The court resolution 2017 1

IN THE COURT OF THE HONG KONG UNIVERSITY OF SCIENCE AND TECHNOLOGY STUDENTS’ UNION Court of First Instance BETWEEN Court Resolution regarding the Chairperson of the First Extraordinary General Meeting, 2017-2018 Date of Resolution: 10th November,2017 The First Extraordinary General Meeting of HKUSTSU, Session 2017-2018, will be held on the 21st November 2017. As stated in Article 7.2 of the HKUSTSU Constitution, “The Council Chairperson or in his/her absence the Council Vice-Chairperson shall preside as the Chairperson at every General Meeting. If neither of them shall be present, the Full Members present shall elect one of them to preside as the Chairperson.” The Court is aware of the possibility of conflicts of interest that those who are facing impeachment or condemnation and suspension might be chairing the General Meeting referred to. By way of resolution of the Court, those listed on the Agenda of the First Extraordinary General Meeting of HKUSTSU, namely, CHOW Kwun Tung, YIP Wai Yeung Dennis, CHAN Ho Sum, LEE Fu Wa, LI Kai Tong, CHAN Ka Shing, HO Wing Hang Jasmine, LI Sai Hung Tommy are not permitted to preside as the Chairperson of this General Meeting.

According to HKUSTSU Constitution Article 14.16, “The adjudication passed by the Court in the form of a resolution shall be binding unless revoked by a Referendum. The point of law therein contained shall be binding on all suborganizations and members of the Union unless repealed by a further resolution of the Court or a legislative resolution of the Council, a General Meeting or a Referendum.”
