Srinagar, Dec 20 : Fire broke out in the cowshed of Shahbaz Ahmad Bhat son of Sonaullah Bhat resident of Bomie, Sopore, in the jurisdiction of police station Bomie, resulting in partial damage to the cowshed. However, no loss of life or injury was reported in this incident.
Unidentified body recovered in Sopore
Srinagar, December 20: Sopore police recovered an unidentified male body near on a road side at Hygam, Sopore. During intervening night of 19th and 20th December, Sopore police recovered a male body of age about 55 years who was not wearing any clothes. The deceased was reported to be roaming in the Choora area few days back. Post Mortem of the body was conducted which reveals that the person has died of Hypothermia. NC changes gears, terms UN resolutions relevant Says Kashmir solution need of the hour
Srinagar, Dec 20 : Echoing the claims of valley’s pro-freedom camp, National Conference Friday claimed that the resolutions adopted by United Nations, in past, for Kashmir issue have ‘relevance’ even during the present political scenario of Jammu and Kashmir. “The UN resolutions are still relevant and that is the reason that we see the office of the United Nations Military Observers Group (UNMOG) here in valley since last six decades. The resolutions adopted by UN about Kashmir cannot be termed obsolete,” said Kamal, adding that the Kashmir issue has become the bone of contention between India and Pakistan and its resolution has become inevitable. He further stated that it is because of the UN resolutions that India cannot move
inside Pakistan administered Kashmir (PAK) and vice-versa. “It is UN that has prevented both the courtiers to enter into confrontation against each other about Kashmir.” He further added that both the countries must come forward and prioritize their respective efforts so that Kashmir issue
could be resolved at the earliest. “We see how may wars have been fought between the two countries over Kashmir and at present the need of the hour is to resolve it on table otherwise the things could get worse.” “Had the Pakistan restrained from sending rebels here, Kashmir would have been the independent country with sovereign powers and full authority but as the Kabailis landed into valley, Hari Singh sought help from India to safeguard his country and people,” Senior NC leader said. PDP for active involvement of youth in governance NC responsible for uncertainty in J&K: Mehbooba Jammu, Dec 20 : Peoples Democratic Party (PDP) president, Mehbooba Mufti has said employment generation for youth will be the main focus of her party’s economic goals if it gets a decisive mandate from the people in the coming elections. Addressing a public meeting at Lam in Nawshera constituency of Rajouri district she said the youth of J&K can rewrite a new destiny for themselves and for the state, if they are involved fully in the system and given due opportunities where they

Taj inspects site for Tertiary Cancer Centre Jammu Jammu, Dec 20 : Minister for Medical Education, Youth Services & Sports, Mr. Taj Mohi ud Din today visited the Super Specialty Hospital, Jammu and inspected the site of the proposed Tertiary Cancer Centre being set up there. The Centre is one among the two Tertiary Cancer Centres being set up under the National Cancer Control Programme in J&K. One such centre would be set up at SKIMS, Srinagar while another would be set up at Super Specialty Hospital Jammu. The Minister went round the Hospital and took stock of the availability of space and other logistics for the setting up of the Cancer Centre. He also reviewed the feasibility of setting up of units like Day Care, PET Scan, bunkers for radiation, emergency etc for the centre. To be set up at a cost of Rs. 45 crore, the centre would have facilities of PET Scan and Linear Ac-
celerator which are used in cancer screening. At present, there is no PET Scan and Linear Accelerator facility available in the State and the patients have to go to outside the State for the same. JK Cement’s new plant a disaster; Govt in slumber Srinagar, Dec 20 : Despite the tall claims of the state government for improving the corporation sector to generate more employment, a state owned corporation, Jammu Kashmir cements Ltd- new plant established with great expectations in Khrew allegedly proved to be an utter failure. Reliable sources told KNS that the new plant at Khrew Pampore was established in 2006 with an expected production of 600 tons of cement but due to alleged corruption by some big fishes its existence is on the verge of end. In a shocking revelation an official source, (while comparing the expenditure of a leading private company which spend approximately 70 crore on a same type of plant in Khrew) disclosed that a huge amount of 1,25,00000,00 was released for the construction of the said plant. Reacting to the recent statement of Peoples’ Democratic Party (PDP) president Mehbooba Mufti wherein she has stated that NC facilitated Kashmir’s accession to India because Jinnah didn’t offer any chair to Sheikh Mohammad Abdullah, Kamal said that the PDP president has issued historically incorrect statement. Kamal added that PDP has launched the tirade of accusations against NC on baseless grounds and that the party’s rhetoric is sans credibility. “The history stands witness to the fact that Shiekh sahib along with other colleagues went to Pakistan and Jinnah didn’t even bother to meet them. This revealed the mindset of the Pakistani leadership vis-à-vis Kashmir. ” Kamal added that historical records are available and that people can themselves analyze the veracity of the statements being issued from the desk of certain quarters about Kashmir’s accession to India.

