Double bonanza in the offing The fourth APREDA Property Show, the biggest real estate extravaganza of the year kicks off at HITEX, Madhapur in Hyderabad from 25th to 27thOctober, 2013. Overwhelmed by the immense response from the last three shows this year it is a three day event. It has been a great platform to bring together the real estate developers and prospective buyers from across the state. Just like the three previous shows this year too it is expected to be a triumphant run with even higher turnout of crowd. The Property Show presents a dual bonanza for you. On one hand it gets you some intellectual enlightenment through the day- long conference on the opening day of the show. ‘Staying Ahead in Real Estate- Innovative Construction and Taxation’, the topic for the conference gives deep insights on innovative construction techniques and impact of taxation to various stakeholders to enhance the growth of the Indian realty sector. APREDA property show has become an annual event inscribed on the city’s calendar. All in all the judicious mix of participants present a promising opportunity to all those on the lookout for their own ‘Home- Sweet Home’. The reason for this mega-event expected to be a big success is the exemplary teamwork and unending hours of toil, members of APREDA have put in the months gone by. Given the present realty market scenario of Hyderabad after the announcement of bifurcation of the state, addressing the concerns of the readers the cover story in this special edition of ‘Horizons’ analyses the current market situation and the prospects ahead for brand Hyderabad. National Lower priced houses promise a big opportunity

L

ow-income urban families need 15 million homes in a price range of Rs 4-10 lakh, presenting an untapped opportunity of a whopping Rs 9 lakh crore for real estate developers and Rs 7 lakh crore for housing finance companies, according to a report by Deloitte India. At least 30,500 housing units were launched below Rs 10 lakh by private developers across 22 cities between June 2011 and January 2013. There is an increased interest in supplying housing and housing finance to lowincome customers but the gap between supply and need is huge, according to the report ‘State of the Low-Income Housing Market’ launched by Housing and Urban Poverty Alleviation ministry. “There is a large proportion of low-

income urban families, with a monthly household income of Rs 10,00025,000, who can afford privately built formal housing costing Rs 4-10 lakh without any aid from the government. The

housing finance, which was almost nonexistent for these low-income customers 5 years ago, is now accessible with over 10 housing finance firms lending to low income customers.

IRDA allows higher investment in housing finance companies

T

o facilitate flow of funds to housing finance sector; the Insurance Regulatory and Development Authority (IRDA) has enhanced exposure limits of insurance companies to housing finance companies. Insurance companies’ single company exposure limit including debt and equity has been raised to 20 per cent from existing 10 per cent. It can be

further raised by another 5 per cent after the approval of the board of directors. “Single investee debt exposure limits in housing finance companies are enhanced to 20 per cent of equity plus free reservesexcluding revaluation reserve plus debentures/bonds taken together,” IRDA said. The regulator said that the group and promoter group exposure norms will

continue to apply on the investments made in housing finance companies. Investment into a single group companies is capped at 15 per cent of the insurer’s fund size. It was a long pending request from the industry. Also, investments in housing finance companies and infra finance companies will be brought under exposure to housing sector and infra sector.

Amendments to Registration Act to help land owners

A

bill to amend the century old Registration Act, was introduced in the Rajya Sabha. It will help in implementation of the Land Acquisition legislation and allow land owners to get market value for their land. Certain proposed amendments in the Registration (Amendment) Bill, 2013, are being brought to ensure greater accuracy in calculating land values thereby benefiting land owners. If the amendments brought to the Registration Act, 1908 are cleared by Parliament, it would necessitate “update and record” of the market value

of the land in the changed scenario, officials of the rural development ministry said. Thus the farmers, whose land is acquired for various projects, would get “real market value” under the Right to Fair Compensation and Transparency in Land Acquisition, Resettlement and

Rehabilitation Act 2013, officials said. However to calculate this amount, the formula relies on the registered value which are, at present, notoriously opaque and often outdated. If registration is made mandatory (and hence frequent) and if it can be vetted/reviewed by members of the general public. Then with the passage of time accuracy in the reporting of land rates will emerge particularly in rural areas. The new amendments to the Registration Act will ensure greater accuracy in helping identify/determine beneficiaries (through clear titles).

National Changed FDI norms to attract mid-level developers

T

he government has proposed easier guidelines for allowing 100% foreign direct investment (FDI) in real estate, hoping to attract mid-level overseas developers to invest in the country. The housing and urban poverty alleviation ministry has sent revised policy guidelines for FDI in the real estate sector to the department of industrial policy and promotion. The ministry has proposed reducing the minimum carpet area to be built in FDI-linked real estate projects to 20,000 square meters from its earlier requirement of 50,000 sq. m. As EIA (environment impact assessment) clearance is not required for a builtup area of 20,000 sq. m. Also, such projects will not merly be restricted to

metro cities and all class 1 cities having a population of more than 100,000 will be included. The ministry found that the criteria of 50,000 sq.m. was restrictive for developers, and the high cost and scarcity of land in cities also prompted it to lower the requirement. The reduction in built-up area and size of projects will allow mid-sized and smaller developers with good track record better access

to FDI. According to the ministry the requirement of a minimum land area of 10 hectares for serviced housing plots should not be reduced. “If we allow smaller plots then it will promote construction for the rich, but we are bothered about affordable housing,” the official said. The ministry has said the changes will encourage developers to come up with low-cost housing projects. The ministry has also proposed lowering the minimum capitalization for wholly owned subsidiaries from $10 million (Rs.60 crore) to $5 million. For foreign developers entering into real estate joint ventures with Indian partners, this has been proposed to be lowered to $2.5 million from $5 million.

