Bar to challenge judgment on ‘Indianism’ Srinagar, November 24: After taking religious scholars and representatives of Islamic organization on board, the Jammu and Kashmir High Court Bar Association (HCBA) has decided to file an appeal against the recent High Court judgment in which the court had said ‘there is only one ‘ism that is Indianism’. Last month, the High Court directed the Central government and the Chief Election Commissioner (CEC) to take action against politicians seeking vote by invoking religious nationalism. “In our constitutional philosophy, there is only one ‘ism that is Indianism. All other isms are sworn enemies of Indianism. Any person claiming to be Hindu nationalist, Muslim nationalist, Sikh nationalist, Buddhist nationalist or Christian nationalist is not only working against Indianism but against the very thought of India,” Justice Muzaffar Hussain Attar See Bar on Pg. 7

Omar for change in education system

Institutions brazenly bulldozed in J&K: Mufti Jammu, November 24:

Stresses on inculcation of moral values in children Jammu, November 24: Chief Minister, Omar Abdullah has underscored the need for inculcating moral values in children adding that all-round personality development should be the necessary part of the education system in all the educational institutions. “It has been observed that more stress is being given on academic side of education ignoring the importance of non-formal and moral education”, he said maintaining that without these aspects human resource development in its positive format is not possible. He refereed the extra pres-

sure being put on young children by making them to study large number of books right from nursery classes. Given away Rashtrapati Puraskar to Scouts and Guides of Jammu and Kashmir Chapter on behalf of the President of India at a function here this afternoon, the Chief

Minister who is also Vice Patron of J&K Chapter of Bharat Scouts and Guides said that the present system of imparting education to the children particularly at the elementary level needs to be changed to suit the personality development of the children and inculcate moral and give

importance to the aspect of imparting non-formal education among children including sports. Omar said that by introducing a system of education where under so many books are handed over to the children from the nursery level for studying ‘we have snatched their childhood

from them’. “Is tarah ke talami nizam se ham ne apne bachon ka bachpan hi sheen liya hai”. He underlined the need for a change in the system so that the childhood is restored to the children. The Chief Minister said that the present day practice in the educational See Omar on Pg. 7

Observing that social justice is possible only by strengthening democratic institutions, patron of Peoples Democratic Party (PDP) Mufti Mohammad Sayeed today regretted that present dispensation headed by National Conference (NC) has brazenly trampled all institutions just to accomplish its nefarious designs. “Meritorious and deserving people of the State are the worst victims due to erosion of the sanctity of institutions in Jammu and Kashmir”, Mufti said while addressing a function to welcome large number of activists from Other Backward Classes (OBCs) who joined PDP today under the leadership of Madan Lal Chalotra here this afternoon.

PDP committed for JK Govt can’t be blamed for everything, Resolution, economic people should self introspect: Mirwaiz development: Mehbooba Srinagar, November 24:

Srinagar, November 24: Peoples’ Democratic Party (PDP) president, Mehbooba Mufti Sunday said with the support of people, the PDP is committed to take forward its unfinished agenda of political resolution, economic development, restoration of peoples’ self-respect and dignity for the larger interests of peace and stability in the South Asia. Addressing public meetings at Lalpora and Haihama in Lolab in the North Kashmir’s Kupwara district, the PDP chief said the party with its clear thinking could bring about a perceptible and immediate change in the overall situation in Jammu and Kashmir in 2002, and will take it further if given a deci-

sive mandate. “We could help in reducing tensions between India and Pakistan; the fear and insecurity on the ground was eliminated; the power sector was reformed and new development agenda was started with sin-

cerity and dedication,” said Mehbooba adding the opening of the Line of Control for travel and trade helped in bridging the gaps between the two estranged neighbors and could help in a big way in reducing the trust deficit between them. PDP reminded the lead-

