From the E D I T O R Greetings from A-Desiflava. 2024 holds a whole lot of reflection and hope - two things I can embrace wholeheartedly. And, I can appreciate the inspiration ignited by the fresh start of a year month, or week as much as anyone. For me, it gets a bit off course when we start longing for the “new” as if it is the antidote to all that was wrong with the “old”. In the case of a new year, it is (as my more cynical friends have pointed out), just turning the calendar page - and that isn’t going to change much about our lives or circumstances. And, how long before the “new” year is no longer “new”, anyway? Our eyes and minds may tell us we want new and fresh, but what our hearts long for most is a restoration of the things we couldn't achieve or do in 2023. I hope 24 will offer a perfect restoration to continue or even start things we couldn't achieve last year. All the best to the entire Indian and south Asian community of Hong Kong. A-Desiflava Magazine has entered its 13th year of publishing in Hong Kong, and none of this would have been possible without our readers. An old man living in TST, calls me on the 10th of every month to check if a new issue of A-Desiflava has been released this month. Trust me, he's been calling me for over 10 years now. The strange part is, if I don't pick up his call, he calls on the landline and checks about the magazine. A big thanks to you Sir, a stranger and lover of our magazine. It's because of people like you I'm still so motivated and energized to keep publishing our magazine, even with the Print Ads completely drying out over the years. But I always tell everyone, I run the magazine, not for money, but to connect with these kinds of strangers in life, who admire, respect, and acknowledge your work and motivate you in life to keep going. With every new issue, I think of something unique for the cover story. For this issue, instead of covering the owners of the famous Indian restaurants in HK, I thought why not cover the culinary experts behind some of the famous Indian restaurants of HK. Our COVER STORY is a candid interview with chefs of four top Indian restaurants in HK. A chef's role is not an easy one. The pressure in which they work cannot be imagined. Our cover story is a thanksgiving, acknowledgment, and gratitude to these hidden gems whose faces you would never see in real life, but their fingers are touching your mouth and hearts almost every day. Next time you visit any of these restaurants, please call out for the chef by his name say thanks, and mention I read about you in A-Desiflava. I'm sure, by doing this, you'll add ten more gems to his proudly worn toque. The FEATURED column is about HK's oldest and biggest Hindu Temple in Happy Valley. The article not only speaks about the history of this temple but also highlights its community involvement aspect. BUZZ-IN-TOWN column is really about a very buzzing and upcoming event in HK, organized by Beyond Bollywood and Sri Shakti Academy. Krishnarpanam is to take the stage in Hong Kong and tickets are still available! In this issue, I've introduced two new columns, KEEP GOING and STARTUPS. Our guest author Sandra Roe's story is a perfect opener for this KEEP GOING. You will read, how despite so many setbacks in her life, she kept rowing and kept going to come out as a winner. Similar inspiring and motivating real-life stories will be published in this column. STARTUPS is my personal favorite column. When you START you need someone to show you UP. You may have a mentor or guide, but remember it's only YOU who can continuously look UP. This column will be handled by a very talented and expert startup guru and consultant Tidimalo Shabalala. I will keep contributing my side of stories as well, as I can share my success stories based on what I went through during the Startup phase of A-Desiflava. The magazine is filled with other exciting and interesting reads in our regular columns. I don't want to make my editor's note too lengthy and want my readers to start flipping the pages. So go on and enjoy reading another issue of HK's first and only surviving South Asians magazine. As we step into the new year, I invite you to continue this journey with me. Could you provide us with a brief profile of yourself as a Chef, including your name and the restaurant you work at? My name is Biplob Biswas, and I am originally from Kolkata. I have been working at "Kailash Parbat" for a long time, following in the footsteps of my father, who also worked here. As an Indian chef, I serve as the head chef in Hong Kong, ensuring that our culinary offerings are of the highest quality and authenticity. I am Ram Bilas, and I come from Uttar Pradesh. At "Kailash Parbat," I specialize as the chaat chef. Cooking chaats is a family tradition for me, as my father and grandfather also worked in the same restaurant. The original founder of "Kailash Parbat'' personally trained my grandfather on the art of preparing chaats, and we continue to follow the exact recipes handed down through generations of Moolchandanis. With our dedication to maintaining the