Mr Togadia was prevented from delivering a speech in Jammu in view of its repercussions on public peace.” Mr Prasad added: “Mr Artun Jaitley the member parliament was stopped from visiting Kishtwar and he had every right to visit the place but we were unable to provide him security and we were very apprehensive that it will create problems. When Mr Jaitely was prevented to visit the place despite being an MP who is Geelani? He is not an elected representative. Wherever he goes he legalizes stone pelting, use of gun and other things. How can that be allowed under law. We stopped people from NC, PDP and Congress from visiting Kishtwar and it is not that we apply law to a single person,” he asked.Regarding reports about government of Argentina having secretly probed the presence of mass graves in Kashmir, the DGP said the veracity of the reports needs to be inquired into thoroughly. “This is a matter which needs to be inquired and nobody knows the details except for what has been published in a local daily that too wherefrom it has lifted the issue. The issue is whether reporting about mass graves in Kashmir is based on facts? This is an effort to try to bring other players into the game. Is there a mass grave in Kashmir? Mass graves and unmarked graves are two distinct things. Unmarked graves is a normal thing in Kashmir but some people want to create an issue out of this. A mass grave is where you burry a large number of bodies together in a single large grave and the concept came from world wars. To the best of my knowledge the largest mass grave here consists of six people who were drowned militants who had infiltrated this side of the border,” he added. Mr Prasad said: “Show us a single grave where the body of a person who got killed was not investigated and the body handed over to Auqaf for burial.
Ms. Sakina in his address said that development of backward and remote areas has remained under active consideration of the government during the last about five years and various schemes to improve and upgrade road communication, water supply, electric supply, health and education sectors received focused attention besides creating number of job opportunities for youth under various innovative measures. She said that government has left no stone unturned for the people prosperity for launching number of development and welfare schemes.

She said, to provide modern educational facilities at the door step students, the PDP during its stint in the government established new universities, opened dozens of colleges, established skill enhancement and technical institutes in every nook and corner of the state. “There was need of more research, professional and technical institutions that will help in producing quality human resource for the state,” she said. Mehbooba said tourism, agriculture and horticulture are the areas of strength of J&K and these sectors offer huge employment avenues and the PDP will harness them to optimum to make the state self-reliant. She said the Rajouri and Poonch districts offer a huge potential for tourism and horticulture, but it has so far, remained untapped, but the PDP will go for robust, planned industrialization in the area, which would not be having any negative impact on the environs around. She said PDP during its tenure in the government established more than one dozen tourism development authorities for the backward areas, but those have been left useless by the present government. Because of the lack of money these authorities have not been able get the desired results on the ground. “Instead of planned development of these areas, the present government has facilitated vandalisation of tourist areas either for money or to favour its agents or relatives of ruling politicians”.

Stringent laws needed to save Kashmir Handicrafts

ashmir was famous for its handicrafts throughout the world and our master craftsmen were not only a symbol of art but also respected for their honesty and purity. The carpets, shawl, the sozni, woodcarving everything was matchless and nobody in the world would produce such a fine, delicate and artistic pieces of work. It is said that once the king of Britain had to present a gift to the queen and he choose Kashmiri shawl for the purpose. The Kashmiri carpet though second to Iranian carpet had its market throughput the world and nobody at any stage would suspect anything wrong in these pieces of art and hand produced by Kashmiris. However with the passage of them the dishonesty, greed and the lust for money started destroying our handicrafts and the masterpieces produced by Kashmiri artisans gradually vanished and were substituted by those pieces which were never pure in quality and of the standard Kashmiri handicrafts sector had reached after centuries of toil and hard work. One is surprised and shocked to know that the shawls manufactured on machines in Amritsar are being brought by Kashmiri people and are then sold in the name of Kashmiri shawl, thus deceiving the customers who with the time have understood the mischief played with them. These dishonest acts have cost darely on our handicraft sector and now people are not easily believing when a Kashmir art piece is presented before them. There are always doubts in the minds of customers with the result the overall industry is suffering heavy losses. The decrease in the demand of Kashmir handicrafts has forced many artisans to leave the craft and take up other professions to earn their bread and butter. Perhaps those greedy and dishonest people who are bent upon to damage and destroy Kashmir handicrafts do not realize as to how they are damaging the pristine of the handicrafts sector within and outside the country. The government though has initiated some steps to curb this unlawful activity but these steps are not sufficient as more stringent laws are needed so that the handicrafts sector is saved from these people.

