nessperson of the Year was Chamber President Mary Ann Brockman for her 20 years of leadership. Chamber Board Chair Larry Rupp talked about how Brockman could do so much with so little, citing the fact that when he first visited her at her office, she had an old computer with a monitor “about the size of a postage stamp.”

Bridge reopens after repair Department of Transportation engineers are working on a plan to fix problems caused by a shift in bridge alignment.

LONGBOAT KEY – A shift in the alignment of the moveable bascule of the Longboat Pass Bridge put the drawbridge out of order on Friday, Oct. 24.

When workers arrived to solve the problem, they found a 1 1/2inch gap in the roadway had enlarged to four inches, locking the roadway in the down position. The bascule could not be raised for boats.

Workers placed temporary lock spans on the bridge, which got the bascule to operate again and the engineers are working on a permanent solution, according to Florida Department of Transportation spokesman Robin Stublen.

“We haven't finalized a design

to fix it permanently,” Stublen said last week.

As flaggers kept the automobile traffic to one lane, workers attached the lock spans to the bascule Wednesday, and when they were finished, automobiles were able to use both lanes of the bridge. After testing the bascule’s ability to raise and drop back into place, officials ended the work.

Stublen said engineers would now attack other problems from the shift, according to Stublen. A maintenance project was planned for the Longboat Pass Bridge this week, but plans may change when they complete an assessment of the bridge’s condition, according to Stublen.

Underneath the bridge, crews are drilling to insert a potable water line for Longboat Key. Officials have not commented on whether that project effected the bridge’s alignment.

High court to hear Yates appeal

Board approves Grassy Point resolution

Holmes Beach city commissioners approved a resolution to ask state legislators to approve a local bill allowing the city to annex submerged land adjacent to Grassy Point Preserve, the city’s 32-acre environmental preserve along Sarasota Bay. The annexation would give the city regulatory and enforcement authority over the environmentally sensitive waters surrounding the preserve. The area now is controlled by Manatee County.

“We have a beautiful little gem there between the uplands and the wetlands, but until we get protection for the submerged lands and mangroves, it’s not a complete preserve,” resident Carol Soustek told the board.

City Attorney Patricia Petruff and Commissioner Jean Peelen will make the presentation asking the Local Legislative Delegation to support a bill.

CORTEZ – An oral argument in the case of former commercial fisherman John Yates is scheduled to be heard by the U.S. Supreme Court on Wednesday, Nov. 5.

Yates was found guilty in 2011 of destroying evidence in a 2007 federal fisheries investigation based on trial testimony that three of 72 undersized grouper discovered by fisheries officers on his boat at sea were thrown overboard before Yates docked in Cortez.

One of the two charges Yates was convicted of is a violation of the antishredding provision of the SarbanesOxley Act, which makes it a crime to “knowingly alter, destroy, mutilate, conceal, cover up, falsify or make a false entry in any record, document or tangible object with the intent to impede or obstruct an investigation.”

Attorneys for Yates contend that the provision does not extend to the destruction of anything meeting the definition of “tangible object,” but is limited to the destruction of tangible objects related to recordkeeping.

City to seek TDC funding for Grassy Point Holmes Beach city commissioners agreed with a proposal by Commissioner Jean Peelen to seek funding from the Manatee County Tourist Development Council to build a boardwalk at Grassy Point.

According to the preserve’s management plan, the city is to provide trails, boardwalks, observation platforms, interpretive displays and a scenic overlook/fishing pier. However, it does not have the funds to make those improvements.

City approves ULI agreement On the advice of their attorney, Holmes Beach city commissioners took no action on an agreement between the three Island cities and the Urban Land Institute for a study regarding recommendations for future planning.

A question arose at a previous meeting when City Attorney Steve Dye, sitting in for Petruff, advised commissioners not to ratify the agreement because “it was not in proper legal form.”

“The check is sent; the signed agreement is sent,” City Attorney Patricia Petruff explained.

“You don’t need to take any other action.

“Mr. Dye said the language in the contract is less than stellar because each city could be liable for the entire cost of the contract, but Anna Maria already sent the $60,000 check.”

Another question the court may consider is whether the preclusion of a witness from testifying violated Yates’ due process rights.

Yates contended at trial that the fish were not properly measured.

In addition to his conviction on the charge of destroying evidence to impede or obstruct a federal investigation, he was convicted of

disposing of evidence to prevent seizure. He was not convicted of lying to a federal officer.

Yates, who is still on probation, is not required to attend the oral argument, but his wife, Sandy Yates, plans to attend, she said.

Crosswalk signs debated Some say the signs create a dangerous situation when drivers stop when no one is in the crosswalk.

HOLMES BEACH – After receiving complaints regarding the crosswalk signs in the middle of the city’s streets, city commissioners agreed to bring the issue to a work session.

Commissioner Jean Peelen said she is hearing more and more objections to the signs that say, “STOP for pedestrians.”

“The stop sign on there is confusing to people,” she said. “They think they have to stop (even if no one is in the crosswalk) and could possibly cause an accident.

Residents Barbara and Stephen Szabo felt differently and said in an e-mail to the commission that they were coming home from a dinner on Longboat Key and nearly had an accident.

“We were cruising home at 35 mph some 40 feet behind a truck when that truck slammed on his breaks because the guy in front of him stopped for one of these many new pedestrian stop signs before the Walgreen’s shopping center.

I had to slam on my brakes and nearly rear ended him by a mere one foot,” Szabo said.

He predicted that the signs would cause havoc with visitors and that the crosswalks that are “painted across the road with the yellow blinking light do the job.” see crosswalk, page 11

Discover Egmont Key this weekend

Come to Egmont Key State Park on Saturday, Nov. 8 and Sunday, Nov. 9 and "Discover the Island."

The event is the 17th annual fundraiser for the Egmont Key Alliance, a non-profit citizen support organization dedicated to protecting, restoring and preserving the key.

Egmont Key has been a prison for Seminole Indians and Confederate soldiers, a refuge for runaway slaves, a hideout for bootleggers during Prohibition and a wartime landing field. It’s now a harbor pilot base, a recreational boating destination and a bird, sea turtle and gopher tortoise refuge.

The first thing you’ll notice is the 156-year-old working lighthouse, built in 1858, which replaced one built in 1848 that was destroyed by storms.

The light, which once ran on whale oil and lard, is now electric.

Watch Civil War re-enactors set up camp, demonstrate drilling maneuvers and engage in skirmishes.

T

he Anna Maria Island Chamber of Commerce honored businesses at its installation banquet Monday night and three worthy establishments won awards.

