“No somos una ciudad santuario”: Alcaldía En la batalla contra el Departamento de Justicia, Filadelfia ha logrado esquivar el término ‘santuario” e intenta destacar los aspectos clave de su cumplimiento con la ley federal. JAMILA JOHNSON

unque Filadelfia puede ser considerada la “Ciudad del Amor Fraternal” en la que no es raro abrazar al prójimo o incluso solidarizarnos con los otros en tiempos difíciles, es difícil verla como un santuario. En un lugar donde los agentes del ICE todavía pueden detener a cualquier personas, las prácticas policiales del stop-and-frisk afectan mayoritariamente a las comunidades negras y latinas, y donde la criminalidad reina, difícilmente puede ser visto como un refugio. Habría que ignorar esa realidad si se pretende seguir llamado a Filadelfia una “ciudad santuario”. Y sin embargo, a pesar de los esfuerzos del alcalde Jim Kenney para hablar de Filadelfia como “una ciudad acogida a la Cuarta Enmienda” que prohíbe las detenciones ilegales, el estado de “santuario” de Filadelfia ha sido tema de debate y alta prioridad para el fiscal general Jeff Sessions y el Departamento de Justicia (DOJ). Como ya reportó AL DIA en su momento, el DOJ publicó el mes pasado una carta dirigida a Filadelfia y otras ocho ciudades estadounidenses para comunicarles su obligación de cumplir con la ley 8 U.S Code 1373. Esta ley dicta que ninguna ciudad o estado puede bloquear el acceso a información sobre inmigración al gobierno federal. A pesar de su brevedad, la carta del DOJ deja muy claro que el no cumplimiento de la ley puede resultar en pérdidas de hasta $1.67 millones en fondos federales para la ciudad, mediante la eliminación de la Justice Assistance Grant (JAG), una subvención que se utiliza para financiar la formación y horas extras de las fuerzas policiales de la ciudad. Filadelfia ha enviado ya su respuesta, que ha sido defendida por las principales autoridades locales, incluyendo el Procurador General Sozi Pedro Tulante, quién declaró que “en la práctica, las políticas llevadas a cabo por la ciudad

garantizan el intercambio de información con el gobierno federal sobre criminales sospechosos o bajo custodia”. El Procurador General añadió además que “la ciudad también garantiza la protección de información confidencial sobre aquellos individuos que no suponen ninguna amenaza criminal”.
LA DEFENSA DE PHILLY
La respuesta de Philly, dirigida a Tracey Trautman, director en funciones del Bureau y la Oficina Asistencia Judicial, empieza con una declaración aclaratoria sobre cómo la subvención JAG ha ayudado a las fuerzas policiales de la ciudad y cuán vital es este dinero para la seguridad de la ciudad. “En 2016, los crímenes contra la propiedad llegaron a su punto más bajo desde 1971, los robos descendieron a los niveles de 1969 y los crímenes violentos alcanzaron el nivel mínimo desde 1979”, puede leerse en la carta. No se trata de ninguna pequeñez, teniendo en cuenta la histórica relación de Filadelfia con el crimen. Sin embargo, a pesar de demostrar la necesidad de dicha subvención, la ciudad argumenta que hoy una ciudad más segura gracias a su forma de cumplir con la sección 1373 de la ley. Al destacar que la normativa federal solo requiere que la ciudad coopere con las fuerzas del ICE, la ciudad demuestra que está cumplimendo por defecto, y también en la práctica, con la ley. ladelfia ya está cumpliendo con la ley, pues ésta no exige que las autoridades policiales interroguen a los ciudadanos sobre el estatus de sus procesos migratorios. Esta idea se apoya además en la admisión por parte de la ciudad de no estar recogiendo información migratoria de partes inocentes y de delincuentes, y de estar dispuesta a compartir la información que dispone con las autoridades de inmigración. La política que no convence al Departamento de Justicia parece ser la decisión de Filadelfia de no atender a las peticiones de arresto del ICE sin la orden judicial debida. La ciudad defiende que esta decisión no afecta a su capacidad para intercambiar con el gobierno federal aquellos datos sobre inmigración que ya dispone. La respuesta de Philly se apoya en dos documentos básicos. Una de ellas es la Orden Ejecutiva 8-09, titulada “Regulación del Acceso de los Inmigrantes a los Servicios Municipales,” que se basa en la ley promulgada en noviembre de 2009 por el entonces alcalde Michael Nutter que garantiza que cualquier individuo debe tener acceso a los servicios de la ciudad sin miedo a su seguridad personal o a ser deportado debido a una interrogación sobre su estatus migratorio. Estos servicios incluyen atención médica, educación escolar, prestaciones sociales para la infancia, y otros. El otro documento clave que define la política de la ciudad sobre temas migratorios es el Memorandum 01-06, que regula cómo la policía debe interactuar con el público en relación a su estatus migratorio. Promulgada por el anterior Jefe de Policía John F. Timoney en mayo de 2001, el mandato prohíbe a los agentes de policía realizar interrogaciones sobre estatus migratorios mientras estén de servicio, con el fin - otra vez - de evitar la creación de una cultura del miedo, que fomente el temor a perder el acceso a los servicios municipales y, en este caso, policiales. El gobierno de Filadelfia sostiene que la premisa básica de la Sección 1373 es prevenir la cooperación con las autoridades de inmigración y aduanas, y que la ciudad está en cumplimiento con ésta porque rechaza activamente recopilar datos sobre inmigración a no ser que hayan sido recolectados en una escena de crimen. El Departamento de Justicia todavía tiene que publicar una respuesta directa a la ciudad de Filadelfia en referencia a la subvención JAG, pero teniendo en cuenta que la ciudad cumplió con los requisitos marcados dentro del plazo (30 de junio), ahora debería esperar la aprobación legal por parte del gobierno federal.

