dallas contemporary bespoke art auction 2012 auction procedures
by bidding in the live and silent auction, bidders agree to all auction rules set by dallas contemporary. check-in bespoke : saturday, april 28, 2012, guests receive a bidder packet containing electronic bid stickers. please use bid stickers on items in the silent auction. stickers will also be collected during the live auction for winning bids. on saturday evening, neither handwritten bids nor bids placed after the auction area is closed at 10.30 pm will be valid. check-out all winners should visit checkout stations, confirm method of payment and set arrangements for obtaining the live and silent auction items purchased. payment dallas contemporary accepts cash, check, visa, mastercard or american express. all sales are final, and all items must be paid for by thursday, may 3, 2012. in the event that items are not paid for by thursday, may 3, 2012, the item will be available to the next highest bidder, until sold. any checks should be made payable to dallas contemporary. 100% of the proceeds shall be distributed directly to dallas contemporary. the winning bid price represents the value of the property purchased and is not a tax-deductible contribution.

delivery of items auction items will be delivered by 2g at the purchaser’s expense. delivery dates for art auction items will be between monday, may 7 and saturday, may 12. items not claimed by this date will incur a storage fee at the expense of the purchaser. you may pick up silent or live auction winnings at dallas contemporary between tuesday, may 1 and tuesday, may 8 between 11.00 am and 6.00 pm. please call erin cluley at + 214 821 2522 to arrange pick up. live art auction all general auction rules previously stated apply to the live auction. the live auction will take place during bespoke beginning at 9.00 pm on saturday, april 28, 2012. descriptions for the live auction items are listed in the auction catalogue. if you wish to place a bid, simply raise your paddle to be recognized by the auctioneer and the spotters. the highest bidder for any item will be the purchaser. items must be fully paid for before removal from the premises. absentee bidding if you are unable to attend bespoke or prefer to bid anonymously during the live auction, you may bid on live or silent auction items by completing the absentee bidding form. all bids must be received by noon on saturday, april 28, 2012. the bid will be executed on the night of the bespoke by the auctioneer on the behalf of the undersigned, on the items designated listed, up to the maximum amount stated. all successful bids will be considered final sales, and winning bidders will be contacted and advised on payment and pick-up proce-
dures. all bids will be accepted and executed subject to the “conditions of sale.� silent auction all general auction rules previously stated apply to the silent auction. silent auction will begin at 7.00 pm on saturday, april 28, 2012 and will close at 10.30 pm. to place a bid in the silent auction, you must raise the existing bid by the minimum increment amount stated for each item. all bids are binding once they have been made. one half hour after the live auction concludes, the silent auction will close. please do not attempt to place additional bids. if the successful bidder has left the premises, the bidder will be notified the following week. if the bidder cannot be reached, dallas contemporary will contact the next highest bidder. buy it now a silent auction bid of retail value plus 20% buys the piece immediately. if the winner is not present at closing, the winner will be notified on monday, april 30, 2012. if dallas contemporary is unable to finalize the sale in one week, the next highest bidder will be notified. information on all auction items is complete as of the catalogue press time.

or the provenance or medium, as the case may be, of any property identified herein). all property to be sold has been donated to dallas contemporary for resale for fundraising purposes. dallas contemporary has undertaken no independent research with respect to the authenticity of any property identified in this catalogue. (b) all property is sold “as is” and dallas contemporary does not make any representations or warranties of any kind or nature, expressed or implied, with respect to the property, and in no event shall they be responsible for the correctness, nor be deemed to have made any representation or warranty of description, geniuneness, attribution, provenance or condition of the property. no statement in the catalogue, online or made at the sale, or in any bill of sale or invoice, or elsewhere, shall be deemed such a representation or warranty, express or implied, as to whether the purchaser acquires any reproduction rights in the property. prospective buyers should inspect the property before bidding to determine its condition, size and whether or not it has been repaired or restored. 2. any property may be withdrawn by dallas contemporary at any time before the actual sale. 3. the auctioneer and dallas contemporary reserve the right to reject a bid from any bidder. the highest bidder acknowledged by the auctioneer shall be the purchaser. in the event of any dispute between the bidders, the auctioneer shall have sole and final discretion either to determine the successful bidder or re-offer and resell the article in dispute.
if two or more parties wish to continue bidding, a bid-off or oral bidding will be permitted with an auction volunteer present until a winner is resolved. if any dispute arises after the sale, dallas contemporary’s sale records shall be conclusive in all respects. 4. if the auctioneer determines that any opening bid is not commensurate with the value of the article offered, the auctioneer may reject the same and withdraw the article from sale, and if, having acknowledged an opening bid he decides that any advance is insufficient, he may reject the advance. 5. on the fall of the auctioneer’s hammer, the highest bidder shall be deemed to have purchased the offered lot subject to all of the conditions set forth herein and thereupon (a) assumes full risk and responsibility therefore, (b) will sign a confirmation of purchase thereof and (c) will pay the full purchase price therefore before property can be resold. all property shall be removed from premises by the purchaser no later than fourteen (14) days following the sale and, if not removed, may be sent by dallas contemporary at the expense of the purchased to a public warehouse for the account risk and expense of the purchaser and such added charges will then be added to the purchase price of the object. if the foregoing conditions and other applicable conditions are not complied with, in addition to other remedies available to dallas contemporary by law, including, without limitation, the right to hold the purchaser liable for the bid price, dallas contemporary, at its option, may either (a) cancel the sale, retaining as liq-
uidated damage all payments made by the purchaser or (b) resell the property on three (3) days notice to the purchaser and for account and risk of the purchaser, either publicly or privately, and in such event the purchaser shall be liable for payment of any deficiency, all other charges due the reunder and incidental damages. 6. deliveries outside of texas may be subject to the tax of another state and, where a duty of collection is imposed by law, dallas contemporary will require payment of all said taxes. a purchase price below or at fair market value is considered to represent the value of the property purchased and is therefore not deductible as a charitable contribution. for a purchase price above fair market value, the amount above fair market value is considered tax deductible. all checks will be payable to dallas contemporary. 7. some lots may be offered subject to a reserve, which is the confidential minimum price below which such lot will not be sold. the auctioneer may implement such reserves by bidding on behalf of dallas contemporary. 8. these condition of sale, as well as the purchaser’s and dallas contemporary’s respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the state of texas. by biding at an auction, whether present in person or any agent, the purchaser shall be deemed to have consented to the exclusive jurisdiction of the state courts, and federal courts sitting in the state of texas. 38
