Staff mental health, which includes workplace stress, anxiety and depression, is taking up an ever-increasing amount of time for those responsible for managing staff absence. Legally, there should be no distinction between physical and psychological illness, but mental illness is one of the most difficult issues employers must handle. Mishandling a mental health problem could trigger a constructive dismissal claim and may also lead to a claim for disability discrimination and personal injury.
