A change of scenery We might not have as many outdoor options as they do in the Cape, but there are still some spots that we can head to in and around Joburg to enjoy nature while exercising under level 3 WORDS: SARAH MARJORIBANKS

M

any municipal nature reserves and parks are still closed during level 3 of the lockdown, but there are a few private farms and reserves that have resumed operation. While there are certain restrictions in place for both staff and visitor safety, it’s quite wonderful to get outside and enjoy big open spaces again. We’ve chosen three different spots that are open for exercise, including options for hiking, mountain biking and running.

Taroko Trails at the Modderfontein Nature Reserve

The beautiful Modderfontein Nature Reserve on the East Rand preserves indigenous flora and fauna and is a fantastic green space for Joburgers to escape to, right here in the city. The 275ha private park contains a number of dams, grassland and hills, and is also home to Taroko Trails. The freshly cut trails are ready to receive hikers, runners and cyclists. While the trails that are dedicated to runners and hikers aren’t open just yet as they’re still being cleared of overgrowth, there are plenty of other trails and jeep tracks to explore. Safety precautions: Taroko Trails isn’t open for social or group activities, and everybody entering the premises will need to wear a mask or buff, comply with hand sanitation practices and maintain social distancing. Good to know: The park will be open every day of the week for exercise, from 6am to 6pm, and there’s no need to book. Entrance fees are R50 per adult and R30 per child under 12 for cycling, and R30 for running, hiking or walking.

Hennops Trails

Head out to the mountains and enjoy one of the hiking trails on offer at Hennops Trails, just 30km from Fourways and Pretoria. The trails set off from the main camp, meander along the Hennops River and head off into the mountains. The Krokodilberg trail is 10km long and one should be reasonably fit to tackle it as the surface is uneven in certain sections and there are steep climbs. However, the Zebra, Dassie and River hikes are easy and manageable for all fitness levels. Safety precautions: All visitors must adhere to level 3 restrictions and are not allowed to enter if they don’t have a mask. All of the Hennops Trail staff have masks, and hand and surface sanitisers are available at reception

and the toilet facilities. All facilities are sanitised at regular intervals, but the picnic and pool areas remain closed. Guards are on patrol on the trails to ensure the safety of visitors. Good to know: The property is open seven days a week and booking isn’t necessary. The entrance fee is R80 per adult and R40 per child.

Northern Farm

Mountain bikers are welcome to explore the 2,500ha Northern Farm Nature Reserve, also known as the Diepsloot Nature Reserve. The nonprofit park is run by volunteers, and while it feels a world away from the hubbub of the city, it’s just 10 minutes away from Fourways. There are a number of cycling trails of varying lengths for different skill levels, each tackling a mix of terrain. However, no group rides are allowed at the moment due to level 3 restrictions. With grasslands and woodlands as well as several dams, the farm is also home to about 270 different bird species, so it’s naturally a popular spot with twitchers. Safety precautions: Temperatures will be taken at the gate and visitors exhibiting Covid-19 symptoms will be turned away. No more than two people per vehicle are allowed entry and the clubhouse and braai facilities on the property remain closed. Masks are mandatory.

TAROKO TRAILS

Good to know: Entry is only open to visitors who’ve booked and paid for their visit online, and limited numbers are allowed per three-hour slot. Northern Farm is open on Saturdays, Sundays and public holidays, from 7am to 5pm, and entry is R60 per person.

