414 death convicts in India include 10 from Kashmir Srinagar, Oct 22: The Asian Centre for Human Right (ACHR) in its report, “Mercy on Trial in India” has said India had a total of 414 death row convicts at the end of 2012. Out of these 414 death row convicts, 10 are from Jammu and Kashmir. According to ACHR report received by KNS, Uttar Pradesh has 106 death row convicts-- maximum number of death row convicts in the country. With 63 death row convicts, Karnataka follows UP. Maharashtra has 51; Bihar (42); Delhi 27; Gujarat 19; Punjab 16; Kerala 14; Tamil Nadu 12; while Assam, Jammu and Kashmir and Madhya Pradesh each had 10
death row convict prisoners. Out of 414 death row convicts, 13 are female. Maharashtra had maximum with five followed by Delhi (four); Punjab (two); and one each in Haryana and Karnataka. India currently has 21 death row convicts whose mercy petitions have been rejected by the President. While the Supreme Court had already adjudicated on the rejection of mercy petition of Devender Pal Singh Bhullar by the President, the writ petitions of the remaining 20 are under adjudication before the Supreme Court and the High Courts. ACHR has urged the Supreme Court to examine the issue of delay as it is a critical factor in the administration
of justice, especially in the context of discretionary powers. “The executive power of the President and the Governors cannot be so discretionary to cause mental trauma in conditions considered to be inhumane and degrading to the condemned prisoners,” Suhas Chakma, Director of ACHR. “The Supreme Court of India must not only consider the death penalty through the right to life principle but also through the absolute prohibition of torture or cruel, inhuman or degrading treatment or punishment. Since India has ratified International Covenant on Civil and Political Rights (ICCPR) in 1979, it is bound by its treaty obligations on absolute
prohibition on the use of torture and inhuman or degrading treatment or punishment even in times of public emergency, which threatens the life of the nation, under Articles 4 and 7 of the ICCPR,” Chakma added. Elaborating international standards, ACHR stated that the European Court of Human Rights in its judgement on 7 July 1989 in the case of Soering v. the United Kingdom held that “the likelihood of the feared exposure of the death-row convict to the death row phenomenon” is in breach of Article 3 of the European Convention on Human Rights relating to prohibition of torture. The ECHR, taking into account length of detention prior to execution, con-

The meeting regretted that situation on the borders was deteriorating due to unabated incidents of cease-fire violation and residents of Jammu and Kashmir were bearing maximum brunt of the skirmish on the borders and they were the worst victim of hostility between India and Pakistan. Meeting recalled that it was during the regime of PDP that cease-fire was announced in the year 2003 and peace was restored all along the border from Kathua to Kargil. “The cease fire announced at that time had brought positives changes in lives of the common people of Jammu and Kashmir but unfortunately the situation has returned back to pre-2003 situation”, meeting observed.

