day dock being reopened in time for the Fourth of July weekend.

Banyas and a two-man crew that consisted of his son, Cole, and stone crab captain Chris Masse, arrived at the Historic Bridge Street Pier in Bradenton Beach Wednesday morning, June 29.

They then proceeded to detach the section of floating dock that was damaged during Tropical Storm Colin and led to the day dock being closed in early June.

Benderson representatives protest moratorium After hearing objections, commissioners changed the wording in the ordinance.

HOLMES BEACH – Two representatives of the Benderson Development Company protested the city’s moratorium on franchise, or formula, businesses, calling it an attempt to block a new tenant, however, city commissioners said that was not their intent and changed the wording in the ordinance.

The issue began when commissioners learned that Dunkin Donuts and Baskin Robbins were planning to open in storefronts in the Anna Maria Island Centre, owned by the Benderson Development Company.

At last week’s City Commission meeting, Todd Mathes, director of development for Benderson Development, said, “It’s fair to say this moratorium that’s being proposed is a reaction to Dunkin Donuts, our tenant. It’s dated June 14, the same date we received comments on the building permit.

“The moratorium is clearly designed to try and block and prohibit that

specific tenant so you can decide about formula retail. We see it as an attempt to block a specific tenant. We ‘re not going to stand by and let that happen.”

He said the company would be willing to discuss design and architecture on businesses coming into the center.

Benderson attorney Bradley Ellis said a business owner “can’t get a business tax receipt until they’ve done everything else and are ready to open, so if somebody is far along in the process and all they need is a BTR, the moratorium blocks that.”

He also said that the hearing was not properly noticed, but City Attorney Steve Dye pointed out that it is a first reading and not a public hearing, therefore it does not require notice.

Commissioners weigh in

“We’re not targeting anyone,” Commissioner Pat Morton declared. “We’re just trying to save our city from invasion by people that come in and disrupt and destroy our mom and pop and small businesses.”

Commissioner Jean Peelen said commissioners made it clear at the last meeting that it did not apply to businesses that already have their paperwork in the pipeline.

Dye said “new” means anything after June 14.

Building Official Jim McGuinness pointed out that the moratorium says “processing and issuance,” which could prohibit those already in the pipeline.

He suggested adding a date after which the city would not accept any more applications.

Peelen asked why the ordinance in-

cludes permits as well as business tax receipts, and Dye said because some businesses don’t require permits.

Commissioners approved the ordinance to include new wording as suggested by McGuinness.

“It has to do with not just saving our small businesses but who we are and the uniqueness of this place,” Peelen stressed. “We’re not unique with a McDonald’s or Dunkin Donuts on every corner.

“If we don’t do something, they’ll be on every corner because we are now discovered and we’re rapidly becoming a year round resort. We can’t be old Florida with these kinds of formula retail stores everywhere.”

Vacation rental signs must comply

Holmes Beach Police Chief Bill Tokajer told city commissioners last week that the city is sending letters to all rental agents that they must comply with the vacation rental sign regulations by July 8.

The regulations are as follows: • No more than one sign shall be placed on the property; • The maximum size of the sign shall be four square feet (single surface) and the sign shall be oriented parallel to the street and located no further than 10 feet from the main structure on the lot or parcel. The maximum height of the sign shall be three feet from the surrounding grade.

Fixe attachments or information boxes are prohibited; • The sign shall be non-moving, freestanding and securely anchored into the ground; • Sign colors shall not be fluorescent; • All signage at vacation rental properties must be brought into compliance within 120 days of the enactment of the vacation rental ordinance.

Mayor to appear on Netflix

According to Bradenton Beach Mayor Bill Shearon, he will be featured in a Netflix program hosted by Chelsea Handler that will debut Thursday, July 7. The segment featuring Shearon pertains to the mayor’s race that resulted in a tie between Shearon and then-Mayor Jack Clarke.

The winner was determined on Wednesday, Nov. 4, 2015, when Shearon drew an ace of clubs and Clarke drew a 10 of clubs while cutting cards at the Supervisor of Elections office. Handler visited city hall earlier this year and interviewed Shearon for the segment that will be made available to Netflix subscribers this week.

Holmes Beach to get Bert Harris appraisals

Holmes Beach commissioners authorized the mayor to execute an agreement for appraisals as the result of Bert Harris claims for 306 Clark Drive and 128 49th Street.

The purpose is to analyze the impact of Bert Harris claims based on the city ordinance that limits the number of bedrooms to four in single-family dwellings and two per side in duplexes. The fee for N.A. Clarizio and Associates, Inc. will be $8,500.

Youth Drama Camp at The Center

The Center of Anna Maria Island and The Islander Players are partnering for Youth Drama Camp on July 11 through 21. Camp will be 9 a.m. to noon Monday through Friday the first week and Monday through Thursday the second week.

Children will have the opportunity to be on a theater stage with all practices and performances at The Island Players. Pam Sikkema will direct the play.

The cost is $150 for members and $160 for non-members. Space is limited, and children must 5 to 12 years old for camp.

BP check puts The Center in the black

Center officials hope the Island cities will double their funding in the coming fiscal year.

ANNA MARIA – The Center will be in the black for the fiscal year, which ended in June, thanks to a check from BP. Executive Director Kristen Lessig told board members last week that the BP settlement for lost income as a result of the Deepwater Horizon oil spill was for $174,000.

Treasurer Jim Froeschle had reported that there was a $57,000 loss in May and an anticipated loss of $90,000 for the year, which changed with the BP check.

He said Center officials had an aggressive plan for program revenue, which fell short, as did anticipated increases in city funding.