All ministers in state cabinet are clean

Mufti made J&K most corrupt after Bihar: Kamal Srinagar, Nov 24: Blaming Mufti Mohammad Sayeed, the former chief minister for increasing corruption in the state, Mustafa Kamal the National Conference Additional General secretary Sunday claimed that all the ministers in the present cabinet are honest and not involved in corruption of any nature. Kamal while talking to Kashmir News Service (KNS) said: “To eradicate corruption in the state, Omar Abdullah has introduced Right to Information Act (RTI) and many big fishes are being caught only because the ap-

propriate steps have been taken for the same and it was Mufti who made the state the most corrupt in India after Bihar.” Commenting over the coalition and the corruption remarks, Kamal said that Omar made the statement as a general remark and that all the misters in the state cabinet at present are clean and there is no reason to worry. “When we have allegations against the ministers of corruption the charges are either baseless or substantiated.” Commenting over the recent BOPEE paper leakage scandal, See Kamal on Pg. 7

ership of our country and that of Pakistan that Kashmir issues will not vanish unless it is resolved and the process of reconciliation needs to be taken forward. The tension on the borders was reduced and the historic cease-fire was enforced there, which didn’t get violated till 2010. “Since1947, India and Pakistan tried to enforce cease fire on the borders but they failed to do so till 2002. It was only when the PDP could create conducive atmosphere on the ground, cease-fire was not only implemented but was religiously followed,” Mehbooba said and regretted things are back to square one now and the National Conference led government could only reverse See Mehbooba on Pg. 7

After the recent BOPEE paper leakage scandal got unearthed in the state, Chairman Huriyat Conference (M) Mirwaiz Umar Farooq said that the people of Kashmir are equally responsible for growing corruption and moral degradation and that the government cannot be blamed here for everything. Mirwaiz while talking to Kashmir News Service (KNS) said: “We cannot blame the government for everything, though the government has failed to deliver here but the people cannot be bailed out at Present. The social and the moral degradation is on the rise and we have to introspect during the present crises.” Mirwaiz further stated that the people here lack the sense of social responsibility and are spinning the lines for themselves only. “We see the apathy of Dal Lake, we witness

the mosques are being constructed over grave yards, encroachment of the public roads.” Mirwaiz said that the sense of responsibility must be evolved among the masses here and that we all have to look inward. Castigating the state gov-

ernment over the rising corruption here, Mirwaiz said that the authorities here take everything with the non-serious attitude and that the outcome of the same is proving disastrous. “It is very unfortunate that the state machinery here

has failed completely to deliver on the ground and that the scarcity of accountability has prevailed in the valley.” Mirwaiz further stated that Kashmir due to the conflict zone is being ignored on all fronts and that the rule of the law and the principles of justice are always being undermined and taken with the non-serious attitude. Commenting over the recent statement of Pakistan Prime Minister Mian Nawaz Sharif that the Indo-Pak talks could be held in the in the proper directions only after polls in India, Chairman Huriyat (M) chairman said that the Huriyat leadership here is optimistic that the new government in Delhi will have thaw with the Pakistan and that the Indo-Pak talks will be held in the better atmosphere. The PDP patron gave example of recent exposure of scam in the Board of Professional Entrance Examination (BOPEE) which established sale of question papers of Common Entrance Test (CET). How the poor, deserving and meritorious students will get justice when sanctity of institutions like BOPEE is also eroded and illegal means were adopted to accommodate undeserving candidates?, he asked and expressed surprise that a person, who is reportedly to be main accused in this scam, has been given extension after extension by the present regime. Pensioners ‘made to work’ as peons at Khanyar Treasury

Re-affirms government’s determination for universalizing better health care Samba, November 22: Chief Minister, Omar Abdullah has re-affirmed his government’s determination to provide better health facilities to the people particularly in far-off and remote villages. He said under a comprehensive and gigantic health consolidation and expansion programme scores of health centres in the villages, sub-districts and districts have been completed and many are in the process of completion. “Besides upgrading and modernizing the health institutions, a mega expansion programme is in offing to ensure health coverage and better medicare facilities to the people across the State”, he said and added that health sector has been focused as one of the most important sectors by the government in the development policy and during last five years it received full attention for improvement and upgradation.

