Materials refers to the building products. Have you used re-claimed or recycled products? What is the efficiency of the building shell in retaining heat? Are these products recyclable when worn out? These materials cost more, and add value. Indoor Environmental Quality… does your house breathe? You want to make sure you change the air in your home, control this flow, and use the exhaust to pre-heat the incoming replacement air. This is known as a Heat-Ventilation-Recovery unit, or HRV for short. Yes, it really does heat the incoming air with a heat exchanger set of tubes that allows the outgoing air to transfer heat as it is exhausted to the incoming air.

No, not painted green, but does it have one or more of the six elements of a “Green Building”? Then there is a new appraisal form that might increase the value of your home when you buy or sell. This form was developed in 2017 and this spring AHFC hosted a very well attended two-day seminar to help train appraisers to understand the function of the Appraisal Institute’s new form. There are seven 3rd party verifiers that are suggested, but most are un-available in Alaska. So, for us you have the option to contract with a SOA licensed Energy Rater to complete this form for an appraiser. The goal is to place a value on the cost of creating a structure, using building methods that are environmentally responsible and resourceefficient throughout a building’s lifecycle. This starts from the location of the structure on the land, extends to design, construction, operation, maintenance, renovation, and finally recycling when it is finally torn down, all these factors should influence value. This form is designed to provide facts that allow an appraiser to assess the black and white value of these features.
Finally, Maintenance & Operation, which is often the most overlooked. High efficiency furnaces, HRVs, smart fans in bathrooms, all of these systems require understanding and maintenance to ensure they operate as designed. Deferring maintenance and failure to operate these appliances properly occurs when the installer or builder fails to communicate to the homeowner how the system works, its function, and what is required to keep it working. So, now that you have gotten the addendum completed by a builder or energy rater, now what happens? This is the question AHFC and the appraisers are working on. One reality is that an appraisal doesn’t usually tell you what a home is worth, but instead verifies that the value of the home exceeds the loan. When the appraiser is contracted to evaluate the home, he or she is handed the sales agreement, finds comparable properties, and returns an appraisal that exactly matches the sales price. This is not surprising, as the true market value of a home should be what it will sell for and it is the responsibility of the appraiser to verify this. So, what is the value of the “Residential Green and Energy Efficient Addendum”? This tool will provide a basis for your low energy use home, with environmental controls, to be worth more! Appraisers I talk to have repeatedly said, this information is missing on most “comps” they use to justify a market value on a home. With this new tool, the industry will be able to add value to a Green Home, and make all those improvements you made worth it. http://www.appraisalinstitute.org/education/green_energy_addendum.aspx
Of the six elements the addendum considers as attributes, there are four that are important for Alaskans. What this form calls Energy, Materials, Indoor Environmental Quality, and Maintenance & Operation are key factors. Translation? OK, first your Energy use. Have you installed a high efficiency furnace or boiler? Or a Heat Pump that strips heat off the air outside, out of the ground, or out of a nearby lake? Is it a net zero home? (This means do you gather heat during the day or in some cases during the summer, and store it for the cold winter nights?) Solar panels creating hot water or electricity, windmills?

Covenants Not As Sacred As They Once Were Dear Dave: We have lived in a subdivision with covenants that were in place from the beginning of the development. We have seen major violations occur unchecked, even though we meet twice a year as an organized homeowners group. The majority of members do not want to speak up about the violations as the developer that built their houses is usually the culprit. We built our own home and would like to see the covenants enforced. Can you advise us? Answer: The short answer is that Recorded Covenants are enforceable by Law. You need to contact a Land Use or Real Estate Attorney. Your problem is not unique. Many subdivisions have covenants and restrictions related to the use of property. When someone buys a home, they should always review the covenants and decide whether they can live under such restrictions. If a homebuyer does not like the rules, they can withdraw from the purchase without penalty under the typical MLS Purchase and Sale Agreement. A developer is particularly responsible because he is the one that created them in the first place during the Platting process. The fact is that covenants are largely ignored in most subdivisions where owners often feel that they are out-
dated and irrelevant. The best way to deal with violations, especially in a small subdivision, is to form a committee, elected by homeowners, and gently start to work on the issues with the support of a majority of homeowners. Most covenants provide for the formation of such an ‘Architectural Control Committee’ (though not restricted to architecture). The Municipality is not interested in such issues unless they involve a conflict with Zoning Regulations. Keep in mind, however, that any one homeowner can take legal steps to enforce an individual covenant irrespective of whether they have been overlooked in the past. The person with liability is the existing property owner, including a developer who still owns vacant parcels, not you.
The fact is that covenants are largely ignored in most subdivisions where owners often feel that they are outdated and irrelevant. The trick is to always try the soft route first. Sometimes a polite letter will work, or even a conversation. However, you ultimately have the power, through the Courts, to force property owners to abide by their implicit consent to the covenants which they agreed to before acquiring property in the neighborhood. A Covenant, by definition, is a legal agreement and once was a sacred pledge between parties, but the quality of life shared between people in any

society is only as good as the character of the individuals that comprise it. Dear Dave: We want to extend our home forward on the lot and were wondering how far can you build out front of your home? Answer: It depends on the Zoning. First, make sure you have a current As-built Survey showing how far from the property line the current structure is situated. Second, check your zoning. If your house is in an R1 district, you can build to within 20 feet of the front property line. Your property line is not where the road is paved (This is a common misconception). The Right-of-Way is always wider than the physical road because the city needs that space to store plowed snow in the winter, so the survey is critical. Next, be sure there are no utility easements out front on your property. You cannot build over these. Finally, a review of the covenants of your subdivision may further restrict your building plans. If your building expansion plan falls between within all these guidelines you may proceed, but don’t forget to obtain a Building Permit from your local Municipal authority.
