Three Things You Should Know About
Family Law Enforcment Orders
A
Professional
L aw
Corporation
A r lene K o ck Divorce & Fa mily L aw 35 Year L aw Practice • E xperienced Support Staff
Enforcing a family law order in California is a relatively straightforward process if you know what you’re doing. 1. Get a clear original order issued from your family law judge. Unclear or unfinished orders result in confusion on how the judge is to interpret the court order in an enforcement hearing. A vague order is an unenforceable order. For example, if you’re trying to specify a visitation plan in your original order, detailed information and specific parenting time tables will make a big difference in enforceability of the order. If you simply state “Reasonable visitation,” you are doomed when it comes to trying to interpret what the order means at a later time. 2. Document violations of the order. Before returning to court on a violation, you should have a record of how the court order was not followed by the other side. Send an email or letter to the other side describing what the order was, along with facts on how the other party has not complied with the order. Give the other side an opportunity to remedy the problem with a specific deadline and state the consequences. You can use a copy of the written communication as an exhibit to your enforcement motion. If you’re having difficulty following an order yourself, set out in writing what part of the order isn’t being followed. Memorialize those events by sending something in writing to the other side establishing that fact. This written information will be helpful when you go to court since you can attach the information as exhibits to your request for enforcement. 3. Specify in your enforcement motion what remedies you would like to resolve the non compliance problem. You are now at the stage where you are returning to court and are ready to file a request for orders. Of course you’ll be including in your Judicial Council forms the reasons why you’re returning to court but just as importantly, you should include in your enforcement motion proposed solutions on how to remedy the problem that you’ve encountered. For example, if the other side hasn’t paid certain bills or hasn’t paid support, you should not only specify all of the amounts that were due but also lay out in your declaration the best approach on how these overdue amounts can be paid to you. The same should be done for visitation and other problems. For example, if there’s been difficulty communicating with the other parent, you might want to propose co-parenting counseling and a return hearing date in case the counseling process is unsuccessful. If you apply these three principles, you have a very good chance of getting the relief that you may want to return to court on an enforcement order. The best chance you could ever have on accomplishing the outcome that you seek would be through the assistance of an experienced family law attorney.

Inventor, teacher, writer, husband and father, John J Muir— b bl the h country’s ’ most extreme naturalist—made li d his hi home h probably in Martinez from 1880 until his death in 1914. Married to Louie Strentzel, the daughter of a fruit rancher who owned 2,600 acres in the Alhambra Valley, Muir took over the family business in 1882. After the former Wisconsin farmer made enough in a ten-year period to last his entire lifetime, Louie convinced him to turn the daily operations of the ranch over to her so that Muir could return to his first love—travel and conservation—which eventually led to the development of the National Park Service. Today guests can wander the grounds of the Muir house, which now sits on a 9-acre park, tour the Muir home and walk through what remains of the orchards. The trees still produce a limited amount of fruit which guests are welcome to enjoy. Start your tour of the Muir site at the visitor center. There you can watch a 20-minute video that gives an overview of Muir’s life and works. A paved path will take you around the grounds and up to the house. Along the way, take time to listen to the self-guided cell phone tour that will give you insight to what life was like when the Muirs lived there. The home itself is cozy and open all day to welcome guests. Tour the house on your own (there are no cell phone stops in the house) or take a ranger guided tour at 2pm each day. A park ranger is in the house at other times to answer questions.
Bringg a picnic p to eenjoy in the orchards, h d over to Mount M or head Wanda, named after Muir’s eldest daughter, which consists of 326 acres of oak woods and grasslands. The out-and-back hike is approximately 3 miles long with about 500 feet of climbing up to a view of the Carquinez Straits. Dogs on leash are allowed. A second national historic site, The Martinez Adobe, is located on the western edge of John Muir’s historic orchards. Once where Wanda Muir made her home, the building now features bilingual exhibits from the Juan Bautista de Anza National Historic Trail. Here you can learn about the Anza Expedition, when Spanish Lt. Colonel Juan Bautista de Anza led 240 men, women and children up the California coast in 1775. Things to know: John Muir National Historic Site is located at 4202 Alhambra Avenue in Martinez. It’s open daily from 10am to 5pm. Closed Thanksgiving, Christmas and New Year’s Day. Admission is free. No food or drinks are available for purchase. Restrooms are located in the visitor center. The visitor center and the first floor of the home are wheelchair accessible. Find Mount Wanda Ÿ mile south from the visitor center on Alhambra Avenue. There is a parking lot at the trail head next to Franklin Canyon Road. Mount Wanda is open daily sunrise to sunset, but has no water or restrooms. MIXED GRAIN
Dolsot with Salmon Bibimbap served in a sizzling stone bowl from Mixed Grain in Walnut Creek.
EATING WELL IS EASY!
If your new year’s resolution to eat better has fallen by the wayside, we have some dining out options for March that will help reboot your efforts. By Janet Fazio
It’s easy to get your daily requirement of veggies at Walnut Creek’s Mixed Grain. The Bibimbap and the Dolsot are the stars here. Made to order, the large bowls are filled with carrots, spinach, bean sprouts, cucumbers, zucchini, mushrooms, radishes and purple cabbage. Choose your rice, then add beef, chicken, pork or seafood. The entire concoction is topped with a sunny side up egg. I ordered the dolsot with salmon, which is the bibimbap, served in a sizzling stone bowl so the bottom layer of rice gets crispy crunchy. The salmon was perfectly done and the veggies still al dente. The menu also includes a variety of small plates & sides. BBQ and noodles are available. Open daily. Lunch is served 11:30am-3pm. Dinner hours are 4-10pm. Entrées start at $11. Beer and wine only. MixedGrain. com or 925.938.5959.
MUSCLE MAKER GRILL
For quick meals with your health in mind, check out San Ramon’s Muscle Maker Grill. Each of their items includes its calorie content on the menu. I opted for the Godfather, which is a large, grilled chicken breast topped with mushrooms, roasted peppers and reduced fat mozzarella served on a bed of broccoli. The chicken had great flavor, and for only a 410 calorie splurge, I was completely satisfied. If you want, add a healthy fat with a side of guacamole. Muscle Maker Grill only uses grass-fed beef and all natural chicken. Protein shakes, smoothies, wraps, power pastas, salads and entrées are all on the menu. Open daily, 10am-9pm (8pm on Sunday). Entrées start at under 400 calories for $5.99. Order at MuscleMakerGrill.com or call 925.277.1264.

