As residential electricity tariﬀs continue to increase and place ﬁnancial pressure on South African households, many are looking at alternate power sources, such as solar panels, in an attempt to reduce their household electricity consumption.

Adrian Goslett, Regional Director and CEO of RE/MAX of Southern Africa, says that the more electricity a household uses, the more it is charged per unit of electricity. Because of this, there is a growing trend of households introducing energy-eﬃcient elements to curb their energy usage and overall cost of running the home. “While the concept of 'green energy' is not new, the growing cost of electricity has led to consumers becoming more conscious of the energy they use. A study conducted by the National Association of Home Builders (NAHB) revealed that

A reminder of the consumer protection act and its effect on landlords, tenants and agents The Consumer Protection Act No. 68 of 2008 (CPA) introduced some far reaching changes to lease agreements for immovable property. Specifically for ordinary people, the changes grant the parties certain rights of cancellation that previously did not exist. It is important to note that Juristic Persons fall outside the ambit of the CPA. Juristic Persons includes Closed Corporations, Companies, Trusts, Partnerships and Associations. No distinction is made between commercial and residential property. THE TENANT'S RIGHT TO EARLY CANCELLATION In order to give content to a consumer's right to choose, section 14 of the CPA provides that a tenant may cancel the lease agreement with 20 business days' notice, without the need to prove that there was a breach (whether material or not) of the agreement. Regardless of the reason for the cancellation of a fixed term agreement, the tenant will remain liable to the landlord (supplier) for any amounts owed in terms of the relevant agreement up to the date of cancellation, but not up to the end date of the contract under the relevant agreement. Early cancellation of a lease agreement does not constitute a breach of the lease agreement, it is a right under the CPA. A tenant has the right to cancel a lease agreement. THE LANDLORD'S RIGHTS Once a tenant has exercised his right to early cancellation, the landlord has the right to in turn impose a reasonable cancellation penalty and demand all outstanding amounts owed in terms of the lease. Whilst the draft regulations indicated that such cancellation penalty may not exceed 10 % of the “remaining contract value”, this provision was excluded from the final regulations. Regulation 5(2) of the CPA now provides that a penalty may not exceed a reasonable

amount taking into account various factors such as: a) The amount that was still owing under the remainder of the period; b) The value of the transaction up until cancellation; c) The duration initially agreed upon; d) The length of notice of the cancellation; e) The potential for the landlord to find another tenant; and f) The general practice relevant to the industry What can a landlord/agent charge the tenant that cancels early? Credit checks for any prospective replacement tenants, advertising costs (only the actual amounts on the invoices) and rental – the exact number of days that the unit remains vacant after the tenant vacates. It is important to keep in mind that all calculations of the penalty can only be made once a replacement tenant has been found. You cannot possibly give the tenant a penalty calculation on the day they cancel and it is important to understand and explain to them the reasons for this. What about the agent's commission? Upfront commission must be separated from ongoing monthly management commission. If an agent were paid an upfront commission, he/she may charge the tenant the balance of the placement commission as it is an expense you need to recover for your landlord. If, however, commission is paid monthly for the management of the premises, finding a replacement tenant will cover the ongoing payment of this fee and there is no need to bill the outgoing tenant. The idea behind the reasonable cancellation penalty is not to penalise the tenant, but to recover any actual loss suffered by the landlord as a result of the cancellation. The principles behind cancellation penalties lie in our law of undue enrichment. A landlord/agent cannot make a financial gain or benefit off a tenant's cancellation. The penalty may further not have the effect of negating the consumer's right to cancel. Landlords may also cancel the agreement with 20 business days' notice but will need to prove: 1. Material failure by the tenant to comply with the provisions of the lease agreement; and 2. That the tenant was asked to remedy the breach but failed to do so. Liesel Greyvenstein

How first-time buyers can pay no tax and get up to 44% more space Buying a newly-built home has many attractions, but for most first-time homebuyers, saving tax is no longer one of them. For many years, one of the biggest incentives to buy off-plan or into newly completed developments has been the fact that the “price you see is the price you pay”, with VAT being built into the sale price and buyers thus not being required to find additional cash to cover transfer duty. “However, with the transfer duty threshold currently at R900 000, that is simply no longer true for many first-time buyers, who are currently paying an average purchase price of around R750 000 to R800 000. The truth is that there is now no tax at all payable on pre-owned properties costing less than R900 000, but still 14% payable on newly-built homes in this price bracket. In other words, those buying the new homes will effectively be getting 14% less floorspace for their money than those who buy pre-owned homes – and will usually still have to come up with some cash to cover the additional transaction costs such

