obody could have foreseen the impact of the Covid-19 outbreak on life in general, let alone on real estate. However, the digitalfirst property company PropertyFox anticipated a need for continued evolution of on-demand experiences in 2020 – and it was right on the money. With more millennials entering the market for homes, PropertyFox predicted that real estate companies would use big data and machine learning in smarter ways to make consumer experiences even more seamless. “At the end of a decade of property industry disruption, we saw homes sold online for the first time, with low commissions shaking up traditional notions of how property should be bought and sold,” says PropertyFox CEO Crispin Inglis. As investors are fast getting used to the idea of a purely digital purchasing experience, buying off plan – with its bespoke offerings and benefits – is suddenly looking really attractive.

Making sense The South African Reserve Bank’s latest reduction of the repo rate in May saw the prime lending rate fall from 7.75% to 7.25%. Buying off plan is a great option whether you are buying to let or to live in the property yourself. Sectional title units are the most common type of real estate sold this way, with many developers offering a choice of layout or floor plan for units of various sizes within the same complex.

Reasons to buy

First-timers

If you purchase off plan from a developer, the transaction does not incur transfer duty. It’s also viewed as a good investment for rental returns. Time is on your side too, says Kent Gush of Kent Gush Properties. “When you’re investing in something like Ellipse Waterfall, a luxury high-rise tower in Waterfall City, Midrand, there’s as much as a two to two-and-a-half year wait from when you buy the apartment until the date you take delivery of it. You’re enjoying the capital growth for that period, which is further enhanced as the precinct itself develops. “People who bought in the beginning are already seeing 10% to15% growth in value. In addition, if a buyer puts down a 10% deposit at the current interest rate of 7.25%, they’re almost cash neutral from day one,” he says.

According to Steyn City sales manager Lambert Bezuidenhout, purchasing off plan has long been touted as the ideal way for investors or first-time buyers to purchase property, as their payment commitments start only on delivery. This can be up to 12 or 18 months from the date of purchase – sometimes even longer. “The price of these units typically includes VAT. That means the purchaser can finance the tax portion of the purchase price rather than paying transfer duties upfront in cash on private sales or resales, which puts a higher burden on cash availability for the buyer,” Bezuidenhout says. “Off-plan purchasers must realise that their property is forward priced to allow for financing and holding costs during the Tricolt’s Ellipse Waterfall in Waterfall City, Midrand construction period.”

Stick to the plan After spending months at home, homeowners may well be considering some additions or renovations to their property, for which planning approval will be necessary WORDS: SUPPLIED

efore going ahead with any home projects to make their lives more comfortable, homeowners should follow the correct procedures and obtain the necessary planning approval to avoid running into issues later.

Why

Having building plans approved is a requirement of the National Building Regulations and Buildings Act of South Africa. Regulating additions and renovations is necessary to ensure that all buildings are conducive to occupants’ health and safety. Before providing home finance, all financial institutions require up-to-date and approved building plans. These plans are also required by the local municipality before issuing a rates clearance certificate required for selling a home. “In short, if a homeowner fails to obtain planning approval, they’ll run into problems when they later decide to sell, and may even be ordered to tear down renovations if they fail to meet the relevant criteria for gaining planning approval. It’s always advisable to obtain the necessary approval before going ahead with any renovations or additions,” says

Adrian Goslett, regional director and CEO, RE/MAX of Southern Africa.

How

For those who are unsure of how to go about this, real estate expert Dietlyn Bekker, RE/MAX Panache explains that any new buildings, alterations, or additions to buildings, boundary walls, swimming pools, garages, Wendy houses and toolsheds, to name a few, will need planning approval. “I cannot stress enough the importance of submitting plans for any changes to internal walls. If you’re changing the use of a property from residential to commercial, for example, you will also be required to submit a plan.”

What

Before you go ahead with submitting your plans, Bekker explains, you first need to check that what you plan to do meets town planning guidelines and requirements. If you used a professional architect, they’ll be able to complete this process for you. “When submitting the plans, homeowners usually require a copy of their title deed and four copies of the proposed plans, a signed application form which is available from the municipality, and proof of payment

of the submission fee. Homeowners should note that only registered architectural professionals are able to draw and submit plans,” Bekker says.

When

“After the plans have been submitted, they’re passed through various departments, including the fire department and health department. The homeowner is then notified as to whether the plans have been approved or rejected. “Should they be rejected, the homeowner is notified as to why and is given a chance to rectify them. Should the rectifications be submitted within a year of the first rejection, there’s usually no additional fee charged,” Bekker says. Though the local authorities endeavour to approve or reject plans within 30 days from submission, the process sometimes does take longer. When an application is approved, the homeowner is notified and provided with a stamped copy of the plan. Only once in possession of this stamped copy, is the homeowner allowed to start

building. A building inspector should be called to inspect the progress of the build, either from the start or on completion, so that a certificate can be issued to confirm that the building is as per the approved plan, says Bekker.

