Whitmore retains county seat Self-proclaimed "Island" girl prevails in hard fought reelection bid.

MANATEE COUNTY – Lifelong Island resident Carol Whitmore is pleased to be serving another term on the Manatee County Commission.

Whitmore, an incumbent Republican, defeated first-time Democratic challenger Terri Wonder in last week’s election by 21,787 votes. Whitmore received 68,085 votes (56.2 percent) compared to Wonder’s 46,300 (38.2 percent).

At the four Island voting precincts, Whitmore’s support ranged from 61 to 54 percent.

She celebrated her re-election at the Pier 22 restaurant in Bradenton, surrounded by campaign supporters, friends and family members.

“I’m very happy, and I’m even more happy that I carried the Island,” Whitmore said.

“I had a tough opponent who had passionate supporters. It was a tough campaign and I give kudos to my opponent.

“I fully expected Carol to win because of

the job she’s done over the past years, but it’s good to see it confirmed. It’s great for Manatee County and the entire region to have Carol back on the commission. She’s a hard worker, a pro-active thinker and someone I work very closely with,” he said.

County Commissioners John Chappie and Vanessa Baugh were also on hand.

“Carol is a fiscally conservative individual and her votes have shown that, but she also listens to everybody and has a history of responding to the community and the individuals in the community,” Chappie said.

“Local government is very personal. It’s about compromise and working together; it’s not about absolutes, and Carol understands that, and I think the commission as a whole understands that,” he added.

“The people have spoken. They wanted to see Carol stay on the board, and they’ve shown they have confidence in the commission,” Baugh said.

As a well-known incumbent, Whitmore held a significant funding advantage over Wonder. Whitmore received $104,735 in campaign contributions and $5,546 in additional in-kind contributions. Wonder received $25,242 in campaign contributions and $4,780 in in-kind donations. Whitmore spent $80,249 on her campaign and Wonder spent $22,725.

Countywide, voter turnout was 56.9 percent, with 121,032 of Manatee County’s 212,609 registered voters casting votes in the Nov. 4 election.

Two new fire commissioners elected West Manatee Fire Rescue District voters elected two new fire commissioners last week. Challenger George Harris beat incumbent commissioner Scott Ricci for Seat 2 with a vote of 5,378 to 4,698. Al Robinson beat incumbent Commissioner Larry Tyler for Seat 3 by a vote of 5,307 to 5,229.

Seats are for four years. The new commissioners will take office on Nov. 14 and be sworn in at the Nov. 20 fire commission meeting at the administration building, 6417 Third Ave. W., Bradenton, at 6 p.m.

New mayor, incumbent commissioners win in Anna Maria

ANNA MARIA – Dan Murphy will become the next mayor of this city after he defeated Mayor SueLynn 461 to 327 in the Nov. 4 election.

SueLynn was appointed mayor two years ago when Mike Selby did not run for a second term. She has spent the past two years trying to deal with the rapid influx of large rental homes that are replacing residences where people sold out and moved away.

Murphy, a retired engineer, Vietnam veteran and longtime resident of the area, might have scored a plus with voters because he attended every meeting after announcing his candidacy.

The morning after the election, as he and his wife, Barbara, were holding up signs thanking voters for their support, Murphy described his reaction.

David Bouchard came in third with 394, trailing Webb by 14 votes. The two

incumbents will return for another two years.

Vosburgh decisively defeats Martin Last week’s election results leave the commission’s balance of power unchanged

BRADENTON BEACH – Incumbent commissioner Jan Vosburgh retained her Ward 4 city commission seat last Tuesday with a landslide victory over challenger Tjet Martin.

Running unopposed, incumbent Commissioner Ed Straight will join Vosburgh in serving a third and final term on the commission.

In last week’s election, Vosburgh received 347 votes and 67.6 percent of the vote, compared to Martin’s 143 votes and 27.8 percent. Of the city’s 763 registered voters, 490 participated in the city’s only commission race, producing a local turnout rate of 64 percent.

In contrast to the August primary election, when more than 50 percent of the precinct’s 307 voters voted by mail, the majority of the city’s voters waited until Election Day to cast their votes.

A joyous Jan Vosburgh will serve a third term on the city commission.

Three hundred and twenty-two voters cast their ballots at the Annie Silver Community Center, 155 voted by mail and 13 traveled to the mainland during the early voting period.

Vosburgh celebrated the victory at her Bradenton Beach home, joined by friends and campaign supporters.

“I’m delighted that I won, and I want to thank all of the people who supported me, and hopefully, the city will be able to look forward now that the

election behind us. I also hope this will heal some wounds so we can get back to doing the work of the city,” she said.

When asked if the large margin of victory surprised her, Vosburgh said, “No. I was confident, because I felt like I had such good support.”

“I believed good will would win out, and so it has,” said former Commissioner Gay Breuler.

“You can’t imagine how happy I am,” said former John Shaughnessy, when he called to congratulate Vosburgh.

“I am elated, but it’s not unexpected,” Clarke said of the results.

The vice mayor feels the margin of victory in a race that involved the mayor’s significant other served, in part, as a referendum on the Shearon administration and the recent discussions pertaining to the mayor potentially being removed from office.

“It seems to me that the people who voted for Tjet are the same people who voted for Mayor Shearon and Commissioner Robertson in 2013. This indicates to me that a small circle of individuals whose self-interest has been promoted see vosburghN, page 32

Support wanes for returning tourist tax to AMI The ManaSota League will not include vacation rental law reform or returning tourist tax funds to municipalities in its 2015 Legislative priorities.

About 43 percent of Manatee County’s September resort tax revenues (the last month available) were generated in Anna Maria Island’s three cities, according to the Manatee County Tax Collector’s office.

SARASOTA – Amending the tourism development tax law to allow one cent of the five cents-per-dollar tax revenues to be repaid to the municipalities that generated them will not be a 2015 legislative priority for the ManaSota League of Cities.

The board decided on Nov. 6 to continue to discuss the issue next year, but declined to include it as one of its legislative priorities.

Manatee County’s 5 percent resort tax is collected from owners of accommodations rented for six months or less who charge the tax to their renters, in most cases, tourists. The majority of the tax is allocated to Bradenton Area Convention and Visitors Bureau tourism marketing efforts, with one of the five pennies allocated to beach renourishment.

“Our concern is that none of that money comes back to cities that are affected most by increasing tourism,” said Holmes Beach Commissioner Jean Peelen, also a Manatee County Tourist Development Council member.

“We get one cent for beach renourishment, but that doesn’t necessarily benefit us in handling the burdens,” she said. “Most of the funds go to increasing tourism in our county. But we have increasing issues with the burden, with police, with keeping our beaches clean, with waste management, code enforcement… the burden on our roads is getting ridiculous.”

“It’s about fairness,” she said. “These funds are being generated by our municipalities and we get nothing back to deal with the increased burden.”

“We have to put up infrastructure, we have police problems, we contribute a lot of this money and we have to put up

with controlling the crowds,” Bradenton Beach Mayor Bill Shearon said, adding that spectators and participants who come for the 2017 World Rowing Championships at Nathan Benderson Park, near the Sarasota/Manatee county line, will flood the beaches.

“We’re congested, we’re overpacked and we have to handle that,” he said.

The issue does not belong on the priority list yet, League President Jack Duncan said.

“This could be another piece of legislation like vacation rentals. It truly, truly, truly needs revision,” he said, asking members to begin putting together a proposal for 2016.

The Manatee County tourism brochure says “Come to Manatee County,” but lists Anna Maria Island and Longboat Key as the prime attractions, he said.

