ouncilwoman María Quiñones-Sánchez is headed into her 13th year representing District 7 on Philadelphia’s City Council. She has become so much of a fixture in Philly politics that it is easy to forget that when Quiñones-Sánchez was first elected to City Council in Nov. 2007, she was breaking down a significant barrier. That victory signalled the first time that a Latina would serve on the City Council in a city in which over 12% of the residents are Latino/Hispanic. It also marked the first time that a Latino of any gender was elected to represent a Councilmanic District. Barriers were broken — up to a point. Since that first election and subsequent successful runs, Quiñones-Sánchez continues to be the first — and only — Latina to ever serve on City Council. It is not a new story, and the underrepresentation is not confined to the local political sphere. At the national level, Latinos continue to be left behind in U.S. politics — although that could be changing. The 2018 Congressional midterms resulted in the highest number of Latinos in both the House of Representatives and the Senate ever recorded (and the rise of one of the most prominent Latinas in politics, Rep. Alexandria Ocasio-Cortez). But the numbers continue to fall short in proportion to the number of Latinos in the U.S. Currently, there are 36 Latinos in the House, and four in the Senate. According to a report from NBC News, to adequately reflect the nearly 18% of the population that Latinos represent, there would be 77

Though the factors that contribute to the underrepresentation of Latinos in local and national politics are multifaceted, in the pg. 10 profile of Quiñones-Sánchez, the councilwoman highlights one personal obstacle that initially held her back. She didn’t know how to tell her own story. “Culturally, Latina women are not taught to tell their stories,” she told AL DÍA. It’s not a panacea, but it’s a starting point for Latinos — and, specifically, Latinas — entering into politics, both locally and nationally. Tell your story, and use your voice. According to the report, the Immigration and Customs Agency (ICE) pays around $120 per day for each person detained at the ICA center, and an extra $28 per person "when the total number of detainees exceeds 500.” The more detainees the government can provide, the more extra $28 the detention centers will have, especially if obstacles such as the Flores Agreement are removed from the road. It is a partnership between the private and public sectors of the government system that include federal agencies, local governments, and private contractors, all moving to the beat of the government's anti-immigrant agenda. "Private detention centers house about 73 percent of ICE detainees on a given day," the report explains. "Public facilities, usually local prisons, have a smaller part of a population largely detained for administrative, non-punitive reasons." But this is nothing new. “Over the last four decades, a series of emergency stopgaps and bipartisan deals have created a new multibillion-dollar industry built on the incarceration of immigrants. As Emily Kassie recounts in her article for The Guardian, OCTOBER 2 - 9, 2019

"The United States’ reliance on immigrant detention is not a new phenomenon, nor did it emerge with Donald Trump (though its growth under his administration is staggering).” Kassie recalls the country's last four decades of history where "a series of emergency stopgaps and bipartisan deals has created a new multibillion-dollar industry built on the incarceration of immigrants." Historical data have determined how the number of people detained by immigration agencies - both at the time of the Immigration and Naturalization Service and now with ICE - "has grown more than twentyfold." Especially after the implementation of the zero-tolerance policy by the government of Donald Trump, which resulted in the separation of thousands of families, the indefinite detention of minors, and the increase in reports of abuse in detention facilities. Worth Rises, a nonprofit defense organization, has documented step by step the way in which this mega-industry has taken off with the Trump Administration, detailing, in particular, the system of retribution through political lobbying. Two of ICE's largest contractors, for example, are The GEO Group and CoreCivic, two for-profit companies whose 40% revenue is due to federal contracts. As Worth Rises explains, "these companies invested heavily in the outspoken federal, state, and local candidates interested in advancing harsh immigration policies like ‘zero tolerance’ during the 2016 election cycle.” In the worst-case scenario, and if politicians don’t do well within the Capitol, they can always retire as former president's chief of staff, John Kelly, and join the boards of detention centers. z

f someone young, like this amazing Swedish girl, is committed to a cause intelligently, courageously and decisively, then there are those who for some mysterious reason believe they have the right to judge — and condemn — everything and everyone, hysterically call it child abuse, manipulation etc. If she or he does not, then the naysayers immediately lament that today's youth are not interested in anything, it is lost, etc. They forget that they, we, the adults, are the ones to blame for this horrific mess that has put the world at the brink of disaster, a disaster Greta and many other young people are struggling to get us out from. They should be ashamed of themselves. Young Cuban doctor Romy Aranguiz had this to say in Facebook about the absurd