Congratulations to businesses Irene's Resort Wear, the Feast restaurant and AMI Resortss and to Mary Ann Brockmen for being named Businessperson of the Year by the Island Rotary Club.

Irene's Resort Wear is a long-established business, The Feast is relatively new and AMI Resorts if a new company of resorts that has been around and were purchased and improved and/or expanded. They are all under the umbrella of the Chamber, as members.

Chamber Board Chair Larry Chatt spoke of being aware of the repercussions when more business is brought in to residential areas. His words were backed up by the response the Chamber had to complaints of noisy wedding receptions in residential neighborhoods. Many rental agents quit renting houses to wedding parties if the neighbors were going to be bothered. It was an example of how businesses could react when informed of a problem. It is also an example of why we need to keep the channels of communication open between businesses and residents.

Lose the pedestrian stop signs I am writing this email after a near rear end collision last Saturday evening, as my wife and I were coming home from dinner with friends in LBK. We were cruising home at 35 MPH some 40 feet behind a truck, when that truck slammed on his breaks, because the guy in front of him stopped for one of these many new pedestrian stop signs before the Walgreen's shopping center. I had to slam on my brakes and nearly rear ended him by a mere one foot. Luckily not.

I can envision it now when all the vacationers arrive, that these signs will cause a havoc to driving, as they already do, if not lots of accidents. I feel the few crosswalks that are painted across the road with the yellow blinking light do the job. And having to read all the upper signs while driving along Gulf Drive, Marina Drive and Gulf of Mexico Drive and then all the new crosswalk pedestrian stop signs that have an actual STOP sign on them, is dangerous. Plus it is a big expense for the resident tax payers.

My wife just got home from work at 3 p.m. and her store manager just told her he almost rear ended another driver who stopped for one of the crosswalk stop signs while driving his motorcycle and no pedestrian was there crossing the road.

I hope commissioners will reconsider this project and not re-install any new ones.

FYI: I totally believe paid parking is needed for all those using our Island and only Island residents should get a free sticker.

Rescue benefit a huge success Rummage for Rescues, a garage sale to benefit four local no kill animal rescues, held October 3-5, was a huge success bringing in a grand total of $3,063. The four rescues who each received a check for $765.75 are Moonracer No Kill Animal Rescue, Inc., Forget Me Not No Kill Animal Rescue, Gulf Shore Animal League and Animal Network, Inc. All of these rescues are instrumental in saving animals from Manatee County Animal Services, many times saving those who are scheduled to be euthanized due to lack of space or minor medical issues.

The event could not have happened without help from many people. Thanks to Pam at Hideaway Storage, located at Cortez and 32nd St., by Cox Chevrolet in Bradenton, for donating a storage unit for three months at no cost. Thanks to the public who were so generous with their donations. We had some great stuff. Thanks to the Jordans, who hosted the sale at their home. Thanks to all the volunteers: Ruth Uecker, Lynn Jones, Linda, Alecia Smith, Bobby Cooper, the Jordan's neighbors, Shelli and kids, Wayne and Guido from CrossPointe Fellowship, who helped set up, man the sale and break down. Thanks to Scott Walraven, who trucked all around Bradenton and Sarasota collecting the donations. We had adoptable dogs and cats at the sale and we even got a few people to sign up to be dog walkers and cat cuddlers at the shelter.

Reconsider tower location The city of Anna Maria is finally going to get some strong cell signal coverage.

It has been a long time coming and not many will argue with the need for good cell service. The plans have been in motion for many months and are almost finalized, the actual 164-foot tower and supporting structure are designed and placement has been adopted by the city commission.

It is the placement of the structure which should be carefully considered. It was originally to be located in the center of the Anna Maria City Hall Park, but has since been moved to the southeast corner of the site. This doesnâ&#x20AC;&#x2122;t mean much when written, but it will actually be very close to Spring Avenue at the entrance of the city parking lot, on full view to most all of the visitors to the city and beaches. As there is no commercial buffer, it will be almost surrounded by residential houses along Spring Avenue. design and, you might agree when standing under it, that it is a huge metallic monstrosity. It will be grossly out of scale with the surrounding homes and does not conform with our low key ambience of Anna Maria. There is mention of covering our platform structure with a colorful scrim painted with trees, but this will not reduce its imposing scale.

The commission needs to reconsider and relocate the tower structure to a more central location at City Hall Park, screened by real trees and hidden from the roadways, or find a more appropriate location in the city.

Cortez Stone Crab Festival this weekend

CORTEZ – Stone crab is at the top of the menu at the Third Annual Cortez Stone Crab Festival on Saturday and Sunday, Nov. 8 and 9, from 10 a.m. to 9 p.m. on Sarasota Bay at the end of 119th Street West.

The free festival will feature music by the Bobby G Band, Razing Cane, Karen and the Big Bad Wolves, Doug Deming, Reid Frost, Brandi and the Ride, Eric von Hahmann and Ted Stevens and the Doo-Shots.

Besides stone crabs fresh from the Cortez docks, the menu includes Cortez hot dogs (mullet dogs), pizza, shrimp and grits, and other fresh-from-Florida seafood, with freshly-made pina coladas with the coconuts opened by machete while you wait. You can also browse the work of local artists, and there are pony

rides for the kids.

The festival is a fundraising effort by the Swordfish Grill, the Flippin’ Mullet Sports Bar, Cortez Bait and Seafood, N.E. Taylor Boatworks and the Cortez Kitchen for Fishing for Freedom, which supports a pending appeal to the Florida Supreme Court to reverse the 1995 state constitutional amendment banning gill nets.

The state’s highest court is not under any obligation to take the case, according to lawyers for the plaintiffs, The Wakulla Commercial Fishermen’s Association, Panacea bait shop owner Ronald Fred Crum and mullet fishermen Jonas Porter and Keith Ward, who sued the Florida Fish and Wildlife Conservation Commission in 2012, arguing that its enforcement of the net ban actually creates the unintended bycatch that the ban was designed to prevent.

Fishing for Freedom members plan to display fishing nets at the festival with models of different sized fish, including adult and juvenile mullet, to demonstrate how the banned gill nets target legal size mullet and let juvenile fish escape.

During its various appeals, the case has resulted in the net ban being temporarily lifted twice. In the most recent decision, the First District Court of Appeal reversed the decision lifting the net ban, putting the ban back in place, and prompting the appeal to the Florida Supreme Court.

The ban was approved by Florida voters in 1994 to preserve fish populations and prevent the accidental entrapment of unintended marine life. The ban became effective in 1995, putting commercial fishermen out of work in Cortez and statewide.

