Man commits suicide in Ganderbal Srinagar July 31: A 50 years old Abdul Gani son of Mohammad Ibrahim Khan resident of Nai Basti, Bailawosan, Gutlibagh, Ganderbal consumed some poisonous substance at his home. He was shifted to SKIMS, Soura, for treatment, where he expired. The body was handed over his relatives after completing all legal formalities.

Increased 150 MBBS seats to be filled from this academic session: Taj Srinagar, July 31: The recently enhanced intake capacity of the state run medical colleges in the state would be made operational from this academic session only. Minister for Medical Education, Youth Services & Sports, Mr. Taj Mohi ud Din, who had pursued the enhancement of seats in the J&K medical colleges in view of the increased demand of medicos, today directed the J&K Board of Professional Entrance Examination (BOPEE) to include the 150 MBBS seats also which

were increased by the Medical Council of India (MCI) recently.

This follows a letter of confirmation of seats’ increase in the state run medical colleges of J&K from the

Board of Governors of MCI received today. Immediately, the Minister directed the BOPEE to make necessary arrangements to include these seats also while framing the merit lists of the entrance test for which the students appeared last week only and not let the seats go lapsed.

It may be recalled that the MCI had recently decided to increase the intake capacity of Government Medical Colleges of Srinagar and Jammu from 100 to 150 and that of SKIMS Medical College, Bemina from 50 to 100.

Sagar inaugurate e-Hospital project in JLNM hospital Rainawari Say all hospitals to get this hi-tech service in phased manner SRINAGAR, JULY 31: Hi-tech computerized services was started Wednesday in JLNM hospital Rainawari under the first phase of centrally sponsored e-Hospital Project.

The Service was inaugurated by Minister for Rural Development and Pyanchati Raj, Ali Mohammad Sagar in presence of Minister of State for Health.

Mission Director J&K, NRHM, Dr. Yashpal Sharma, Controller Drugs and Food Organization, Satish Gupta, Managing Director Information Technology, Suresh, Medical Superintendent, Dr. Iqbal, Dr Muhammad Abdullah Deputy Director Health Services Kashmir, Medicos, Para-medico of JLNM, hospital and senior officers of Health Services, Kashmir besides prominent citizens of the area were also present on the occasion.

Appreciating the initiative taken by the J&K National Rural Health Mission, the Rural Development Minister said that this would prove much beneficial in disseminating day to day work of the hospital and would provide quick health services to the patients in the hospital.

He congratulated the management of the hospital for attaining the distinction of being the first hospital in the Valley to have the prestigious services.

The Minister said that this will help in maintenance of records, creation of Data base for research, quick handling of registration, compilation of day-to-day data base and Information regarding registration of patients. He underscored the need for extending the e-hospital facility to other hospitals of the State.

Sagar said that government under the leadership of Chief Minister Omar Abdullah has made tangible achievements in upgradation of healthcare facilities during last over 4 years in

the state. He said that expansion of Lalla Ded Hospital, Children Hospital, Rainawari Hospital and other district hospitals has provided much relief to the patients in their treatment at their areas.

He appreciated the efforts of State Health Minister which he taken to improve and upgrade healthcare facilities in the hospitals. He also underscored the need for timely completion of upgradation work of JLNM hospital. He called upon medicos and para-medicos to work with more missionary spirit for the welfare of the patients.