authenticity and excellence of our legendary chaats, we strive to bring joy to our customers' palates. Q2. As a chef at "Kailash Parbat" Indian Restaurant in Hong Kong, what is the most important thing you enjoy about your work? Ram says, “The most important thing I enjoy about my work is seeing the satisfaction on our customers' faces.” Our main motto is to ensure that our customers have an enjoyable experience and leave our restaurant with a smile. It brings me immense joy and fulfillment to work as part of

a close-knit family, serving customers whole-heatedly with a commitment and passion for our craft. We consider it our privilege to create memorable moments for our customers and to witness their happiness. The satisfaction and enjoyment of our customers are what make every day in the kitchen worthwhile. Q3. If you were told to provide a lower-calorie menu and had to make each of your dishes healthier, how would you approach that process? Ram gave us the insights–In our general menu, we already have lots of low-calorie

options that are not only lower in calories but also high in nutrition. For example, we have a dish called Bhelpuri, which consists of rice puffs mixed with vegetables, green chillies, jaggery, tamarind, and coriander. It's a flavorful and wholesome choice. We also offer tandoor items like Paneer Tikka and Malai Paneer Tikka, which are high in protein and are charcoalgrilled, making them low in fat. These healthier options are not only delicious but are also recommended by dieticians. When it comes to drinks and desserts, if we fry anything, we ensure we use good quality oil and maintain the proper temperature to minimize oil absorption. Q4. What is the signature dish at "Kailash Parbat" Indian Restaurant that is most enjoyed by the people of Hong Kong? Biplob commented, “At "Kailash Parbat," we take pride in offering a diverse menu that appeals to people from all walks of life. We don't have just one signature dish; rather, our entire menu is filled with popular and well-loved dishes. From our flavorful chaats to our delicious mains, Indo-Chinese specialties, house specials, desserts, and drinks, people appreciate the wide variety of options we offer. Our goal is to create dishes that not only cater to the Indian community but also intrigue and delight the local Hong Kong population.” For instance, our "pani puri" stands out because all the ingredients are made inhouse, ensuring freshness and an authentic kick.

Another dish that has gained a devoted fan following and received praise in numerous magazines and publications is our "chhole bhature." These fluffy Indian breads served with healthy chickpeas, rich in protein, and accompanied by our house-made chili pickle, never fail to bring a smile to diners' faces. In the drinks category, our mango lassi is incredibly popular and is almost a mustorder for any table, and the cheese-stuffed mushrooms from our "tandoor" section are the highest-selling items. Our "Paneer Lababdar" dish is loved not just in Hong Kong but also across the world. We also showcase Sindhi items like Tikki chaat and Ragda Pattice, which are rarely found in other restaurants, allowing our patrons to experience the rich traditions and culture of India. And, of course, our legendary ‘Mango Lassi” and "kulfi" is a crowd favorite that adds a sweet touch to every meal. Q5. Can you share with us your day-to-day responsibilities and how you manage through peak hours especially on weekends in Hong Kong?

Biplob shared with us, “As a chef, I have a range of responsibilities that keep the kitchen running smoothly. One of my key responsibilities is ensuring quality control. I make sure that every dish leaving the kitchen meets my high standards and fulfills any special dietary requirements or instructions from customers. Additionally, I handle store management and prioritize hygiene to ensure the safety and wellbeing of our customers.” To manage through peak hours, especially on weekends, I implement an efficient structure to distribute responsibilities to the staff. I conduct briefings with the team, ensuring everyone is aware of their tasks and responsibilities. Communication is crucial, and any feedback I receive from senior staff members is passed on to my teammates. By working together as a team, we ensure operations run smoothly even during busy periods. We have extensive experience in handling outdoor catering, corporate parties, Diwali parties, and even Dandiya events. Dealing with high numbers has made us well-practiced and

