It goes without saying that homeowners who place their property on the market are looking to get the best possible return on their investment, says Adrian Goslett, Regional Director and CEO of RE/MAX of Southern Africa. He notes that a vital aspect of selling a home is its listing price, so having a sound pricing strategy is essential for sellers in order to find the right buyer for their home. “Regardless of whether the market favours buyers or sellers, it is important that homeowners have a plan of action if they want to achieve the best possible selling price for their property. In today's age of readily available data, buyers are savvy and educated with regard to the property pricing and fair market value. As such, sellers need to price their property accordingly to ensure that they will attract the right buyers to the home,” says Goslett. Here are six common pricing mistakes that sellers should avoid: Overpricing The most common pricing mistake that homeowners make is inflating their listing price to counteract buyer negotiations. There is also the matter of emotional attachment to the home. Many homeowners perceive their home

An experienced real estate professional will have access to this kind of information and will be able to provide valuable guidance to sellers when determining the right listing price.
Not considering online search parameters Nine out of ten buyers start their home search online. As such, it is crucial to consider this when setting an asking price. “Property search portals require the user to enter a price range to narrow down their search options. If the asking price is R755 000 and the buyer's price range is from R700 000 to R750 000, the home will be missed. By listing the property at R750 000, there will be a far greater chance of capturing potential

asking price or other conditions, could mean that the seller is in for a long and bumpy ride during the selling process,” says Goslett. “Sellers may need to decide whether it is more important to get the full asking price and have the home on the market for longer or make a few concessions and close the deal.” Not taking the agent's insights into consideration Selecting a reputable agent with area experience will put the seller on the right path to setting the correct asking price. An agent will have access to resources and information that the homeowner will not. They will base their assessment on facts and figures, without bringing emotion into the equation. An agent will be able to provide an unbiased opinion, looking at the situation from all angles, such as the home's features, the local market, recent sales and more. Goslett concludes by saying that avoiding these common mistakes and setting the correct price from the start will ensure that it will attract the right potential buyers, which will result in the homeowner selling for the best possible price, within the best possible time frame.

Ask for a comparative marketing analysis to see what has recently sold in the area, and at what price. 3. Find the right agent. Work with someone with whom you are comfortable and who has a proven track record in the area in which you live. Make sure the agent is registered and is in possession of a valid Fidelity Fund certificate. 4. Consider signing a sole mandate. Agents who have a vested interest in a property will often work harder to ensure the property is sold. A sole mandate is prized in the real estate industry and agents should have a clear idea as to how they intend marketing the home. Ask to see a detailed marketing plan before signing the agreement.
1. Get your house in order (literally) before putting it on the market. This is a no-brainer and yet it's surprising just how many sellers believe that buyers won't notice defects and that even if they do, will still be willing to pay top dollar for the property.
5. Take your chosen agent's advice and price the home according to their valuation. Agents have a sound knowledge of what sells, and at what price. THE VAT INCREASE AND THE EFFECT ON THE SALE OF RESIDENTIAL PROPERTY SARS has raised the VAT percentage from 14% to 15% with effect from 1April 2018. This raised many questions relating to the sale of property. For the purposes of this article, we will look at 3 of them. Firstly, how does this impact the commission I have to pay an estate agent as a seller? To answer this question, it is imperative to establish when commission falls due to the agent. If the agreement stipulates that the commission accrues to the agent only on registration of transfer, the date of registration determines the percentage of VAT to be levied. If this is after 1 April, 15% VAT is payable on the commission. It has been established that the mandate agreement (assuming it simply states the % commission plus VAT without a specified % for VAT) tacitly implies that the agent will be able to collect the applicable rate of VAT should there be a change in VAT during the relationship. Most agencies in Port Elizabeth, however, have a clause in their standard pre-printed agreements of sale stipulating that commission accrues on fulfilment of suspensive conditions. This means that in most cases the date of fulfilment of suspensive conditions (approval of bond as an example) will be the date to determine the rate of VAT applicable. If a mandate was signed prior