Srinagar, Nov 22:

Interacting with the people after inaugurating Rs. 11.83 crore 70-bedded District Hospital at Samba on Friday, the Chief Minister said that coming up of modern health facilities at the district level would not only expand the orbit of health coverage for people but reduce the pressure on the hospitals in cities. The Chief Minister asked the

Health and Medical Education Departments to ensure better facilities to the patients in government hospitals and utilize modern equipments provided to the health institutions to extend modern treatment to the patients. He said specialists, doctors and para-medics have been placed in government health See Omar on Pg. 11

The state government pensioners Friday complained that the treasury departments have taken them for a ‘ride’, making them to wander from one section to the other for the purpose of ‘physical’ verification. Omar....... system is to judge the capacity and capability of a student from his marks sheet. “This is also not the right balance to weigh the student’s caliber”, he said and added that the allround personality development should be the measuring stick for judging the worth of a student. Omar said that Bharat Scouts and Guides is the institution which deals with imparting non-formal and moral education in the students making them fittest and all-round developed personalities who could face challenges with confidence and bravely. He said expansion of this institution is significantly necessary to cultivate and nurtured a young generation with both high moral values and academic excellence to take over the rains of the country in future and give new dimension to the welfare and development of the society where discipline, rule of law, honesty and justice would rule the roost. The Chief Minister announced Rs.4 lakh for J&K Chapter of Bharat Scouts and Guides for its welfare activities and asked the office bearers of the Organization to come up with a proposal of bringing J&K Chapter of Bharat Scouts and Guides at par in benefits to the students associated with this organization with other states of the country. The function was addressed by the President, Bharat Scouts and Guides, J&K Chapter, R. S. Chib, State Commissioner and Secretary, I. D. Soni, Senior Vice President, Roma Wani while Vice President, Gulzar Ahmed Qureshi, Zonal Commissioner, Wing Commander, M. M. Joshi, Training Commanders and other office bearers, parents of the award winners and others were present on the occasion. The Chief Minister gave away 22 Rashtrapati Puraskar to winners and congratulated them on his and on behalf of the President of India for their extraordinary work done as Bharat Scouts and Guides.

Mufti.........