Who

Adding onto or renovating your home can add immense value if done correctly. “For those contemplating whether to add on or buy new, I would recommend that they speak to a local real estate advisor to find out what value the addition can add to their home versus what they can afford to purchase within their budget. This will make it much easier to decide on a way forward,” Goslett concludes. According to Grant Gavin, broker/ owner, RE/MAX Panache, there are various complications that have the potential to delay a property transaction. “An experienced property practitioner is therefore worth their weight in gold for ensuring that these complications are identified and dealt with as early as possible in the transaction.”

Breaking the bond One of the tricky issues to be resolved during a divorce could be when the couple owns a property jointly and even more so when a mortgage bond is registered in both their names WORDS: MARANA BRAND

etermining how to deal with joint ownership and joint liability under a mortgage bond when a couple unties the knot, is largely dependent on the provisions of the divorce order, the settlement agreement and whether the couple was married in or out of community of property, says Anke Olivier-Kok, associate attorney, Adams and Adams. She explains what this entails:

In community of property Each spouse is entitled to one half share in the property. Typically, however, one of the parties will be awarded full ownership of the entire property and may then apply to the Registrar of Deeds to endorse the existing title deed so he or she is now the sole owner. No formal transfer is prescribed.

Out of community of property

By virtue of their separate estates, the parties will already be co-owners of the property. Once divorced, former spouses, however, rarely choose to remain co-owners and will typically agree that one party acquire the other party’s share and become sole owner. A formal deed of transfer is necessary in this case, and not merely an application to the Registrar of Deeds.

The process

Whomever is awarded the property (Party X) must have it transferred into his or her name, says Maryna Botha, director, STBB law firm.

• “The fact that the divorce agreement stipulates that the property is awarded to Party X doesn’t mean that ownership has passed to X,” she says. X must appoint a conveyancing attorney to attend to the registration of transfer in the deeds office. • The conveyancer will need a copy of the divorce agreement and divorce order, among other things. The “usual” transfer process is then followed, which includes obtaining a municipal clearance and levy clearance (if the property is a sectional title unit) or homeowners’ association clearance (if the property is in a homeowners’ estate). • A transfer duty receipt or exemption must also be obtained. If the property is acquired by virtue of a divorce order, no transfer duty applies, but only where the spouse held sole ownership in his or her personal capacity. Where a property was registered in the name of a trust, transfer duty is payable, Botha says. • Party X will also have to pay the conveyancing fees for the transaction, unless the divorce agreement states otherwise.

The bond...

“When there’s a pre-existing mortgage bond over the property, both of the former spouses are co-mortgagors and equally liable to the bank for the full debt amount,” Olivier-Kok says. The parties will have the following options: • If the loan amount has been paid up, the bond can be cancelled.

• If the bond cannot be cancelled because there’s still debt under the existing home loan, the party acquiring full ownership will need to apply for a new home loan, taking full liability for the entire remaining debt amount on the bond. • The bank has to be satisfied that its client can afford the sole financial responsibility of repaying the bond, before removing the other party’s name and liability from the mortgage bond.

Liability issues

“Ideally, parties should deal with the liability for the current bond in the divorce agreement, so that this doesn’t hinder the transfer of ownership,” says Botha. Also find out what the lender’s lending criteria is before signing the settlement agreement as it may have changed since the bond was first registered. The bank may not automatically agree for one of the parties to take over the bond, in

which case he or she can also apply for a new bond at another institution.

Compensation

In practice and irrespective of having been married in or out of community of property, the party who has acquired the other party’s share will typically need to compensate that party for his or her share. Often the acquiring party will apply for an additional loan to ‘buy out’ the other. “The bank will usually require that a second mortgage bond be registered over the property to secure the further debt,” OlivierKok explains. Affordability will once again have to be established.

Cohabitation agreement

When deciding to purchase a property as an unmarried couple, putting in place a cohabitation agreement while things are rosy is important, says Kagiso Mahlangu, director, CMS RM Partners.

“Among other things, this type of agreement can ensure that both parties’ claims on the property are noted and can even deal with what should happen to the property when the relationship ends.” If there’s no cohabitation agreement, it can have great financial implications especially if parties can’t decide what should happen to a jointly-owned property, says Mahlangu. “The worst case scenario is where a couple is separated yet forced to remain coowners of a property because one of them refuses to sell the property and split the proceeds. If one party cannot afford to buy out the other and the bank isn’t willing to finance the party who wishes to remain the registered owner of the property, this can lead to a stalemate.” This often affects parties’ credit profiles and whether they can buy another property, she says.