accustomed to handling high demand and large footfalls. For example, during Dandiya events in collaboration with A-desiflava, we set up a food counter, and everyone was delighted with our offerings. It's not solely my responsibility to manage the entire situation during peak hours. It's a team effort that involves floor staff, inside supervisors, other chefs, floor supervisors, stewards, and utility personnel. Together, we work efficiently to ensure smooth operations and provide exceptional service. Q6. What is the most challenging part of being a chef? Ram adds, “Working as a chef in Hong Kong's Indian restaurant scene comes with its unique challenges.” We cater not only to the Indian community but also to local Chinese, expats, and even local Indians who may not prefer spicy food. It's essential for us to infuse flavors without overwhelming spiciness, carefully considering different taste preferences. Additionally, there are dietary restrictions to consider, such as gluten-free and vegan options, which were not as prevalent back in India. For vegan dishes, we can't even use dairy products, which are a backbone of many Indian dishes. However, these challenges fuel our creativity and push us to find innovative ways to bring flavors to the table. Overcoming these challenges is incredibly satisfying and brings me immense happiness.

Q7. What are the three traits that you believe every chef can benefit from having? Ram believes in–”There are three essential traits that I believe every chef should possess. Firstly, time management is crucial in a fast-paced kitchen environment. Being able to prioritize tasks, work efficiently, and meet deadlines is essential. Secondly, hygiene consciousness is paramount to ensure the safety and well-being of our customers. Maintaining a clean and organized kitchen and following proper food handling practices is of utmost importance.” Biplob adds, “ Finally, being innovative in your work is essential. Whether it's creating new dishes or adding a unique twist to existing ones, being innovative keeps the dining experience fresh and exciting for our customers.” Q8. How do you feel working in Hong Kong's Indian restaurant scene? Biplob says, “Working in Hong Kong's Indian restaurant scene is truly an honor for me. I have the opportunity to cater to a multicultural community, and the Indian community in Hong Kong is incredibly welcoming. They make me feel at home, and it's like a home away from home. I take great pride in representing Indian cuisine outside of India.” Initially, people warned me that I might feel homesick, but thanks to our amazing team and management, I never do. It's an absolute honor to live and work here.

Q9. Which celebrity chef do you idolize or admire the most? Ram answered, “One celebrity chef I truly idolize and admire is Claudio Aprile, a renowned Masterchef and celebrity chef from Canada. What I appreciate about him is his down-to-earth attitude and commitment to his work.” He always has a constant smile on his face, which not only creates a calm atmosphere in the kitchen but also instills confidence in his teammates. His passion for food brings creativity and innovation to every dish, ensuring that customers have a unique and delightful dining experience. Claudio Aprile's work and approach to cooking inspire me to constantly strive for excellence in my culinary journey. Q10. Which food ingredient is the most important in your restaurant's menu? Biplob and Ram were thrilled at the questions and collectively answered, “Favorite question! Well, there are a few key ingredients

that play a vital role in our restaurant's menu. “ They told us, firstly, good quality spices are the backbone of our flavorful dishes. We ensure that we use the finest spices to enhance the taste of our food. Secondly, paneer (Indian cottage cheese) holds immense importance in vegetarian restaurants. We use the softest paneer, known as "malai paneer," and prepare it fresh to ensure its quality and taste. Thirdly, yogurt forms an imperative base of our cooking framework. We pay acute attention to the texture and fine details of our yogurt, which has come to be defined by customers as ‘snowy yogurt’. Our mango lassi, which is a best selling item on the menu, enjoys the main consumption of yogurt.

Chef Thomas from Jashan Chef Thomas, shares with us interesting insights on how he manages one of HK’s all-time Indian food extravaganza grounds– Jashan. Could you provide us with a brief profile of yourself as a Chef, including your name and the restaurant you work at? Hello, I'm Chef Thomas, and I come from India. I am a culinary professional with diverse experience in both North and South Indian cuisine. Currently,

With six years of experience at Jashan, I have had the privilege of working under the guidance of Mr. Terry, a highly respected hospitality professional. His expertise and mentorship have greatly influenced my culinary journey.