systematically erosion of sanctity of institutions?”, he asked added that poor and deserving people were bearing brunt of the misdeeds and corrupt practices being adopted by the present government. He added that Congress party was equally responsible for depriving people of Jammu and Kashmir of their legitimate democratic rights. “It is a historical fact that the National Conference is notorious for undermining sanctity democratic institutions in the State but it is very unfortunate that Congress, which is part of the present government, is also playing dubious role”, he said. He mentioned towards failure of the government to take some concrete steps for strengthening of Panchayati Raj institutions or holding civic bodies elections in the State. Referring towards repeatedly statements being given by the Congress leaders especially AICC vice president Rahul Gandhi on 73rd and 74th amendments in public, Mufti said that failure of the government to strengthen Panchayati Raj institutions in the State was a clear indication that Congress leaders were giving statements only for public consumption but internally they were also not serious in strengthening democracy at grass root level. “Had Congress leaders been serious in strengthening Panchayats, party ministers should be effectively taken up this issue in the government as well as in the Coordination Committee?” , he observed. “More than two and half years have been passed after completion of the Panchayat elections but till date government has failed to hold Block Development Councils (BDCs) elections despite the fact that notifications were earlier issued in this regard”, he regretted, adding, “It is nothing but a mockery of the democracy and blatant dishonour of the mandate of the people by those who are at the helm of the affairs”. Reiterating resolve of his party to work for the socio-economic growth of weaker sections, Mufti said that empowerment and upliftment of marginalized lot of the society was main agenda of the party. He reminded his association with former Prime Minister V P Singh who was crusader for the social justice and had sacrificed power for the weaker sections. Mufti emphasized on formulating policies which help in inclusive growth and emancipation of suppressed and neglected lot of the society. He argued that socioeconomic growth of the OBCs and other weaker sections was must for the over-all development of the society. “Benefit of the developmental policies and other welfarist schemes must be reached to neglected lot of the society”, he said. “These is a need to formulate a comprehensive policy especially to target these sections for inclusive development in the society”, he said and assured the gathering that PDP was committed for socio-economic growth of the neglected lot of the society. “Programmes and policies of PDP are formulated by incorporating wishes and aspirations of all sections of the society”, he said and reminded that gathering that during PDP led regime various programmes were launched for the upliftment of weaker sections of society Rangil Singh, Yashpal Sharma MLC, Ved Mahajan, Daman Bhasin, Shanti Devi, Hussain Ali Bafa, Rashid Malik, Deepinder Kour, Ashok Jogi, chairman OBCs/SC cell, Thakur Suram Singh, Bhushan Dogra, Amreek Singh Reen, Vijay Kumar Choudhary, Rashpal Singh Bittu, Haji Shak Mohammad, Kuldeep Sharma, Mohinder Kotwal, Rafiq Malik, Rajinder Dharmat, Rajinder Singh, Jatinder Bhat, Sunil Bhat, Varinder Singh Sonu, Kamal Sharma, Ravi Salgotra, Anju Bhan, Digvijay Singh, H S Sodhi, Dr Harmesh Singh Slathia, Vikram Singh, Vikram, Showkat, Saleem Choudhary, Lal Chand, Badri Nath, Sunil, Vijay Anand and others also spoke on the occasion. Prominent among others who joined PDP along with Madan Lal Chalotra included Tilak Raj contractor, Vikas Chalotra, Dev Raj Bhatti, Varinder Chalotra, Sham Lal Gandhi, Vijay Kumar Choudhary, Kuldeep Raj, Ram Lal, Sanjeev Verma and others.

Mehbooba........

the gains made earlier. She said the cease-fire will continue to remain hostage to prevocational and hawkish utterances, if peace-process is not taken forward seriously. Relations between the two countries will not smoothen unless the stakes of people are developed in the peace process. The hassles in getting the travel documents need to be removed to pave way for more public interaction. The cross-LoC travel should not remain confined to the divided

families only, in order to increase more people to people contacts its ambit needs to be broadened. Routes like Kargil-Skardu need to be opened. To make it more vibrant and successful entity, the hassles in the crossLoC trade should be removed. Mehbooba said these are the issues which have been agreed upon by the two countries and they need to be implemented. Increasing the strategic needs of the country and of the region, Kashmir should become a corridor for trade and co-operation that will lead to greater level of satisfaction of people who have been deprived of economic activities and peace so for, the PDP chief said. Over the last 65 years, Jammu and Kashmir has remained a zone of conflict and source of tension, discord, and it is the PDP’s vision to make it the bridge of understanding between the two countries and for that purpose people have to give the party a decisive mandate. Mehbooba regretted that over last five years everything has been reversed, development process has been stopped, corruption has become the order of the day and the rulers are living in their own fancies without caring about anything else. The continuation of this inept and insensitive government has become a big problem for the people and, in any case, it has to be shown door now. She said the present government could not channalizie the aspirations of people and they could not use the opportunity and mandate to resolve the problems of people, a statement of PDP issued to KNS reads. The much touted about rehabilitation policy for the PaK returnee has been mockery of. Bracing huge hardships and threats, those who have returned from the other side of the border have been landed in no mans land by the insensitive rulers, and there is nobody to take care of them. They could get meaningful employment opportunities; no school, college or university is lending admission to their wards and, in the given scenario, many of tem wanted to go back, but they could not do that even. If the rulers could not provide them ‘authorities entry routes’ to enter here, there was no fun to humiliate and put them in trouble along with their families. The party’s Chief Spokesperson, Naeem Akhtar; senior party leader and MLA Lolab, Abdul Haq Khan; Haji Ghulam Mohammad Mir, Khursheed Iqbal and others were also present on the occasion.

