C

otswold is one of Port Elizabeth’s long-standing suburbs, and a popular choice when it comes to buying a home in which to nurture and raise a family. It’s bordered by Westering in the west, Fernglen to the south, Newton Park to the east, and parts of Malabar and Parkside across the valley to the north. Despite the presence of the N2, which runs through it, Cotswold and Cotswold Extension are reasonably quiet areas with a community heart. Many of the tree-lined streets have ornithological names such as Hoepoe, Lewerkie, Barton and Warbler. Riaan Marais and his wife, Christelle, bought their duplex in Cotswold just over two years ago, and live here with their three-year-old son, while Marliza Taylor and her family have lived in Plover Street, Cotswold Extension, for 17 years, having previously rented in Kingfisher Street for a year.

Neither Marlize nor Riaan know when Cotswold was established, though most houses seem to date from the 70s and 80s. “I’ve noticed the bridge across the N2 bears the date 1963, the year I started school, so I presume Cotswold Extension developed reasonably soon after that,” Marliza says.

Property Cotswold is made up of mostly older, free-standing homes, and some townhouse complexes. Apartment blocks don’t feature. Port Elizabeth businessman Jaco Rademeyer of the Rademeyer Group, says Cotswold has seen a growing mix of residential, commercial and industrial developments in the last five years. The group’s head office is in Cotswold as it bought the old Cape Cookies building about a year ago, renovating it to house Pieter Rademeyer Plumbers, Pieter Rademeyer Plant Hire, and the family’s property and development arm. “The well-known Westway Cafe also moved back to its original ‘home’ and rent from us now,” Jaco says. The group developed the Woodpecker Industrial Park with 20 warehouses in Cotswold, and is building a fivewarehouse development, also in Woodpecker Street. The 60-unit Karilzé Villas in Warbler Street is one of its residential developments. “Residential properties zoned for business purposes are fetching higher prices now, which is what happened to Newton Park a few years ago,” Jaco says. “Cotswold is becoming the new Newton Park.” Marliza says her home was priced at only slightly more than what the family could afford at the time. “We liked that we could occupy it immediately without having to do anything to it,” she says. “We originally looked for houses closer to the Grey schools in Mill Park, as we both worked there, but when we realised how close this area was to many shopping areas and to Mill Park, we decided to buy here.

Ours is a spacious house on a corner property with a pool. The value of the property has escalated a lot since we bought here.” One “drawback”, she chuckles, is that her home is close to the quarry at Moregrove, which means she spends a lot of time dusting! Riaan and Christelle also chose their duplex because it was in good condition, needed little work, and was reasonably priced. “The convenience of a duplex is the bedrooms are upstairs, while the living spaces are downstairs, providing more privacy,” Riaan says. “Many of the houses have been extended at some stage as the yards are fairly big. Our yard is quite small, but large enough for our two pugs.” Cotswold has an active neighbourhood watch and visible patrolling by security companies.

Schools Moregrove Primary is in Cotswold Extension, and Cotswold Primary has made the transition from a preparatory school to a primary school. Primary schools beyond the suburb’s borders, but still easily reached, include Sunridge, Newton Park, Herbert Hurd and Westering. Northern Lights is a special-needs school in Stow Street, Cotswold. There are no high schools here, but Framesby and Westering are close enough.

Explore Cotswold’s proximity to the N2 and to bustling Cape Road, its southern boundary, contributes to much of the convenience associated with living here, including making it easy to reach other suburbs, outlying attractions such as Port Elizabeth’s beaches, and shopping centres like Baywest and Greenacres/The Bridge. “We live close to everything we need,” Riaan says. “Getting to work is easy, schools and shops are convenient to reach, and we have quick access to the N2 if heading out of town.”

here’s no doubt that the resurgence of wallpaper in decor continues unabated. The ranges just get wider, more exotic, and more experimental – you can basically create any mood you like. Clinton Kearney, general sales manager, Wallpaper Inn, says, “Wallpaper in South Africa suffered a bad reputation during the 80s, with a shift to paint effects, textured wall finishes, and plaster effects. About five years ago, we saw a resurgence of interest in wallpaper.” He feels exposure to overseas decor programmes from the UK and US helped in part to inspire homeowners to choose wallpaper as a big impact accessory. “This, coupled with the improvement in good design and advances in print technology, has moved wallpaper on.”

The biggest trend

Dean Bassett, director, WCI Wallpapers JHB Pty Ltd, confirms a global resurgence in interest in wallpaper. “Especially digital printed wallpaper, where you can create any custom wallpaper or mural to suit your specific preference. The overall shift in the local and international market is more focussed on developing bespoke wall coverings, given the wealth of options available to the client.”

This is not a bad strategy at all, as it sends a positive and proactive message to foreign investors and governments that South Africa is filled with potential and ripe with investment possibilities.”

Wallpaper or paint?

Dean feels, “You can use wallpaper to transform any environment, no matter where. The richness of the colours and depth of textures cannot be achieved with simple paint, making wallpaper an everlasting necessity in interior design.” For many designers, it’s the combination of the two that works. It’s often only necessary to wallpaper a single wall, particularly if it replaces a headboard, or is intended to bring the outside in – or vice versa – in a bathroom for instance. Carefully pairing paint colours and textures with wallpaper can enhance both materials.

