PEOPLE Who Escaped Certain Death

It’s better to be born lucky than born beautiful or smart, but if you have all three, you are onto a winner. Not many of us can hold down all three and make it look easy, but we do try! However, some people take luckiness to a whole new level. We all face daunting situations in our life, but who can honestly say they have escaped certain death? Some might say that certain death is the only certainty in life, and this way of thinking is certainly certain. But here are three stories about people who cheated the Grim Reaper and lived to tell the tale.

Baby Survives 6-Storey Fall It is routine when a baby is born for the doctor to say some smart-arse quip such as ‘she’s going to be trouble when she gets older’, or ‘he looks like the milkman.’ But how many say, ‘this baby will fall from 6-storeys and be caught by a passer-by?’ Not many I would imagine, but that’s exactly what happed to an 18-month old toddler in Frogballs, Arkansas (it wasn’t really in Frogballs, but I couldn’t leave out such a great place name).

This story could have quite easily lend itself to the phrase ‘bouncing’ baby boy, but fortunately we will never find out. According to witnesses, this cute little 18-month old toddler was playing Jackie Chan on the balcony of a 6th floor apartment when he fell to ‘certain death’. What are the chances that someone who was coincidently walking by was directly under the baby when he fell? And what are the chances that the savior in question was a doctor, and not a social worker, who caught the baby square on? That is exactly what happened, and the baby is still here to tell the tale, although he just burps when you ask him about it.

Door-To-Door Plane Delivery Have you ever been sat at home watching the latest comedy sitcom to be rudely interrupted by an airplane crashing into your living room? Me neither! In May 2014, a pilot was flying upside down above Northglenn, Colorado, when he lost control and crashed unceremoniously into a house.

Fortunately, the homeowners were out and had a solid house insurance plan that covered

freak occurrences. The most stunning factor of this crash is not why the pilot was flying upside down in the first place, but he and his crew emerged from the accident uninjured! I wouldn’t want to be the one that had to clean up afterwards. But it could have been much worse.

Mountain Climbing is Armless Enough Some say that drug addicts who find themselves with health issues due to their addictions shouldn’t receive free health care. What about mountain climbers and other extreme sport goers that risk life and limb at the taxpayer’s expense?

A 27-year old mountain climbing freak named Aaron Ralston from Colorado (what is in the water there?) was alone in a canyon when a 500kg rock collapsed on where he was climbing. Although Aaron wasn’t harmed by the rock, it trapped his arm and he was unable to break free.

Not only had Aaron not told his mum, or anyone else, where he was that day, but he also wasn’t wearing clean underwear.

For 3 days and nights, Aaron had not seen or heard anyone else in the proximity and took drastic action to save his own life. He had one of those multi-purpose Swiss army knives with a corkscrew, tin-opener and a small pen-knife. After downing a bottle of Crystal, and eating tinned baked beans with those lovely little sausages, Aaron decided to cut off his own hand to break free.

And that is what he did.

After patching up his arm to stem the blood flow, Aaron had to lower himself down a 20m high canyon and walk 10-miles to safety. Moral to the story is always make sure you wear brown trousers when rock climbing.

itigation is the process of taking a case to a court of law or carrying on a lawsuit for settling controversies or disputes so that a judgment can be made.

The general courts are ordinary courts which have authorities to try and adjudicate criminal and civil cases.

Those courts are: • Civil Courts • Criminal Courts • Provincial Courts • Municipal Courts (Kwaeng Courts) Under Thai Law, the plaintiff must bring a civil case to the court where the cause of action arises or where the defendant is domiciled. Where an immovable property is involved, the plaintiff has to bring a lawsuit to the court where such property is situated, or where the defendant is domiciled.

As regards criminal cases, the court in a district where an offence has been committed, alleged or believed to have been committed, or where an accused resides or is arrested, or where an inquiry official conducts an inquiry, has jurisdiction over the cases.

The primary function of Municipal Courts is to dispose of small cases quickly with minimum formality and expense.