El costo de la mala conducta policial Este caso implica “represalias”, especifica muy claramente la primera frase del segundo párrafo de un fallo reciente del Tribunal de Apelaciones del Tercer Circuito Federal.
E
l desencadenante de este fallo por parte de la Corte de Apelaciones fue la mala conducta ejecutada por varios agentes de la policía de Filadelfia en 2012 y 2013. Aunque no hubo palizas brutales ni tiroteos fatales, el carácter vengativo de las acciones llevadas a cabo por los oficiales de policía violaron de forma escandalosa la política interna del Departamento de Policía de Filadelfia y los derechos constitucionales establecidos en la Primera Enmienda. Dichas acciones tuvieron lugar en septiembre de 2012 y septiembre de 2013, un año y dos años después respectivamente de que el entonces comisario en jefe de la Policía de Filadelfia publicara un memorándum (con fecha 23 de septiembre, 2011) en el que se informaba claramente a todos los miembros del Departamento de Policía de la ciudad el carácter inapropiado de lo que precisamente hicieron dichos agentes en 2012 y 2013, desencadenando una serie de acontecimientos que acabaron con el fallo del Tercer Circuito. Esta mala conducta policial costará dinero a los contribuyentes de Filadelfia. Dinero que servirá no solo para compensar a las personas que sufrieron abuso policial y otras READ IN conductas similares, sino también para ENGLISH sufragar los costes asociados a los proNEWS.com/OPINION cesos de litigación. Sin embargo, la perspectiva de que los ofensores se enfrenten a castigos disciplinarios graves o a una penalización en su caja de impuestos para drenar su mala conducta parece aún muy lejana. Casi nadie discute que la práctica policial es un trabajo duro y, sí, también peligroso. Y casi nadie discute tampoco que la ley otorgue cierta laxitud al cuerpo policial a la hora de aplicar su autoridad. El problema en este caso (y en muchos otros) es que la policía, de manera demasiado frecuente, interprete esta laxitud como una licencia para hacer lo que le dé la gana, incluso hasta cruzar el límite de la legalidad. Y el hecho de la policía actúe en el territorio de la ilegalidad en demasiadas ocasiones es “incitada e inducida” por sus propios superiores, que excusan las conductas erróneas cometidas por sus colegas; por procuradores que buscan condenas a partir de arrestos claramente equívocos; y por jueces que anhelan dictar exenciones legales a la policía, aunque esas exenciones corroan el concepto de igualdad de justicia ante la ley. El fallo del Tercer Circuito del que estamos hablando se
basó en los arrestos de personas que filmaban en video actuaciones policiales en espacios públicos. Estos individuos no estaban interrumpiendo de ningún modo el trabajo policial. En el año 2012, un agente detuvo a un observador legal que estaba filmando a otro policía mientras arrestaba a un manifestante en las inmediaciones del Convention Center. Y en 2013, otro policía detuvo a un estudiante universitario mientras filmaba la irrupción de otro policía en una fiesta privada. Estos arrestos violaban claramente el memorándum promulgado en 2011 por la Jefatura de Policía, que ordena que los agentes “no deberían” detener a ningún individuo por filmar (la mayor parte) de las actuaciones policiales. Unos meses más tarde, el Departamento de Justicia de EE.UU. promulgó un listado de recomendaciones dirigidas a la policía de todo el país alertando que los oficiales de policía no deberían arrestar a nadie por filmar en video las actuaciones policiales. En noviembre de 2012, la Jefatura de Policía de Filadelfia decidió incorporar dichas recomendaciones federales a una directiva mejorada sobre este tema. Los agentes descarriados que han sido objeto del fallo del Tercer Circuito alegaron que no estaban seguros de lo que podían y no podían hacer, mientras la Ciudad de Filadelfia defendía que no tiene responsabilidad por los actos errantes cometidos por los empleados de su cuerpo policial. Como señaló un juez durante el fallo del Tercer Circuito, los oficiales de policía “no tenían terreno para reclamar ambigüedad sobre los límites de los derechos constitucionales de los ciudadanos ...” La mala conducta de la policía continuará existiendo hasta se empiecen a tomar medidas… ¡duras! A juicio ley tonta y racista en Arizona La férrea disputa sobre la Ley 2281 de Arizona ha llegado a una corte federal de ese estado, donde una demanda alega que la norma que prohibe el programa de estudios méxicoamericanos en escuelas públicas es discriminante.