POPI Act demystified The long-awaited Protection of Personal Information Act (POPI) came into effect on 1 July, but whose info does it protect? WORDS: MARANA BRAND IMAGES: SUPPLIED & SHUTTERSTOCK

M

ost of the provisions of the POPI Act took effect on 1 July. The act is designed to promote the protection of personal information and to bring South Africa’s privacy laws in line with international standards. “It limits the rights of businesses to collect, process, store and share personal information. It also makes businesses accountable for protecting the privacy of this information,” says specialist sectional title attorney and BBM Law director Marina Constas. The act has significant implications for owners, tenants and executives in community housing schemes like sectional title complexes, apartment blocks, residential estates and retirement villages. Constas says the wisest course of action for trustees is to get up to speed with what it says.

What info are we talking about?

In terms of the Sectional Titles Schemes Management Act, it’s compulsory for body corporate trustees to prepare and update lists of trustees, owners and tenants with their full names, ID numbers, passport numbers (if they’re not SA citizens), mailing addresses, telephone numbers and e-mail addresses, she says. This personal information is valuable and cannot be used without consent

for any purpose other than that of the operational daily management and administration of the scheme. “If an owner is in arrears with levies, for example, the body corporate knows where to serve the summons or a letter of demand. If a tenant plays their music too loud, a warning letter can be sent to their e-mail address,” Constas says.

How can this info be misused?

If, for example, a trustee whose brother-in-law who runs a gardening service tries to get hold of the body corporate database to send out his brother-in-law’s advertising material, there would be a serious breach of the POPI Act, Constas says. “If the body corporate database with details of trustees, owners and tenants gets into the wrong hands, there may be unsolicited harassment in the form of advertising or worse still, identity theft which is exceptionally serious.”

Act welcomed

“I think in the past body corporate databases have been exploited. The POPI Act is most welcome and completely overdue. The right to privacy is protected in our Constitution, and the act now enhances that right and ensures that a balance is struck between the right to privacy, and the need for the free flow of and access to information.

“Trustees are under a fiduciary duty to guard personal information against the risk of loss, unauthorised access, interference, modification or destruction. If a person’s personal information has been compromised, that person must be notified immediately,” she explains.

Obligated

Trustees must now be able to respond when owners want to know what they are doing with their personal information. They need to consider how they’ll warn residents that their personal information may be made available to those inspecting the books of account and record. If an owner suspects that their information has been shared without their consent, they can approach the Information Regulator who’ll in turn send the complaint to the Enforcement Committee for investigation. “The final decision lies with the Regulator who can impose a penalty or a fine and/or imprisonment for 12 months. The complainant can also bring a civil claim for damages to court.”

What about guards at the gates?

The guard at the entrance of a scheme often requests a visitor’s ID card and proceeds to make a copy.

“That card has a photo, an ID number and a date of birth. Now, under the POPI Act that visitor would have the right to demand the following from the trustees of the scheme: What’s the purpose of taking this information? How will you guarantee the safety of that information? How long will you keep the information and will it be deleted after that time period?” Trustees must be able to account when it comes to visitors who provide their personal information to the guards at the gate.

Up to date policy required

Constas recommends that every body corporate has a clearly expressed and up to date policy about its management of personal information. The policy should include details of the type of personal information the complex collects and holds, as well as how the complex collects and stores personal information. The purposes for which the complex collects, uses and discloses personal information must also be detailed, along with information on how an individual may access it. “The policy document must also outline how an individual can complain to the Information Regulator and how the complex will deal with that type of complaint,” she says.

here are many reasons why consumers consider switching their home loan to another lender, such as a lower interest rate, reduced monthly payments, consolidating finances, freeing up some cash, and long-term cost savings, among others. Whatever your motivation, it’s important to do your homework and keep an eye out for hidden costs.

Benefits

If another bank is willing to provide a lower interest rate, switching can be an enticing option, says Adrian Goslett, regional director and CEO, RE/MAX of Southern Africa. “Even a small reduction of 0.5% in the interest rate could save you thousands over the term of the bond.� Under the current economic conditions where interest rates are already very low, a more compelling reason for switching could be to access the equity that has built up in a homeowner’s property over time, says Kevin Penwarden, CEO, SA Home Loans. “Equity in the home loan (the difference in value between what you owe on your home and the value of the home) may have built up from decreasing the outstanding amount on your bond over the years, or the value of the home may have increased since the home was first purchased. This value that

has built up is available to homeowners by switching their home loan to a new home loan provider,� Penwarden says. Switching your home loan and accessing the equity in one’s property, is probably the cheapest form of credit available and has several potential benefits, he says. These include: • Switching gives access to any additional value in the property • Additional equity can be used to reduce expensive, short-term debt • It helps you maintain a healthy credit profile • It can result in an increased surplus in your monthly budget

• It makes your property investment work harder • It gives you the option to free up cash to use for projects such as home improvements

Considerations

When switching your home loan, you’re technically applying for a new home loan, which includes assessing affordability. It therefore means fees that you would normally incur for a new home loan, such as the initiation and bond registration fees, are applicable. Penalties may also apply. So before you look at other lenders, it would be advisable to speak to a

home loan consultant at your current bank and see whether they would be willing to renegotiate. “If the response is positive, you may have saved on interest without having to pay any additional costs,� says Goslett.

