amilies with young, schoolgoing children and people considering retirement are all after the freedom and peaceful quality of life offered by secure lifestyle estates and developments.
Pets are also part of many family setups. For this reason various developments are making provision to accommodate animals, but not without rules in place. For instance, some estates only allow small pets.
Having schools on the premises also encourages tenants with children of school-going age to sign longer leases, says Jessica Hofmeyr, head of Houss Rentals and Century Property Developments.
This is what makes these developments a sought-after home investment choice in South Africa.

Buying a home is the biggest investment decision most people will ever make. It follows that a home with the added value of a safe environment, access to good schools and other superior amenities would be extremely attractive to buyers from all age groups.
Add the benefit of being able to walk your children to school or taking your pet for a stroll in a beautiful park-like setting and you may just want to move in for life. And that’s exactly what many families are doing.

“Since the lockdown, we’ve noticed that security, comfort and outdoor space top the list of what prospective buyers want,” says Central Developments Property Group head of communication Alda Erasmus. More retirees are interested in either multigenerational or lifestyle estates with care amenities that allow them to be close to their families while continuing to enjoy having their own living space.

“Lifestyle estates are one of the fastest growing property trends in South Africa, which ranks among the countries with the highest number of estates globally,” says Seeff Property Group chairman Samuel Seeff.
Developers are consequently expanding their portfolio of homes to cater to a broad range of income groups. Rabie Property Group director Miguel Rodrigues confirms that this developer offers an array of lifestyle options within its Burgundy Estate near Cape Town. There are apartments for single young homeowners or tenants as well as larger townhouses and houses that are more suited to families. “The proximity of schools and preschools is most definitely a strong consideration for buyers. And in the retirement market especially, being allowed to have a pet is an important aspect of making a happy home,” says Rodrigues.

Quality education
All the major metro areas in South Africa have a growing selection of lifestyle estates that have access to topquality private schools on the premises or a short distance away. This includes developments in smaller enclaves such as Somerset West, Paarl, Stellenbosch and KwaZulu-Natal’s North Coast.
Setting the trend is Steyn City in Midrand. This city within a city offers an early-learning centre, a preparatory school and a college catering to learners up to Grade 11 (matric will also be offered next year). Children are able to walk or cycle to school or catch a ride on a safe shuttle. Securing primary and high-school placements at reputable educational institutions can be a time-consuming and stressful mission. Having a school on the premises of a lifestyle estate greatly simplifies the process.
Parents have peace of mind knowing their children are receiving quality education, as estate developers take great care to include only educational institutions of a high standard on their premises. On South African estates the preference leans towards private schools with solid academic records like Curro, Reddam and other independent schools. “More family time and fewer anxious hours spent in traffic make for a happier family overall,” says Rodrigues.

Grandparents next door In step with the trend towards multigenerational estates, more retirement villages are being built adjacent to lifestyle estates with schools. This makes it easier for retirees to be involved in the school activities of their grandchildren.
Clara Anna Fontein Lifestyle Estate in Cape Town’s Northern Suburbs, for example, offers three types of homes – a lock-up-and-go townhouse development, large plot-and-plan erven and a retirement development called Oasis Life. Pets welcome Many South Africans, whether single, in a relationship or part of

a family, have a special bond with a pet and would prefer a home that allows them to keep their furry or feathered companion. Catering to this demand, especially for older residents, most lifestyle and retirement estate developers now allow residents to keep a cat or a dog subject to rules usually determined by the homeowners’ association. “We find the pet-friendly topic is a big positive for us in the age bracket for retirement villages,” says Devmark Property Group national sales manager Bruwer de Jager. As can be expected, the rules mostly concern the size of the pet and the number of pets depending on the size of both the home and the residential development.
For instance, some retirement estates allow only small pets that are not noisy and do not require space or exercise. This tends to apply where apartments don’t have gardens, explains Erasmus. “In our other security estates where the houses have large gardens, we allow two medium-sized dogs per household, whereas only small dogs are allowed in ground-floor apartments that have small gardens,” she says. According to Seeff, this trend will not be short-lived. “There’s no doubt that we’ll see continued demand for estates that offer these amenities and buyers are prepared to pay a premium for them,” he says.

