SUMMONS, NOTICE AND BRIEF STATEMENT OF NATURE OF ACTION CONSUMER CREDIT TRANSACTION SUPREME COURT OF THE STATE OF NEW YORK COUNTY OF ERIE INDEX NO. 060043/2014 STATE OF NEW YORK MORTGAGE AGENCY, Plaintiff, -against- STEVEN B. MINTON; ET AL., Defendants. TO THE DEFENDANT STEVEN B. MINTON: YOU ARE HEREBY SUMMONED and required to serve upon plaintiff 's attorneys an answer to the complaint in this action within twenty (20) days after the service of this Summons, exclusive of the day of service, or within thirty (30) days after service is complete if the Summons is not personally delivered to you within the State of New York. The United States of America, if designated as a defendant in this action, may answer or appear within sixty (60) days of service hereof. In case of your failure to answer, judgment will be taken against you for the relief demanded in the complaint. Trial is desired in the County of Erie. The basis of venue designated above is that the real property, which is the subject matter of this action, is located in the County of Erie, New York. NOTICE YOU ARE IN DANGER OF LOSING YOUR HOME IF YOU DO NOT RESPOND TO THIS SUMMONS AND COMPLAINT BY SERVING A COPY OF THE ANSWER ON THE ATTORNEY FOR THE MORTGAGE COMPANY WHO FILED THIS FORECLOSURE PROCEEDING AGAINST YOU AND FILING THE ANSWER WITH THE COURT A DEFAULT JUDGMENT MAY BE ENTERED AND YOU CAN LOSE YOUR HOME. SPEAK TO AN ATTORNEY OR GO TO THE COURT WHERE YOUR CASE IS PENDING FOR FURTHER INFORMATION ON HOW TO ANSWER THE SUMMONS AND PROTECT YOUR PROPERTY. SENDING A PAYMENT TO YOUR MORTGAGE COMPANY WILL NOT STOP THIS FORECLOSURE ACTION. YOU MUST RESPOND BY SERVING A COPY OF THE ANSWER ON THE ATTORNEY FOR THE PLAINTIFF (MORTGAGE COMPANY) AND FILING THE ANSWER WITH THE COURT. HELP FOR HOMEOWNERS IN FORECLOSURE New York State Law requires that we send you this notice about the foreclosure process. Please read it carefully. Summons and Complaint You are in danger of losing your home. If you fail to respond to the summons and complaint in this foreclosure action, you may lose your home. Please read the summons and complaint carefully. You should immediately contact an attorney or local legal aid office to obtain advice on how to protect yourself. Source of Information and Assistance The State encourages you to become informed about your options in foreclosure. In addition to seeking assistance from an attorney or legal aid office, there are government agencies and non-profit organizations that you may contact for information about possible options, including trying to work with your lender during this process. To locate an entity near you, you may call the toll-free helpline maintained by the New York State Department of Financial Services at to 1-800-269-0990 visit the Department`s website at www.dfs.ny.gov. Foreclosure rescue scams Be careful of people who approach you with offers to “save” your home. There are individuals who watch for notices of foreclosure actions in order to unfairly profit from a homeowner’s distress. You should be extremely careful about any such promises and any suggestions that you pay them a fee or sign over your deed. State law requires anyone offering such services for profit to enter into a contract which fully describes the services they will perform and fees they will charge, and which prohibits them from taking any money from you until they have completed all such promised services. The foregoing Summons is served upon you by publication pursuant to an order of Honorable Tracey A. Bannister, Justice of the Supreme Court of the State of New York, signed on the 5th day of December, 2014, in Buffalo, New York and to be duly entered in the Erie County Clerk's Office, in Buffalo, New York. The Nature of this action pertains to a note and mortgage held by Plaintiff on real property owned by the above named defendants as specified in the complaint filed in this action. The above named defendants have failed to comply with the terms and provisions of the said mortgage and said instruments secured by said mortgage, by failing and omitting to pay the balance due and owing and the Plaintiff has commenced a foreclosure action. Plaintiff is seeking a judgment foreclosing its mortgage against the real property and premises which situates in the Town of Collins, County of Erie and State of New York and is commonly known as 2456 Vail Road, Gowanda, NY 14070 and all other relief as to the Court may seem just and equitable. North Collins Girls Varsity Basketball Team Winning Streak