You cannot allow a situation where our people are leaving their homes their fields, their kids are leaving their schools to continue like this,” said Tanvir adding “Ceasefire has been the biggest achievement of the peace talks and if it is violated, the situation will be difficult to handle” Stating that reluctance by the separatists to get engaged in dialogue is a stumbling block in finding the roadmap to the problem Tanvir said “Omar led government is strongly convincing the Centre to be in dialogue with separatists and also engage Pakistan in an external dialogue so that the long pending political issues of J&K are settled” The Political secretary said that the Chief Minister is committed to facilitate dialogue process, “We will continue to bat for it and facilitate the dialogue,” he said. Third party mediation won’t help
A
fter the rejection of fresh request of mediations from Pak Premier Nawaz Sharief, USA reiterating its old stand has made it clear that it is a bilateral issue which should be addressed by the two countries and an amicable solution carved out. Here comes the importance of Shimla agreement which has laid basis for addressing all outstanding issues between the two countries through a sustained dialogue. The Kashmir problem is one of the main issues which has led to three wars including that of Kargil incursion between India and Pakistan. It is perhaps the most complicated issue which has many stake holders and every stake holder has his own logic and theories in favour of his claim. India and Pakistan understand that unless they keep the process of dialogue going on, there can be no betterment in their relations. Though the two countries have initiated many steps in the past to normalise the bilateral ties, however, these steps fell short of expected mileage as the Kashmir problem becomes a main hurdle. With same culture, same historical background and almost similar in every field of life, the people of two countries want exemplary relations and friendly atmosphere between the two neighbours. The past animosities have only had adverse effects on the economy of the two countries and drained out major portion of their financial resources on unproductive things like purchase of armoury and weaponry. There can be no better judge than the two countries to understand, grasp and plan a mechanism which can suffice aspirations of all stake holders and can help in establishing stable peace and tranquillity in the sub continent. The leadership of the two countries should not create cold war like conditions and should refrain from issuing provocative and hard hitting statements which are bound to generate ill-will and strain the relations to a point of no return. Instead of raising the issue with foreign countries and international fora, Pakistan should take bold initiatives for the talks and should also address the security concerns of India. The two countries should not be swayed away by the confusing, contradictory and malicious statements issued by those countries who want to provoke both of them as they want customers for their arms, ammunitions. Why should the both the countries not walk extra miles to create cordial conditions so that problems become easier to be addressed and solved. There is no doubt that the two countries can take sincere steps towards the solution of all outstanding issues and no third party mediation can prove more effective than them.

Drug Abuse – A Holistic Approach

rug abuse, also called substance abuse or chemical abuse, is a disorder that is characterized by a destructive pattern of using a substance that leads to significant problems or distress. Teens are increasingly engaging in prescription drug abuse, particularly narcotics (which are prescribed to relieve severe pain), and stimulant medications, which treat conditions like attention deficit disorder and narcolepsy. Long ago… Initially, drug users were look down upon as those lacking in moral values that accounted for this strange consumption (of the drug) and it was more often held that a person was not "man enough" to get away from addiction. It was first recognized to be a disease like any other, by Alcoholics Anonymous, who did pioneering work in this field as an organization, delving deep into the reasons why a person fell into and subsequently in short time lost control of himself on such usage. Dr.Jellinek's pathbreaking studies helped change the very orientation one hitherto had about these alcohol/drug users (abusers). Further with the advancement of neurophysiological science, more importantly after 1956, one came to the conclusion that drug abuse is a chronic disease, could trouble a person for his entire life and was ultimately, curable by proper treatment. The disease of addiction was thus much better understood than in the past. What was needed therefore, more than the sympathy towards such affected persons, a due recognition and systematic treatment appropriate for such cases. These could be akin to treating patients with other health problems like sugarcontrol or hyper-tension, to name a few. Types of Drugs Drugs drastically put to wrong use are brown sugar (its inferior version is heroin) cannabis (ganja, bangh and other such categories) and even alcohol which qualifies to fall under the drug category, for the reason that it is merely a chemical in liquid form that is used to give a "high". The initial options that we had for switching fuel resource presented larger challenges in terms of global warming coupled with almost dwindling fossil fuel resources. When we look at the world's energy resources, oil, natural gas and coal seem to be still riding the crest and the contribution of renewable seems marginal at this juncture. Solar energy seems to enjoy a better edge over the others at this juncture due to vigorous pursuit to transform it into an attractive and economic option. Power consumption in India has been increasing fast due to population growth and economic development. India has tremendous energy needs and faces an uphill task in meeting these requirements through traditional means of power generation. The Indian economy faces increasing challenges because energy supply is struggling to keep pace with demand, and there are energy shortages of 10-13% daily almost everywhere in the country. Because India has so many black-outs, many factories and households use emergency generators and inverters as back-ups. This back-up power could be supplied by solar energy. Solar has the potential to transform the Indian economy in the same way as the Information Technology (IT). India is in a unique position to introduce clean energy solutions on an enormous scale to provide affordable energy for everyone – especially the poor. From an energy security perspective, solar is the most secure of all sources, since it is abundantly available. Theoretically, a small fraction of the total incident solar energy (if captured effectively) can meet the entire country’s power requirements. It is also clear that given the large proportion of poor and energy unserved population in the country, every effort needs to be made to exploit the relatively abundant sources of energy

