Enforcing a family law order in California is a relatively straightforward process if you know what you’re doing. 1. Get a clear original order issued from your family law judge. Unclear or unfinished orders result in confusion on how the judge is to interpret the court order in an enforcement hearing. A vague order is an unenforceable order. For example, if you’re trying to specify a visitation plan in your original order, detailed information and specific parenting time tables will make a big difference in enforceability of the order. If you simply state “Reasonable visitation,” you are doomed when it comes to trying to interpret what the order means at a later time. 2. Document violations of the order. Before returning to court on a violation, you should have a record of how the court order was not followed by the other side. Send an email or letter to the other side describing what the order was, along with facts on how the other party has not complied with the order. Give the other side an opportunity to remedy the problem with a specific deadline and state the consequences. You can use a copy of the written communication as an exhibit to your enforcement motion. If you’re having difficulty following an order yourself, set out in writing what part of the order isn’t being followed. Memorialize those events by sending something in writing to the other side establishing that fact. This written information will be helpful when you go to court since you can attach the information as exhibits to your request for enforcement. 3. Specify in your enforcement motion what remedies you would like to resolve the non compliance problem. You are now at the stage where you are returning to court and are ready to file a request for orders. Of course you’ll be including in your Judicial Council forms the reasons why you’re returning to court but just as importantly, you should include in your enforcement motion proposed solutions on how to remedy the problem that you’ve encountered. For example, if the other side hasn’t paid certain bills or hasn’t paid support, you should not only specify all of the amounts that were due but also lay out in your declaration the best approach on how these overdue amounts can be paid to you. The same should be done for visitation and other problems. For example, if there’s been difficulty communicating with the other parent, you might want to propose co-parenting counseling and a return hearing date in case the counseling process is unsuccessful. If you apply these three principles, you have a very good chance of getting the relief that you may want to return to court on an enforcement order. The best chance you could ever have on accomplishing the outcome that you seek would be through the assistance of an experienced family law attorney.

Inventor, teacher, writer, husband and father, John J Muir— b bl the h country’s ’ most extreme naturalist—made li d his hi home h probably in Martinez from 1880 until his death in 1914. Married to Louie Strentzel, the daughter of a fruit rancher who owned 2,600 acres in the Alhambra Valley, Muir took over the family business in 1882. After the former Wisconsin farmer made enough in a ten-year period to last his entire lifetime, Louie convinced him to turn the daily operations of the ranch over to her so that Muir could return to his first love—travel and conservation—which eventually led to the development of the National Park Service. Today guests can wander the grounds of the Muir house, which now sits on a 9-acre park, tour the Muir home and walk through what remains of the orchards. The trees still produce a limited amount of fruit which guests are welcome to enjoy. Start your tour of the Muir site at the visitor center. There you can watch a 20-minute video that gives an overview of Muir’s life and works. A paved path will take you around the grounds and up to the house. Along the way, take time to listen to the self-guided cell phone tour that will give you insight to what life was like when the Muirs lived there. The home itself is cozy and open all day to welcome guests. Tour the house on your own (there are no cell phone stops in the house) or take a ranger guided tour at 2pm each day. A park ranger is in the house at other times to answer questions.

The out-and-back hike is approximately 3 miles long with about 500 feet of climbing up to a view of the Carquinez Straits. Dogs on leash are allowed. A second national historic site, The Martinez Adobe, is located on the western edge of John Muir’s historic orchards. Once where Wanda Muir made her home, the building now features bilingual exhibits from the Juan Bautista de Anza National Historic Trail. Here you can learn about the Anza Expedition, when Spanish Lt. Colonel Juan Bautista de Anza led 240 men, women and children up the California coast in 1775. Things to know: John Muir National Historic Site is located at 4202 Alhambra Avenue in Martinez. It’s open daily from 10am to 5pm. Closed Thanksgiving, Christmas and New Year’s Day. Admission is free. No food or drinks are available for purchase. Restrooms are located in the visitor center. The visitor center and the first floor of the home are wheelchair accessible. Find Mount Wanda Ÿ mile south from the visitor center on Alhambra Avenue. There is a parking lot at the trail head next to Franklin Canyon Road. If you haven’t been to Blossom Vegan in Pleasanton, you’re missing out. I was a bit skeptical, as I prefer meat with my veggies, but I was quickly won over. The menu includes many choices, some of which feature a meat substitute, and others that let the veggies shine on their own. I opted to stick with veggies, starting with an order of spring rolls filled with lettuce, shredded carrots, jicama and avocado served with a side of peanut sauce. For my entrée, I enjoyed the curried vegetables with broccoli, carrots and cabbage cooked in a coconut curry sauce. CHABOT REDWOODS NIGHT HIKES

ROUND THE MOUNTAIN HIKE

The brightness of the moon guides your exploration of the redwoods on this easy 2-3 mile hike. After the hike, stay and view the night sky through telescopes (weather permitting). This classic loop at Mt. Diablo provides views in all directions as you circle the park’s dominant peak via Deer Flat, Prospector’s Gap and Oak Knoll.
