“The event of August 17 has been the most gruesome and painful road fatality ever encountered during my time as Mayor. This event will remain a prominent story in the history of public roads in KwaDukuza. We will be forever be touched by this unfortunate event. “We hope that the families, relatives and friends find solace in the knowledge that they are not alone. Government and other structures have been working tirelessly to support the families of the people who fell victim to this unfortunate event,” said Mthembu. The Municipality confirmed that an amount of R100 000 will be allocated to the bereaved families. Dumisane Nonyazi, South African National Civic

Organisation (SANCO) Regional Secretary: KwaDukuza, spoke about previous accidents claiming lives in similar fashion. “The issue of taxis being overloaded needs to be addressed and we need a new mode of transport,” he said. He also mentioned that engineers needed to be deployed. He may have had a premonition because KwaZuluNatal MEC for Transport, Willies Mchunu sent engineers to visit the collision scene. “They will submit their recommendations to me. The team is already on the ground conducting traffic count and making assessments. This area is now a red spot and requires extraordinary interventions to prevent further loss of life,” Mchunu said.

A total of seven suspects are at large after breaking into the Telkom Head Office at UShaka Mall in the early hours of Thursday, 20August 2015. According to Nitesh Arjun of N-Force Security, two guards were held hostage. “The suspects kicked open the front door and entered the store. They held two guards hostage,” said Arjun. “The third guard heard noises and went to investigate. He

then called us and we arrived to find seven males in a Toyota double-cab heavily armed,” he said. Arjun added that they chased after the men but lost the vehicle towards the Mandeni area. It is with great sadness that we have lost one of our stalwarts and faithful sons of Stanger. Mohammed Husain Moosaji, brother of Khalil Moosaji of Trendsetters passed on after having being involved in a tragic motor vehicle accident near Villers in the Free State. Mohammed (as he was fondly known) was on his way with his wife and children to attend a funeral in Azaadville on Friday, 21 August 2015. His wife, Mrs Moosaji also passed away while his children, son-in-law and daughter-in-law are in a stable condition in hospital. His sudden passing on together with his wife has shocked the entire community of Stanger. His broad smile and charming demeanor won the heart of any person who came into contact with him. Mohammed Husain Moosaji was described as a person who was humble, simple, smiling, never angry and dedicated to the poor. He inculcated in his children the five (S)'… Salaam (Greeting), Smile, Salaat (Prayer), Sabr (Patience), Shukr (Thankfullness) His concern for the religious and welfare needs of the community was one of the many outstanding qualities he possessed. His religious commitment to the propagation

of Islam was quite remarkable. He travelled extensively in the last few years locally and abroad for religious propagation the last being to Brazil, Uruguay, Chile and Argentina about a month ago. Mohammed was a person who loved serving the poor, especially the people of Glenhills, Indian Village and Sunny Park. He knew every person by name, including their respective grandparents and extended family. He used to always ask about their health, about their children and whether they were praying. He was concerned as well about if they were married. He used to always have a book and pen in his pocket, so after inquiring about family welfare, he used to make it his duty to inform the brothers of the mosque in the morning, then he himself visited the families. His wife was also very active in the social welfare needs of the community. She regularly kept contact with woman from broken homes, widows, under privileged, neighbors and transported them to the weekly woman (taleem) gathering. She was also involved in the burial committee that was responsible for bathing deceased woman. Her selfless contribution in this aspect of community work spans for more than three decades. Her enthusiasm to help anyone at the

expense of her own comfort was a living testimony to her selfless nature which compelled anyone to adore the wonderful qualities she possessed. Their sudden demise has certainly left a void in the community, but the legacy left by them will remain in the hearts and minds of many people for a long time. The funeral was held on Friday night in stanger and a crowd of more than two thousand people attended the funeral. This is a clear testimony of their acceptance and impact they had on the hearts and minds of those around them. They are survived by a son, Moulana Rashid Ahmed who is the Imam at our main Mosque, 4 loving daughters and 19 beautiful grandchildren. We hope and pray that the Almighty blesses them with forgiveness and grant the family patience to bear this huge loss. The family greatly appreciates the support and encouragement of the community of stanger and request to continue remembering the deceased in their prayers. The Xpress Times, on behalf of the community would like to offer a collective condolence to the Moosaji family. We also pray for Moulana Moosaji's speedy recovery from the serious injuries he sustained in the accident.