ace siete años, Arizona aprobó una ley que prohibió el programa de estudios mexicoamericanos en las escuelas públicas de Tucson. La ley fue patrocinada por el entonces superintendente de las escuelas estatales Tom Horne, y también por el entonces senador republicano del estado, John Huppenthal, quienes redactaron la propuesta que a la postre fue firmada por el entonces gobernador Jan Brewer. La ley dictamina que “ninguna escuela distrital o subvencionada podrá ofrecer formación alguna que promueva el derrocamiento del gobierno de Estados Unidos o el resentimiento hacia una raza o clase particular”, prohibiendo de esta manera los cursos diseñados fundamentalmente para estudiantes de grupos étnicos particulares, argumentando que cada estudiante debería ser tratado de manera individual. A pesar de que el distrito de Tucson cuenta con cursos de estudios étnicos variados, el único programa que fue suspendido por supuesto rompimiento de la ley fue el de estudios mexicoamericanos. El curso había sido creado en 1998 después de que el grupo Tucson Unified School District Parents introdujera una demanda por la ausencia de un Departamento de Estudios Hispanos, argumentando que el distrito “promovía segregación y discriminación basadas en raza u origen”, según reportó el medio Mother Jones. El programa introducía un pensum de obras literarias méxicoamericanas, con el propósirto de “reducir la brecha

entre los estudiantes latinos y sus compañeros”. Pero el entonces fiscal Horne afirmó que el distrito escolar había violado la ley y dejó en manos de Huppenthal la decisión de recortar en 10% los fondos federales al distrito. Frente a la amenaza, la Junta Escolar de Tucson suspendió el programa de estudios mexicoamericanos en 2012 y confiscó todos los libros de las escuelas.
UN PROGRAMA CON RAÍCES PROFUNDAS
Los cursos de estudios étnicos surgieron en las universidades estadounidenses durante la lucha por los derechos civiles en la década de los años sesenta. En un principio, representaba una batalla intelectual por la reivindicación de las raíces y la reestructuración de la identidad del hombre de color. Durante los últimos años de los 90, el enfoque de estos cursos fue ampliado a todo tipo de etnias y culturas. En un testimonio ante la Corte, Curtis Acosta –exprofesor en la Escuela Secundaria Magnet en Tucson y uno de los fundadores del programa– el curso estuvo diseñado con la intención de dar seguridad a los estudiantes que no se conectaban con el currículum tradicional. El programa de estudios mexicoamericanos logró crecer durante 13 años de manera exponencial, recibiendo a más de 1.300 estudiantes de todas los niveles en 2010. Según continúa el reportaje de Mother Jones, “una auditoría encargada por el estado en 2011 recomendó, entre otras cosas, mantener y expandir el programa”. De la misma manera, el curso lograba grandes resultados en su audiencia. Así lo demuestra también un estudio publicado en enero de 2016 y llevado a cabo por Thomas Dee y Emily Penner
LA LEY 2281 de Arizona vetó el programa de estudios méxicoamericanos supuestamente porque promovía el odio racial y sentimientos de rebelión contra el gobierno de EE.UU. Hoy la ley se encuentra demandada ante una corte federal del mismo estado. huffingtonpost.com del Centro de Análisis de las Políticas Educativas de la Universidad de Standford, que determinó que este tipo de cursos aumentan la asistencia a clases en 21 puntos porcentuales, así como también aumenta el rendimiento escolar.
