Redistricting is Back (Again)
One of Dr. King’s most enduring achievements was the passage of the Voting Rights Act in 1965, landmark legislation that outlawed discriminatory voting practices and upheld the principle of one person, one vote in this country. Under Section 5 of the Voting Rights Act, states with a past history of racial discrimination – like Texas — must get “preclearance” from the U.S. Department of Justice before implementing any laws that affect voting, including state redistricting plans establishing congressional, State House and Senate district boundaries. Last year, the election maps drafted by the legislature were voided by federal courts because they violated the rights of minority voters under the Civil Rights Act. As a result, the temporary, interim maps used in 2012 elections for State House, State Senate and Congressional districts were drawn by the U.S. District Court in San Antonio. These maps, while better, also contained flaws that need to be addressed. Governor Perry has called a special session on redistricting, but for the sole purpose of adopting – without any changes – the interim maps drafted by the courts, even though they include features that – in my and many

legal experts’ view – continue to violate the U.S. Voting Rights Act. So how did we get here? Every 10 years, state legislatures review new census data and redraw the districts of their elected representatives, from the State Board of Education to members of Congress. Texas continued to experience tremendous growth, and that meant our state added four new members of Congress, and dramatically changed State House and Senate districts. African-Americans and Hispanics accounted for over 90 percent of that growth, which should have meant additional seats for minority candidates. Unfortunately, the Republicandominated legislature drew maps which ignored this growth and packed minority voters into fewer districts, weakening their voting strength while strengthening Anglo voting power in Texas. For instance, of the four congressional districts created, only one real minority opportunity district was created, despite the fact that nearly all Texas’ growth is due to minority – predominantly Hispanic – growth. And that district was in North Texas, not Harris County. It was even worse in state legislative races. Nearly 90 percent of Texas growth is due to growing minority population, yet we gained no new seats in House and Senate. Texas is now 54.1 percent minority – and growing – yet only one-third of Texas legislative seats are minority opportunity districts. The numbers didn’t add up, so a three-judge federal court ruled that the State Senate, State House and congressional redistricting plans adopted by the Legislature violated Section 5 of the U.S. Voting Rights Act. Perhaps more importantly, the judges unanimously ruled that the state-passed Senate and congressional plans were drawn with a discriminatory purpose. It is a sad and discomfiting fact that Texas is the only state in

the country which adopted redistricting plans following the 2010 Census that have been ruled to be deliberately discriminatory to African-American and Latino voters. Other states covered under Section 5 of the Voting Rights Act, including Alabama, Georgia, Louisiana, Mississippi, South Carolina and Virginia, were able to adopt redistricting plans without deliberately discriminating against their minority citizens. In each instance these other covered states gained approval of their plans under the Voting Rights Act. Not Texas. Of further concern, Attorney General Greg Abbott, on behalf of the Governor and our legislative leaders, is currently arguing before the U.S. Supreme Court that the state-passed discriminatory redistricting plans be reactivated and put in place for the 2014 elections. His briefs to the High Court include an explicit argument attacking Section 5 of the Voting Rights Act, the key provision protecting the minority voters we represent from exactly the type of discrimination contained within the state-passed maps. While the interim Senate plan restored the ability of minority voters to elect their preferred candidate in Senate District 10 in North Texas, the same cannot be said of the interim State House and congressional plans. These interim plans continue many features of the state-passed maps that undermine the voting strength and voting rights of African American and Latino voters in Texas. Further, data from the Texas Legislative Counsel regarding the Harris County region is telling.