“In an article which appeared in a local newspaper dated 14 August 2015 bearing the title “KDM using illegal means to cut power”, the journalist alleges that the electricity disconnections by the municipality are illegal, that they can be challenged in a Court of law, and that it seemed that the municipality was using extortionist means “to force people to pay”. The KwaDukuza Municipality maintains that its disconnection policies are in accordance with the law, particularly with the decision of our Constitutional Court in the matter of Olga Rademan v Moqhaka Local Municipality & others. The facts of the case are as follows 1. Mrs Rademan did not pay rates for her Kroonstad property because she was unhappy with what she regarded as poor service delivery. The municipality disconnected the supply of electricity to Mrs Rademan's property; 2. Mrs Rademan successfully brought an application in the Kroonstad Magistrate's Court for an order directing the municipality to restore her electricity supply, alleging that the municipality was not entitled to disconnect her electricity in the absence of an Order of Court and by virtue of the fact that her electricity account was not in arrears; 3. The municipality took the matter on appeal to the High Court. The High Court concluded that the municipality was not required to obtain an Order of Court where payment was owed to the municipality, and the fact that Mrs Rademan was not in arrears in respect of her electricity account did not preclude the municipality from cutting-off her electricity supply; 4. Mrs Rademan then took the

matter on appeal to the Supreme Court of Appeal which confirmed that the municipality did not need an Order of Court before it could disconnect electricity. In its judgment, the Court stated that a municipality had the power to consolidate all the various accounts of a resident into one account and that if the resident did not pay the whole amount due, the municipality had the power to cut-off the electricity supply; 5. The matter then proceeded to the Constitutional Court which held as follows 5.1 section 5(2) (b) of the Municipal Systems Act 32 of 2000 places upon members of the local community “to pay promptly service fees, surcharges on fees, rates on property, and other taxes, levies and duties imposed by a municipality”, and section 5(2)(e) places a duty upon members of the local community “to comply with by-laws of the municipality applicable to them”; 5.2 the effect of the consolidation of a person's account is that it is not open to a customer to speak about an “electricity account” or a “refuse removal account” or a “rates account” as there are no longer separate accounts but only one account with various components. A further effect of consolidation of accounts is that if a customer pays only part of the account and not the entire account, the customer is in breach of his or her obligations. 5.3 the fact that Mrs Rademan had paid the electricity component of her account did not preclude the municipality from cutting-off her electricity supply after she had failed to pay her account in full;

5.4 the municipality was entitled to cut-off Mrs Rademan's electricity supply. In accordance with the law, consumers who are in arrears with their accounts may validly and lawfully be disconnected. The KwaDukuza Municipality's credit control and debt collection bylaws provide for arrangements to be made by a consumer in the case of arrears and consumers are encouraged to approach the Finance Department if they have any payment difficulties. Consumers are furthermore urged to do so prior to being disconnected. The revenue from rates and service charges is vital for the financial sustainability of the Municipality and for service delivery. It is disappointing that as opposed to encouraging consumers to effect payment, the local newspaper has chosen to mislead consumers about the correct legal position.” Eds note: It is hoped that the municipality applies its Debt collection policy to all ratepayers and consumers and not just to the poorest in the community who are targeted first for electricity disconnection whilst “big businessmen” continue to run services and accumulate rates in the region of over R 100 000 and more. Great care must be taken by KDM to ensure any Debtor Incentive Scheme (DIS) is not abused by multiple participations of debtors reenrolling. “If the ANC does to you what the Apartheid government did to you, then you must do to the ANC what you did to the Apartheid government.” - Nelson Mandela

At these workshops educators are empowered with problem solving strategies and given a hands-on-approach on solving problems in the hope of cascading the same knowledge and skills to their learners. The grade three workshop took place on Monday at Stanger Heights and the grade four/five workshop was held at Manor Primary, also on Monday. Today (Wednesday) the grade 6 and 7 problem solving workshop will take place at Dawnview and KwaDukuza Primary

