The Minnesota Supreme Court takes

center stage

in Eden Prairie Attorney David Flaherty gives his argument during a Minnesota Supreme Court case at the Eden Prairie High School Performing Arts Center Thursday, May 5. The case was the State of Minnesota v. Melissa Jean Crawley that originated in Winona County. It was the 33rd time the court has made oral arguments accessible to high school students, in an effort to show just how the system works. PAUL GROESSEL • SUN NEWSPAPERS They may have been on stage but they were far from acting. The robes, arguments and case were the real thing. Around 700 Eden Prairie High School students heard actual oral arguments in a Minnesota Supreme Court case Thursday, May 5, in the school’s performing arts center. The case was the State of Minnesota v. Melissa Jean Crawley that originated in Winona County. The central question in the case: Does a state law that criminalizes making a false statement about police misconduct a violation of the First Amendment? In general, Crawley’s attorney argued the state law, Minn. Stat. 609.505, subdivision 2, is not constitutional since it makes it illegal to make a false statement that is harmful to a government official, but it does not criminalize false

statements supportive of a government official. The Supreme Court only heard the oral arguments, and a ruling was not made. Taking four to six months to rule on a case is not abnormal, according to Lissa Finne with the court office. The court usually spends the first two weeks of a month hearing oral arguments and ruling on cases. The second two weeks they read the cases for the next month and write the opinions for the decisions they just decided. That’s how Justice Helen Meyer described the justices’ typical day during the question and answer session after the oral arguments were heard on Thursday. Also during those first two weeks, the court decides which cases they will take. COURT: TO PAGE 22

2011 Legacy Award winners announced BY PAUL GROESSEL • SUN NEWSPAPERS It’s nice to get recognized. Especially when it’s not asked for or expected. Some Eden Prairie students, staff, alumni, teachers and volunteers received some for their efforts, attitude and influence in the schools. The Foundation for Eden Prairie Schools honored nominees and acknowledged winners of the fourth annual Legacy Awards during a dinner Wednesday, May 4, at Olympic Hills Country Club. The foundation is a nonprofit that formed in 1998 and is volunteer-run. Since the group began, it has given more than $200,000 in grants and scholarships for Eden Prairie students and teachers. Legacy Award winners and nominees were selected by community members, teachers and staff. There were seven award categories, plus a special, surprise award given to Cathy Bockenstedt. She was named Honorary Teacher of the Year at the end of the night’s program. Foundation president Jeff Parker said Bockenstedt has been nominated for the Teacher of the Year award almost every year, but since she’s on the foundation’s board of directors, they didn’t want to award one of their own members. City Council has preliminary discussion about long-term street, maintenance funding BY PAUL GROESSEL • SUN NEWSPAPERS With nearly 200 miles of residential streets in the city, the Eden Prairie City Council and staff want to make sure their will be enough funding on a year-to-year basis to pay for maintaining them. Since different roads need repair at different times over their respective lifetimes, the city has a system and program in place to repair the streets when they are needed, said Director of Public Works Gene Dietz during a May 3 workshop. “We have a plan and what we need is funding for it,” Dietz said. The model that the city and consultants have worked out in the past would require about $2 million per year (not including inflation) to make streets sustainable in the long-term. To help come up with some ideas, the city’s Budget Advisory Commission citizen group will begin looking into a variety of funding options for the Capital Maintenance and Reinvestment Fund, which is where a lot of street work payments come from. The fund is used roadwork, trails and other maintenance costs exceeding $25,000. Each year, the fund usually has $2 million in street and trail work alone, Dietz said. In recent years, little money has gone into the fund, which is expected to have a deficit by the end of 2015. It had a balance of $6.7 million at the end of 2010, said finance director Sue Kotchevar. Earlier this year, the BAC was charged with finding potential revenue sources for the fund (often referred to as the CIP).

Those possible sources were discussed during the May 3 workshop. The city council considered which of the options they’d like to rule out and which they’d like to have the BAC dig into further. Funding options the BAC will most likely look into include the tax levy, special assessments from reconstruction projects, franchise fees, street light utility fees, user fees, liquor store funds and other sources. “I think some [funding options] we know we’d say no to,” Council member Ron Case said during the meeting, but it would be good to have the BAC analyze all options, so council members could know and explain why those options were ruled out. Council member Brad Aho said he’d like to see multiple funding sources for the maintenance budget, not just one key source. The meeting was a precursor to the yearly budgeting that will take up much of the city council’s schedule for the coming months. Since the early May workshop was an initial discussion, it’s unclear how much revenue each option could provide, and it’s unclear how it could directly impact residents. The BAC is expected to begin hashing that out. Council member Sherry Butcher Wickstrom said she’d like to see talks about the future not be limited to funding sources, but on innovation. It seems a lot of the discussed funding option are traditional ways of doing things, she said. She’s like to see some new ideas for how the city operates, not just how they’re funded. Beginning May 20, Hopkins’ Mainstreet will transform into “ArtStreet.” Five sculptures will be welded into place on the street, the first step in creating ArtStreet, a program designed to incorporate art into the community. This marks the first year in what will become an ongoing program, a collaboration between the city, Hopkins Business & Civic Association and the Friends of the Hopkins Center for the Arts. The vision includes permanent and rotating artwork displayed downtown Hopkins. “It is our hope the art forms will vary over time and the locations will grow,” said Kersten Elverum, Hopkins director of economic planning and development. “The possibilities are endless as we look at other landmarks and gateways to Hopkins.” The project is funded partially through a grant from the Metropolitan Regional Arts Council. ArtStreet will incorporate new artwork each year. The pieces arriving May 20 are on loan for a year, with only one becoming part of a permanent collection. The other pieces will be available for purchase at the end of the project year. Although this year’s lineup is heavy on sculptures, Elverum said it was the city’s hope that the art forms would vary over time, incorporating interactive pieces, light and projection art and more. The pieces will be located in front of the Hopkins Center for the Arts, 1111 Mainstreet, on 10th Avenue North, on Ninth Avenue South at the Clock Tower Plaza and in front of Marketplace Lofts, 750 Mainstreet. One of the artists participating this year is Richards Poey, whose sculpture will be at the Clock Tower Plaza. He has participated in similar shows in Sioux Falls, S.D. “It’s a wonderful opportunity to show the public the beauty of art,” he said. Poey, an Eden Prairie resident, began sculpting in 1997 after retiring from Honeywell. It quickly grew from a retirement hobby to a passion. ARTSTREET: TO PAGE 18