The North Collins Lady Eagles hosted a new opponent, the Global Concepoints Gators, and one of WNY's top players in girl’s high school basketball Tea'Loya Huff on Wednesday, January 14. The Lady Eagles met the challenge with a 44 to 40 victory for their 5th win of the season. North Collins has won 5 of its last 7 games and presently has a 3 game winning streak with a 5 and 5 overall record. The Lady Eagles had several heroes themselves. Aurora Klawinski opened the scoring in the 1st quarter of the game with a long 2 point jump shot. She finished with 7 points. Aurora scored 5 points late in the 4th quarter. Arrika Bley continued her command of the boards with 15 rebounds and 12 points and Jenna Keppel continued her tremendous all around play with her speed, scoring 11 points and had 5 steals. Maddie Burgess contributed with 5 points and 7 rebounds. Sam Gier had 7 points and 4 blocked shots, with a solid block on Huff with seconds to go. Carly Richardson who did not score and had to deal with the Gators defensive pressure from Huff all game, managed to dish out a season high 7 assists. Kim Gick chipped in with a basket and a key defensive rebound late in the game with the Eagles only up by one point all leading to a wild finish with the Gators up by 3 points very late in the game. Gier and Gick slowed up a fast-break by Huff who scored 21 points for the Gators, when out of nowhere Arrika Bley blocked a ball from behind. North Collins then got a down the middle crossover dribble layup from Klawinski. Then Bley pulled down an offensive rebound and passed it to Klawinski again for a layup and foul for the lead. Klawinski, Gier with 2 and Keppel all combined to make four consecutive free throws to prevent the comeback win. “This was their finest hour." Carly Richardson had two last second field goal shots in North Collins vs Forestville Varsity Girls home basketball game on Monday, January 13, 2015. With 12 seconds remaining in the first half Arrika Bley pulled down a rebound off a Forestville missed free throw. A quick outlet pass to Sam Gier up the court and then a pass to Carly Richardson for a last second 3 point basket gave the Lady Eagles a 15-7 half time lead. Very late in the fourth quarter Carly Richardson made 3 consecutive free throws and Sam Gier hit a 2 point basket to give the Eagles a 3 point lead. Forestville was able to make a last second 3 point basket to tie the game at 30. In overtime Jenna Keppel had a steal and a basket to give North Collins a 2 point lead. Again Forestville hit a 3 point shot for a 33-32 lead. Sam Gier's steal and basket gave North Collins a 34-33 lead. A free throw by Forestville then tied the game at 34 each. With 16 seconds remaining Carly Richardson made a shot off a loose ball for a 36-34 lead. With 6 seconds remaining Richardson got her 5th foul but Forestville was only able to convert the first free throw and with some timely defense North Collins won their 4th game of the season with a 36-35 victory. Sam Gier had 13 points, Carly Richardson also in double figures finished with 10 points Jenna Keppel had 8 points, Arrika Bley had 5 points along with her team high 12 rebounds. 5th Annual Alumni Basketball Game
The 5th Annual Alumni basketball game was held at the North Collins Jr.-Sr. High School on Saturday, January 10, 2015. The crowd was entertained as 24 alumni played in either women’s or men’s game. This annual event is sponsored by the North Collins Girls Varsity Club and is organized by Mr. Vince Fininzio. The lady alumni started off the evening welcoming 2 male alumni onto their team in order to have enough players. Jaden and Jordan Keough assisted the EVEN year team to score 20 points. The ODD year team ended the game with 31 points. Wendy Chuba led the scoring for the ODD year team with 12 points and Cynthia Nelson led the EVEN year team with 12 points as well. A very aggressive and competitive men’s game followed the women’s game ending in a score of 61-54 with the ODD year team claiming victory. Jordan Keough led the scoring for the ODD year with 15 points and Kyle Hoffman led the EVEN year team with 16 points. Although a little battered and most likely quite sore the next day, this family fun night left a smile on the faces of all who played or attended. Mr. Fininzio and the Varsity Club would like to thank everyone who played in the game, helped out, or attended.

By Keith Roach, M.D.
Mystery Bruise Appears, Vanishes As If by Magic DEAR DR. ROACH: I have just returned from seeing my doctor, and was told that the cause of what I experienced is a mystery! In the late afternoon, my husband and I were sitting at the kitchen table. He noticed that a bruise was forming on my right temple -- a dimesize purple mark, with a bump near the hairline. Over the next few hours the bruise grew larger, with red discoloration down the right side of my face, to the jaw. I had not been injured in any way, and it did not hurt! I called a 24-hour advice nurse, and was told I probably had broken a blood vessel. The next day, I called my doctor for an appointment, just to be on the safe side, but my doctor didn’t have anything to look at. When I got up, all the bruising and discoloration was gone! She told me that there would still be some discoloration if it had been a broken blood vessel, so therefore it was a mystery. -- C.C. ANSWER: I agree with the nurse that it likely was a broken blood vessel, which can happen spontaneously to anyone. Once the blood is under the skin, it gets cleaned away by cells with enzymes that break down the blood. The color typically goes from dark red to green to yellow. This way, we can tell approximately how old a bruise is. Very superficial bleeding also can move, as the blood literally gets pulled by gravity (which is why you had a darkening down to the jaw).