He may develop a strange secretiveness that keeps him away from the family. On the social side he would try to become a truant with an altogether negative attitude. But as a thumb rule it would be better if one stuck to repeated usages as a symptom, where the user is fully aware of the consequences and but is prevented by a strange inability to restrict or stop the consumption of the drug in terms of quantity, frequency and be inclined towards an insurmountable urge towards drug usage. Vulnerability Instead of looking at the causes for drug addiction per se', it is better to understand it as a vulnerability to addiction. That would a better term. Genetic make-up plays a vital part in forming this habit, the family and friends around a person may serve as a deterrent or cause further usage of the drug(s) thereby increasing the positive expectancy that is to be derived out of it. If there is tacit approval by those around him, then it is held as a normal habit. It is no more drug abuse ; it is only rightful "use". It is "taken" in its stride. Psycho-social factors, lack of coping skills, the mechanism of a backup of friends during immense emotional pain -
any or all these may be the causes for the above-mentioned vulnerability. Withdrawal Symptoms Withdrawal symptoms create an uncomfortable feeling and will depend more on the drug which is consumed. The body and mind become restless, become more and more irritable, all parts of the body could be affected and there is pronounced sleep disturbance. It is similar to a pair of physical balances where one scale is at its extreme and what is strictly happening is a process of re-adjustment. If the patient goes back wanting to consume only a small quantity then the brain recalls the experiences it has had in the past and forces him to consume more and more till it provides complete satisfaction. This is a state that has to be completely avoided. It would be a reminder here that substitution of one drug by another is neither the solution nor the cure. Treatment Drug abuse, then is the disease of the body, the mind and the soul. Though treatment may begin medically but that alone is not enough and the patient would need an enormous amount of psychological help. If, a person gets cornered and conquered by an intake for three valium tablets, for instance, he should be taught and educated how to pass his time without these three. It requires long-term treatment, a change in lifestyle and the involvement of the family becomes cardinal in these kinds of treatments. Care should be taken to see that the patients dignity is preserved and he should always be respected. Prevention Prevention is a community process and not a one-time affair or a single day affair, of taking vows and the like. Instilling mere knowledge that drugs are bad alone may not also work. Developing of coping skills, learning to say a firm "no" to drugs even when repeatedly persuaded, a good support system, echoing the message against drug addiction repeatedly at different points of time, involving all sectors of the society are some of the preventive measures to be taken, all in a truly holistic manner, if results are to be seen. Government Initiatives The Union Ministry of Social Justice &
Empowerment, as the focal point for drug demand reduction programmes in the country, has been implementing the Scheme for Prohibition and Drug Abuse Prevention since the year 1985-86. As implementation of programmes for deaddiction and rehabilitation of drug addicts require sustained and committed/involved effort with a great degree of flexibility and innovation, a Statecommunity (voluntary) partnership appears to be particularly strong mechanism for service delivery. Accordingly, under the Scheme, while major portion of the cost of services is borne by the Government, the voluntary organisations provide actual services through the Counselling and Awareness Centres; Deaddiction cum Rehabilitation Centres, Deaddiction Camps, and Awareness Programmes. The Ministry is assisting 361 voluntary organisations for maintaining 376 De-addiction-cumRehabilitation Centres and 68 Counselling and Awareness Centres all over the country. The basic objective in creating facilities for treatment, at Centres run through voluntary organisations, is to ensure that the support of the family and the community is mobilized to the maximum. To facilitate the medical treatment of hard-core addicts who require intensive long-term medical attention, 100 De-addiction Centres are being run in Government hospitals/Primary Health Centres, etc. The initiatives from the Government include maintaining of Quality Assurance and Minimum Standards ensured by developing a Manual of Minimum Standards of Services, Professional Manpower Development where National Centre for Drug Abuse Prevention (NCDAP) as an apex institution has the necessary mandate for training, research and development in the drug sector and Focused Interventions for Vulnerable Targets where The Workplace Prevention Programme (WPP), a collaborative effort of the Government, ILO, NGOs and corporate sector has come up as a result. This collaboration has led to the formation of an effective group of various stakeholders, known as ARMADA, the Association of Resource Managers against Alcohol and Drug Abuse.