RETÓRICA CONFLICTIVA
El caso de los programas de estudios étnicos (sobre todo el de los estudios mexico-americanos), llamó la atención de los conservadores cuando la activista por los derechos laborales Dolores Huerta, ofreció un discurso a los estudiantes en la Escuela Secundaria Magnet en 2006. Huerta llamó a la reflexión de su audiencia sobre el porqué del “odio Republicano hacia los latinos”, haciendo referencia a la legislación migratoria que estaba en debate en el momento. Según Mother Jones, ese comentario fue suficiente para que el entonces superintendente Horne catalogara el programa de estudios mexicoamericanos como un “chovinismo étnico”.
UN JUICIO LO DECIDIRÁ TODO
Durante el inicio del juicio federal el pasado 27 de junio, la evidencia en contra del otrora senador John Huppenthal habló por sí sola. Los abogados expusieron los comentarios racistas que habría publicado -bajo seudónimos- el conservador en varios blogs en línea entre 2010 y 2013. Huppenthal comparó a los profesores del programa con el Ku Klux Klan. “Las clases de estudios méxicoamericanos usan la misma técnica que Hitler utilizó para llegar al poder —dijo Huppenthal, y enfatizó—. Nada de estaciones de radio en español, ni vallas en español, ni canales de televisión en español o periódicos en español. Esto
es Estados Unidos, hablen inglés”. Si bien estos comentarios podrían ser el argumento perfecto de que su campaña por la ley 2281 partía del racismo orgánico, Huppenthal no retiró lo dicho durante su testimonio en la Corte. A pesar de ello, Huppenthal, quien se desempeña ahora como profesor de matemáticas “dedicado a las comunidades hispanas más pobres”, aseguró que el éxito de los estudiantes hispanos recae sobre su capacidad de adaptación y su “fluidez en inglés. Si hablé sobre la necesidad de una fluidez en inglés, es porque creí que ayudaría a los estudiantes a ser exitosos”, dijo ante la Corte.
ACTIVISTAS A JUICIO
Tony Díaz, uno de los más feroces defensores del programa de estudios méxicoamericanos, ha decidido promover una campaña social que ha llamado Librotraficante Caravan, como parte de la ONG literaria Nuestra Palabra: Latino Writers Having Their Say, a través de la cual han recuperado los libros prohibidos por la ley 2281 y los han devuelto como contrabando a Arizona. Díaz y compañía han dispuesto de varias librerías clandestinas incluso en otros estados. Según comentó a Remezcla, Díaz aseguró que la meta es “crear conciencia sobre el juicio contra la prohibición de los estudios méxicoamericanos en Arizona”, pues temen que este tipo de veto llegue a abarcar los estudios afroamericanos, asiáticos o incluso de género.

In Pennsylvania there are about 50,000 lawyers in various branches of law: criminal, administrative, commercial, labor, nongovernmental and even activist: defender of human, environmental and civil rights. Sharon López ha dedicado su vida al servicio de causas nobles: de activista por los derechos de las comunidades excluidas y la lucha contra la epidemia del sida y la violencia intrafamiliar, pasó a ser una abogada que desde los tribunales ha promovido la excelencia, inclusión y diversificación de su profesión. ice el dicho popular que a la mayoría de las personas no les gustan los abogados. Est, por supuesto, es hasta que necesitan uno. Y la verdad es que, tal y como son las cosas en este país, ninguno de los aquí presentes está exento de requerir en cualquier momento los servicios de un jurisconsulto. Esa quizá sea suficiente razón para querer saber a dónde acudir en caso de emergencia:
o sea, en caso de necesitar a alguien que pelee por usted en un tribunal, o alguien que le dé consejos para abrir un negocio, alguien que lo convenza de que no es normal sentirse abusado por su jefe o su arrendatario, o simplemente alguien que le brinde auxilio cuando de enfrentar un susto migratorio pueda tratarse. No hay persona en el mundo que no tenga derechos, y nadie mejor que un abogado para defenderlos. En Pensilvania hay cerca de 50.000 abogados repartidos en varias ramas del derecho: el penal, el administrativo, el comercial, el laboral, el no gubernamental e incluso el activista: defensor de los derechos humanos, ambientales y civiles. Eso, partiendo del último censo, da más o menos una razón de un abogado por cada 256 habitantes.