Homes Within Reach making ownership possible in west metro The nonprofit organization has helped close to 90 families like the Trailers purchase houses in west Hennepin County over the last 10 years. Homes Within Reach Executive Director Janet Lindbo said the program, also known as the West Hennepin Affordable Housing Land Trust, has qualified buyers purchase the house structure, and lease the land underneath it for a nominal fee. By removing the cost of land from the equation, mortgage payments, property taxes and closing costs are significantly reduced, making homeownership possible for working households, she said. The Minnetonka-based organization began in 2001 when community leaders in that city saw a need for permanent affordable homeownership for teachers, retail and customer service workers, food custodians, municipal employees and other laborers. “We want to meet the needs of those essential workers in our communities,” which have since grown to also include Brooklyn Park, Deephaven, Edina, Eden Prairie, Golden Valley, Maple Grove, New Hope, Richfield, St. Louis Park and Wayzata, said Lindbo. With a decade of service behind it,

BY KATIE MINTZ • SUN NEWSPAPERS For many working families, purchasing a home in one of west Hennepin County’s suburban climes is out of reach. When a job brought Chris and Angie Trailer to the Twin Cities from Iowa last year, they were disappointed to find even several years of savings wouldn’t take them very far. “We had a sizeable down payment,” said Angie. “The problem we kept running into was my husband works in human services and that’s not a big money maker.” Angie, who stays home with kids Kailey, 4, and 2-year-old Ethan, said they couldn’t find a decent house in the area with affordable monthly mortgage payments. Then the property manager at their rental in Bloomington told them about Homes Within Reach. For the last six months they’ve owned a modest rambler in Edina. She said her children love having their own rooms and a backyard to play in. “It’s been a wonderful little place for us,” said Angie Trailer. “And especially with our two kids, getting into the Edina School District was just a dream for us.”

Lawmakers shouldn’t widen gaps in property tax burdens BY MIKE MAGUIRE AND NANCY TYRA-LUKENS GUEST COLUMNISTS For years, we’ve been told Greater Minnesota communities needed to be specially protected from property tax increases because property taxes hit wallets in their communities harder than in ours. But, a report from the Minnesota Department of Revenue shows these longheld assumptions are not true. Homeowners in the Twin Cities metro area pay a 39-percent higher share of their income to property taxes than their Greater Minnesota counterparts. That fact is revealed in the Minnesota Department of Revenue’s “Residential Homestead Property Tax Burden Report”

released earlier this year. It’s a myth-buster of a report, providing hard evidence that property tax burdens in the Twin Cities metro area are more onerous than in Greater Minnesota. This comparison between homeowners with the same income, regardless of where they live, shows that metro-area property taxpayers devote 3.19 percent of their income to property taxes compared to just 2.30 percent in Greater Minnesota. As legislators and Gov. (Mark) Dayton grapple with a $5-billion budget deficit, there’s no question cuts will be made. We believe when lawmakers and the governor make those cuts, they should be mindful of these property tax inequities and do everything possible to make the situation better,

not worse. If legislators hold to the outdated narrative that’s been spun at the state Capitol for years – that Greater Minnesota can’t afford to absorb any cuts in state programs – they run the risk of widening, not narrowing, the gap. The facts show that Twin Citiesarea taxpayers actually subsidize the costs of Greater Minnesota services through a variety of ways. And, now we know that property tax burdens in the metro area are higher than in out state. To help educate citizens and legislators about this inequity, the Municipal Legislative Commission, a coalition of 16 suburban communities including more TAXES: TO PAGE 9

LETTERS TO THE EDITOR Stensrud: We need to reign in spending To the editor: One thing is abundantly clear at the Capitol: no matter how much we spend, someone in St. Paul always wants to spend some more. Minnesota expects to receive an additional $3 billion in revenue during the 2012-13 term, enough for a 9 percent increase in spending. That should be plenty to make ends meet, yet our governor proposes raising taxes by billions more to pay for a 22-percent spending increase over the next two years. The good news is our governor cannot spend money; he can only make reductions. The House offered his budget proposal during a tax committee hearing recently, but it was resoundingly voted down by members of both parties. Our state’s spending habits do not match the economic realities of today. I am a smallbusiness owner, so I know the

financial slumps and have struggled right alongside my customers. I also am a father who is concerned about tuition costs, and I worry whether my son will find a job when he graduates from college next year. Families are struggling to pay for gas and pay the mortgage. We have all adjusted our family budgets and it is time for our state to follow suit instead of insisting on spending more. We must quit the old habit of assuming spending more money will fix any given problem, while failing to scrutinize the outcomes and returns on our investments. I have authored a number of proposals to help our state run more efficiently and will continue working on new ideas. We need to stick with our priorities and live within our means. Tax hikes and spending increases will not help our business climate. It may require difficult decisions, but we must remain disciplined to shape a sustainable future for Minnesota. Kirk Stensrud Eden Prairie

Stensrud is the Republican Representative for the Minnesota House of Representatives, District 42A, which encompasses sections of Minnetonka and Eden Prairie.

