By Xpress Reporter

T

he long court battle between renowned businessman, Vivian Reddy and Cassim Moola, The Concerned Citizens Group (CCG) as well as Attorney Paul David may have just come to an end on Friday, 21 April 2017 when the Durban High Court dismissed with costs the interdict to stop the construction of KwaDukuza Mall and Mixed Use Development. The Mall is set to be built on the KwaDukuza Recreational Grounds, a 30 hectare

sporting complex for the community which the municipality sold to Reddy for R9 million in 2015. The CCG and company filed an interdict to halt the construction of the Mall citing among other things that the tender process was not followed accordingly which resulted in the municipality accepting an 'Unsolicited bid' from Reddy's firm, Double Ring Trading and that by building the mall, the municipality is deviating from the initial plan to redevelop KwaDukuza golf course only and

not the other parts of the complex which include a soccer field and a volley ball court to mention a few. From then on, the court issued an order restraining Reddy's company from taking occupation or possession of the property and commencing or continuing with excavations or any form of construction on the property. In the recent developments, the judge found that the application was frivolous and Continued on page 5

ANCYL slams Ballito mall management By Xpress Reporter

The ANC Youth League in the Greater KwaDukuza Region responded to the management of Ballito Junction Regional Mall following correspondence with regard to its mass march last month. The ANCYL in its Memorandum of Demands had raised a number of concerns relating to the failure of the Ballito Bay Regional Mall developers to recruit local people. In response to the Youth League's Memorandum of Demands, the management of the mall provided a lengthy reply which stated that the Ballito Junction Mall has been involved, integrated and fully committed to the KwaDukuza and iLembe areas. “During the recent upgrades at the mall, we began to liaise with all of the tenants at the centre. The tenants were also recently addressed by both Council representatives and the Mayor. At those addresses, it was impressed upon the tenants that there was a need to benefit the local community as far as possible, and that they needed to be given preference in respect of

job opportunities, supply agreements, etc,” read part of the feedback. In a statement issued by the ANCYL, the management of the mall was condemned for the response that they provided. “The ANC Youth League of Greater KwaDukuza Region rejects with the contempt it deserves the second-rate response provided by the management of Ballito Junction Regional Mall on demands encapsulated in our latest Memorandum of Demands dated 23 March 2016. “The Youth League cannot reduce itself into a phrasemongering group by entertaining this 22-point rhetoric. Definitely this cannot be at the expense of the authentic outcries by the toiling masses of this region who are systematically marginalized from meaningful participation in the economic mainstream of this region.” The ANCYL said that they are “going to embark on a series of more intense actions directed to the mall in a bid to coerce the other concerned party, in that it responds appropriately to the demands and issues raised in the 23rd

March Memorandum.” “This time around, we envisage to multiply the number of participants; whom we will draw from all walks of life, i.e. youth organisations, the religious denominations, workers' unions and civic organisations, etc. Part of the planned continuous package which awaits the greedy bosses and mall management would be a massive march or protest action, picketing and

unexpected visits to the mall wherein we will address people inside the mall premises with a view of understanding our plight as the working class youth of this region and that being the genuine demand to share in the mainstream economy.” They further stated that “no amount of intimidation will deter our clarion call for the empowerment of young people of this land. “We also call upon

KwaDukuza Municipality to side with the people and penalize dishonest and mischievous greedy bosses or developers who breach the m e m o r a n d u m o f understanding they sign with the local entity. This regional mall has failed dismally to deliver as per community expectations as well as to honour the agreement of preferential treatment of the people of the Greater KwaDukuza Region.”

