.

Man sentenced to life in KwaDukuza Court By Xpress Reporter

Two men were given harsh prison sentences, for being found guilty of heinous rape crimes, at the KwaDukuza Regional Court on Monday, 12 August 2013 and Tuesday, 13 August 2013 respectively. According to SAPS Provincial Media liaison officer, Colonel Vincent Mdunge, Nhlanhla Dlamini (19) was handed a life imprisonment term, on Monday, for raping a 10year-old girl earlier this year.

Mdunge added that Dlamini invited the victim and her friend offering them alcohol laced drinks and forcing them to finish it. The victim's friend managed to escape, however the victim was raped repeatedly in the bushes. Mfanafuthi Ntombela (22) was handed a 45-year imprisonment term on three counts of rape committed in 2009 and 2012. The 22-yearold dragged his victims into the sugar cane fields.

Six injured in Umhlali accident

Six taxi commuters were injured in a roll-over accident on the R102 near the Umhlali River Bridge on Saturday morning. According to Chris Botha of Netcare, the taxi was traveling on the north bound lane when the vehicle overturned rolling several times. “Netcare 911 paramedics arrived at the scene and found that the injured had been ejected from the vehicle while it was tumbling down the roadway. After triaging they found that two people sustained serious injuries while four miraculously escaped with minor injuries,” said Botha. He added that paramedics stabilized the injured on scene before they transported them to various hospitals. Exact detail to the cause of the accident and preceding events are under investigation.

Local police officer found murdered By Xpress Reporter

An Umhlali SAPS Dog Unit officer was allegedly murdered by her boyfriend last week Thursday, 15 August 2013. According to Captain Thulani Zwane, KwaZulu-Natal SAPS spokesperson, the murder happened in Umhlali. “We can confirm that Umhlali Police Station is investigating a

case of murder which happened at Etete Second Stop area in Umhlali on 15 August 2013,” he said. Officer Pinkie Mthembu (27) was allegedly shot dead by her 38-year-old boyfriend who in turn allegedly shot himself in the head. “The motive for the killing is unknown at this stage,” said Zwane.

A shop owner on King Shaka Street was arrested last week Wednesday for allegedly assaulting a pick pocket. At around 4:15pm one of the shop owner said that he had heard screaming when he saw a man running pass his shop been chased by another. He said he helped reprimand the pick pocket who had stolen a phone from a worker with the help of a neighbouring shop owner. The shop owner and the worker were charged for assault by the pick pocket and appeared in the KwaDukuza Magistrates court on Monday morning and the case is still not resolved pending further investigation. The shop owner said: “The pick pockets are a regular occurrence on this street and we catch on average two or three every week and no police patrol the area.” He then added: “This is the first time I was charged for trying to help our customers against pick pockets but in the end I was charged with assault for helping a victim.” The pick pockets go mainly after cell phones, purses, wallets and even gold chains. The shop owners also said that some even carry knives and the thieves are allowed to roam the street which means the street is unsafe and customers are scared to come to our shops and in turn business has slowed down and also feels that criminals get more protection from authorities than the victims. Run baby, run Rose Dladla (34) of Melville will learn her fate one day if she is ever arrested. It is alleged by Seelan Pillay of Frolbrick that a gear-box and steel was missing from their yard during April. Night of terror A 25-year-old female who broke the golden rule has paid a high price for her negligence. The female alleges that she was returning home alone at 11:30pm. She was accosted by four youths who held her up at gunpoint and allegedly raped her. She managed to escape and reported the matter to the police. At the police station, police had arrested one of the youths on a charge of attempted murder. The victim identified him and alerted police who then rounded up his three accomplices. Blood stains of the victim were found on one of them after he had stabbed her several times on her legs. All four culprits aged 25, 27, 20 and 23 are due back at court on 22 October. As this was a gang rape they might appear in the High Court.