Make the most of remote working Working from home during lockdown and possibly beyond, has various advantages – including a possible tax benefit WORDS: MARANA BRAND

ost businesses in South Africa recently had to adopt new approaches to how they operate, which means thousands of employees are now working from home and will continue to do so for the foreseeable future. This has created an opportunity for many employees who did not previously claim home office expenses as tax deductions, to do so for the 2021 tax year (1 March 2020 to 28 February 2021) in particular – and possibly going forward – if working arrangements move
away from offices and more towards remote working. “The good news is that there’s indeed a claim for so called ‘home office expenses’ where one meets the requirements; however, this is limited in the case of an employee,” says Thomas Lobban, tax associate and registered tax practitioner, Tax Consulting South Africa. The South African Revenue Service (SARS) allows certain individual taxpayers to deduct their home office
expenses from their taxable income, provided that the requirements of the Income Tax Act are met.
The general rule for deductions
The principle in our tax law according to which home expenses like rent or mortgage interest, insurance, utilities, telephone and internet costs etc can be deducted if someone operates a business from home or generates additional income from home, is well established. “Whether this principle also applies in the present remote-working environment amid the lockdown seems to be less certain,” says Sanet van Zyl, legal and corporate advisory manager, SERR Synergy. The general rule is provided in section 11(a) of the Income Tax Act and states that employees (people who are working full time for someone else) and those who are self-employed and generally working from home, may be able to claim a deduction for expenses to reduce their overall tax liability, but only if those expenses are incurred while the taxpayer is generating an income or physically doing the work, says Lobban. However, section 23(b) of the Act excludes the deduction of “domestic or private expenses”, which means that the circumstances in which one can claim
a deduction in this regard are limited, especially in the case of an employee.
When does one qualify?
Having a dedicated home office may allow you to claim a tax deduction from SARS if you are a full-time employee who spends more than half your working hours in your home office, a commission earner whose employer does not provide you with an office, or a small business owner or freelancer who always works from home. However, the work space in one’s home should be allocated solely for work purposes, such as a study, and should be used regularly and exclusively for business or work purposes. This requirement will not be satisfied where, for example, one works at the dining room table or has a desk in the main bedroom. “This will apply irrespective of the person’s trade, for example whether they’re a sole proprietor, freelancer or employee,” Lobban says.
Full-time employees
In other words, a full-time employee will be able to claim a deduction for their home office expenses if they work from home for more than six months out of the year of tax assessment (at least 187 days). “So if lockdown in South Africa is counted from April 2020, this means that the deduction will only be available to those full-time employees working from home until at least October,” Lobban explains. Section 23(m) of the Act limits the amounts that may be
claimed by ordinary full-time employees somewhat further and determines that employees (other than commission-based earners) may only deduct very specific amounts, which include pro-rated deductions based on rent, interest on a mortgage bond, repairs to the premises, rates and taxes, cleaning, wear-and-tear, and all other proportional expenses relating to their house. An ordinary employee may not deduct expenses relating to telecoms and stationery, for example, says Lobban. This means that the amount deductible as a home office expense is determined by the percentage of your house that is used exclusively for office space in relation to the total home area. “If the home’s total area is 1,000m2 and the work area is 100m2, 10% of the qualifying home office expenses will be allowed as a tax deduction. Divide the total usable area of your home by your work area to arrive at your percentage,” explains Van Zyl.
Conclusion
“Full-time employees who have been working from home during the lockdown but might not qualify under the circumstances listed above, for example in terms of designated office space or a period of more than six months, should be able to apply the home office tax deduction in the next tax submission as SARS may be lenient given that such employees might not have had sufficient time to arrange proper designated areas,” says Van Zyl.

Renovate your insurance, too So, you’ve been updating your home during lockdown and are maybe even busy with some add-ons? Here’s how this may influence your home insurance. WORDS: SUPPLIED

