Letting Regulation By Tim Abbott: Walsh and Blair Lawyers. The requirements associated with letting premises for short term accommodation may become a little clearer soon following a submission by the NSW Law Society to a State government call for submissions to an Options Paper. The government issued the Options Paper in July 2017 following a parliamentary enquiry into the adequacy of regulation, or non-regulation, of short term holiday letting in NSW. Submissions were accepted by the Department of Planning and Environment until 31 October last year. The parliamentary enquiry was initiated in response to the rapid growth in short term holiday letting, both nationally and in NSW, over recent years because of the advent of services such as Airbnb. The enquiry found that short term holiday letting was valued at $31.3 billion nationally, with NSW constituting about 50 per cent of the national total. In its submission to the Options Paper the Law Society said it supported recommendations to amend planning laws to regulate short term

rental accommodation, to allow home sharing and letting principle places of residence as exempt development, and to strengthen owners/ corporations powers to manage and respond to short term holiday letting issues in strata properties. The Law Society said that the Strata Schemes Management Act 2005 created uncertainty over the validity of strata body by-laws restricting the rights of owners to deal with their properties and not allowing short term letting. The Society suggested that the government should clarify the strata legislation to provide clarity about the validity of by-laws prohibiting the use of strata apartment blocks to be used as serviced apartments or short-term holiday letting. It also recommended that owner/corporations be given more powers to manage and respond to adverse behaviour resulting from short term letting in their buildings and that consideration be given to the differentiation between strata buildings and residential houses where the potential social environmental impacts were greater.

In addition, the society suggested that short term holiday letting operators should be registered, particularly where a council approval might be required, and that the number of days a property could be used for short term letting each year be limited to ensure that the primary use of the dwelling remained for residential purposes. In conclusion, the Law Society noted that: “We acknowledge the need for any new regime to not be unduly restrictive so as to avoid unnecessary red tape, and to facilitate the significant economic benefits of the share economy through short term holiday letting while managing its social and economic impacts”. It appears therefore that there will be some regulation of short term holiday letting operators such as has happened in other places around the world, including Paris and London. Hopefully, this will permit short term holiday letting in strata title buildings where strata committees have passed by-laws to abolish or prevent that practice.

Turn to the chairs, and the Tozer’s collection is simply mind-boggling. “We have four red chairs which belonged to Lord McAlpine who built the Intercontinental Hotel in Sydney. They are Gothic period which is very unusual, and the chairs come with Lord McAlpine’s tassles,” Brian said. There is a rare Davenport tea set also dating back to 1770, and a glove box belonging to the singing angel, Dame Nellie Melba, which also includes a newspaper clipping and a 45-rpm single record. What is most astounding is the condition the items. Even pieces hundreds of years old look like they were only recently crafted such is their pristine condition. There’s an original Norman Lindsay facsimile of some of his nude sirens, and a silver gilded high tea servery which came from a castle in Scotland, blackened after the castle was bombed by the German air force in 1942. A woman brought it out in pieces to Australia and had it cleaned and reassembled.

SOFT LANDSCAPING AT ITS BEST By pennie scott Living walls (hedges) add numerous features to a house and garden and can vary in height, depth and width according to the placement and purpose. Hedgerows were commonplace in England for thousands of years as they provided a permanent boundary between properties, an edge to the common, protection for field animals from icy winds, habitat for thousands of birds and insects, and food for humans and animals. Most of these hedges were a variety of species, making them useable at all times of the year and their sculptural forms provided sinewy relief over hills and through dales. Fast forward to today and hedges are a rare feature in landscaping and farming, yet, their benefits are many. Almost any plant can be planted and trained into a hedge formation, but, before deciding on which plants to use, have a think as to why you want a hedge, and what you want it to achieve in this location. If you wish to attract birds into your garden, select Australian species of plants.

Callistemons, grevilleas, hakeas, melaleucas and some acacias can all become single species hedges, or use a mix of species so there’s always something flowering. Small birds love to nest in thick thorny branches because their nests are protected against larger birds and goannas, which raid nests for a quick feed. Edible hedges are delicious, and a variety of plants can be used including blueberries, citrus, apples and pears, stonefruit and figs. Plant them

reasonably close together so branches intertwine and become dense, but always manageable with a pair of secateurs! Passionfruit on a trellis is a quick-growing edible hedge and this plant isn’t only wonderful for its fruit – its leaves and flowers are used also for medicines (see Jo Wilson’s column on page 20 of the Wagga Weekly for more information).

We walk through them drooling and wishing it was ours but usually they are way over our budget, and, are we really going to use those retreat areas or excessive bathroom features? Here’s a list of considerations to think about before purchasing a new home based on lustful house features.

It’s usually additional to your Alfresco area and we dream of having coffee and eggs there in the mornings, reading the paper. Sadly, most of us won’t use them and they’ll become full of tumble weeds, be ignored and won’t be a long term useful space.

FIREPLACES I’m talking about open wood-fires, but for people who haven’t used one before, the lure of an open wood fire could prove to be a wrong decision down the track because they have a high level of maintenance that comes with them.
