NEW REGULATIONS FOR LOST DEEDS Without your ORIGINAL title deed, you are unable to sell or mortgage your property. A lost or misplaced title deed will mean that you'll need to make an application for the certified copy thereof to be issued by the Deeds Office. A certified copy (certified by anyone other than the Deeds Office) will not be acceptable. Many clients are unaware of the fact that a title deed and Deed of Transfer are one and the same thing. The procedure to be followed for the application for the deeds office certified copy of title deeds will be significantly changed from 25 February 2019. In the past, our clients were merely required to sign an affidavit confirming that their title deed was lost and could not be found after diligent search. The new application must be signed in front of a Notary Public (not merely a Commissioner of Oaths) and must be published in the Government Gazette where after it must lie for inspection at the Deeds Registry for two weeks after the date of publication. This will apply to all transfers lodged from the 25th of February 2019 onwards in terms of the new Regulation 68(1) procedure. A Notary Public is a specialised attorney who 'notarises' documents in a formal recording and certification process that carries more weight than would attach to a normal affidavit signed before a Commissioner of Oaths. There are extra costs involved in having documents notarised and placing an

The biggest cost, however, lies in the fact that the seller's sale or the registration of a further mortgage bond taken out will be delayed should the problem be uncovered too close to the expected date of transfer. Other advertisements that are placed in the Government Gazette are deceased estates and sales in execution, so the placing of these advertisements is not a new concept for attorneys. We are currently waiting for a directive from the Chief Registrar to get more clarity on the practical arrangements, but it is important to establish the whereabouts of the title deed when you commence with the marketing process. Please remember that the title deed will be with the bank if the property is bonded so do not panic if you don't have your title deed for a bonded property. The bank holds it as part of their security and if the bank has misplaced it this will only become known to the conveyancer at an advanced stage of the transfer process. However, the banks are generally much better with their securities than years ago as their systems are far more advanced. As a result there are not as many lost deeds as we had a decade ago. How to proceed with this whether you are the seller, purchaser or agent in respect of a property: confirm the whereabouts of the title deed of the property. If you are selling a property it will help if his is brought to light sooner, so as to avoid delays in the process. If you are the estate agent or purchaser, ask your clients or the seller regarding the whereabouts of the Title Deed or Mortgage Bond, this will assist all the parties involved in the sale. This protects consumers against dealing with somebody who claims to have knowledge of the industry but doesn't.”

Similarly to how one might expect a doctor to display his / her degree on the wall of their office, professional real estate agents should be more than willing to provide evidence of their credentials when doing business with you. If not, you might be dealing with a non-registered estate agent. “Did you know that if your agent doesn't have a valid Fidelity Fund Certificate (FFC), you don't have to pay them commission for selling your home? If an agent fails to produce an FFC that is still valid at the time when the commission is due, sellers can legally deny payment of the agent's commission,” explains Regional Director and CEO of RE/MAX of Southern Africa, Adrian Goslett. Carrying this risk, one might think that the number of nonregistered estate agents would be relatively low, right? Wrong. At the end of 2017, then EAAB spokeswoman announced that possibly around 50,000 estate agents were operating in the country without a valid FFC. “Throughout last year, there was a call for the EAAB to clamp down on these illegally operating agents. Yet, the problem seems to persist, particularly in small towns such as

If the agent in question is unable to produce a valid FFC, we further encourage sellers to report the agent to the EAAB by lodging a claim against them on the EAAB website,” Goslett concludes.
