estville has always been a popular family suburb, primarily because of its accessibility to Durban, 15km away, and its position close to the freeways going in all directions. Set between Pinetown and Sherwood, Westville’s easy access to all points of the KwaZulu-Natal compass has been a primary driver for expansion. Over the past decade or so, a number of office parks have been built in the region, with many large firms choosing
Westville over the northern business parks. For many this has provided a desirable “live, work, play” lifestyle, which has kept them firmly rooted in Westville. Another significant drawcard for Westville is its superb reputation for quality government schools. With the suburb’s expansion, new retail offerings have popped up and existing ones have been refurbished. The Pavilion – the second-largest mall in KwaZulu-Natal after the Gateway Theatre of Shopping – draws shoppers from Westville and beyond. The well-situated Westville Mall has comprehensive retail offering and is a central meeting point for the community. Westville Junction and Westwood Mall are other popular malls, and there are numerous smaller strips of retail shops dotted throughout the suburb.

he healing properties of gemstones and crystals have been known since ancient times. Facilitating the free flow of energy throughout the body is now something anyone can do. Eva de Fleuriot used her passion for crystals and gemstones to start a business that makes beautiful and affordable jewellery, Crystal Deva. Q: How did your business start? A: My love of crystals and gemstones started in the early ’90s and
soon resulted in me buying and selling them at flea markets in and around Durban. I then saw a gap in the market for affordable, wearable gemstone jewellery, so I decided to start making my own, which culminated in opening my little store called Crystal Deva.

Q: What are the shop rental/ sales prices like in this area? A: Higher than average because the area is high-end retail space with safe off-street parking.
Q: How did you find your premises? A: T here were a few retail spaces vacant on the premises and I approached the landlord.
Q: How many people go through your business each day? A: It varies from a few people on a quiet day to about 40.

ver wondered whether you could party in your home until 2am, or keep a brood of chickens? Sifiso Msomi, partner: property and conveyancing, Shepstone and Wylie Attorneys, gives us the low-down on what you can and cannot do in your home according to the law. The way in which you can use your property is primarily determined by the zoning scheme applicable to it. In addition to this, various bylaws and other legislation can also impact how residential property may be used.
Business
Residential zoning schemes across the country mostly permit people to use residentially zoned property in urban areas for various activities in addition to using it as a residence. This includes allowing a residential property to be used as a bed and breakfast, a daycare facility, a home business or even a shop without business rights. Operating a residentially zoned property in one of these ways is, however, usually subject to certain conditions. For example, a bed and breakfast will be limited to a certain number of rooms (usually three), and a home business will be limited to a certain number of employees
(usually two) and to certain types of industries. Sufficient parking for the business activity is also a condition that generally needs to be met. An important factor across the various zoning schemes is that the property shouldn’t lose its residential character.

Building regulations
In recent years, many cities have introduced limitations on the number of dogs that may be kept on residential property. The general rule across most of the bigger municipalities is that two dogs may be kept per dwelling erected on the premises, although people can get permits to keep more. While keeping bigger animals such as livestock is generally not allowed in residential areas, slaughtering for cultural purposes is permitted if done in accordance with the applicable bylaws, including giving notice of when a slaughter will take place, keeping the slaughter out of public view and taking measures to prevent health risks.
Noise
Noise generated from residential property is also regulated. In urban areas, loud music above a certain level is generally only allowed until 9pm from Monday to Thursday and until 12 midnight on weekends. However, in

This means that questions such as proximity to boundaries, erf size versus coverage and servitudes can all be addressed at a local level, with rules varying in different municipalities.
Zoning
Zoning can be checked through the town planning department of the municipality. Thereafter, you can consult the zoning scheme to see the exact details pertaining to that subzone in that municipality. Applications for changes to zoning can be made through the town planning department. Sectional title and share block units are subject to the rules stipulated by their zoning as well as by their ruling bodies. In less formal residential areas the ways in which property can be used are generally broader with fewer conditions than in more formal urban areas. One reason behind this is to encourage local employment and income generation in less formal areas.