“My wife just got home from work at 3 p.m. and her store manager just told her he almost rear ended another driver who stopped for one of the crosswalk stop signs while driving his motorcycle, and no pedestrian was there crossing the road,” Szabo said.

He asked commissioners to reconsider the project and not install any new signs.

In a yes or no question at the Sun’s candidate’s forum, candidates were asked whether they thought the crosswalk signs should be taken out.

Marvin Grossman said yes and no, Judy Titsworth said yes, Andy Sheridan said not in mass, David Zaccagnino said they need to be looked at because they are a safety hazard and Bob Johnson said yes as long as the roads stay the way they are.

Board accepts director’s resignation Island Community Center Executive Director Dawn Stiles’ resignation will be effective on Nov. 14.

ANNA MARIA – The Island Community Center board of directors met in special session on Monday, Oct. 27, to accept the resignation of Executive Director Dawn Stiles.

“We appreciate Dawn’s service to the community, especially given the time and distance it took her from her family. “ Board Chair Scott Rudacille said. “While we regret her decision, we

certainly understand and accept it.”

According to a press release, Stiles told the board, “My original plan was to move here with my family. However, events intervened and my husband’s career required him to remain behind.

Frankly, I would have made this decision sooner, but I felt obliged to remain until things could stabilize here at the Center.

“The last several months have been both challenging and exciting, as the board has been significantly strengthened with capable new members. They are carefully examining all aspects of Center operations in order to increase revenues and reduce costs while making full use of the facilities in order to be responsive to a much broader commu-

nity base.

“They have brought many fresh ideas to the conversation. This, along with a revised and dedicated staff, has given me comfort that the Center is in good hands. I am very grateful to the board for it’s understanding that family comes first, and I look forward to their future progress.”

Rudacille said the board is meeting in special session again on Wednesday, Nov. 5, to discuss how to proceed.

“We are looking at options for an interim director,” he said. “We will begin a search for a new director, and I expect it to move much more quickly that the last search. We have a lot of work to do.”

Proposed parking approved by panel

BRADENTON BEACH – Monday morning, the Planning and Zoning Board unanimously recommended approval of a major development review and a special exception request that clears the way for an additional 34 parking spaces for the soon-to-be-opened Wicked Taco Cantina.

The restaurant owners, Mike and Janice Dolan, presented the

requests on behalf of property owner Clyde Ingram.

The additional parking spaces will bring the total number of spaces to 72, and allow for enough restaurant seating to comply with state liquor license requirements.

The additional sand parking lot will be located north of the existing paved lot on Seventh Street North that also serves a laundromat, a dive shop, Castaway’s tavern and the Green Turtle Shell & Gift Shop.

If granted final approval by the city commission, the proposed parking area would be built where a vacant house currently stands, just north of the existing lot.

Because the property sits lower than the crown of the road, planning board member John Metz expressed concerns that the parking area might be prone to flooding.

BRADENTON BEACH – The roof atop the city-owned restaurant space that currently houses the Cast-n-Cage restaurant is leaking and needs repair.

As the business owner’s landlord, the city is responsible for the repairs.

When contacted by Public Works Director Tom Woodard, Sutter Roofing repair manager Andrew Tuinstra estimated it would cost $3,993 to repair the junctures where 16 wooden support posts meet the metal roof Sutter installed in 2007.

Woodard’s initial inquiry pertained to the roof’s 20-year warranty, and whether the warranty would alleviate the need for the city to make an unbudgeted repair expenditure.

“The problem is not the material itself, which is functioning and holding up quite well,’ Tuinstra stated in a recent e-mail to Woodard.

“The problem is the supports should have been made of treated steel, because they don’t shrink or hold water.

The current (wooden) supports will continue to shrink and hold water. Simply put, we are going wrap the posts and properly flash them, so that you don’t have a problem moving forward. This

However, that’s what was called for and they (the posts) were in when we got there. No one wanted to absorb the expense of changing them, so we came up with the flashing detail that

is present. However, like Andrew said, it’s wood and eventually the caulk and flashing will break lose, which is what happened. Suffice to say, this may be something that should be checked every year or so,” Sutter wrote.

The Sutter estimate revealed a situation less dire than originally suspected. When the roof repairs were first discussed at a previous Pier Team meeting, there was cause for concern that the entire roof would have to be removed and replaced.

During last week’s Pier Team meeting, Jeffery “Rusty” Roberts, manager of the currently shuttered Rusty Anchor bait shop, requested an additional $165 in temporary rent abatement. This is on top of the $1,135 temporary rent reduction the city commission granted Roland Pena and his business associates in September.

The requested figure represents the monthly rent adjustment the city currently makes in order to account for a shared electrical panel that also powers the pier lighting, which is a city expense.

Because the pier lighting is not in full use during the pier reconstruction, it was suggested that the abatement be limited to the city’s actual share of the monthly power bill, rather than the proposed $165 flat rate. The request must be approved by the city commission, and is scheduled for discussion at Thursday’s commission meeting.

ost investors have a distinct choice in their retirement plan savings efforts. Selecting the correct choice can yield a larger after tax income in retirement. However, making the choice can be complicated by our inability to know what future tax rates may be, or what level of income we’ll have in retirement.

The choice resides between two philosophies. The traditional plans, like IRAs and 401Ks allow the participant to make contributions to the plan and receive a tax deduction for the portion of their earned income they contribute each year. There may be limitations on deductibility of traditional IRA contributions depending on level of income and simultaneous participation in an employer sponsored retirement plan.

These traditional plans are of the pay later variety, meaning that you enjoy the up-front tax deduction for contributing, tax deferred growth of the assets in the plan during your accumulation phase, but distributions out of the plan during your retirement phase are taxed as ordinary income.

Investment Corner TOM BREITER The pay now plans are the Roth variety of IRAs and 401Ks. With these plans there is no tax deduction for making annual contributions, so you are taxed on the income as you earn it, even though it ends up in a retirement vehicle. But, the assets in the plan continue to grow tax-free during your accumulation phase, and there is no tax on distributions from the plan in your retirement phase. Nor are you ever required to take required minimum distributions from a Roth plan when you reach 70 1/2. You can leave the entire Roth to your heirs if it turns out you don’t need to use the account for income.

High income earners should also be aware that your ability to contribute to a Roth IRA may be lost if your income is too high. In 2014, contribu-

tions begin to be limited for adjusted gross income greater than $181,000 for a married couple ($114,000 for individuals), and is completely lost at $191,000 for joint filers ($129,000 for individuals). These limits are adjusted for inflation every few years.

