Moving House A Leap of Faith Dear Dave: What is the deal with “contingent” offers? When I bought my last house, they took it off the market until I sold my current one. This time, the seller of the home I want to buy says he will continue marketing the home for another offer and, if he gets one, I have 48 hours to remove my contingency or lose the house. Why should I do this? I need to know that my wife and our four kids have a home to go to before I sell their house out from under them. Answer: In this modern world where moving house is a process of juggling paperwork, rather than simply loading up the wagon and prodding the mules down the trail, we lose sight of some of the basic facts of life. You just can’t take ownership of a piece of real estate with a structure on it unless you give money in the form of some paper credit or legal tender. A deal is struck between two people to exchange a home and land for U.S. currency. The deal is documented on paper because the elected powers in the country have enacted laws that will enforce the written agreement.

To sell your own home, obtain payment for it, and then purchase another home is somewhat a leap of faith. Now think about the reality. Your seller also wants to load up the wagon and be moving on down the trail. You say you will pay him for his property, but you can’t guarantee when that will be because you don’t have the money until you get it from someone else who wants to settle on your piece of territory. What if he takes it off the market and waits, and waits some more, but several new moons pass and you have no buyer for your property? “Up the creek with no paddle” might describe your seller’s situation! It is normal, and very appropriate, for sellers to take contingent offers like yours with a “48 hour clause” that keeps their option open to sell to another party. Your wife and four children (and even you) have my sympathy. To sell your own home, obtain payment for it, and then purchase another home is somewhat a leap of faith. There are a couple of things you can do. First, ask your Realtor to put your property on the market and, when a buyer is on offer, try for an extended closing to enable you to find and negotiate

the purchase of your new home as fast as possible. You could even accept that offer with your own ‘contingency clause’ that it depends on you finding your new residence. Your Realtor can help you here with creative juggling of the deal. A lot depends on the personalities involved, there motivation to compromise, and their personal circumstances. Second, you could just go ahead and buy the new home with ‘bridging finance’, provided that you can afford it. Third, and most practical, is to make arrangements for some kind of ‘Plan B’ place to stay between transactions. Family, church or friends may be able to help cover the interim period when you’ve sold your home and have the proceeds but no place to go. Perhaps you could even survive in a short term rental. Life’s about risk, and faith, and adventure – but don’t expect someone else to take the risk for your decision to relocate. After all, isn’t life just one contingency after another?