As the Indian Executive Chef at Jashan, I have the privilege of leading an excellent team of five chefs. Together, we work as a well-coordinated unit, following standard operating procedures to maintain our quality control systems, ensure customer satisfaction, and uphold consistency in our dishes. During peak hours, especially on weekends, we rely on our efficient teamwork and experience to manage the bustling kitchen. Our focus is on maintaining the high standards we set for ourselves, sourcing top-notch quality ingredients such as lamb and chicken, and delivering exceptional service to our valued customers. Q6. What is the most challenging part of being a chef? One of the most challenging aspects of being a chef is ensuring the consistent quality of the food we serve. Every time a customer visits our restaurant, they expect the same high standards,


taste, and presentation. At Jashan, we strive for excellence and do not compromise on quality. We refrain from using any MSG in our dishes, yet we relentlessly pursue the best flavors. Customer satisfaction is of utmost importance to us, and we work diligently to meet and exceed their expectations. Q7. What are the three traits that you believe every chef can benefit from having? Three essential traits that every chef can benefit from having are discipline, teamwork, and leadership. Discipline is vital as it allows us to pay attention to every small detail, ensuring precision and consistency in our culinary creations. Teamwork is crucial in maintaining a harmonious and efficient kitchen environment, where everyone, from dishwashers to general duty managers, works together towards a common goal. Lastly, leadership skills enable us to guide and inspire our team, even in challenging situations, fostering a positive work atmosphere and delivering exceptional dining experiences. Q8. How do you feel working in Hong Kong's Indian restaurant scene? It is an absolute pleasure and a tremendous opportunity for me to work in Hong Kong's Indian restaurant scene. Being able to showcase the best of India – its diverse cuisine and the warmth of its people – is truly gratifying. Which celebrity chef do you idolize or admire the most? There are a few celebrity chefs whom I idolize and have learned a great deal from. One of them is Sanjeev Kapoor, whose expertise and passion for Indian cuisine have been an inspiration to me. I have also gained valuable insights from Chef Khurana from Hyatt, whose culinary skills and innovative approach have shaped my own culinary journey. Additionally, I must give credit to all the sous chefs I have worked with during my training and career.

At Jashan, there are two crucial elements that define our menu. Firstly, the blend of Indian spices and herbs is mandatory for our restaurant. We pay meticulous attention to the selection and combination ofspices, as they are the essence of Indian cuisine. With VIPs and high-end clientele, including consulate officials and investment banking professionals, frequenting our restaurant, we ensure that our quality is never compromised and that our flavors are truly authentic. Secondly, the love with which we serve food is an integral part of our menu. Jashan fosters inclusivity, and we believe that our purpose extends beyond simply making money. We aim to create lasting memories and forge deep connections with our customers. With abundant hospitality, we serve our guests, making them feel valued and cherished. This personal touch enhances the overall dining experience and allows us to connect with our clients on a deeper level. I hold Chef Justin Paul in high regard and consider him my idol. I had the privilege of working closely with him during my time in Macau, and I was inspired by his innovative and creative approach to the culinary arts. What is the story behind the Hindu Temple? In the bustling city of Hong Kong, a Hindu Temple stands as a beacon of spirituality and community. Located proudly at Happy Valley in Wanchai, was a gift to the HK Hindu community and beyond by The Hindu Association, who established the holy premises on 15 February1953 after twentyseven years of extensive planning and hardwork. The construction of the temple was encouraged by the already strong presence of Hindu community in HK and the cascade of flow of Indian immigrants into Hong Kong post the Indiansubcontinent partition era, including a lot of traders who found opportunity in trades of cotton, silk and opium. The temple was welcomed with great fervor, gratitude and warm reception by the Hindu community then and till date continues to thrive and serve as an important social, cultural and religious landmark for not only Hindu devotees, but also to the wider demographic who seeks to attain a better understanding of Hinduism and contribute to our society in meaningful ways. It’s one of the largest of its kind in Hong Kong. The present significance, influence and devotion to the temple is an ode and testament of the dedication of our community towards our values, heritage, roots, customs, traditions and most importantly, our strength as a religious institution.

