n the current market, potential buyers might still be figuring out if they prefer to build or buy something brand new, or if they’d rather buy an existing property with the potential to renovate.
Stick to what you know
Some people may prefer to buy an older property, because it is ready for you to move straight into and gives you room to transform it as you go along. There are other perks too! Older properties tend to have already nabbed premium and
central locations, allowing buyers to smoothly settle in developed areas where access to retail, schools, main roads and a convenient and quality lifestyle is easy. Due to being in locations that are already built up, there is also a familiarity and “tried and tested” appeal to buying an older property. Erf sizes tend to be larger and that, coupled with revamps, can bolster value. Hugo la Grange, principal, Jawitz Properties Western Seaboard, believes a larger plot size enables effective home improvements. “It gives the buyer the chance to improve on the property by, for example, adding another bedroom or granny flat, installing a pool, fixing up the garden, or building an additional garage. Compared to new builds, where your house takes over the stand and there isn’t much room to play with, a large plot gives you the freedom to add value in a variety of ways,” he says.

Try something new
While some people opt to build their homes, it can be quite an administration-intensive process with unforeseen costs and delays. This is why others are opting to buy off plan, whether it is for a free-standing home or a unit in a complex, because you can enjoy the flexibility and savings with less of the administrative headaches. In a nutshell, when you buy a plot‑and-plan in a new development, you can make a selection from something that’s at least in the realm of what you want, but don’t have to deal with a builder, architect or the city council. In some cases, you can even have some say in the finishes and fittings. Katya Varga, assistant area and projects manager for Pam Golding Properties in Stellenbosch and Somerset West, says plot-and‑plan residential developments are typically managed by seasoned developers and builders which offer a sense of comfort. “They are well thought out and cohesive in design, while offering buyers a choice of a few plans at different price points, including the interior specifications or ‘look’ such as dark or light options,” she says. T
he spike in digital fraud has prompted financial institutions to urge clients and property professionals to be alert for any irregularities and verify credentials. The increase in scams perpetrated by the electronic interception of communication between attorneys, estate agents and their clients, has been so significant that the Attorneys Indemnity Insurance Fund no longer covers attorneys who fall victim to cybercrime, says Eduan Milner of Eduan Milner Attorneys, Notaries and Conveyancers.
Electronic communication scams
Losses arising out of cybercrime include payments made into an incorrect or fraudulent bank account. This type of fraud entails a phishing-type email aimed at intercepting correspondence to one of the parties and the progress of the transaction is then monitored, with the fraudster sometimes even phoning for updates, says Milner. “Shortly before payment is due, they send an email from an almost identical email address notifying the purchaser or conveyancer of a change in bank details. The email addresses are sometimes so similar that it’s easy to miss the small discrepancy.” Milner says that, if successful, this scam has serious ramifications for all concerned. “If the buyer is deceived into paying into a fraudulent account, he can no
longer financially perform in terms of the agreement of sale which places him in breach of contract and liable for damages to the seller. It’s a horrible two-fold blow because buyers lose their money, they don’t get the house, and have to pay for damages.” Similarly, if conveyancers get duped into paying the fraudster, they are also liable. Milner also cautions that fraud can happen at any point of the transaction – even after a sale has been cancelled.
Savvy syndicates
Grahame Diedericks, manager principal in Midrand for Lew Geffen Sotheby’s International Realty, cautions against syndicates posing as estate agents, sellers, and even registered attorneys. “One method is to sell homes that are not for sale. This is usually done in one of two ways. Firstly, when someone poses as the owner, the property is transferred, and proceeds paid without the owner being aware of the sale. This will only be successful if the agent and conveyancer are negligent in authenticating the identification of the seller, because to transfer ownership, you need an original title deed and a special power of attorney from the owner authorising the conveyancer to make the transfer. “Fraudsters may also identify homes that are legitimately on the market, post an advert, pose as an estate agent and take an
unsuspecting buyer for viewing. A keen buyer is then taken to the ‘agent’s’ lawyer to sign a sales agreement and instructed to deposit the money, but this is immediately transferred to various other accounts and withdrawn.” Milner says buyers can also be liable for committing fraud when they intentionally misrepresent or omit information which financially impacts the seller. Sellers can be held liable for omissions about a property’s history, especially relating to zoning restrictions, significant structural damage, the presence of undiscovered nuisances, mould, or other toxic damage.
Rental racket
Diedericks cautions for vigilance with rentals too. “Use a reputable agency to vet all parties, but if you rent directly and you have any doubt, don’t do it.” He adds that you can insist that an attorney hold the funds for release to the landlord once an inspection is done. Milner offers the following advice to protect all parties against fraudulent real estate scams: • It’s important for agents and attorneys to verify and know their clients and always personally verify any change in payment instruction. • Be especially vigilant if bank details are changed and independently verify the bank account details directly with the bank.
• Never pay money into an account that does not belong to a bona fide party to the transaction. • Confirm that your estate agent is legitimate. You can also do so via the Estate Agency Affairs Board website. • Never just click reply to an email when you are sending important information. Rather create a new email and input the email address directly. This will ensure that you never send information to a fake email address that looks similar. • Important documents should always be signed in person and verification of bank details always completed. • Be on the lookout for spelling errors in emails or other messaging systems, the presentation of sudden changes or decisions as having strict deadlines, hasty changes to terms and conditions of the contract, or refusal to speak on a phone. • Property professionals should be adequately insured. Advises Milner, “Follow your gut instinct if you feel uneasy about any aspect of the transaction. And if you do fall victim, contact the fraud department of the recipient bank and of your bank immediately as they may be able to stop the money from leaving the account.”