“We’re the drawing card, but with that comes expense,” he said, adding that a proposal must be worded in a way that supports tourism.

To League members who deny that the issue is a problem, Peelen warned, “There will be an increased need for short term vacation rentals around the whole Bradenton/Sarasota area, and

it may be more important to you then than it is now.”

Vacation rental law

The League also decided against including further vacation rental law reform on its priority list.

The state Legislature passed a law in 2011 prohibiting municipal regulation of vacation rentals, including minimum stays and frequency, causing city governments to complain that they could not address noise, parking and trash problems at vacation rental properties.

Last year the Legislature tweaked the law, allowing municipalities to regulate rentals for health and safety.

“None of the cities on the Island have taken advantage of the change made last year,” Peelen said, adding that the League may consider the issue again after cities act.

Duncan congratulated outgoing Anna Maria Mayor SueLynn’s progress on the vacation rental issue, which he said he had “thought was DOA.” The League also decided not to oppose state support for beach renourishment being linked to beach parking access.

EDITORIAL A good choice for the Center

S

core a solid win for the Anna Maria Island Community Center, albeit a temporary one, with the appointment of longtime Island resident Cindy Thompson as interim executive director.

Thompson, a business owner and former president of the Anna Maria Island Chamber of Commerce, is an excellent choice to lead the Center following the departure of outgoing Executive Director Dawn Stiles, who is headed back north to reunite with her family. Stiles leaves the top job at the Center in capable hands with Thompson, and she can look back on her past year here with satisfaction, as she helped steer an exciting new course for the organization that means so much to the Island.

As for Thompson, a better selection could not have been found by the Center board of directors and they were smart to quickly snap her up from her current position as vice-president of that same board. Her organizational skills as a business person and event planner are well known on the Island, and she was for years the driving force that made Bayfest the huge success that it has become.

We have no doubt that Thompson will bring that same success to the Center, in the interim and beyond.

Center director says thanks “Gratitude is one of the least articulate of the emotions, especially when it is deep.”

As my time at the Community Center grows short I realize that there are many individuals and groups in the Island community that I have failed to thank for helping the Center.

Cultural Connections is a group of “artists” of all types; painters, musicians, actors, and others who come together to grow and celebrate the cultural aspect of the area in which we live. This group has embraced the Community Center and helped it to recognize its potential through partnerships and alliances. Thank you.

Last week the Bridge Street Merchants Association and Angela Rodocker of Bridgewalk made a generous donation to the Community Center from a raffle they held at the first Taste of Bridge Street and Farmers Market of the season. Thank you.

During the Community Center’s “Save the Center” meeting in June a woman stood and made several suggestions that would help the Center with recognition and communication – Jennifer Cascardo of SugarBeach Digital. She immediately provided in-

kind services to implement her suggestions. Thus began the “Share the Community” branding movement; the implementation of our Social Media including video production of several youtube posts, Facebook, Twitter, Pinterest and Instagram; training and assistance to staff on using the social media effectively (still a work in progress); and sponsoring teams in our sports leagues. Thank you.

AMI Radio – “Can’t Contain the Cool” – Casey and Robert, who have promoted all of our events, worked with our youth to teach them about radio broadcasting and putting them on-air to report on events at the Center. Thank you.

And last but not least – all of our over-asked local businesses - we come to you often for sponsorships, gift certificates, monetary donations and anything else that isn’t nailed down. Thank you.

Crosswalk signs are working I have been somewhat chagrined

by your survey results and letters to the editor concerning the crosswalk signs in Holmes Beach. Although I understand the concerns of those who worry about an impending automobile rear end accident, I'm not sure any have occurred since the signs have been in place. I, however, am one of many who use these crosswalks living across from Publix on East Bay Drive. When we first moved here the lack of any crosswalk at all created a highly dangerous situation, especially for the elderly on our side of the road. We were relieved when a crosswalk was put in that allowed us to cross the three lanes to Publix and the beach. I found, however, that most motorists were not yielding.

The effect of the new pedestrian stop signs in the median was immediate. Now the motorists are overwhelmingly observant of them. I would hope the potential injury to a pedestrian who is attempting to cross the road would outweigh the concern over a possible low velocity rear end accident. We've already had at least one death on the island at a crosswalk. Hopefully, these signs will keep us from having another and with only some minor inconvenience.

ANNA MARIA – The Island Community Center board of directors has named Cindy Thompson as interim director during the transition period between the departure of current Executive Director Dawn Stiles and the selection of her replacement by the board.

“I was humbled and honored to be asked to step in as IED during this transition,” Thompson said. “I do feel I am uniquely qualified, and most importantly, I have a desire to see the Community Center thrive once again.”

Effective Monday, Nov. 10, Thompson will work with Stiles to ensure a smooth operational transfer.

Thompson stressed, “Time is not on our side with Dawn leaving in just days. We cannot lose momentum in continuing our mission to

rebuild a sustainable business model while providing needed services to our membership. We need to put the community back in to the Community Center.”

Stiles pointed out that Thompson is a “sound and reasoned thinker who adds a measure of common sense to any discussion” and has “boundless energy and willingness to take on projects without hesitation.

“Cindy will be a great asset to the Center and resource for staff during this time of change. Her knowledge of the Center, staff and what we do will truly make this a smooth transition.”

Governance Committee member Blair Schlossberg commented, “The Center has a number of important issues and events upcoming in the near term that need strong leadership now as the Center moves forward on a financial plan and management strategy that take the Center to a new level of community services.

Board Chair Scott Rudacille agreed, saying, “While we don’t intend a long, drawn out search, we are committed to taking the time necessary to make the right decision, both for the community and the Center. Having Cindy at the helm during this process gives us the ability to do that.”

Thompson is owner of Thompson Academy in Bradenton, co-owner of Paradise Bagels & Café in Holmes Beach and was the event planner with Island Festivals in Holmes Beach. She has more than 15 years experience working with non-profit organizations.

Diana McManaway replaced Thompson on the Governance Committee, and the board named former Caterpillar executive Jim Froeschle, Blair Schlossberg, Micheal Coleman and Larry Craft to the search committee.

“I have full confidence in the board of directors and the selection committee to ultimately choose the best candidate available to carry out that mission,” Thompson said. “I think it is actually a very exiting time for our Center and I look forward to being a part of it.”

Martin files records suit The mayor’s significant other has had a chilling effect on the commission and city staff’s willingness to use city e-mail accounts.

BRADENTON BEACH – After failing to win a commission seat, the mayor’s girlfriend, Tjet Martin, wasted no time filing a lawsuit claiming the city has been slow to respond to her public records requests.

She also wants the city to pick up the tab for any legal costs she incurs in the process.

On behalf of Martin, attorney Rolf Brookes submitted a petition to the 12th Judicial Circuit Court on Friday, asking the court enforce provisions of the Florida statutes pertaining to public records requests.

The filing occurred one day after the city commission reluctantly agreed to pay a $4,084 invoice for attorney fees Martin previously subjected the city to as the result of public records requests she made

regarding the e-mail accounts of Vice Mayor Jack Clarke, Commissioner Jan Vosburgh, City Attorney Ricinda Perry, and Public Works Director Tom Woodard.

Martin Martin has previously said that her requests are an attempt to prove city officials violated Sunshine Laws and conspired against the mayor. To date, Martin has produced no substantial evidence to support her allegations.

Police Chief Sam Speciale has said on multiple occasions that he feels the city has met its obligation on responding to Martin's requests, but Martin contends that a records request she made in July has not been fully met.