Traditional Austrian beef goulash soup Ingredients • 3 tablespoons olive oil • 3 medium onions, chopped • 1 teaspoon garlic, finely chopped • 1 tablespoon tomato paste

1 tablespoon paprika ½ teaspoon ground cumin ½ teaspoon marjoram ½ teaspoon thyme ½ teaspoon cayenne pepper (optional) 250g boneless, cubed beef ¼ cup red wine 4 cups warm beef stock 3 medium potatoes, peeled and diced Salt and pepper to taste

To serve • Sour cream • Chopped chives • Crusty bread Here’s how 1. Heat the oil in a large, heavy based pot over medium heat. Add the onions and garlic and sauté until tender for 8 to 10 minutes. 2. Stir in the tomato paste, paprika, cumin, marjoram, thyme and cayenne pepper. Add the beef and fry for five minutes. 3. Stir in the red wine and simmer for five minutes. Add the stock, cover and cook for 40 minutes. 4. Add the potatoes and simmer for a further 30 minutes until the potatoes and meat are fork-tender. 5. Season the soup to taste, ladle into bowls and top each portion with a dollop of sour cream. Sprinkle some chives on top and serve with freshly baked bread.

Rental market calls for progressive thinking With many people struggling to make ends meet and job security under threat, renting may prove more popular than buying, while some tenants will downgrade. This, among other things, may cause an upswing in the rental market. WORDS: MARANA BRAND

W

ith more tenants struggling to pay their monthly rent, changes are undoubtedly on the cards for the rental market. Samuel Seeff, chairman, Seeff property group, expects to see a great deal of movement in the rental market. “Many tenants will look to downgrade, and more people will move into the rental market until financial stability returns and the economy improves. While rental rates will come under pressure as a result of the economic decline, we do expect the market to bounce back quite quickly,” he says. With countless citizens facing reduced salaries or job losses due to the lockdown, it’s no surprise that more and more tenants are having trouble paying their full rent, says Jacqui Savage, national rentals manager, Rawson Property Group.

According to her, the incidence of tenants defaulting has been climbing since lockdown began, and could continue to be an issue as the economy struggles to recover. During March, just over 20% of tenants were in arrears, increasing to almost 24% in April. PayProp head of data and analytics Johette Smuts says that the average size of arrears jumped from 78% of monthly rent in March to a massive 84% in April. “While we have already seen an increase in both the percentage of tenants in arrears, and arrears as a percentage of rent in April, we expect May and June to be even worse.” Landlords, meanwhile, will be looking hard at their cash flow projections wondering how they’ll meet repayments to banks and

other lenders, says Gary Palmer, CEO, Paragon Lending Solutions. This situation will force certain trends in the rental market to emerge, which will remain for some time to come.

Flexible landlords One of these trends is landlords embracing progressive payment plans. Palmer says a good working relationship between owner and tenant is valuable, especially when times are tough, and explains four ways in which landlords can help tenants weather the storm: 1. Either writing off the full rental for one or two months, or allowing tenants to just pay 50% for a number of months. These losses are

then reported in their tax returns. 2. Property owners capitalising the payment holiday into the lease. If you follow this route it’s best to include addendums into the lease, explaining the details. 3. Passing on the savings property owners have seen as a result of the interest rate cuts. While it’s not a huge amount, tenants will appreciate even this small saving. 4. Allowing tenants who can’t pay rent to take a break, with the understanding that they’ll then forfeit their deposit. One option landlords shouldn’t consider when tenants can’t pay, is to set eviction procedures in motion – at least not for now. “Persons may not be evicted from their home during alert level 3, except if the court decides that it’s just and equitable to do so – which is not an easy hurdle to overcome,” says attorney Marlon Shevelew, director, Marlon Shevelew and Associates.

Legal challenges in and of themselves are without a doubt a constructive and essential part of a constitutional democracy, but they do mean that nothing is truly final. Tenants must play it straight

However, it’s important that tenants know what the impact of each option will be, says Palmer. “Simply jumping at a payment holiday, for instance, may come with some unattractive longterm consequences. Interest will still be accruing and you could end up with a nasty surprise in a year’s time. Do the math before you sign anything.” Tenants shouldn’t assume they’ll be granted payment breaks. “They should have all the necessary documentation at hand when going to their landlord. It also may be worth having your credit record handy to show a record of good payment behaviour,” Palmer advises.