R
ecently, a brazen heist carried out on the N1 highway near Pretoria, saw 31 paintings by nine local artists stolen, leaving an unfortunate collector “out of pocket” to the tune of around R1,5m.

“This type of criminal activity should serve as a warning to art collectors to reassess the security arrangements around their priceless collections and to check that their art is insured at market value,” says Christelle Colman, MD, Elite Risk Acceptances, a subsidiary of Old Mutual Insure.
She offers four tips to HNWIs to avoid disappointment when at a claims stage.

She adds that too often local victims of art theft are disappointed to find that the insurance cover they have in place is not adequate for their art collection. This is partly a result of pieces having appreciated significantly in value over time – either upon the death of the artist or depreciation of the rand-exchange rate – but also because many general household insurance policies apply a minimum value limit per item insured and would therefore fail to provide sufficient insurance cover for fine art that far exceeds this assigned value. Although the media tends to focus on high-profile art thefts, with a recent example being the theft from a Dutch museum of a Van Gogh painting valued at €6m (±R102m), Colman says that the reality in SA is that the value of stolen work varies. “Big-ticket thefts make good headlines when in reality there are countless artworks valued at between R5,000 and R100,000 reported damaged or stolen each year,” says Colman.

Colman. She adds that priceless collectibles could be hanging on the walls of many unsuspecting homeowners. Who knows, perhaps the painting handed down by your grandmother, and now gathering dust in your living room, turns out to be an early Battiss or Sekoto; you won’t know until you have it valued. 2. Determine whether your high-value art collectibles are covered by your existing insurance policy. You should check your policy wording for what items are on cover and what excesses and exclusions apply. “Individuals who have single high-value art works or a collection of pieces should
consider placing their contents insurance on cover with a specialist insurer who understands the unique risks associated with collectables to avoid costly surprises at claims stage,” says Colman. 3. Ensure that each art collectible is correctly insured at insurance replacement value and review this valuation frequently. “Art prices tend to fluctuate widely based on their perceived collectability, the success or death of an artist and even movements of the rand against the dollar. We can accommodate this volatility by recommending a team of experts to assist our clients with facilitating this important value calculation,” says Colman. 4. Be prepared for unexpected losses, as art collectibles can be damaged or lost in the strangest circumstances. Imagine, for example, that your newly commissioned sculpture is destroyed in a studio fire, or your newly acquired painting goes missing while in transit between Paris and Johannesburg. Colman points out that Elite’s clients enjoy peace of mind thanks to features such as deposit and transit cover built into the policy. “If you have commissioned an artwork that requires a deposit and it gets stolen or damaged before it is completed, your insurance cover should allow you to recover this amount, provided you specified it in the ‘fine arts and valuables’ section of your policy,” she says. “It’s impossible to insure the sentimental value linked to your favourite artwork, but you can take steps to secure financial compensation, at replacement value, for any loss suffered due to damage or theft. To avoid disappointment, we suggest dealing with a specialist insurer that has the know-how to correctly assess and value art collectibles and the financial clout to pay out high-value claims,” says Colman.