Community Health Clinics Awarded Funds
Houston- Recently, Congressman Al Green called representatives from South Central Care Community Health Center, the Harris County Hospital District, and the Asian American Health Coalition of the Greater Houston Area to congratulate them on being awarded grants to assist Texans in enrolling in the new Health Insurance Marketplaces and receive quality health care services. These grants are important investments not only in our community health clinics but in the health and vitality of our community,” Congressman Al Green said. “I trust that our community health clinics will use these grants wisely and further expand access to health care in Houston.” Health and Human Services Secretary Kathleen Sebelius announced $58 million in grants to 1,157 health clinics across the country working to enroll uninsured Americans in the new health insurance coverage options made available by the Affordable Care Act. With these funds, health clinics can expand their enrollment assistance efforts as more Americans enroll in affordable health insurance coverage. These awards will allow community health clinics to expand the hours of existing outreach and enrollment assistance workers, as well as hire new or temporary workers. The South Central Houston Community Health Center received $165,755 in the fiscal year for 2013 and $92,935 in 2014; the Harris County Hospital District received $154,326 in the fiscal year for 2013 and $85,662 in 2014; the Asian American Health Coalition of the Greater Houston Area received $90,867 in the fiscal year for 2013 and $45,279 in 2014. ALEC losing support over Stand Your Ground Joy-Ann Reid Editor of The Reid Report
ALEC, the influential nonprofit credited with writing the original template for “Stand Your Ground” laws has lost corporate donors and Republican legislative members in the wake of the Trayvon Martin shooting, a report in The Guardian says. The Guardian obtained internal memos that were prepared for the August 2013 board meeting of the American Legislative Exchange Council (ALEC), which has produced model legislation on everything from guns to voter ID, with an emphasis on conservative policy ideas like reducing corporate taxes and regulations. The group has hundreds of members drawn mainly from Republican legislators around the country, and it counts as former members House Speaker John Boehner, Wisconsin governor Scott Walker, and Ohio governor John Kasich. ALEC is best known for laying the groundwork for Florida’s 2005 “Stand Your Ground” law, developed in conjunction with the National Rifle Association, which expanded the so-called “castle doctrine” to provide legal protection to gun owners who use their firearms in self-defense. The law has been replicated in more than 30 other states since it was signed into law by then-Governor Jeb Bush. “Stand Your Ground” became the object of controversy and protests, including by the Dream Defenders in Florida, despite not being invoked by
defense attorneys for George Zimmerman, who was acquitted in July in the shooting death of 17-year-old Trayvon Martin. But “Stand Your Ground” altered the jury instructions in Florida for manslaughter and second-degree murder, and it was mentioned by a juror in the case in explaining her vote to acquit. As printed in The Guardian article: Alec’s own internal records of its membership states that it has 1,810 state legislators on its membership books – amounting to almost a quarter of all elected representatives at state level across the nation. That support base has declined though over the past two years, from a peak in 2011 of 2,200, underlining the structural problems that the group faces in the wake of the Trayvon Martin outrage. The documents show that Alec has struggled to hold on to members from the financial services industry.” He specifically wanted to point out to theGrio that ALEC no longer creates and supports “model policies” as it did with “Stand Your Ground” and other highly conservative initiatives. He said ALEC has “gone back to basics,” focusing on issues its members want to be supported. Regarding a loss of both legislative and corporate support, Meierling said, “Corporations, like people, do not like controversy of any sort. Some of the engagements in the past have indeed been controversial. But what has happened is not necessarily a bad thing. It has forced us to refocus and evolve. What we are doing now is a repositioning for our future growth.” ALEC saw defections by several major corporate donors as it attracted scrutiny over the role it played in crafting “Stand Your Ground” laws.

The Constant Disrespect of our Black Leaders Continues
E
ldridge Cleaver once stated that, “Respect commands itself and can neither be given nor withheld when it is due.” I agree with him in this thought because no matter how hard people try to disrespect the man that occupies the highest seat in this nation that any man can; the fact still remains that he is the 44th president of the United States of America. And that is a mark on his resume that no one will ever be able to take away from him; no matter how hard Republicans and others around the country talk about, ridicule and refuse to support him. At the end of the day, he is a Black man and he is the president and that within itself is enough to demand respect whether he is given it or not. We MUST Understand, that anytime it seems that one race, group or entity has a significant amount of power, influence or control; that sect is an immediate target for destruction. This element only, serves to create more of a division within the powers that are supposed to be used to unify and promote the enhancement of the American people as a whole. My problem with this is that rather than elected officials be it: Republicans, Libertarians or otherwise support their leaders
in office; their mission seems to be that of the contrary. They seek to demolish any progress that could be made, simply because it is not their plan, thought, agenda or party initiating it. Such has been the case of the governmental shutdown that occurred earlier this year, as well as all the negative hype and attention in reference to the Affordable Health Care Act signed into legislation by President Barack Obama. Republicans have made it very clear to Americans and the world that no matter what the president does or tries to do they will not support him. Any little bitty thing that he does is always under a microscope. Now, that is one of the most blatant forms of the continual disrespect of the President. Continuing, it is no accident that since Eric Holder the Attorney General of the U.S. has been in office, he has been asked to resign from his position. A position I must add that is also one of the three highest seats that can any man can attain in this country. During the incident that occurred over a year ago Senator Scott Brown stated, “For the best interest of the country, I think he should step down and resign. He’s lost the confidence of the American