Where are people using wallpapers?

“Wallpapers are typically used for feature walls in bedrooms and living rooms, but we’re seeing an increase in people wanting them in bathrooms and kitchens – no problem, as long as the correct wallpaper is chosen, and the application is done correctly,” says Clinton. “People love to actually feel their wallpaper, so paper with a texture is often a deciding factor,” he adds. “We’re also encouraging the use of non-woven backing paper, which is easier to hang especially if you want to DIY it.”

W

ith estate and complex living more popular than ever, body corporates and homeowners associations are a part of many South African’s lives. The differences between homeowners’ associations and body corporates stem from the type of development they function in. “A homeowners’ association is registered for a development with free-title homes and a body corporate for sectional title developments,” says Jeff Gilmour, president, Association of Residential Communities. In practice, this means that apartments and complexes are generally run by a body corporate, which is managed by trustees, while big estates will have a homeowners’ association with a board of directors.

The legislation which governs the two is different. “A homeowners’ association has a memorandum of incorporation registered within the Companies Act, while a body corporate has articles of association registered within the Sectional Titles Act,” says Gilmour. In both instances, residents are expected to pay levies, but the costs covered by the levies differ. Gilmour says that in the case of a homeowners’ association, levies will cover security, common land, common area insurance, landscaping, maintenance, roads and all costs relating to areas outside of each separately owned erf. Owners are responsible for their own building’s maintenance. “In a body corporate, the levy will include these things as well as unit insurance and exterior maintenance of each unit. In a

homeowners’ association, all levies are equal. In a body corporate, levies are calculated according to the size of each unit, with bigger units paying more,” he says. Although homeowners’ associations do have rules, they’re very specific to the particular circumstances of the development and pertain to building guidelines and conduct rules. The Sectional Titles Act has a set of prescribed rules which all new developments use as a base for establishing rules for the body corporate. The rules are divided into two categories: management rules and conduct rules. Management rules deal with issues pertaining to the running of the body corporate. Conduct rules deal with issues pertaining to the dayto-day running of the complex and the harmonious living in the complex.

HOW DOES OWNERSHIP DIFFER IN A SECTIONAL TITLE OR FREEHOLD SCHEME? In a sectional title, the common property is owned by all the owners in undivided shares. Therefore, an owner owns their section plus an undivided share in the common property. These combine to what is commonly referred to as a unit. This undivided share in the common property cannot be separated from the section. In a freehold situation, each homeowner owns their house and land, which have separate erf numbers, while the homeowners association owns the common property and manages it under the direction of the members.

Tel: 041 363 6044 CAN I CANCEL MY LEASE AGREEMENT IF MY TENANT IS IN BREACH OF CONTRACT? To answer this, you must first determine whether the Consumer Protection Act (“CPA”) applies to your lease agreement. The CPA does not apply to all lease agreements and it is accordingly important to determine whether or not the CPA will apply to your lease agreement. In order to do so, the following questions should be asked: 1. Does the landlord lease property in the ordinary course of business? If the answer is no, then the CPA is not applicable. However, if the answer is yes then you would need to ask the second question. 2. Is the tenant a consumer? All natural people are consumers and a juristic person (e.g. Company/Close Corporation/Trust) is a consumer if its asset value or annual turnover, at the time of entering into the transaction (lease agreement), is less than R2 million. No distinction is made between commercial and residential property. If the CPA does not apply to your lease agreement, the provisions of the breach and/or early termination

clauses in the lease agreement must be followed. However, should the CPA apply to your lease agreement then the following must be noted: • Section 14 of the CPA affords a landlord the right to cancel a lease agreement after giving 20 business days’ written notice to a tenant. Section 14 of the CPA overrides the provisions of both the lease agreement and common law. A landlord is therefore not entitled to rely on a shorter notice period as may be provided for in the breach clause of the lease agreement. • That written notice referred to above must: o point out that the tenant is in breach of contract; o call upon the tenant to remedy his/her breach; and o record that the landlord shall be entitled to cancel the lease agreement in the event of the tenant failing to remedy his/her breach. Common examples of breach include amongst others: the tenant failing to pay the rental amount in full every month, intentional damage to the property or continued non-compliance with body corporate rules and regulations. If the tenant fails to remedy his/her breach within 20 business days, the landlord is entitled to cancel the lease agreement. In this event, the landlord is entitled to claim a reasonable cancellation penalty from the tenant which will be determined by having regard to the factors listed in regulation 5(2) of the CPA. Lastly, if the lease agreement contains an early cancellation clause allowing for termination where the tenant has not defaulted (some lease provisions permit early termination in instances where, for example, a landlord intends to sell or renovate), the landlord will be precluded from giving such notice by virtue of section 14 of the CPA. The tenant must be in breach and must have failed to remedy the breach within the allocated time. The CPA therefore invalidates any early cancellation clause in so far as the landlord is concerned. When dealt with correctly, section 14 meets the purpose of the CPA without creating an unreasonable disadvantage to the owner. We recommend that you consul your attorney or property rental agent/manager for advice and assistance when dealing with a tenant that is in breach of contract.
