No restriction in Old City Today: Govt Srinagar, Jun 26 : The district authorities have decided not to impose the restriction of any sort in the old city on Fridaymaintaining that the situation so far has remained peaceful with the people contributing a lot in the same. Sources have told KNS that no restrictions shall be imposed in any part of the Srinagar and nowhere shall the pedestrian movement be curbed. “We don’t want to trouble people rather we want the peaceful situation to prevail. 1 dies, 05 injured in road mishaps Srinagar, June 26 : One person died and five others were injured in different road accidents across the valley. According to a statement issued to KNS, a Maruti van bearing registration number JK05C-0634 on way from Tangmarg to Kreeri skidded off the road at village Sheikhpora, in the jurisdiction of police station Kreeri, resulting in on spot death of driver Fayaz Ahmad Bhat son of Ghulam Rasool resident of Kreeri and injuries to Ishfaq Ahmad Mir resident of Kreeri. The injured was shifted to hospital for treatment. Kreeri Police has registered a case in this regard. Ashraf Zakhmi passes away Srinagar, June 26 : Mohammad Ashraf Zakhmi of Kharibagh, Ranger Budgam breathed his last yesterday morning after a brief illness. MHA to allocate Rs 10 crores for Chakan-da-Bagh and Rs. 5 Crores for Salamabad TFC Srinagar, June 26 : A joint meeting of the officers of State and Central Governments to review and discuss the issues related to cross LOC trade was held here today. Mr Khurshid Ahmad Ganai, Financial Commissioner, Industries and Commerce, Joint Secretary, J&K Affairs, Ministry of Home Affairs, Mr. R.K Srivastava, Principal Secretary, Home, Mr Suresh Kumar, IG (CID), J&K Dr. B. Srinivas , Deputy Secretary (K) Ministry of Home Affairs, Mrs. Sulekha besides officers of Industries and Commerce Department, J&K Bank and BSNL were present on the occasion. Talking to KNS, Khurshid Ahmad Ganai, Financial Commissioner, Industries and Commerce, said: “The MHA was very positive for streamlining and augmenting the cross LoC trade and it has shown keen interest to open up new routes for the trade. The MHA has also promised to revise the Standard Operating Procedure (SOP) governing the Cross LoC

State Human Rights Commission (SHRC) Thursday stated that it will use its power if the police fails to carry DNA sampling and identification of the persons buried in unmarked graves in Kashmir valley. According to the KNS correspondent, the division bench of SHRC heard the case of the unmarked graves on Thursday after an application was filed in the commission by the human rights groupseeking identification of the persons buried in unmarked graves via DNA sampling. The state government in its argument stated that it is ready to go for the DNA sampling of the any person buried in the grave if the person’s family identifies the spot that it believes to be of their relative’s grave. The SHRC in September 2011 had asked the state government to conduct DNA profiling of the bodies in unmarked graves in north Kashmir to set at rest speculations that people buried, and claimed to be militants by security forces, were persons who went missing under suspicious circumstances since eruption of militancy in the state in 1989. Srinagar, June 26, CNS: The allotted rice meant for five circles of Central Kashmir’s Budgam district for the month of June has gone missing while the top officials of Consumer Affairs and Public Distribution Department (CA&PD) are feigning ignorance and are telling that they would look into the matter. Reliable sources told CNS that 1256 quintals of rice were allotted for this month to the five circles of Central Kashmir’s Budgam district including Charar-e-Sharief Circle A, B, Chadoora A, B and BK Pora. Sources added that instead of dispatching 1256 quintals of rice for the distribution purpose to these five circles, the employees at Shiekhpora Granary dispatched 1068 quintals only to Nagam Granary. Surprisingly, 188 quintals that went missing have not been mentioned in official records. Store-Keeper Nagam Granary admitted that that he received