Una de las organizaciones que agrupa a buena parte de esta comunidad de expertos en todo tipo de leyes es la Pennsylvania Bar Association (PBA, por su sigla en inglés) —lo que en español se llamaría algo así como el Colegio de Abogados de Pensilvania–, una entidad que con sus cerca de 27.000 miembros afiliados es la organización de jurisprudentes más grande del estado; lo que la convierte en una especie de templo dedicado al estudio y permanente desarrollo de la ciencia y el ejercicio del derecho. Según se lee en su página web, el propósito de la PBA es promover “la excelencia profesional de los abogados en todos los ámbitos de la práctica y en todos los rincones del estado”; una misión bastante ambiciosa para una comunidad que no para de crecer (son pocas las universidades de Filadelfia que no tienen una facultad de derecho). Es en este contexto en el que el nombre de una latina aparece y resuena en los pasillos de varios colegios. Se trata de Sharon López, una mexicana de nacimiento, latinoamericana de corazón y abogada por convicción que este año tomó las riendas de la PBA con un solo objetivo: seguir promoviendo la inclusión y la diversidad de voces en el mundo de las leyes, mundo que -en sus palabras- aún hoy es percibido como “un club de hombres blancos vestidos de traje y corbata”. Que lo diga ella, una abogada con más de 20 años de ejercicio profesional, no es poca cosa. ¿Cómo es posible que una sociedad cada vez más heterogénea aún carezca de suficientes profesionales que representen esa multiplicidad de orígenes y cruces culturales? Para López esa premisa es mitad verdadera mitad falsa. Explica que una cosa es la percepción y otra muy diferente la realidad. Y la realidad para ella es que todas las personas son diversas en sí mismas porque cada quien está cruzado por diferentes identidades: se puede ser latino, afrodescendiente, católico y homosexual al mismo tiempo: eso hace ver el mundo de manera diferente. En el campo de los abogados ese tipo de diversidad o capacidad de ver el mundo de manera integral es fundamental. “El papel de los abogados es el de garantizar que los fundamentos de nuestra constitución y nuestra sociedad sigan siendo justos y correctos. Y que la gente que no tiene voz, sean escuchados, incluso si no tiene mucho dinero”, asegura.
ABOGADOS LATINOS, AÚN UNA MINORÍA Pero cuando se trata de hablar de quienes históricamente no han tenido voz, vale la pena entonces mencionar a los hispanos y “su pool” de abogados latinos. Con ellos sucede lo que pasa en los pueblos pequeños: todo el mundo se conoce. Y no es que la comunidad hispana sea precisamente la más pequeña de Filadelfia o Pensilvania, lo que pasa es que aún son muy pocos los latinos que escogen el camino de la jurisprudencia para ganarse la vida. ¿Discriminación? ¿Pobreza? ¿Falta de acceso

a educación de calidad? Posiblemente todas las anteriores; estudiar derecho hoy no es lo mismo que hace tres décadas, y aunque todas las personas son iguales ante la ley, no todos tienen igualdad de condiciones para estudiarla. Quizá por ello, y por ese aire parroquial que persiste en las diferentes comunidades latinas de Filadelfia, es que es relativamente fácil repasar la historia de sus hijos más ilustres en el mundo de las normas. Fue por allá en 1965 que el primer abogado latino, Juan Silva, fue aceptado en el Colegio de Abogados de Pensilvania. A él lo siguieron Silvio Sanabria, en el 69, Nelson Díaz -el primer juez latino de una corte de Filadelfia, y Mari Carmen Aponte, la primera puertorriqueña aceptada como miembro de la misma asociación. Así, con unos pocos pioneros abriendo camino, se fueron pasando los 70, los 80 y los 90; décadas en las que creciente una comunidad latina presentaba una mayor necesidad de servicios legales de calidad. Ese también es el contexto histórico del que parto Sharon López, nacida en México, criada durante los primeros años de su vida en Uruguay y llegada a los cinco a Pensilvania, en donde echó raíces como activista por los derechos de las comunidades LGBT, la lucha contra la epidemia del sida, los derechos civiles, de las mujeres y de los trabajadores. Con un grado universitario en sociología y
español, y después de haber militado en causas sociales, López decidió que necesitaba más herramientas para seguir haciendo lo que tanto le apasiona: tratar de cambiar el mundo. Las encontró en la facultad de leyes de la Universidad de Widener y desde entonces, mediados de los 90, ha litigado y asesorado en temas de género, comunidad LGBT, derecho laboral, violencia intrafamiliar -y otros- a nivel estatal y federal. Uno de los primeros en celebrar el nombramiento de López en la PBA fue precisamente el primer juez latino de Filadelfia, Nelson Díaz, quien aseguró que “[su llegada a la presidencia de la PBA] es un hito para Pensilvania por un lado porque la Philadelphia Bar nunca ha tenido un líder de las características de López, y por otro porque la Pennsylvania Bar demostró estar dispuesta a acabar con las prácticas históricamente discriminatorias en contra de los abogados de color en el estado”. Por su parte, su colega y amiga, Caroline Cruz -Deputy City Solicitor- expresó estar contenta por el papel de López al frente de la PBA. Dice que ya como presidenta electa el año pasado inició una serie de esfuerzos para aumentar el tamaño y diversidad de la organización.