Residents upset over uncovered hole HAZARDOUS: Concerned residents of Indian Village are up in arms over an uncovered hole that has been left unattended to since August last year. It is alleged by a resident that there was an underground water leak last year. “iLembe was contacted, and the leak was eventually attended to. However, in order to sort out the problem, a deep hole was dug. The hole is still there and it is a hazard to children and elderly people in the area. “I asked iLembe to solve the problem and they said they are trying to contact the contractor who fixed the initial fault and dug the hole,” she said. iLembe Municipality did not respond at the time of going to press

Judge Mahen Chetty who presided over this case said, “The application is dismissed with costs, including costs of senior counsel, to be paid by the applicants jointly and severally, the one paying the other to be absolved”. Following the judgment, Vivian Reddy said, “This captured group is really a proxy for a few local business persons that do not want competition in the town of KwaDukuza. It does so at its own risk as the Court in the review proceedings can very well decide in the CCG's favour,” said Mohammedy. Meanwhile, the early phases of the construction began on Tuesday, 25 April 2017. Project Manager, Mr. John Townsend of Betts Townsend PTY LTD said, “It's been a long road to get to here. COLLISION: An accident on the R102 in the Compensation area outside Ballito left five people injured

By Xpress Reporter

Five people were injured in a collision on the R102 in the Compensation area outside Ballito on Friday, 21 April 2017. According to Chris Botha of Netcare, a car and a taxi collided. “Paramedics arrived at the scene and

found that the taxi had veered off the roadway, its twisted frame coming to rest on the grass. After the injured were examined it was found that one person sustained serious injuries while four others escaped with minor injuries,” said Botha. He added that

medics treated the injured at the scene before they transported them to various hospitals in the area. “Exact detail to the cause of the crash and preceding events is still speculative and will form part of the police investigation.”

Mayor hands over multi-million rand projects OPENING: KwaDukuza Mayor Ricardo Mthembu turned the sod for the official opening of Etete Sports field project.

Suspected foul play over missing body parts By Nkosinathi Dube

By Xpress Reporter

KwaDukuza Mayor, Cllr. Ricardo Mthembu handed two multi-million rand projects to the community on Tuesday, 25 April 2017. His worship presided over the official hand-over

ceremonies of Etete Sports Field and Etete Creche, two major infrastructure projects which in their totality amount to the value of R20 million. Mthembu kicked off the day's proceedings by handing over the

Sports field in Etete which amounts to R17 million and proceeded to the R3 million Community Creche where he delivered the official opening remarks and addressed the local community.

These projects form part of the council's commitment to rollout meaningful infrastructural developments to rural communities in order to enhance the local economy and skewed spatial apartheid planning.

A family from Nsuze's Dladla homestead was left distraught after discovering that a family member's body parts were missing on Sunday April 23. According to Nsuze SAPS, the deceased, Sthembile Radebe had her eyeball missing as well as a chunk of her right cheek. The discovery was made by a family member who accompanied the body on Friday from Montobello Hospital mortuary to a funeral parlour in Ozwathini area. There were no injuries to her face. It is alleged that they only discovered the injuries on Saturday while fetching the body to which the funeral Parlour's personnel cited that it was mice that caused the injuries. Family members of the deceased suspected foul play and thus the police were called in, as the deceased's cause of death was an overdose of ingesting expired pills. The unfolding of events led to police and pathological services from KwaDukuza to fetch the body at the funeral on Sunday for further investigation. An inquest docket has since been opened at the Nsuze SAPS.

Heavy winds leave homes wrecked By Xpress Reporter

Strong winds in Macambini, an area on the outskirts of Mandeni, during the Easter weekend wrecked about 25 homes and left one person dead. The areas which were mostly affected by these winds were ward 8 and 9, under Councillors Linda Mdletshe and Mphile Mngadi. About 20 people were also reported to have

sustained injuries ranging from minor to critical. According to Cllr. Mngadi, the situation is very bad as some of the residents have no proper structures above their heads. “We would really like to urge anyone who can be able to help us to please contact the municipality and help because nobody expected anything of this nature” said Mngadi.

WRECKED: This was the scenery at over 25 homes in Macambini after the heavy winds.