She is asking the court to order respondents to show cause why the requested records should not be produced, and asking that the respondents be required to produce the requested records so she and her counsel can inspect them.

She is also asking the court to award her filing fees and attorney fees, which, if granted, would be paid

for by the city.

No one has questioned Martin’s right to request public records, but Vosburgh and Clarke have publicly questioned the extent and frequency of her requests because employees are frequently pulled away from their daily duties to work on her requests.

According the suit, the city recently requested payment of $720 in order for Martin to obtain access to public records provided by the city attorney.

Martin objected to the fee because she felt an administrative fee of $90 per hour was not reasonable, and eight hours was not a reasonable amount of time to produce the limited records she sought.

Clarke has fully complied with requests, but some of Woodard’s e-mails linked to a discontinued personal account cannot be recovered.

Vosburgh feels she has complied, and she is not happy with the latest developments.

“I had the clerk sign a piece of paper that said the records had been received. I have a copy of every city e-mail I have sitting in my office. Tjet can go in there and look at them any time she wants, so I don’t know what

her big gripe is. I feel I have complied completely,” Vosburgh said.

“It’s a waste of money and time trying to take care of problems caused

by Tjet Martin. The Sunshine Law was not enacted for harassment purposes, and this is harassment,” she added.

Martin’s efforts have had a chilling effect on the commission’s willingness to use e-mail as a means of correspondence. Commissioner Ed Straight recently told the commission he no longer responds to any e-mail sent to his city account. Clarke, Vosburgh and multiple city employees have expressed similar views.

“I have not sent an e-mail on my city account in weeks,” Clarke said.

Vosburgh thinks Mayor Bill Shearon should ask his significant other to cease and desist, but he has previously expressed no willingness to do so.

“He says he has no control over her, but this is absolutely ridiculous.

This shows that he doesn’t have good managerial skills and I hold him responsible for her behavior. I do not think he is looking out for the best interests of the city,” Vosburgh said.

ANNA MARIA – Owners of a house located across the street from Mayor SueLynn have filed suit against the city for delays in getting a permit for a remodeling job.

The suit, filed late last month in circuit court by 423 Spring St. AMI LLC, claims Building Official Bob Welch held up a construction permit.

According to the complaint, the owners began a remodeling and addition project at the house in early 2014. On May 23, the petitioner was granted an interior demolition permit. During the demolition, the project was visited by Code Enforcement Officer Gerry Rathvon at least twice.

On July 16, the petitioner applied for a building permit. On Aug. 29, more than 30 days after that application, Welch sent an e-mail to the designer instructing him to apply the 50 percent rule. The designer changed his plans to comply with the

The complaint said up until the filing of the complaint, Welch had not issued a building permit or provided a legitimate basis for his failure to do so.

Meanwhile, on Sept. 22, the city declared a moratorium. The next day, the petitioner’s contractor spoke with Welch, who told him a permit would not be issued for the project because of the city com-

mission’s instruction to not give permits to homes with more than three bedrooms or rooms that could be used as bedrooms.

On Sept. 26, the petitioner’s counsel requested all records of the city pertaining to the house for the past two years and all correspondence related to the moratorium, vacation rentals, numbers of bedrooms in houses and occupancy limits.

Later that day, Welch forwarded to the petitioner’s counsel a copy of an e-mail exchange between him and the designer dated Aug. 27 and 29, saying “The clerk will get the rest of the correspondence and a copy of the permit documents to you.”

On Oct. 13 and 21, the petitioner’s counsel asked about the status of the records and on Oct. 22, the clerk forwarded an e-mail from an outside information technician purporting to be the remainder of the records, but the complaint says those files contained no information pertaining to the house. Instead, it contained spam e-mails and inquiries related to other properties on Spring Avenue and legislative updates to city commissioners. It contained no correspondence related to the property in question. There were also no records of code enforcement complaints and inquiries at the property.

The complaint also notes a moratorium ordinance has not been enacted by the city.

The complaint asks for a writ of mandamus, compelling the city to act on it. The petitioner also asks for his legal costs to be reimbursed.

The complaint was signed by Fred E. Moore, Esq., of Blaylock Walters PA. The city has not responded at this time.

Crackin’ good crab fest The Third Annual Cortez Stone Crab Festival drew about 8,000 people to Cortez last weekend to hear music, enjoy arts and crafts, drink rum drinks from coconuts and crack into stone crab claws. Organizers said abut 1,500 pounds of stone crab were sold, easily eclipsing the record 900 pounds sold in 2012.

The festival was a fundraiser for Fishing for Freedom, which supports a pending appeal to the Florida Supreme Court to reverse the 1995 state constitutional amendment banning gill nets.

So far, a judge in the case has temporarily lifted the net ban twice, but on appeal, the net ban was put back in place, prompting the appeal to the Florida Supreme Court.

City proceeds with take-home police vehicles The vehicles will cost $78,500, and at the end of four years, the city can purchase the vehicles for $1 each.

HOLMES BEACH – City commissioners approved a budget resolution to allow the police department to lease seven vehicles from Ford so officers can take home their vehicles.

The vehicles will cost $78,500, and at the end of four years, the city can purchase the vehicles for $1 each. The lease agreement includes a seven-year maintenance program.

At budget hearings in July, Police Chief Bill Tokajer lobbied for the vehicles and said if the department received additional funding from the county for beach patrol and partial funding from the School Board for the

school resource officer, it could shift funds to implement the vehicle plan.

It did receive those funds and according to the resolution, $25,000 was from school resource officer revenue, $35,000 was from beach patrol revenue and $18,500 was transferred from the code enforcement vehicle budget.

When lobbying for the vehicles in July, Tokajer said benefits of take home vehicles include savings in time for officers, maintenance and replacement costs, as well as being a valuable perk to retain and hire new officers.

He said studies prove that officers take better care of their vehicles if they take ownership and that officers would pay $50 per month for gas if they live 10 miles from the city.

Another benefit is that officers would be automatically equipped to come to work in the event of a natural disaster and to aid other officers with traffic accidents and other emergency situations on their way to and from work.

Health department urges mosquito precautions With an increase in mosquito-borne disease activity, the Manatee County Health Department urges precautionary measures to prevent illnesses.

Fall is typically an active time for mosquito-borne disease activity in Manatee County. Shorter days, combined with Daylight Saving Time, means evening walks and outdoor exercise now occur during dusk, which is peak activity time for mosquitos.

Mosquitoes can carry dangerous diseases, such as chikungunya, West Nile virus and dengue fever. These diseases are transmitted to humans through mosquito bites.

Although there have been no reports of humans contracting these diseases yet this year in Manatee County, officials are reporting an increase in mosquitos testing positive during September and October of 2014.

The Florida Department of Health in Manatee County reminds everyone to protect themselves by following the five Ds: • Dusk and dawn – Avoid being outdoors during the dusk and dawn hours when mosquitoes are most active.

• Dress – Wear clothing that covers most of your skin.

• DEET – When the potential exists for exposure to mosquitoes, repellents containing DEET are recommended.

Picaridin, oil of lemon eucalyptus, and IR3535 are other repellent options. If additional protection is necessary, a permethrin repellent can be applied directly to your clothing. Always follow the manufacturer’s directions.

• Drainage – Check around your home to rid the area of standing water, which is where mosquitoes can lay their eggs.

Egmont ready for dredging The island has experienced large-scale erosion and structural damage on its western shoreline, according to the Army Corps of Engineers.

EGMONT KEY – Workers for Great Lakes Dock and Dredge are preparing to dredge away 875,000 cubic yards of shoaled sand along 17 miles of channel to improve safety at this tiny spit of sand in the mouth of Tampa Bay. Great Lakes also will install geotextile tubes along Egmont Key to stabilize the shoreline, according to a release prepared by Susan Jackson, of the Army Corps of Engineers.