Alternative school is good fit for daughter To the editor: I am writing to let the community know about an amazing but not well-known resource for area students called Prairie Center Alternative School in Eden Prairie. Our daughter was struggling to keep up in a large local high school. The big, lecture-based format did not meet her learning style. She was always behind. When a family accident struck, the emotional toll of the accident and ever mounting workload proved daunting. In stepped Prairie Center Alternative. The small class sizes and self-directed but structured classes have more than met our daughter’s needs. The

atmosphere promotes higherlevel thinking without the distractions present in many larger classrooms. Real learning takes place every day sparking many new interests and avenues of inquiry. The instructors are bright, engaged and caring toward their students. The administrators are flexible and interested in each student’s success. During a recent visit, I was impressed to see all students either quietly studying or engaged in small group discussions. The first day there, our daughter took a series of tests to assess her learning style. Those have shaped her ongoing instruction. Fridays are used to perform community service or interact with outside speakers. She now gets up easily each day because she wants to go to school. Even though she is going to school at Prairie Center Alternative, her final transcript will be from her local high school. For students who have a hard time with one-size fits all, Prairie Center Alternative is a model that works. Kim Montgomery Edina

OPINION

‘The blessed life’ BY PASTOR TROY DOBBS • GUEST COLUMNIST Today there is a mountain of warped and scandalous teaching floating around in Christian circles regarding prosperity and the “blessing” of God. The teaching is fundamentally flawed, biblically indefensible and conspicuously one-sided. It goes something like this: “God is a God of blessing. God wants to bless His people. That blessing is appropriated through our worldly reward system as Bling – Rings – and More Things.” Under that criterion, the flawed teaching becomes a perpetual lesson in how to readjust and realign your life so as to tap into those blessings. Solve the God puzzle and let the party begin – so to speak. And if, as a Christ follower, you don’t experience those types of blessings, it is nobody’s fault but your own; it is either a lack of faith or leanness in the sewing and reaping department. Now let me say from the outset, I believe the Bible teaches that God is a God of blessing and He does desire to bless His people (Genesis 12 and Acts 3:26). However,

the deceptive prosperity teaching propagates an overly simplistic formula as it pertains to relating to God – just crack the God code and God is duty-bound to bless. Obviously, God is not a problem to solve or a code to crack. Moreover, do we really believe we can manipulate God into releasing what is in His hands – and that the “only things” in His hands are “things?” The tragedy of this teaching is that it reduces the Christian experience to getting something from God, and “our getting” something out of God trumps “our loving” God with all of our hearts, minds, souls, strength and “our loving” our neighbors as ourselves (Mt. 22: 37-38). In addition, it eclipses “our living” all out for the glory of God (1 Cor. 10:31) not ourselves. Now to be fair, the message on “blessing” is not wholly inaccurate, but it is woefully incomplete. God does bless His people materially, but not all the time, and not just materially. Unfortunately, the concept of blessing in “religious America” has been notoriously equated with promotion, not DOBBS: TO PAGE 9

than 834,000 residents and 529,000 employees, recently launched a website and educational campaign. You can learn more about it at our new website – PropertyTaxFairness.com. With the legislature set to adjourn in late May, legislators will be making important decisions over the coming weeks. Take some time and reach out to our area legislators – tell them we need property tax fairness and ask what they’re doing to make it happen. State changes to property tax relief programs and local government aid payments could have a major impact on our disproportionate property tax burdens. Lawmakers should take this opportunity to make things more fair.

persecution; success, not suffering; getting invited, not getting insulted; bigger, not smaller; health, not pain; more, not less; and now, not later. Interestingly, the silence is deafening in Christian circles when it comes to the categories of persecution, suffering, insult, smaller, pain, less, and later as being a part of the biblical equation of blessing. These are the blessings of God that no one really wants. Consequently, when we settle for a truncated definition of the word “blessing,” we are destined not for a life of blessing, but for a life of frustration and defeat and misguided striving. Additionally, and I think most importantly, if our Christian experience becomes nothing more than the quest for God’s blessings, it comes at the high cost of missing God’s greatest blessing and reward of all: Himself (Genesis 15:1). So, let’s seek first God and His Kingdom because God is God’s greatest blessing.

Rather shocked, teacher Cathy Bockenstedt listens to Foundation for Eden Prairie Schools President Jeff Parker explain why the Foundation surprised her with an Honorary Teacher of the Year award. Even though she’s on the foundation’s board of directors, Parker said the nominations she has received and the things she’s done are worthy of recognition. leadership skills. While presenting the award, Jonathan Young, last year’s winner, noted Pollino also earned a 35 on his ACT. “Although all of these activities, accomplishments, and accolades are impressive, what really makes Andy stand out in our minds is his character,” the nomination letter from Julie and Joel Young said. “Andy is humble, courageous, kind, loving young man, who has consistently demonstrated his caring for others and his selflessness.” Volunteers of the Year: Ann Steen and Jo Benson Benson was nominated by community members, including Bill and Susan Paulus. “It’s hard to find a major band initiative that Jo is not supporting in one way or another,” the nomination letter said. “Jo has been a dedicated PTO member and contributor throughout many years with her children” in four different schools. Steen was also nominated by community member Deb Karulf. An excerpt from her nomination letter: “Ann is a humble helper. She just quietly accomplishes it all with a sweet spirit and smile on her face. Ann never bats an eyelash, but she takes on enormous tasks of volunteer coordinating with Herculean effort and equal success.” Alumnus of the Year: Paul Anderson A staff member and other alumnus selected Anderson, an associate justice in the Minnesota Supreme Court and member of the graduating class of 1961. He selected Eden Prairie High School for the Supreme Court oral arguments that took place May 5, so approximately 700 students could get a glimpse of how the court operates. Anderson has also been involved with various community education groups.

