TIPS FOR SUBMITTING AN OFFER
Searching for and finding the ideal property, is only part of the journey to becoming a homeowner. Once you have decided on the property you want, the next step is to sign the documentation and submit an Offer to Purchase (OTP). “For some, submitting an offer is the most daunting part of the sales process,” says Adrian Goslett, Regional Director and CEO of RE/MAX of Southern Africa, “but if they following a few simple guidelines, there is very little to worry about.” He adds that in essence, an OTP is an agreement that outlines the terms and conditions of the property transaction between the buyer and seller. “Before the contract can be signed, it is important that both the buyer and seller agree to all the terms and conditions in the document. To avoid confusion or conflict in the future, it is vital that everything that is agreed to by the parties is put down in writing in the agreement. Once signed by both the buyer
and seller, the document becomes a legally binding contract,” Goslett explains.

Why is the OTP such a vital document? Simply put, it is imperative because it protects both parties in the agreement and ensures that there is no ambiguity. Misunderstandings can result in conflict, which could jeopardise the sales process. “Ensure that the document completely covers all aspects agreed upon, such as the date of occupation, occupational rent, fixtures and fittings and the conditions of sale. Once concluded and signed by each party, the OTP will become the deed of sale on the property,” says Goslett.
The parties need to agree regarding what items are included in the sale of the property and what aren't. As a general rule of thumb, any fixtures or fittings that have been attached to the property (nailed, bolted, glued or screwed down) will stay.
While it might be a tedious exercise, the OTP should be as detailed and specific as possible. “Essentially more detail means more protection for the parties involved. There is also less chance of either party negating on the agreed upon terms at a later stage,” says Goslett. “It is not unusual for certain items of furniture or curtains specifically made for a uniquely shaped room in the home to be sold with the property. In a situation like this, it makes sense to list the items in the agreement. If the item is not listed, there is no obligation
“It is common for buyers to submit an offer on a property while they are still in the process of selling their current residence. In the offer, they will include a condition which states they have submitted the offer subject to the sale of their other home, this is known as a suspensive condition,” says Goslett. A suspensive condition will normally include a time limit that will depend on the agreement made between the buyer and seller. Once the suspensive condition is fulfilled, the buyer should notify the real estate agent without delay so that the offer can be made unconditional. “If the suspensive condition is not met or the seller is not notified the agreement can become null and void, and the whole transaction could fall through,” advises Goslett.
A vital inclusion in the agreement is the date of occupation, which stipulates the date on which the seller will vacate the property, and the buyer will take occupation. This provides both parties with a clear date to work towards regarding moving. It will also determine whether either party may need to pay occupational rent. The rental amount should be market-related and can be agreed on by both parties with the help of an agent. The occupational rent amount should be included in the agreement. “Because the OTP is contractually binding once signed by both parties, it is important that each party is fully content before they put pen to paper. Buyers and sellers should go through the document thoroughly, and if there is any clause that they need clarification on, they should ask their agent for an explanation or obtain a professional opinion from a lawyer.” In closing, Goslett says that the OTP is a crucial aspect of a property transaction, and if used correctly, it will make the process of buying a home as easy and transparent as possible, reducing the risk of conflict.

At present there are 3 deeds offices responsible for registrations pertaining to properties in the Eastern Cape. The Minister of Rural Development and Land Reform has approved the changes of the jurisdictional areas of the Cape Town and King William's Town deeds offices with the effect that the Cape Town deeds office will no longer be responsible for properties situated in the Eastern Cape and that those properties will fall within the jurisdiction of the King William's Town deeds office from the 4th of December 2017. It was also confirmed that the electronic database of all properties situated in the Eastern Cape will be transferred to the King William's Town deeds office by the 4th of December 2017. The last day for conveyancers to lodge documents relating to Eastern Cape properties in the Cape Town deeds office is the 15th of November 2017. Thereafter, deeds for registration relating to properties situated in the Eastern Cape can only be lodged in the King William's Town deeds office from the 4th of December 2017. Significant delays in registration are being anticipated by conveyancers due to the fact that there will be an almost tenfold increase in lodgement volumes at the King William's Town deeds office and the fact that there will be a period of 3 weeks during which no lodgements will take place for the affected Eastern Cape properties. Pet Ownership in sectional title schemes
Turning to the courts
Pets are considered a part of the family by many and disputes around them can be an emotive issue. The STSMA lays down the rules regarding pets in sectional title schemes. Of the various disputes dealt with in sectional title schemes, it could possibly be said that those involving pets is high, and it possibly for this reason that the rules dealing with pets is at the top of the list in the Sectional Title Schemes Management Act, says Michael Bauer, general manager of property management company IHFM.