So how do you make the choice of which type of plan to contribute to? As stated earlier, there is not an exact formula that can be applied with certainty because we can’t be sure what the income tax rates will be 10, 20 or 30 years from now. We also don’t know for sure what our level of income will be after retirement.

But we can make some judgment calls. With the nation’s debt burden, I think it is a fair assessment that tax rates have a better chance to be higher down the road than to be lower. In this scenario the Roth plans would have an advantage because the cost of the taxes now may be lower than the cost in the future. In addition, since distributions from Roth plans never find their way to your tax return in retirement years, the

income derived from your Roth won’t have an impact on the possible taxation of your Social Security Income.

The traditional plans which offer the immediate tax break should be your choice if you don’t believe tax rates will be significantly higher in the future or if your level of retirement income will be modest enough to keep you out of the higher tax brackets.

There are calculators which can help with this decision, allowing you to provide data on your personal situation and make assumptions on current and future tax rates. HOLMES BEACH – A 70-year-old man who was working on a display at a local art gallery died Sunday afternoon, apparently while getting

something out of the back seat of his car.

Two men observed Donald D. Pulver, of Bradenton, lying in the back seat of his BMW, and he was not responsive. Michael Pulver Cappello and Robert Phillips conducted CPR on Pulver until the EMS ambulance arrived. EMTs continued to work on Pulver until it was

apparent he was not going to respond.

A Holmes Beach police officer called the victim’s son, who said his father had serious cardiac problems.

The family had pre-arranged funeral arrangements with the Good Earth Crematory. The victim’s doctor was called, and he agreed to sign the death certificate because of his patient’s heart problems.

It took awhile to remove the artist’s

body from the parking lot, as police called the medical examiner’s office and were told it would not respond.

Good Earth Crematory then said it would come.

The gallery, Island Gallery West, had planned to hold a reception for Pulver on Friday, Nov. 7, from 5 to 8 p.m. Spokeswoman Brenda Alcorn said the reception would continue as planned in his honor.

Castles in the sand The America Recycles Day at Sandblast is held in conjunction with Symphony on the Sand, both events at Coquina Beach.

It’s that time when the sand on the beach takes on new artistic forms with blueprints only in the minds of those who mold it.

America Recycles Day at SandBlast 2014, on Saturday, Nov. 8, is a sand sculpture competition that has an open division for adults and a school division that pairs youth groups with local business sponsors. They raise funds to support Keep Manatee Beautiful’s programs.

SandBlast celebrates America Recycles Day, the only nationally recognized day (officially on Nov. 15) dedicated to encouraging

Americans to recycle and to buy recycled products This year’s event sponsor is the Bradenton Area Convention and Visitors Bureau. The Anna Maria Island Beach Café is the event host at its beachfront on Coquina Public Beach. Team Sandtastic, a professional sand sculpture team will start three days before the event by building an 80-ton exhibition sculpture at the Coquina Public Beach.

Teams and the public are invited to the free clinics put on there by Team Sandtastic on Nov. 6 and 7 from 5 to 6 p.m. to learn the tips, tricks and techniques of sand sculpting.

On Nov. 8, teams will begin arriving at 8 a.m. at the Coquina Public Beach to get first pick of the 15-by15 foot plots. Sculpting commences at 9 a.m. and continues until 1 p.m. Master sculptors with Team Sandtastic will judge the sculptures of each theme from 1 to 2 p.m. The sand sculptures will stay in place

for the public to view until Dec. 1.

Carmel Monti to task for a letter he sent to voters claiming, “I and all the commissioners endorse Bob Johnson … ” “I never endorsed Bob Johnson,” protested Zaccagnino at last week’s city commission work session. Zaccagnino is running against Johnson for the mayor’s seat.

Zaccagnino stressed, “It’s pretty disturbing that he gives the impression that the city is backing my opponent.

He’s putting the city in a libelous situation, which he’s done time and time again for the past two years,” He said the letter carried the city’s return address and said Carmel Monti and friends paid for it. He said if a group is involved, it has to be a PAC (political action committee).

HOLMES BEACH – City commissioners told Island Congestion Committee Chair Carol Soustek to work with Commissioner Marvin Grossman, the police chief and the building official on putting up signs in areas they’ve identified for additional parking.

Commissioner Jean Peelen asked if the purpose is to add parking and if so why.

“What I’m hoping it will do is

pull some parking from residential areas because they are not marked,” Soustek responded. “Sometimes they are not used because people are not sure they can park there, and they are scared they’ll get towed.”

“We’re not adding parking; we’re just designating where people are already parking,” Commissioner David Zaccagnino said.

Grossman said he designed a parking sign with a sea turtle “to make them more attractive.”

Foreclosure report

Code Enforcement Officer David Forbes reported that it is difficult to keep track of the foreclosed properties in the city because “there’s so much

flip flopping between lenders, trustees, property managers.”

Having regulations requiring foreclosed properties to be registered “is something that could be beneficial to every aspect of the city – emergency services, building department,” he said.

He said he has copies of the Manatee County and city of Palmetto ordinances to study, as well as note he has taken. City Attorney Patricia Petruff advised him also to look at the city of Coral Gables ordinance.

Commissioners asked Forbes to work with Human Resources Analyst Mary Buonagura and Petruff on developing foreclosure regulations for the city.

November is Manatee Awareness Month

ow much do you really know about manatees?

Sure, they’re cute, and Manatee County is named after them.

But did you know that the marine mammals are smart?

Snooty at the Parker Aquarium in Bradenton, the oldest living manatee in captivity at age 66, hoists himself up on the side of his pool on command for veterinary visits.

Buffett and Hugh at Mote Marine in Sarasota perform tasks on command that allow staff to weigh them. Hugh weighs a mere 1,199 pounds while Buffett tips the scales at 1,855 pounds.

They also push paddles to “predict” Super Bowl winners, a behavior used in research on how they perceive boat engine sounds.

Did you know that manatees are related to elephants?

That fishermen back in the day used

to think they were mermaids?

That they’re vegetarians?

That they have their own state proclamation signed by the governor declaring that November is Manatee Awareness Month? “The manatee is a distinctive, valuable, and beloved natural resource. Cooperation among Florida’s public, private, and governmental organizations is vital to saving manatees, and organizations and individuals must continue working together for the long-term survival of the manatee.”

Did you know that manatees – not dolphins – are the state’s official marine mammal?

That they’re defenseless against cold, red tide, watercraft and disruptions to their habitat?

That they’re endangered?

On two days in January this year, researchers counted 4,824 manatees in Florida waters.

