Tel: 041 363 6044 DEBUNKING THE MYTH THAT RENTAL IS ONLY DUE ON THE SEVENTH DAY OF THE MONTH A lease agreement will ordinarily contain a clause that deals with the payment of rental. It will confirm the amount that must be paid, the due date for payment and the manner in which it must be paid. Given the existence of a lease agreement these obligations are contractual in nature as between the Landlord and the Tenant and both parties are obliged to observe its various terms and conditions. Despite the existence of a rental clause in a lease agreement (and the concomitant contractual obligations which follow); many tenants are still of the opinion that a common law "grace period'" for the payment of rental is applicable. This "grace period" supposedly grants the tenant a further 7 days to make payment of rental. As a result of this misconception, the perception is that tenants are allowed to pay rental on the 7th day of each month as opposed to the 1st, as agreed in most lease agreements. The common law provides that the full rent must be paid at the proper time – that means that payment must be effected at the time and on the date contractually agreed upon by both the tenant and the landlord. The common law does not provide the tenant with a 7-day "grace period". The lease, which

codifies the contractual terms agreed upon between the Landlord and the Tenant, regulates when a rent payment is due and a tenant may not deviate from this. It is also worth noting that a tenant must ensure that the rent payment reaches the bank account of the landlord or the landlord's agent by the due date. If funds need to be transferred from one bank to another, the payment must be made with enough time to ensure that the landlord or the landlord's agent receives the rental into his/her/its banking account on the agreed date. While a landlord is not entitled to charge a penalty for late payment; a landlord may levy interest on any overdue rental. A word of caution to tenants. Failure to pay rental strictly in accordance with the provisions of the lease agreement renders the tenant in breach of the lease immediately after the due date for payment of the rental has past. Once the tenant is in breach, the landlord is entitled to proceed against the tenant in terms of the relevant breach provisions as set out in the lease agreement which may culminate in the termination of the lease and the eviction of the tenant from the property. In the event of the premature termination of the lease agreement as a result of the tenant's breach, the Consumer Protection Act makes provision for a landlord to claim a reasonable cancellation penalty from the tenant. This penalty is likely to include any and all damages suffered by the landlord as a consequence of the tenant's breach of the lease agreement and may be set off against the tenant's deposit. To ensure your lease agreement is correctly formulated; we recommend that you consult your attorney or property rental agent/manager for advice and assistance sooner rather than later.

That's why, according to the 2017/2018 Old Mutual Millennial Survey, 37% of millennials are more likely to save money first towards travel than any of their other expenses. However, according to Regional Director and CEO of RE/MAX of Southern Africa, Adrian Goslett, having a home loan does not necessarily mean that you must live in it yearround. “There are several options available to homeowners who are out of the country for periods of time. For example, short-term letting and Airbnb rentals present useful solutions to

the nomadic homeowner. In both scenarios, however, homeowners will need to make use of the services of a reliable property manager who can collect payment on the homeowner's behalf and be available to address any maintenance issues the temporary tenant might come across while the homeowner is out of the country,” Goslett explains. Usually, a standard homeowner's and household goods' insurance policy would cover a homeowner against unfortunate occurrences such as damage to the physical property and the furniture therein. However, managing these risks becomes slightly more complicated when the homeowner is both the primary resident and the temporary landlord. “Certain homeowner's insurance policies might provide cover if you rent out your home occasionally,

while others will require you to take out a separate landlord's insurance policy. Similarly, some policies will cover furniture damage while the property is occupied by tenants, and others will not. Buyers will have to do thorough research on insurance policies to ensure that they are covered against these kinds of damages,” Goslett warns. The other risk traveling homeowners face is the challenge of securing tenants for the period that they are away. “My advice to these kinds of buyers is to search for a property that has year-round appeal to the short-term rental markets. For example, suburbs near tourist hot spots will attract the holiday renter, which is often a seasonal market. If you plan to be out of the country over the peak tourist seasons, then these kinds of homes might be ideal.

Suburbs near business districts, on the other hand, will attract those travelling for work, which is a more stable, year-round market,” explains Goslett. While there are risks involved in leaving your primary residence in the hands of a temporary tenant, Goslett summarises the above by emphasising the importance of hiring a reliable property manager to look after your home while you are out of the country. “A property professional with the specified experience will be able to guide homeowners into making sure they avoid the major stumbling blocks involved in these kinds of arrangements,” Goslett concludes.

With just a few days to go before it is finally voting day in Elections 2019, Samuel Seeff, chairman of the Seeff Property Group says that the elections simply cannot come quick enough. It is time to get it done and dusted as quickly and efficiently as possible so that we can get back to the business of building the economy and property market. He says that most of the year has been characterised by “buyer analysis-paralysis” with buyers hesitating, sitting on the sidelines and waiting to see how the elections unfold. This has been especially the case among those with discretionary money who do not have to buy or invest right now. And so, what we have seen in the market this year, is lacklustre demand and weak price growth. It has been a period of frustration for property owners looking to sell and move on, but simply cannot because there just isn't the level of demand that we should have seen in the market this year, he adds. In a sense, the “political impasse”, has left people with a level of uncertainty and the best course of action, is to get the election out of the way as quickly as possible. An

essential element of economic and property market growth is stability and confidence, and the country is certainly poised for a return of confidence and economic revival, he says. What we now need, is for the commitment and hard work done by President Ramaphosa and the investments to start filtering into the economy. The combinations of certainty and stability is the vital ingredient that South Africans need to recommit to the future and economy. The latest FNB Property Barometer points to a level of stability returning to the market. Despite more people selling for financial and emigration reasons, our branches have seen an uptick in activity, specifically in the core R1.2-R3 million price band, and there is an expectation that buyers will start heading back after the elections, he says. Sellers should be ready to capitalise on that demand.

Seeff says that while there is an expectation of renewed energy in the market as we dust off the uncertainty that has characterised the lead-up to the elections, market conditions are likely to remain fairly flat for this year. But, he adds, with so much good stock, more motivated sellers, a flat interest rate and positive mortgage lending landscape, there's every reason for momentum to start building. As momentum builds and the year unfolds, we could then hopefully start looking forward to a return to real growth next year.

Conditions are favourable for buyers. Economists expect the interest rate to remain flat at least for the next quarter. Mortgage lending conditions have also improved further. Ooba for example recently reported that the bond approval