outh Africans didn’t just spend their lockdown baking banana bread and making sourdough. They also took the opportunity to do renovations to their homes, with the hardware industry reporting an unexpected boom in home upgrades, repairs and extensions. But if you’ve recently renovated your home, it’s critical that you revisit your insurance policies to make sure your buildings and home contents remain insured correctly, says Wynand van Vuuren, partner of client experience, King Price Insurance. “Anything that affects the replacement cost of your home can also affect the value that you’re insured for, and the likelihood that your insurer will pay 100% of your claim,” says Van Vuuren. “If you’ve done a renovation, or added a pool or a granny flat, your property is suddenly worth a lot more, and your policy needs to reflect the new value. The biggest mistake you can make is to be under-insured: if you’re 50% underinsured, for example, your insurer will only pay out 50% of your claim in the event of any losses.” If you’ve done some renovations or improvements, here’s what you should be doing.
Know the different types of insurance To start with, it’s important that homeowners understand the two different types of home insurance:
Buildings insurance As the name suggests, this covers the structure of your home and its outbuildings and their permanent fittings, against fire, damage and theft. If you own a house, make 100% sure you have buildings insurance, regardless of whether you have a bond or not. Home contents insurance This covers your stuff. If you could turn your house upside down and shake it, what falls out is home contents – clothes, furniture, TV, wine glasses, the lot. Many people don’t have home contents insurance. Bad move.
Do a post-reno buildings insurance review
If you’ve got a bond, it’s compulsory to have buildings insurance. This is usually taken care of by your bank, and the premium is “hidden” in your monthly bond repayment. “However, you’re not obliged to accept your bank’s quote, and it’s possible you’ll get a cheaper premium from the insurer that covers the rest of your valuables. So do shop around,” Van Vuuren says.
Insure for replacement value, not market value A building’s insured value isn’t its market value.
Buildings insurance should cover what it would cost to rebuild your property from the foundations up, including your boundary walls, solar panels, swimming pool, taps and tiles. “It should even include what you would need to pay in a worst-case scenario, like demolition charges and waste removal,
and the professional and municipal fees that are part of the building process,” says Van Vuuren.
Review your home contents coverage
If you’ve built onto your home, and filled the new extension with brand-new furniture and appliances, this is a great time to update your home contents insurance as well. “As with buildings insurance, the key is to make sure you cover your
home contents for their current replacement value – don’t guess. And remember, insurers can only protect what they know about. It helps to keep the original receipts for items like big screen TVs, so that you can prove their value if you need to claim,” Van Vuuren advises. To help you assess your home contents correctly, some insurance companies have a handy example of a home contents inventory list for ease of reference.

Support for women in sectional title W
omen are reportedly the largest group of property buyers in South Africa today. They are, however, underrepresented and largely unacknowledged and unheard in the property sphere, says specialist sectional title attorney and BBM Law director Marina Constas.
“Women may be snapping up properties, but they’re still being left out in the cold when it comes to holding leadership positions and having their voices heard in the property sector. I am regularly consulted about conflicts in which women involved in different aspects of sectional title – from tenants and owners to trustees – are ignored in what is still a largely male-dominated industry,” Constas says. She has now founded a platform that aims to connect, support and develop women involved in the growing and dynamic sectional title sector. The vision of Women in Sectional Title (WiST) is to unite women from all areas of sectional title in one vibrant, collaborative community. WiST will enable women to network, learn, share knowledge, collaborate with and inspire each other, while gaining access to the resources they need to succeed in this field,” Constas says.
Who should join?
The Women in Sectional Title (WiST) platform is aimed at all women involved in sectional title, including homeowners and sectional title tenants, but also trustees, managing agents, real estate agents, property developers, property investors, legal professionals, students, and those aspiring to a career in sectional title.
Disputes are bound to arise when people are living in close proximity in a sectional title development. These disputes often involve female homeowners or tenants, says Constas. “I would urge these women to get well informed; and to arm themselves with the facts on the legislation that applies to sectional title and community schemes,” she says. They can do this through the WiST platform. It’s a place where they can get the information they need, share and resolve problems, and make connections with other women who can help to ensure that their voices are heard and their opinions considered.

“WiST will offer networking events, educational programmes, mentoring and advocacy for all women in sectional title,” she states. “The platform

eighbourhood and community retail centres effectively secured the national food distribution network during the height of the lockdown. It’s no surprise then that investors currently favour these “recession-resistant” properties. According to High Street Auctions director and lead auctioneer Joff van Reenen, property investment indices emerging from the Covid pandemic have only served to underscore the intrinsic long-term performance of the neighbourhood and community retail shopping precinct asset class. “Even before the pandemic, investor appetite for retail property on auction was largely impervious to broader negative economic sentiment. It’s a growing trend in recent years that’s kept pace with increased local consumer spending driven by the retail convenience factor,” he says.
However, looking only at the headline figures in isolation can be deceiving. At an aggregate level, annualised trading density growth has been mainly driven by the smaller retail formats which have benefitted as shoppers favour convenience centres for an increasing proportion of their spend. Excluding community and neighbourhood centres, drops the overall growth to below 1%. Annualised trading density growth by segment for March 2020, as measured by the MSCI South Africa Quarterly Retail Trading Density Index in the SAPOA report, shows that the greatest performer by far was neighbourhood retail at 14.9% followed by community