Her uncompromising position in defense of the young activist brought her many virulent and unfair criticisms from both the right and the left, which, she said, was very disappointing. “The argument that Greta cannot feel empathy because she was born in the first world speaks very badly of those who make, in my opinion, a projection of their own inability to empathize with people outside their own circle. The argument that Greta has greeted people who represent institutions directly responsible for the exploitation of the planet for the enrichment of few and the misery of many is laughable, being that in all her speeches she clearly and up front mentions the real problem of the indiscriminate use of resources. “The argument that long before Greta, many others have fought, suffered and even died in the fight for environmental justice is also simplistic and gross. hen Silvia Roldán was a child, she recycled old sheets of paper by using them to make small notebooks. She then started selling them to her friends. That childhood venture would later plant the seeds for a future aspiration of owning her own business. “I think since I was little, I wanted to have my own business, but I didn’t know how,” Roldán recalled during an interview with AL DÍA. With help from her business degree and a local non-profit for immigrants, along with a natural desire to learn, Roldán fulfilled that dream in 2017 when she became the owner of Yaku Wear, an online boutique that sells Panama hats and silver jewelry.

ARRIVAL TO THE UNITED STATES

Silvia Roldán’s story began in Ecuador’s capital city of Quito. After spending much of her life in Santo Domingo, Roldán moved to the city of Cuenca to study at Universidad Tecnológica América. When Roldán later moved to Philadelphia, she began searching online for a place she could go to to help improve her English speaking and comprehension skills. That’s how she first came across the Welcoming Center for New Pennsylvanians. Roldán credits the Welcoming Center with helping her grasp a better command of the English language through its ESL classes, and providing support for her to develop her business idea through their Business Training Program. The 12-week training program helped Roldán with the planning, marketing, management and operations for her eventual business. In 2017, Roldán launched the online boutique, Yaku Wear,

where she sells traditional and custom-made Panama hats, and jewelry.

THE HISTORICAL SIGNIFICANCE OF PANAMA HATS

Despite the name, Panama hats originated in Ecuador — Roldán’s native country — and are a product of the handiwork done in artisan villages throughout the country. The craft tradition is often passed down from generations, and the weaving of the hats are, for the most part, done by hand. In 2012, the art of weaving a traditional Panama hat was added to the UNESCO Intangible Cultural Heritage list. When Roldán began brainstorming names for her business, she wanted to come up with a name that connected the hats with their origins. The name ‘yaku’ is Kichwa, the language of the indigenous population in Ecuador, for ‘water.’ Roldán continues to import the hats from Ecuadorian artisans, and through a new project she hopes to soon start, customers will soon be able to have decorations on their hats. In the coming years, Roldán hopes to see her business grow enough to have a brick and mortar store in Center City Philadelphia, where she can sell her craft and continue helping people learn more about Ecuador and the significance of Panama hats. n her 12 years as a City Council member representing District 7 at City Hall, María Quiñones-Sánchez says she’s never had the chance to reflect on her journey as a public servant.

EARLY EXPOSURE

It began in Hunting Park, where Quiñones-Sánchez remembers translating for her Puerto Rican mother, who then offered her daughter’s services to her neighbors and friends. Whether it was making a phone call or filling out a form, a young Quiñones-Sánchez became in many ways, the conduit between her Spanish-speaking community and the wider, English-speaking world. “It got to a point at one point where I told my neighbors I would do this thing with the shade. It’s a policy she still uses to this day for people on her block in Norris Square, and an early experience that instilled a willingness in Quiñones-Sánchez to always try to resolve any problem. She says she often takes this skill for granted, but thinking back, it’s a rare quality to develop at such a young age and it’s shaped her career since then. “I always knew I wanted to help people and it was very gratifying to be able to do that,” said Quiñones-Sánchez.

MARIA THE ACTIVIST

With that early mission in mind, Quiñones-Sánchez jumped into a career as a community activist. In that role, she took part in many different political and social campaigns on behalf of her community and raised millions for many different causes. Politically, Quiñones-Sánchez remembered her first election, during which she registered people to vote and was a self-described “human bulletin board” for her candidate. “And I still wasn’t old enough to vote,” she recalled. Later on, when Quiñones-Sánchez was regional director for the Puerto Rico Federal OCTOBER 2 - 9, 2019

In the end, GOTV registered 32,000 new voters and increased turnout in targeted areas up to 35%. Socially, she served as the first female and youngest executive director in the history of ASPIRA — an organization dedicated to developing education and leadership opportunities for Hispanic youth. While there, her efforts resulted in the creation of Pennsylvania’s first bilingual charter school — Eugenio Maria de Hostos Community Charter School — in her neighborhood of Hunting Park.