Mirwaiz........

India must realize the vitality of Kashmir resolution and would play the active part in it. “We hope that whether it is BJP or the UPA , the next government in India will understand that the Kashmir issue is must to resolve so that there would be better relations between India and Pakistan.” Mirwaiz further stated that unless Kashmir issue is resolved, there will never be good relations between the two countries.

Talks........

relations with India also,” he said in his speech at the conference held in Lahore, capital of Punjab province, on Saturday. Nawaz Sharif said both India and Pakistan should come to the table to solve all their outstanding issues including Kashmir, the more than six decadesold row over the former Himalayan state divided between the two countries and claimed by both in full. Referring to recent firing incidents on the dividing Line of Control in Kashmir, Sharif said the two sides should work to prevent such skirmishes. He said his party had never resorted to hitting out at India during its election campaign, but Pakistan bashing was still going on in India during ongoing election campaigns, which “is counter-productive”. Recalling his meeting with the then Indian Prime Minister Atal Bihari Vajpayee in 1999, he said that Vajpayee had showed resolve to settle all issues in an amicable manner and “we have to move forward with this spirit”. “Islam also advocates better and friendly relations with neighbours,” he said. Sharif said Islam was being criticised over terrorism and extremism and stressed the need to effectively project true face of the faith to remove misconceptions. He said Islam preaches unity, peace, fraternity, love, tolerance and interfaith harmony. The prime minister announced Rs20 million (Dh682,695) grant for the construction of a modern club for poets and literary persons.

Kamal........

Kamal stated that the recent event must not be undermined wherein the high ranked officer has been jailed for the corruption charges. “Some people claim that he was made as a scapegoat, let the people who claim the same prove it.” When asked how Mushtaq peer was reinstated even after the retiring from the civil services, Kamal said that Peer was not the first man but Mufti has reinstated many corrupt people like Mehboob Iqbal who according to Kamal was involved in the Gulmarag landscape. “Mufti not only shielded the corrupt people but also gave them the senior ranks in his party.”

Bar..........

had said in second week of October this year. “This expression has evoked sharp reaction from a section of population and divided people of the country into different pigeon holes of different isms. A very serious and potential threat is posed to the very existence of the idea of India by the fringe elements, who take cover under various types of isms other than Indianism… India is not a Hindu, Muslim, Sikh, Buddhist or Christian India. It is India which is born from the bosom of unrelenting struggle of millions of people,” Justice Attar had said in his judgment. Meanwhile, the general secretary of HCBA Mohammad Ashraf told KNS that in this regard, the Bar Association had convened a meeting of prominent religious scholars, preachers and leaders on Saturday in which besides all the executive members of the Bar Association, the representatives of Jamati-Islami, Jamaet-i-AhliHadees and AhliSunnatwal-Jamaat participated. “The meeting had been called bythe Bar Association to discuss the course of action to be followed by the Bar in respect of the virdict of the High court in case titled Sanjay Tikooversus State and others wherein the court besides other things has held that there is only one “ism” viz “Indianism” which has

to survive in India and all other “isms” have to disappear from the firmament of the country called India,” he told KNS. In the meeting the judgment of the court was discussed threadbare and all the participants expressed that the judgment impinges on the rights of the people to profess, propagate and practice their faith and belief freely. The representatives of the religious organization who participated in the meeting,on their part assured the members of the Bar Association that they will also take up the matter with their respective heads of their organizations and will apprise the people about its fall out very shortly. “In view of the consensus arrived at, in the meeting the Bar Associationwill now file the Appeal before the High Court on the grounds available to it under Personal Law and other laws on the subject,” Bhat told KNS.