Who is responsible for the stewardship behind this majestic Temple? Over the past four decades, Lal Hardasani, President of the Hindu Association, has been an integral part of this sacred place, serving as the Trustee of the Temple and overseeing its activities meticulously with unwavering dedication. Together with a 15-member Managing Committee, they convene regularly to discuss the administration of the Temple. In a heartfelt message, President Lal Hardasani has assured all devotees that their needs will always be met, emphasizing that their suggestions and ideas are not only welcome but also encouraged–”we are always there to serve you and help you when you need us the most”. He’s one of the first visionaries to take initiative with respect to transformations and pioneering needed changes in the temple under his tenure of Presidentship. Deepak shares, “Despite being new to the unfamiliar realms of HK, my sense of curiosity and continuous learning drive led me and my wife, Neha to seamlessly integrate into the temple’s environment and worshiping duties.” Maharaj’s presence infuses each ritual with a sense of profound reverence and solemnity, and for all of us looking to embrace our traditions, we find a guiding hand and enlightenment in Deepak ji and his devotion. The duo also shared with DesiFlava their mantra to success –“To be successful in life, you need 4 things–Vision, devotion, hardwork and grace of God which will come via your efforts in fostering your connection with him.” Under the committee, The Temple has managed to

maintain a commendable transparency, with a clear record of accounting, ledgers, receipts, donations and financial reports in the Treasury. The accounts are circulated to all the members of the committee during the Annual General Meeting.

What are the activities in the temple and how can you get involved? Under their diligent guidance of the leadership team, the Hindu Temple has flourished into a vibrant hub. There is a special Sunday ‘bhajan’ session every week, from 11:30-1:00 pm, attracting a massive gathering and fostering a sense of unity and togetherness among the Hindu community. After the Bhajan Kirtan session, ‘aarti’ is performed in the morning and ‘Langar Prasad’ which is an impressive five-course vegetarian lunch is served to devotees funded by community contributions. Mondays witness a special ‘aarti’ during the evenings followed by ‘prasad’ distribution to the worshippers. It is also known

as ‘Abishek’ symbolizing Lord Shiva’s togetherness with us each passing week. The temple makes special arrangements for pooja items like garlands to be specially sourced from Singapore and India–a dedicated group of devotees brings handmade materials and food to join in the celebration. Regular Poojas and Aartis are performed daily in the morning and evening.In addition, regular Poojas are conducted on Poornima and Ekadasi days every month. Services are in Hindi, with some English used. The Temple also observes and celebrates all the major Hindu festivals with great enthusiasm, pomp and show, showcasing the rich cultural heritage and religious traditions of the Hindu community. One of the prominent festivals celebrated is Deepavali, also known as Diwali, which is a vibrant festival of lights. It is observed over the course of three days and involves lighting earthen oil lamps, fireworks, and the exchange of sweets. Another significant festival is Hanuman Jayanti, which commemorates the birth of Lord Hanuman. Devotees fast, recite prayers, and engage in the chanting of sacred mantras.

Holi, the festival of colors, is another joyous occasion celebrated with utmost joy. Participants play with colored water and powder, sing special Holi songs, and engage in bonfires to symbolize the triumph of good over evil. Janmashtami, the birthday of Lord Krishna, is marked by fasting, devotional singing, and recitation of sacred hymns. Navaratri, meaning "nine nights," honors the nine manifestations of Goddess Durga. Devotees observe fasting, offer prayers, and participate in cultural programs and traditional dances. The Temple also celebrates Karwa Chauth, Radha Ashtami, Rakshabandhan,

Shivratri, RamNavmi and Dussehra among the many other important Hindu festivals. These festivals bring the Hindu community together, fostering a sense of unity and devotion. These are especially popular times to visit The Temple, attracting about 600 to 800 celebrants. The Hindu Association offers the service to the Hong Kong Hindu community, arranging the Crematorium, completing the formalities that are required to be fulfilled with the relevant HKSAR government departments, and ensures the availability of the Crematorium as early as possible.

What’s new? Renovation of the Temple: The temple is a declared Heritage Building - Grade II by the HKSAR Government. The Old Building To cater to the need of evergrowing expansion of our Hindu community as well as to address the needs of accessibility and adequate spacing, the Hindu Temple has undergone rigorous renovation over the last few years, spearheaded by its community members and

has emerged to be a victorious and bigger backdrop for Hindu devotion, yoga, meditation, spiritual lectures and marriage ceremonies. Completed wellahead of its 70th anniversary, the repairs and enhancements in the renovation include new carpeting,tiling, flooring, waterproofing, air-condition configurations, re- painting of the idols, installment of a TV in the temple’s Mohan Hall to facilitate spectators’ viewing on special crowded events. The decoration and marble pieces were especially imported from India for the works. Several functional areas like office, conference room, storerooms, kitchens, additional halls were expanded and developed. The temple has therefore significantly expanded in capacity and all the works have cost approx 30 million Hong Kong Dollars.