(Photos by Paul Groessel • Sun Newspapers) “I see this alum as a man who will be renowned for his work for a long time and we are proud to call him an Eagle,” according to nominator Eden Prairie High School Principal Conn McCartan. Staff of the Year, Individual: Kevin McGee He is an education coordinator for Eagle Heights Spanish Immersion. Nominator Andrea Becker wrote, “His efforts to support both students and teachers are seen daily. He actively encourages social justices, and brings this into schools via his language, volunteer opportunities, book collection, and hunger program efforts. Kevin just makes a person feel in control, calm, and capable of anything.” Staff of the Year, Group: Jim Anderson, Larry Paul, Ed Kerber, Rick Brockopp, Greg Paulsen and Bryan Van Ningren The nomination letter from community members highlighted the facility and maintenance crew’s daily efforts and their work during special events. “Each year we look forward to seeing the guys because they arrive with smiles on their faces and attitudes that make what is a very hectic day seem more relaxed.” Teacher of the Year: Vincent Thomas Thomas has taught math classes at Eden Prairie High School since 1972, according to nominator Jonathan Young. “His great sense of humor dictates a positive and relaxing environment in the classroom, making it easier to learn. … He demonstrates the important principles of both learning and teaching: having vision for the future of his pupils, committing himself to the best of the class, and taking action to ensure his students benefit from his teaching.” A complete list of nominees is available on the foundation’s website. GRADUATION TRIBUTE SECTION

Local governments regain variance authority BY MARC INGBER • SUN NEWSPAPERS Cities and counties have been given the OK to grant variances like they did in the past. Gov. Mark Dayton signed a bill May 5 that allows local governments greater latitude to grant zoning variances. A decision the Minnesota Supreme Court handed down in July 2010 changed the landscape for variances. The court ruled that a “municipality does not have the authority to grant a variance unless the applicant can show that her property cannot be put to a reasonable use without the variance.â€? That differed greatly from a 1989 decision that stated a variance could be granted if property owners “would like to use the property in a ‘reasonable manner’ that is prohibited by the ordinance.â€? In effect, the 2010 decision made it next to impossible for cities to grant variances, except in rare circumstances. It was handed down in the case, Krummenacher v. City of Minnetonka.

The bill Dayton signed May 5 is designed to clarify the law so that cities and counties can use the standards that had been in place for decades prior to last year’s decision. The new law states variances may be granted when applicants establish there are “practical difficulties in complying with the official control and they intend to use the property in a “reasonable manner. The variance law that went into effect last year affected more than $45 million in building projects, according to the 2011 Builders Association of the Twin Cities. “Any project requiring a variance was ground to a halt last summer, leaving property owners with no options to improve their property and builders and remodelers on the sidelines, said Rich Riemersma, the organization’s president. “These projects can now move forward. The bill went into effect immediately after Dayton signed it.

Total number of EP crimes decreases in 2010 BY PAUL GROESSEL • SUN NEWSPAPERS The number of reported crimes in Eden Prairie declined in 2010. The Eden Prairie Police Department released their crime statistics for 2010, which shows there were 52,041 calls for service. That’s a decrease from 2009, which had 59,470 911 calls. “2010’s more of an average, normal year for us,” said Sgt. Dennis Paulson. Even though 2009 was abnormally high, Paulson said new reporting and

ticketing software implemented last year will help streamline the citation process, which could actually mean more traffic and other violations in the future. “In the long-run, you’re going to see the numbers increase,” Paulson said. The software took some training and time to implement, Paulson said, so once the orientation process is over, the system will become fully efficient. The new system eliminates a lot of paperwork, he said. Rather than the officer writing out a traffic ticket by hand and distributing copies to the courts, the driver and the police department, the new computerized system can print and send citations from a squad car at the push of a button, Paulson said. In terms of specific incidents, there were two homicide cases in 2010 and none in 2009, according to Paulson. Both incidents involved infants, one of which started as a homicide investigation, but no homicide charges came about. “It was more of a possible child protection issue,” Paulson said.

The other homicide arrest was the recently settled Randel Richardson case. Richardson, a 37-year-old Eden Prairie man, was found not guilty of first-degree murder late last month due to mental illness. Reported domestic assaults also increased from 2009, when there were 95 cases. In 2010, there were 126 reported cases. Paulson said he thinks this is because officers have begun categorizing some incidents as domestic assault that they previously would not. Police calls may start as a public assist or disturbance, but upon closer look, officers classify it as a domestic situation. Officers then look for ways to prevent those domestic situations from becoming violent in the future, Paulson said. Part of that preventative work has come from the Domestic Abuse Response Team, Paulson said. DART formed in 2006, works with domestic abuse victims and makes efforts to preCRIME: TO PAGE 18

Richfield woman charged with swindling Eden Prairie employer BY PAUL GROESSEL • SUN NEWSPAPERS

A Richfield woman has been charged with swindling her Eden Prairie employer while acting as a bookkeeper. The following allegations were provided in a criminal complaint filed in Hennepin County District Court: Jessica Belcher, 28, worked as a bookkeeper for Skyview Dairy beginning in 2008. The business owner, an Eden Prairie resident, noticed that between Jan. 1, 2010, and March 14 of this year, Belcher had written five checks to herself from

the company. The total amount was nearly $5,000. Belcher had written the checks to herself and made it look like they had been written to other groups. Eden Prairie Police Department Det. Andrew Rohde interviewed Belcher, and after reading her rights, she admitted to depositing five work checks into her account without permission. She said she had intended to repay the company, but never did. Belcher has been charged with theft by swindle and if convicted could face up to five years in prison, a $10,000 fine or both.