There have been many cases where the owners of pets have been willing and able to afford taking their dispute to court, as it has been very important for them to keep their pets with them. There have, too, been cases where the body corporate has had to present their case in court for the removal of a pet. Either way, it is an expensive and time consuming exercise, which should be avoided if at all possible, says Bauer. The STMSA and pets In the STSMA Regulations, Annexure 2 Model Conduct Rules, it stipulates that owners or tenants in units must have the trustees' written consent to keep a pet. While the trustees cannot be unreasonable in withholding consent for this, they do have to consider the circumstances of the request and the best interests of the scheme. When allowing occupants in sectional title schemes to keep pets, they could stipulate that certain conditions
must be met by the owner of the pet and if these are not adhered to, the consent could be withdrawn.
Guide dogs, hearing dogs and service dogs There is an addition, Rule 1(2), which says that consent is automatically given if the pet is a guide dog, hearing dog or service dog. There are increasing cases where dogs are used to alert epileptic sufferers of impending attacks, or diabetic owners of blood sugar level problems, and therapy dogs used to help those who suffer from anxiety and depression related disorders. The owner should be able to present proof of the disability the dog assists with. Obligations of pet owners The STSMA does stipulate that pets must not inconvenience other owners. Owners should have a sense of obligation to clean up after their pet and keep it under control at all times. Adding a “no pets” clause If the owners of units in a sectional title scheme
are adamant that they want a pet free complex, in order to include a “no pets” clause in the rules there needs to be a special resolution taken. To do this there has to be a quorum, then 75% of those present must be in favour of the rule – both in value and number. Breaching the rules If any owner breaches the rules by keeping pets without permission or has a pet that disturbs others, the body corporate can either apply to the Community Schemes Ombud Service for assistance in dealing with the matter or turn to private arbitration or the courts to have the pet removed. Pets have in many households become “members” of the family and this is a highly emotive issue. When addressing a dispute that involves a pet, there has to be clear reasons from each party stating grievances and solutions, to come to a solution quickly and effectively, says Bauer.

FACTORS WHICH CAN ADD VALUE TO A HOME ESPECIALLY IF IT IS TO BE SOLD them striking red, black or other strong colours. Ceilings, said Rawson, have come a long way in the last two decades and no middle class home these days can afford to have hardboard ceilings with peg joints. These, although perfectly efficient, are seen as suitable only for affordable housing. There is, however, a growing tendency for ceilings to be removed altogether and for the trusses to be sanded and painted, thereby making an attractive ceiling. This move, he said, usually involves adding insulation to the interior roof. Wood strip ceilings are also acceptable today in workrooms, gymnasia and family rumpus rooms but are generally regarded now as unsuitable for living rooms and bedrooms.
South Africans, says Bill Rawson, Chairman of the Rawson Property Group, are as susceptible to trends and styles in home design and décor as any other people in the world, even when they do not realize what is influencing their choices.
Lighting, too, said Rawson, has entered into a new era, one in which hanging lights and chandeliers are increasingly seen as old fashioned. Recessed down lighting is now what most people prefer and it is almost essential today for such lights to have strength level
This being the case, said Rawson, any home owner wanting to add value to his property, particularly if he is about to sell it, should consult with an experienced estate agent on what features buyers today regard as popular and if possible ensure that these are incorporated in his home.
The trend towards natural materials, added Rawson, is especially noticeable in flooring; solid natural wood floors are today one of the first installations undertaken on most upgrades and there can be no doubt that they do add greatly to the value of any home – in most cases instantly adding more than double the installation cost. Laminated wood floors, said Rawson, have often been seen by many as a cheap alternative, but the plain truth is that they are today so well made that it is often difficult to tell the difference between them and genuine wooden floorboards. The quality of tiles, too, said Rawson, has also improved out of all recognition, but judging by the plans he sees, they are now not quite as acceptable as they used be in the living and communal areas. They are generally kept now for bathrooms and kitchens only. Surprisingly, added Rawson, following the trend in Europe where wallpapers are almost de rigeur, wallpapering is coming back into fashion here, especially in the more upmarket homes. Certain wallpapers are extremely smart but also very expensive. Full length glazing, especially when it forms part of a sliding aluminium framed door, is definitely another of the main improvements that home upgraders tackle. Aluminium windows and door frames are probably the most popular new feature that aspiring home upgraders can introduce and the big advantage is that not only are they aesthetically pleasing but unlike wood they are maintenance free and do not jam as a result of warping or expansion due to moisture.