“We’re going to fall way short of doubling municipality funding, which was unchanged from the year before,” he said. “We’re still looking at about 4 percent of our revenues coming from municipality funding, which is an extremely low number for any community center.”

Chair Bill Shuman said it should be 25 to 26 percent.

Froeschle remarked, “Twentyfive percent is one of those things you dream about. We’re hoping the cities will double their gifting.”

Lessig said the city of Holmes Beach’s funding has remained the same since 1985 at $22,500. Anna Maria contributes $16,000 plus the use of the land for The Center.

“The mayor described it as a marriage between the city and the Center,” said board member Ed Chiles. “In a marriage both parties support each other. We’re not seeing that. We deserve to be supported by the cities. It’s not right.”

Lessig reported that: • Board member Mike Thrasher designed an ad for the trolley.

• She is working with the AMI Chamber of Commerce and the Annie Silver Community Center to display rack cards.

• Summer camp attendance is

up from last year and the teen program is growing.

• A sand soccer tournament is planned for Aug. 6 and 7 at Coquina Beach.

• A pilot program for physical activity and nutrition is planned for third graders at Anna Maria Elementary.

• The Chiles group is offering corporate memberships for employees (see related article on this page).

• Sean Murphy has started a pick up hockey program for youths on Saturdays at 2 p.m.

• A members’ social on June 24 was very successful with picnic food and two movies for kids.

Froeschle said he is working with fundraising and philanthropy specialist Bob Carter on revamping the way The Center is funded.

Board member Patty McBean said the governance committee is seeking new board members.

“We are running slim at a board level,” she explained. “As we move forward and try to create a board, we want to insure that the board has the skill set and experience that will help us move forward.”

She said she has a list of prospective board members, and the committee plans to conduct interviews. Shuman said the board has nine members and can have up to 17.

Chiles offers corporate memberships to The Center The Center is partnering with the Chiles Restaurant Group to pilot a corporate membership program for its more than 300 employees. The Center is hoping that the relationship with the Chiles Group, the largest employer on Anna Maria Island, will lead to additional partnerships with other area businesses, both large and small.

Through the program, employees will be given access to the fitness center at no charge. The Chiles Group will reimburse The Center on a monthly basis at a rate of $3 per usage per employee. Employees will only be required to pay an initiation fee of $20 for the upfront investment of membership.

In addition to use of the Fitness

Center and access to an array of health and fitness classes, tennis and pickleball, employees will have access to the playground, field and gymnasium during nonprogram scheduled times. Finally, they will receive significant discounts on participation in The Center’s specialty, sport and youth program offerings, to include afterschool and seasonal camps.

The benefits of a corporate wellness program are statistically proven to reduce absenteeism, increase productivity, reduce employee turn over and reduce associated health care costs.

“We are extremely excited to enter into this new formalized partnership with the Chiles Restaurant

Group,” Executive Director Kristen Lessig stated. “Both Ed and Tina continue to be very supportive of the new direction of The Center.

“As we continue to focus on ways to reengage our local Islanders, we feel that working with area businesses is a key element to success in doing so. I look forward to seeing the employees and their families active in our diverse array of programs for all ages.”

Chiles added, ““This corporate partnership is a great opportunity for our business to encourage a healthy lifestyle for our employees while also supporting the most important community organization in Anna Maria. I hope other local business will join us.”

Bert Harris claims keep coming The city has received 54 claims seeking more than $14.4 million in compensation for lost property values.

According to Deputy Clerk Debbie Haynes, the claims received on Friday, July 1, were filed by the Najmy/ Thompson law firm.

The claim filed for the vacation rental located at 211 Magnolia Ave. seeks relief from occupancy restrictions or $345,000 for the assessed lost value of the five-bedroom rental structure that lists a pre-vacation rental ordinance adoption occupancy of 11 guests. The property is owned

by Starfish 66 LLC, which according to state records is registered to Thomas Rushmore, from Reddick, Fla. The claim filed for the property at 217 Magnolia Ave. seeks occupancy restriction relief or $345,000 in lost

The claim filed for the property at 228 Willow Ave. seeks occupancy relief or $595,000 in compensation for a five-bedroom structure than can

accommodate 13 guests. The property is owned by 228 Willow LLC, which is registered to John and Deanna Munn, from Celebration, Fla. The latest claims bring the total number of claims to 54 and the total amount of compensation sought to more than $14.4 million.

For each claim filed, the city has 150 days to negotiate a settlement before the property owner can file a lawsuit.

The city’s vacation rental ordinance allows for the lesser of two persons per bedroom or a maximum occupancy of eight. If a registered property received a grandfathering provision, the property is allowed two persons per designated bedroom for a five-year period; and a maximum of eight when the grandfathering period expires in 2021.

The Holmes Beach vacation rental regulations allow in perpetuity a maximum of six occupants or two persons per bedroom, whichever is greater.

The city of Bradenton Beach does not have any active vacation rental regulations or occupancy restrictions in place.

EDITORIAL A July Fourth well spent

I

t was another splendid Fourth of July holiday on the Island, beginning with a colorful, hot and humid parade by the Privateers and ending with another rousing fireworks display, presented on the beach by the Chiles Group.

Thanks to both of these Island organizations for putting in the time, money and sweaty effort required to make such traditional celebrations happen. The fact that they are free to the public can't be overlooked, either.

Estimates of how many people turned out for Monday's festivities were all over the map, but it's safe to say there were somewhere between 10,000 and 20,000, which most agreed was a slightly smaller crowd than last year.

However, the happy holiday atmosphere could have been marred if not for the efforts of Manatee County lifeguard Chelsea K. Hart, who rescued a young boogie boarder from a nasty rip current at Coquina Beach.