Triathlete raising funds for Foundation for Eden Prairie Schools The Foundation for Eden Prairie Schools has announced Brad Canham will compete in the Wisconsin — Ironman triathlon on Sunday, Sept. 11. to raise funds for the foundation. An Ironman triathlon features three consecutive events: a 2.4-mile swim, a 112-mile bike race, followed by a 26.2 mile run (marathon) covering a total distance of 140.6 miles. It is one of the most challenging events for some of the nation’s best endurance athletes. Funds raised on the foundation’s behalf will go towards the purchase of additional robotics kits for the Eden Prairie Robotics team. In 2009, the foundation sponsored the initial purchase of 28 robotics units, which have been used in 9 different classes by 270 students. Every $365 donated will provide for

the purchase of an additional kit and help expand the robotics program in the schools. The Foundation for Eden Prairie Schools is a nonprofit organization that was founded in 1998 to support and enhance the legacy of excellence in Eden Prairie schools. A board of community volunteers runs the foundation. The foundation raises money for the schools by sponsoring events such as the Taste of Eden Prairie, the Alma Mater Trotter and the FEPS Golf Classic. Info: foundationforepschools.org.

At AirBroom Minnesota In Excelsior Can Help How does your chimney look? Are the bricks crumbling? Does it have White or Black exterior staining? Are you afraid to use your fireplace because you’re not sure how safe it is? When was the last time you used it? The professionals at AirBroom Minnesota Fireplace and Air Duct Cleaning in Excelsior can restore both your confidence and your chimney. Did you know that water causes more damage to masonry chimneys than fire? Your chimney, unlike other parts of your house, is constantly exposed to the elements. They are generally constructed of brick, mortar, tile, steel, and iron. All of these materials suffer deterioration as a result of prolonged contact with water. Freeze and thaw cycles so familiar here in the Twin Cities cause stress on the chimney. Water that has penetrated expands and contracts. Left unchecked it will cause interior and exterior damage to your home and masonry chimney. Some of the damage that can be caused includes: 1) spalled and broken exterior brickwork, 2) deteriorated masonry and metal firebox assemblies, 3) rusted dampers, 4) decayed mortar, cracked or missing flue liners, and in the worst case scenario damage to adjoining walls, ceilings, and woodwork. There are three main ways to prevent water damage. 1) Install a chimney cap. This is the most inexpensive measure to prevent water penetration to the flue and inside chimney elements. We sell and install locally manufactured caps for as little as $99.

Present this coupon after estimate

Ed Crandall and Dennis Imbody 612-607-0057 www.PROTECTPAINTERS.com

2) Repair or replace a damaged chimney crown. The crown sits atop your chimney and covers and seals it from the flue liners to the chimney edge. Many chimneys are built with an inadequate crown constructed from common mortar mix. Mortar is not designed for and will not withstand years of prolonged moisture exposure without cracking and chipping which allows water to penetrate the chimney. A proper crown is constructed of a Portland

cement mixture and formed to provide an overhang drip edge. This assures the water will shed helping to prevent erosion in the mortar and brick of the chimneys surfaces. Keeping the crown “watertight” and shedding away from the sponge like masonry elements that the chimney is built of is the most important element to preventing deterioration. At AirBroom Minnesota we use the industry leading line of Saver products to build and repair chimneys. Use of these products allows us to pass on manufacturers material warranties of up to 15 years to our clients. 3) Waterproof your masonry chimney and crown. Most masonry is porous and will absorb large amounts of water. Brick acts like a sponge absorbing water and wicking it to the chimney interior. Products we use are specifically developed for use as waterproofing agents on masonry chimneys. These are vapor permeable – which means they allow the masonry to breath out but not in. This allows water that has penetrated the chimney to escape while preventing additional water from entering from the outside. Non vapor permeable sealers commonly available should never be used because they trap moisture inside actually accelerating deterioration. We use a special permeable sealer with a 10 year consumer warranty to protect your chimney. Doing this before deterioration occurs can save you hundreds or even thousands of dollars in future repairs. Water damage to chimneys is usually a slow subtle process. The problem is generally not obvious until it has become quite serious. Although these prevention measures may cost you a few dollars they can save you a lot more by preventing large future masonry repairs. The Hartmann’s at AirBroom Minnesota in Excelsior offer free no obligation repair estimates in the Western Metro area. Call John, Jim, or Lynda today to arrange a free no obligation estimate. Visit us at AirBroomMinnesota.com or call us at 952.545.2254. As a bonus, repair jobs over $750 scheduled with us prior to May 31st receive $100 off when you mention this article.

Former home health nurse enjoys creating healthier homes New Windows for America expanding its products, efficiency and facility Rhonda and Jim Steffes have owned and operated New Windows for America in New Brighton since 2000. Their business has grown to 30 employees and moved in March 2011 to a bigger location in New Brighton off of 35W. The company sells and installs residential windows, doors, siding, attic insulation, metal and solar roofing. “We started as a windows only company, but over the years have expanded to include more energy efficient products,” said Rhonda, who started the company after working for 10 years as a home health care RN. “I went from taking care of people to taking care of homes. We want to be your Energy Savings Solution Company.” Jim was a CPA working as the chief financial officer for a manufacturing plant before he joined Rhonda in the company. “We were founded after all the hassles and high prices we obtained while searching for windows in our home,” says Rhonda. “We felt we could do it better, cheaper and with less hassles for the homeowner. We become your