Fine print

If you go ahead with switching, he advises homeowners to look at their current home loan agreement and see what clauses it contains regarding penalties and a notice period. “More than likely, the financial institution will have included a penalty clause, which could result in paying 90 days’ interest on the current home loan if

it’s cancelled before the stipulated notice period has passed.� Apart from the possible penalty, other costs involved in switching include legal fees, a registration cost to register the “new� home loan, valuation fees and an initial administrative fee.

Relief

To take the angst out of switching, lenders often give customers discounts or take on some of these fees like the legal costs of the switch (subject to a minimum duration of the new bond) or the valuation and administration fees, making the process easier. There’s also the chance that they would be willing to pay a portion of the registration and cancellation costs involved. “If this is the case, switching would make far more sense,� Goslett says.

Weigh it up

Although some lenders will simplify the switching process considerably, the transfer of the home loan may still take anything from 60 days to three months, depending on the work volumes of the Deeds Office, Goslett warns. “Switching your home loan is not a quick and easy way to save money. Homeowners should take their time and do their research thoroughly before going ahead with this option,� he concludes.

LET’S TALK POPI: WHAT YOU NEED TO KNOW RIGHT NOW The Protection of Personal Information Act 4 of 2013 (“POPI”) was initially implemented in April 2014. It was however implemented incrementally as only certain sections came into force. The President has announced that remaining sections will now be implemented as follows: 1. Sections 2 to 38; sections 55 to 109; section 111; and section 114 (1), (2) and (3) shall commence on 1 July 2020; and 2. Sections 110 and 114(4) shall commence on 30 June 2021. POPI protects the rights of individuals to privacy as it restores the autonomy of the client allowing them to decide whether they want to share or receive information as the POPI regulates the collection, retention, dissemination and use of personal information. The sections which will commence on 1 July 2020 are essential parts of the Act and are summarised as follows: 1. The following 8 conditions set out the requirements for the lawful processing of personal information: 1.1 Accountability- Responsible parties (a public or private body who determines the purpose of processing personal information) must ensure that the conditions set out in POPI are complied with. 1.2 Processing limitation- Personal information must be processed lawfully and in a reasonable manner i.e. data collection must be proportionate to the purpose and the data subject must give consent to the information processing. 1.3 Openness- The data subject must be aware of the collection of the data and must be provided with the name and address of the responsible party. 1.4 Data subject participation- A data subject must be provided with access to the personal information and may request that personal information be corrected. 1.5 Purpose specifications- Personal information must be collected for a specifically defined and lawful purpose related to a function of the responsible party. The data subject must be aware of this purpose. 1.6 Security safeguards- The responsible party must ensure compliance with the regulations of the Information Regulator by ensuring integrity and confidentiality of personal information.

2. The regulation of the processing of special personal information: A higher degree of protection is given to special personal information under POPI, given the highly sensitive nature of such information. Special personal information includes the following: • Religious or philosophical beliefs • race or ethnic origin • trade union membership • political persuasion • health or sex life • criminal behaviour or biometric information 3. Codes of Conduct issued by the Information Regulator: If a code of conduct is issued by the Information Regulator it must be published in the Government Gazette, as soon as reasonably practicable after the code is issued. The code of conduct will come into force on the 28th day after the date of its notification in the Gazette or on such later date as may be specified in the code and is binding on every class or classes of body, industry, profession or vocation referred to therein. 4. Procedures for dealing with complaints: A code of conduct may prescribe procedures for making and dealing with complaints alleging a breach of the code. The code of conduct will provide for the appointment of an independent adjudicator to whom complaints may be made. 5. Provisions regulating direct marketing by means of unsolicited electronic communication, and general enforcement of POPI: The processing of personal information for the purpose of direct marketing by any form of electronic communication, including automatic calling machines, SMS or e-mail is prohibited unless the data subject has given consent to the processing; or has not previously withheld such consent. The requirement of consent in cases where the data subject is not a customer of the responsible party, would be better served by an opt-in or opt-out provision. 6. Section 114(1) is of particular importance as it states that all forms of processing of personal information must, within one year after the commencement of the section, be made to conform to the Act. This means that entities (both in the form of private and public bodies) will have to ensure compliance with the Act by 1 July 2021. Non-compliance with POPI can potentially lead to claims for civil damages, administrative fines, or criminal prosecution where fines and imprisonment of between 1 and 10 years are prescribed.