The 10-year-old boy was being pushed into the barnacle-laden rock jetty when Hart saw him and pulled him to safety. It was another case of a county lifeguard doing her job during the course of her day and it likely saved this boy from serious injury or worse. Our lifeguards don't get the credit or recognition they deserve for the service they provide, but we're all glad they are there when we need them.

LETTERS TO THE EDITOR Stop the greed In regards to Anne Johnson's letter in the June 29, 2016 issue of The Sun, I couldn't agree with you more. I've meant to write something for a while about these Bert Harris claims that are being filed in Anna Maria and now the issue is coming up here in Bradenton Beach about vacation rentals. They remind me of an old pub song, though paraphrased; "Ah, isn't it grand boys to be so bloody well" . . . greedy.

Listen, I'm all for a body making a buck, but at the detriment of a community? I think one of the first claims was for a place holding up to 18 people, though most are for around 12. Other than a wedding party, are families still that big? Who the heck are these owners renting too? It also makes me wonder if any of these owners even live out here on the Island? If these owners want to stick that many people into a vacation rental maybe they should start thinking of slinging hammocks from the ceiling.

I've lived here for 16 years now, but have been coming here since the early 1970s when I was still in the service. The atmosphere, people who live and work here and their friendliness are the reasons I decided to settle here. As for the folks who visit here, I say welcome and enjoy. But you have to admit, there are some folks living and working here who hope to never see you again.

Also, these mini-hotels going up around the Island are truly "monstrosities". I believe we should be grateful that these things can only be built three

stories high or we would be looking like Sarasota or St. Pete.

I just hope and pray that the powers that be in Bradenton Beach, Holmes Beach and Anna Maria do truly see what's happening and put a stop to it all.

Or, at least, place a moratorium on any future construction.

Don't ban franchises Editor's note: This letter was originally Holmes Beach City Commission Chair Judy Titsworth and has been edited for content.

On behalf of the more than 300 industries that use the franchise business model to fuel entrepreneurship, I am writing to express our strong opposition to the proposed temporary ban on franchise businesses opening in Holmes Beach.

Continuing to move forward with this blatantly discriminatory prohibition will arbitrarily and unfairly restrict the ability of current and future local small business franchise owners from offering their goods and services. Additionally, the proposed ordinance will have potential legal ramifications, up to and including litigation. Often times, franchisees enter in franchise agreements requiring multiple units to be opened within a given period of time, which could clearly be impacted by proposed ordinance 16-15.

Celebrating 55 years of excellence, education and advocacy, the International Franchise Association is the world's old-

est and largest organization representing franchising worldwide.

Franchise businesses are locally owned small businesses with a national name.

The brands do not own the stores, and, as you acknowledge, franchisees are small business owners, not "mega corporations." Moving forward with the ban does nothing but discriminate against local small business entrepreneurs in Florida, while simultaneously restricting consumer choices. Like any other small business, a franchise's success depends on the franchisee's own capital, hard work and long hours. Like any other enterprise in Holmes Beach, a franchise operating there pays taxes, is involved in supporting community activities and creates economic opportunities for employees and suppliers who directly benefit from the existence of the enterprise.

The city government should not impose its will on the consumers of Holmes Beach, but should instead allow the community to decide, through marketplace, if certain businesses are acceptable to them.

I urge you to reconsider your proposed moratorium on franchise businesses.

Such drastic steps not only harm your community by weakening its economy, but are contrary to the most basic tenets of American entrepreneurship and fairness.

State of city address scheduled The agenda for the Thursday, July 7, Bradenton Beach City Commission is lighter than usual and notes that Mayor Bill Shearon will present his annual state of the city address. The commission will also hear a presentation from the Paranormal Society of Bradenton regarding a potential Bradenton Beach ghost walk.

The consent agenda includes a request for the city to renew an interlocal agreement that assists Manatee County in obtaining federal funding from the Department of Housing and Urban Development and a special event permit request for a beach soccer tournament.

The agenda also calls for a Bazzy litigation update regarding the pier lawsuit. The meeting will take place at Bradenton Beach City Hall, 107 Gulf Dr. N., at 6 p.m.

Basketball, football leagues to start The youth basketball league will start at the Center on Aug. 2, and players must register by July 15. Registration is available on-line at Centerami.org or at The Center at 407 Magnolia Ave, Anna Maria.

Players will be evaluated at 6:30 p.m. on July 18 for 5- to 7-year-olds, July 19 for 8- to 10-year-olds, July 20 for 11- to 13-year-olds, and July 21 for 14- to 17-year-olds.

The cost for the league is free for members with a $5 processing fee and $90 non-members. Schedules will be made after evaluations.

There will be coaches and players clinic on July 18, 19 and 20 at 6:30 p.m. by Bradenton Christian Boys Basketball Coach Scott Townsend and players. Attendance is recommended for all players.

Tree house motion withdrawn A trial date has been set for July 15 regarding the initiative petition.

HOLMES BEACH – One day before a scheduled hearing with a special magistrate, tree house attorney David Levin withdrew a motion for a stay pending appeal.

In May, Special Magistrate Kelly Fernandez ruled that Richard Hazen and Lynn Tran, owners of the tree house on the beach in front of Angelino’s Sea Lodge at 103 29th Street, did not bring it into compliance by removing the violations or demolishing the structure. She ordered a fine of $50 per day starting from July 22, 2015.

Following the ruling, Levin filed a notice of appeal of the fine to the circuit court. He also filed a motion for stay of enforcement of the order imposing the fine pending appeal.

The July 1 hearing was for the special magistrate to determine whether to grant the motion for stay of enforcement of the order imposing the fine. Regarding withdrawing the motion, Tran said the fine issue would be addressed in the court appeal.