Q: What makes you an area specialist? A: I have a passion for the people and the properties in Heidelberg. My kids went to school here, I have a good network of family and friends and it’s a stable established community in one of South Africa’s most historic towns. Heidelberg is the ideal town for people working in Joburg who want a more relaxed family lifestyle and are willing to commute to work. Q: What does the area have to offer investors? A: All investors seek assets that produce the highest return on investment (ROI) with the lowest possible risk. Heidelberg offers various investment opportunities that meet these requirements – from self-storage units to the lower income rental townhouses. I deal with qualified, serious buyers and investors so that I don’t waste my seller’s time, the buyer’s or mine. This is a key difference between being a sales agent and a property professional. An article in Rapport published on 14 October 2018 projected population growth in Heidelberg to double in the next 10 years – which means a shortage of housing is imminent. The upside of this is excellent opportunities for developers and investors. Q: For a family looking to relocate, would you recommend this town? Why? A: Without a doubt I would recommend historic Heidelberg to any family planning a move. Nestled in the foothills of the Suikerbosrand Nature Reserve, Heidelberg Kloof Nature Estate is probably the
most exclusive estate in Gauteng with newly built homes priced from as little as R2,5m to as much as R35m. This estate is 144ha with only 22ha allocated to 120 stands. The remainder was left as natural habitat with impala, nyala and springbuck roaming freely. Heidelberg Central has the most beautiful historic houses. Typical of the Victorian era, these houses with old world charm, have been lovingly renovated to their current beautiful condition, with a typically old Transvaal look, wrap-around porches and patios with direct access to most rooms of the house. These properties are priced between R1,2m and R5m. Overkruin and Jordaan Park are also neighbourhoods where families can safely enjoy evening strolls. Heidelberg is a wonderful environment in which to raise children or spend one’s retirement.
Q: Generally, what do the area demographics look like? A: Currently, most of the property owners and tenants here are middle income earners, predominantly Afrikaans but showing a definite increase of other cultures. I find that most of my clients want a relaxed environment where afternoon walks in the neighbourhood are safe, families can ride their bicycles in the street, children can play and grow without being concerned for their safety. Heidelberg offers that and so much more. Q: As an area specialist, do you have any additional insights to add? A: I could talk on this topic for hours! Two years ago I had the privilege of doing The Real Estate Business Owner Development Programme (BODP) coached by the brothers Trevor and Malcolm Gaw – a mini-
MBA in real estate wealth creation. This, together with monthly one-onone coaching sessions with Trevor, has increased my confidence and competence. Consistent training, reading and upskilling are imperative in my profession. It enables me to adapt to changes creatively. I can now enjoy the sales mastery I earned through this coaching and personal commitment to my goals and wealth creation strategy. Q: What are the current market trends in Heidelberg? A: Just Property Heidelberg currently has 119 properties listed, ranging from R265,000 for a one-bedoom flat to R14,2m for a 566ha game farm. The majority of the registered market activity in Heidelberg for the past three months has been in the R800,000 to R1,5m bracket, accounting for nearly 32% of transfers in the past three months (Source: Lightstone town report).

DEALING WITH FIXTURES & FITTINGS IN A PROPERTY SALE AGREEMENT While sellers and purchasers sometimes take time to accurately list the items that are excluded or included when a property sale agreement is concluded, one often finds that this detail is lacking. It results in never-ending disputes, long after transfer. It is fairly easy to avoid most of these disagreements by keeping the general rule in mind. This provides that when a purchaser purchases a property, he or she is entitled to receive the land together with the permanent physical improvements thereon (such as newly erected carports) along with all items which are permanently attached to the land and/or buildings (such as large Jo-Jo tanks or decking over a lawn). When is something ‘permanently attached to a property? To answer this question, our law looks at the following:
1. What is the nature of the item and purpose for which it was attached?To be considered a permanent fixture, the item must be attached with the intention that it is permanent, to serve the land indefinitely; 2. If removal of the item/attachment will cause substantial damage to the land/structure, it points towards the conclusion that it is a permanent fixture; and 3. What was the intention of the owner when the item was attached? It is important that sellers prepare a list of items which are to be included in the sale, prior to listing the property with an estate agent. It is encouraged that this list form part of the seller’s mandate with the agent in order to allow the agent the opportunity to point out any items which are to be removed by the seller prior to registration of transfer. Alternatively, the list can be incorporated in the sale agreement in order to record the true intention of both parties. By way of an example: If X sells his property to Y and later decides that he will be removing the fixed chandelier in the living room as well as the fixed bathroom mirrors before he moves out, then absent any agreement in respect of these, Y can insist that each item either remain on the property or be replaced by an item of similar value. Should X refuse, Y can seek legal recourse against X. It is therefore important that a seller familiarises himself/herself with rights of purchasers in relation to the above and ensure that he or she only remove items which have been expressly excluded from the sale.