Lalu Prasad, Jagdish Sharma disqualified from Lok Sabha RJD chief Lalu Prasad and JD(U) leader Jagdish Sharma have been disqualified as Lok Sabha members following their conviction in the fodder scam. While Prasad stands disqualified for a total of 11 years — five years of jail term and six years subsequent to his release, Sharma stands disqualified for ten years — four years in jail and six more years after that as per electoral laws. Theirs is the first disqualification from the Lok Sabha after the Supreme Court struck down a provision that protects a convicted lawmaker from disqualification on the ground of pendency of appeal in higher courts. The first disqualification from Parliament came on Sunday when 66-year-old Masood, a Congress member of the Rajya Sabha, was held guilty in a case of corruption and other offences in September. Lok Sabha Secretary General S. Bal Shekar has issued the notifications disqualifying Lalu and Sharma. The Election Commission has also been intimated about the disqualification and the subsequent creation of vacancies in the Lok Sabha. Their disqualification came on Sunday night after Rajya Sabha disqualified Congress MP Rashid Masood earlier on Sunday after his conviction in a graft case.
65-year-old Prasad, convicted in the fodder scam, was sentenced to five years in prison and imposed with a fine of Rs. 25 lakh. He was till now an MP from Saran in Bihar. Sharma (63) too was sentenced to four years imprisonment in the case. He represented Jahanabad in Bihar. The Rajya Sabha notification said Masood stands disqualified as an MP from September 19, the day he was convicted by the CBI court. Citing provisions of the Representation of the People Act, it said he will remain disqualified for the period of his sentence and will continue to remain disqualified for a further period of six years after his release. Masood’s conviction was the first after the Supreme Court struck down a provision in the electoral law that provided immunity to MPs and MLAs from immediate disqualification. In its July 10 judgement, Supreme Court had struck down sub-section 4 of Section 8 of Representation of the People Act, under which incumbent MPs, MLAs and MLCs can avoid disqualification till pendency of the appeal against conviction in a higher court. The appeal has to be made within three months of the conviction. Seeking to negate the SC verdict, government had introduced a Bill in Parliament in the Monsoon ses-
sion. But following differences with the opposition, the bill could not be passed. An ordinance on the lines of the Bill was later cleared by the Union Cabinet on September 24, to protect convicted lawmakers. But reversing its earlier step, the Cabinet on October 2 decided to withdraw the Ordinance as well as Bill in the wake of public outburst against it by Congress Vice President Rahul Gandhi. The overturning of the decision
came in the wake of Mr. Rahul Gandhi’s trashing of the Ordinance as “nonsense”. He had said it should be “torn” and “thrown out”. President Pranab Mukherjee had also questioned the government’s decision on the ordinance. Clearing the air about the procedure to be followed following conviction of an MP, Attorney General G.E. Vahanvati has recently told the Lok Sabha Secretariat that notification declaring the seats vacant should be issued immediately.

A complaint was filed by Somdutt yesterday against the yoga guru's younger brother Ram Bharat accusing him of abducting his grandson Nitin Tyagi, a former employee of Ramdev's Patanjali yogpeeth, and assaulting him, Kankhal police station Circle Officer Chandramohan Negi said. Tyagi has been rescued and one person has been arrested in connection with his alleged abduction, he said. On the basis of the complaint of Tyagi's grandfather, a case under sections 365 (Kidnapping or abducting), 342 (Punishment for wrongful confinement) and 323 (Punishment for voluntarily causing hurt) of IPC has been lodged against the yoga guru's brother who is still at large, he said. Reacting to the development, Ramdev alleged that it was a "conspiracy" by the Congress as he was "exposing the party" during his tours. Addressing a "Meet-The-Press" programme in Indore, he said that the case had been filed by the Uttarakhand government to defame him. He said that his brother "is not an absconder" and that the police had so far not called him for interrogation.