Digitization efforts by the Temple: Deepak Maharaj Ji shared, “ The Hindu temple has made remarkable strides in embracing digitization and leveraging technology to enhance community engagement. By replacing traditional pamphlets with interactive flyers, we've reduced paper waste while providing a more immersive experience.” Their consistent presence on social media

platforms, including a dedicated Facebook page, the introduction of WhatsApp broadcasts has allowed them to reach a wider audience and disseminate important information and engage in real-time conversations. Through these efforts, the temple has successfully created a more dynamic and accessible spiritual hub. The temple continually invites and gracefully accepts generous donations throughout the year, with the latest Octopus machine installation making it easier for devotees to contribute.

First-time initiations and accomplishments: Given the growthdriven mindset of the Temple’s leadership team, there’s an array of new spheres, avenues and accomplishments that is entered by the Temple very frequently, and we bring to you the most notable ones in the recent times: 1) Immersive act on Ravan Dahn: The temple seeks to offer more memorable experiences, and choreographed a drama dance act for the first time in a short notice during Dussehra. The Ravan/demon was also created from

scratch in-house rather than extensively outsourcing it. It received widespread positive critical acclaim from the audience, encouraging the administration to plan future productions like Ramleela. Participation is encouraged via responses in broadcast channels. 2) Establishment of Ganpati ji with God’s grace for the first time, which was usually otherwise done by the Maharashtra Mandal. 3) Remembrance Day: The slope behind the Temple embodies the graves of the valiant Indian soldiers who laid down their lives during the First World War assisting Britain’s army. In an endeavor to honor their legacy, the Temple has been observing a special Remembrance for the brave at 11 am every 11th November since the last three years. The service is carried with full customs, traditions and salutes in presence of esteemed guests and VIPs. It has been noticed and lauded by the Defense Ministry of India who has committed to providing unwavering support to the mission. This initiative takes the Temple a long way into standing with the Indian community with an unflinching love and solidarity.

Brain cancer When I had brain cancer in 2008, which is when some of the cells in the body are not working properly and they are acting wonky, I did what I needed to do with my husband’s support. I focused on getting better, I took my supplements, had chemotherapy, the special medicine that got rid of the cancer. I ate nutritious food, stayed away from processed foods and remained calm and focused on all of the positive things.

Our minds are very powerful so focusing on what we want, not on what we don’t is the key.

Feeling Scared When I had lost my memory and then was diagnosed with the brain cancer, this was terrifying for me. I would not leave the apartment by myself and if I got lost I would stop and cry. We all may feel scared at some point but if you can, face it, and, bring

Anger/Feeling Mad Once my memory had returned, if I got lost I would then get mad. But this feeling would not help me figure out how to get to where I wanted to go. It did not serve me. Stopping to take a breath in and out, then thinking about the situation first will be more beneficial to you and will help you figure out a solution instead of getting frustrated or mad.

Confidence As I mentioned, when I got lost I would just stop and cry. I was not able to process where to go or even ask someone for help because of having had the memory loss. When my memory was coming back I slowly gained my confidence to go out

and do the things I used to do and ask people for directions to where I wanted to go. Sometimes it takes some steps and tools to gain confidence. When you take these steps you will feel great. It might be a small step, trying something new, saying hello to someone you don’t know or going somewhere you have not been before.

Farting! Oh yes, and I still made sure I farted! The two large plates of broccoli I ate and the chemotherapy I had for the brain cancer gave me a lot of gas. The farting made me laugh. And laughter is the best medicine when you are not feeling well. And yes we all do this! Being able to laugh when we are going through something that is not so nice helps to relax our bodies and our minds.