Sand placement will start at the northern end of the key, which is the most severely eroded portion of the island, according to project engineer Andy Cummings. The renourishment will then proceed south along the western shoreline. The project is expected to take four months.

Engineers will monitor water turbidity during the project to ensure water quality standards are met. Endangered

species monitors will help protect marine wildlife. If sea turtles are numerous in the navigation channel, they might be relocated using open-net trawling.

Egmont Key is home to gopher tortoises, nesting sea turtles, nesting shorebirds and wintering migratory birds.

Florida Park Service Manager Tom Watson, who lives on the key and has been there for 13 years, will monitor wildlife activity along with his staff and help ensure the safety of boaters and other visitors who enjoy a variety of recreation activities at Egmont Key. “We’re grateful for the continued support of the Army Corp of Engineers who have been such a vital part of protecting the eroding shoreline,� Watson said.

According to the release, erosion on the western shoreline has caused a two- to three-foot escarpment to form and numerous palm trees to fall into the Gulf of Mexico. As a result of the erosion, the beach on the west side of the island is not available for sea turtles to nest. Placing sand there in the early part of the winter season provides time for wave action on the beach to naturally sort the sand and silt, according to Aubree Hershorin, Ph.D., project biologist. “This is important, because it ensures the beach is as suitable as possible for

Harley Wade, grandson of Debra and Jim Bangma, of Holmes Beach, had worked on the project when he was a student in Tennessee, but he moved to Bradenton with his parents since then. That didn’t stop him from being involved, however.

Wade is now a student at Braden River High School, but he has permission to return to Tennessee to work on a second experiment. He left for his old high school last week.

“I was watching the launch live,” Wade said. “It happened very quickly, and my emotions went from excitement to disappointment to disbelief.”

The experiment, which benefits from limited gravity in the space station,

includes samples of cancerous tissue and the affect of Reishi mushroom, an herbal mushroom that Wade said is known to have miraculous health benefits. Instead of cancer cells, though, they will be using e-coli cells.

“Reishi mushrooms have proven effective in treating Alzheimer’s disease and some forms of cancer,” he said.

“There are three possible outcomes: either positive, negative or neutral.”

Wade said they are working on replacing the items destroyed in the explosion, and he will be speaking about the experiment at the Smithsonian Institution in Washington, D.C., where students hope their experiment will be approved again.

According to Wade’s mother, Julie, they worked on the project for nearly a year the first time.

Wade said students initially got into this experiment because of their ecology teacher, who he said is top rated in the nation. He said his whole high school in Tennessee participated in the first project. It was submitted and got into the final three to be selected by NASA to go into the space station.

“Now we’re getting a second opportunity,” he said. “It’s a blessing.

Commission approves mayoral raise The monthly pay for a mayor would rise from $9,600 per year to $19,000, but it had to be passed before Tuesday’s election for SueLynn to have benefitted from it, if she were re-elected.

ANNA MARIA – Thanks to a special meeting vote by the city commission on Monday, Nov. 3, Mayor Dan Murphy will be getting more pay for running the city than his predecessors.

The full commission voted on the raise with Dale Woodland and Nancy Yetter casting nays. The last time a vote was taken, two commissioners who were for the raise were absent.

Commission Chair Chuck Webb got it placed on the agenda again and they approved it.

Commissioners then turned their attention to responding to notices by landowners who plan to sue the city under the Bert Harris Act for loss of value because of the living area ratio (LAR) size requirements for new homes. The law allows citizens to sue a governmental entity if an action by that entity lessens the value of their property, and those people appealing feel the new LAR will reduce the value of their property, according to notices filed with the city.

The landowners had one year since the LAR restrictions were enacted to notify the city of a possible legal action.

Six landowners filed those letters representing seven properties. One couple filed a letter even though they are also

filing an appeal of a city decision to not allow a variance to the LAR provisions.

The city has 150 days to try to settle the disputes as spelled out in the letters, and on Monday, commissioners agreed to extend that time period to Jan. 22, 2015. “I’ve talked to the counsel for six of the seven properties that we’ve had claims from, and all their clients have agreed to an extension,� said City Attorney Jim Dye. “The reason (the extension is) out that far is because of the holidays with reduced meeting time and we’ve got full agendas, that kind of stuff.�

Dye said he reached the lone holdout’s attorney just before the commission meeting, and he said that his client would agree to the extension, but with a cutoff of Dec. 15.

With that, the commission voted unanimously to have the mayor sign a document that would extend that deadline for six of the properties to Jan. 22 and the other to Dec. 15.

Finally, Commissioner Doug Copeland expressed concern over the city’s moratorium on permits for homes that are designed with more than three bedrooms or rooms that could be used as bedrooms. He said it has been six weeks since the moratorium was enacted. “There are plenty of people out there that are held up from their projects, and they have good intentions, some of them for the second time,� Copeland said. “I truly don’t believe it’s fair.�

Webb said last week staff members had not had time to do the research, and they would put it on the agenda when they could.

Zaccagnino was gracious in his concession and said, “I wish the best for Holmes Beach. Good luck with the new mayor.�

Titsworth received the highest number of commission votes at 1,282 and Grossman came in second with 1,088.

Challenger Andy Sheridan received 857 votes.

“Thanks for believing in me again,�

Titsworth told the crowd. “I will continue to work hard for all the citizens of the city.� “I want to thank everybody,� Grossman added. “I appreciated the privilege of working for my community. It was great being part of a team that has changed the direction of the city.�

Sheridan said the loss would not deter him, and he would “continue to go to meetings and speak up on issues and be there for the citizens of Holmes Beach.�

The swearing in of elected officials is set for 9 a.m. on Tuesday, Nov. 25.

In addition to the commission and mayor’s races, the voters were asked to decide on 18 charter amendments. All 18 were approved.

Project Healing Waters aids vets

P

roject Healing Waters Fly Fishing, Inc (PHWFF) is a nonprofit organization that started at Walter Reed Army Medical Center in Washington, D.C., in 2005. The name PHWFF was established in the fall of 2006, and the organization was incorporated in the state of Maryland in 2007. PHWFF is currently represented with 173 programs in 49 states.

Programs are managed locally by volunteers and were originally based at a Department of Veterans Affairs facility. The program has now expanded to locations in over 15 geographic regions throughout the United States. PHWFF also has affiliate programs in Puerto Rico, Canada and Australia.

PHWFF is run by a volunteer organization and governed by a board of trustees and elected officers who provide operational and budget oversight, are responsible for the strategic plan and create policy.

Reel Time RUSTY CHINNIS Full-time employees and one parttime employee support the administrative and program functions at the national level.

The volunteers at the local and regional levels work with the national staff to administer programs, assist with fund raising, coordinate operations and plans and manage special projects. PHWFF refer to the local affiliates as programs, not chapters or clubs, and is not a membership organization.

PHWFF relies on the generosity of both private and corporate donors and solicits foundation grants, but does not receive government funding. PHWFF programs are associ-

Some programs are run jointly by both Federation of Fly Fishers and

Trout Unlimited clubs.

On Saturday Nov. 7, I took part in a PHWFF event in conjunction with HOW (Heroes On The Water) at the Bradenton Yacht Club. HOW also serves our nationâ&#x20AC;&#x2122;s warriors by providing healing and rehabilitating kayak fishing outings that are physically and mentally therapeutic through a nationwide community of see reel time, page 25

volunteers and donors. The event was hosted by volunteer Ted Hass and supported by the yacht club and its Commodore Mike Reeves.