Last year, 830 manatees died in Florida waters, seven of those in Manatee County, many from boat strikes. That’s 17 percent of the state’s known manatee population.

So far this year, another 315 have died.

November is a critical time for manatees because that’s when they start returning to warm-water winter refuges

Here are some tips to make sure that manatees stay safe, for their own sake, and so that the next generation of humans can be charmed and fascinated by them.

• Wear polarized sunglasses on the water to better see manatees in your path.

• Follow posted signs for slow-speed manatee protection zones.

• Keep your distance from manatees – never feed, chase, touch or harass them.

•Stow trash and fishing line when under way. Marine debris that accidentally blows overboard can become ingested by or entangled around manatees.

• If you observe a manatee mating herd - several manatees gathered as males vie to mate with a female - watch from at least 100 feet away. Coming any closer might disrupt the animals' natural mating behavior or put people into harm's way.

Moose expands renovation plans The expanded renovation plans now include the construction of a new bar.

BRADENTON BEACH – The renovations to the Anna Maria Island Moose Lodge took an unexpected turn recently, when it was determined that structural decay necessitated the demolition of the bar area at the south end of the lodge.

When the dust settles, members will be rewarded with a brand new 38-seat horseshoe-shaped bar that will further enhance the lodge’s spectacular waterfront view.

“From one side, you’ll be able to look out and see the Gulf,” Lodge Administrator Ernie Casali said.

The change in plans pushes the estimated completion date to May 1, but the main dining room and Gulf side patio remain operational.

“We’re open and we’re not going to skip a beat. The menu’s still the same and nothing’s changed; we’re just short a little space,” said Casali.

Because the work in progress reduces an already limited number of Moose parking spaces, Casali encourages patrons to leave

“There’s no parking at all. Take the trolley,” he advised.

Casali said the unexpected turn of events means the original $350,000 projected renovation costs will increase to between $500,000 and $600,000.

He estimated the fallen wooden structure

to be approximately 50 years old, and he attributed its decay to piecemeal construction and constant exposure to salt air.

“We could’ve repaired it, but everything was rotting out, so we ripped it down and are going to replace it all at once,” Casali said.

The new ground level structure will be

built of cinder blocks and precast planks, making it much more durable.

When asked how the renovations are funded, Casali explained that each Moose lodge is an individual not-for profit 501(c) 8 corporation, supervised by the national organization, but fully responsible for its own costs and expenses.

Located at 110 Gulf Dr. S. in Bradenton Beach, Moose Lodge #2188 is among the most popular in the country. The Bradenton Beach/Anna Maria Island Women of the Moose Chapter 1601 is the organization’s largest women’s chapter. The lodge’s total membership ranks second only to Lodge #1533 in Indian Lake, Ohio, and those bragging rights might be up for grabs soon.

“We will be the largest lodge within less than a year,” Casali predicted.

“How many new members do you think we’re going to get when they can sit out there in the new bar and eat a lobster roll for $11.95,” he boasted.

As for the trademark moose that proudly stood above the lodge entrance, Casali said, “The moose is in storage, but he’ll be back.”

He also said the exterior mural would likely be restored.

As the weather cools and daylight gets shorter, it’s time for the second annual Community BBQ Honoring Veterans at CrossPointe Fellowship, 8605 Gulf Drive

in Holmes Beach, on Saturday, Nov. 15, from 10:30 a.m. to 1:30 p.m. Veterans will be honored at 11 a.m.

This year’s event features some of America’s bravest warriors.

Army Staff Sgt. Juan Roldan is a double amputee who was injured in an explosion while on patrol in Sadr City, Iraq, a place described by him as “hell in earth.”

Army Staff Sgt. Joe Beimfohr lost both of his legs from an improvised explosive device explosion near Baqubah, Iraq, while making his way toward a suspected enemy observa-

tion position.

Also present will be Rick Hamme, a seasoned counselor to combat veterans after serving more than 30 years in the Marine Corps and Navy. He is currently training enlistees. Capt. Joe Ludwikowski is a 26-year Navy veteran who served in the Pentagon and is now helping combat veterans with post traumatic stress.

Local DJ and musician Mike Sales will emcee and Emily Brier and Band will provide the music. The menu includes barbecued pork and chicken

plus hot dogs and all the fixin’s. Those attending may bring a side dish or dessert to share. There is no charge to eat.

There will be bounce houses, games and rides for the kids, and adults will have a chance to play a popular local edition of Jeopardy .

It’s all about the men and women who put on a uniform and take a vow to protect our country, and it’s a good way to meet people, whether you live on the Island or are just visiting.

the city’s consent.

Having met the restaurant owners, Imperial House resident Barbara Hug offered support for their request, in part because they promised they would not use the area behind the restaurant to wash off their

equipment, which was a concern with the previous restaurant operators.

Janice Dolan said they plan to open the Austin-inspired, Tex-Mex style restaurant in early December.

Tripletail – a unique species

T

ripletail are a unique species of fish that make a strong appearance in local waters after traps are placed in the Gulf during stone crab season. Tripletail like all kinds of structure – floating debris, channel markers, and swim buoys, but most anglers target crab trap floats this time of the year because they are so prevalent.

This curious fish has the general shape of a fresh water crappie and the coloration of a smallmouth bass. The name tripletail comes from their large anal and dorsal fins.

They are most often found floating on their side very close to a float or other structure. Tripletail are ambush feeders and prey on the small baitfish and crustaceans that are attracted to the algae that grows on the structure they gravitate to.

Most anglers look for tripletail while fishing for other species, keeping an eye out for them near crab trap floats in the Gulf. The best tactic once a fish has been spotted is to make a wide circle back to the marker, giving the fish time to

Reel Time RUSTY CHINNIS settle down. A trolling motor is helpful to make an approach, but isn’t critical. A drift past the marker at a comfortable casting distance works just fine, but make sure you avoid drifting into the marker.

The weaker tides seem to be better for working crab trap lines, but I’ve seem tripletail on floats in a strong moving tide. Wind in and of itself doesn’t seem to bother tripletail as much as it complicates the approach and your presentation.

It’s best to work the trap or structure from the downwind side to avoid blowing into the fishes’ comfort zone. It’s harder to cast into the wind, but this tactic is usually much more effective.

Tripletail are one of the only species that will respond to a fly or lure fished in their direction.

In fact that’s the most productive tactic. Since they are usually tight to

structure, it’s important to use a lure or fly with a weed guard to prevent a hook up on the structure.