Esto fue lo que dijo. Usted fue elegida presidenta de la Pennsylvania Bar Association, eso la convierte en la primera latina al frente de esta organización que reúne a cerca de 27.000 abogados de todo el estado. ¿Qué significado tiene para usted? Creo que estamos en un momento cumbre en el que muchos cambios se están dando y debemos estar listos para asumirlos. De alguna manera el que la asociación me ALDÍAnews.com / JULIO 12 - 19, 2017 / 9
PORTADA haya nombrando antes como vicepresidente me ayudó a proyectar el camino para llegar a la presidencia este año. La asociación me seleccionó porque sabe que puedo generar un cambio en términos de inclusión de las diferentes voces que hacen parte de la organización y que podemos garantizar -porque así lo queremosque todo el mundo participe en nuestras conversaciones. Entendemos que las elecciones tipo “plebiscito” no son la manera usual como la Pennsylvania Bar Association elige a sus presidentes, pero en su caso fue diferente: hubo una carrera. ¿Cómo fue eso? Lo más común [en la asociación] es que un miembro del Board of Governors se postule a sí mismo; se trata normalmente de un tema de carrera: la gente hace su trayectoria para llegar a la presidencia de la asociación y eso se da de común acuerdo. [En mi caso], teniendo en cuenta mi experiencia de activismo y campañas sociales, me sentía bastante confiada de poder transmitir mi mensaje al comité de nombramiento, compuesto por 33 personas. Lo que hice fue hablar directamente con cada uno, les pregunté cuáles eran sus preocupaciones para después explicarles por qué yo era la persona perfecta para asumir el cargo. ¿Cuáles eran esas preocupaciones? En general les preocupaban tres aspectos de mi postulación: Mi poca experiencia como miembro del Board of Governors (o mesa directiva), mi ubicación geográfica (yo vivo en Lancaster y la sede principal de la organización se encuentra en Harrisburg), y que nunca antes me había postulado para el cargo sumado a que mi oponente ya había expresado su deseo de presidir la asociación. ¿Qué les dijo para ganarse su confianza? Sobre lo primero, era apenas normal que me vieran como una extraña, ya que mi trabajo legal estaba más cerca de las comunidades que de los niveles administrativos de la organización. Sin embargo, traté de convencerlos de que ese tipo de liderazgo no era necesario para ejercer como presidente, porque lo que se necesitaba era saber trabajar con abogados y que en eso yo tenía la experiencia suficiente. Sobre el segundo aspecto, les expliqué que soy una abogada que no representa solo un área del estado (Lancaster), sino que dada mi trayectoria profesional a nivel de trabajo comunitario tuve que recorrer todas las regiones del estado, además que he ejercido en el campo de las leyes federales y que he vivido en ciudades como Filadelfia y Lancaster. Sobre el tercer punto, les dije que era un momento muy importante para tener a una persona con perspectiva de cambios, con capacidad de organización y con habilidad de brindar confianza. La Pennsylvania Bar Association es una organización de 121 años de antigüedad. ¿Cuál es su propuesta para garantizar que siga tan robusta como lo ha logrado ser hasta ahora? Mi propuesta se resume en tres puntos específicos: membresía, publicidad y consejerías profesionales. 10 / JULIO 12 - 19, 2017 / ALDÍAnews.com
los abogados del país se identifican como hispanos y que quizá a nivel estatal sean más bajos, ¿cree que eso va a cambiar en un futuro corto? Cómo cree que la idea de que el derecho es una profesión exclusivamente para hombres blancos pueda cambiar? Pongamos las cosas en contexto. Antes era más fácil ingresar a una escuela de leyes. Yo soy una baby boomer y por suerte pude asistir a una facultad muy económica. Ahora lo que tenemos son escuelas de leyes increíblemente costosas, y una competencia laboral que es muy difícil. Por otro lado, dentro de poco mi generación empezará a retirarse; eso sucederá en los próximos 10 años y tendrá un impacto en la profesión. La pregunta es ¿quién estará ahí para reemplazarnos? Demográficamente hablando, tenemos una gran brecha generacional y las generaciones X y Y no son suficientes para llenar todas las vacantes que se abrirán. Los llamados a llenarlas son los millenials, que son una clase muy grande. ¿Qué tiene que ver eso con el asunto de las minorías y con la asociación? Lo siguiente es mirar si esos estudiantes van