Ironically, he was right. The girl in fact cooked up a story and did not reveal that she had been raped till more than 24 hours later. In fact, her original version was that she had been abducted by the two accused drivers - Satish and 28-year-old Venkateswarulu - and they had let her off once she raised the alarm. Cyclone Phailin:
European Union allocates 96,748 euros for relief
New Delhi: The European Commission (EC) has allocated 96,748 euros to the disaster relief emergency fund of the Red Cross International to "urgently respond" to the needs of almost 15,000 vulnerable families affected by cyclone Phailin.The European Commission's Humanitarian Aid and Civil Protection department (ECHO) allocated the amount after the International Federation of the Red Cross and Red Crescent (IFRC) appealed for funds to carry out relief operations. More than 10 million people were affected after Phailin hit the coastal areas of Odisha and Andhra Pradesh resulting in extensive damage to infrastructure, housing and livelihoods.Many people who lost their homes currently require urgent shelter and essential household items. Those who have returned to their villages after the cyclone do not have access to safe drinking water.These funds, channeled through the Indian Red Cross Society, will be utilised to provide temporary shelters, clothes, kitchen sets, water buckets and safe drinking water.In order to curb the spread of the water-borne diseases, the Indian Red Cross will also conduct health education activities in the cyclone-hit areas.ECHO has signed a Euro 3 million humanitarian contribution agreement with the IFRC to support the Federation's Disaster Relief Emergency Fund (DREF).

While Sachin Tendulkar’s career right from the time he began as a teenager has been an example of phenomenal dedication combined with discipline, Tendulkar has also been fortunate in being surrounded by people who made an impact on him and guided him when he began his career. Hemant Kenkre, Lalchand Rajput and Krishnamachari Srikkanth consider themselves lucky to be associated with Tendulkar at the start of his career. Kenkre, a batsman in Mumbai cricketing circles, was Tendulkar’s first captain in ‘A’ division Kanga league in 1988, leading Cricket Club of India. Rajput was Sachin’s first captain in Ranji Trophy and Irani Cup in 1988-89 while in a momentous occasion, Srikkanth led the youngster in his first international on the tough tour of Pakistan in 1989. “It is only God’s grace that I was his first international captain,” Srikkanth says. Looking back with pride, Kenkre, now 55, says: “We were only lucky to get a chance to do
what we did. We did not do him any favour. It was ordained and I just happened to lead him in his first ‘A’ division league in Kanga as the regular captain at that time, Sandeep Patil, was not available.” For Rajput, it’s a “great feeling that we saw a youngster who was really keen, very focussed, run hungry coming at that age and carried that for the last 25 years. It is easy now to say but then we never thought he will get a hundred international centuries.” Kenkre remembers Tendulkar’s first Kanga ‘A’ division match as if it happened yesterday. Tendulkar was only 14 then and the rules of the CCI did not allow any minor to use the clubhouse premises, where the dressing room was located those days. However, the rules were amended to accommodate the little genius. Kenkre says, “Against Karnataka Sports Association, we were batting second and the pitch was deteriorating. Young Sachin walks in at No. 4 and I was the non-striker. “The first ball he faced off Sharad Rao, a former Karnataka Ranji medium-pacer, he hit it straight over middle-stump for a six. That was just a six but spoke a lot about Sachin’s attitude and that he had no fear. It was not a slog but a beautiful shot straight from the copybook.”