In the morning, participants were treated to coffee and donuts, had a meet and greet and worked with local volunteer guides and volunteers from Federation of Fly Fishing Clubs in Sarasota, St. Pete and Tampa on fly casting skills in the

clubâ&#x20AC;&#x2122;s parking lot and pool. After matching with guides participants loaded onto boats with the guides for a morning of fishing.

I was graciously taken around the Manatee River, Tampa Bay and Terra Ceia Bay by Jeanne Reeves and a good friend, Lucinda McCarthy, to take pictures of the participants fishing. Although we werenâ&#x20AC;&#x2122;t able to capture anyone in the act of catching, we did find a number of very happy

participants with stories of fish that were caught during what turned out to be a beautiful morning.

Participants returned to the yacht club in the early afternoon for a fabulous buffet spread on tables on the pool deck. The chef and staff did a wonderful job of preparing fresh sandwich makings, prime rib and a delicious desert of peach cobbler and whipped cream.

and rod building exhibitions in the dining room making for a wonderful ending to a great day for both volunteers and veterans.

Army exploring for explosives

Passage Key is a popular weekend boating destination as clear, shallow water extends for hundreds of yards to the south and east of the tiny island, which has been under water at all but dead low tide for the last five years.

PASSAGE KEY – Now a peaceful bird sanctuary, Passage Key was a bombing and aerial gunnery range during World War II, and the military plans to explore it for unexploded munitions within the next year.

The U.S. Army Air Corps at MacDill Field (later called the U.S. Air Force at MacDill Air Force Base), used Passage Key as a target during World War II, leaving behind several items that were discovered in 1998 that interested the Army, said Amanda Parker, public affairs officer with the U.S. Army Corps of Engineers, declining to disclose what the items are.

The key, visible from the north end of Anna Maria Island in Tampa Bay, was underwater until recently, and its reemergence has made the site accessible to the Army Corps, although the public is still prohibited from landing on the key, which is a National Wildlife Refuge.

The Army Corps will work with the U.S. Fish and Wildlife Service during the project to avoid injuring or killing birds, Parker said.

Passage Key is one of about 800 defense sites in Florida under investigation by the Army, which will begin digging on the key and searching its underwater Interpretive signs about Passage Key are located at Bayfront Park in Anna Maria, within sight of the key.

A meeting last week on the project, scheduled at the Anna Maria Island Community Center, was relocated and closed to the public and the press.

Many names, many uses

In 1757, when Tampa Bay was called Bahia del Espiritu Santo or Holy Spirit Bay, the Spanish named Passage Key Isla de San Francisco y Leon or Saints Francis and Leo Island. The English renamed it Burnaby Island in 1765;

it was also known as Pollux Key. In 1783, it was renamed again, to Cayo del Paseje, or Passage Key. In the early 1830s, Capt. William Bunce operated a fishing rancho on the key. In 1836, the U.S. schooner Grampus and the cutters Washington and Jefferson anchored at its small dock.

In the 1850s, a survey estimated the key’s land area at about 100 acres, Parker said.

It was only 60-plus acres by Oct. 10, 1905, when Pres. Theodore Roosevelt, at the urging of the National Audubon Society, established Passage Key National

Wildlife Refuge as a sanctuary for seabirds and shorebirds.

At the time, the key had a freshwater lake and the largest population of royal terns and sandwich terns in the state.

In 1910, Capt. Asa Pillsbury and his family, who homesteaded on Passage Key in 1908, reported 102 species of birds on the key.

Pillsbury worked for the Audubon Society as the part-time warden of the key until it was destroyed by the hurricane of 1921, before hurricanes were named.

Natural sand flow rebuilt the key in time to be used as a bombing range during World War II in the 1940s.

In 1970, Passage Key was designated a wilderness area and remains one of the only undeveloped barrier islands in Tampa Bay. More than 50 species of birds roost and nest on the key, now a four-acre sandbar.

Since 1991, Passage Key has been closed to the public, although photography and fishing are allowed outside the boundaries of the refuge, much of which is underwater. Boaters routinely violate the law, contributing to erosion with boat wakes, boat beachings and hiking.

Anglers fishing with me on my Action Craft flats skiff the Snook Fin-Addict, out of CB's Saltwater Outfitters on Siesta Key, had action catching and releasing false albacore (little tunny) in the coastal Gulf and trout in Sarasota Bay on flies, CAL jigs with shad tails and DOA Deadly Combos and top water plugs during the past week.

Bill Moore, from Libertyville, Ill., caught and released a large false albacore on a top water plug in the coastal Gulf while fishing with me on Tuesday. He also had good action catching and releasing numerous trout near Stephens Point in Sarasota Bay on CAL jigs with shad tails and DOA Deadly Combos. Sarasota winter resident Mike Perez fly fished in the coastal Gulf with me on Wednesday and also had some action with albies.

City approves variance to stop lawsuit Mark and Katherine McLean asked for a variance to remodel their house to accommodate a wheelchair, but were turned down, so they filed a suit.

ANNA MARIA – Facing legal action under the Bert Harris Act and with time running out to negotiate a settlement, the city agreed Thursday night to allow Mark and Katherine McLean to remodel their house, even though it does not comply with the Living Area Ratio (LAR) that the city instituted to control the size of houses.

Just before the city commission meeting, Peter Mackey, the attorney for the McLeans, sent a letter to City Attorney James Dye offering two solutions: either the city pay $200,000 for loss of value plus an attorney’s fee of $12,502 and $945 in additional costs

or grant the variance that had been rejected.

“It’s unfortunate we couldn’t keep the lines of communication open,” Dye said. “One advantage to settling, though, is you shut off those legal expenses.”

The commission voted and agreed to allow the variance on a 3-2 vote with Commission Chair Chuck Webb and Commissioner Nancy Yetter voting against it.

The suit was the result of the city’s attempts to downsize the homes being built, especially the rental houses. Since then, the city has enacted a moratorium against permits to build houses with more than three bedrooms or rooms that could be used as bedrooms until the city fine tunes what it wants.

The moratorium has gone on for a month and at the end of the Thursday meeting, they decided to discuss the problem again on Thursday, Nov. 13.

In other news, the commission agreed to accept the appli-

cations of four citizens – Jenah Victor, Lynn Brennan, David Rogerson and Jeanne Deam – to be on the Environmental Education and Enhancement Committee (EEEC). The group was nearly disbanded last year but the city wants to bring it back to help with environmental projects.

Micheal Coleman said he wanted the group to recognize the fact that his wife, Jane, is still on the committee.

Also, the commission voted down the amendment to the sign code to allow homeowners to place for rent or for sale signs within 10 feet of the road, instead of 10 feet of the house, in cases where the home is set back from the road to the point where the sign would be unreadable from the road. They agreed to have staff monitor the situation and allow signs near the road on those lots where the house is set back farther than normal.

Remember, well maybe you don’t, when taking in lodgers was a sign that you were having problems making ends meet. Then lodgers were converted into guests and vintage homes with multiple bedrooms all around the country were turned into a bed and breakfast.

The latest incarnation of the lodger and bed and breakfast concepts is now renting rooms within your home to guests who would like to enjoy the benefits of living in your home for a short stay without the impersonal and expensive aspect of a hotel.

Now before I get myself in trouble here, I want to state there are taxes, both local and federal, you may be required to pay. Also, you need to determine what permitting and zon-

And as in any rental situation, fair housing rules apply, which prohibits discrimination based on race, religion, age, gender and more. Basically, if this is something that appeals to you, research would certainly be required.