Punished for discipline A Grade 9 student at Chief Albert Luthuli School has caused a stir with his ill discipline problems. According to Principal Njabulo Mhlongo, the youth was suspended for chasing another pupil armed with a knife by the learner support committee. He was approached by a man at the school, whose relationship to the child is unknown, demanding the code of conduct at the school. The man became aggressive and head-butted Mhlongo causing a laceration to the bridge of his nose. The suspended pupil who joined the attack was himself attacked by other pupils and teachers who rescued Mhlongo from being further assaulted. Sibonelo Khumalo (18) and Malcom Thomas (33) are due

Good Samaritan beaten up Justin Monyale alleges that he was visiting his girlfriend in the Groutville area. His girlfriend's mother, sister and brother began assaulting his girlfriend's children and he intervened. The family members left and a group returned later with the girlfriend's brother and began to assault Monyale. Due to the injuries sustained in the attack, he spent two days in hospital. Thus far police have arrested Sphiwe Ndlanzi (20). More

Fortunately, the boyfriend was present and resolved the problem. The girlfriend then convinced Gumede to accompany her and her friends. Upon arrival at their destination, Gumede was locked up in a house and severely assaulted by the friend and another female. She was stabbed with a broken bottle in the chest. A few days later she

again spotted Gumede and attacked her with a sjambok. Nonhlanhla Khumalo (22) failed to appear in court last week and a warrant of arrest was issued for her. Pay back the money Nkosinathi Vilakazi alleges that he was with his family at home. He was called by two persons who requested to speak to him. The trio left and as soon as they were out of sight they demanded the money he had borrowed. Unable to repay the loan, the two began assaulting him and struck him with a bottle on the head. He fled but they caught him and continued to assault him. He managed to finally escape. Zandile Ngubane (28) and her boyfriend, Lindani Myeza (25) are due back at court on 25 May.

Celebrating Freedom Day

LIBERATION: Nelson Mandela casts his vote during the country's first democratic elections on 27 April 1994

By Xpress Reporter

Freedom Day is observed tomorrow, 27 April 2017 and is an annual celebration of South Africa's first nonracial democratic elections of 1994. This momentous day marks the end of over three hundred years of colonialism, segregation and white minority rule and the establishment of a new democratic government and a new state subject to a new constitution.

The elections were the first non-racial national elections where everyone of voting age of over 18 from any race group was allowed to vote. Previously, under the apartheid regime, nonwhites had only limited rights to vote. The ANC (African National Congress) was voted into power and Nelson Mandela was elected as the first democratic President of South Africa. On Freedom

Day people pay tributes to all those who sacrificed their lives to gain liberation for South Africa. Va r i o u s e v e n t s a n d celebrations take place across the country to mark this significant event. Freedom Day highlights the struggles and obstacles that South Africans faced in their fight against inequality, and is a celebratory event for all South Africans as we now live in a democratic land.

World Asthma Day By Xpress Reporter

World Asthma Day is observed on 2 May 2017 and is an annual event organized by the Global Initiative for Asthma (GINA) to improve asthma awareness and care around the world. The aim of World Asthma Day is to raise awareness, care and support for those affected by asthma. Whilst the primary focus is supporting the person with asthma, support may also extend to family, friends and caregivers. Asthma is a chronic disease of the lungs which causes breathing problems. Symptoms of asthma include breathlessness, coughing, wheezing and a feeling of tightness in the chest. These symptoms vary in frequency and severity. When the symptoms are not under control, the airways can become inflamed making breathing difficult. The symptoms can be controlled enabling people with asthma