Other trends Another trend in the lockdown rental market is Airbnbs converting to long-term lets, because of the tourism sector’s shutdown and because – like all short-term rentals – it’s still prohibited under alert level 3. This way, however, there’s more competition with others already in the market, says Savage. In some cases, Airbnb owners are even removing the furniture from their properties, as unfurnished apartments remain the most popular choice for tenants for reasons of affordability. Social distancing is likely to stay with us beyond lockdown. That’s why top-quality rental agents have been turning to cutting-edge technology like virtual valuations, 3D virtual tours and real-time virtual showhouses to deliver the same level of service while minimising face-to-face contact. This also ensures that only serious, qualified tenants make it across a rental property’s doorstep, Savage says.

Legal difficulties For agents, tenants and landlords, navigating the rental arena during lockdown, irrespective of the alert level, can be fraught with legal difficulties, says Shevelew. If, for instance, a tenant should refuse to

allow estate agents to show homes to prospective tenants or buyers because of fear of exposure to Covid-19, this will amount to a breach of the terms of the lease in most instances. “This is a difficulty which must be addressed by estate agents and landlords alike,” says Shevelew. “In the normal course, one would be able to cancel the lease if the tenant refused to comply, or sue to compel the tenant to comply, and claim damages if any are suffered.” Seeking legal recourse in such a case is, however, not straightforward considering the way that the lockdown regulations have affected the courts. “Each court has its own practice directives and in some instances only selected cases may be placed on the roll,” he says.

More confusion The uniformity of the alert levels we have enjoyed thus far may soon be a thing of the past, Shevelew says. “Alert level 3 regulations make provision for declaring certain areas hotspots that may become subject to more stringent regulations. This means that the situation in certain areas could change on a dime, with different regulations applicable in different locations. Keeping track of what is permitted where, will become increasingly difficult.” He adds that, aside from the uncertainty caused by vague wording of regulations, or inconsistent application by the police, “there are several ongoing legal challenges to the regulations, and there are bound to be more in due course”. Each legal challenge brings with it the possibility that, just as everyone has figured out how the regulations as they currently have been gazetted work, they will be set aside or changed by a court. Just this past Tuesday, the Pretoria High Court declared the regulations promulgated in respect of alert levels 3 and 4 unconstitutional and invalid. “Legal challenges in and of themselves are without a doubt a constructive and essential part of a constitutional democracy, but they do mean that nothing is truly final. This just adds to the uncertainty which must be negotiated in the coming time,” says Shevelew.

The who and how

Under level 3 regulations, most estate agents are permitted to operate normally since 1 June, except for short-term home-sharing, letting, leasing and rental for leisure purposes, explains Lavashnee Mandry, senior associate: property department, Adams and Adams. “As estate agents are a vital link in property transactions, this news will

be welcomed by homeowners who want to sell their properties, as well as buyers, tenants and other industry players such as banks, mortgage originators and attorneys,” she says.

Safety first

Businesses that are permitted to operate under alert level 3 are, however, subject to strict compliance with health protocols and social distancing measures. These include mandatory wearing of face masks, using hand sanitisers, daily screening of employees etc. The return to work should be phased in to put in place these measures, Mandry says. Tony Clarke, MD, Rawson Property Group, says the whole industry has been working around the clock to create the safest possible plan of action, “to allow people to put a roof over their heads without risking their health and safety”. Goslett reiterates the necessity to adhere to prescribed safety protocols. “We need to make sure we capitalise on this opportunity safely. It’s imperative

that protocols are followed strictly to ensure the safety of our clients, our colleagues and our agents,” he says. Industry body Rebosa (Real Estate Business Owners of South Africa) prepared a safety protocol for property professionals and advises, among other things, that the viewing of show houses should only be allowed by appointment and should be limited to one or two sellers. According to Carl Coetzee, CEO, BetterBond, putting all the necessary health and safety measures in place will not only provide peace of mind to all concerned, “but will also reinstate trust in our industry, and demonstrate our commitment to making a meaningful and constructive contribution to restarting the economy”.

