IS AIRBNB ALLOWED IN SECTIONAL TITLE SCHEMES? Airbnb, the internet platform founded in 2008 in San Francisco by three young American out-the-box thinkers to enable property owners to list houses, apartments and rooms online for rental, has been the subject of an increasing number of queries. Several issues have been raised, particularly regarding shortterm lease of space in community residential developments such as sectional title schemes or those managed by homeowners' associations. By their nature, such residential developments entail people living in relatively close proximity to one another, sharing common spaces and being affected to a greater or lesser degree by constant activity of neighbours. Some residents have welcomed the option of extra income provided by the short-term Airbnb leasing option, and require input on the legal and financial ramifications of listing their property. Others have expressed aversion to the increased activity and potential security compromises posed by the to-ing and fro-ing of visitors to Airbnb abodes. Are Airbnb listings allowed in housing schemes operated by sectional title or homeowners' associations? The short answer is: Yes, provided that the scheme's rules or association's governance documentation do not expressly prohibit it. Given that there is a slight difference between the underlying legal structures of a sectional title scheme and a homeowners' association (the details of which, for the sake of brevity, will not be given here), residents, whether exploring or objecting to Airbnb listings, will need to take a different approach in each instance. Property owners must in addition ensure that whatever accommodation they want to list on Airbnb, complies with the permitted uses under zoning regulations and, where the local authority has specific policies regarding short term holiday rental, that these are not contravened. Sectional title schemes are governed by both the Sectional Titles Act 95 of 1986 and the new Sectional Title Schemes Management Act 8 of 2011. Such schemes are required to have a set of rules in place when they are established. These are binding, by law, on all owners and occupiers in the scheme. Neither of the two pieces of legislation contains any out-and-out prohibition of short-term letting (under which description Airbnb would fall). But note that in terms of the Sectional Title Schemes Management Act, the body of owners in a sectional title scheme is allowed to make its own rules or alter or amend existing rules. (The latter, however, must be approved by the office of the Community Schemes Ombud as per the Community Schemes Ombud Services Act 9 of 2011, which came into effect in

October 2016. Only once approved by the Ombud will the new rules be valid and binding on all residents.) It is, therefore, possible for a scheme to decide that it wants to limit or prohibit Airbnb listings by putting it to the vote at a meeting of owners. The Act provides for the passing of a change or amendment of a conduct rule by special resolution, meaning that 75% in value and number of those residents at a validly constituted meeting must vote in favour of limiting or prohibiting Airbnb rentals. If the community scheme is a homeowners' association, the management and administration of the scheme is in the hands of an association or non-profit company which will appoint a board of directors or trustees to attend to the scheme's daily running and operation. Such schemes will have their own individual conduct and management rules which can address issues of concern to owners. Whether or not a rule already exists on short-term letting (like Airbnb by home owners) residents, as members of the association, will be able to amend or make new rules by passing a resolution at an owners meeting. The voting procedure and percentage votes required for changes and amendments will be prescribed in the development's governance documents. Whichever community scheme is involved, however, there are two other factors to take into account when residents wish to list on Airbnb: the provisions of the tenant's lease agreement - if the tenant subleases on Airbnb, and the principles of neighbour law. 1. Sub-letting: Often a tenant's lease agreement includes a provision prohibiting sub-letting. So even if Airbnb or subletting is not prohibited in terms of the sectional title scheme's rules or a home owners' association's governance documents, if an individual lease agreement prohibits sub-letting, then a tenant may not lease out his premises on Airbnb. 2. Neighbour law: A further overriding consideration when exploring Airbnb listing is the principles of neighbour law. This is a branch of law that governs a very fine balancing act: a property owner is entitled to enjoy, use, convert, alter, destroy or sell his property in any way that he pleases within the limits of state and local authority regulations, provided he does not interfere with a neighbour's legal rights to do the same. A dispute between neighbours invariably involves, amongst other things, the question of whether there has been an abuse of a right, and the facts are examined to determine whether the neighbour whose conduct is being complained about, acted reasonably or not. In the context of continuous or regular short-term letting (such as in the case of Airbnb operations) – which may go hand in hand with increased activity, noise and use of shared facilities and amenities – the question that must be asked is whether the complaint is objectively reasonable. In other words, is it fair to require the complainant to tolerate the intrusion? This answer will vary from scheme to scheme: whats acceptable in a sectional title scheme inhabited by mainly students may not be reasonable in a quiet golf estate. Kelly Freeth