Lo primero que hay que decir es que nuestra asociación es de carácter voluntario. En Pensilvania hay más de 50.000 abogados, 40.000 ejerciendo y de esos 27.000 se encuentran afiliados de manera voluntaria a nuestra organización. Mi objetivo como presidenta es que como asociación podamos crecer, ser más grandes, mejores y más relevantes. Lo segundo, sobre el tema de publicidad o marketing, la idea es promover con más fuerza nuestro trabajo. Quiero promover el mensaje de que los abogados le prestamos un gran servicio a las gente, hacemos grandes cosas por la sociedad, incluso por las corporaciones (risas)… En resumen, hacemos muchas cosas buenas para que nuestra sociedad siga adelante. En este tema los millenials son importantísimos, porque ellos son una generación de jóvenes colaboradores y sabemos que quieren ser parte de proyectos buenos. El punto es que si hacemos marketing para el futuro seremos capaces de mantenernos vigentes. Lo tercero es lo que tiene que ver con las consejerías profesionales; se trata de conectar a los abogados de Pensilvania con los recursos apropiados en el momento que los necesiten. La idea es garantizar que nuestra asociación sea capaz de ofrecer esas conexiones, y que asegure de que la gente tenga acceso a recursos. Volvamos al tema de ampliar las membresías, especialmente en cuanto a minorías se trata. Si tenemos en cuenta que a nivel nacional solo el cuatro por ciento de

a ser capaces de pagar su deuda. Ciertamente no me gustaría que un hijo mío fuera a una escuela impagable. Lo que hay que pensar es en no tener una deuda el resto de la vida y mantener la posibilidad de hacer lo que quieres hacer. Lo siguiente es pensar en qué tipos de trabajos estarán disponibles para las futuras generaciones. Yo creo que sin importar cuántos baby boomers se retiren en los próximos años, la profesión sufrirá una especie de efecto Uber, en términos de modernización, y el verdadero reto es enfrentar esos cambios sin que nuestros servicios pierdan calidad y sigan protocolos éticos. En resumen, necesitamos dar acogida a todo abogado joven proveniente de una minoría que quiera ser parte de la asociación y que exista un conducto para los estudiantes de leyes que quieran ejercer su profesión. CULTURA El Museo era una Fiesta En el año 2003, unas prácticas en el Museo del Barrio de Nueva York me permitieron vivir en una de las mejores ciudades del mundo y tomar contacto con la comunidad latina de Estados Unidos. ANDREA RODÉS

ace un par de semanas leí una nota en The New York Times sobre la nueva exposición de una artista cubana en el Museo del Barrio de Nueva York y no pude evitar que me invadiara la nostalgia. Para los que no hayan oído hablar nunca de él, el Museo del Barrio es uno de los mejores museos de arte caribeño y latinoamericano de la costa Este, con una interesante colección permanente de artistas mexicanos, puertorriqueños y cubanos. La verdad es que yo en el año 2003 tampoco lo conocía. Por aquel entonces tenía 22 años y acababa de graduarme en Administración de Empresas en una prestigiosa escuela de negocios de Barcelona, pero mi sueño -para desesperación de mi padre, que

acababa de financiarme la carrera- era trabajar en algun museo. (más adelante decidí complicarme un poco más la vida y acabar siendo periodista). Me puse manos a la obra. Empecé a enviar currículums y rellenar decenas de formularios interminables para que algun museo de Londres, París o Nueva York me aceptara en su programa de internships. Casi todos me rechazaron, alegando que no tenía la experiencia ni formación suficiente, pero yo seguía insistiendo. Tampoco tenía mucho más que hacer, excepto aburrirme en un trabajo de verano que me había conseguido mi tía en una consultoría de salud pública, donde mi tarea básica era hacer fotocopias y editar tablas de Excel. Y entonces, en medio de una tarde bochornosa de agosto, de esas en que el asfalto de Barcelona parece sacar humo y los ojos se te cierran frente al ordenador reclamando una siesta, ocurrió el milagro, Un nuevo correo electrónico en mi bandeja de entrada comunicaba lo siguiente: “El director del Museo del Barrio estará encantado de ofrecerle unas prácticas de

