Legal Ways of Handling Neighbour Disputes According to Adrian Goslett, Regional Director and CEO of RE/MAX of Southern Africa, dealing with some sort of neighbour dispute is an unavoidable part of life unless, perhaps, you choose to live on a remote small holding for the rest of your life. “The reassuring thing is that, for the most part, the law tends to be on the side of the reasonable neighbour who just wants to live in peace,” says Goslett. In his experience, resolving neighbour disputes can be a time-consuming process if you have to take it up with authorities, so it is always advisable to attempt to resolve it with your neighbour before you get others involved. That being said, sometimes these issues cannot be resolved no matter how diplomatic, polite and reasonable you might have been when you approached the issue. Luckily, the law is there to help you during these times. “Issues that can be dealt with at a local police station include boundary wall offenses and noise complaints. In many cases, just one warning call or notice from a local police station is enough to set a neighbour straight. But, if they choose to ignore the

warning, then you are allowed to request that your local authority issue them with a fine,” he elaborates. Below are some of the legal grounds on which you may approach authorities to assist with neighbour disputes: Boundary Issues Legally, the boundary wall belongs to both neighbours. However, whatever falls to either side of it belongs to the neighbour who owns that property. If your neighbour builds a structure or plants a tree that encroaches onto your property, you are allowed to lay a formal complaint against him/her. This does not, however, include things like shadows or buildings that block your view. Noise Complaints These fall under two categories: 'Disturbing Noise' and 'Noise Nuisance'. The former refers to objectively loud noises. Things like late-night parties usually fall under this classification. The latter refers to subjective noises that disrupt the ongoing peace of an individual. Things like the non-stop barking of a neighbour's dog is a perfect example of things that fall under this category. Both of these categories are illegal behaviours and perpetrators can be fined or even arrested for continuing with these actions at any point during the day.

“As an absolute last resort, you may bring the issue to your nearest court where you can apply for an interdict to prevent your neighbour from continuing the offending behaviour. You may also sue your neighbour for damages that may have resulted from their offense. In these cases, however, you will be required to provide evidence that the matter is something that any reasonable person would find intolerable to live with and that is having a seriously negative effect on the enjoyment of their property. But, even with the legal recourse you are allowed to take, we would still recommend trying to resolve the issue face to face. Remember, you're going to be living side by side for some time still,” Goslett concludes.

“Nationally, we measured an increase in the percentage of tenants in arrears from 18.5% in April 2017 to 23.2% in March 2018,” says PayProp head of data Johette Smuts. “This means that only 76.8% of tenants pay their rent in full every month – and one in four don't.” The average tenant in arrears is one month behind Smuts says that the average arrears percentage relative to rent is also increasing over time. “In April 2017, the average tenant in arrears was just over 80% in arrears. In March 2018, this number was much closer to 100% (96,4% to be exact), meaning the average tenant in arrears is almost one full month behind with their rent. Unfortunately, this is the trend we see for every province.” Subdued rental growth Throughout the first few months of 2018, rental growth continued the downward trend we've been seeing since the beginning of last year. “Year on year growth in January 2018 was just 4,5% - slightly more than half the rate measured a year earlier.” Growth slowed even more during February and March 2018, with both months registering rates below 4%. Smuts says that this is not such a big surprise if we compare rental growth to the trend in the inflation rate. “In March, the latter figure came in at

Arrears across rental categories While the most expensive rental bracket (over R15,000) had the lowest percentage of arrears relative to rent (78.4% in Q1 2018), it didn't have the lowest percentage of tenants in arrears. “We also know from previous indices that most tenants rent for between R5,000 and R7,500. This is still the case nationally with 31% of tenants renting in this bracket in Q1 2018, so it's good to see that the proportion of tenants in arrears here was at the low end of the scale, at 22.4%. The lowest rental bracket (R1,000 – R2,500) has the lowest percentage of tenants in good standing and the highest percentage of arrears relative to rent. The arrears percentage relative to rent in this bracket has decreased slightly over the past six months, while increasing for every other bracket. Smuts emphasises the importance of selecting good tenants, despite them being increasingly hard to find. “In coming months, it will be interesting to see the combined effects of the lower inflation rate and interest rate cut on rental growth, as these are usually competing forces with opposite effects on broader economic indicators,” concludes Smuts www.privateproperty.co.za

YOURS, MINE, OR OURS? Property Advice for Newlyweds The notion that newly-wed couples will move from their childhood home into their first home together is as outdated as dial-up-internet. According to the 2015 Stats SA report, the average marriage age for men is 34-years-old and 30years-old for women. Chances are high that both individuals in the couple will be living in their own place long before the question gets popped. The next question newlyweds will have to ask is: whose place goes and whose stays? “Choosing where to live can have profound implications on the future happiness of the couple. That is why it is often best, where possible, for couples to move into a new place together where they can both feel equally at home rather than to move into the other person's property. That way, they can avoid some of the arguments that inevitably occur when moving into somebody else's home,” says

Adrian Goslett, Regional Director and CEO of RE/MAX of Southern Africa. According to Goslett, this is a relatively easy thing to achieve if both parties are renting, but the process can become more complicated if one party owns the property in which they're currently living. “In these cases, it is advisable that, rather than sell, the owner becomes a landlord and rents out his/her home. Eventually, this asset will become an investment for the newlywed couple that – once the bond is repaid – will bring in a monthly recurring income.” The trickiest newlywed situation is where both individuals own property. “Managing tenants and bond repayments on two different properties can become a bit of a juggling act – especially when you're trying to adjust to the new roles and responsibilities of being married. In these cases, it is best to sell one of the properties if the couple plans on moving into a new

home together, and get a tenant to occupy the other. If, however, they choose to move into one of the homes they already own, then they can keep the other property and use it to generate rental income. As an added benefit in this scenario, both individuals maintain the legal rights to their own properties if ever the marriage breaks up,” Goslett suggests. But, if a couple chooses not to deal with the hassles and risks that come with being a landlord, and they're caught between which of their two properties to sell and which to keep, then Goslett suggests three factors that need to be considered in making this decision: financial benefits, practicalities, and sentimental flexibility. “Financially, couples need to decide which home will be the better long-term investment. Arrange to have a property valuation done on each home. Then, you need to consider the

potential growth value for each property – how much will this value increase over time? A good estate agent will be able to provide some insight into this. The property which promises to increase in value at a higher rate is the property which couples should keep.” The next factor Goslett adds to this decision-making equation is the practicalities of each home. “It is no use selling the two-bedroom home in the suburbs in favour of the one-bedroom apartment in the city bowl with higher investment value if you are planning on expanding your family in the near future. You will also need to decide which home offers the best

location in terms of the daily commute for both you and your spouse.” “The last thing to consider is the sentimental attachment both might have to their properties. It might seem counter intuitive, but whoever is least attached to their home should be the one who gets to keep it. If the property means too much to a spouse, then they're unlikely to allow any changes to be made. In order for it to feel like home for both parties, the one owning the home needs to be flexible enough to allow their spouse their own say in the how the house is run – after all, it does not belong just to one person anymore,” Goslett concludes.