INCREASE YOUR CHANCES OF SECURING A RENTAL As the demand for rental properties continues to outstrip the current inventory available, it has become increasingly more difficult for tenants to find the right property, says Adrian Goslett, Regional Director and CEO of RE/MAX of Southern Africa. “The demand for rental homes is unprecedented high, while there is simply not enough properties to go around. Tenants are looking for the best place for the best value, but currently, it seems that many rental agencies are unable to assist because of the lack of inventory out there. If a rental property is within reasonable price range, there is often a waiting list of potential tenants eager to get into the property. For tenants that have missed out or lost a place because another applicant was accepted, the process can be frustrating - especially if time is a factor. However, there are ways that tenants can improve their chances of finding their ideal rental property,” says Goslett. Here are some basic tips and tactics to help tenants get the property they want. These tips are especially helpful for good tenants with excellent credit and track record. Things to avoid: There is little point responding to an online ad that has been viewed hundreds of times. Rental properties that are perceived to be good value will be snapped up instantly. “Listings that appear after page 10 or those older than a week, will probably already be taken, especially rentals under R10 000 per month. “Check property search portals on a daily basis to ensure you are responding to ads as quickly as possible,” Goslett advises. Given the volume of competing tenants in the market, asking an agent to add you to a list or take your number will not suffice. Rather get the email address of a reputable agent who is active in the area and email them with the intention of gaining some rapport. Don't be complacent and leave it to the last minute, it's harder to secure the right place than you think. Responding to online ads To be noticed, it is crucial to respond to online ads efficiently. Here are a few pointers on how to respond. · Be brief and ask for an appointment to see the property as soon as possible. · Do not ask if the property is still available – this wastes time, and the property will be gone before you get the benefit of a reply. · Briefly, outline who you are, note the number of occupants, pets and why you are moving. · State that you have a clean credit history and have all documents, proofs and deposit ready.

· Leave the questions about what is included until you are face to face with the agent or landlord. · Shortlist as many potential places to view as possible to improve your chances of securing one. · Landlords and agents seek quality tenants, and you will need to ensure you have all the necessary documents to show you are a quality and exemplary tenant. · Be prepared to be asked for the contact details of references Be prepared to give the following to the agent or landlord Having all the necessary documents in order will speed up the process and show the landlord that you are serious about the rental. Have the following in order before responding to an ad: · An updated credit report should be kept so that it can be offered to the owner or the agent. They may do their own, but at least you will know your credit history and score. · Most agencies and savvy private landlords will have an application form. If possible, get this document before the viewing and complete it before you arrive. · Other documents to remember are copies of ID documents, proof of income or a letter from your employer or if you are self-employed have three to six months of bank statements. · Remember rental agents and landlords seek applicants who earn roughly three times the rental amount as a gross combined income. · A letter from your past landlord or rental agent is always helpful or at least have their contact details handy. Agents/landlords want to know your conduct and payment behaviour at previous properties you have rented. · If you have never rented or if you previously owned your property, try to get a good reference from a responsible authority figure, school bursar, minister etc. · If you have anything that negatively affects the application, rather be honest and open about it and state what you have done to improve the situation. Being honest about it shows integrity. “To make a good impression with a landlord, be sure to be on time for the appointment. If possible, also try and build some rapport with the landlord so that they will remember you. Have all the necessary supporting documentation on hand when you arrive and ask if there is a formal application to follow. If they can provide a receipt, ask if you can pay the lease fee or deposit immediately,” says Goslett. “During the process, it is vital not to lose hope and give up. While it may take some time, If you apply the above tips and keep at it you will eventually find the ideal rental property,” he concludes.

TOP TREND: HIVING ON THE RISE AGAIN For both economic and security reasons, households made up of several generations of the same family are on the rise again in South Africa, and estate agents are reporting a marked rise in multi-generation home purchases, with parents and children or parents and grandparents pooling resources to buy a residential property that will accommodate them all. “There has recently also been a rise in demand for homes with multiple granny flats or separate cottages to accommodate retired parents, newlyweds or working singles in the same family,” says Berry Everitt, CEO of the Chas Everitt International property group. “At the same time, many retirees who already own large properties are now building themselves a retirement cottage on the same stand while one or more of their adult children move into the original family home.” And similarly, he says, the demand for smallholdings with several dwellings is increasing, as siblings or cousins band together to buy properties that will serve as family “compounds” and enable them to jointly also provide housing for their ageing parents or grandparents.

“This type of 'hive' living is however quite distinct from the cocooning that was popular a few years ago, in that it enables members of the family to share living spaces and interact closely when they wish, but also to still live quite independent lives.” Writing in the latest Property Signposts newsletter, Everitt says the main drivers of this trend are of course declining affordability in the current economic climate, especially for the young and the elderly, as well as concerns over crime and personal security. “But it has been found that multi-generational housing also delivers many social benefits for the families concerned - and for wider society. For example, retired parents who live on the same property as their children might do it primarily to stay close to their grandchildren – but at the same time may also be relieving the pressure on scarce state housing for the aged. “In any case, we expect hiving to continue gain ground in SA, and to see specific home designs begin to emerge to meet the demand.” www.chaseveritt.co.za
