ituated in the Baakens Valley at the bottom of Target Kloof, this hidden gem is surrounded by nature, adding much of the appeal of living in this verdant part of Port Elizabeth. Ancient cliffs, the Baakens River and its tributaries, Settlers Park Nature Reserve which flanks Essexvale on one side, and Wellington Park overlooking it towards the back, are the main natural elements that contribute to making life in this area special. Essexvale comprises three streets at best and residents like to quip they live in Port Elizabeth’s tiniest suburb! Though lying alongside busy Target Kloof Road, Essexvale is peaceful and quiet thanks to its natural buffers. Essexvale’s location at the bottom of Target Kloof means you can effortlessly reach Walmer going one way, and Five Ways/Cape Road/Central when heading up the kloof in the opposite direction. Five Ways is an important crossing from which the city’s main
freeways are easily accessed. The first plots were laid out from the mid-1920s and houses built from then on. Some still have original 1930s, ’40s and ’50s features; one or two others were designed by noted architects towards the end of the 1960s and beyond. Johan Gerryts and his partner of 22 years Penny Sawyer, have lived in Chelmsford Avenue since 2001. “It was overgrown, leafy, private and very central, which we loved, and the house was on the Baakens River, which made for a unique location that appealed to us and our style of living,” Johan says. “Essexvale and the street names Chelmsford and Colchester, are very English, but I’m not sure why and how these were named as such. What we enjoy most is that you can sit on the stoep and not know you are in the middle of a city.” Their garden is much bigger than average, but they keep it simple and indigenous to the local vegetation. Essexvale may not appeal to everyone, Johan says. “Although we believe it’s the best place in the world to live, there are some disadvantages – it’s cold in winter, hot in summer, we have traffic on Target Kloof and occasional flooding of the bridge in Chelmsford Avenue. “We also have dassies, water leguaans, snakes, otters and other wildlife. All these make it special for us, but perhaps not for everyone. Many people do not even know about our little neighbourhood’s existence – and that’s fine too!”
Property Essexvale is made up of free-standing homes, with no townhouses or flats. In terms of municipal demarcation it falls under Mill Park, which overlooks it from the opposite side of Target Kloof. Walmer is its other neighbour. However, Essexvale prices are more reasonable than what you would pay in Mill Park. Johan and Penny bought before

PE’s “property boom” and values have gone up considerably since. They paid just R359,000 in 2001, spent a further R300,000 and their house is now worth about R2,8m. Atlas and ADT maintain a security presence and there’s a very active WhatsApp group informing residents about everything from security alerts to otter sightings!
Schools Essexvale has no schools, but is very close to some of PE’s top schools, among them Clarendon Park Primary, Grey Primary and High School for boys, and St George’s Preparatory and College. Other schools under 4km away are Settlers Park Primary, Greenwood Primary, DF Malherbe High, Theodor Herzl Primary and High, Victoria Park High and the PE Montessori School.
Explore Settlers Park is home to indigenous plant, bird and animal species. Start at the bottom of Settlers Park, accessed from Chelmsford Avenue, then make your way right to the top. Look out for Boer War trenches built as a preventative measure even though PE never went on to see Boer War action. When walking or cycling here it’s best to make up a group for safety. Settlers Park and the valley are also excellent for mountain biking, with groups heading through several times a week. The Baakens Valley is a birdwatchers’ dream. Residents often see loeries, guinea fowl, hamerkops, and even raptors and owls in their gardens and in the reserve. For the more culturally inclined, Art on Target, at 2 Target Kloof Road, is the home, studio and art school of artist Bretten-Anne Moolman. It’s an important component of PE’s annual Arts Meander, and hosts regular musical gatherings and exhibitions.

The nearest is Sixth Avenue Shopping Centre in Walmer. • Head up Target Kloof and you’ll reach the Five Ways Spar complex on Cape Road. • Main Road, Walmer, is another bustling area and has several standout shops, including Mastertons coffee specialists and The Old Curiosity Shop for antiques. Grow and multiply You can make your investment work smartly by remortgaging cleverly or growing your property portfolio by using only one bond. Here’s how. WORDS: MIRIAM MANNAK

esidential property is regarded as the Holy Grail of investment. But how can buyers make their purchase work for them financially to make the most of their investment?