So how does this work? First you need to be comfortable with a stranger living in your house. It can be a wonderful experience or it can be a nightmare, especially if your guest decides to invite the folks they just met at the local bar over to continue the party. Second, after cruising around the Internet, I determined that most homeowners who are mak-

ing rooms available to guest are providing basically a nicely appointed bedroom and a private bath. If there is also a private entrance better still. Most homeowners do not provide food or breakfast, but will allow guests some kitchen access.

Usually renters looking for private home accommodations are also looking for locations that are vacation friendly like beaches or ski resorts. Practically any home on Anna Maria Island with an extra bedroom would be attractive to short term vacation guests. And finding vacation renters is not all that difficult, especially with the beach within a short walk of your home.

There is a website called airbnb, Inc. devoted almost exclusively to matching landlords and renters. Airbnb has over 35,000 listings around the world. The property listing highlights location, amenities and pictures of both the property and the homeowner. There is a fee for both the guest and the homeowner.

After checking out the west coast on airbnb, including Sarasota, Treasure Island

and Anna Maria, I found the per night costs ranged from $50 to $90 for a bedroom with a private bath, and there was something for everyone, downtown Sarasota, Siesta Key, canal front, and walking distance to the beach.

What airbnb has created is what is coming to be known as the sharing economy. Consumers contract for short term use of their underused assets like homes or space in their homes, cars, boats and other possessions that can be easily rented to interested parties on a short term basis. Shared economy is different than commercial rentals offering more personal one on one interaction and usually priced better. You’re not renting a car from Avis to drive through New England for two weeks you’re sharing a private individual’s vehicle for a fee.

If you think your home is fabulous and you want to share it with others, the sharing economy may be something to think about.

Remember, they’re not lodgers, they’re guests, and you don’t have to cook them breakfast.

According to trial testimony, he ordered his crew to dispose of undersized grouper at sea, and officers calculated that three illegal grouper were missing when the boat docked at Cortez.

Yates, 62, was convicted and jailed for 30 days for disposing of evidence to prevent seizure and destroying evidence to impede or obstruct a federal investigation.

The latter charge was based on the so-called anti-document shredding provision of the Sarbanes-Oxley Act, which makes it a crime to “knowingly alter, destroy, mutilate, conceal, cover up, falsify or make a false entry in any record, document or tangible object with the intent to impede or obstruct an investigation."

Grouper aren’t objects

Yates’ attorney, John Badalamenti, argued that the provision should not extend to grouper, saying “The phrase ‘record, document or tangible object’ is confined to records, documents and devices designed to preserve information, the very matters involved in the Enron debacle.”

Former Ohio congressman, Michael Oxley, who sponsored the law, filed a friend-of-thecourt brief in support of the position.

“If you look against the backdrop of the Sarbanes-Oxley Act, there is plenty of support that Congress was targeting businesses, corporations and publicly traded companies,” Badalamenti said, to which Justice Ruth Bader Ginsburg replied, “Isn’t running a fishing vessel a business?”

“It doesn’t change the fact that ‘tangible object’ doesn’t mean everything,” Badalamenti said.

Grouper are objects

A grouper is a tangible object, attorney Roman Martinez argued for the government, and the missing grouper were evidence in the investigation, and were knowingly destroyed, according to trial testimony.

“Mr. Yates was given an explicit instruction by a law enforcement officer to preserve evidence of his violation of federal law. He directly disobeyed that. He then launched a convoluted cover-up scheme to cover up

the fact that he had destroyed the evidence.

He enlisted other people, including his crew members, in executing that scheme and in lying to the law enforcement officers about it,” Martinez said.

“You make him sound like a mob boss or something,” Chief Justice John Roberts said, getting a laugh.

‘Mad prosecutor?’

The court grilled Martinez on whether the law would apply to a recreational fisherman who throws a trout into a lake when approached by an officer or a camper who extinguishes an ember from a prohibited fire or a hiker who picks a protected wildflower and throws it away.

Prosecutors have discretion whether to charge suspects, he replied. In Yates’ case, prosecutors did not object to a 30-day sentence, a fraction of the potential 20 years the offense carries.

“But he could have gotten 20 years. What kind of a sensible prosecution is that?” Justice Antonin Scalia asked. “What kind of a mad prosecutor would try to send this guy up for 20 years or risk sending him up for 20 years?”

Martinez said that federal justice department guidelines authorize prosecutors to charge the most severe penalty possible for an offense. Scalia responded that Congress SEE YATES, PAGE 39

HOLMES BEACH – The dream of an Island-wide bicycle path may be closer to reality thanks to Commissioner Marvin Grossman.

Grossman invited Florida Department of Transportation District Secretary Billy Hattaway to the Island to drive its streets and discuss the issue last week.

Also joining the meeting were Mayer-elect Bob Johnson, Police Chief Bill Tokajer and Anna Maria Commissioner Doug Copeland.

“I had thought of Holmes Beach as Phase I, and then we would go north to Anna Maria,” Grossman explained. “There’s plenty of demand. The mayor told me that one weekend during last season, there were 1,500 bikes rented.

“At that point, I saw the need for safer places to ride. Both visitors and Island residents will want to use it.”

Grossman said in addition to the bike path, there are plans to reduce the speed limit on Marina Drive to 25 mph and reduce traffic on Marina Drive by diverting a third of it to Gulf Drive.

Tokajer said coming south from Anna Maria, Gulf Drive is used by only one-tenth of the vehicles and added, “We tried to change that by putting up a sign, but that didn’t do it.

“The speed limit is 35, but a study I did showed that over 50 percent of the cars are going less that that. Only .06 percent of the almost 300,000 vehicles I counted in a month’s time were going 10 miles over the speed limit.”

Tokajer said there are not a lot

of traffic accidents in the city, even with bicycles, and that the city has added pedestrian crosswalk signs in the streets, which have been effective.

The group then went on a citywide drive to view the streets.

Following the drive, Grossman said that Hattaway said he would review projects in the area and ask for the department’s bicycle specialists to perform a study and make recommendations for the three cities.

City parks topic of panel discussions

HOLMES BEACH – Beautification board members elected Bob Longworth as their new chairman and then discussed several of the city’s parks at their first meeting since their summer hiatus.

Member Jerry West said the park at 6807 Homes Boulevard, which some call the FEMA park (Federal Emergency Management Agency) needs a name. He felt the city commission should name it.

The park is called the

FEMA park because that agency paid the owners to demolish their home after declaring it a repetitive loss property due to frequent flooding.

The city then obtained ownership of the lot and landscaped it as a community pocket park.

West said the city is seeking grants for Grassy Point for Phase I – a boardwalk from Easy Bay Drive to the park and Phase II – a boardwalk from the park to the water.

Commissioner Jean Peelen is writing a proposal to seek funding from the Manatee County Tourist Development

Council, and Building Official Jon Betcher is seeking a grant from the Florida Department of Environmental Protection.

West also pointed out that the plants in the park at the traffic triangle at Key Royale and Marina drives are the wrong type for the location because they grow up too fast and are a hazard to drivers.

Longworth said the drainage in the large dog park needs work, and West made a motion to ask the public works department to address the issue.

City attorney to sit out forfeiture proceedings The city commission will go it alone when they present formal forfeiture charges against Mayor Bill Shearon.

BRADENTON BEACH – City Attorney Ricinda Perry will not be an active participant when the forfeiture of office proceedings against Mayor Bill Shearon resume.

Having guided the commission through the formulation of the city’s new forfeiture of office resolution, Perry requested that she be allowed to sit out the forfeiture efforts directed specifically at Shearon.