The e- Hospital project @NIC Suite is a web based solution using Free Open Source Software (FOSS) tools for managing healthcare service delivery in public hospitals to accelerate infusion adoption of ICT tools and maintain healthcare standards. Giving further details, the State Health Minister said the project has been funded under National Rural Health Mission for managing healthcare service delivery in public hospitals and to maintain healthcare standards. He said the e-Hospital project costing Rs 6.5 crore has to be implemented in two phases covering four modules, including outdoor patient and in door patient, emergency and billing in the first phase and store management, Radiology and Lab services in phase second. “So far the e-hospital projects have been implemented in only two hospitals of the State, including Government Hospital JLNM, Rainawari and Gandhi Nagar, Jammu with26,000 and 40,000 registrations, respectively”, Shabir said.

an being a social animal learns from the mistakes of history. Now, perhaps, the society including Media has started introspecting the impex of violence on the mindset of one generation born during the turbulent period. Everyday, one comes across some spine-chilling incident or the other- whether youths committing suicide, pushing themselves to the dark gorge or drugs, brutally killing relations, friends for money or property. The rapidly growing criminalization in the society has left the old rather middle aged generation in lurch on this sordid state of affairs from where there is no way back to the same secular and Sufi culture of the valley, known for all over the world. Media, except for official media towards which no one ever paid any heed in that surcharge display of emotions and sentiments, suppose to be the fourth pillar of democracy, remained silent at a time when corrective measure could have helped a lot to set the plague right. But it missed chance due to various obvious reasons. The irrational following to extra political sloganeering by some disgruntled leaders, sanctified violence to such an extent that society today stands at such a cross road where there is nothing except darkness and a spineless, limping society with an ‘army’ of physically and mentally disabled, sallow faced youths in trance intoxicated with hype passions of escapism, cynicism, having bitter and passive attitude, with no spark in life to stride against the tides. The optimistic society with higher goals set can only strive hard and excel in world. What can a society attain where nearly two lakh youths including thousands of young women are in spate of drug addiction? The situation instead of improving is rather worsening with every passing day due to lack of proper health care facilities especially for psychological diseases. Very oftenly, government or system is blamed for these lacunas. But one has yet to come across a ‘self-destructive’ society like Kashmir which set ablaze temples of education, health care, government institutions meant for the welfare of the common masses with its own hands for speculative dreams of freedom. The Kashmiris known for hard work, honesty, hospitality and all other virtues are now labeled with passivity, corruption, drug smuggling, violence, crime and what not.

How and when did the ‘work culture’ vanish from this land? Which are the factors responsible for this? The answers to these questions lie within ourselves provided we see and introspect the past happenings without rose-tainted glasses and with full honesty as what are the gains and losses of the past two decades’ struggle. Other than the civil society governmental institutions, rising above the political interests and brickerings, should solve the political and social issues with rationality and moderation. Let the society again epitomize honesty, love, passion, communal harmony, respect, honour and justice for all the communities living in this beautiful land with positive attitude towards life.

Electoral Laws of India

ndia is a sovereign, socialist, secular democratic republic. Democracy is one of the inalienable basic features of the Constitution of India and f orms part of its basic structure (Kesavanand Bharati v State of Kerala and Others AIR 1973 SC 1461). The concept of democracy, as visualized by the Constitution, pre-supposes the representation of the people in Parliament and State Legislatures by the method of election (N P Punnuswami v Returning Officer Namakkal AIR 1952 SC 64). For democracy to survive rule of law must prevail and it is necessary that the best available men should be chosen as people’s representatives for proper governance of the country (Gadakh Yashwantrao Kankararao v Balasaheb Vikhepatil AIR 1994 SC 678).

And for the best available men to be chosen as people’s representatives, elections must be free and fair and conducted in an atmosphere where the electors are able to exercise their franchise according to their own free will. Thus, free and fair elections form the bedrock of democracy.

India has adopted the British Westminster system of parliamentary form of government. We have an elected President, elected Vice-President, elected Parliament and elected State Legislature for every State. Now, we also have elected municipalities, panchayats and other local bodies.

For ensuring free and fair elections to these offices and bodies, there are three prerequisites: (1) an authority to conduct these elections, which should be insulated from political and executive interference, (2) set of laws which should govern the conduct of elections and in accordance whereof the authority charged with the responsibility of conducting these elections should hold them, and (3) a mechanism whereby all doubts and disputes arising in connection with these elections should be resolved.