inister for Housing and Urban Poverty Alleviation Dr. Girija Vyas has called upon the realty sector to come forward and participate through capital and technology for upgradation and creation of affordable housing stock and help the government

build an inclusive India. Talking at the conference organized by CII she, exhorted the realty sector to come forward to supplement the government’s efforts. “In a country like India, where housing represents a key component of economic growth, contributing 5

percent to the GDP and there still being a shortfall of 18.7 million units, improvised building technologies are required to promote mass housing and economies of scale. It could go a long way in addressing the housing shortfall,” Dr. Vyas said.

Govt to promote ‘public-private partnership’

T

he government plans to give a fresh impetus to public-private partnership by overhauling the framework for such projects on the basis of a study being undertaken by the Planning Commission. The move comes after a few big PPP projects in infrastructure sector fell apart while those in the power sector have been struggling to sail through. “We are doing some analysis internally as to what are the kinds of problem that PPPs face. To illustrate these problems, which the government is worried about, we are doing a detailed study of four PPP projects and will come out with a paper to make the entire PPP more attractive,” Montek Singh Ahluwalia, deputy chairman of the

identified by the panel. This year, GMR and GVK walked out of mega-highway projects worth 10,700 crore envisaged with the National Highways Authority of India while Reliance Infrastructure recently pulled out of the 5,800 crore Airport Express Line of the Delhi Metro. Though the private sector’s participation in infrastructure PPP projects has grown substantially from 10% in the 10th FiveYear Plan to 37% during the 11th plan, the government feels it will be difficult to attract the estimated 50% of the $1 trillion investment in infrastructure in the country during the 12th plan period from private players unless the contractual issues are resolved.

National Exit route likely for FDI in unviable realty projects

R

eal Estate companies will be allowed to sell undeveloped plots through the automatic route, subject to clearance by the Foreign Investment Promotion Board, in cases where development cannot happen because of land or legal disputes or other economic, social and political reasons. Currently, FDI regulations do not permit an investor or investee company to sell undeveloped plots. If approved, this will enable companies to exit unviable projects. However, the ministry has proposed that company needs to submit an auditor certificate, saying

the transaction (land disposal) has been undertake on a no-profit basis under such exceptional circumstances. Under the new

proposal, the Indian company, or the recipient of FDI, will be responsible for obtaining all necessary approvals, including building/layout plans, developing internal and peripheral areas and other infrastructure facilities and complying with all other requirements as prescribed by regulations of the state government and the municipal or local body concerned. According to the MoUD, this will have a positive impact on the joint ventures to be set up by foreign investors and provide greater clarity to the foreign investor community.

SEBI revives plans for Real Estate Investment Trusts

S

eeking to attract real estate investors to the capital market, Securities and Exchange Board of India (SEBI) has revived an over fiveyear old proposal to allow listing and trading of REITs (Real Estate Investment Trusts) as an investment product. The move is aimed at allowing investors to buy and sell units of REITs and providing them an investment vehicle for the real estate sector, similar to mutual fund and Exchange Traded Fund structures for stocks, bonds and other securities, a senior official said. However, initially it is considering to restrict the investments in REITs to only foreign funds, domestic institutional investors and HNIs given the higher level of risks associated with the real estate sector, a SEBI official said,

adding that small retail investors could be allowed at a later stage. The move is likely to help channelise investor interest towards REITs, while leaving the physical real estate market (comprising of housing units and office spaces) for the end users thus helping the market reach a pricing level based on real demand and supply metrics. As per the proposal being considered, REITs can issue units of their investment schemes through a public offer and list them thereafter on a stock exchange in a way similar to the issuance and listing of shares during an IPO. Thereafter, the units can be traded on the stock exchange platform just like shares. The money collected by the REIT through the public offer can be used for development of real estate projects as

per its stated objective disclosed in the offer document.

SEBI allows 73 AIFs to operate in India

M

arket regulator SEBI has allowed 73 entities to set up Alternative Investment Funds (AIFs) -- a newly created class of pooled-in investment vehicles for real estate, private equity and hedge funds -- in the past one year. The 73 AIFs have been registered with the SEBI since July 2012. SEBI had allowed 49 AIFs to set up shop in the

country till April, and the number has increased to 73 now. The AIFs that have registered include KKR India, Arth Capital, Landmark Opportunity Fund, HBS Raksha Movies, Tata Alternative Investment Fund, Monsoon Alternative Investment Trust, DSP Blackrock Alternative Investment Fund and Edelweiss Alternative Investment Trust. The regulator had notified the guidelines for

this new class of market intermediaries in May 2012. AIFs are basically funds established or incorporated in India for the purpose of pooling in capital from Indian and foreign investors for investing as per a pre-decided policy. The SEBI rules apply to all AIFs, including those operating as private equity funds, real estate funds and hedge funds, among others.