HOLMES BEACH – City commissioners approved the amended noise control ordinance on first reading after clarifying an issue brought up by Commissioner Jean Peelen.

At a work session on June 16, City Attorney Jim Dye explained the two areas of change. One is the citation procedure, which gives the officer the discretion to give a warning or a ticket, and the other changes the venue of citation hearing from county court to a special master.

be gone, they’re going to get a ticket,� but if it’s a resident, the officer can use discretion, Commissioner Carol Soustek explained and said police are recording all complaints “to see if there’s a pattern.�

Tokajer added, “The officers are well aware of the problem, and they want something as a solution. The discretion would come in if they go to a location that has never had a complaint before.�

Peelen suggested rewording the section to make it clearer, and the others agreed.

Street resurfacing approved On June 23, the Anna Maria City Commission approved the first phase of a two-phase street resurfacing agreement with Superior Asphalt not to exceed $78,674 for work taking place during the 2016 fiscal year that ends on Sept. 30. The approved resurfacing will take place on Spring Avenue, Alamanda Street, Crescent Drive, Fern Street, Hibiscus Street and Poinsettia Road.

An additional expenditure of $293,099 anticipated for the 2017 fiscal year has not yet been approved by the commission. The second phase would include Jacaranda Street, Cypress Avenue, Coconut Avenue, North Shore Drive, Gulf Drive, Sycamore Avenue and Elm Avenue.

City Engineer Lynn Burnett said the long-term goal is raise city streets Island-wide two inches every 15 years in order to stay ahead of projected sea level rising.

BRADENTON BEACH – Cayo Construction Co. hoped to be able to open up some areas along the parking lot for Cortez Beach for the Fourth of July holiday, but it appears Tropical Storm Colin took away those hopes.

Project engineer Michelle Pfeifer said it is unknown when to expect completion of the replacement of the three groins, but she said in an e-mail that work would extend into August.

The groins made the area popular with surfers, but over the years the three structures became dangerous.

The county roped off the piers and banned trespassing on them for years.

Eventually, one of the piers collapsed into the water.

As part of the most recent beach renourishment project last year, Manatee County got the funding for the piers’ replacement and two of them are finished, although they are not open to the public at this time. Surfing around the piers has been restricted because of underwater debris and fencing.

Work on the third groin continues as concrete slabs are being unloaded for placement on the structure. The three piers are going to be adjustable to cut down on erosion.

No turtle left unadopted

“Life is like an ocean. It can be calm and still, or rough and rigid, but in the end, it is always beautiful.”

Sentiments like this commemorating both lost and living loved ones are popping up all over the beaches of Anna Maria Island as loggerhead sea turtles lay their nests and Anna Maria Island Turtle Watch and Shorebird Monitoring volunteers stake them off and post them with adopt-a-nest plaques.

The program, a fundraiser for the not-for-profit organization, is so popular that Turtle Watch is accepting requests for nest adoptions on a waiting list for this summer, contingent on the cooperation of the turtles.

Besides serving as memorials, adoptions also are used to promote businesses and organizations.

The plaques remain on the nests for 60 days, approximately the length of time it takes a nest to hatch. After the nest has hatched, each adoptive parent receives the plaque as a keepsake, data from the nest, including how many turtles hatched from it and when, a letter of appreciation and the satisfaction of helping an imperiled species, according to Turtle Watch.

Turtle Tips During sea turtle season, May 1 – Oct. 31, please follow these tips: • Turn off lights visible from the beach and close blinds from sundown to sunrise; lights confuse nesting sea turtles and may cause them to go back to sea and drop

their eggs in the water, where they won’t hatch. Light can also attract hatchlings away from the water.

• Don’t use flashlights, light sticks, or cell phone or camera flashes on the beach at night.

• Remove all objects from the sand from sundown to sunrise; they can deter sea turtles from nesting and disorient hatchlings.

• Fill in the holes you dig in the sand before leaving the beach; they can trap nesting and hatching sea turtles, which cannot live long out of the water.

• Don’t use sky lanterns or fireworks; they litter the beach and Gulf.

• Do not trim trees and plants that shield the beach from lights.

• Never touch a sea turtle; it’s the law. If you see people disturbing turtles, call the Florida Fish and Wildlife Conservation Commission’s Wildlife Alert hotline at 888-404-FWCC (3922).

The basics of tying knots

Y

our fishing tackle can be the best money can buy. You can use the perfect bait, lures and flies, but get one of the smallest details wrong and all your effort can be in vain. One of the most important components that can mean success or failure has never changed and that’s tying your knots correctly. The average angler doesn’t need many knots, but it’s critical that they be tied properly. Learning to tie knots correctly may seem a minor part of the fishing equation, but you won’t meet many anglers who haven’t lost a great fish to an improperly tied knot!

The place to learn and practice knots is at home and not on the water. With some practice, you’ll be able to learn a number of important knots with good instruction, a pair of pliers and some spools of line.

Then when the action is hot, you’ll be ready to tie that all important connection between you and your fish. Below are a few tips on tying knots that won’t fail you and that will handle most every fishing situation you’ll encounter in the Gulf or on the bay.

There are a few critical factors to tying knots that won’t fail. First, make sure you give yourself plenty of line to make the knot. If you use too little line, you’ll

You can master the most complicated knots, but if you don't tie them properly they’ll have a high probability of failing. The most critical component of any knot is that it is tight.

Knots break when they slip. To make sure they’re secure, wet them when they are secured and make sure they’re tight and won’t slip when pressure is applied.

I suggest using an eye bolt attached to a bench when rigging at home and a small eye hook on your boat console. Tie the knot, wet it and tighten it with a pair of pliers. Finally, test the connection with a strong pull, just shy of breaking the line. Follow these rules, tie the knots that work for you, and you’ll strengthen the weakest link in your fishing experience.