Duties of owner of property expropriated or which is to be used by (the Municipality). (1) An owner whose property has been expropriated in terms of this Act, shall, within sixty days from the date of notice…., deliver or cause to be delivered to the (Municipality) a written statement indicating(a) if any compensation was in the notice of expropriation offered for such property, whether or not he accepts the compensation and, if he does not accept it, the amount claimed by him as compensation and how much of that amount represents each of the respective amounts contemplated in section 12(1)(a)(i) and (ii) or (b) and full particulars as to how such amounts are made up; (b) if no such compensation was so offered, the amount claimed as compensation by him and how much of the amount represents each of the respective amounts contemplated in section 12(1)(a)(i) and (ii) or (b) and full particulars as to how such amounts are made up; (c) if the property expropriated is land and any amount is claimed in terms of paragraph (a) or (b), full particulars of all improvements thereon which, in the opinion of the owner, affect the values of such land; (d) if the property being expropriated is land(i) which prior to the date of notice was leased as a whole or in part by unregistered lease, the name and writing or full particulars of the lease, the name and address of the lessee, and accompanied by the lease or a certified copy hereof, if it is not in writing: (ii) which, prior to the date of notice, was sold by the owner, the name and address of the buyer, and accompanied by the contract of purchase ad sale or a certified copy thereof. (ii) on which building has been erected which is subject to a builder's lien by virtue of a written building contract, the name and address of the builder, and accompanied by the building contract or a certified copy thereof. (e) the address to or at which the owner desires that further documents in connection with the expropriation may be posted or delivered or tendered. Provided that the (Municipality) may at (its)discretion extend the said period of sixty days, and that, if the owner requests the (Municipality) in writing within thirty days as from the date of notice to extend the said period of sixty days, the (Municipality) shall extend such period by a further sixty days.” “12. Basis on which compensation is to be determined(1) ……………. (2) ……………. (3) (a) Interest at the standard interest rate determined in terms of Section 28(1) of the Exchequer and Audit Act, 1975 (Act No. 56 of 1975), shall, subject to the provisions of subsection (4), be payable from the date on which the Municipality takes possession of the property in question in terms of Section 8(3) or (5) on any outstanding Portion of the amount of compensation payable in accordance with subsection (1): Provided that (i) …………. (ii) If the owner fails to comply with the provisions of Section 9(1) within the appropriate period referred to in the said section, the amount so payable shall during the period of such failure and for the purpose of the payment of interest be deemed not to be an outstanding amount. (4) If the owner of property which has been expropriated occupies or utilized or any portion thereof, no interest shall, in respect of the period during which he so occupies or utilizes it, be paid in terms if subsection (3) on so much of the outstanding amount as, in the opinion of the (Municipality), relates to the property so occupied or utilized.” “13. Payment of compensation in respect of rights of unregistered leases in respect of property expropriated (3) If the owner of expropriated property fails to comply with a the provisions of Section 9(1) (d)(1) and the (Municipality) did not prior to the payment of any compensation money to the owner become aware of the existence of the lease in respect of such property the (Municipality) shall not be obliged to pay compensation to the lessee concerned in respect of the termination of his rights, but such owner shall be liable to any such lessee for damages sustained by him in consequence of the termination of his rights.” 6. Your attention is directed to the provisions of Section 20 of the Expropriation Act, which read as follows: “20. Payment of certain taxes and other moneys out of compensation monies (1) If any land which has been expropriated is situated within the area of jurisdiction of a local authority, such local authority shall upon receipt or publication of a relevant notice in terms of section 7, forthwith inform the (Municipality) in writing) of any outstanding tax or other moneys in respect of the payment of which the production of a receipt or certificate is in terms of any law prerequisite for the passing of a transfer of such land by a registrar of deeds. (2) The (Municipality) may utilise so much of the compensation money in question as is necessary for the payment on behalf of the owner of such land of any tax or other moneys mentioned in subsection (1) .” 7. If the title deed to the land is not in the possession or under the control of the Owner(s), you are further requested in terms of Section 9(3)(a) of the Expropriation Act to provide within sixty days of the date of this notice written particulars of the name and address of the person in whose possession or under whose control is. 8. “It is cool to be an artisan” On14 August 2013 I had an opportunity to be invited by the iLembe District Municipality (IDM) to the certification and induction ceremony at the Umfolozi FET College in Groutville. Forty learners were being certificated by the college for having completed a plumbing course and a further 40 learners were being inducted to the college. This is the spin-off from IDM investment of R1.2 billion on the construction of the Lower Tugela bulk water project. Through this project, in the long run, every resident within the KwaDukuza municipality (KDM) will have proper sanitation, thus avoiding the “pooh wars” as we see them in Cape Town. Whilst this is an excellent provision of service to our people by the District Municipality, I could not help but marvel how in the process the iLembe Municipality have been able to deal with the paucity of skills and empowerment of youth in the area. Through this project 40 unemployed young learners have been given a head start in life. They have now gained skills and knowledge which they can use anywhere across various sectors. As they were unemployed and faced a bleak future, they now have increased chances of getting better paying jobs. Already those who were certificated have been placed within the same Lower Tugela bulk water project to do their practicals and are