‘window guy’ for any problems, questions or concerns. One call to us will take care of it.” With the federal government pushing homeowners to be more energy efficient, New Windows for America has joined forces with Xcel Energy and is now a trade partner. “Our relationship with Xcel Energy helps us help our customers save money by making their homes more energy efficient with attic insulation,” adds Rhonda. “We also made homes energy efficient with Energy Star certified windows, guaranteed to help save up to 40 percent in home energy costs.” Solar roofing is another new product the company is installing so homeowners can eliminate a large portion of their home electrical costs, which in turn helps decrease our dependency on foreign oil. For the last nine years the company has received the Super Service Award from Angies List and has an A-plus rating from the Better Business Bureau. They also have a 6 month Same-as-Cash financing program. Rhonda claims that a major key to their

success is having the highest quality installation, adding how “most of our customer feedback is reporting how conscientious and meticulous our installers are.” New Windows for America offers a double lifetime warranty including glass breakage and lifetime labor. All vinyl replacement windows are guaranteed for as long as you own the home. The warranty in non-prorated and there will be no charge for glass seal failure or glass breakage to the present property owner or the subsequent homeowner. “If you provide lifetime labor warranty, it needs to be right the first time,” adds Rhonda. In addition to the lifetime warranty the company offers an energy guarantee. Their standard window is a triple pane which is 30% more energy efficient than double pane windows most companies install. Besides being more energy efficient, Rhonda says other benefits of having new windows and siding include increased property value and security, noise reduction,

enhanced appearance of your home and they are maintenance free and easy to clean. Plus, the Remodeling Magazine's Cost Versus Value report concludes, when replacing 10+ windows with vinyl replacement windows, the home's immediate return of investment is 73.6 percent. New Windows for America offers a wood interior window that has the maintenance free vinyl exterior. This is a nice option for those who want to keep a real wood window in their home. The wood windows are available in both oak & poplar. “We have over 2,770 references, and have installed over 50,000 windows in the Twin Cities,” adds Rhonda. “Approximately 35-40 percent of our business is generated through referrals or repeat business.” Store hours are 7:30 a.m. to 8 p.m. Monday through Thursday, 7:30 a.m. to 4:30 p.m. Friday and 8:30 a.m. to 2:30 p.m. Saturday. Explore energy-efficient window coverings The ultimate goal of homeowners may be to install new energyefficient windows on their homes. However, the reality is that new windows can be a costly endeavor, one that's not necessarily for affordable for homeowners who continue to tighten their purse strings in a struggling economy. There are alternatives to installing new windows, including exploring options in energy-saving window coverings and draperies that can help prevent the exchange of air from inside and outside the home. Because they can be considerably less expensive than replacement windows, energy-saving window coverings are a viable option for those looking to eliminate drafts or preventing summer's heat from entering the home via windows that aren't up to snuff. There are several different styles from which to choose that make good alternatives for homeowners. Homeowners can convert traditional drapes into energy-saving options by making them fit more snugly. By securing the sides and the bottoms of the drapery to the walls with double-sided tape or Velcro, the curtains will contain the air that flows from the drafty window. Options also abound for homeowners who prefer blinds or drapes that are energy-efficient. Honeycomb blinds are the new alternative to mini blinds or verticals. They are made from accordion pleated fabric that forms a honeycomb pattern when the blinds are lowered. The double-layer blinds insulate the windows and can prevent heat

or cool air loss. Some accordion blinds are even rated for their efficiency. Black-out drapes can do more than darken a room for those who want to sleep longer in the morning. These drapes can keep hot sunlight out during the summer months, which can lead to a cooler home and less money spent on air conditioning. The same drapes can block drafts in cooler months because of the thickness of this type of curtain. Individuals who live in warm climates should select drapes and blinds that are light in color so they will reflect the sunlight and prevent rooms from overheating. Awnings or shrubbery placed by westand south-facing windows can help block even the harshest of the sun's rays. There are also energy-saving window films that can be applied to insulate windows and/or reflect sunlight. An added barrier between the glass of the window and the interior of the home may be all that's needed to make temperatures more comfortable. Until drafty windows can be replaced, homeowners can rely on energy-saving window coverings to help alleviate drafts or loss of cool air inside of the home. Different types of blinds and drapes can be used to provide insulation on drafty windows and prevent energy loss.

Consider concrete walls to replace wood Building the envelope of a house with concrete instead of wood is in high demand in the 21st century. Concrete is now a premium choice for delivering energy efficiency -- and as a replacement for wood framing, concrete walls reduce the need for trees and represent a big step in responsible building. Indeed, the latest technology in this field is able to deliver important energy savings -- as well as significant environmental and human health benefits. The award-winning wall system, by industry leader, Nudura, builds with pre-assembled forms, each one stacked, reinforced, and then filled with concrete. Once locked together (like Lego), the system creates a solid, monolithic concrete wall. Energy savings are recorded up to 70 percent. Drafts are eliminated. Wood-rot, mould, and the related toxicity are eliminated. The concrete building envelope is recorded to be up to three times more sound resistant, four times more fire resistant, and nine times stronger. More information on this building system is available online at www.nudura.com.

Concrete is an increasingly popular choice as a replacement for wood construction.

Poey said Hopkins had changed quite a bit in the last 10 or so years, adding its art center, new restaurants and other businesses. He likes that people will be able to enjoy his art as they walk through downtown. “(Hopkins) is doing everything in its power to involve the community,” he said. “It’s a wonderful way to get the community involved in the visual arts.”

Besides Poey, the other artists featured include Kyle Fokken of Minneapolis, Norman Holen of Richfield and Deb Zeller of Victoria. Elverum said two of the ArtStreet program’s goals were to support artists and provide them the opportunity to reach new audiences and make highquality art easily accessible to the greater Hopkins community. The city also wants to re-enforce the brand of Hopkins as an arts community. Residents will be asked to vote on their favorite piece, including a special chil-

dren’s choice award. “It is hoped that the project brings both current residents and new visitors to Mainstreet and in doing so, they discover all the great things Hopkins has to offer,” Elverum said.