Tripletail rely on deception, mimicking a piece of moss that you’ll often find hanging from crab trap lines. Look for tripletail with its nose right on the structure and notice how its body shape and color closely matches the mosses.

try again because tripletail are not shy about hitting a fly or lure multiple times. It’s also possible to return to a trap after a foiled hook up and fool them a second time.

While most of the tripletail run from four to 10 pounds, it’s possible to hook fish 15 pounds or larger. Since you’re looking for them around structure, you may need to apply a bit of muscle to separate them from their haunts. A fast nineweight fly rod or a 10-pound spinning outfit will usually suffice for fish you’ll find in the Gulf, but downsizing to an eight-weight fly rod or eightpound spinning tackle will make the hunt more sporting and fun.

Flies or lures for tripletail should resemble a baitfish, crab or shrimp, track well, and look alive.

Clouser minnows and bend back flies are good choices. A DOA shrimp fly can fool even the most stubborn tripletail. Weed guards are a good idea when possible so you can cast right on top of the markers and trap lines where the fish hang out.

Lures like the DOA Shrimp and jigs are also very effective.

When the season ends May th and the traps are pulled, many anglers stop looking for tripletail, but this actually concentrates fish around the remaining crab traps, buoys, markers in the bay and abandoned ghost traps.

Tripletail can be a challenging fish, sometimes easy to find and often hard to locate. The best action seems to be off the beach in 30 plus feet of water, but tripletail will venture closer inshore and are even found in the bay. The next time you’re out, keep an eye out for this unusual and feisty gamefish.

Fishing this past week out of Island Discount Tackle at Keyes Marina on Anna Maria Island has been excellent and very productive. Fall season is in full swing and a multitude of fish species are coming to the dinner party.

The near shore waters of Anna Maria have been on fire with kingfish, Spanish mackerel, sharks and other pelagics moving through our waters as they make the run south. The key to success has been to have a live well full of shiners and chum the passing schools of fish to the back of your boat.

Sharks have also been active off the beach. Using a whole Spanish mackerel rigged on a wire leader has produced black tip sharks to 5 feet. After a leader touch, the sharks were freed to fight another day .

Inshore fishing has been steady with the snook, speckled trout, and redfish on the bite. The key to success has been to be at your spot when the current is moving and having a live well of frisky shiners to chum and get the bite going.

This week’s low tide during the day moved the fish out to the mangroves and to the outside edges of the flats.

A tip to entice the bite to fire up is to use a mixture of live and dead baits in your live well as chum. Throw the shiners right into your fishing spot and wait for the reds and other predators to move in.

Looking forward, the bite will continue to produce as we near the next full moon. Redfish will start to gather in big

Anglers fishing with me on my Action Craft flats skiff the Snook Fin-Addict, out of CB's Saltwater Outfitters on Siesta Key, had good action catching and releasing Spanish mackerel, tripletail, flounder, snook, reds and trout on flies, CAL jigs with shad tails and DOA Deadly Combos in Sarasota Bay and the coastal Gulf waters during the past week.

from Olympia, Wash., were the successful bidders on a trip I donated to the International Federation of Fly Fishers.

They fished the coastal Gulf with me on Thursday and had good action with tripletail, getting numerous shots at them and catching releasing two.

Outdoor writer, Jan Maizler and photographer, Allen Williams, both from the Miami/Ft. Lauderdale area, fished with me on Friday and Saturday. I poled a shallow flat in Sarasota Bay on Friday, and they caught and released several snook on CAL jigs with shad tails and top water plugs. We also drifted a deep grass flat and caught and released trout, flounder and bluefish on DOA Deadly Combos and CAL jigs with shad tails.

We fished oyster bars, mangrove shorelines and docks in Little Sarasota Bay and caught and released several Jacks, a couple of snook and a nice flounder on CAL jigs with shad tails.

Tripletail, Spanish mackerel and false albacore in the coastal Gulf should be one of the best options now depending on conditions. Look for bait schools, diving birds or breaking fish to find albies and mackerel. Trout, blues, Spanish mackerel, flounder and more should be good options on deep grass flats of Sarasota Bay. Snook fishing should be good around lighted docks and bridges in the ICW at night or on shallow flats of Sarasota Bay. You might find reds and trout along with snook on lighted docks this time of year. Also, look for reds on shallow flats mixed with mullet schools.

Privateers ride to the rescue The Anna Maria Island Privateers held off challenges from several other "crewes" who were searching for treasure last Saturday. 10/23, 10:07 a.m., driving with a suspended license, 6000 Marina Drive. The officer ran a computer check on the vehicle and driver and found the driver had a suspended license with a seize order to take his tag. He was ticketed and his car was towed.

10/23, 10:49 a.m., burglary, 500 block of 68th Street. The homeowner said a burglar got into her garage, then used a crowbar to damage the doorframe and enter the living area. Fifty dollars in change is missing, and the burglar apparently put all the alcohol into one box, but did not take it.

10/27, 12:40 p.m., burglary to a structure, 4000 block of Fifth Avenue. Police found a homeless man who had entered an unoccupied home from the back and lived there, using electricity and the telephone. He was arrested.

Ed Chiles has been encouraging restaurateurs in Manatee and Sarasota counties to serve locally raised food to help foster a sense of community, and on Thursday, Nov. 13, his Sandbar restaurant will host its second garden tour and tasting event from 10:30 a.m. to 1:30 p.m.

The Pine Avenue Edible Garden Tour and Sandbar tasting lunch will begin with a walking tour of the community gardens located on Pine Avenue, dubbed by its developers as the “Greenest Little Main Street” in America. The hour-long tour will be led by native plant expert Mike Miller, who will educate those touring about the gardens and encourage onsite tastings of produce contained in them.

After the tour, the group will move to the Sandbar restaurant, where Chiles will be serving a multiple-course tasting lunch, which will showcase produce picked from the Pine Avenue gardens and company-owned Gamble Creek Farm, as well as fresh seafood from local waters.

Who the heck is Bert Harris?

here is a new name that many of us have only just started hearing about within the past year, but he has made a big impression leaving everyone to ask, “Who the heck is Bert Harris?” I thought it was high time to find out who and what Bert Harris is and how it affects property owners.

First of all, although surely Bert Harris is or was a real person, what everyone is really referring to is the Bert J. Harris, Jr. Private Property Rights Protection Act of 1995. The Bert Harris Act was presumably created to restore balance to the regulatory process by providing citizens with a mechanism for seeing compensation when government regulations or policy actions inordinately burdened their property rights.