people. Certainly he’s lost the confidence of Congress.” Call it what you will, but I call it the constant disrespect of our Black leaders. Undoubtedly, the thing that is bothering the counterparts of Obama and Holder is that, there are two Black men in these executive offices. Here it is of three of the most powerful offices that can be held in the nation there are two Black men occupying two of them, and I just don’t think that sits well with them. At the end of the day, all I am trying to convey is that the constant disrespect of the first Black president and the Attorney General has gotten to be totally ridiculous. But, I have said it once and will continue to say and state it until I feel that somebody is getting the message. If people have no regard for and continue to disrespect the men that occupies the highest seats in the country that any man can, all because they just happen to be Black; then exactly what do you think that means for you?

HOUSTON- Harris County Precinct One Constable Alan Rosen is proud to announce his first toy drive for families in need. “I want to do all I can to make sure your future is the brightest it can be,” says Alan Rosen, Constable Precinct One. “We try to do a toy drive in December and a food drive during the holiday season because the community does so much for us. I’m thankful to all of you and I want to embrace our future.” Constable Rosen thanked Pastor William Anthony Jordan at Lyons Unity Missionary Baptist Church for hosting the toy drive Saturday afternoon. Sunday evening, Harris County Precinct One Deputy Richard Greason, volunteer David Stribling and Community Outreach Coordinator Erica C. Davis distributed toys at several churches in Acres Home community. “You may know of a neighbor whose circumstances
have changed, either due to illness, family complications or unemployment, so please let them know we are here for them.” Families in need were identified by church leaders in the community. All of the toys were generously provided by the deputies and support staff in Constable Alan Rosen’s Precinct One office. “I am so proud to see the leadership of the churches in our area partnering with us to assist families,” says Erica Davis. This was a memorable afternoon as the Precinct One team brought joy and happiness to many families. Youth Minister Kim Wyatt and church website administrator Adanna McElroy assisted in sorting and distributing the toys and Constable Rosen brought his son Sam Rosen, 12, to help him distribute the toys and see the heart of the Harris County Precinct One Constable’s Office at work in the community. The People Are Not Afraid, The “Leaders” Are!
Houstonians protested George Zimmerman’s acquittal in the death of unarmed, black Florida teen, Trayvon Martin ended up on Texas 288 at Southmore.
HOUSTON- The not guilty verdict of George Zimmerman in 2013 for the murder of Trayvon Martin unleashed a response from Black people and others of good will the like of which hasn’t been seen in decades. Houston, Texas in many ways was on the cutting edge of protest, marches and rallies in the days that followed the verdict. The militant tone, uncompromising nature and thousands that participated in these actions represents a departure from which has been on the more conservative reputation in which the city has in regards to social justice activism. Surely, Houston has always had radical activism; however it has been some time since it has been on display like it was after the Zimmerman verdict. The people took to streets in large numbers shutting down Highway 288, the federal building and city hall during different protest. In addition, thousands marched directly through the
heart of wealthy River Oaks. The United States Attorney of this region for the Department of Justice was forced for the first time to come and answer to the community on the Martin case and local cases. Noticeably, during these actions staple activist were joined by large numbers of citizens inspired to voice their outrage. It seems some so called “leaders” job is to cool the masses desire for change down to no action or soft acceptable statements. In Houston, through the Community JustUs Coalition the energy generated by the Zimmerman verdict is being organized for long term solutions. The people are ready for change, but the “leaders” want the status quo. In 2014 we can make the changes we seek, but it will come at a cost.