This is the knot to use when tying two lines of dissimilar diameters together fast or in the dark. The surgeon’s knot is really just an overhand knot tied with two strands of line. It is one of the most important knots you can learn.

The uni-knot is another simple knot that can be used to construct leaders as well as tying a hook to your bite tippet.

This is probably the most popular knot tied locally. It’s not rated at 100 percent, but I’ve never had a properly tied one fail.

The Albright special is an especially useful knot for the coastal angler. This is the knot to tie when you’re rigging for Spanish mackerel or tarpon. It allows you to tie mono to wire without a swivel see reel time, page 19

One knot that I avoided for years, but recently mastered is the blood knot. Preferred by most Keys guides for building leaders, this knot has a slim profile that easily slips through the guides of a rod.

The Bimini twist is another great knot to master. It may take some time to learn, but it can be used as a foundation for all saltwater leader systems. The Bimini allows you to double your standing line into a loop, creates 100 percent knot strength and acts as a shock between small line and heavier leader.

An easier knot to tie that is an effective way to double the standing line is the spider hitch. It doesn't have the knot strength of the Bimini twist but again, I’ve never had a properly tied one fail.

The final step is to tie a hook or lure to the leader. The Nonslip mono loop is my choice for several reasons: it’s easy to tie, tests near 100 percent and forms a loop that gives bait and lures more range of motion. The knot has a couple of other advantages: it won’t tighten when a fish is hooked, and the tag end comes out facing away from the standing line which keeps it from picking up weeds or other debris. The uni-knot also can be used to tie the hook to the bite tippet, but has the disadvantage of tightening down when pressure is applied.

There are a lot of YouTube videos with instructions on tying every imaginable knot. “Fishing Knots,” by Lefty Kreh is one of the best I’ve seen on the market. It’s spiral bound, so it easily stays open to the page you’re studying, and no one I’ve met has the wealth of experience of Kreh. As a bonus there’s a one hour DVD included where you can follow Lefty tying all the most important knots. The movie is peppered with invaluable tips on line, leader and knot tying. Fly anglers fishing the coastal gulf in Sarasota with me, out of CB's Saltwater Outfitters on Siesta Key, had good action with tarpon during the past week. We had numerous shots at tarpon on several days of fishing, a couple of hook ups and one tarpon caught and released.

Hal Lutz, from Parrish, and Jeb Mulock. From Bradenton, fished with me on Thursday. With poor visibility, Hal laid a quick back cast down and hooked up on a short cast. He fought the tarpon through numerous jumps and runs before the fish was leadered and successfully released.

Mike Storey, from Bradenton,, fished with me on Friday. Mike had previously done some fly casting instruction and a flats fly fishing trip with me and was ready for the challenge of tarpon. Since it was his first time targeting tarpon with a fly, we worked on line handling, presentations and various other aspects of fly fishing for tarpon.

He has a good eye and was able to spot numerous fish at a considerable distance. It all came together

Tarpon fishing in the coastal Gulf should be a good option next week depending on conditions, as we head away from a new moon on July 4. Outgoing tides in the afternoon should be best. Snook season is closed now on the west coast of Florida, but catch and release night snook fishing around lighted docks and bridges in the ICW with flies and DOA Lures should be another good option. Trout, bluefish and

more should also be good options on deep grass flats of Sarasota Bay.

Captain Daniel Kesten reports snook fishing is still good at the mouth of the river, Terra Ceia and on the beaches. Trout are in the deeper grass flats, and Spanish mackerel are also around the trout.

Snapper are on the nearshore reefs.

Captain Scott Moore says flounder are along the beaches and the trout and snook are scattered.

Mangrove snapper are around the bridges, artificial reefs and in the bay.

Hot time on the Island Thousands brave the sauna-like conditions on Anna Maria Island to celebrate our nation's Indpendence Day.

he festivities began with the Anna Maria Island Privateers Fourth of July Parade that started at Coquina Beach and ended at the Anna Maria City Pier.

The Privateers estimated about 130 vehicles in the parade, counting bikes and other modes of transportation. It was smaller than last year’s 150 vehicles.

One Privateer said there seemed to be more people lining the streets and more people using squirt guns in the parade, to the dismay of those trying to shoot pictures of them.

Golf carts were popular because they were easy to adorn with red, white and blue decorations.

After the parade, the Privateers reassembled at the Ugly Grouper in Holmes Beach for lunch and liquid refreshments. They brought up winners of their annual scholarships.

It was busy on the beaches Monday and according to lifeguard Colin Schmidt, the parking lot at Coquina was full and beachgoers were parking on both sides of Gulf Drive.

On Saturday, lifeguard Chelsea K. Hart pulled in a swimmer who got caught in a rip current.

“He was fighting it and trying to grab hold of the jetty, but it had barnacles,” she said. “I got him out of the current, and he was OK.” Hart became a Manatee County lifeguard two years ago. Born in Virginia City, Va., she served as a pool lifeguard and worked in Volusia County. She’s an Army veteran, and she likes where she’s at because her family lives here.

Open government advocate makes records requests Joel Chandler has a long history of association with public records lawsuits.

ANNA MARIA ISLAND – Lakeland-based open government advocate Joel Chandler submitted public records requests to the cities of Bradenton Beach and Anna Maria last week.

On Monday, June 27, Chandler e-mailed a public records request to the e-mail account associated with the city of Anna Maria’s administrative assistant’s that sought “all records memorializing payment of dues or membership contributions for any person, corporation, foundation, trust, association, group or other organization made by your agency.”