As stated within the wording of the act, “The term inordinate burden means that an action of one or more governmental entities has directly restricted or limited the use of real

Castles in the Sand Louise Bolger property such that the property owner is permanently unable to attain the reasonable, investment-backed expectation for the existing use of the real property or a vested right to a specific use of the real property with respect to the real property as a whole, or that the property owner is left with existing or vested uses that are unreasonable.”

When the act was drafted in 1995 the strongest critics of it were primarily city and county governments that frequently, in passing regulations, impacted the freedom of the use of private property and property values without compensation. We are now seeing the

Bert Harris Act being used to sue local governments on Anna Maria and in Manatee County.

On Anna Maria, homeowners and developers are suing over use of their private property specifically as it relates to the Island cities attempting to restrict usage so as not to be attractive as rental property. The city of Anna Maria has a moratorium on permits for homes with more than three bedrooms or rooms that could be used as bedrooms currently in place while it weighs its options.

Manatee County is also doing battle with the developers of Long Bar Pointe, who claim their riparian rights were taken away when the county denied creation of a channel to access their land.

Medallion Homes, the developer of Long Bar Pointe, says it is being restricted from building waterfront retail, a hotel and a marina by the county by not giving it a permit for a channel to access

these potential facilities. The attorneys for Medallion Homes state that if the use of the bayfront is not restored, their clients should be paid by the county for the full value of that loss.

The growing popularity of Anna Maria Island and the coastal regions of Manatee County have placed both residents and local government in the position of having to face the downside of development. How do you protect the rights of property owners while at the same time protect the lifestyle of individuals and maintain an ecological balance?

No matter what the outcome and no matter how much money is spent on attorneys to litigate the issues, you will never make everyone happy. Living in such a beautiful place is both a blessing and a curse, and, unfortunately, those of us who go back as little as 10 years have seen changes we never dreamed of. At least now we know who Bert Harris is and why we keep reading about him.

Turtle season ends Sea turtles are the pot of gold at the end of the rainbow on Anna Maria Island. The 2014 nesting season that ended on Oct. 31 was the third best ever – the record was set in 2013, with 369 nests and 23,234 hatchlings. This season also exceeded the 15-year average of 178 nests and 9,607 hatchlings.

Millers pies coming to Bridge Street

The mother and son tandem of Megan and Shawn Miller are the new owners of the Back Alley in Bradenton Beach. The new owners intend to keep the business name, while bringing to Bridge Street those “famous Miller’s pies” sold at Miller’s Dutch Kitchen in Bradenton for the past 34 years. Shawn will manage the coffee shop, and Megan will manage the gift shop. The Millers say the Back Alley will continue to support local artists and will feature live entertainment on weekends.

Former owners Carol and Ronnie Clifford said they sold the Back Alley so they can spend more time at their Restless Natives business in Holmes Beach, where business continues to grow at a fast pace.

Jessie’s comes back to remain undefeated

As regular season for the Anna Maria Island Community Center adult co-ed soccer league winds to a close the dominant teams stand out.

Jessie’s Island Store, led by Captain Jeff Christianson, remains undefeated despite a very strong effort last week by Island Pest Control in a 4-3 loss.

The first half of the game saw one goal scored on Troy Shonk, goalie and captain of Island Pest Control.

Before the fifth minute of play, Brent Laudicina scored the first goal for Island Pest, with an assist by Teddy Louloudes, tying the score at 1-1.

Louloudes scored the second goal for Island Pest with a penalty shot against Shonk less than one minute into the second half. Donald Christianson answered that goal shortly

after the fifth minute of the second half. Laudicina responded with a score a minute later, but that would be the last one of the evening for Island Pest.

Dominance of the pitch by Matt Kretzman tied up the game 3-3 with less than 10 minutes of regulation play. Kretzman scored with a header and scored the third goal for Jessie’s with a solid penalty kick.

The fourth, and winning goal, was scored by Holly Belton.

Noteworthy assists by Jeff Gonzalez and Donald Christianson, along with nine saves by goalie K.B. Belton, brought Jessie’s Island Store one game closer to an undefeated season. Goalie Shonk had 12 saves in the tough loss.

With two games left in the regular season, Jessie’s Island Store faces Eason Builders on Thursday night.

Shootouts at AMICC: Youth Soccer Playoffs Begin

Each season, as the coaches draft their teams for youth soccer at the Anna Maria Island Community Center, the goal is parity in the league and fun on the field. This season was no different. The first week of youth soccer playoffs once again showed that any in given game, any team could win, as two of the three games on Wednesday night ended in a shootout. The championship games are on November 10.

Division III (8-to 10-year olds) – Feature Youth Game of the Week

Jeremiah Sculco led off the scoring for the game in the first half for Gulf Bay Realty, but the team was held to just one goal against the solid skills of Josie Alderson and a tough defense by Emma Laade and Reese Riley for Tyler ’s Ice Cream.

Cailyn Connor scored her first goal of the season for Tyler ’s in the second half off an incredible corner kick by Ava Alderson.

Adding to the offensive front for Tyler ’s were Lance Valadie, Travis Bates, Marley Smith and Sam Waterman, who skillfully moved the ball down the field. Tyler ’s offense faced the fierce goalie skills of Cody Vadas. Gulf Bay made its offensive threats with solid play by Evan Talucci, Elek Brisson, Mikey Coleman, Jessie Vadas and Anthony Nguyen.

After 46 minutes of regulation play, the shootout ensued with Sculco leading off for Gulf Bay and Waterman shooting first for Tyler ’s.

The miss by Sculco put Tyler ’s up by one goal. The shootout was soon tied up with Nguyen’s goal and Connor ’s miss. Gulf Bay added a goal by Coleman and Tyler ’s sewed up the game with two successful shots by Laade and Bates.

Number one seed AMI Donuts will face Tyler ’s Ice Cream and the second- and third- seeded teams, Bowes Imaging Center and Miller Electric, will meet in the second round of the playoffs.

Division II (11-to 13-year olds)

Jen Crady Massage, which finished in second place for regular season play, faced Sugar Beach Digital in the first playoff game for

Division II. A second half comeback by Sugar Beach resulted in a 4-4 tie, pushing the playoff game into the second shootout of the night. Tyler Brewer scored all four goals for Sugar Beach and Alex Rodriguez pounded the goal with four goals for Jen Crady Massage.

As the clock ticked in the second half of play, The Feast defense could not stop the offensive charge by Zack Fernandez, who scored two goals, and Ava Zink, who had a single tally. The 3-0 finish takes Smiledeep in the championship game still undefeated and the team to beat.

The championship game for Division II AMICC youth soccer will be played on November 10 at 7 p.m.

Division III (14-to 17-year olds)

With only two teams in the Division III category, the squads played toward the championship game with another head-to-head battle.