Clever bond financing
Investors can eventually buy two low- to medium-cost properties with one bond while keeping repayments low and paying off the mortgage quicker, says Just Property Invest sales manager Pieter Piek. He says a R1m flexi or access bond typically involves repayments of about R9,800 a month for 20 years. However, a paying tenant in your property can change this. If their rental income covers the bond repayments, you could increase your payments by R5,000. “The bond will be paid off in less than half the time,” says Piek. Because flexi or access bonds allow you to withdraw money, you could take out the excess after five years to buy a second property at R500,000 without a new bond. Piek says this unit should achieve a rental income of R4,500, to be put towards your original bond. “This means you now have two properties paying off one bond and you still have 15 years left in which to pay it off.”
Save, save, save
Put bonuses, 13th cheques, tax rebates and other windfalls into your bond.
“This allows you to pay back more than just your monthly repayment rate,” says Mike Greeff, CEO, Greeff Christie’s International Real Estate in SA. “The increased payment paired with any potential cash injections could cut your bond period by up to five years.” Defaulting on payments negatively impacts on your credit score and opens the door to added interest and potential charges on returned debits, Greeff warns.
Remortgage, don’t sell
While it may seem attractive to sell a home that is appreciating fast, capital gains tax payments on the profit need to be considered. Remortgaging your home or using your property’s higher value to obtain a larger mortgage, may be a better alternative. “This is called releasing equity,” says IP Global head of Africa George Radford. “This lump sum can be used to diversify a portfolio or invest in new properties in different markets to mitigate risk – each with their own mortgage.”
Beware of a bargain
A bargain may become a rip-off due to unforeseen renovation bills, which can impact on bond repayments. Piek’s advice is to buy newer units. “You might pay a little more but you’re getting new geysers and know that the plumbing and wiring have been done recently.”
QUESTIONS TO ASK BEFORE SIGNING • Buying property to let requires an investor’s mindset free of emotion. The perfect investment location is an area with high rental demand and may not be your own preferred location. • The low- to mid-end market has a higher demand for rentals than the upper end. Entry-level residential properties almost always appreciate in value faster. • Set up an emergency fund for unexpected costs not covered by insurance. • When purchasing to let, calculate the potential yield of the property (the annual rental income minus expenses, divided by the price of the property) and compare it to the yield of other rental properties in the area. • Do a comparative marketing analysis of the area. Make sure your rental income covers your monthly repayments and that you can afford potential shortfalls. • Find an experienced management agent to find the right property, an approved tenant, manage rent collections, and take on maintenance issues. • Be aware of all legal aspects and capital tax implications.

With prices for a studio apartment starting from only R650,000 including transfer costs, the developers aim to address the ever-increasing shortage of affordable residential property developments close to work, schools, transport nodes, shopping centres and other amenities in and around the Cape Peninsula.

A
lthough improving, the property market remains largely favourable for buyers while sellers have to compete for the limited pool of buyers in a market which is generally still overstocked. While pricing is important in any market, it’s especially so in this market, says Samuel Seeff, chairman, Seeff Property Group. He says any property sale involves competing interests. Firstly, that of the seller who wants to achieve the highest possible price and, secondly, the buyer who wants to pay the lowest possible price. Since the listing process starts with the asking price, the seller will
often think that setting the price at the highest possible level will get you better offers closer to the desired price. In reality, says Seeff, there’s simply no evidence that shows a higher asking price will result in a higher selling price and actually has the opposite effect by putting buyers off from the outset. There’s a psychology to pricing and the consumer’s mindset about price can make or break a sale. A New York Times report states that “in a market where buyers and sellers circle one another warily, each certain that he or she is being taken advantage of, no matter what the conclusion of a deal, the asking price of
a property is rarely a straightforward reflection of comparable values”. It says that sellers often start at a point which equates to “wishful thinking” and even when the seller and agent finally reach a point of consensus, it’s often still slightly above the ideal price level. Buyers on the other hand, simply love a bargain and will always look to deconstruct the price, not just in terms of how it represents fair value, but they’ll actively look for vulnerabilities. In this climate, says Seeff, the role of an experienced local area agent becomes pivotal as they know the area, what’s on the market and what has sold and for how much. With their eye on the market and their nose to the ground, such an agent will offer guidance to ensure that your property is not standing out like a sore thumb with an outof-kilter price, but that it’s also not competing at the same price level as every other property on the market. Setting the price at the right level can mean the difference between getting a quick offer and drawing little interest which may result in having to drop your price to get an offer. Seeff says there are many pricing myths which can stand in the way of a successful sale and highlights six of the most common misconceptions.

Nope, Seeff says this is a weak strategy which will have the opposite effect. Today’s buyers are informed and aware of market conditions and prices. They’ll simply overlook an overpriced property in favour of those which are correctly priced. This could mean that you may have to make price cuts which in turn could attract bargain hunters rather than serious offers.

Research has shown that the first offer is often the best as it’s based on the value that buyers attach to the property. Sellers tend to be sceptical at first, thinking that the buyer is trying to make a quick bargain buy. If it’s a fair offer, you should always consider it. There are no guarantees that another offer might come along, especially in this market.

Renovations and improvements will get a higher price
Renovations do not equal a higher price. While some improvement of an older property may well be advised, you should take care not to overspend and overcapitalise. Always consult a local agent and do a “cost versus value” analysis before embarking on renovations.

Receiving an offer soon after listing means that the property is on the market at the right price to attract buyer interest. If you appoint a credible agent, they will not risk their reputation on giving you incorrect pricing advice.

With so much written about the market, often by people who are not local experts, it’s easy for sellers to get caught up in the hype of rising prices. Many sellers also look at the property portals which are generally overpriced. It’s best to trust your agent who will use local area sales to advise on the appropriate asking price.