People Staring / Embarrassment I had my husband shave my head when I had brain cancer so my hair would not fall out in clumps. I did this because

when I was 14 years old, I had a type of childhood cancer and my hair had fallen out. This was very embarrassing because I was liking boys. Once my husband shaved my head, people would stare at me. This was very upsetting. My hair actually never fell out due to the large amount of supplements I was taking. But after awhile I felt better and started looking at people again when I got my memory back and this built up my confidence. You may feel upset or sad about something but remember, we all feel this way sometimes. It is okay. Just remember you can create some tools to shift yourself out of these feelings.

Competition It is not a competition between you and other people. You are not competing with others to achieve what you desire. There is room for all of us to succeed. I have written 23 children’s books and 4 books for adults. As well, I have also written a

Expert Insight about Hong Kong and India Legal System Hong Kong Arbitration Awards enforcement in India Hong Kong is a well-established financial center in the world and at the same time India is growing as a global economic power in recent years. Both Countries have their own demographics and economic structure but we will analyze their legal system with a legal luminary Mr. Vishal Pancholi a well known lawyer of India and residing in Hong Kong for more than 14 years. We interview him with regard enforcement of Hong Kong Arbitration awards in India. Here are the excerpts of interview with lawyer Mr. Vishal Pancholi:

Q.1 How would you compare Hong Kong and Indian legal systems? Ans: The Relationship of Hong Kong and India with regard to business arrangements from both sides are very long, Hong Kong Companies do business in India and vice versa. Hong Kong is Asia’s world city and door for business gateway to China and South East Asia Region. From the point of legal system both countries have developed their own

procedures and practice as per their social, political and business environment and changes. India has been an arbitration friendly country right from the beginning, because arbitration was prevalent even before the codified law came into force. In the pre-court period the leaders of the communities and the elders of the families used to act as arbitrators and people used to obey the decision of those arbitrators.

Q.2. Is there any connection between two Jurisdictions with related to Arbitration Awards? Ans: In a notification in the official gazette by the Indian government in 2012 and recognition of China and Hong Kong arbitration awards in Indian courts was taken as welcome move by both the Jurisdictions. Now the shipping disputes and trade related disputes between companies in India and Hong Kong are well within the jurisdictions of both the courts.

Q.3 Is Arbitration is the most appropriate and affordable way to adjudicate the matter or settle the dispute between two parties? Ans: Arbitration is much faster way of out of court resolution of dispute between two parties decided by impartial third party. You don’t require any court room, jury and formal procedure to adjudicate the matter. Arbitration is cost effective way of resolution of matter out of court. The features like speedy process, cost effective way and privacy make its clearly beneficial for both the parties.

Q.4. How Indian Courts can enforce the arbitration awards of Hong Kong in India?

Ans: In 2012, India confirmed that it will add the Peoples’ Republic of China (including the Special Administrative Regions of Hong Kong and Macao) to the list of socalled “gazetted” states. The approach of the Indian court to enforce the arbitration award is still in the process of evolvement. The Supreme Court (“SC”) judgment in Government of India v. Vedanta Limited and Others while noting that a foreign award does not become a “foreign decree” at any stage of the proceedings, the SC held that enforcement of a

foreign award takes place only after the court is satisfied that it is enforceable under Part II of Chapter I of the Act. The foreign award has to pass the muster of Sections 47 and 49, after which the award becomes a ‘deemed decree'. Following the 2015 amendment to the Arbitration and Conciliation Act, the Indian courts have maintained their approach of minimal intervention in cases concerning the enforcement of foreign awards. The courts have stepped in to prevent enforcement only on limited grounds and in a few select cases. Even in such select cases, the threshold for convincing the court that an award should not be enforced is high. Therefore, it appears that enforcement is the norm and refusal is the exception. The idea of foreign arbitration award enforcement in India is getting rolled with lot of pace and Indian courts are finding a lot of applications for enforcement of Foreign Arbitration Awards in India.

Ans: Arbitration is the way forward step to move closer in the dispute resolution in both the jurisdictions. Indian government is opening the legal sector for the foreign law firms on the reciprocals basis and soon we will see more changes not only in both jurisdictions but legal sectors as a whole. I think India and Hong Kong has much wider scope to move closer in future with respect to future changes in lawsin both te countries.