That same evening, Chandler sent a similar request to Bradenton Beach Mayor Bill Shearon that was directed to the attention of the custodian of public records for the city’s Community Redevelopment Agency (CRA).

According to Holmes Beach City Clerk Stacey Johnston, Chandler had not submitted a similar records request to her office as of Friday afternoon.

Chandler On Tuesday, June 28, Anna Maria City Clerk Diane Percycoe sent an e-mail to the mayor and city commissioners informing them of the records request.

She later sent an e-mail to Chandler that said, “Attached is the general ledger for membership/ association dues from 2010-2011 to 2015-2016. If you want copies of each invoice and payment, I will have to pull each invoice and copy and scan each one. I will also have to contact our outside IT department to retrieve the e-mails concerning membership/association dues. Once you let me know the time frame, I can come up with an estimated labor cost to fulfill your record’s request.”

The summary documents Percycoe included in her e-mail to Chandler

indicated the city paid $3,058 in membership and association dues in the 2015-16 fiscal year. Those receiving payment included the Florida League of Cities, the International Institute of Municipal Clerks, The Anna Maria Chamber of Commerce and the Arbor Day Foundation.

On Friday, Bradenton Beach City Clerk Terri Sanclemente said, “Once he pays the estimated invoice, we will begin to work on his request.”

The invoice Sanclemente referred to was for $250.

Chandler is currently affiliated with the Florida Open Government Watch (FogWatch) organization, and he formerly held a salaried position with the Citizens Awareness Foundation in Deerfield Beach.

The SunSentinel newspaper, which covers the Broward and Palm Beach areas, published a story in March 2015 that said Chandler was affiliated with more than 200 lawsuits filed during a seven-year period.

an attempt to revise public records laws to address those who “deliberately provoke violations of the law to generate legal fees for the law firms with which they are affiliated,” The SunSentinel reported.

The story noted that Chandler is not an attorney and cannot collect damages in public records cases that only allow for the recovery of attorneys’ fees and that he filed for bankruptcy in 2014, According to a report published

by Ashley Lopez at the Florida Center for Investigative Reporting, the city of Lakeland paid $95,000 to Chandler’s lawyers and least $55,000 to the law firm that represented the city in a four-year legal battle that stemmed from Chandler and his attorneys challenging the Lakeland Police Department’s policy of charging a flat public records fee of $23.50 rather than providing public records at no cost or basing the fee on the work required to produce the requested records.

Efforts to contact Chandler for comment last week proved unsuccessful.

Adults battle in the playoffs at The Center

The Island kids are off playing in the sun and sand, attending summer camps, enjoying time away from school, while waiting for the next youth recreational sports season to start at The Center. The adults, on the other hand, are sweating it out on the basketball court and pitch finishing the spring seasons in the playoff games leading to the championship games in each sport.

Playing each Tuesday night, seven teams battled week after week until four teams go on to the semi-finals.

Finishing with a perfect record, Team Jackson, lead by Antwan Jackson finished the season on the top of the leader board. With two losses each, Teams Sapanora and Team Calvary move on to the second round of the playoffs. Team Aaron had a winning regular season and captured the final spot in the semi-final round with a record of four wins and three losses.

The Center’s reported statistics give high score credits to three players. Two of the players with 21 points, whose teams did not make it to the next round of playoffs, were Eric Gledhill, of Team Terman, lead

by Andrew Terman and Neil Baumann, of Team Bekkerus, captained

by Tyler Bekkerus. Captain Patrick Calvary had last week’s scoring leader, Pedro Vega, with 25 points, who helped move his team one game closer to the championship game.

The adult basketball league championship game will be held at 7:30 p.m on Tuesday, July 12, at The Center.

In adult co-ed recreational soccer, the men and women of the nine teams fight it out on the grass to win a spot in the third Paul “Ace” Hayward Championship Cup game to be held at 7 p.m on Thursday, July 21.

Last week’s action broke up the middle of the pack, while three teams floated to the top of the record.

Team Slim’s Place, that had a bye last week, rocks the top of the charts with its 6-2 season record finish.

The Blake Medical teams’ wins and ties once again shows that the playoffs are a new day in the season. The first seeded team has the daunting challenge of making it to the next round. The lowest seeded teams have been known to defeat the top seed in the playoffs. Any given Thursday the underdog can win.

Stacy Collier Frank Stacy Collier Frank, 61, of Tampa, Davis Islands and Anna Maria, died Saturday, June 25, 2016, at Tampa General Hospital.

Born in Washington, D.C., she came to Florida in 1961, where her father, Richard “Dick” Frank, began his labor law practice and her mother, Pat Frank, started a career in politics. Stacy was a lifelong fisherwoman: she received her first tackle box at age 7 and was captaining her own boat by 12. She was an excellent marksman at her father’s elbow.

As the Frank sisters grew up and attended Plant High, their father became a Second District Court of Appeal judge and their mother was elected to the Hillsborough school board, state House, state Senate, county commission and office of the clerk of the circuit court. Stacy attended Georgetown’s School of Foreign Service and then Florida State University Law School, where she made law review. She became in-house counsel for TECO before going into private practice and later starting her own successful business negotiating leases and construction of cell towers.

She was a member of the Athena Society, the Hillsborough Commission on the Status of Women, the Tampa Bay Committee on Foreign Relations, Florida Bar Association and the Tampa Yacht & Country Club. A diehard Democrat who ran her mother’s cam-

paigns, Stacy loved politics and opened her home and wallet to candidates and causes in which she believed. On her shelves were photos of her with Bill Clinton, President Obama and Hillary Clinton. She loved her family and friends deeply and created a life for herself centered around them. At her Anna Maria beach house, she loved nothing more than opening her doors to friends, old and new, serving dinner and arguing politics over wine. She adored her nephew Collier and niece Courtney. She always loved animals, especially her dog Ladybird.