The Constitution of India has paid due attention to all these imperatives and duly provided for all the three matters. The Constitution has created an independent Election Commission of India in which vests the superintendence, direction and

control of preparation of electoral rolls for, and conduct of elections to, the offices of President and Vice-President of India and Parliament and State Legislatures (Article 324). A similar independent constitutional authority has been created for conduct of elections to municipalities, panchayats and other local bodies (Articles 243 K and 243 ZA).

The authority to enact laws for elections to the offices of President and Vice-President and to Parliament and State Legislatures has been reposed by the Constitution in Indian Parliament (Articles 71 and 327).

Laws relating to conduct of elections to municipalities, panchayats and other local bodies are framed by the respective State Legislatures (Articles 243 K and 243 ZA).

All doubts and disputes relating to the elections to the office of President and Vice-President are dealt with by the Supreme Court (Article 71), whereas the initial jurisdiction to deal with all doubts and disputes relating to the elections to Parliament and State Legislatures vests in the High Court of the State concerned, with a right of appeal to the Supreme Court (Article 329).

The disputed matters relating to elections to municipalities, etc. are decided by the lower courts in accordance with the laws made by the respective State Governments. The law relating to the elections to the offices of President and Vice-President of India has been enacted

by Parliament in the form of Presidential and Vice-Presidential Elections Act 1952.

This Act has been supplemented by the Presidential and Vice-President ial Elections Rules 1974 and further supplemented by the Election Commission’s directions and instructions on all aspects.

Conduct of elections to Parliament and State Legislatures are governed by the provisions of two Acts, namely, Representation of the People Act 1950 and Representation of the People Act 1951.

Representation of the People Act 1950 deals mainly with the matters relating to the preparation and revision of electoral rolls.

The provisions of this Act have been supplemented by detailed rules,

Registration of Electors Rules 1960, made by the Central Government, in consultation with the Election Commission, under Section 28 of that Act and these rules deal with all the aspects of preparation of electoral rolls, their periodic revision and updating, inclusion of eligible names, exclusion of ineligible names, correction of particulars, etc. These rules also provide for the issue of electoral identity cards to registered electors bearing their photographs at the State cost. These rules also empower the Election Commission to prepare the photo electoral rolls containing photographs of electors, in addition to their other particulars.

All matters relating to the actual conduct of elections are governed by the provisions of the Representation of the People Act 1951 which have been supplemented by the Conduct of Elections Rules 1961 framed by the Central Government, in consultation with the Election Commission, under Section 169 of that Act. This Act and the rules make detailed provisions for all stages of the conduct of elections like the issue of writ notification calling the election, filing of nominations, scrutiny of nominations, withdrawal of candidatures, taking of poll, counting of votes and constitution of the Houses on the basis of the results so declared.

The superintendence, directions and control of elections vested by the Constitution in the Election Commission empowers the Commission even to make special orders and directions to deal with the situations for which the laws enacted by the Parliament make no provision or insufficient provision. The classic example of filling such vacuous area is the promulgation of the Election Symbols (Reservation and Allotment) Order 1968 which governs the matters relating to recognition of political parties at the National and State level, reservation of election symbols for them, resolution of disputes between splinter groups of such recognised parties, and allotment of symbols to all candidates at elections, etc.

Another such vacuous area where the

Election Commission exercises its inherent powers under Article 324 of the Constitution is the enforcement of the Model Code of Conduct for guidance of political parties and candidates. The Model Code is a unique document evolved by the political parties themselves to govern their conduct during elections so as to ensure that a level playing field for all political parties is maintained during elections and, in particular, to curb the misuse of official power and official machinery by the ruling party(ies) to further the electoral prospects of their candidates.

All post election matters to resolve doubts and disputes arising out of or in connection with the elections are also dealt with in accordance with the provisions of the Representation of the People Act 1951.

Under this Act, all such doubts and disputes can be raised before the High Court of the State concerned, but only after the election is over and not when the election process is still on.

