Imagine how anxious you would feel if, without warning or explanation, you were taken to an unknown destination and all of your belongings had been unpacked into this new space. By the time evening rolled around, and nobody showed any signs of returning you to your home, the nerves would understandably begin to set in.

“Adjusting to a new home can be challenging, especially for your furry companions. To avoid pets running away or inflicting harm upon themselves, homeowners should take the necessary precautions to help them adjust to the new space,” advises Adrian Goslett, Regional Director and CEO of RE/MAX of Southern Africa.
Familiar objects and routines are useful ways to help your pets adjust to their new environment. Make sure that all of your pet's favourite things (their cushion, chew toy, drinking bowl, etc.) are unpacked before they arrive. Though you might think that a new home presents the perfect opportunity to purchase new things and develop new habits for your pets, it is better to hold off on anything new until your pet has become comfortable in the unfamiliar space.
According to Goslett, one of the first things responsible pet owners should do is find the closest vet in their new area and get their pet's tags and chips updated with their new address. It might also be a

As a final piece of advice, Goslett reminds homeowners that in this
new territory, they are they one of the only things that are familiar to their pets. “It can be easy to get so caught up in all the logistics of unpacking and redecorating your new home that you neglect to spend time with your pet. Now more so than ever, your pet needs you to be around. Boxes can always be unpacked later, but the wellbeing of your pet cannot wait,” Goslett concludes.

Tel: 041 363 6044 THE NEW KID ON THE BLOCK: SPLUMA SPLUMA is “The Spatial Planning and Land Use Management Act 16 of 2013” (“SPLUMA”) and came into operation on 1 July 2015. SPLUMA is a national framework act that requires provincial legislation to enable municipalities to enact spatial planning and land use management by-laws. The municipal SPLUMA by-laws prescribe how land use applications and appeals are dealt with. These by-laws have many requirements and procedures regarding spatial planning and land development. One such requirement is contained in Section 53 of SPLUMA and prohibits any act of registration without the approval of the municipality. This means that no registration will take place in the Deeds office unless this approval has been obtained. From 1st of June 2017 the Registrar of Deeds Mpumalanga no longer permits transfer of property without a certificate issued by the relevant municipality indicating that the SPLUMA requirements have been complied with. Having regard for requests that we have recently been receiving from the King Williams Town Deeds Office, it is clear that it intends to follow suit. Significantly SPLUMA also establishes a new administrative procedure for the removal of restrictive conditions by means of s47 of that Act, by placing the necessary authority in the hands of the Municipal Planning Tribunal (“MPT”) or designated municipal official. In the result SPLUMA requires each Municipality to establish the MPT to determine land use and development applications within its jurisdiction such as: Application for rezoning, Township establishment, Subdivision of land, Consolidation of different pieces of land Removal, amendment or suspension of restrictive conditions.

These applications must be brought in accordance with the processes set out in the relevant municipal By-laws. As it currently stands, Nelson Mandela Bay Metropolitan Municipality (“NMBM”) published a draft SPLUMA by-law for public participation/comment in September 2017. As per the Notice published by the NMBM, the MPT was established on 30 May 2018 and was scheduled to commence its operations on 25 June 2018. The MPT will endeavour to resolve the current backlog of land use and development applications referred to above. A question which came up for consideration as a result of the advent of SPLUMA was whether or not the High Court retained its jurisdiction in relation to the removal of restrictive conditions as they occur in title deeds. This grey area was dealt with in Ex Parte Whitfield and related matters [2017] 2 All SA 841 (ECP) which concerned seven similar applications, in terms of which the applicants sought the removal of restrictive conditions of title incorporated in the title deeds of their respective properties. Each of the matters was then referred to a Full Court of the Eastern Cape Division of the High Court for the issue of jurisdiction to be determined. The issue to be determined was whether or not the consent of a Municipal Planning Tribunal had to be obtained before a court would authorise such removal. The court held that s 47(1) did not require the consent of a municipal planning tribunal in all circumstances. Therefore, a court's power to grant an order authorising the removal or amendment of a restrictive condition of title on proof that all interested parties have consented thereto is not affected by the provisions of SPLUMA. In each instance it would be necessary to establish that all interested parties have indeed consented thereto which ordinarily occurs through court directed publication of the intended removal or amendment. It is therefore clear that in the absence of the Municipal Planning Tribunal, the court does still have jurisdiction over the aforementioned applications. It is of vital importance for each property owner to be SPLUMA compliant as the enactment of SPLUMA by-laws in the NMBM is inevitable. The owner must ensure that: Approved building plans for all buildings are in place; the use of the property is in accordance with the municipal zoning; no encroachments over the building lines and property boundaries have occurred. Why home buyers should avoid taking on more debt Recent hikes have put many of us under pressure and some may be tempted to borrow in order to make ends meet. More debt will, however, reduce your chances of getting a home loan. The weaker Rand, rocketing fuel prices and the steep electricity and municipal tariff increases that are taking effect in many cities and towns this month could delay many families' hopes of becoming home owners – especially if they start borrowing more to make ends meet. So says Rudi Botha, CEO of SA's biggest bond originator BetterBond, who notes: “SA households have come under increasing pressure this year, especially since the VAT increase in April, and in response it seems that many consumers are now taking on more debt again. “We are concerned that this could easily reverse the gains made over the past 10
years as South Africans worked really hard to pay off their debts, and steadily reduced the household debt-to-income ratio from 86,5% in 2008 to the current 72%. Particularly worrying is the rise in rate of unsecured borrowing, which includes personal and micro loans, credit card balances and overdrafts.”
This means, says Botha, that a bigger and bigger percentage of the average consumers' monthly take-home pay is being used to repay “bad debt” rather than “good debt” such as a home loan. “What is more, this could get worse due to further fuel price hikes and this year's round of municipal tariff increases, while the stagnant economy is making it difficult for employers to offer wage increases that would improve the situation.
The latest Reserve Bank statistics reveal that unsecured credit extension in the household sector showed year-on-year growth of 5,3% at the end of May, compared to 3,1% at the end of December. And personal and 'pay-day' loans, which make up almost 59% of unsecured credit, showed even faster growth of 5,7% at the end of May, compared to 2,7% in December.
“And prospective buyers whose disposable incomes are diminished by additional debt will find it more difficult over the coming months to qualify for home loans, even though the banks are currently eager to lend to them.”
Secured credit extension, which includes home loans, leases and vehicle instalment sales, showed annual growth of 3,9% at the end of May, with household mortgage balances recording year-on-year growth of 3,3%.
The reason, he explains, is that the banks don't only consider the applicant's income and credit record when deciding whether to approve a home loan, but also look closely at their regular monthly household expenses and existing debt repayment commitments. “They are obliged to do this, in terms of the National Credit Act, to ensure that borrowers really will be able to afford
their monthly bond instalments without getting into financial trouble. But prospective buyers should actually be confident of this themselves, before applying for a bond, and that is one of many reasons to consult a reputable bond originator such as BetterBond as one of the first steps in the home buying process. “Our experts know exactly what the banks require and can suggest ways for borrowers to improve their financial position and credit profile before applying for a bond.