Sciatica and its Reflexology Treatment hardly be able to move out of bed. Usually patients complain of pain while walking or standing but at times reverse of this happens, the pain is worse while lying down in a normal sleeping or lying posture and the patient has no other option other than to stand or walk or lie in certain uncomfortable posture. Patients with sciatica may suffer from additional symptoms such as numbness and weakness along the course of nerve, tingling and pins and needles feeling (mostly in the foot or toes). Sciatica is not a disease in itself but a symptom of the sciatic nerve being irritated or compressed ('pinched' as one may call it in layman's language) along its course. The most common place for this to occur is the lower part of the spine where the nerve roots of the sciatic nerve are

compressed by a prolapsed (slipped) disc. Pinching of the nerve due to a disc prolapse is the most common cause. Other medical conditions including trauma to the spine, spinal tumors, and spondylolisthesis (slipping of one vertebra over the other) and lumbar vertebra canal stenosis can cause sciatica. Reflexology as a natural system of treatment offers distinct advantages to the people who suffer from sciatica. The biggest advantage that reflexology offers is that it is able to treat the pain very effectively and is able to rectify the compression or irritation on the sciatic nerve. Another great benefit of using reflexology is that along with the treatment of sciatica, reflexology also aims at strengthening the patient's constitution in order to prevent further recurrences.

Holistic Wellness Centre Sciatic nerve happens to be the longest nerve in our body. It starts from our spinal cord in the lower back and passes down through the hip into the back area of the lower leg. When we say 'Sciatica' we refer to the pain in this sciatic nerve. As this nerve passes down through the pelvis, hip and to the lower leg, the sciatica pain whenever it occurs, is felt in the areas through which it passes. This nerve controls many muscles of the lower leg and also controls the sensation of thigh, leg and feet. Pain that travels from the lower back or from the hip through the back part of the thigh to the lower part of the leg or to the foot is usually very indicative of sciatica. Sciatica pain can range from a simple dull ache to severe electric like shocks. The pain can at times be so severe that the patient may

Grade 7 winners of the Top 20 competition with LTMA officials and educators

Mathematics whiz kids throughout KwaDukuza showed their prowess at the 2017 inter-school math-amove and Top 20 competition hosted by the Lower Tugela Maths Association on Tuesday at Stanger Heights Primary School. Chairman of the Lower Tugela Maths Association thanked the principals of the 20 schools who allowed their learners to participate in the competition and was indebted to the various maths educators for preparing their charges for the competition. Abraham said that the two games offered learners an opportunity to pit their maths skills in a fun way. The Top 20 game which involves the use of cards gives learners an opportunity of applying the four operations to arrive at a desired

MESSAGE FROM HIS WORSHIP THE MAYOR OF KWADUKUZA LOCAL MUNICIPALITY, COUNCILLOR RICARDO MTHEMBU, ON THE OCCASION OF 23RD ANNIVERSARY OF FREEDOM Fellow residents of KwaDukuza, On the 27th April 2017 South Africans will mark a day which forever resonates as a turning point in our history. This year's Freedom Day celebration will take place under the theme: “The year of OR Tambo: Together deepening democracy and building safer and crime-free communities. This year's celebration coincides with the centenary of struggle stalwart Oliver Reginald Tambo who epitomised our struggle for liberation. It presents an opportunity to reflect on the many sacrifices that were made for the freedom we enjoy today and on how South Africa`s democracy was achieved. 2017 is also marks 50 years of the mysterious death of Chief Albert Luthuli. This year's theme calls upon all of us to deepen democracy and build safer and crime-free communities as we count tens of thousands of people who perished in the hands of the brutal apartheid regime. Some, like Chief Luthuli, have not been accounted for. During Freedom Month, we are encouraged to reflect on the progress made over the last 23 years. It is also a time to recommit ourselves to the Constitution which is the foundation of our democracy and the very essence of what freedom means. This we do as many in our country believe, and would like everyone else to believe, that there is no reason to celebrate. This is so among those who are free to eat and sleep at will. The majority of our people in South Africa who are the beneficiaries of freedom celebrate this day knowing that our government is working tirelessly in changing the lives of South Africans for the better. They know South Africa has made significant progress in transforming from an apartheid state into a democratic one. These South Africans know that our democracy has restored the dignity of millions of South Africans and changed our lives for the better.