The commission discussed Perry’s role in the proceedings during the Thursday,

Nov. 6 meeting, when trying to determine a date to conduct the next forfeiture meeting, at which the charges against Shearon will be formally presented. Due to the commissioners’ individual schedules, Perry the next forfeiture meeting is not expected to take place until after Thanksgiving.

“I need to understand my role with respect to this particular issue,” Perry said, when discussing her future participation in the forfeiture process.

“My personal preference is I prefer to opine in my capacity as the city attorney on general city business and not function as the city attorney advising the commission in the actual forfeiture proceedings themselves,” she said.

“I saw no issue with respect to providing advice to the commission on the resolution because that was general policy and it was not specific to the forfeiture proceedings (initiated against Shearon). A lot of people tried to make it specific, but it’s not; it was to be very general for the city,” she said of the resolution that is applicable to any future forfeiture efforts as well.

The commission was divided on whether they wanted Perry to attend the next forfeiture meeting. Clarke and Commissioner Jan Vosburgh said they would preferred Perry to be present when the charges against the mayor are presented.

Shearon shared his belief that it would be a conflict of interest for the city attorney to represent one faction of the commission against another, while also serving as the city’s general counsel.

Commissioner Janie Robertson felt it was up to Perry to make the decision on her own, and at her own risk.

In the end, the commission unanimously agreed to honor Perry’s request and they will now have to go it alone when the forfeiture proceedings continue.

The recently approved forfeiture resolution does allow the commission to request outside legal counsel or guidance from the city’s special master, attorney William Robinson Jr., but commission members hope to avoid saddling the city with additional legal fees unless absolutely necessary.

After the meeting, Perry said she felt confident in the commission’s ability to guide themselves through the presentation of formal charges against Shearon, and once that is done, they can determine their future legal needs as the process moves forward.

Parking fines increased Last week, Bradenton Beach Commissioners approved on second reading an ordinance that increases fines for motorists who violate the city’s parking laws. The fine for parking in a handicapped space is now $200, rather than $150. All other parking citation fines were increased from $30 to $35. Ordinance 14-446 also allows officers to issue citations for parking on a city right of way or city roadway, and all delinquent fines not paid within 30 days are subject to a 35 percent administrative fee.

Cell tower coming soon According to Alpha-Omega Communication Managing Director Jim Eatrides, the construction of the Bradenton Beach cell tower should be completed by the end of November.

“But I think the key point is Sarbanes-Oxley prohibits the destruction of fish,” Martinez replied, “and if you stop someone on the street and ask them ‘Is a fish a tangible object?,’ the answer would almost certainly be, would be ‘Yes.’ ” The justices also probed the attorneys on how far the law might reach, debating whether other things could be considered objects under the act, from a photographic print of a fish or a catch log recording a fish’s catch to information stored in the cloud.

At the end of Martinez’ argument, Justice Anthony Kennedy quipped, “Perhaps Congress should have called this the Sarbanes Oxley Grouper Act,” prompting laughter.

Yates reaction

It’s no joke to John Yates, who has not been able to make a living commercial fishing since the day in 2007 his boat was boarded.

He did not attend the hearing, but talked about things on Saturday that have always bothered him

about the case.

The fish were not properly measured, he said, citing a difference between measuring them from the lower lip or the upper lip, and saying that the officer pushed on the mouths of the fish, making them appear shorter. He also has maintained that the fish measured shorter on the dock after being on ice than they were when they were measured at sea.

Yates said he doesn’t understand why he could be convicted for throwing fish overboard when the lower court found him not guilty of a third charge, lying to a federal officer about throwing fish overboard.

He suspects the credibility of a witness that testified that Yates ordered the crew to throw fish overboard because the witness said during proceedings that he didn’t want to go to jail.

Yates said he no longer fishes because “There’s a target on my back.” He runs a shop with his wife in Cortez called Off the Hook. The appeal is not costing him anything, he said, because he’s represented by a federal public defender.

Yates’ wife, Sandy Yates, and their daughter attended the hearing.

Sandy Yates said her impression after seeing the court in action was that the justices were “indignant” when Martinez spoke about “throwing the book” at her husband.

“The whole court seemed livid,” she said, adding that it seemed the case may go their way. “By the tone of it, I can’t see it going any other way, but you never know. You can’t predict them.”

A decision is expected by spring/summer 2015.

On the road to the championship game

Division III (8-to-10-year-olds) – Feature Youth Game of the Week

Monday night found the four remaining teams in Division III youth soccer go head-to-head at the Anna Maria Island Community Center in the semi-finals.

The night’s first game was a showdown between the second place season finishers, Bowes Imaging Center, and the third seed team, Miller Electric.

In goal to start the game for Miller Electric was Nicholas Yatros, with the other goal covered by Tres Maddox. With solid defensive play by Luke Bowes and Mariella Ferrari, Bowes Imaging was able to hold Miller Electric to just one goal after one half of regulation

play. Twenty minutes into the game found Connor Allan and Gavin Johnston down by Bowes Imaging’s goal.

Allan’s assist to Johnston’s goal brought the half to an end with the score of 0-1.

The half saw defensive prowless by Aubrey Barkley, Juliet Greene and Kylie Huffman, accompanied by huge stops made by Ozzy Lonzo.

The second half of the game continued the defensive battle. Max Higgins had an amazing stop in the goal for Miller Electric four minutes into the half, as well as continued defensive efforts by Connor. In the 15th minute of play in the second half, Kiera Johnston carried ball down the field to score the second goal for Miller Electric. The second half saw outstanding offensive play

With Yatros in goal, Cole Pearson came from mid-field to score a goal for Bowes Imaging just before the 19th minute of the second half. Bowes Imaging had its chance to tie up the game when the goalie Yatros dropped the ball in the box and picked it up again causing a handball penalty. Despite a valiant effort, Bowes Imaging missed the penalty shot and the game ended with a 1-2 score.

Miller Electric moved on to the Division III finals to face the #1 seed AMI Donuts which won its semifinal game against Tyler’s Ice Cream the #5 seed 4-2. Both goals for Tyler’s were scored

ler for AMI Donuts. The winner of the game on Monday, Nov. 10 will be named the champion for the youngest age group in the Center’s non-instructional recreational league.

Division I (14-to-17-year-olds)

Divison I soccer finished out its regular season Monday, Nov. 3 with a 4-4 tie between AMI Fitness and Wash Family Construction. Nico Calleja had three goals, and Cortini Wash had a single goal for team Wash Family Construction. Both Lucan Heffernan and Tyler Pearson had two goals in the game for AMI Fitness.

These two teams played one last time in their championship game on Monday, Nov. 10.

At the Anna Maria Island Community Center, the soccer season is kicked off with a pasta dinner fundraiser by the Beach Bistro and regular season play ends with a night of awards and cheer. With more than 20 teams of children from three to 17 years of age, trophies and medals were received by all of the soccer players.

In addition to the team awards, six special awards were presented for the non-instructional divisions.

Hayward is an individual who has been a huge influence on the youth and adults on Anna Maria Island. The first annual Smiledeep award was presented to: Division III (8-to -10-year-olds): Reese Riley Division II (11-to-13-year-olds): Lilah Bowers Division I (14-to-17-year-olds): Cooper Hardy Unfortunately, Hayward could not be present at the awards ceremony.

Despite living with stage 4 renal cancer, Hayward continues to work as a middle school soccer coach at St. Stephen’s Episcopal School. A fundraising benefit, raising more than $7,000 was held for Hayward earlier this year.

