Five Divorce Myths In answering questions for many clients considering divorce, I found there are a number of myths that need to be dispelled. This article is an attempt to address some key divorce myths I regularly encounter: 1. It matters if they cheated. In California, infidelity has no relevance to pursuing a divorce action. In 1971, California law was modified to allow either party to seek a divorce based upon irreconcilable differences, which can mean anything to anybody, including just drifting apart. Unless the parent’s behavior is out of control, it is highly unlikely that the court would consider any claim that a parent’s time with the children should be restricted. 2. You just need to fill out a few forms and submit them to the court and the court does the rest. While it is true that California prides itself on simplifying the Judicial Council forms that are submitted for processing divorce actions, properly completing those forms is not just an “add water and stir” event. An accurate understanding of the law and how it applies to those forms is crucial to properly proceeding on your family law matter. 3. Everything must be split equally. Division of property doesn’t have to be exactly penny for penny. The parties can even agree to an unequal division for many reasons. Sometimes an unequal division is adopted by the parties and approved of by the court for the purposes of making compromises on support amounts, satisfaction of community debt and for other equitable justifications.

4. It’s best to start hiding things. Any attempt to hide assets from the other spouse will only turn into bad news for the bad actor. If the court determines that there’s been a concealment of an asset, the person committing this offense could lose their share of the property to the other spouse as well as pay attorney’s fees and sanctions for their misconduct. 5.The kids always go to the mother. Family law courts have caught up with the concept of joint parenting and blended families. The result of this more modernized appreciation of both parents playing a significant daily role in a child’s life produces many different custody arrangements where both parents can maintain an active role in the child’s life. A SoCal favorite, Burger Lounge opened in Walnut Creek this spring much to the delight of burger enthusiasts. Aficionados will appreciate that the menu features 100% single source, American grass-fed beef, organic cheese, cagefree chicken and turkey, and nitratefree bacon. I ordered the lounge burger with white cheddar cheese, grilled onions, lettuce, tomato and house made Thousand Island dressing. I opted to add Applewood bacon to mine. The juiciness factor was fabulous. It wasn’t too drippy, but I definitely needed multiple napkins. Instead of fries, I wanted to try the onion rings, which had noticeable seasonings mixed in with the batter. If you are an onion ring fan, you’ll like these. Burgers start at $7.99. San Francisco’s Beep’s Burgers headed to the suburbs this summer, moving into the “burger spot” in Danville’s Blackhawk Plaza. With a more limited menu than its city counterpart, burgers here feature 100% Neiman Ranch hormone and antibiotic free beef. The signature Beep’s Burger comes with lettuce, tomato and Beep’s sauce. Add cheese, bacon and grilled onions if you’d like. I had mine with a generous serving of fries. Cooked medium, the burger had good flavor. If you want more of a tidy burger, you’ll love Beep’s where the drip factor is minimal. The crispy chicken salad, which consists of a fried chicken breast sliced and served on a bed of jalapeño cole slaw, is notably good. Go ahead and indulge. The name pays homage to the year the city was incorporated. I’m not a beer expert by any means, but I loved my flight of brews from a selection of options that are crafted in-house. The flight paired perfectly with an order of spicy wings served with a side of cooling, blue cheese dressing. The Dublin burger features a six-ounce patty topped with sharp cheddar, onion rings, tomatos, onions and pickles. It comes with a side of fries. FORT FUNSTON A

fter last winter’s deluge, followed by record heat this summer, it’s anyone’s guess as to what fall will bring, so we might as well make the most of it and head outside to explore while we still can. Fort Funston is a former military harbor defense installation turned Golden Gate National Recreational Area. If you’ve never been, now is a perfect time to go. Just prepare to be swept away - literally! Located in the southwestern corner of San Francisco, Fort Funston is up in the bluffs. Because of this, it’s consistently windy. These 200-foot bluffs make Fort Funston a prime spot for hang gliding, especially in October and March when conditions are optimal. Even if

you don’t hang glide, it’s a fun sport to watch. To catch upclose views, head to the launch area or wheelchair-accessible viewing deck. Be sure to stay in the designated areas and heed the posted cautions about the unstable cliffs. If you prefer hiking to hang gliding, Fort Funston offers that also. There are paved trails as well as sand dune trails. If you want to be on the pavement, hike the Funston Trail, which is a 1.9 mile loop trail that’s popular with both man and beast. Dogs are permitted to be off-leash at Fort Funston, making it a prime destination for dog walkers. All the dogs I encountered while there were friendly and mostly well-mannered.

Funston Trail is partly in the sun and shade, so prepare for both. The trail is considered wheelchair-accessible because of the pavement. Due to the wind, however, drifting sand covers portions of the pathway, which may cause difficulty for wheelchairs and strollers. Picnic tables are located along the shaded portion of the path. There are also paths leading down the dunes to the beach. The dunes are steep and the sand is soft. Wear appropriate footwear and prepare, if necessary, to scramble. When you make it down to the water, be mindful of the surf and undertow. While the hang gliders give us something to gaze up at, Mother Nature encourages us to look

down. The sand dunes are home to unique plants that can survive in the harsh conditions. It’s not every plant that can thrive in the sand. Additionally, swallows dig holes and nest in the sandstone cliffs. From March to June, these endangered species raise their young here. In the months of July and August, the chicks fly from the nest, with their parents trailing behind. You may want to bring binoculars for a closer look. If you go: There is no fee for entry or parking, making this a very attractive Daycation. Park in the lot off Skyline Boulevard. Bring a lightweight coat or sweater as the wind can be chilly. Western Railway Museum’s

Pumpkin Patch Festival

Weekends, October 7th - 22nd

Each Saturday and Sunday from October 7-22nd, the Western Railway Museum presents its annual Pumpkin Patch Festival. This classic harvest festival is a highlight of autumn, and for many, a family tradition. The Museum opens at 9:30am. The first express train leaves the Museum at 10am, with departures every half-hour until 4pm. The ride on a historic life-sized electrical-powered train takes visitors back in time 100 years on a scenic five-mile trip to Gum Grove Station, a wooded glen far from the trappings of modern life. At Gum Grove, guests can experience the huge hay bale fort, food, tractor rides, music, games and of course, pumpkins for sale, just in time for Halloween. It’s a real community effort, with three individual Rotary Clubs (Fairfield-Suisun, Cordelia, and Dixon), and 100 Museum volunteers all rallying together to make the event a success. All proceeds from ticket sales benefit the Western Railway Museum (a nonprofit educational institution) and the local Rotary Clubs who re-grant thousands of dollars to our community and youth activities each year.