While no seller or agent would want to be in this position, there may come a time when it seems that the market is just not reacting to a particular asking price. In such an instance, if you need to, or are motivated to sell, your agent may advise a price drop. Remember, time is money and the longer your property is on the market, the more it costs in bond repayments, utility costs and so on. Lowering the price could even result in a better offer.

SMALL CLAIMS COURT
The Small Claims Court (“SCC”) was established to afford members of the public a more cost effective means of accessing our courts in pursuit of justice. In essence, the SCC has been designed for members of the public who either do not have the means to sustain protracted and expensive litigation processes or whose claims are not large enough to justify the cost associated with pursuing those claims through the “usual” courts. Access to justice through the SCC is however subject to certain limitations. The first of the limitations (as the name suggests) relates to the extent of the claim which an SCC may entertain. In this regard the maximum sum which may be claimed in proceedings before an SCC was increased from R15 000,00 to R20 000,00 on 1 April 2019. Claims against municipalities and state organs are specifically excluded from the jurisdiction of an SCC as well as claims or disputes related to marriages and Wills. The mechanisms of the SCC are only available to natural persons. In other words, those mechanisms are not available to companies. Other than the aforementioned limitations any claim which exists between two parties (natural persons) may be brought before an SCC. While legal representation is not allowed when presenting your case before an SCC you are quite entitled to seek legal advice from an attorney in advance of either lodging a claim with an SCC or in advance of a hearing before an SCC. HOW THE SMALL CLAIMS COURT WORKS: Anyone who has a claim of R20 000,00 or less can approach an SCC for relief. Should your claim exceed the jurisdiction of the SCC, you have the option of abandoning part of your claim to bring it in line with the SCC’s monetary jurisdiction. The SCC allows both parties to a dispute the opportunity to present their case to an SCC in person without the need for an attorney. The Commissioner (who presides over the proceedings before an SCC) will then examine the evidence presented and may pose questions to the parties to facilitate him/her making a fair decision. COMMENCEMENT: To proceed with a claim in the SCC, the person seeking to make a claim (“claimant”) will be required to address a letter of demand to the other party (“defendant”), which may be served on the defendant by the claimant via registered mail, alternatively with the assistance of the clerk of the SCC. Once a period of 14 days has lapsed from the day on which the letter of demand was delivered and should the claim not have been
satisfied within such period, the Clerk of the SCC will issue a Summons and will assist and guide the claimant on how the Summons should be served upon the defendant through the Sheriff’s offices and in so doing compel the defendant to come to the SCC on the date stipulated in the Summons. HEARING: The commissioner is normally a practicing attorney or advocate who offers their services to the state, free of charge for the advancement of justice. The parties to a dispute are required to treat the commissioner with respect at all times and to address him/her as “Commissioner”. Bear in mind that the Commissioner will, at first instance, look at the letter of demand to get a better understanding and overview of the matter. The letter of demand therefore needs to be accurate and contain sufficient detail to allow the Commissioner to understand your cause of action. The inquiry will proceed with the claimant’s evidence and witnesses first, where after the defendant’s evidence and witnesses will follow. Each party will have an opportunity to address the commissioner and when they do, the other party may not object or interrupt the other. Should either party wish to question the other party’s witnesses, permission to do so must be requested from the Commissioner. JUDGMENT: At the end of the case, the commissioner will give his/her judgment. However, should the commissioner request that further research into the matter needs to be conducted to allow himself/herself to deliver a fair judgment, the commissioner will reserve such judgment. If the claimant is successful, he/she is normally granted either whole or part of the claim, interest at the legal rate (currently 9% per annum) on the debt outstanding calculated from the date of demand and costs of suit. Should the defendant prove successful then the claimant’s claim will be dismissed. The costs of suit refers to the fees incurred in the process, such as the registered postage costs and the sheriff’s fees for the service rendered by him/her to the claimant. Judgment must be complied with within 10 days of the judgment having been delivered or alternative arrangements need to be made to settle the claim. Should the unsuccessful party fail to comply with the judgment given, the successful party will have to approach the clerk of the SCC, who will assist to have the matter transferred to the Magistrates Court. The judgment will, once transferred, be enforced in the Magistrates Court through the normal execution process provided for in those courts. REVIEW: The Commissioner’s ruling is final, and no appeal lies against it. Both parties are obligated to abide by the commissioners ruling. The Judgment cannot be challenged unless there is a basis for review. In an instance where you would like to take the matter on review, the proceedings may be referred to the High Court for the purposes of review. There are three grounds upon which you may bring a review before the High Court, namely that the Court did not have the necessary jurisdiction to adjudicate the claim, the commissioner had an interest in the matter, was corrupted or biased and that there was a gross irregularity in the proceedings. You will require the assistance of an attorney in order to take the matter on review. ASSISTANCE: The outcome of a case is often a reflection of how well it was prepared and presented before the SCC, as much as it is a reflection of the merits of the case itself. It may therefor be worthwhile considering the help and guidance of an attorney beforehand. There are several advantages to having the assistance of an attorney. Consultations with a lawyer might help assess the strength of a particular case and highlight weaknesses that might not have been apparent to a lay person and may in turn increase the possibility of a successful claim or defence.