Sydney: Australian batsman Usman Khawaja may follow fellow Muslim Fawad Ahmed and refuse to wear a uniform with a beer brand logo, but admits that cementing his Test place comes first. Khawaja, the first Muslim to wear the baggy green, told The Sydney Morning Herald he had considered whether it was possible to wear a uniform which did not have the logo of Cricket Australia's key sponsor the VB brewery. "I understand what Fawad is doing, and I'd be lying if I said I hadn't thought about it," Khawaja told the newspaper. Legspinner Ahmed was exempted from wearing the VB logo in England after he explained that it clashed with his Islamic faith - a move which sparked a row and criticism that he should not accept sponsorship money from companies promoting alcohol.
Even at 14, Sachin was a man in the midst of many stars. “He just fit into the scene. He never looked out of place. The CCI had big names like Patil, Alan Sippy, Shishir Hattangadi among many others. From the first day, he had that aura,” recalls Kenkre, who had also played against Tendulkar’s brother, Ajit, when the latter turned out for Jolly Cricketers. Kenkre was also coached by Tendulkar’s guru Ramakant Achrekar, who allowed CCI to include Tendulkar in the team. “Achrekar sir believed that if Sachin plays for the CCI, which has a rich history and tradition, he would get to play at an international ground and also get to play on very good pitches of international standard. He would be mentored by stalwarts like Dilip Sardesai, Hanumant Singh, Milind Rege among others. They were always there for advice.” It was only a matter of time that Tendulkar graduated from CCI to play for Mumbai Ranji team. Rajput recalls: “He was very comfortable at the nets, taking on our best fast bowlers like Raju Kulkarni with ease. As he was only 15, he was very shy when he joined. “My job was to make anybody new to the Mumbai team feel comfortable, like he is part of
the family. And make him feel like he has played a lot of matches. On his debut match against Gujarat at Wankhede, he was nervous in the initial stages. I fell for 99. When he came in at tea time, he told me ‘Bad luck, sir’. I said ‘Don’t worry, I will be happy if you get 100 on debut’. He got a 100 and never looked back since.” As captain, Rajput insisted that Sachin be included in the playing XI straightaway, though some including the then chairman of selectors Ramakant Desai felt that he should gain experience by being part of the team for a couple of matches. “Selectors Milind Rege and Naren Tamhane supported me and said that a batsman in good nick should play. When he got his first century, everyone was talking about him. The best part was in the second game against Saurashtra in Rajkot, he got a brilliant 89 in the second innings on a turning track. That’s when I said that this boy is going to be something special.” Special he did become, when he got the India call up, which Tendulkar thought should have come for the tour of the West Indies in MarchMay 1989. Kenkre remembers: “Sachin said to me that he was disappointed at not being selected for the West Indies tour. Though he did not crib, I
could make out he was so sad. ‘I should have been there’ he told me.” Srikkanth’s job as a captain was made easier by the fact that Tendulkar had a bagful of runs including centuries on debut in Ranji Trophy and Irani Cup. Srikkanth says: “My initial thought was, by the time Sachin came to Pakistan, he had the talent as he has had enough runs in first class cricket. As captain, my job was to give him all the support and encouragement, and ensure he was comfortable. “The greatest thing about Sachin was that he was calm and composed, knew how to handle pressure, never looked flustered and could carry on the whole thing. “He was confident of himself. Even after getting hit by Waqar Younis on the nose, he wanted to continue batting and scored a brilliant halfcentury in Sialkot, where Pakistan were desperate to beat us. By the time the series ended, everybody knew he is the boy who will be the man for the future.” Srikkanth or any of the Indian think tank had no doubt that Tendulkar would succeed at the international stage that early. “As captain, all I told him was that he will play all the four Tests and that he needn’t worry.”

Our think tank is strong and have good planning. Bowlers are training hard for last two days. The harder they work the better they would perform. Hopefully we will do really well against the Aussies tomorrow," he said. Admitting that adjusting to the new ODI rules was proving difficult for the bowlers, he said: "We are not getting the ball to reverse, while spinners are also not getting turns as with two balls it do not get old. But we have no excuse. We have to do well under the circumstances."We have to admit that it's tough for the bowlers. When five players are inside (the circle), it's obviously going to be difficult for the part-timers as your regular bowlers are not doing well. "Bowlers come under pressure as to what lie and length they would have to try when five players are inside. You're allowed to bowl two bouncers but then you have to bowl four more balls after that."Raina however said they would have to live up to the challenge laid out by the ICC.
