POPI AND THE QUALITY OF YOUR INFORMATION Posted on: 16 November 2017 “I work at a recruitment agency. I generally receive personal information, such as copies of identity documents from our clients listing their CVs with us. These copies are stored in our electronic database. I understand that POPI requires that personal information of clients, such as the quality of copies of identity documents must meet certain requirements. What exactly are these requirements?” Firstly, it should be noted the Protection of Personal Information Act 4 of 2013 (“POPI”) was signed into law on 19 November 2013, but has, to date, not yet fully come into effect.

Although POPI does not provide detailed specifications for what is standard or sub-standard data, it does oblige responsible parties to take reasonable practicable steps to ensure that all the personal information which they collect is complete, accurate and not misleading. In your example of an identity document, if the quality of such is so poor that it is not legible or the person cannot be identified, the data (namely the identity document) would then be sub-standard, particularly if the reason for the collecting – namely to forward it to potential employers – is taken into account. Responsible parties also carry the obligation to ensure that personal information is up to date. For example, if you have outdated contact details of a client which is provided to potential employers, such outdated contact details may make it impossible for the interested employers to contact your client (the data subject) for a recruitment interview. Responsible parties must thus ensure that the quality of data remains intact over time, taking into account that data can change or deteriorate over time, thereby impacting on the quality of the data.

POPI protects persons from suffering damage and harm by requiring entities and persons who, store, use and destroy personal information to protect such information and to keep it private and confidential. The entities and persons who carry this responsibility are termed “responsible parties”.

As you are potentially dealing with a wide variety of personal information and are also providing access thereto to other third parties, it would be advisable that you enlist the help of a legal specialist to help you establish a compliance framework for your business that is aligned with POPI when it becomes effective.

“As a rule of thumb, anything smaller than 2mm in width is normally just cosmetic,” says Clarke, “but cracks wider than that are a warning sign that should definitely be inspected by a professional.”

Walls and floors

Damp walls are often chalky, mouldy, or show bubbling or flaking paint close to the source of the problem – usually within 1m of the floor or up at ceiling level. If a home has been recently painted, however, it might be difficult to see these symptoms. In this case, Clarke recommends running a hand over the walls to feel for any telltale “cold spots” and being aware of any damp musty smells.

Wooden floors “Old houses with suspended wooden floors can fall prey to sub-floor rot,” says Clarke. “The best way to check for this is to walk around and feel for any soft spots or areas that sag or bounce. Some give is normal, but more than a little could be cause for concern.”

Bathrooms and Kitchens

Professional home inspections are a vital part of buying a home, Tony Clarke, Managing Director of the Rawson Property Group, shares his tips on spotting potential problems. These DIY checks are just the first step of the process, and should always be followed by a professional inspection – even if you don't find any red flags. Leaks, dampness and water-damage Ceilings According to Clarke, ceilings give great clues to the condition of a property. Stains or sagging suggest past or present leaks from the roof, geyser or water pipes, and mould is a good indicator of poor ventilation or potential damp problems. Dark marks around light fittings could also be a sign of electrical problems, and smoke-stains near a fireplace are a sure sign that the chimney doesn't draw properly. “It's also a good idea to ask about things like ceiling insulation,” says Clarke. “It can make a big difference to the liveability of a home.”

Testing taps and toilets is a good start, but to detect less noticeable leaks, Clarke recommends inspecting floors, countertops and splashbacks for damage, as well as the inside of any vanities or under-sink cupboards. “It's also important to check the walls that back onto showers and baths for any signs of moisture. If the paint is flaking, or there are stains or cold spots, it could mean hidden pipe leaks or poor waterproofing,” he says. Gutters You might get a few odd looks if you ask to climb onto the roof during a normal show house, but Clarke says that gutter problems can often be spotted from the ground. “Check to see that the gutters run straight and don't sag noticeably anywhere,” he says, “and keep an eye open for drip marks or dark patches – these are usually caused by leaky joints and seams. You'll also want to take note of the condition and number of downpipes, and make sure they divert the rainwater to proper drainage channels or soak wells. Downpipes that pour water onto the foundations aren't doing anyone any good.” Roof coverings It may be difficult to see the condition of a home's roof tiles or roof sheets from the ground, but if you can, check for signs of patching or rust that could indicate leak problems. “A roof that has been patched once will likely need to be patched again in the future,” says Clarke, “so if possible, find out about the