It is also one of the bigger plots of open park space in the city. In 2009, during her first term on City Council, Quiñones-Sánchez was a contributor to the Fairmount Park Conservancy’s revitalization project for Hunting Park — despite it not technically being in her district. “The park is physically in Clarke’s district, but he’s like: ‘Everything that goes on there is

Most recently, Quiñones-Sánchez appeared at the unveiling of new handball courts in June 2018. In regards to her neighborhood’s influence on certain policies, Quiñones-Sánchez said she looked at personal data in Hunting Park when implementing Owner-Occupied Payment Agreements (OOPA) for overdue property taxes and the Tiered Assistance Program (TAP) for water bills. She said both are arguably her most successful pieces of legislation and based on seeing the lives of her neighbors and friends in the neighborhood who often had to choose which bill to pay on a daily basis. “I read, and I know policy,” said Quiñones-Sánchez, “but the lived experience is really what has generated the best policy.”

That being said, before she could be an effective legislator, Quiñones-Sánchez admits there

was a steep learning curve going from activist to political candidate. Before her triumph in 2007, Quiñones-Sánchez led an unsuccessful campaign for City Council in 1999. “I wanted to be the operative and the person to help people, but a campaign is not the time,” she said. “It’s to tell a story and organize to get elected.” What followed the failed run was eight years of tough decisions. “If you’re going to do this, then you’re going to do this to win,” she remembered telling herself. “The best way to help the people you want to help is to be the most effective candidate and then the most effective legislator.” It meant Quiñones-Sánchez needed to go back to the basics and confront some of the things she was most averse to if she were to succeed.

“Making a commitment that in order to be effective and provide a voice to the people I want to provide voice means I have to do things I’m the most uncomfortable doing,” said Quiñones-Sánchez It started by taking a few classes around campaign fundraising — something she called a “necessary evil.” “After raising millions of dollars for causes and things I believe in, I still hate it,” said Quiñones-Sánchez. Message-wise, she had to learn to tell her story — a process that her upbringing held her back from at first. “Culturally, Latina women are not taught to tell their stories,” said Quiñones-Sánchez. In the end, after her eight-year hiatus, Quiñones-Sánchez won her second time around in November 2007. On Election Day, she won 80% of the vote to become the first Latina ever elected to represent a district on Philadelphia City Council.

THE FIRST LATINA

The responsibility of being the first Latina is something Quiñones-Sánchez takes very seriously. “You don’t want to be the last and you don’t want to be the only,” she said. To make sure that won’t become a reality,

UN CUARTO PERÍODO Y MÁS ALLÁ

Quiñones-Sánchez has prided herself on her accessibility. While she said it is sometimes hard to manage, the Councilwoman tries to return all her calls, attend as many events as possible, and holds weekly coffee talks with people in her district. “I try to make myself as available to a classroom as I do a constituent who just wants to talk one-on-one,” she said. In terms of mentoring, Quiñones-Sánchez has done it for many young women — some of whom she said are now much more successful than herself. Her office also offers internships for young women every year. Her advice to all of them is to follow their own path. What she did is something to learn from, but it happened in a different time, meaning there’s new obstacles to overcome and new ways to solve old ones. “You gotta do it your way, you gotta create your own path-

way,” said Quiñones-Sánchez.

A FOURTH TERM AND BEYOND

In many ways, Quiñones-Sánchez is still charting her own path in politics 12 years after first being elected. She’s done her best to be the champion and cheerleader of a district that’s long struggled with chronic poverty, crime and drug addiction as one of a 17-member legislative body. What she admits she has lost in energy and passion over the years, Quiñones-Sánchez has gained in wisdom and a respect for the democratic process as a means of causing real change. “I never thought I could adhere to those rules,” she said. Going into her fourth consecutive term on City Council, Quiñones-Sánchez is focused on many different things. For one, she wants to work towards