uicide committed by Delhi-based NGO Director and social activist Khurshid Anwar is unfortunate and warrants immediate action to look into the circumstances that led late Khurshid to terminate his life. The gruesome incident raises question-mark on the conduct and credibility of electronic-media which carried its own media-trial against the person much before the law could take up the case into its own hands and found out the truth and proclaim him guilty. In fact, media created an environment which went against Khurshid and, therefore, deeply hurt by the “false allegations” was forced to commit suicide. Time has come when the media- trials need to be discouraged. Again, in the light of stringent law passed recently, the complaint lodged by a woman, too, needs thorough verification and scrutiny before action is initiated, since the statement of the aggrieved could, sometimes, come out of vengeance , personal revenge , hostility and or due to some other reasons. Income Tax Ombudsman: Take his help to Redress Your Grievances
A
s a taxpayer, you may have some very legitimate grievances relating to your incometax matters of settlement of your claims. You may, for example, feel that the Income Tax Department owes you a certain refund of tax but it is not doing enough to hear your grievance of complaint nor taking action to redress it. You may also be aggrieved about the rude behaviour of officials or their failure to follow instructions and circulars of the Board. In all such cases, you can approach your Income tax Ombudsman. Before you do so, however, you have to ensure that certain conditions are fulfilled. The Ombudsman is governed by, and has to act within, the framework of the Income Tax Ombudsman Guidelines, 2006. The institution of Ombudsman is of Scandinavian origin. The Ombudsman enquires into grievances or complaints against the functioning of a public authority. In our own country, the Income tax Ombudsman is appointed by the Central Government. He is usually a person with vast experience in tax administration, but functions independently of it. At present, the Government has appointed Ombudsman at New Delhi, Mumbai, Chennai, Kanpur, Chandigarh, Pune, Bhopal, Kochi, Kolkata, Hyderabad, Bangalore and Ahmedabad. What Grievances can you take to the Ombudsman You can complain to the Ombudsman about your grievances relating to delays in disposal or settlement of claims connected with: a. Issue of refunds; b. Interest waiver petitions; c. Appeal effects; d. Rectification applications; e. Release of seized books of accounts and assets; f. Allotment of PANs/ issue of PAN Cards. You can also complain of such matters as failure to: a. Give credit for taxes paid, including tax deducted at source; b. Maintain transparency in selection of cases for scrutiny; c. Follow the guidelines, circulars and instructions of the Central Board of Direct Taxes; d. Observe proper working hours by Income-tax officials; e. Acknowledge letters and documents forwarded by the assessee; f. Maintain or update records and registers leading to harassment. “A person can also complain about any unwarranted rude behavior of Income Tax officials with assesses.” Etc., For further details, please refer to clause 9 of the Guidelines. Procedure to be Followed On receiving complaint, the Ombudsman will examine it to see if certain basic conditions laid down in the guidelines have been fulfilled or not. He cannot take notice of the complaint unless these conditions are fulfilled. These conditions are:
i. The complaint should have been signed by the complainant as well as his authorized representative, in case the complainant is represented by such an authorized representative. ii. The complaint should clearly indicate/provide: a) The name, address and PAN of the complainant; b) The name and designation of the official who is being complained against (this should invariably be the junior most officer who has given rise to the grievance, not below the rank of an Income Tax Officer)’ c) The facts giving rise to the complaint; d) Supporting documents; and e) The relief sought from the Ombudsman. iii. The Ombudsman will accept complaints filed through the electronic media if they are otherwise in order, but the print out of such a complaint has to be signed by the complainant at the earliest. After he does so, the complaint would relate back to the date on which it was first received electronically. A complaint shall not lie to the Ombudsman unless in the first instance, the complainant had also made a written representation to the superior authority of the officer complained against. Also, a complainant can complain only if he has received no reply and more than one month has passed since he submitted his representation. Alternatively, he can also complain if he has received a reply but he is not satisfied with it, or if his representation has been rejected. No complaint can be made: i. 12 months after the reply was received from the superior authority; ii. 13 months after the representation was submitted to the superior authority but no reply was received. Remember, the Ombudsman will not take cognizance of the complaint if it has been the subject matter of : a. an earlier settlement made by the Ombudsman (OR) b. an appeal, revision, reference or writ before any Income-tax authority or a court of law. On receiving a complaint, the Ombudsman shall forward it to the officer complained against and shall endeavour to settle it by an agreement through either conciliation or mediation. If the officer cannot settle the grievance by agreement with the complainant within a period of one month, or such further time as the Ombudsman may allow, the Ombudsman will mediate and try to bring about an agreement. If he still does not succeed, he can make an ‘award’. Powers The Ombudsman has the following powers: i) He can receive complaints on matters indicated in clause 9 of the Guidelines. ii) He can consider these complaints and settle them either by agreement through conciliation and mediation or by passing an appropriate award. iii) He can require the Income-tax authority concerned to provide any information or