Making sure they open, close and lock properly, and that their paint or varnish is in reasonable condition. Sliding doors should move smoothly and seal tightly against drafts and wind. Plaster and paint work Cracked or shabby plaster and paintwork isn't necessarily a sign of serious underlying defects, but it can be expensive to fix as a new homeowner, nonetheless. Clarke suggests taking note of the condition of the paintwork and factoring the cost of any maintenance into your purchase decision. Structural problems - Cracks While most homes have at least one or two hairline plaster cracks, larger cracks can indicate a serious structural problem.

“Pipes and wiring are beyond most of us, but anyone can test dimmers, switches and water pressure,” he says. “Listen out for strange noises and take note of any obvious faults.” “Remember, no property is perfect, so don't let a few minor faults put you off,” says Clarke. “If you find a place that feels like home and doesn't ring any major warning bells, go ahead and get a professional inspection done. they can let the property because the tenant will largely dictate the financial success of the rental. “The tenant selection process is where the services of a rental agent will really pay off, as they will provide the landlord with the professional vetting of potential tenants. Factors that will need to be considered are the tenant's previous rental history, reasons why they are moving, their place of employment and income. Landlords should verify the information given by contacting the references provided by the tenant,” advises Goslett.

Building an investment property portfolio and becoming a landlord can be a great way of increasing your income or making a living, however being a landlord is not for everyone. While letting out property is a viable option for generating income, there is a lot more to being a landlord than signing lease agreements and collecting the rent. “Many landlords underestimate the amount of time and energy it can requires to ensure that a rental portfolio is maintained and tenants are kept happy. This does, however, largely depend on the tenants who are renting the property,” says Adrian Goslett, Regional Director and CEO of RE/MAX of Southern Africa. “There is also the matter of any legal issues and ensuring all legal requirements are adhered to and the right procedures are followed. This is especially important in the case where the tenant is not paying their rent. The correct steps need to be taken to deal with the delinquent tenant while protecting the landlord's interests.” Goslett notes that it is imperative for prospective landlords, as well as those who are already landlords to consider a few elements that will assist them along the way. He adds that there are five factors in particular that first-time landlords and those thinking about getting into the rental business should consider: Plan and set a timeframe Purchasing a rental property is not a get-rich-quick scheme. Property investment of any kind should be viewed as a medium to long-term investment. “A property will appreciate over the long term and will generate a rental income, however, there might be costs that are not entirely covered by the rent, which is why the decision needs to be made with the future goals and plans in mind,” says Goslett. “There is a good chance that the rental property will pay for itself over time or when the market booms or when the bond is paid off, however in the initial stages there will probably be a cost involved.” Crunch the numbers The monthly bond repayment is only one of a few monthly expenses that

The more that is covered in the contract, the smoother the rental should run as each party knows exactly what is expected of them. There are also general legal fees for drawing up lease agreements or advice on the landlord's legal rights and responsibilities. A lettings management agency can also be a highly effective tool for landlords to make use of. A rental agent can assist with vetting potential tenants, collecting rent and general management of the property. Selecting the right tenant is crucial Each prospective tenant should be put through a vetting process before

Equally important is for the landlord to have a detailed agreement with the management agent should they decide to use one. The landlord will be able to sign a mandate with the rental agent which outlines all terms and conditions of the agreement, such as the commission structure and what is expected from the agent. Having a checklist can save both time and money The landlord should make a checklist of all the items that they need to look at and check before a new tenant moves into the property. The list will ensure that all potential problem areas can be sorted out and that a snag list can be drawn up with the tenant in a comprehensive manner. In conclusion, Goslett says that although owning a rental property and becoming a landlord can be hard work, it can also be the foundation to creating wealth over the long term. He notes that the key element to success is to always view property investment with the future in mind.