Dr. Conrad Murray Release and Future plans
HOUSTON - Dr. Conrad R. Murray is a free man. He was sentenced to four years in prison but only served two years in jail for killing Michael Jackson, Murray didn’t spend an extra minute in jail. According to the L.A. County Sheriff’s Dept. ... Murray was released at 12:01 am Monday. However, he did not make a triumphant walk out of jail. Murry, instead choose to sneak out away from media, photographers, and people who either wanted questions answered or to hackle him about being released early. By remaining unseen, Murray obviously knows he raises the price tag of that coveted first interview with him. A group of hecklers was clearly irritated they were not permitted to voice their disdain
face-to-face and took it out on Murray’s lawyer, Valerie Wass. As for why the L.A. County Sheriff’s Dept. made the accommodation to keep Murray’s release secret. The good doc has been locked up since November ‘11 after being convicted of manslaughter. As we previously reported Murray plans to try and get his medical license back in Nevada and block revocation in California sources say he doesn’t stand a chance. In 2006, Dr. Conrad R. Murray opened the Acres Homes Heart and Vascular Institute. “We have been so lucky to have Dr. Murray and that clinic in this community,” Houston patient Ruby Mosley told People magazine. “There are many, many patients that thank God this man was here for them.” Those who have had finan-
cial dealings with the doctor, however, might feel otherwise. Unpaid debts, lawsuits, and tax liens have followed Dr. Murray’s life. In fact, it was Dr. Murray’s debt situation that set the stage for his working relationship with Michael Jackson. Reports indicate that, Jackson began making plans for his upcoming 2009 concert tour, he hired Dr. Murray to be his personal physician for an astounding $150,000 a month. Jackson’s motivation to bring Murray aboard, though, may have had less to do with friendship and more to do with the singer’s own complicated reliance on prescription medicine. In the months that followed the pop star’s death, Conrad Murray’s working relationship with the singer became not only
the target of irate and shocked Jackson fans, but police investigators as well. Around that same time, news reports indicated that Dr. Murray was soon going to be charged with manslaughter, something that was heightened on August 24, 2009, when preliminary findings revealed that Jackson had died as the result of lethal levels of propofol. Although in recent news “Conrad Murray is convinced he has what it takes to follow in the footsteps of the pop great he is responsible for killing.” Said ex- bodyguard of Murray’s, Jeff Adams. “Murray thinks he can make it as a singer in the future.” Murray is said to have hired a publicist to help change his image. Freedom will clearly also have its challenges.

Black America from pg. 1 HOUSTON - The history of American civilization has left remnants of many open wounds that are constantly agitated within the Black community of its culture on a constant basis. A reflection over the year 2013 entails the fact that, there have been many instances of these open wounds that have reoccurred every day. Among them are many elements such as: affirmative action, voting right laws and racial profiling, just to list a few. On Affirmative Action: Affirmative Action may be best described as taking the appropriate steps to, increase the representation of women and minorities in areas of employment, education and culture from which they had been historically excluded. This action was introduced into American culture and issued as an Executive Order by President John F. Kennedy on March 6. 1961. He created the Committee on Equal Employment Opportunity which served to mandate that projects financed with federal funds "take TX-8
affirmative action" to ensure that hiring and employment practices are free of racial bias. Since it’s induction into US society, universities, states, employers and various other entities have fought relentlessly against it. In a couple of states there have already been bans placed on affirmative action such as, California and Washington. While it was just this year, that affirmative action in Texas has been up for challenge. Borgna Brunner revealed the following, “In Fisher v. University of Texas, the court allows universities to continue considering race as a factor in admissions to achieve diversity, but it does tell them that they must prove that “available, workable race-neutral alternatives do not suffice” before considering race.” Accordingly, Brunner found that the court ruled to send the case back to the U.S. Court of Appeals for further review to determine if the school passed the test of "strict scrutiny”. Which means that the final decision has not been made so we should really pay attention to these matters and Wake Up