Opening reception The ArtStreet sculptures will be installed the afternoon of Friday, May 20. An opening reception will be held 6-8 p.m. that evening at the Hopkins Center for the Arts, 1111 Mainstreet.

In 2009 there were 59 non-residential burglaries, compared to 25 in 2010. Paulson said the arrest of Mark Seaborn in late 2009 could account for burglaries being cut in half. Seaborn was convicted of burglary in 2010. He had five burglary convictions prior to that.

Homes FROM PAGE 5 “We really think the mission is great for our communities,” said Hamilton, an Edina resident and co-chair of the event. Homes Within Reach purchases typically foreclosed and abandoned properties with funding from local, state and federal programs, and private donors. The properties are then refurbished to safety, health and efficiency guidelines before they are sold to the new owners. Fixes can include new electrical wiring, windows, roofs and appliances. Owner Christine Johnson, who’s been in her St. Louis Park house for a year and a half, said she was blown away by its condition. “Everything was new in my home except for the washer and dryer,” she said, taking away the risk for immediate costly repairs that could break the bank. “They make sure that you will be able to succeed in home ownership.” Johnson, who works as certified peer counselor for Ramsey County Adult Mental Health, is a foster parent and single mom to an adopted 4-year-old boy. She said she had never entertained the possibility of owning a home until she saw a Homes Within Reach flier in a coffee shop. To qualify, buyers must earn less than

80 percent of the area median income. Most clients make closer to 58 percent, said Lindbo. The average household income is $40,868. Buyers must be able to get a mortgage. The average monthly mortgage payment is $907, often equal to or less than the cost many were paying to rent. Lindbo said while home prices have dropped in some areas over the past few years, the cost of the land has not decreased in the suburbs. Homes Within Reach has found available properties need more work, offsetting savings. Additionally, more people are looking for affordable options as wages and hours have been reduced. At the same time, nonprofits are facing funding challenges with public and private sector cuts. For example, Community Development Block Grant dollars were reduced 16 percent in the 2011 federal budget, Lindbo said. Homes Within Reach receives money from that source from three of the communities it serves, including $82,000 allocated by the city of Edina in 2010. Lindbo said currently Homes Within Reach is able to add 10-15 homes a year to its roster and at any given time is working with up to 30 applicants in different stages of the process. Board member Patti Marrinan of Edina said her favorite part is seeing the smiles on new homeowners’ faces after closing.

In the Community, With the Community, For the Community

For Marrinan, co-chair of the upcoming benefit, housing has long been a passion. She remembers her father, a real estate agent, working hard to get one young couple into their first home. Her mother’s plan to finally paint their own house was dashed because it turned out he didn’t take any commission. “My father had this passion that all people should have a home and I’ll never forget that,” she said. Minnetonka resident Rebecca Edmondson is also on board, a third of which is comprised by clients like herself and Johnson. Edmondson said she wants to give back to others what she’s received since purchasing her home a year and a half ago through Homes Within Reach. Unlike most clients, Edmondson was not a first-time buyer. She sold her first home 15 years ago to move to Mexico, where she worked as an academic advisor for a private international Catholic school system, eventually becoming a vice principal. She was later transferred to Chicago. After going through a divorce, she came home to Minnesota, however, her teaching license didn’t transfer. She heard about Homes Within Reach while working part-time at an after-school program She said having a permanent home near family was important for her and son Lalo, 12, after moving so many times in recent years.

“Our house is in a very nice neighborhood,” said Edmondson, who is nearing completion of a master’s degree in curriculum development. “There are a lot of kids my son’s age here. His new best friend lives next door. He can walk to his school bus and feel safe.” Once owners purchase their home, they can stay there even if their income increases beyond 80 percent of the area median. If they decide to sell their home during the course of their 99-year land lease, it must be sold to a qualifying buyer. Often, owners will work with Homes Within Reach to complete the transaction. Hamilton said each investment over time has the potential to serve a large number of people. “The average person stays in one of our homes for about nine years,” said Hamilton. “Because we can put this land in our trust for a century, our 90 homes will serve 900 families.” Lindbo said the communities where the homes are located also benefit from the new dedicated homeowners and community members. The Trailers said they enjoy owning a home and doing all of the work that comes with it. They are already planning some upgrades in their kitchen. “We have all these dreams for the house,” said Angie. “It as completely move-in ready and now we can totally dream whatever we want to.”

The court usually accepts one in eight cases presented to them, according to a statement from the court. “We have a very routine work life. I can tell you a year from now what I’m going to be doing. … We spend a lot of time reading and writing, and that’s the bottom line,” Meyer said. Schools. Principal Conn McCartan also credited him with bringing the Supreme Court to Eden Prairie High School to give the students a glimpse of the court’s operations. Providing a better understanding of how the court operates was the goal of having it at the high school for the day, and it was the 33rd time the court has made oral arguments accessible to students across the state, according Finne. Students were also prepped before the justices and attorneys played out their day on stage. Attorneys from Minnetonka-based United Health Group went to the high school to conduct classroom discussions in preparation for the visit. Before the justices departed for lunch and some classroom visits, Justice G. Barry Anderson gave some sage advice when an audience member asked how students could prepare to become a Supreme Court justice. He said not to set that as a lifetime career goal, because so many different things can happen throughout a career or lifetime. That would just be a setup for disappointment. So, his advice to prepare for a possible becoming a judge would be the advice he’d give to anyone, regarding any career. “Find work that you love, do well at it and to be an active, responsible citizen [then] let the chips fall where they may,” he said.