Resolving disputes

T
he Community Schemes Ombud Service (CSOS) is the regulatory authority for all community schemes in South Africa. It was established in terms of the Community Schemes Ombud Service Act, 2011 (Act 9 of 2011). The purpose of the CSOS is to offer a low-cost dispute-resolution mechanism for residents of community schemes. This helps regulate the conduct of parties concerned, assure the quality of all scheme governance documentation and provide stakeholder training, consumer education and awareness for property owners, occupiers and other stakeholders, and ensure that the organisation is managed in an efficient and sustainable manner. The regulations governing the service were promulgated in October last year and the CSOS is now able to issue adjudication orders in disputes. This is expected to be quicker and more costeffective than legal proceedings. The methods used will include conciliation, where the parties use the services of an independent conciliator to be appointed by the ombud to arrive at a mutually agreeable solution, and adjudication, where an independent
adjudicator appointed by the ombud or selected by both parties from the list provided by the ombud determines how the dispute is to be resolved and makes a binding decision or order. The CSOS will cover disputes over matters such as finances, governance, meetings, private and common areas, and management services, among other issues. The process begins with an application lodged via email or in person. The application will then be assessed to determine its validity and whether it has gone through the necessary internal dispute resolution procedures. If it’s valid and able to be resolved amicably, it will be set down for conciliation. If the matter is not resolved, the conciliator will issue a Notice of Non-Resolution and Referral to Adjudication and the matter will be subject to a thorough investigation prior to the adjudication hearing where the adjudicator will consider all the evidence presented and hand down a determination. Adjudicator orders are enforceable in the magistrates’ court or high court depending on the nature of the relief granted in the determination.

Kliptown public environment upgrade
M
ore than 400,000 paving stones of Corobrik’s clay paver range were used for the urban enhancement of the Kliptown Walter Sisulu Square of Dedication, as well as Union Avenue and Square Road, all based in Soweto. Forming part of the Kliptown Public Environment Upgrade, the 24,000m² paving project, completed in July 2017, was commissioned by the Johannesburg Development Agency (JDA). This branch of the city was established to efficiently manage and facilitate the development
of an equitable, sustainable and resilient city to achieve the strategic city development objectives. “The regeneration of this vibrant area, steeped in cultural history, is a fantastic undertaking by the JDA and we applaud the selection of Corobrik’s robust and inspired pavers,” said Musa Shangase, commercial director, Corobrik. “The finished design works well to complement the existing structures and, among the many product benefits of pavers, the durability will minimise any future maintenance or replacement costs for the city.”
Currently in its third developmental phase, the JDA is focused on the implementation of Joburg 2040, which addresses city challenges to achieve its objectives, as well as supporting the development of the City of Johannesburg’s “Corridors of Freedom”, which the Kliptown Public Environment Upgrade falls under. Through urban regeneration, these Corridors of Freedom allow residents to work, live and play within the same space, without the inconvenience and high costs of travelling long distances.
Economic outlook for property market
F
ollowing Finance Minister Malusi Gigaba’s maiden mini Budget presentation to Parliament, Samuel Seeff, chairman, Seeff Property Group, has advised that the key message out of the presentation, poor economic growth and rising sovereign debt levels, points to a period of prudence for the property market. No impact is expected in the short term, but property stakeholders should pay special attention to the weaker
economic growth outlook which has been downgraded for this year from 1,3% to 0,7% and is expected to only reach about 1,9% in 2020.

Amdec unveils Harbour Arch

he Amdec group has unveiled a major new mixed-use development, which is set to transform the Cape Town Foreshore and bring with it much-needed jobs. Harbour Arch’s initial development phase – No 1 Harbour Arch – will comprise 432 apartments, two motor dealerships, retail, leisure and commercial office space.