only 1068 quintals of rice. He told CNS that there was a delay in sending this quota to these five circles because of strikes. His claim was contested by Tehsil Supply Officers of Charar-eSharief Circle A and Chadoora A. TSO Charar-e-Sharief Circle A told CNS that instead of receiving total allotment of 278 quintals, he received only 213 quintals while TSO Chadoora A said that till date he has received nothing from the Nagam Granary. “I was supposed to receive 168 quintals of rice for BPL category but have not received anything till date,” he said adding that the current month is almost over,” he said. While discussing various demands and problems being faced by the traders associated with cross LOC trade at Salamabad, Uri and Chakan da bagh, Poonch, it was felt that there is urgent need for further augmentation and streamlining of the cross LOC trade. It was agreed that the additional items to be included for trade shall be forwarded by the Industries & Commerce Department to the Ministry of Home Affairs for its inclusion in the agreed list of items in the SOP. Regarding banking facilities, the Joint Secretary informed that the matter has already been taken up with the Government of Pakistan and the Ministry will pursue the matter with them vigorously. Provision of ISD facilities to the senior officers dealing with the cross LOC trade and the designated heads of traders association was also agreed to. The meeting was informed that the tendering process for purchase of Full Body Truck Scanners has been completed and a team of experts will be sent soon to identify the location and advice on the preparatory work before installation. During the meeting enhancement of cash amount to be carried by the passengers travelling across to PoK was also agreed to and a proposal to this effect will be submitted by the Home Department to the MHA for approval. Opening of additional trade routes, issuance of Visa permits and maintenance of balance sheet for goods traded across LOC from both sides were also discussed in the meeting. Upgradation of infrastructure at TFC Salamabad, Uri and TFC Chakan da Bagh was agreed and the custodians of the respective TFCs were directed to submit the updated proposals to the State Government for further necessary action and release of funds by the MHA. Upgradation of road and communication facilities from TFCs to zero line, visit of traders across LOC also came up for discussion and it was agreed that the Home Department will submit its recommendations to the Ministry of Home Affairs for obtaining necessary clearance from the Government of Pakistan. Liberal central assistance for road connectivity- a welcome step

T

he decision of union govt. to earmark Rs.Twenty thousand crore for development of road communication in J&k and North Eastern states is a welcome step and should be hailed by one and all. There were fears that the BJP govt. will not be much interested in the development of J&K as compared to UPA which has sanctioned some good projects for the state. However the decision has cleared all the doubts and apprehensions and it seems that the present govt. headed by Mr. N.Modi is inclined to make J&K a model state as far as development of basic infrastructure is concerned. There is no doubt the this hilly state with a difficult terrain is far behind in all sectors including road connectivity which is only 25% to 30%. The only National High Way connecting the valley with rest of the country is depleted and has become a death trap for passangers.The four laneing of this highway has almost been stopped and the company doing the job has already asked for extention of one year to complete the job even between Srinagar to Anantnag. If the same pace of work continues, the project from Udhampur to Srinagar will take another decade to be completed. The central govt. should view this situation seriously and efforts should be undertaken to complete the project on time so that the highway reduces the travelling time besides strengthening the economy of the state . In all the road communication in the state is too poor which needs immediate attention of the central govt. so that steps are taken to make movement of the people and goods faster. The economic stability of any state depends on its roads which play an important role in taking the state ahead on the path of development. The new budget will ensure better roads which means better trade, better tourism, better employment and better movement in all spheres of life

Environment Protection under Constitutional Framework of India T he constitution of India is not an inert but a living document which evolves and grows with time. The specific provisions on environment protection in the constitution are also result of this evolving nature and growth potential of the fundamental law of the land. The preamble to our constitution ensures socialist pattern of the society and dignity of the individual. Decent standard of living and pollution free environment is inherent in this. The Environment (Protection) Act, 1986 defines environment as “environment includes water, air and land and the interrelationship which exists among and between air, water and land and human beings, other living creatures, plants, micro-organism and property”. The chapter on fundamental duties of the Indian Constitution clearly imposes duty on every citizen to protect environment. Article 51-A (g), says that “It shall be duty of every citizen of India to protect and improve the natural environment including forests, lakes, rivers and wild life and to have compassion for living creatures.” The Directive principles under the Indian constitution directed towards ideals of building welfare state. Healthy environment is also one of the elements of welfare state. Article 47 provides that the State shall regard the raising of the level of nutrition and the standard of living of its people and the improvement of public health as among its primary duties. The improvement of public health also includes the protection and improvement of environment without which public health cannot be assured. Article 48 deals with organization of agriculture and animal husbandry. It directs the State to take steps to organize agriculture and animal

husbandry on modern and scientific lines. In particular, it should take steps for preserving and improving the breeds and prohibiting the slaughter of cows and calves and other milch and draught cattle. Article 48 -A of the constitution says that “the state shall endeavor to protect and improve the environment and to safeguard the forests and wild life of the country”. The Constitution of India under part III guarantees fundamental rights which are essential for the development of every individual and to which a person is inherently entitled by virtue of being human alone. Right to environment is also a right without which development of individual and realisation of his or her full potential shall not be possible. Articles 21, 14 and 19 of this part have been used for environmental protection.