On the question of colour schemes, Rawson said that although white, off-white and soothing neutral toned plastered walls are still the first choice of most home owners, face brick is again proving popular because it offers big reductions in maintenance, particularly in the coastal areas. And in the lower and lower middle price brackets, he said, face brick is an obvious choice. Pastel shades, said Rawson, are now very much in favour and it is common these days to find that pale greens, blues, pinks and yellows are increasingly used. In certain modern houses, particularly those on the Atlantic Seaboard in Cape Town, there is a growing tendency to be really bold on one or two interior walls, giving

Fully glazed sliding doors linking with outdoor patios, which in turn link with the garden, are regarded by many as an essential on most homes today.
Similarly, said Rawson, open-plan interiors now almost always add value to a home. These days an open link from the living or dining areas to the kitchen is regarded as a bonus as it enables the family to talk to each other while food is being prepared. However, as a corollary to this, it is essential that the finishes and fittings in the kitchen be upmarket and attractive: granite, marble or expensive wood countertops, aluminium extraction fans and timber covered façades are big draw cards and add value. It has to be remembered, he said, that for many people the kitchen is the most important room in the house. The main factors which will immediately detract from the value of the home, said Rawson, should also be admitted and all the evidence shows these are damp spots on the walls and cracks. “It will,” he said, “often be said by sellers or estate agents that cracks can be easily remedied and are not serious, but shrewd buyers, quite rightly, distrust such statements and if there is evidence of cracks having been plastered and painted over they will be particularly suspicious. This is perfectly natural because there have been some very unfortunate cases where even homes approved by bank valuers have developed serious cracks in the first one or two years after transfer.” www.rawson.co.za
Seller advice: Sectional Title units need certificates too for home owners to hold compliance certificates for any electric fence or gas installations on their properties, while in the Western Cape, a by-law requires a water installation certificate to be provided to the local authority when selling a property, before the owner can obtain the municipal clearance certificate required for transfer. However, while all of these certificate requirements apply to Sectional Title (ST) properties as well as freehold properties, the ST home owner is actually only responsible for compliance within his or her section. In terms of the Occupational Health & Safety Act, all home owners are supposed to have a valid Electrical Certificate of Compliance (ECOC) – and must certainly be able to produce one when selling their property, or the transfer to a new owner will not be able to be registered.
The body corporate, represented by the trustees, is responsible for ensuring the compliance of any relevant installations on the common property, such as security lighting, gate motors, electric fences and any external taps, water pipes and irrigation systems, and for obtaining the necessary compliance certificates.
More recently, it has also become compulsory
So in practice, ST owners who want to sell their
properties need to obtain copies of the body corporate's ECOC and other certificates and submit them to the transfer attorneys along with the originals of the certificates that pertain to their own units. And this is not always as easy as it sounds. Certificates can get lost, and sometimes they are not replaced when necessary, or not obtained at all. Owners who are not selling and don't need copies of valid common property certificates may argue against the cost of obtaining new ones. Fortunately, the situation is likely to improve as more and more schemes begin to implement Regulation 22 of the Sectional Titles Schemes Management Act, which came into effect a year ago. This regulation provides for every ST scheme to have a written 10-year maintenance for all major items or systems on the common property – including those that will require new or updated compliance certificates when they are repaired or replaced.
What is more, Regulation 2 of the Act provides for the body corporate, made up of all the owners, to establish a reserve fund to finance the maintenance plan – so there should be no more disputes about who should pay for which repairs or which certificates. But it is probably going to take a while for all the reserve funds and maintenance plans to be put in place, and until then, ST owners who plan to sell would be well advised to start gathering up all the compliance certificates they need as soon as possible. Meanwhile, ST owners who begrudge the cost of a new compliance certificate for a common property installation should consider what could happen if someone were to be electrocuted, for example, or there was a fire caused by an electrical short, and the insurance rejected any claim for damages because the system was not certified safe. www.chaseveritt.co.za