changing the approach to the opioid crisis, a primary concern for Kensington, from a short-term to a long-term vision. “How do we move away from the crisis mode and make institutional changes?” Said Quiñones-Sánchez. Another debate in which she hopes to play a central role is with land reform. Many years ago, she was an outlier when creating the Philadelphia Land Bank, but said some of her colleagues are finally ready to move forward on legislation that could make it more effective. Beyond the next four years, Quiñones-Sánchez said she believes it will be time for Philadelphia to elect its first female mayor. And while recognizing other very accomplished women who could vie for the spot, she’s confident pitting her record against any of them come 2023. “It’s our time,” said Quiñones-Sánchez. z

hile working in the Mexican Air Force decades ago, Edgar Ramírez was working at a job where he said there “wasn’t much to do,

except obey.” Often bored, he began to read, secretly, while on his shift standing watch. One day, he was reading Colombian author Gabriel García Márquez’s masterpiece, One Hundred Years of Solitude, when his boss caught him in the act. CULTURE that Ramírez enjoyed literature and had an inclination towards reading and writing, his boss began giving him more opportunities to do different jobs in his unit, like being an adviser and working on field investigations. “Thanks to this incident I always have had the opportunity to work in other things apart from manual work, doing things exactly because of my habit of reading,” said Ramírez, the founder and host of Philatinos Radio, a community and digital radio station in South Philadelphia. Ramírez is currently dedicated to his work at Philatinos Radio, but has always maintained this love of books. As a result, it’s rare to see him without a book in hand, which has won him the nickname: “Señor del Libro”. Out of this great love of literature was born the idea of having a Latin American Book Fair in Philadelphia: a dream that Ramírez, Ana Omana, Leity Rodriguez-Largo, and a group of organizations and lovers of literature — including City Councilmember David Oh and cultural organizations like Acción Colombia, Casa de Venezuela, and Taller Puertorriqueño — are now making a reality. On Oct. 4, the first Latin American Book Fair in Philadelphia will be held from 10:30 a.m. until 5:30 p.m. in the central patio of City Hall. More than 28 local authors will present their works in Spanish, and there will be workshops, music, and dance to celebrate literature in Spanish and lovers of Spanish books that live in the City of Brotherly Love. In an interview with AL DÍA News on Sept. 10, Ramírez affirmed that the goal of the festival is not only to highlight the works of local authors who write in Spanish; it’s also to “promote reading for Latinos,” and make literature accessible with the goal of building a community that is a “fusion between writers and readers." Ramírez believes that literature has a great power in forming community and preserving memory and identity. He credits his

I was born in Buenos Aires, Argentina and moved to the United States when in 1st grade with my parents, my two brothers and my sister. My dad was offered a job in New York for a two year period. Once he was in the position they asked him to stay, so we did. The economy in Argentina was not nearly as good as this one, and we slowly were getting used to living in the states. My dad was still very traditional when it came to family customs. We had to always eat dinner together as a family, and we were forced to speak Spanish at home among our siblings and with our parents, even when our friends who only spoke English were over at our house! I'll admit growing up I sometimes felt embarrassed talking in Spanish as a kid, but now I couldn't be more grateful.

Your career includes networks such as CNN, CNN en Español, CBS, Al Jazeera America, most recently NBC 10/ Telemundo 62, and now Yahoo Finance. Tell me about your current role? And what motivates you about it?

¿Por qué decidió regresar a hacer “reportajes de mercado”? Why did you decide to go back to “market reporting”? It's really fun! The markets are always changing and something is always happening. Sometimes it feels a little bit like sports; reporting on the winners and laggards. I get to talk about what companies are doing, innovations, and strategies and how they influence the way we live.

You have covered many stories throughout your career, can you tell us about a particular story that impacted your life? I'll share a story that showed me that anything is possible. When I was at NBC 10 /Telemundo 62 in Philly last year in the consumer reporting unit, I got a call from a viewer who recently had his limb amputated following an untreated foot infection. He had been a landscaper, spoke very little English and had no health insurance. The only way he could get around was in a wheelchair, and he asked if I could somehow help him walk again. I figured there had to be a way to help here. I contacted Limbs for Life, a local podiatrist, and a prosthetic and orthotics clinic near Philly which worked on pro bono cases. A whole team of people came together to help him. Today, he's walking with a prosthetic limb.