The jurisdiction of these courts covers both criminal and civil cases. Criminal cases fallen in the jurisdiction must deal with the criminal offence punishable with a maximum of three years imprisonment, or fine not exceeding 60,000 baht or both. For civil cases, the amount of claims must not exceed 300,000 baht. The proceeding in Municipal Courts is emphasized on the speedy trial; therefore, the trial is more simple and oral judgment or summarized judgment may be issued.

Lawsuits must be filed before the statute of limitations.

The length of the litigation procedure depends on the complexity of the legal issues and facts. The volume of cases being handled by the court also affects the process. Some lawsuits can be resolved quickly, whereas

others may take several years to conclude.

Whether you are the one filing a lawsuit or the one being sued, it is important that you have an appropriate legal counsel. They will guide you and help to comprehensively and competently evaluate your case at an early stage. Defendants usually have a specific period of time to respond.

ALTERNATIVE TO FILING A LAWSUIT There are different alternatives to filing a lawsuit, depending on the legal situation. Mediation and arbitration are two of the several Alternative Dispute Resolution (ADR) methods for settling disputes without resorting to lawsuits.

Alternative Dispute Resolution (ADR) refers to any means of settling disputes outside of the courtroom. It typically includes early neutral evaluation, negotiation, conciliation, mediation, and arbitration.

Mediation is a form of dispute resolution facilitated by a neutral third person who assists the disputing parties in finding mutually acceptable solutions. It gives the parties the opportunity to discuss and clear their issues and find areas of agreement. If the parties reach an amicable solution, they may enter into a binding and enforceable compromise agreement.

Mediating a case before filing a lawsuit enables the parties to present their case to a neutral third person who assists in finding mutually acceptable agreements before any money is spent on litigation.

If those involved in a dispute cannot resolve it by mediation, they often submit it to arbitration. Arbitration takes place out of court. The disputing parties select an impartial third party, known as an arbitrator. Disputing parties agree in advance to comply with the arbitrator’s decision then participate in an informal hearing at which both sides can present evidences and testimony. The arbitrator’s decision is usually final, and courts rarely reexamine it.

If you live or are on holiday here, it doesn’t matter your visa type, how many orphanages in Lop Buri you have funded or how many Isan villages that depend on your cash supply each month to keep the old buffalo functioning, you have to live by the local laws and life philosophy.

Slagging off the military dictatorship, haranguing the Royal Family or explaining to the police that you pay their wages when they stop you for a driving offense will only result in you taking a magical mystery tour to prison. Of course, we need to point out some of life’s uncomfortable truths, but there is a time and place for that, and that time is not now and the place is definitely not in Thailand.

Making a Joke about a Thai person in Public We have covered this topic in another article in Pattaya City Uncovered, but losing face is a massive thing in Thailand and SE-Asia. Where I come from, people constantly berate

each other in public, and if you find someone’s weakness, instead of laying off, you really do go for the jugular and wind them up to the point they break or just laugh it off. It’s just the way some Europeans are. But we can safely say that all Thais are not that way inclined!

What could be a simple joke in your mind about a Thai person looking like a Teletubby could lead to you waking up with a crowd of people around you. They do not take public criticism very well. If they feel you have made them look stupid in front of other people, especially their friends or superiors, you are in for the shock of your life. Just remember that only small areas of the world understand sarcasm and an ironic sense of humor. Do not make a Thai person lose face in public, or you might lose your face, or definitely part of it!

Urbanisation is happening at the startling rate of 65% and by 2030 there will be more than 1 billion city dwellers in China alone.

And with these trends, where does the growth really lie, in the Chinese market or the global players who will fuel these urban Chinese, my opinion is the latter.

Apple Pay has just been launched in China where last year US$5.5 trillion was spent on mobile payments, it doesn’t take a huge chunk of that kind of money to increase the bottom line even with a balance sheet as giant as Apple has.

Companies grow by the consumer buying and using their products, core stocks mentioned above will continue to benefit from these Chinese consumers and it certainly isn’t slowing down any time soon...