According to Article 21 of the constitution, “no person shall be deprived of his life or personal liberty except according to procedure established by law”. Article 21 has received liberal interpretation from time to time after the decision of the Supreme Court in Maneka Gandhi vs. Union of India, (AIR 1978 SC 597). Article 21 guarantees fundamental right to life. Right to environment, free of danger of disease and infection is inherent in it. Right to healthy environment is important attribute of right to live with human dignity. The right to live in a healthy environment as part of Article 21 of the Constitution was first recognized in the case of Rural Litigation and Entitlement Kendra vs. State, AIR 1988 SC 2187 (Popularly known as Dehradun Quarrying Case). It is the first case of this kind in India, involving issues relating to environment and

ecological balance in which Supreme Court directed to stop the excavation (illegal mining) under the Environment (Protection) Act, 1986. In M.C. Mehta vs. Union of India, AIR 1987 SC 1086 the Supreme Court treated the right to live in pollution free environment as a part of fundamental right to life under Article 21 of the Constitution. Excessive noise creates pollution in the society. The constitution of India under Article 19 (1) (a) read with Article 21 of the constitution guarantees right to decent environment and right to live peacefully. In PA Jacob vs. The Superintendent of Police Kottayam, AIR 1993 Ker 1, the Kerala High Court held that freedom of speech under article 19 (1)(a) does not include freedom to use loud speakers or sound amplifiers. Thus, noise pollution caused by the loud speakers can be controlled under article 19 (1) (a) of the constitution. Article 19 (1) (g) of the Indian constitution confers fundamental right on every citizen to practice any profession or to carry on any occupation, trade or business. This is subject to reasonable restrictions. A citizen cannot carry on business activity, if it is health hazards to the society or general public. Thus safeguards for environment protection are inherent in this. The Supreme Court, while deciding the matter relating to carrying on trade of liquor in Cooverjee B. Bharucha Vs Excise commissioner, Ajmer (1954, SC 220) observed that, if there is clash between environmental protection and right to freedom of trade and occupation, the courts have to balance environmental interests with the fundamental rights to carry on any occupations.

Public Interest Litigation under Article 32 and 226 of the constitution of India resulted in a wave of environmental litigation. The leading environmental cases decided by the Supreme Court includes case of closure of limestone quarries in the Dehradun region (Dehradun Quarrying case, AIR 1985 SC 652), the installation of safeguard at a chlorine plant in Delhi (M.C. Mehta V. Union of India, AIR 1988 SC 1037) etc. In Vellore Citizens Welfare Forum vs. Union of India (1996) 5 SCC 647, the Court observed that “the Precautionary Principle” and “the Polluter Pays Principle” are essential features of “Sustainable Development.” At local and village level also, Panchayats have been empowered under the constitution to take measures such as soil conservation, water management, forestry and protection of the environment and promotion of ecological aspect. Environment protection is part of our cultural values and traditions. In Atharvaveda, it has been said that “Man’s paradise is on earth; this living world is the beloved place of all; It has the blessings of nature’s bounties; live in a lovely spirit”. Earth is our paradise and it is our duty to protect our paradise. The constitution of India embodies the framework of protection and preservation of nature without which life cannot be enjoyed. The knowledge of constitutional provisions regarding environment protection is need of the day to bring greater public participation, environmental awareness, environmental education and sensitize the people to preserve ecology and environment.

APEDA: Helping Farmers to Look Outwards R ight from the moment when a produce is harvested from the farm to the time it takes to be on board for moving to its desired destination, the life of the agricultural produce gets battered at various stages. It is estimated that almost 30-40 per cent of the produce of fruits and vegetables is wasted due to lack of adequate infrastructure for post-harvest handling, transportation and storage. The inadequacy of post-harvest infrastructure facilities and wastage has persistently been underlined as a major bottleneck in boosting export of perishable products from India. Apart from it, the country’s agriculture export policy sometimes gets affected by short term interventions or restraints like ban on export of farm produce in the times of sudden price rise or supply constrictions. Whenever such restraints are imposed, processed and/or value added products have to bear the brunt. Processed food sector and value addition in India forms but a minuscule portion of the overall agri economy and accounts for a small fraction of export of their commodities. Requirement of continuity in policy regime for encouraging investment in processed food sector is therefore an imperative. In the light of all these problems, the Government, in coordination with Agricultural and Processed Food Products Export Development Authority (APEDA), has been providing necessary technical inputs and financial assistance. APEDA has taken several initiatives for promoting export of perishable commodities. APEDA has set up common infrastructure facilities like Centres for Perishable Cargo (CPC) at various international airports like Delhi, Mumbai, Kolkata, Bagdogra, Amritsar, Hyderabad, Bengaluru, Chennai, Goa, Nashik, Vapour Heat Treatment facilities for export of mangoes to Japan and Australia, Irradiation facilities for export of mangoes to USA, integrated pack houses, pre-cooling facilities, high humidity cold stores, Asceptic Packaging Unit and collection centres among others. In addition, exporters, through Scheme of Infrastructure Development, are encouraged for purchase of reefer vans, setting up integrated pack houses, pre-cooling facilities, high humidity cold stores etc. so as to maintain cool chain which ultimately helps in maintaining the quality of the produce exported from India. Appropriate market intelligence in terms of reliable trade data on demand, supply, season, process etc. is another critical requirement