On Racial Profiling: The Leadership Conference suggests that racial profiling is, “the targeting of particular individuals by law enforcement authorities based not on their behavior, but rather their personal characteristics; such as: ethnicity, national origin, and religion. It is generally used to encompass more than simply an individual's race.” Therefore, it should not come as a surprise that while Congress passed a bill in 1865 intended to abolish slavery; that members of the Black community still have to deal with modern-day oppression to a certain extent. In some ways this oppression often involves, Blacks consistently being targeted by law enforcement officials. A great deal of times these demonstrations yield, ‘trumped up’ charges, imprisonment and death in some cases. Allow me to digress back to an incident that occurred on February 26, 2012, but has left Blacks around the nation outraged by the verdict in 2013. On this date, a Sanford, FL neighborhood watch captain, George

Zimmerman initiated an assault on 17-year-old, Trayvon Martin. After spotting Martin and telephoning 911 reporting of a “suspicious person” and being instructed not to get out of his vehicle; Zimmerman proceeded to disregard the operator. As a result, Martin was beat and gunned down, ultimately leading to a very untimely demise. Though the entire situation had already shaken members of the Black community on an enormous scale, the “insult-to-injury” occurred after the determination of a not-guilty verdict on July 13. Since that time, Zimmerman has had two bouts with law enforcement officials. The first being pulled over in Dallas for speeding. The second, led to him being arrested and jailed for an assault on his girlfriend, who claimed that he pulled a gun on her. Many White residents of Florida have only NOW begin to refer to Zimmerman as a “ticking time bomb” since his latest encounters. And that is now that he has pulled a gun on a White woman so, Wake Up Black America! On Voting Rights: The Fourteenth and Fifteenth Amendments were passed by Congress to allow Blacks the right to vote in 1868. Yet, it is a sad reality that after their passing, other measures were put in place to still block Blacks from voting. Voting provides an individual the power to speak without ever having to open their mouth. Whites during this era knew that this would give Blacks power previously not bestowed upon them. Thus, Blacks were purposely not told when and where voting elections were held. Then there was a poll tax that many could not afford to
pay. Additionally, states in the South enacted laws requiring people to pass reading and writing tests before they could vote. This was a grave injustice because so many Blacks had been in slavery and could not read or write. It was not until nearly a century later that Civil Rights movements were started and Blacks voices were finally heard. Therefore, the Civil Rights Act of 1964 was eventually signed into legislation by President Lyndon B. Johnson. For it was just earlier this year that voters in Texas faced redistricting policies, that would not have been so accommodating to minority communities. Penda D. Hair informed in article that, “The Supreme Court's decision in Shelby County v. Holder, striking down the coverage formula for Section 5 of the Voting Rights Act, made it easier for states to forge ahead with laws restricting the vote.” “Texas waited just two hours after the Shelby ruling to announce that the state would begin enforcing its voter ID law, which had previously been blocked under Section 5, and that its discriminatory redistricting plan would also go into effect” she continued. Fortunately, the Department of Justice counteracted these measures by pursuing lawsuits which highlighted that their decision did not allow for “open season on voters”. Concluding, though it may appear that this nation has come a long way with new bills being passed, there remains a long journey ahead for AfricanAmericans. Hoffman Middle School participates in “Mock Trial”
HOUSTON - Recently, 39 of our Hoffman Middle School of Aldine Independent School District, students were able to participate in the Houston Bar Association’s Mock Trial. They traveled to the Harris County Courthouse, downtown, where they tried a felony criminal mischief case. Both the defense attorneys and prosecution attorneys did a splendid job trying the case, which ended in a hung jury. All of the participants memorized their lines for the entire trial. It was a great performance and a wonderful learning experience. Afterwards, the students enjoyed dining at the Spaghetti Warehouse where the lasagna and 12 layer chocolate cake were the favorites on the menu.