To him, Smiledeep is when your heart and soul smiles and is a way to think positive every single day.

Eason Builders takes down Jessie’s Island Store

With only two games remaining in the regular season of the adult co-ed soccer league at the Anna Maria Island Community Center, Jessie’s Island Store found itself undefeated and without one of its key players, Matt Kretzman. Eason Builders, having only lost two games during the season, took full advantage of the situation.

Five minutes into the first half saw Matt Plummer with a strong strike into the goal making the score 1-0 early in the game. Nearly 21 minutes of play went by

before the next goal. Less than one minute after the second half kick-off, Sean Sanders for Eason Builders scored his only goal of the game. Scott Eason followed with two more goals back-to-back in the 3rd and 4th minutes of play.

Plummer quickly answered back with his second goal in less than a minute, pushing Eason Builders further into the lead 5-1. More than 60 players participated in Fall Stag Day at Key Royale Club Thursday, Nov. 6.

Individual low gross and low net honors went respectively to Tim Friesen ( score of 32) and Wayne Patterson (score of 27). The winning team with the lowest combined score was composed of Larry Solberg, John Purcell and Peter Solleveld with a score of 121.

As in past years, Mixon Insurance sponsored hole-inone prizes including $10K, golf equipment and a Kindle Fire. While no one recorded an ace, Larry Pippel did have closest-to-the-hole on number 8 at 12 inches – any closer and Larry would have claimed $10K in prize money.

Commission reverses stance on e-mail software The recent passing of the city’s e-mail administrator forced the commission to rethink its software needs.

BRADENTON BEACH – Last week, the city commission did a 180 on the use of the much-debated Microsoft Office 365 e-mail software. The software was purchased earlier this year, but never put into use.

During the special commission meeting that took place Monday, Nov. 3, the commission unanimously supported Police Chief Sam Speciale’s recommendation to convert to the Office 365 e-mail software as soon as possible. In addition to his duties as police chief, Speciale serves as the city’s in-house computer guru.

The recent death of e-mail administrator Ric Gatehouse led Speciale, Vice Mayor Jack Clarke and Commissioners Ed Straight and Jan Vosburgh to reverse their previous opposition to the Microsoft software purchased by former City Clerk Jamie Anderson, with Mayor Bill Shearon’s blessing.

Last week’s decision was a political victory for Shearon, who along with Commissioner Janie Robertson, supported the Office 365 system all along; and Robertson is pleased that users will be able to create their own passwords, rather than using passwords assigned by Gatehouse.

When the Office 365 purchase was debated last spring, Clarke, Straight and Vosburgh opted to renew Gatehouse’s contract and use his revamped system instead. The commissioners then took exception when the 365 software was purchased without their consent, using savings produced by computer purchases made through a county-approved vendor.

Shearon and Anderson were criticized

for the purchase, and it later played a role in Anderson’s dismissal.

Forgoing the opportunity to rehash old battles, Shearon said, “It’ll be a good system. We’re looking into getting some training, and there’s all kinds of Microsoft tutorials online. The changeover should be relatively painless.”

When Gatehouse died, England-based software engineer Keiron Skillett inherited ownership of the e-mail system Gatehouse designed and maintained for the city. He also inherited the domain names associated with the city website. Skillett told Speciale he would return the domain names to the city and said he had no issues with the city converting to the 365 software.

Faced with the option of forming a new working relationship with an overseas administrator or converting to Office 365, the commission opted for the later.

“I’m ready to move forward; I don’t think we can deal with someone who lives in another country,” Straight proposed.

When the Office 365 purchase was first discussed, Speciale and Straight expressed concerns about the security of a cloudbased mail system.

Addressing those concerns last week, Speciale said, “It’s not as secure as having the drive physically in hand, but they’re public records anyway.”

Speciale said the Office 365 e-mail archiving system would make it easier for the city to respond to public records requests.

James Martin and Friendly IT Management will assist the city with the conversion and users will have ongoing Microsoft support.

The one-year software licenses purchased early last year for approximately $4,000 will have to be renewed on an annual basis, beginning in early 2015, and the city will also incur an annual technical support fee.

The defendant gave a false name, but the deputy was able to find her real name and she had several out of state warrants.

When he approached her to arrest her, she ran, but fell a short time later, and he handcuffed her.

Jeanne M. Parrish Jeanne M. Parrish, 95, Bradenton, passed away on Nov. 3, 2014. Jeanne was born on Dec. 2, 1918 in Donalsonville, Ga. The family moved to Bradenton in 1925. She attended Ballard Elementary and was a graduate of the class of 1935 from Manatee High School. She went on to receive her bachelor’s degree from FSU and began her teaching career in 1940 at Manatee High School.

While at MHS she taught English and served as the chairman of the English Department. During her 37 years as a teacher, it is estimated she taught between 7,000 and 8,000 students, many of whom went on to become prominent leaders of Manatee County. She was also sponsor of the Domestic Exchange for 18 years, accompanying

11/5. 11:41 p.m., DUI, refusing to submit to a breath sobriety test after license suspension, 11600 block of Cortez Road West. The deputy stopped the driver, who appeared to be confused. He could not get his driver’s license as requested and was disoriented and incoherent.

He failed the field sobriety test and refused to submit to a breath test. The deputy found out the driver had previously refused to submit to a breath test as well.

She was a member of the Original 13, life member of Entre Nous, served as a captain at the U.S.O. during World War II, worked part-time as a funeral assistant for Shannon Funeral Home Westview Chapel for several years, was a member of the First Presbyterian Church and former member of Kirkwood Presbyterian Church of Bradenton.

Jeanne was honored as an outstanding teacher by the Kiwanis Club of Bradenton and received the District Star Teacher award in 1966. Another honor occurred at Hawkins Stadium, where she was named the 2008 MHS Outstanding Alumni. Jeanne celebrated her 90th birthday by taking her first hot air balloon ride, which was a gift from her son, Paul.

Jeanne was predeceased by her loving husband Paul in 1993 and is survived by her greatly loved son, Paul, of Bradenton, a sister, Helen Aderhold, of Atlanta, Ga., and two granddaughters; Debbie and Tracy, of Atlanta, Ga. license, 3400 block of Gulf Drive. The officer stopped the defendant after learning from the computer system that the driver’s license had been suspended. The driver said she did not know her license was suspended. The officer ticketed her, her tag was seized and her car was towed.

10/25, 4:41 p.m., driving with a tag that is not assigned to the vehicle, possession of marijuana and paraphernalia, 5500 block of Marina Drive. The officer ran a computer check on the defendant’s vehicle tag, and it was assigned to another vehicle. As he approached the car, the officer saw the defendant had pink hair and appeared agitated. He admitted to putting a tag on the car without registering it and not owning a driver’s license. It had been suspended, according to the computer check.

When asked to step out of the car, the defendant admitted there was marijuana in the console. He also found rolling papers and a grinder. The defendant’s wife arrived and took construction equipment and a cooler from the truck

Born in Poland, Ohio, on March 19, 1940, to Lewis and Lilian (Schofield) Carlson, Sheralyn graduated from Poland High School in 1958 and got her bachelor’s degree from Kent State University in 1962 and a master’s degree from John Carroll University. She taught in the Poland School System for two years before moving to Chagrin Falls, where she taught for many years. She moved to Florida on June 27, 1992. She loved bridge, pool aerobics, her dogs and going out with friends.

The victims later called to say a man returned their purses, but not everything of value. He said he found them on the Skyway Bridge, and he possibly knew who took them. The victims, who live out of the county, were unable to return to Holmes Beach, but the office promised to inform the detective about this development.