She will be remembered as a strong, fierce and generous woman who never backed down. She died after a sixmonth battle with non-smoking, nonsmall cell lung cancer. The world is less without her.

She is survived by her mother, Pat, of Tampa; sister, Hillary and husband Michael Aubin, of Jacksonville; sister, Courtney Frank, of Tampa; aunt, Lenore Shniderman; cousin, Craig Shniderman and wife Judy Shniderman, of Washington D.C.; and niece and nephew, Courtney, and Collier Weber.

In lieu of flowers, please make donations to the H. Lee Moffitt Cancer Center Stacy Frank Fund, which will go towards early detection of non-smoking lung cancer. Committee to set theme for bridge aesthetics The group will meet on the fourth Wednesday of the month at 10 a.m. at the City of Bradenton Public Works building.

BRADENTON – The Anna Maria Island Bridge Aesthetics Committee held its first meeting on Wednesday, June 29. The meeting, however, wasn’t official because the panel failed to attract a quorum.

The group was formed by the Florida Department of Transportation (FDOT) to get public input into what the existing bridge’s replacement will look like.

One thing is certain – the new bridge won’t resemble the old one since it will be a fixed span instead of a drawbridge, and it will be about 75 feet high, nearly twice as high as the current bridge.

The aesthetics committee is

comprised of FDOT engineers and consultants, including managing project engineer Katie Sherrard, and representatives of the three Island cities, Bradenton, Manatee County, Keep Manatee Beautiful and Save Anna Maria. Anna Maria Public Works employee Dean Jones was present, but Bob Rosas, of Holmes Beach, and Bradenton Beach Mayor Bill Shearon were absent. Manatee County had not appointed a member. Keep Manatee Beautiful Executive Director Ingrid McClellan was present and Lee Holt, of the Manatee Sarasota Metropolitan Planning Agency attended.

Sherrard said the new bridge will be 75 feet tall, with a clearance of 65 feet and might be 100 to 150 feet longer. She said there would be two 12-foot-wide traffic lanes with two 10-foot-wide shoulders and two 10-foot-wide pedestrian lanes separated from the travel lanes by safety barriers. Sherrard said the first thing the committee should do is settle on a theme for the bridge. She listed three: a nautical rustic concept, a

beach getaway concept or an old Florida charm concept.

“Once we settle on a concept, we can get into more details,” she said.

The committee will make that decision at its meeting on July 22, assuming a quorum is present.

Meanwhile, Save Anna Maria representative Nancy Deal asked about the high bridge’s susceptibility to high winds from approaching storms and whether the authorities could put in a remote sensor to monitor the wind speed. At one point, an engineer pointed out that when the wind got that high, the Palma Sola Causeway would likely be flooded, halting evacuation over the bridge.

Sherrard said they would make decisions in the future about bridge design treatments, such as the type of footings, the landscaping and the hardscaping such as textures on the bridge sides, fencing for the pedestrian lanes, benches and lighting.

The group also will elect a chair, vice-chair and secretary.

Freedom and owning a home I

t’s summer, its hot, termites have discovered your deck, the palms need to be topped and your air conditioner is blowing out hot air. By now you’re wondering, "Why do I own a home?" Well, I’m here to tell you the benefits for both your lifestyle, your bank account and the freedom to enjoy the American dream, which we just celebrated.

Cultural thinkers have always told us that owning a home is associated with less crime, better health, better education and generally more of a social and neighborly population.

In addition owning your home has always been the best way to accumulate wealth for the average person, since even if your home doesn’t appreciate during the time you own it, which it historically does, paying down a mortgage is a forced savings.

Most everyone who has a home mortgage knows they can deduct the interest on that mortgage up to $1 million dollars for a joint filing and $500,000 for a single filing. This deduction is eligible for both first and second

Castles in the Sand Louise Bolger homes. But many homeowners don’t fully understand the capital gains laws as it relates to selling your home.

Capital gains regulations are very favorable for most homeowners and few wind up owing any capital gains with the exception of very high end properties in very high priced areas. Married couples filing jointly can exclude as much as $500,000 of the gain on the sale of their primary residence and singles can exclude up to $250,000. This exclusion is applicable on your primary residence, and you must have owned and used it for at least two of the five years before the sale date, but they do not have

to be consecutive. You could qualify for an exception to the two-year rule if it involves special circumstances related to your job or unforeseeable events. The other good news is that this is not a one- time exclusion. Homeowners will benefit from the capital gains regulation every time they sell their property as long as it meets the IRS’s criteria.

Another nice little benefit of owning a home happens right here in Florida. It’s called the Save Our Home Amendment and applies to full time homesteaded residents.

Homesteaded residents benefit from a $25,000 exemption of the assessed value of the property as well as a 3 percent maximum cap on any annual valuation increase of homesteaded properties. Basically, this means that your property taxes go up very little during the course of the time you own your home, regardless of how much your home has increased in value.

But there’s more; you also will benefit from something called portability, which translates

to the ability to transfer the Save Our Homes cap (the difference between your market value and the assessed value) from an existing homestead to a new homestead. There is a mathematical calculation for this, and you do need to complete a form to apply, all of which can be confusing, however, it is applicable each time you move. The portability provision came into effect in January of 2008 and really helps homeowners who want to sell and move up to more expensive homes while still retaining much of the benefit of the cap on property taxes they enjoyed on their previous home. This rule did help the real estate market since it encouraged homeowners to move on freeing up properties to be placed on the market and creating activity.