to 1 April, the property is sold prior to 1 April, conditions fulfilled prior to 1 April and registration of transfer takes place after 1 April, VAT on commission will be payable at 14%. The second question that arises is the purchase price of properties bought from a developer at an agreed price with completion and registration of the unit taking place after 1 April. Does the developer have to pay 15% VAT on the purchase price and therefore will recoup it from the purchaser? With developments, the specific time of supply rules applicable to fixed property is deemed as the earlier of registration date or date of payment resulting in an increase of VAT to 15% for transfers registered after 1 April 2018. A concession was however made in respect of residential property transactions and the 14% rate will continue to apply where: *The price of sale was determined and stated in the agreement; *The agreement was concluded (signed) by the parties before 1 April 2018; *Payment and registration after 1 April 2018. This concession only applies to the sale of residential property. The last issue is around VAT payable on the attorney's fees by the purchaser. If I have been given my statement of account reflecting 14% VAT and registration is only going to take place after 1 April, do I have to pay the increased VAT amount as the attorney takes his fee on registration? The answer is no. The conveyancer will raise the invoice prior to 1 April which means that the fee accrues prior to 1 April with VAT payable at 14%. It is important to note that the invoice can only be raised if all suspensive conditions have been met. Liesel Greyvenstein
Rainwater tanks: Should a landlord or tenant supply them? Many home owners are installing rainwater tanks and grey-water systems to help them meet water restrictions and to protect themselves against a Day Zero scenario. But what of tenants? Drought is affecting many parts of the country, not just Cape Town: Johannesburg had a critical shortage of water a few years ago, Durban in 2016, parts of Limpopo have struggled with poor supply for years, the Northern Cape and Eastern Cape have areas facing water crises too. Many home owners are installing rainwater tanks and greywater systems to help them meet water restrictions and to protect themselves against a Day Zero scenario. But what of tenants? Who is responsible for supplying rainwater tanks and having them connected to the guttering? Is it the landlord's duty or is that for the tenant's account? While landlords are required to ensure that their tenant enjoys an uninterrupted water supply in terms of section 8(2) of the Western Cape Unfair Practice Regulations, it is the State's responsibility to ensure a continuous supply of water. If the State is unable to supply water, the landlord cannot be held responsible. However, if the lease stipulates that the landlord will ensure a continuous supply of water, he or she will have to look at installing rainwater tanks for their tenants. “Most leases were drawn up prior to the current level of the drought,” notes Johan van Bosch, principal estate agent at Just Property Claremont. “However since residential leases are normally valid for 12 months, we expect to see parties inserting clauses in the leases going forward to deal with this issue.” If the tenant pays for a water tank (incurring a not-insignificant cost while adding what could

Johan explains that a fixture is deemed a fixture by nature of its installation: “A rainwater tank is normally placed on a flat surface and the weight of the water acts as an anchor. In theory the tenant should be able to remove the tank once empty but this will require the tenant to remedy the area where the tank was placed and all subsequent piping. However if the piping from the tank is integrated with the existing system to the house the whole rainwater tank and piping will be deemed a fixture.” Johan advises tenants to obtain permission from their landlord before any installation of this kind is made. “The two parties can then also agree as to what will be required at expiry of the lease.” All agreements should ideally in writing and possibly made an addendum to the lease. That said, no lease can supersede a law or bylaw. When restrictions preclude water usage – e.g. the backwashing/filling of a pool or the watering of a garden – a landlord cannot use a dry garden or halffilled pool as a reason to hold back the tenant's deposit. Obviously, in all other areas tenants and landlords must still look after the property in accordance with their lease agreement.

A landlord, however, has an obligation not to interrupt the supply of water being received by his or her tenant.” So even if a tenant is using more than the stipulated 50 litres a month, a landlord or body corporate may not cut off the tenant's water supply. Agents and landlords need to remind their tenants to adhere to the notices and anything put in place by body corporates regarding the enforcement of restrictions, -says Doreen Mynhardt, of Just Property Helderberg. “Lease agreements should be explicitly linked to compliance with 'House Rules' and these can be subject to amendments from time to time. Proactive landlords and agents who manage properties should be communicating regularly and across multiple channels with tenants about these issues.”

Consider reaching an agreement on who is responsible for what when it comes to drought; make sure there is complete understanding regarding what constitutes a fixture that remains when the tenant leaves, and what the tenant may take with them. I highly recommend added addendums that spell out each party's responsibility to your lease. Our agents are always happy to advise our tenants and landlords on such issues. Water scarcity is a reality we all have to come to terms with, throughout South Africa and whether you are a landlord or a tenant, it makes sense to ensure your rights are protected.”