Have you ever felt that being a Latina created challenges in your career? If so, what are some of those challenges? Sure, one of the main challenges has been letting go of the need to try to prove myself as valuable as everyone else. When you come from a different culture, naturally you want to assimilate. I've always felt the need to work a little harder, because I've tried to prove something to those around me, and ultimately myself. I've let go of a lot of that, as I've learned to value my own self, regardless of my background. Another challenge is something thinking in the right language! I can go back and forth between Spanish and English in the blink of an eye. There are times though when I'm reporting in English and a certain word will come to mind in Spanish, or vice versa. I have to translate the word in my head quickly!

On the other hand, what are some of the advantages of being a Latina journalist? I've come to feel like I'm a true hybrid. I feel both American and Latina. It's great, I'm really comfortable and it helps to be able to look at things from different viewpoints.

Do you have any role models or mentors? My greatest role model is my mom. She had four awesome brothers, but as the only woman among her siblings, she was never really encouraged to attend college. When my sister and I went to college she would tell us how much she would've loved to have had studied at a university. She may not have a college degree, but she's the smartest woman I know. She can talk to you about pretty much any topic! She's intelligent, cultured, open-minded and has a positive outlook on life. She's most proud of the family she and my dad created. z

Todo un equipo se unió para ayudarlo, y hoy él puede caminar con una prótesis.

¿Alguna vez ha sentido que ha tenido obstáculos en su carrera por el hecho de ser latina?, ¿cuáles han sido esas barreras? Claro que sí, uno de los retos principales ha sido dejar de demostrar que soy tan valiosa como cualquier otra persona. Cuando provienes de una cultura diferente, es natural querer integrarse. Por eso siempre sentí la necesidad de trabajar más para demostrar que soy capaz, ante los demás y en especial ante mí. Pero ya dejé eso de lado porque he aprendido a valorarme, independientemente de mi procedencia. !Otro reto es pensar en el idioma correcto! Puedo pasar del inglés al español en un segundo, pero, algunas veces cuando estoy haciendo un reportaje en inglés y una palabra en español aparece en mi mente, o el caso contrario, ¡tengo que traducirla rápido en mi cabeza!

Miremos la otra cara de la moneda, ¿cuáles han sido las ventajas de ser una periodista latina? Me siento como un verdadero híbrido; me siento tan americana como latina. Es una cualidad fabulosa con la que me siento muy cómoda y hace que vea las cosas desde perspectivas diferentes.

¿Hay modelos o mentores en su vida? Mi modelo a seguir más importante es mi madre. Ella tuvo tres hermanos excelentes, pero como la única mujer entre sus hermanos, nunca se le motivó a asistir a la universidad. Cuando mi hermana y yo asistíamos a la universidad, nos dijo lo mucho que le hubiera gustado haber estudiado en una.Puede que ella no haya ido a la Universidad, pero es la mujer más inteligente que conozco. ¡Te puede hablar casi de cualquier tema! The festival, held every year in the heart of Latino Philadelphia at “El Centro del Oro” — the business and arts district in Kensington and Fairhill — is a celebration of Latino culture, family and community.

“BOMBA” ARRIVES

The headliner for the day was Ballet Folklórico Hermanos Ayala, a renowned “bomba” dance group hailing from Loíza, Puerto. The group formed in 1959 and their September 8 performance at Feria del Barrio marked their first ever in Philadelphia. “Bomba” draws origin from Puerto Rico’s history of African slavery and is an expression of the Afro-Puerto Rican community.

• PUBLIC NOTICE • PROPOSED AMENDMENT TO THE CONSTITUTION OF PENNSYLVANIA This notice contains information about a question that will be on the ballot in the Municipal Election to be held on November 5, 2019. The ballot question proposes an amendment to the Constitution of Pennsylvania, based on a joint resolution of the General Assembly of Pennsylvania. If this ballot question is approved by a majority of the people voting on it, the amendment will become law. The General Assembly of Pennsylvania first proposed the amendment during the 2018 session and approved it for a second time during the 2019 session of the legislature, as required by Article XI, Section 1 of the Constitution. This public notice is part of the process of amending the Constitution of Pennsylvania. The Secretary of the Commonwealth is required to publish: • A copy of the joint resolution proposing the amendment. • The text of the question that will be on the ballot. • A “Plain English Statement” prepared by the Office of Attorney General explaining the purpose, limitations and effects of the ballot question upon the people of this Commonwealth. Text that appears in bold print are the changes to the words of the Constitution that are proposed by the General Assembly. Kathy Boockvar, Acting Secretary of the Commonwealth JOINT RESOLUTION NO. 2019–1 Proposing an amendment to the Constitution of the Commonwealth of Pennsylvania, providing for rights of victims of crime. The General Assembly of the Commonwealth of Pennsylvania hereby resolves as follows: Section 1. The following amendment to the Constitution of Pennsylvania is proposed in accordance with Article XI: That Article I be amended by adding a section to read: § 9.1. Rights of victims of crime. (a) To secure for victims justice and due process throughout the criminal and juvenile justice systems, a victim shall have the following rights, as further provided and as defined by the General