A few days ago we celebrated Independence Day. One of our basic freedoms is the freedom to live anywhere in the country, and home ownership may be the ultimate freedom of all. Happy belated Independence Day!

“The cities released their funding, and within a few short weeks, equipment was in place, memberships were sold to vacation properties at rates we could never compete with and their original plan was underway.

“Since then the fitness center has expanded, and The Center just finalized a deal for 200 plus vacation properties with AMI Accommodations.”

She pointed out that The Center is a 501c3 organization, is tax exempt and receives government funding. She said it is violating their 501c3 by profiting from the fitness center.

“Holmes Beach recently said no to franchise businesses that would essentially come in and destroy local businesses, so I must ask, ‘What is the difference?’” she said. “Why is it OK for our own community center to compete with local small businesses?

“I ask you to please stand behind us and defend our local owned and operated businesses in Holmes Beach. We all know that not only my own, but all of our small businesses are the heart and soul of Anna Maria, and they are the real community centers.”

Resident Nancy Deal said she supports Crady and said, “I met with The Center’s director last year and explained how the community felt about the situation and that Brenda (Brenda Canning of Island Fitness) and Jen felt threatened by what was perceived to be happening at the Center.

“She looked me in the eye and said that’s not going to happen, we are not going to expand the fitness center. Less than a month later, they did expand.

“A 501c3 cannot be in business for themselves. Are they are using the community center as marketing tool? Does that violate their non profit status?”

Resident Pam Leckie agreed with Deal and added, “I don’t think the city should be donating money to a business in competition with our businesses.”

Resident Mike Deal said he works out at the gym, with a member “who is also a part of the rental moguls on the Island,” as well as a Center board member, who said, ‘We’re going to do whatever we want as far as the fitness center at the community center and nobody can stop us.’ So I urge you to pull the money from them.”

Commissioner Jean Peelen pointed out, “We have a small division on the issue within our community. I understand that a number of young families whose kids go to

the programs at the Center and who love the idea of the fitness center because when their kids are in sports programs, they can work out and they have day care.

“What they don’t have is the history we have with The Center of exclusiveness, of secrecy, of hiding finances and telling so close to untruths when they were here last year that I don’t know what to call that. So I’m not taking a position, but it is a very distressing situation.”

Commissioner Carol Soustek said, “I understand they are struggling, so I think they are trying to stay afloat as best they can, but some of their choices might be questionable.”

In an e-mail to the mayor and commissioners, Kelly Smith, a member of The Center’s Parent Advisory Committee (PAC), said the PAC requested increased fitness facilities.

“Part of this reason is that there is no other gym on the Island that offers childcare or concurrent classes for our children while we work out. In order to get these services, many island families were leaving the Island and going to the local YMCA. “We were looking for a place in which our entire family can spend time together.

At the Center, we can work, play, learn and even grab a meal there or to take home. It definitely works to allow us to spend time together.”

She said the PAC’s goals include meeting the needs of current community members and offering services that will draw new members to the community.

“The PAC has worked with the Center administration to strengthen and build classes and fitness at the Center,” she said. “ It is a huge part of our lives as parents, and we want our children to learn healthy habits as well.

“Also, being busy parents means our time is limited, and if we can get a workout in while our children get a class as well it is a great way to maximize our family time. The Center has responded to our needs.”

She said the Center is trying to decrease the burden on families with its rental program to bring in funding from tourists.

“The Center is not a gym or fitness place.

Instead it is a place where friendships are formed, newcomers are welcomed to the community, families are supported, skills are taught, children laugh, play and learn and overall the community grows. This is what the local funding supports.

“It is not supporting some huge lifetime fitness center that is drowning out the little guy. I feel strongly that by opening up the Center to local tourists it may even give them a glimpse of how everyday life can be here. It will allow them to mix with locals, and can possibly act as an advertisement for Island life and draw in new residents.”

“We’re going to take it to the Swordfish Grill and Tiki Bar and make a stage for our stone crab festival. It’s going to be a nice stage, with barnacles and some cleats on it,” said Banyas, who also owns the Swordfish Grill.

When the city moves forward on removing the remaining section of floating dock and replacing it with a fixed dock, Banyas will also remove those sections of dock at no expense to the city. He said he might use some of the additional sections as a temporary floating dock during fishing tournaments.

“This is so appreciated,” Spooner said Wednesday morning when the work commenced.

During its June 16 meeting, the City Commission was asked to authorize an expenditure of up to $30,000 to pay Duncan Seawall, Dock and Boat Lift to remove the damaged section. Although the section of dock was still afloat and appeared to be in good condition, it was feared that it had become de-

The funding request stated it would cost an estimated $23,000 to remove the damaged section of dock as soon as possible and another $37,000 to remove the remaining and still useable

sections at a later date.

During that meeting, Police Chief and Pier Team facilitator Sam Speciale told the commission that Spooner had contacted an individual who offered to do the job for free, in exchange for being allowed to keep the sections of dock removed.

The commission unanimously agreed to utilize this cost-free approach if possible. A newspaper ad was published in order to make others aware of this opportunity, but Banyas was the only person to respond.

While attending the Planning and Zoning Board meeting last Wednesday afternoon, Mayor Bill Shearon was notified at the day dock had been reopened.

After the meeting, Speciale said, “I think it’s great that somebody from the community stepped up to help us out and save us a ton of money, and it’s great that Commissioner Spooner was able to make that happen in time for the July 4 holiday. This is what happens when commissioners and members of the community work together.”

In regard to replacing what remains of the floating dock, Speciale said he spoke to someone at the Florida Department of Environmental Protection and is in the process of scheduling prepermitting meeting in order to determine what the state agency needs from the city in order to move forward with the installation of a fixed day dock.