The above mentioned Representation of the People Acts 1950 and 1951 and the Registration of Electors Rules 1960 and Conduct of Elections Rules 1961 form complete code on all matters relating to elections to both Houses of Parliament and State Legislatures. Any person aggrieved by any of the decisions of the Election Commission or the authorities functioning under it has to find a remedy in accordance with the provisions of these Acts and Rules.

These Acts and Rules enable the Election Commission to issue directions and instructions to deal with various aspects of the preparation/revision of electoral rolls and the conduct of elections and lead all such matters of detail to be dealt with by the Commission. Pursuant thereto, the Commission has issued a plethora of directions and instructions which have been consolidated by the Commission in various compendia and the handbooks for the Electoral Registration Officers, Returning Officers, Presiding Officers, candidates, polling agents and counting agents.

Migraines do not hurt your brain

Migraines are not associated with cognitive decline, suggests new research even though previous studies have linked the disorder to increased stroke risk and structural brain lesions.

Migraines affect about 20 percent of the female population, and while these headaches are common, not much is known about this complex disease.

"Previous studies on migraines and cognitive decline were small and unable to identify a link between the two," said Pamela Rist, research fellow in preventive medicine at Brigham and Women's Hospital (BWH), who led the study.

"Our study was large enough to draw the conclusion that migraines, while painful, are not strongly linked to cognitive decline," said Rist,

the British Medical Journal (BMJ) reports.

The research team analysed data from the Women's Health Study, a cohort of nearly 40,000 women, 45 years and older. In this study, researchers analysed data from 6,349 women who provided information about migraine status at baseline and then participated in cognitive testing during follow-up, according to a BWH statement.

Participants were classified into four groups: no history of migraine, migraine with aura (unpleasant smell, seeing flashing lights), migraine without aura, and past history of migraine. Cognitive testing was carried out in two-year intervals

up to three times. "Compared with women with no history of migraine, those who experienced migraine with or without aura did not have significantly different rates of cognitive decline," said Rist.

"This is an important finding for both physicians and patients.

Patients with migraine and their treating doctors should be reassured that migraine may not have long-term consequences on cognitive function.

For 20 minutes, the scientists played a stream of syllables to babies while measuring their brain responses using electroencephalography (EEG).

Delhi gangrape: SC asks Swamy to inform JJB to defer verdict involving juvenile New Delhi, Jul 31 (PTI) The Supreme Court today said that the Juvenile Justice Board (JJB) be informed not to pronounce its verdict on the alleged role of a minor in the December 16 gangrape and murder case, till it decides a PIL seeking fresh interpretation of the term 'juvenile'.

A bench headed by Chief Justice P Sathasivam asked Janata Party president Subramanian Swamy to inform the JJB on this issue and posted his case for hearing on August 14.

Advocate Anoop Bhambani, appearing for the juvenile, opposed Swamy's plea and sought more time to file response to his petition.

The Centre also opposed Swamy's plea, saying a third party should not intervene in a criminal case and any decision taken by the apex court in this case cannot be applied retrospectively.

The bench, however, said the issue raised in the petition needs to be examined along with

maintainability of the plea.

Swamy has sought that the "mental and intellectual maturity" of minor offenders be considered instead of the age limit of 18 years while fixing their culpability.After the apex court had on July 23 agreed to hear his plea, the JJB had deferred till August 5 the pronouncement of its verdict on the alleged involvement of the juvenile accused in the December 16 gangrape and murder case.The juvenile was one of six persons who had gangraped a 23-year-old girl in a moving bus here, according to the prosecution. The victim died in a Singapore hospital on December 29.Of the other five accused, four--Mukesh, Pawan Gupta, Vinay Sharma and Akshay Thakur--are facing trial before a fast track court. Proceedings against key accused Ram Singh abated after his death on March 11 when he was found hanging in his cell in Tihar Jail here.