as legal fees and bond registration fees, which are the same for both types of property. Meanwhile, due to the fact that building costs continue to increase at more than twice the rate of inﬂation, newlybuilt homes are currently at least 30% more expensive than pre-owned homes of the same size. Looked at another way, newly-built homes are likely to be at least 30% smaller than pre-owned homes at the same price point. This means that those buying for less than R900 000 could be getting as much as 44% more ﬂoorspace when they buy a preowned home instead of a newly-built one – and we believe this has much to do with the current resurgence of interest in many of the older and lower-priced suburbs in our

cities, especially if they also happen to be close to good schools, shops and workplaces, and well-served by public transport. There are of course many advantages to buying a newly-built home, not the least of them being the fact that they are usually much lower maintenance properties, and often have better security provisions. Modern ﬁttings and ﬁnishes are also a big attraction. However, we are seeing huge interest among young buyers in older city centre apartments that are inevitably more spacious than newly-developed ones, and especially attractive if they have recently been renovated or revamped and are in a city improvement district with good security and an active nightlife. Similarly, pre-owned townhouses and

smaller houses in the older, inner suburbs are also in high demand, especially among young families who want to have everything they need close by and prefer to use public transport to get to work rather than sit in traﬃc every day. “Many of these buyers are also happy to buy homes that are in less than perfect condition and renovate them over time, in return for a lower price and a convenient location. They are bringing a new energy to these areas and are often also prepared to get involved in community eﬀorts to improve and secure their neighbourhoods. “We see this as a healthy, positive trend that will help to reverse the decay that has taken place in many inner suburbs, and to preserve and increase the value of the housing stock in those areas, while also encouraging the establishment or reestablishment of many small businesses and the creation of new employment opportunities.” www.chaseveritt.co.za

I'M GETTING MARRIED – WHAT ARE MY PROPERTY RIGHTS AFTER I TIE THE KNOT? Marriage is an undeniably life-changing event, and not just in the emotional sense – it alters the way we manage things like finances and property ownership too. The contractual side of tying the knot may not be particularly romantic, but it can have far-reaching effects on your future, and should definitely be a part of your discussions before you say “I do”. “Property is often the most valuable asset a person will own in their lifetime,” says Tony Clarke, Managing Director of the Rawson Property Group. “It's also pretty central to most marriages – the marital home – but that doesn't necessarily mean ownership is always

shared equally between spouses. It really depends on your marital contract, and can be affected by whether the purchase was made before or after the marriage.” With more and more couples waiting until later in life to get married, it's not uncommon for one or both parties to already own property before the wedding. They may even share ownership of a property, and have a contract in place to define their ownership rights and responsibilities. According to Clarke, however, these contracts may be superseded by a marriage contract in some situations, and couples can't just assume the same agreement will carry through when they become spouses. “All marriages are contractual,” says Clarke, “whether you sign an anti-nuptial or not, and the type of contract you choose determines how the ownership of assets is assigned to each spouse during

the marriage and in the event of death or divorce.” In South Africa, the default marital contract is in community of property, and if you don't have an anti-nuptial drawn up before the wedding, this is the contract that will govern your marriage. “When a couple marry in community of property, they agree to share all marital and pre-marital assets equally,” says Clarke. “That means both spouses will be equal and joint owners of any property bought before or after the marriage, regardless of whose name is on the title deed. They will also both need to consent to any future property sales or purchases.” Most modern couples choose not to be married in community of property, however. Rather, they choose between marriage by anti-nuptial with or without accrual.

“Accrual basically means anything bought or earned during the marriage – otherwise known as a marital asset – will be divided equally between the spouses should the marriage end for any reason,” says Clarke. “That means any property bought after the marriage will be considered jointly-owned in the event of death or divorce, unless it has been specifically excluded in the contract. Assets bought or earned before the marriage, however – including property – will belong to the original owner, alone. If a couple jointly owns a property before marriage, the original ownership division should be specified in the anti-nuptial agreement. That way, if the marriage should end, each spouse retains the shares agreed upon when they made the purchase.” Marriages by anti-nuptial without accrual do not share ownership of any marital or pre-marital assets. “In this case, whoever

bought the property, owns the property,” says Clarke, “but things can get a little complicated if both spouses contribute to the cost of ownership.” Marriages by anti-nuptial, whether with or without accrual, do not require consent from both spouses for property purchases or sales. This is because all property remains individually owned until the dissolution of the marriage, at which point the assets are divided according to the agreement in place. “There is no, one, right way to handle property ownership when you marry,” says Clarke. “It's something you need to discuss with your partner, and consider all your options to find the best fit for you. It's always a good idea to consult with a lawyer if you have any questions, and be open and honest about your hopes, expectations and beliefs.” www.rawson.co.za