The 2015 edition of the Math-aMove and Top 20 competition hosted by The Lower Tugela Maths Association (LTMA) at Stanger Heights last week was a resounding success. Chairman of the Lower Tugela Maths Association, Isaac Abraham thanked all principals who allowed their learners to participate in the competition and heaped praise upon the maths educators of the more than 20 schools for preparing their learners for the competition. To allay the fears of teachers and boost their confidence, the Lower Tugela Maths Association

“Even the most enthusiastic and dedicated teacher experiences difficulty” Amidst the endless reporting of teachers being charged with corporal punishment at schools, I wish to give another side to this story. As a teacher who is faced with problematic and ill disciplined learners daily I wish to express my frustration. Today the behavior of some learners at schools has become unreal, even in our primary schools where you would expect learners to be much more respectful. We always strive for the best education for our children and the best teachers, but even the most enthusiastic and dedicated teacher experiences difficulty in giving off their best when faced with such uncontrollable learners. What do you do when a learner openly bullies and threatens another child in front of you? What do you do when a learner laughs in your face when being reprimanded? What do you do when a learner blatantly refuses to complete

assigned tasks in class? What do you do when parents do not come to school to address their child's misdemeanors? In no way am I condoning corporal punishment but before you judge that teacher and hurl abuses at them first think about how they may have been abused daily in the classroom. Parents need to start taking accountability for their children. Teachers alone cannot reform problematic children; parents play a huge role in instilling the correct values in their children so that they grow into productive members in society. Already I have been witness to criminal like behavior being displayed by ten year olds. We always ask ourselves why crime is so rife in South Africa; take a closer look at our schools you might find the answer you are looking for. Frustrated teacher

Sporting Club Real Celtic plans reunion The oldest footballing club in KwaDukuza, Real Celtic plans on holding a reunion for the class of 1984 to 2004 at the Darnall Country Club this December. Various meetings have taken place at the clubs headquarters to get things off the ground for this huge undertaking and from indications early on it would appear that preparations are well on track according to Vice President Fishy Naidoo. He went on to say that the event will be a prestigious function which will acknowledge the 32 years of existence of this equally prestigious club and attendees can be guaranteed a function of class and splendour at a minimal fee. Sub committees have been formed to oversee the different aspects in

the planning phase and work is already under way. Celtic was formed in early 1984 and played socially as it catered for the then members of the local SAPS; they later joined the ranks of the Lower Tugela Soccer Federation under the name SAP Football Club. Due to events at the time the club was compelled to change its name or face expulsion from the league hence the birth of Sporting Club Real Celtic. The club is steeped in tradition and has a rich vein of history which would surely make for good conversation and reminiscence on the day. 'In the air tonight' set to thrill

Three phenomenal musical acts will perform at the 'In the air tonight' show held at Umfolozi Casino. Grove complete Round 3 undefeated Grove set another record when they completed their round III fixtures in the EZE's Electrical Premier Volleyball League (played under KwaDukuza Volleyball Association) undefeated after defeating the high riding Warriors Sport in a closely fought league game played at the Association courts last Thursday. Grove End have not dropped a game in both the previous leagues and have dominated proceedings in the Premier league from the start of the 2015 season, capitalising on their dominance in the past few

seasons. The acquisition of the talented youngsters, Cyprian Thulsiram and Vinnie Singh, playing in tantrum with their stalwarts Satish Bhowanibick, Preggie Pillay and others seemed to put the needed impetus into the Grove End game. Warriors were not to be outdone in this thrilling contest fighting Grove End for every point. However, Warriors faded towards the end of both sets to lose 23-25, 22-25. Podium finish contenders, KSST were also put through their paces by bottom of the table Manor, and had to dig

deep in their reserves to keep out the rampant Manor outfit who have only registered one victory this season. KSST dominated early proceedings but Manor kept them on their toes throughout the first set, eventually succumbing 2125. The second set was a thrilling encounter that set the courts on fire. Both teams matched each other with every point played, with the lead changing numerous

times. Manor eventually held out 26-24 winners to force the match into the third and decisive set. However, Manor ran out of steam in the final set allowing KSST to run out 15-10 victors. The last round of Round III

will be played out tomorrow night (Thursday) and this will determine the second and third spot behind Grove End. Sunbrook meanwhile continued their dominance of

the KDVA Division I league with a comfortable 25-17, 25-16 victory over Frendz whilst Cool Leaders continued in their merry little way defeating Manor Old Boys 25-16, 25-23.