HOUSTON- MacArthur High head football coach Andy Garza presented former General quarterback Odell James with a framed jersey and other memorabilia from his playing days after he was the featured speaker at MacArthur’s Fall Sports Banquet. Recently, Odell James returned to his roots to address athletes at MacArthur High School with an inspiring message during the school’s Fall Sports Banquet held at the M.O. Campbell Educational Center. James was a high school sensation from 1993-95 and was one of the most sought after quarterbacks in the country after his senior season. He was recruited by a number of top programs across the country, including Texas, Nebraska, Florida State, Ohio State, Oklahoma and just about every other major Division I program before signing with Baylor Univeristy. As a sophomore, James led Bob Alpert’s Generals to the Class 5A Division II state title game, where MacArthur fell, 43-37 in the Astrodome. That game is

still considered one of the most exciting state title games in the storied history of Texas high school football. The lead went back and forth throughout the contest with Lewisville scoring a late touchdown to hold off the Generals. James led the Generals to the playoffs as a junior and senior and was named a Bluechip and Super
Prep All-American his senior season. He played quarterback his first three seasons at Baylor before moving to free safety his senior season. He received his bachelor’s degree in speech communication and sociology from Baylor in 2001 and a master’s degree in Sports Leadership from Duquesne University in December of 2010. For the last 10 years, James has worked on Baylor’s football operations staff and currently serves as the school’s assistant director of football operations. In 2012, he served in the Bill Walsh Coaching Fellowship with the Washington Redskins working with the wide receivers. James said losing the state title game was tough to handle as a teenager, but he and his teammates knew they gave it their all that magical season. “One of my biggest memories was during my sophomore season when our football team went all the way to the state championship,” James said. “It is still talked about as one of the best games ever played in Texas high school football history.
Although we lost, I will always remember how me and my boys from the Mail Route fought hard the whole season. We gave it our all for each other and for our coaches. We were a family and we made the choice to be great.” That 1993 season was a magical one for the Generals and their fans. They earned the final playoff berth in District 21-5A and then
won five playoff games to earn a spot in the state finals. James was remarkable during the playoff run, rushing for more than 1,000 yards and passing for more than 1,000 yards. The top programs around the country took notice and began contacting him. He knew then he had to make the right decisions in his life if he hoped to reach his goal of playing college football.

MARSHALL- Even before African-American athletes became household names by eclipsing racial milestones in sports, a group of students from Wiley College in Marshall were making similar inroads in the arena of collegiate debate. “It’s amazing their story is so little-known,” says Lloyd Thompson. In the fall of 1923, Melvin B. Tolson took a teaching job at Wiley, a small, all-black college where he wore many hats. In 1924, he founded the Forensic Society of Wiley College. “The Great Debaters” from the Melvin B. Tolson/Denzel Washington Forensics Society,

claimed their first Individual Events National Championship title at the National Christian College Forensics Association Tournament in Siloam Springs, ARin 2013.The win makes Wiley the first Historically Black College or University to earn a national team forensics championship title. The Great Debaters placed second in combined Overall Team Sweepstakes. The team also made a historic accomplishment by “closing out” the final round of Novice Poetry. Wiley’s debaters earned 35 awards during the tournament, bringing the school’s year-to-date trophy count to 321.

Faran Foy Student Regent Faran Foy is a third-year law student at Texas Southern University Thurgood Marshall School of Law (TMSL) and a 2014 Juris Doctor canadidate. Ms. Foy was born and raised in
Jacksonville, Florida. She began her collegiate career at 16-years-old in the Duval County Dual Enrollment Program at Florida State College at Jacksonville. Ms. Foy is a product of the Duval County Public School system and a 2008 graduate of N.B. Forrest High School. In 2011, Ms. Foy received her B.A. in English from Florida State University (FSU) in the newlyformed editing, writing and media program. She also studied journalism with a concentration in magazine production at Florida A&M University. Chapter of Phi Alpha Delta Law Fraternity International and vice president of the Student Ambassadors, a program that focuses on servicing the students and faculty of TMSL. Ms. Foy recently worked as a legal intern for the Honorable Jeff Bohm at the Southern District of Texas United States Bankruptcy Court. Ms. Foy gives her time serving the community and mentoring young women. Prior to attending law school she worked for the Capital Region YMCA Minority Achievers, a national college-readiness program for teens. Ms. Foy is committed to academic rentention and enhancement and cultivating and encouraging young minds.