furnish certified copies of relevant documents required by him. iv) In the event of the failure of an Incometax authority, to furnish such information or documents (indicated in para iii above), he may draw an adverse inference. v) He can suggest remedial measures for redressal of grievances. vi) He can also report his findings to the Secretary, Department of Revenue and Chairman, C.B.D.T. Duties The duties of the Ombudsman are to: i) Exercise powers of superintendence and control over his office. ii) Maintain confidentiality of information coming into his possession and not divulge the same to third parties, except with the consent of the person who furnishes such information. He may, however, divulge such information to an opposing party to the dispute in order to reasonably comply with the principles of natural justice. iii) Protect the taxpayers’ rights and reduce their compliance burden. iv) Identify issues that increase the burden of compliance and bring the same to the notice of the CBDT and Ministry of Finance. v) Furnish a monthly report to the Chairman, CBDT and Secretary, Department of Revenue recommending appropriate action including that to be taken against erring officials. vi) Furnish an annual review of the tax administration to the Chairman, CBDT and Secretary, Department of Revenue. vii) Compile a list of awards made by him during the financial year and report the same to the Chief Commissioners concerned and Chairman, CBDT so that the same can be taken into account while writing the Annual Confidential Reports of the officials concerned. Nature of the Proceedings The proceedings before the Ombudsman are quasi-judicial in nature. He is not bound by any legal rules of evidence. He is expected at all times to be fair and reasonable while performing his functions. Nature of Awards As already indicated, he shall try to settle a complaint by agreement in the first instance. If such agreement is not forthcoming within a month or such further time as the Ombudsman may allow, he may make an award. This shall be speaking order and shall clearly specify the directions to the authority concerned- including making of an apology. The award, however, cannot affect the quantum of total income or tax assessed or the penalty already imposed. The Ombudsman can award compensation upto Rs. 1000/- for the loss suffered by the complainant. Such compensation will be the first charge on the budget allotted to the authority complained against. The award shall be binding on the department but it shall be binding on the assessee, only if he issues a letter of acceptance within 15 days of its receipt. If the complainant does not accept the award or fails to furnish a letter of acceptance
within 15 days or further period of 15 days if the Ombudsman permits, it shall lapse and be of no effect. If it is accepted by the assessee, the authority complained against has to implement the award within one month of its having being made. Compliance of having done so has to be reported to the Ombudsman. Check List A check list has been prepared to help you file a complaint. This is given below: 1. The complaint has not been signed by the complainant. 2. It has not been signed by the authorized representative. 3. It does not contain:a. The name and address of the complainant b. Supporting documents c. Details of the relief sought from the Ombudsman. 4. It has been made electronically but the hard copy (print out) does not have the complainant’s signature. 5. The complainant does not seem to have reported to the immediate superior of the officer complained against. 6. More than one month has not passed before the representation to the immediate superior was filed. 7. The complainant does not appear to be aggrieved with the reply received from the immediate superior. 8. (a) The complaint has been made after the expiry of one year from the receipt of the reply of the immediate superior; (OR) (b) Where no reply has been received from the immediate superior: The complaint has been filed after the lapse of 13 months from the date of filing of the representation before the immediate superior. 9. The complaint is the Subject matter of an earlier proceeding with the Ombudsman. 10. The ground(s) of the complaint is/are also the subject matter of a proceeding in appeal, revision, reference or writ before an appellate authority or a revisionary authority or a Court of Law. 11. The ground is not covered by Guideline 9 of the Income Tax Ombudsman Guidelines, 2006. 12. The complainant is represented by an authorized representative but no power of attorney to represent the complainant has been filed before the Ombudsman. Remember, the answer to every statement in the check list should be negative. A positive response to statements are Sr. No. 1 to 7 and 12 would indicate that the complaint is defective and the Ombudsman cannot proceed further to redress your grievance till the defect is removed. A positive response to statements at Sr. No. 8 to 11, on the other hand, would indicate that not only is the complaint defective but it is also incurable. No purpose would be served by filing such a complaint. We all have a positive responsibility in making this institution effective. We can do so by ensuring that we eschew the defects indicated in the check list given above and avoid filing frivolous or vexatious complaints.