The 6-2 victory for AMI Fitness was lead by Tyler Pearson with four goals. Alex Butram added two more goals for AMI Fitness and Nico Calleja scored Wash Family Construction’s two goals.

The awards ceremony celebrating the accomplishments of the teams and players take place Wednesday, November 5 at 6:30 p.m. at AMICC.

In addition to the activities on the soccer field, Anna Maria Island Community Center is home to the adult co-ed basketball league. The five teams burned up the court this week.

Two homeless men were arrested in Holmes Beach Monday, Oct. 27, and charged with burglary after a cleaning person walked in on them, according to Holmes Beach Police.

The cleaning person called police after finding Scott Francis Petrelli, 47, and Guy Vincent Massiello, 58, sleeping on the back porch of the home in the 4000 block of 5th Street around 12:30 p.m. A Holmes Beach officer awoke the two men and learned that they had used the electricity, cable TV, propane grill, pool, and shower for a period of seven to nine days. The unit normally rents for $350 per day. The men were arrested without incident.

Attorneys debate forfeiture legality Two local legal minds share differing opinions regarding the forfeiture of office proceedings.

BRADENTON BEACH – Last week’s forfeiture of office discussion included dueling legal opinions offered by Robert Lincoln and John Metz.

Lincoln works for the Icard Merrill law firm and represents BeachHouse restaurant owner Ed Chiles in two lawsuits involving Mayor Bill Shearon and the city.

Metz, a retired attorney who practiced law in California, is a member of the Planning and Zoning Board. He is also Shearon’s friend and neighbor.

Both men provided their written opinions at no expense to the city and requested that they be read into the public record.

Metz’s opinion claimed the proposed forfeiture resolution failed to include “an impartial trier of fact” because three commission members already voted in favor of proceeding with the forfeiture efforts. To Metz, this suggests commission members may be

biased and unable to render an impartial decision when determining Shearon’s political future.

He cited acrimony among commissioners as an additional concern for bias.

Metz Metz believes Vice Mayor Jack Clarke should recuse himself from the forfeiture process because he stands to succeed Shearon as mayor.

The former attorney also claims there is no legal basis to suspend Shearon while the forfeiture process plays out, which thus far has not been proposed.

Lincoln “The resolution is a constitutionally deficient rush to judgment,” Metz concluded, while suggesting commission oversight from an impartial hearing officer.

Citing state and federal law, Lincoln’s document contended that a local governing body does have the right to

remove an elected official, as long as the accused is afforded due process and a fair hearing.

In regard to bias, Lincoln noted that individual bias could be for or against the mayor. He also cited case law that states a commissioner voting in favor of moving forward with the efforts to remove an elected official is not sufficient evidence the commissioner is biased.

Lincoln refuted the suggestion that Clarke should recuse himself.

“It is unclear that the additional pay for the mayor’s position is a financial gain when it is offset by greater responsibilities. More important, Florida statute states that no public officer shall be prohibited from voting on a matter affecting his or her salary, expenses or other compensation as a public officer. Clearly the vice mayor is not statutorily prohibited from voting on the mayor’s forfeiture,” Lincoln opined.

“For these reasons, I do not believe the procedures set forth violate the due process rights of an elected official subject to forfeiture,” he added.

Lincoln’s document included evidence that supports the commission’s

efforts to remove Shearon from office.

He alleged Shearon assumed the role of city clerk and acted as a department head when he granted unbudgeted pay raises without commission consent.

Lincoln believes this equates to dual office holding, which is prohibited by state law. He then cited a second Florida law that states, “An officer of a municipal government may not contract for expenditures in any fiscal year except pursuant to the adopted budget.”

Lincoln alleged Shearon violated state Sunshine Law when he solicited e-mail input from commissioners regarding board appointments, the appointment of Janie Robertson as vice mayor, the efforts to streamline special events permitting and litigation pertaining to Chiles’ restaurant ownership group.

“I believe these incidents support the commission in determining there is probable cause that the mayor violated standards of conduct established by law for public officials,” Lincoln’s statement concluded.

the commission to present a list of specific charges Shearon is accused of, and this may occur as early as next week. The charges will serve as the basis for a triallike hearing that will include public input and the presentation of evidence, testimony, and rebuttals.

Shearon will not chair the forfeiture hearings, nor cast a vote in the commission’s decision. Instead, he will assume the role of defendant while the four commissioners collectively serve as prosecutor, judge, and jury.

If three commissioners vote in favor of forfeiture, Shearon will be removed from office. He has the right to file an appeal, but according to City Attorney Ricinda Perry, the forfeiture would remain in effect unless a court ruled otherwise.

If the commission strips Shearon of his mayoral duties, Clarke will serve as mayor for the remainder of Shearon’s term, and a Ward 1 resident will be appointed to fill Clarke’s vacated commission seat.

“Resolving our differences with a forfeiture process will continue to divide the commission and the public. The vot-

ers elected the mayor to lead the city and should be given the right to change the mayor. For the majority of the commission to make this decision defeats the electoral rights of our country,” he added.

“I recommend we stop this process today and consider the past as errors in judgment by the mayor and commission. I further

recommend we workshop our differences and agree by majority on direction. As a last resort, we could use a mediator to resolve the issues with less cost, time and effort,” Shearon concluded.

While reading his own prepared remarks, Clarke said he provided the mayor with specific concerns during a meeting in September.

“You are in denial. You have operated in a manner completely contrary to the spirit and letter of our city documents, ordinances, and resolutions. Your apology is noted, but there’s no indication that any change is forthcoming. In fact, you are quoted in interviews that you will not change,” Clarke said.

“Above all else, you have polarized this city,” Clark said, while sharing his view that continued public records requests, many of which were filed by Shearon’s girlfriend, Tjet Martin, are being used as a weapon that cripples city communications and consumes staff time.

“If you really place the best interests of the city and the health and welfare of its residents above your own, then save us the anguish and expense of the proceedings and resign your post as mayor,” Clarke concluded.

“I will never resign,” Shearon said in response.

Deanne married Dean Prochaska on Sept. 2, 1961 at St. Patrick’s Cathedral in Parsons, Kan. They enjoyed their time together, devoted to their children, relaxing and enjoying their cabin in the mountains, living primar-

ily in the Annapolis area and loving being in Florida for over 20 years. They travelled extensively, loved being with family and enjoyed each day. They were a loving couple and completely devoted to each other. Deanne also had an infinite passion and was dedicated to the VR Beach Club on Anna Maria Island and its members.

She is survived by her adored and loving husband, Dean.