being stipended. According to the reports given by the college the students themselves did not disappoint as they displayed exceptional commitment to their training. They hardly missed a day and virtually all those who enrolled completed their course. This is a clear demonstration by learners that hard work and commitment does pay off no matter what environment you are in. It is also a clear commitment by the IDM to the skills development agenda. Needless to say that KwaDukuza Municipality also has a youth mass skilling program which involved 40 learners as well. This newly acquired qualification by learners is also a confidence booster to them. I saw them walking tall and holding their heads high as they approached the podium to receive their certificates. All 40 learners were also presented with two books each: Life without Limits and Unstoppable both by Nick Vujicic which is inspiring books by an extra-ordinary man who was born without limbs but was able to overcome his disability. I am certain that once the learners have read these books their lives will never be the same again. The ball is now firmly in the court of the learners. Peaceful and fun filled fundraiser disrupted by unruly biker club from Stanger Generally, biker Clubs of the world have tried to change the perception of people about a biker or biker clubs. This is not evident as far as the Stanger bikers are concerned. Bikers arrived at the Engen Garage amongst hundreds of children and music enthusiasts and disrupted the fun by wheeling and smoking up the area on the

courtyards. Enthusiastic children ran to see what was happening and converged around the bikes. The bikers, from ages 30 55, continued this despite being told to stop, endangering the lives of children and pedestrians. Drastic measures had to be taken. One of the bikers had his keys taken off the bike to stop him and a fight started with the bikers threatening to assault and kill the old gentleman. This behaviour had disrupted and caused the function to end early, thus causing loss of funds to the fundraiser. I wish Claud Burton and his companions of the biker club refrain from this kind of behaviour in future. Music enthusiast / Concerned

It's a dog's life… During my morning and afternoon runs through many streets in Stanger Manor I constantly face menacing dogs that bark at me and at times come after me until I pretend like I am throwing a stone at them. Most of these dogs come out of the Manor homes leaving me asking why they are not chained up. I mean I look at the dogs in their owner's yards and here I am jogging on the roadside thinking if one of these canines (dogs) happen to attack me thereby biting me, the owner's of the dog are liable to be charged and I can legally sue. What the dog owners must also realise is that if other residents and / or citizens are attacked and bitten then they are liable for damages and legal action CAN BE INSTITUED against them. Over 100 runners/walkers brave the cold, windy and sometimes rainy conditions when they took to the streets around Newtown to participate in the Stanger Super Spar/M3 Carriers sponsored 5km fun run/walk that was hosted by the KwaDukuza Athletic Club this past Sunday. Old and young converged at the Stanger High School grounds to support a fun filled day with the Coke truck thumping out the music for the entrants and supporters. There were numerous awards on offer including medals and goodie bags for all finishers, trophies for the first three in all categories a washing machine and BMX bicycle in the lucky ticket draws. On scene were the service providers for Stanger Super Spar and

included Ola, Sasko and Coke. Sabelo Mbambo showed the rest of the field a clean pair of heels in the senior male category when he completed the race in an incredible time of 16:40. Closely following him in second place was Philaneezo Nzuza in a time of 17min with Philani Mkhize taking third place in a time of 17:40. The senior female race was dominated by Eunice Ntuli who cut the tape in 25 minutes. MP Myeza (28 minutes) and Patricia Hadebe (32 minutes) came in second and third respectively. Jabulo Khoza was the toast of the junior males wining in a powerful time of 17:25. Makedi Keswa was second best in a time of 24 minutes and Sandile Dube came in

third in 24:10. Siphelele Magalula won the junior female category in 27 minutes with Asanda Ntuli (30 minutes and Mpumo Mbatha (30:15) filly in the last podium finish. Honour of the day went to Daddy 'Mandeni' Naidoo at the ripe old age of 80 who scooped the oldest runner award with the female category going to Sally Naidoo at the age of 64. In his address, President of KDAC President, Chander Gungadeen thanked Sunny Somduth of Stanger Super Spar and Leon Moodliar of M3 Carriers for their generous support. He also extended his thanks to the Stanger Super Spar service providers for their goodies that went in the goodie bags.

iLembe Cricket to host 1st Council Meeting ILembe and District Cricket Union will host their first Council meeting on Monday, 26 August 2013 at the Stanger Sabha Hall commencing at 18:30 (6:30pm). High on the agenda will be the double wicket tournament, election of selectors and the finalisation of the league. Clubs are urged to send delegates to this important meeting.
