Man, 30, admits assault on pals A man has been jailed for 20 weeks for assaulting two men because he thought they were laughing at him. Carl Swingle, aged 30, yesterday admitted in a hearing held via prison video link that he bit James McCann’s face and finger causing him to bleed, and admitted he punched another man, Mark Wilkes, during the incident in Deighton Road, Yew Tree, on October 31 last year. Mr Colin Heald, prosecuting, told Walsall magistrates that the defendant and his victims knew each other. He said the men were walking in Deighton Road at 6.30pm when Swingle cycled up and “asked them what they were laughing at”. Mr Heald said: “The defendant got off the bicycle and threw it on the ground. “He punched Mr Wilkes in the face. When Mr McCann tried to intervene the defendant bit his finger and face, and pushed something, the victim didn’t see what it was, in the left side of his face which drew blood.” Swingle, a serving prisoner, was jailed for unrelated matters. Mr Harmail Gill, defending, told the court his client said it was the other two men who made a move towards him first. Yesterday Swingle pleaded guilty to assault occasioning actual bodily harm and common assault. He must also pay £150 compensation.

Report by Colin Drury Sentencing him at Wolverhampton Crown Court, Judge John Warner said: “The deliberate and gruesome way in which you sought to dispose of the body of Mr Daly is undoubtedly an aggravating feature of this murder. It has added to the family’s inevitable stress and heartache over and above that of the murder itself.” Roger Smith, for Walker, said the murder was not pre-meditated. He said the sports science student would have pleaded guilty at an earlier opportunity, but he was seeking to protect Jenny Miah, his partner. Miah admitted perverting the course of justice and assisting in the concealment of evidence at after she helped redecorate the house she shared with Walker in a bid to get rid of all DNA evidence. The 37-year-old will be sentenced next month.

After the hearing, Mr Daly's family spoke of their horror at finding out he had been murdered. His sister Sam Darrell, a 29-year-old NVQ assessor from Tipton, said: “It was just numbing, just a shock. Nobody deserves what happened to him – it's horrifying. “When he went missing we weren't too worried because he'd disappeared before and turned up. He had friends in north Wales and he’d ‘ go there to get away for a while. But three months was a long time even for David. “I saw reports that a body had been found in the canal and I just remember thinking, ‘that's him’. I knew it, I just had a feeling.” Mr Daly, a former pupil at Hall Green High School, Bilston, was “a lovable rogue”, she said. His father Robert, 53, of Bilston, said: “David would never have hurt anyone and he certainly didn't deserve this. It's been a nightmare.”

Cannock Chase Council aims to save £380,000 a year from privatising management of its leisure facilities. The authority is spending £100,000 in 2010-2011 and £50,000 in 2011-2012 on a study of options for the privatisation. Council leader, Councillor Neil Stanley, said that if it went ahead they expected to then make savings of £380,000 on the budget for 2012-2013. One of the options the authority is looking at is creating a charitable trust to manage facilities like Chase Leisure Centre. “The costs are on legal work to investigate whether it would be beneficial to proceed with a private partner in managing of leisure facilities. To get to the position of being able to save money we have got to spend this,” he said. The district council has also been in talks with Stafford Borough Council about sharing the costs of privatising leisure management. Councillor Stanley said that this was still in the stage of negotiations. The council is to carry out a consultation over proposals to provide new indoor and outdoor sports facilities in the district. Councillor Stanley emphasised at a meeting of the cabinet that it was a “wish list”, not something the authority had funds for.

A widow was frogmarched around her Birmingham home by two men who stole jewellery given to her by her husband, it was revealed today.