nueve meses a partir del mes de septiembre.” Salté de alegría en mi silla. De pronto, ya no me importaba pasarme el resto de la tarde haciendo fotocopias. ¡Me iba a Nueva York! Para una estudiante de 22 años que todavía vivía con sus padres, irse sola a la Gran Manzana era una aventura en toda regla. Aunque fuese para trabajar en un museo del que nunca había oído hablar. La experiencia valió la pena. No solo porque me permitió vivir en una de las ciudades más vibrantes y cosmopolitas del mundo, sino porque fue mi primer contacto con el mundo latino. El Museo del Barrio es un centro de arte fundado en 1969 por un grupo de educadores, familias y otros miembros influyentes de la comunidad puertorriqueña de Nueva York con el fin de promover el arte latino en Estados Unidos. Tiene una colección permanente muy interesante, que incluye desde muestras del mejor arte taíno y pre-colombino a la obras de artistas latinos modernos y contemporáneos, aunque yo lo que mejor recuerdo son los postres que preparaba Carmen Ana, la esposa del presidente de Goya Foods, que era una miembro muy activa de la Junta del museo. Carmen Ana era una mujer puertorriqueña de mucha categoría. Probablemente era una de las invitadas más disputadas en la galas Latinas de Manhattan y andaba siempre muy ocupada, pero tenía el detalle de aparecer de vez en cuando por el museo con bandejas de flanes de coco, budines de crema y unas galletitas de café
CULTURA deliciosas, que yo me comía a puñados. Entre los postres de Carmen Ana y mis incursiones a las cantinas mexicanas del East Harlem a la hora del almuerzo, conseguí ganar varios kilos en pocos días. Pero yo era feliz, descubriendo cada día un nuevo plato de cocina latina: burritos, quesadillas, tacos, sopas picantes como el diablo… Solía volver a la oficina con la cara manchada de salsa y las manos pringosas. Todavía no he aprendido a comer una torta o un burrito sin que se me desmonte. A parte de ponerme las botas, en el Museo del Barrio tuve ocasión de trabajar con latinos muy competentes. Para empezar estaba Julián Zugazagotia, el flamante nuevo director general del museo, hijo de un exiliado vasco y una actriz mexicana de telenovelas famosa: Susana Alexander, todavía me acuerdo de su nombre. Julián era un tipo alto y delgado, con unos ojos azules que enamoraban a todos. Había estudiado Historia del Arte en París y tenía ese toque de sofisticación europeo tan apreciado en el mundillo del arte. Bajo la dirección de Zugazagotia, el museo organizó varios eventos importantes, como una retrospectiva de arte de Puerto Rico en colaboración con el MoMa o la presentación en Nueva York de la película “21 Grams”, de la mano del director mexicano Alejandro González Iñárritu. Me hubiese gustado que vinieran Sean Penn y Benicio Del Toro, pero no tuve tanta suerte. En cambio, sí tuve la ocasión más adelante de estrecharle la mano a Hillary Clinton, entonces senadora de Nueva York, que un día apareció en el Museo para presentar su autobiografía, “Living History”. Todavía guardo en una caja de recuerdos la foto que nos hicimos todo el equipo del Museo junto a la senadora. Entre los empleados del Museo del Barrio también recuerdo con cariño a Susy, la directora de Relaciones Públicas, una mujer de risa contagiosa, con el cabello rubio muy rizado y unas gafas redondas de montura de pasta que resbalaban por su nariz cada vez que soltaba una carcajada. Susy había nacido en Surinam, antigua colonia holandesa en el Caribe, y me parecía listísima. Hablaba más de cinco lenguas, incluida el surinamés, un dialecto criollo que tiene palabras parecidas al catalán, el idioma autóctono de Barcelona. Lo normal era que Susy estuviera sentada en su despacho hablando por teléfono y comiendo nachos. Si Susy soltaba carcajadas, significaba que en el museo se respiraba buen ambiente. Algo que ocurría casi siempre, excepto cuando el arte del chismorreo -desafortunada perdición de los latinos- se descontrolaba. La cocina era el lugar oficial para empezar a circular rumores: que si iban a despedir a Doris, la recepcionista colombiana, porque no tenía papeles y se pasaba el día navegando en webs de dating; que si la directora de marketing había tenido un affaire con el contable; o que si la dominicana de Finanzas estaba enamorada del repartidor de comida, un veintañero mexicano, con el bigote mal afeitado y una voz ronca, que con una sonrisa se ganaba la propina de todas. A mi lo único que me preocupaba era que los burritos hubieran llegado calientes.

l Museo del Barrio de Nueva York expone hasta el próximo 5 de noviembre la obra de la artista cubana Belkis Ayón (1967-1999), conocida por sus potentes creaciones iconográficas inspiradas en la Abakuá, un culto religioso secreto de origen africano muy arraigado a la isla. En un momento en que la Administración Trump amenaza con dar un paso atrás en las relaciones con Cuba, la exposición Nkame (que significa “alabanza” o “saludo” en el idioma Abakuá) “nos recuerda cuánto podemos ganar con el libre intercambio de energías culturales con nuestra isla vecina”, escribe el crítico de arte Holland Cotter en The New York Times.