BY GREG KLEVEN • SUN NEWSPAPERS This has been a difficult spring for Minnesota Twins manager Ron Gardenhire. His baseball team has struggled because of illnesses, injuries and lack of hitting. Eden Prairie High School baseball coach Mike Halloran has dealt with a few injury issues as well this spring. His No. 1 starting pitcher Adam Bray opened the 2011 season by throwing a 10-0 shutout against Bloomington Jefferson April 14. But Bray injured his ankle and was sidelined for half of the season. And several other Eagle regulars have been bothered by injuries. But while the Twins have struggled to a losing record, defending state Class 3A champion Eden Prairie has relied on its depth to post an impressive 13-3 overall record and 7-2 Lake Conference mark. Bray, who had a 7-0 record last season, made his second appearance of the season May 9, when the Eagles defeated Edina 4-3 at Braemar Field. He picked up a save in relief by striking out three Hornet hitters in the bottom of the seventh. Lance Thonvold (3-0) recorded the pitching win by allowing eight hits and three earned runs in six innings. “It was nice to get Bray back on the mound and a few other players healthy,” said Eden Prairie head coach Mike Halloran. “We have been plugging along and our players are working hard. “We just haven’t been fielding or hitting on a consistent basis. We made four errors in a 6-2 loss to Minnetonka last week. “But we are getting pretty good pitching and strong efforts from our players,” added the Eagle coach.

The Eden Prairie resident has played a key role on the Holy Family baseball team this spring. Hanson went 5-for-9 with two home runs and four RBI during a doubleheader sweep of Montgomery-Lonsdale (16-6, 8-5) last week. Holy Family has a 9-1 record.

Kate Tobin The Eden Prairie native and Augustana College senior was named to the AllNorthern Sun Intercollegiate Conference women’s golf team. She had a 78.1 stroke average heading into regional play and finished second in the Minnesota State Invitational.

Matt Griffin Eden Prairie shortstop Tony Skjefte covers second base on a pick-off attempt of a Minnetonka runner during the Eagles’ 6-2 May 4 at Round Lake Stadium. Skjefte and his Eagle teammates have a 13-3 record heading into the final two weeks of the regular season. (Photo by Brian Nelson • Contributing Photographer) Tyler Ruemmele and Ryan Bull had two hits apiece in the one-run win over Edina. Thonvold contributed one hit and one RBI. Danny Blasy had one hit and two RBIs. Eden Prairie defeated Hopkins 6-4 May 6 at Round Lake Stadium. Ruemmele improved his pitching record to 4-1 with the win. He allowed four hits and struck our five in five innings. Thonvold picked up his fourth save of the season working the final two innings. Ruemmele continued to pound the ball. He finished with three hits, including a home run, and drove in three runs. Bull and Thonvold had two hits apiece. Thonvold and Tony Skjefte were credited with one hit each. Eden Prairie swept a pair of games against Wayzata last week. The Eagles

beat the Trojans 4-1 May 2 as Thonvold pitched six innings and struck out nine while giving up eight hits. Reliever Dylan Frederick pitched the final inning to preserve the win. Skjefte drove in one run with a sacrifice fly. Ruemmele also had one RBI. Grant Soderberg collected two hits. Eden Prairie defeated Wayzata 9-1 May 3 as Soderberg was the winning pitcher. He allowed seven hits and struck out four in five innings. Anthony King-Foreman pitched the final two innings and gave up only one hit. Ruemmele and Blasy had two hits each. Blasy was credited with two RBIs. Ryan Maenke had one hit and two RBIs. Skjefte drove in another run with a sacrifice fly.

The Eden Prairie boys track athlete placed first in the 300-meter hurdles with a time of 41.40 seconds in the Eden Prairie Booster Invitational April 30. Griffin finished third in the 110 hurdles (16.02).

Ciera Stifel Stifel had four goals and three assists as the Eden Prairie girls team defeated Hopkins 18-5 April 26.

Women with Low Thyroid Many people live their lives suffering from low thyroid symptoms. This is especially true for females. Thyroid hormones control all your metabolism, and when thyroid hormones are low they cause all the cells in your body and mind to slow down. These symptoms include fatigue, weight gain, mood swings, sweet cravings, depression, sluggish thinking, thinning hair or hair loss, and cold hands and feet. For some people digestive problems like constipation and acid indigestion may signal low thyroid. Even when taking thyroid medication, many people continue to suffer from the symptoms of having low thyroid. Some people are even told their lab tests are normal but still continue to endure the symptoms of low thyroid. However, there can be a solution for symptoms from low thyroid! Dr. Phil Gilman DC FMA FASBE, a published thyroid researcher and chiropractor, is holding a seminar to discuss low thyroid symptoms. His research shows that while blood tests are valuable in evaluating thyroid dysfunction, often the basic tests are inadequate in finding the underlying causes of low thyroid. For example Dr. Gilman’s published research showed that liver func-

tion affects low thyroid. This research also showed that low thyroid persons have a observable posture and testable muscle weakness. There are six patterns of thyroid dysfunction and only one of them responds well to thyroid medication. That is why so many have been disappointed in their results. During the seminar Dr. Gilman will reveal the number one cause of low thyroid in the United States, why many women taking replacement hormones won’t get better, six patterns to thyroid problems, and why doctor’s don’t run complete thyroid tests. He will also discuss the one food that is often involved in low thyroid and how to test for it. In addition to exposing these truths about thyroid treatment, Dr. Gilman will also discuss natural solutions to correct thyroid problems. Due to the high demand and sensitivity of this information, seating for Dr. Gilman’s private thyroid seminar is limited to 15 people. It will be held on Tuesday, May 17th at 6:30 PM at the Hampton Inn, 4201 American Blvd W in Bloomington. Please call 651-681-8199 to reserve a seat today!