Assembly, which shall be protected in a manner no less vigorous than the rights afforded to the accused: to be treated with fairness and respect for the victim’s safety, dignity and privacy; to have the safety of the victim and the victim’s family considered in fixing the amount of bail and release conditions for the accused; to reasonable and timely notice of and to be present at all public proceedings involving the criminal or delinquent conduct; to be notified of any pretrial disposition of the case; with the exception of grand jury proceedings, to be heard in any proceeding where a right of the victim is implicated, including, but not limited to, release, plea, sentencing, disposition, parole and pardon; to be notified of all parole procedures, to participate in the parole process, to provide information to be considered before the parole of the offender, and to be notified of the parole of the offender; to reasonable protection from the accused or any person acting on behalf of the accused; to reasonable notice of any release or escape of the accused; to refuse an interview, deposition or other discovery request made by the accused or any person acting on behalf of the accused; full and timely restitution from the person or entity convicted for the unlawful conduct; full and timely restitution as determined by the court in a juvenile delinquency proceeding; to the prompt return of property when no longer needed as evidence; to proceedings free from unreasonable delay and a prompt and final conclusion of the case and any related postconviction proceedings; to confer with the attorney for the government; and to be informed of all rights enumerated in this section. (b) The victim or the attorney for the government upon request of the victim may assert in any trial or appellate court, or before any other authority, with jurisdiction over the case, and have enforced, the rights enumerated in this section and any other right afforded to the victim by law. This section does not grant the victim party status or create any cause of action for compensation or damages against the Commonwealth or any political subdivision, nor any officer, employee or agent of the Commonwealth or any political subdivision, or any officer or employee of the court. (c) As used in this section and as further defined by the General Assembly, the term “victim” includes any person against whom the criminal offense or delinquent act is committed or who is directly harmed by the commission of the offense or act. The term “victim” does not include the accused or a person whom the court finds would not act in the best interests of a deceased, incompetent, minor or incapacitated victim. Section 2. (a) Upon the first passage by the General Assembly of this proposed constitutional amendment, the Secretary of the Commonwealth shall proceed immediately to comply with the advertising requirements of section 1 of Article XI of the Constitution of Pennsylvania and shall transmit the required advertisements to two newspapers in every county in which such newspapers are published in sufficient time after passage of this proposed constitutional amendment. (b) Upon the second passage by the General Assembly of this proposed constitutional amendment, the Secretary of the Commonwealth shall proceed immediately to comply with the OCTOBER 2 - 9, 2019

Ballot Question Shall the Pennsylvania Constitution be amended to grant certain rights to crime victims, including to be treated with fairness, respect and dignity; considering their safety in bail proceedings; timely notice and opportunity to take part in public proceedings; reasonable protection from the accused; right to refuse discovery requests made by the accused; restitution and return of property; proceedings free from delay; and to be informed of these rights, so they can enforce them? Plain English Statement of the Office of Attorney General The proposed amendment, if approved by the electorate, will add a new section to Article I of the Pennsylvania Constitution. That amendment will provide victims of crimes with certain, new constitutional rights that must be protected in the same way as the rights afforded to individuals accused of committing a crime. The proposed amendment defines “victim” as both a person against whom the criminal act was committed and any person who was directly harmed by it. The accused or any person a court decides is not acting in the best interest of a victim cannot be a victim. Generally, the proposed amendment would grant victims the constitutional right to receive notice and be present and speak at public proceedings involving the alleged criminal conduct. It would also grant victims the constitutional right to receive notice of any escape or release of the accused and the right to have their safety and the safety of their family considered in setting the amount of bail and other release conditions. It would also create several other new constitutional rights, such as the right to timely restitution and return of property, the right to refuse to answer questions asked by the accused, and the right to speak with a government attorney. Specifically, the proposed amendment ould establish the follo ing new rights for victims: To be treated ith fairness and respect for the victim s safety, dignity and privacy