BLOSSOM VEGAN
If you haven’t been to Blossom Vegan in Pleasanton, you’re missing out. I was a bit skeptical, as I prefer meat with my veggies, but I was quickly won over. The menu includes many choices, some of which feature a meat substitute, and others that let the veggies shine on their own. I opted to stick with veggies, starting with an order of spring rolls filled with lettuce, shredded carrots, jicama and avocado served with a side of peanut sauce. For my entrée, I enjoyed the curried vegetables with broccoli, carrots and cabbage cooked in a coconut curry sauce. Both dishes had lots of flavor, great texture and were completely satisfying sans meat. Wednesday-Friday, 10am9pm and weekends 11am-9pm. No alcohol. Entrées start at $8.95. BlossomVegans.com or 925.399.5232.
DEMITRI’S TAVERNA
Sargam Indian Cuisine
Livermore Demitri’s Taverna is a great choice if Mediterranean fare is on your meal plan. Demitri’s Bifteki, a large charbroiled patty of savory ground chuck and lamb mixed with fresh herbs, is one of my favorites. The meat is flavorful on its own, but even better topped with grilled onions, tomatoes and a side of tzatziki. It’s normally served on a pita with a side of fries, but you can substitute a salad for the fries and opt out of the pita to make it a lower calorie choice. Several other healthy choices, including kabobs, lamb chops, grilled chicken and many salad entrée options round out the menu. Monday-Thursday, 11am9pm, Friday 11am-10pm and Saturday and Sunday 11:309pm. Full bar. Entrées start at $13.75. DemitrisLivermore. com or 925.373.0306.

UNCONDITIONAL LOVE IS AS CLOSE AS YOUR NEAREST SHELTER Contra Costa Animal shelter has one of the highest reported intakes in the Bay Area averaging 14,000 animals per year since 2008. The live-release rate -- the statistic that tracks shelter animals that are adopted or returned to owners was 68 percent in 2013. This is consistently one of the lowest in the bay area. The Mission of ARF People Rescuing Animals... Animals Rescuing People...® ARF saves dogs and cats who have run out of time at public shelters and brings people and animals together to enrich each others lives. ARF strives to create a world where every loving dog and cat has a home, where every lonely person has a companion animal, and where children learn to care. ARF is a national leader in the animal welfare industry co-founded by Elaine and Tony La Russa in 1991. Headquartered in Walnut Creek, California, the nonprofit receives no government funding and is an accredited four-star charity. ARF’s core mission is the rescue of dogs and cats who have run out of time at public shelters, giving them a chance at life until a new home can be found. ([KLELW 1RZ 2SHQ :HGQHVGD\ 6XQGD\ ‡ DP SP This permanent 26,000 square foot exhibition displays exceptional artifacts with experiences of the High Plains Indians and the Euro-Americans at end of the 19th century until the dawn of the 20th century. The Indian side explores the themes of family, spirituality, ceremony, leadership and war while the Euro-American side chronologically tells the stories of early Western trappers and explorers, emigrants, pioneers, cowboys, the frontier army, outlaws and Buffalo Bill. Wildlife dioramas and original mural paintings enhance the visitor’s experience. The main focal point of the exhibition is a massive 140 foot long topographic table with over 9000 miniature figures that further helps to tell the story of the Old West. A tepee and a prairie schooner will act as gathering places for school kids to learn about the life and culture of the High Plains Indians and the pioneers making the arduous journey across the West. Visit the museum for an unforgettable experience into the past.

Percussionist Ken Bergmann’s smashing spectacle of drums, cowbells, chairs and more incorporates instruments from around the globe. The popular family-oriented show features a hysterical romp through the sound effects of Hollywood, a unique look at the computer age, all the flash one would expect from a drummer gone amok and for no apparent reason, a cymbal clanging monkey. Bergmann will have audiences doing more than just tapping the their feet. He’ll have them out of their th seats and on the stage producing the roar of thunder, the tap of footsteps, thun and a rumbling locomotive.