I suspect that while asleep, the remainder got pulled into the hairline or lower down, where it could no longer be seen. Many people have come down with another mysterious illness, chronic fatigue syndrome. The booklet on it explains the illness and its treatment. To obtain a copy, write: Dr. Roach -- No. 304W, Box 536475, Orlando, FL 32853-6475. Enclose a check or money order (no cash) for $4.75 U.S./$6 Canada with the recipient’s printed name and address. Please allow four weeks for delivery. *** DEAR DR. ROACH: Are men less likely to wash their hands after using the bathroom (for any reason) than women? Are there any studies providing statistics? I “preach” hand-washing as the single greatest preventive for most illness. -- L.P. ANSWER: If you can think of it, it’s probably been studied. In 2003, a study at a university found that after using the washroom, women washed their hands with
soap and water 61 percent of the time, and men 37 percent of the time. Placing a reminder sign increased the rate to 97 percent of women, but only 35 percent of men washed their hands with the reminder, although 53 percent rinsed their hands without soap. Keeping hands clean reduces infection transmission to yourself and to others. Unfortunately, too often even doctors forget to wash our hands (only 65 percent of the time, in several studies). Our nursing colleagues are better at washing their hands. Many hospitals, including mine, have policies in place to improve hand-washing compliance. *** Dr. Roach regrets that he is unable to answer individual letters, but will incorporate them in the column whenever possible. Readers may email questions to ToYourGoodHealth@ med.cornell.edu. To view and order health pamphlets, visit www.rbmamall.com, or write to P.O. Box 536475, Orlando, FL 32853-6475.

By Sam Struckhoff
PICKS OF THE WEEK “Fury” (R) -- Sgt. Collier (Brad Pitt) -- or Wardaddy, as he is called -- has led his tank crew through carnage of World War II, all the way from North Africa to Germany. “Fury” is the name of their Sherman tank, manned by Wardaddy, “Bible” (Shia Lebouf), “Gordo” (Michael Pena) and an uncouth hillbilly called “Coon-Ass” (Joe Bernethal). Near the end of the war, the hardened crew gets a fresh-faced typist (Logan Lerman) as a new assistant driver. His first task: find his seat and wipe up the remains of his predecessor. Director David Ayer (best known for gritty crime dramas like “Training Day” and “End of Watch”) shows battle in brutal intensity. It’s a grim affair, but the mood and tone match the severity of what’s going on. The movie shows heroism in war without chest-beating or draping itself in a flag. “The Book of Life” (PG) -- This animated feature mixes pop culture and Mexican folklore to make an adventure about life, death, love and goofiness. Manolo (voiced by Diego Luna) is a passionate young guitarist who’s competing with a narcissistic soldier (Channing Tatum) for the love of the fairest -- and toughest -- young lady in town. This love triangle has the attention of the gods of the afterlife, setting up Manolo for an adventure through the worlds of the dead. The mythology of the movie is a lot of fun, especially the colorful and exciting “Land of the Remembered.” The film was produced by Guillermo del Toro, and
Self-portrait from “Art and Craft” his fantastical and ghoulish sensibility is reflected here. Last year was a good year for animated flicks, and this one ranks among the best in its class. “The Judge” (R) -- This family/courtroom super-drama reaches out for a hug while smothering your face with pages of old Grisham novels. Hank (Robert Downey Jr.) plays a big-city lawyer who journeys back to his unloved small-town roots for his mother’s funeral. Hank’s father (Robert Duvall) is a judge -- and windbag -- who has ruled his small-town Indiana courtroom for decades. Just as the family tension thickens, Judge Father is arrested for a hit-and-run homicide. In his desperate hour, the high-and-mighty patriarch must rely on his son’s defense. “Art and Craft” -- For years, the most prolific art forger
in U.S. history got hundreds of fakes into museums and collections. His forgeries looked masterful, and he mimicked the works of artists from a wide array of styles and eras. Most of his art supplies were things you could pick up at Wal-Mart. He lied and schemed to pass off his work as the originals, but he never really made any money doing it. He wasn’t trying to. This documentary sits down with the unassuming middle-aged man, and puts light on a surprising human story. TV RELEASES “Masterpiece: Downton Abbey Season 5” “Marie’s Mind for Murder: Set 1” “Mama’s Family: Mama’s Favorites -- Season 4” “Regular Show -- Mordecai Pack” “Maison Close: Season 1” (c) 2015 King Features Synd., Inc.