Many to benefit

It’s extremely positive that the real estate industry is to be fully operational again, as this sector makes a meaningful contribution to the country’s economy, taxes and employment, says Andrew Golding, chief executive, Pam Golding Property group. Many people aspire to own a home, as ownership provides security of tenure and a nest egg for the future. “In addition, estate agents are largely dependent on commission-based income for their survival, while a host of other related sectors including financial institutions, mortgage originators, conveyancers, construction and engineering companies, among others, directly and indirectly derive income and employment,” he says. Coetzee adds that the opening of the property sector is particularly good news for buyers, and investors too, as the prevailing market conditions are geared to favour residential property buyers. “With interest rates at a 50-year low, and the threshold on transfer duty raised to R1m earlier this year, upfront expenses when purchasing a property are lower, making it a buyer’s market for sure.”

Virtual viewings are here to stay

In terms of viewings of homes for sale, the Pam Golding Property group will continue to make use of high-quality virtual tours, iShow days, as well as other technological innovations, which they’ve found successful during lockdown. “However, where a buyer wants to physically view the property, we’ll make the necessary arrangements and follow the strict protocol guidelines as set out by the authorities,” Golding says.

Rawson Properties, like many others, have also been fine-tuning their suite of digital tools to facilitate more comprehensive virtual services than ever before. “These include virtual valuations, virtual show houses and live virtual tours, all of which will continue to be leveraged to minimise human contact when the industry ramps back up to full operations,” says Clarke.

Tribute to sector lobbyists

Industry leaders in the real estate sector lobbied on behalf of the thousands of property professionals unable to earn an income from the sale of property to have the entire value chain of real estate services operating under level 3. These include the National Property Practitioners Council (NPPC), Samuel Seeff (Seeff ), Tony Clarke (Rawson), Adrian Goslett (RE/MAX), Richard Gray (Harcourts), Herschel Jawitz (Jawitz Properties), Rebosa, and the Estate Agency Affairs Board (EAAB). The efforts by the real estate sector were also supported by industry representative bodies from the legal profession, valuators, mortgage brokers and the banking sector who all made submissions to government. However, according to Clarke, the discussions with government are far from over. “Our goal is to have the industry formally reclassified as a level 4 service to ensure continuity, should hotspot flare-ups cause a return to stricter lockdowns. We don’t want to end up in a situation where new leases or sales are paused halfway through the process because we went back to level 4 lockdown,” he says.

There’s a trend towards incorporating a more diverse offering of homes in estates – including more affordable sectional title properties and retirement villages. This ensures that estate living caters to a larger market of potential homeowners.”

He says the lack of congestion on an estate has great appeal for those wanting to escape from high-density, congested city living, where some have been cooped up in tiny apartments.

“Many estates are increasingly selfsufficient and completely or partly off the grid in terms of water and energy, making the decision to live in a secure lifestyle estate wise in terms of cost and convenience.”

New World Wealth estimates that over 40% of South African HNWIs (high net worth individuals) live or have homes on residential estates, says Sandra Gordon, senior research analyst, Pam Golding Properties. “Recent trends in this sector of the market include a move towards lifestyle and retirement estates, rather than golf estates, while parkland estates with parks, birdlife, walking and cycling trails are becoming more popular. Most developers are now creating small neighbourhoods within estates, allowing for more open spaces and parklands, unlike the old model where homes were spaced evenly around the entire property. In addition, many estates have started to add luxury apartments to their offerings, whereas previously, most estates focussed only on freehold houses.” “Even as house prices – particularly at the upper end – slow in the face of a struggling economy, which had slipped into recession even before Covid-19, the percentage of estate homes sold in the upper price band has continued to rise, albeit relatively slowly. It appears likely that the arrival of Covid-19 and the persistence of infection fears will reinforce the trend by underlining the appeal of estate living,” Gordon says.
