Tel: 041 363 6044 CLARIFYING COHABITATION Cohabitation, which is also commonly referred to as a "common law marriage" or "domestic partnership" is not recognized as a legal relationship or a default marriage in South African Law, regardless of the amount of time a couple has lived together. Unlike a "normal" marriage which is regulated by specific legislation, a cohabitation relationship does not enjoy such protection. As a result, should such a relationship terminate or should a partner in such a relationship die without leaving a valid Will, the surviving partner is inevitably left vulnerable and without legislative protection, protection which is otherwise enjoyed by married spouses engaged in a "normal" marriage relationship. By way of illustration a surviving partner in a so-called "common law marriage" has not right to inherit under the Intestate Succession Act, nor may such a surviving partner depend on the Maintenance of Surviving Spouse Act to secure maintenance from the estate of the deceased partner. If the partners in a so-called "common law marriage" cohabit upon immovable property owned by only one of the partners, the partner who is not the registered owner/co-owner of that property has no rights to it.

In order for partners in a so-called "common law marriage" to enjoy protection against the risks and consequences alluded to, life partners may wish to consider entering into a cohabitation agreement with one another. A cohabitation agreement regulates the partner's respective rights and obligations during the subsistence of their union and the patrimonial consequences in the event such union terminates, directing the division and distribution of their assets. It is also permissible for parties to make provisions for the payment of maintenance upon the termination of their union. Should either partner breach the cohabitation agreement concluded between them, the aggrieved partner is entitled to approach the courts for an order enforcing the terms of the cohabitation agreement against the defaulting partner. Where no cohabitation agreement exists our courts have, on occasion, come to the assistance of couples engaged in a so-called "common-law marriage" if persuaded, on the facts of each case, that an express or implied universal partnership existed between the parties in question. Universal partnerships must however satisfy four legal requirements, namely: 1. The aim of the partnership must be to make a profit; 2. Both parties must contribute to the enterprise; 3. The partnership must operate for the benefit of both parties; 4. The contract between the parties must be legitimate. Even though there is no special regime for cohabitees, the universal partnership figure can be used to give both parties a right to share in all property acquired during, and even before the commencement of the relationship, if such a partnership was created tacitly or expressly. Tips for keeping pets in smaller homes Not all of us can afford spacious properties with large gardens. But, that does not mean we cannot harbour our furry friends comfortably within our tiny homes. “Pets are a huge part of making a space feel like home. However, if you do have a smaller space, you should make sure your property is located near a park, a beach or is within a safe neighbourhood where you'll feel comfortable to let your cat roam around freely and take your dogs out for regular walks,” says Regional Director and CEO of RE/MAX of Southern Africa, Adrian
Install a Pet Door “For security reasons, it's not ideal to install a pet door on your front door unless you live in a wellpatrolled security estate or have a security fence around your property. However, if you have even just a small outdoor space in the back of your property, installing a pet door will allow your pet some extra space in which to roam around during the day and is safer than leaving a backdoor open while you're at work.”
Create a Pet Corner “According to our research, dogs generally feel
more at ease when they have their own dedicated space. This is easier to achieve in larger homes where there is space to spare, but it can be tricky to find such a spot in smaller spaces. Consider tucking a pet bed underneath the staircase or renovate some cupboard space to create an open pet station where one might otherwise have installed a shoe rack – just be sure to gain permission from your landlord if you're renting the space.”
Deodorise Often “Keeping pets in smaller spaces can lead to your home developing a rather strong pet odour. Be sure to keep your space well ventilated throughout the day. If you feel uneasy about leaving a window or two cracked slightly open at all times, install burglar bars so that you're able to
keep some air flowing through the space. You will also have to clean regularly to ensure that the pet smell never becomes too overbearing.” As a final piece of advice, Goslett reminds homeowners that it is often not the size of the home that makes pets unhappy, but rather the quality of life that their owner can offer them. “Provided you spend enough time with your pet and allow them to get fresh air regularly, most smaller breeds won't mind being kept in smaller spaces. I would just suggest that you check with your vet to make sure your living space is adequate for the needs of your specific pet,” he concludes.

Luckily, other dilemmas are easier to solve, like where to start when buying a home, for example. “Many first-time buyers begin at the wrong step in the home-buying process and consequently lose their footing before the deal can be finalised. Rather than checking what they qualify for first, many buyers choose to jump straight into the search for a home, often leading them to fall in love with a property they simply cannot afford,” says Regional Director and CEO of RE/MAX of Southern Africa, Adrian Goslett. To help buyers avoid the heart break of losing out on their dream home, Goslett provides a step-by-step guide to the home-buying process: 1. Speak to the Pied Piper “The very first step in the process is to find out what you qualify for and to get pre-qualified bond approval. You can do this either by going to the banks directly or by working through a bond originator. To apply, most institutions will require your latest payslip, three months' bank statements, and a certified copy of your ID. Once processed, you'll receive a printed quote stating the bond amount you'll be granted, as well as the interest rate and the instalment amount, following an appraisal and signed OTP.”
3. Find your Perfect Match “Counter to popular belief, most buyers don't know what they want until they walk into the home of their dreams. It is always advisable to view a few properties in person before deciding on placing an offer on a property.” 4. Name your Price “Chat with your estate agent and settle on an amount together that will be submitted as an offer. You might have an idea of what you'd like to spend, but your estate agent will be able to guide you towards putting the best offer forward to ensure that it is accepted.” 5. Read the Fine Print “After the offer is accepted, you will need to sign a legally binding offer to purchase. Make sure you read through this carefully as it will effect things such as what happens if the deal falls through, what stays behind and what goes with the previous owner, as well as other relevant issues.” 6. Hire Inspector Holmes “Before signing the offer to purchase, make sure that it states that the deal will only be finalised on condition that the property passes the home inspection. If the home inspection reveals issues, make sure that the seller addresses these issues before you finalise the deal. If not, you'll
be saddled with the costs of the repairs once the home is yours.” 7.Set a date with BetterBond “Make sure you get the best deal on your home loan by working through a bond originator. BetterBond has found that on average, buyers who work through them save up to 0.5% on their interest rate. To put this in rand value, on a R1.5 million home loan over 20 years, this would save you up to R120,000.” 8.Schedule the Moving Date “Once all the paperwork has been signed, the last and most exciting step is to set the moving date. This is often a moving target which will depend on how soon the sellers will be able to move into their new home and by when you have to be out of your current property,” Goslett concludes.