Once added to the Pennsylvania Constitution, these specific rights of victims cannot be eliminated, except by a udicial decision finding all or part of the amendment unconstitutional or the approval of a subsequent constitutional amendment. If approved, the General Assembly may pass a law to implement these new, constitutional rights, but it may not pass a law eliminating them. If approved, State and local governments will need to create new procedures to ensure that victims receive the rights provided for by the amendment.

al fi ar el monto de la fian a y las condiciones de liberaci n para el acusado; tener aviso ra onable y oportuno y el derecho de presenciar todo el procedimiento que involucre el conducto criminal o delincuente; ser notificado de cualquier disposici n previa al uicio en el caso; salvo los procedimientos del gran jurado, ser escuchado en cualquier procedimiento en el cual el derecho de la víctima se implica, incluso, pero no exclusivamente, la liberaci n, la declaraci n, la sentencia, la disposici n, la libertad condicional y el indulto; ser notificado de todo procedimiento de libertad condicional, participar en el proceso de libertad condicional, proveer informaci n que se considerar antes de conceder libertad condicional, y tener aviso de la libertad condicional del delincuente; protecci n ra onable del acusado o cualquier persona que act e en nombre del acusado; tener aviso ra onable de cualquier liberaci n o escape del acusado; recha ar una entrevista, deposici n u otra petici n de descubrimiento hecha por el acusado o cualquier persona que act e en nombre del acusado; recibir restituci n completa y oportuna de la persona o entidad condenada por conducta ilícita; recibir restituci n completa y oportuna, seg n la determinaci n de la corte, en un procedimiento de delincuencia uvenil; la devoluci n puntual de propiedad cuando ya no se necesita como evidencia; procedimientos libres de demoras irra onables y una resoluci n puntual y final del caso y cualquier procedimiento posterior a la condena relacionado al caso; consultar con el abogado del gobierno; y ser informado de los derechos enumerados en esta secci n. (b) a v ctima o el abogado del gobierno, a petici n de la v ctima, puede afirmar en cualquier tribunal de uicios o de apelaci n, o ante cualquier autoridad, que tenga urisdicci n del caso, y hacerse respetado los derechos enumerados en esta secci n y todo derecho proporcionado a la v ctima por ley. sta secci n no concede a la v ctima estatus de parte, ni crea ning n derecho para compensaci n de da os y per uicios en contra del stado o cualquier subdivisi n pol tica, ni ning n oficial, empleado, o agente del stado o cualquier subdivisi n pol tica, ni cualquier oficial o agente de la corte. La enmienda brindará a las víctimas de crímenes ciertos derechos constitucionales nuevos que deben ser protegidos de la misma manera que los derechos otorgados a las personas acusadas de cometer un crimen. La enmienda propuesta define como “v ctima” tanto a una persona contra la cual se cometió el acto criminal como la persona que resultó directamente dañada por dicho acto. El acusado, o cualquier persona que una corte decida que no actúa en el mejor interés de la víctima, no puede ser una víctima. Por lo general, la enmienda propuesta otorgará a las víctimas el derecho constitucional de recibir aviso y estar presentes y hablar en procedimientos p blicos ue involucren la supuesta conducta criminal. Tambi n otorgar a las víctimas el derecho constitucional de recibir aviso de cualquier escape o liberación del acusado y el derecho de que se considere su seguridad y la seguridad de su familia al considerar el monto de la fian a y otras condiciones de liberaci n. Tambi n se crear n otros nuevos derechos constitucionales tales como el derecho a la restitución y devolución de propiedad, el derecho a rehusarse a responder preguntas realizadas por el acusado y el derecho de hablar con un abogado del gobierno. Espec ficamente, la enmienda propuesta establecer a los siguientes nuevos derechos para las víctimas: Ser tratadas con usticia y respeto por la seguridad, dignidad y privacidad de las víctimas.

Una vez que se agreguen a la Constitución de Pennsylvania, estos derechos espec ficos de las v ctimas no pueden eliminarse, excepto mediante una decisión judicial que concluya que la totalidad o parte de la enmienda es inconstitucional o que se apruebe una enmienda constitucional subsiguiente. Si se aprueba, la Asamblea General podrá pasar una ley para implementar estos derechos constitucionales nuevos, pero no podrá pasar una ley para eliminarlos. Si se aprueba, los gobiernos locales y estatales necesitarán crear nuevos procedimientos para asegura que las víctimas reciben los derechos provistos por la enmienda.