Those who suffered the brutalities of apartheid know that the values of human dignity, non-racialism and non-sexism, and the rule of law remain paramount in our nation. It is for this reason that they will continue, working with their government, to work for freedom against poverty, unemployment, racism, sexism and other forms of discrimination. The people of South Africa, in their various formations, will continue working together with their government to deepen democracy and build safer and crime-free communities. We cannot allow crime and criminal activities to derail us. This they do because they know that South Africa is the country it is today because of the countless sacrifices that were made for our freedom. They know that many South Africans fought tirelessly to overcome the brutal apartheid system and some even lost their lives so that we free ourselves from the bondage of apartheid colonialism. We must do everything within our means to cherish, protect and advance our hard won freedom because the struggle for freedom secured the right for all South Africans to be a part of our democracy. The struggle to build a country where all people are and feel safe continues. Fighting crime is one of government's main priorities and we will not rest until all people are and feel safe. Because the ANC government cares, the fight against crime is part of the JCPS Cluster's integrated approach to ensure South Africans feel safe in their homes and work spaces. Fighting crime is a shared responsibility between the police, the community and the business sector. As we engage in the fight against crime we must always remember that criminals thrive in communities where their actions are tolerated. Together let us stamp out crime wherever it resides. Drug related crime is on the increase and will

only be stopped if communities and families stand up against this scourge. As citizens of South Africa we have no illusion that we have a second home. Therefore, our freedom binds us together. We all know too well that while South Africa is a better place to live in today, there is still much to be done to create a united and prosperous society. We are alive to the reality that freedom did not automatically heal the divisions of the past. We must, therefore, work to remove the obstacles that still divide our society. It is these divisions which have the potential to be used to polarise our nation. There is more that binds us together as South Africans than that divides us. Let us strive to build on our many ties. Together we can forge a national identity that is built on mutual respect, tolerance and acceptance. LONG MAY THE SPIRIT OF OR TAMBO CONTINUE TO INSPIRE US! MN51/2017

Do we need two municipalities?

I was shocked to read in one of the local papers that ILembe Municipality will charge sewer according to the municipal valuation of your property. This has been done without public participation and their input. Further this was the norm, some 20 years ago. Why did they change? This is not acceptable. With the present system they have failed to have the meters read (prepaid) monthly although they have outsourced the drive by reading. Most Municipalities (Including Western Cape, which has one of the worst droughts in South Africa) still supply 6 KL free water. We are being overcharged for sewer since the prepaid meters were installed. According to the Department of Water and Sanitation, 29% of water is used for sewer. This means that

Warriors whip Morningside

Kwini Kuza to feature on Lotus FM

Warriors in ecstatic mood after victory

In a T20 league match at Gledhow, a depleted Morningside fielding 9 players took on Warriors Sport. Morningside won the toss and elected to bat first. Warriors opening bowler Rishen Mathapershad went straight into the attack and claimed the first wicket with his first ball, sending the opening batsman straight back to the dugout. Delialyn Subrayan stepped in for Morningside and restored some honour averaging 4 runs an over, until he fell victim to Praveen

Ramgareeb in the fifth over. The writing was on the wall for Morningside as Praveen took a further wicket and Ashveer Balchand claimed 5 more wickets in quick succession for just 8 runs. Morningside were all out for 49 in the 10th over. Warriors skipper Riaz Mahomed, seeing the low target of 50, opted to give the bottom order a chance to bat first. It was all Ashveer as he bulldozed his way through the Morningside bowlers and put on his career best 32 earning him

the man of the match award. He was assisted by fellow opener Suhail Younus with 12 not out. Warriors saw victory in the 12th over with the score on 53/6. Don Naidoo claimed 2 wickets and Dillon Subrayan 4 giving Warriors a rough ride in spite of Morningside losing the battle in the end. Both teams played with pride. In a post-match interview, Warriors' Ashveer attributed their victory to a good team spirit all season round.

Local kids band, Kwini Kuza will feature on Lotus FM tonight (Wednesday, 26 April) from 8:30pm. Listeners can call in to speak to the talented musicians in studio. The band recently wrapped up filming for the music video for their new single Speed of light, which will be played on radio for the first time tonight