of the exporters to diversify and explore new markets. APEDA has achieved market access for various products in hitherto inaccessible markets such as mango to USA, Japan, Australia and China; grapes and bitter gourd to China, basmati rice to Japan, Mexico and China; mango products to Mexico, livestock products to Algeria, Syria, Egypt, Morocco etc. Packaging is critical for delivery of product in good condition. APEDA has got developed packaging standards and specifications for various fruits, vegetables, cut flowers etc. Exporters using packaging of these standards and specifications are also given financial assistance to the tune of a maximum of Rs. 5 lakhs per annum. Food safety is a primary concern in international trade. There is an increasing need to provide greater assurance about the safety and quality of food to the end consumers. Paying heed to the concerns of food safety and traceability shown by importing countries, APEDA has introduced traceability system for export of grapes to the EU countries via GrapeNet, pomegranates to EU via AnarNet and organic products via TraceNet. APEDA has encouraged and provided financial assistance to exporters for implementation of food safety standards in various sectors such as meat, poultry and dairy manufacturing units, units manufacturing mango pulp, pickles, dehydrated products etc. APEDA has also introduced a stringent system for recognition of export testing laboratories (23 at present), which has helped in upgrading their testing capabilities in terms of human skills and testing infrastructure. Research & Development is an important activity with the objective of export enhancement programme. For the benefit of processors/ exporters, APEDA gets R&D work conducted through expert institutions in accordance with trade requirement for development of value added products, improvement in processing technologies, development of new varieties etc. High airfreight cost has been a persistently inhibiting factor in enhancing export potential and erodes the production cost advantage in India. High storage and inland transportation costs further aggravate the situation impeding growth in export of agricultural and processed food exports. Through the scheme for Transport Assistance, aid to exporters of horticultural, flo-

riculture, processed food and animal products is extended. To further facilitate the export of perishable agri produce, the Government through the Foreign Trade Policy 2009-14 made a provision for introduction of a Single Window System. Apart from these initiatives, APEDA has also taken several other export promotion measures for fruits and vegetables from time to time. A number of agri export zones for fruits and vegetables have been set up in different parts of the country. AEZs entail focused channelisation of efforts and assistance in a converged fashion for the overall development of supply and value chain of the identified produce. APEDA also encourages exporters to participate with it in various international trade fairs which offers opportunity to the participants to get exposure and access to business channels overseas, thus augmenting export opportunities. APEDA has initiated a programme for integrated training of horticulture produce for some identified fruits like grapes, mangoes, litchis in selected regions. In the first step, APEDA has selected certain varieties of mangoes from the major producing belt i.e. Alphonso mangoes from Ratnagiri, Kesar mangoes from Aurangabad. APEDA has implemented the Integrated Training Programme in identified mango areas, response of which have been encouraging. APEDA has also made efforts to establish a semi-commercial facility in India to meet the commercial requirement. In this direction, APEDA received a 1.5 tonne capacity machine to treat 20 feet containers (8-10 tonnes in one-day treatment). This facility has been established by Maharashtra State Agricultural Marketing Board (MSAMB) at Vashi, Mumbai. APEDA has also initiated experiments of Controlled Atmosphere containers for the sea transportation of mangoes to various countries. APEDA has also been providing financial assistance to exporters for packaging, infrastructure development like packhouses, pre-cooling facilities, reefer vans etc, brand publicity through advertisement, purchase of laboratory testing equipment and implementation of quality systems etc. In this way, efforts for upgradation of post-harvest handling, distribution and marketing facilities have been able to cut down on wastages and for preserving the quality of fresh produce.