National Government to scrap slow-moving highway projects

T

o revive India’s stuttering highway building efforts, the government may scrap several existing contracts that are making little progress on the ground. The road transport and highway ministry has asked the National Highways Authority of India to review all languishing projects and identify those that can be terminated on contractual grounds, so that they can be bid for all over again. The move comes in light of the fact that several projects awarded in recent years are either stranded midway or have been complete non-starters. The road ministry also wants the same clarity for those stalled projects that could benefit from deferral of premium payments. It will recirculate a Cabinet note on its proposal to allow financially stressed developers to defer payments of premium projects that they had committed to pay to win

the highway projects. An additional option of cancelling the projects and

re-bidding them would now be included in the note.

Companies Bill 2013 receives President’s assent

T

he new Companies Bill has received President’s assent that will make it into a law replacing the nearly six-decade old regulations that govern corporates in the country. The Companies Bill 2013 received assent from the President Pranab Mukherjee recently. The new Bill provides sweeping changes in the way companies operate and are regulated in the country, received Parliamentary approval earlier this month. It would replace the Companies Act 1956. The Corporate Affairs Ministry is in the process of making the rules for the new legislation. The draft rules, expected to be ready in two weeks, would be put out on the

ministry’s website. After this, stakeholders and general public, among others, would have up to 60 days to provide their comments. Corporate Affairs Minister Sachin Pilot had earlier said the government plans to adopt a transparent and interactive process to finalise a detailed set of rules to be adopted under the new Companies Bill. The new Bill requires companies to spend on social welfare activities, empowers investors against any frauds committed by promoters, encourages companies to have women directors, and seeks to bring in greater transparency in corporate governance matters.

Builder can’t sell parking space

T

aking note of a Supreme Court judgment, a consumer forum has ruled that a developer can’t sell parking space and directed Tata Housing Development Company Limited to refund Rs 50,000 along with a compensation of Rs10, 000 to Ghatkopar-based Suresh Mehta in Mumbai. Mehta had purchased

a flat along with parking space at Betegaon, Palghar for Rs 17.44 lakh on June 30, 2010. But filed a complaint against the builder upon coming across a judgment, which held that a builder can’t sell stilt or open parking as it was part of the common area of the society. While Rs 50,000 was for car parking, another

Rs 50,000 was taken as club house development charges. Mehta said that in August 31, 2010 he came across a judgment. The judgment also held that once the Occupation Certificate is issued by the corporation and society is formed, the developer ceases to have any title on the open space.

National Realtors embrace new technologies to cut costs

R

eal estate developers are increasingly cutting 10-15 per cent of their costs by adopting new construction technologies. At a time when buyers are complaining about developers not sticking to delivery schedules and delays stretching for three-four years, these technologies have come as a boon. Along with reducing the time taken to complete units, these technologies also help overcome labour shortage and tackle the rise in input costs. Now, precast technology and prefabricated structures are common in the realty sector. As the structure/wall panel/block is pre-built in this case, the time taken to complete a unit is reduced manifold. Brotin Banerjee, managing director and chief executive of Tata Housing, says the

adoption of technology by the Indian realty sector has been slow, though it has picked up pace. “Over the past five years, there has been a shift in the trend. With growing labour shortages and increasing input costs, developers need to bring in new technologies to

not only to save costs, but also improve the quality of construction,” he said. “We have used low-cost technologies and raw materials such as reinforced concrete blocks, precast hollow blocks, precast lintels, floor tiles and prefabricated panels and polymer panels for doors and windows. We have reduced construction costs 20-30 per cent. We have also been able to save seven-10 per cent of costs compared to conventional construction,” he added. An analyst tracking the sector said, “We will see more and more developers opting for technology innovation in construction. Apart from saving on costs, the developers are focusing on quality and timely delivery, which would also improve their brand value.”

Challenges facing AP’s Cement Industry

he cement industry in AP is expected to be least impacted by the creation of Telangana. This

industry in the State is predominantly concentrated in the Telangana region, which has most of the limestone

deposits. In fact, the units located in the region have easy access to the markets of Karnataka, Maharashtra and Odisha while those in Seemandhra region are in proximity to Karnataka and Tamilnadu. Nearly 55 per cent of the units and production come from Telangana with the highest concentration of cement plants in Nalgonda district followed by Ranga Reddy and Adilabad. This is followed by Jaggayyapeta, Krishna district and near Guntur in Andhra region. In the Rayalaseema area, units are spread across Kadapa, Kurnool and Anantapur districts. However, the cement sector itself is going through tough times with power cuts and slow down in the realty sector and significant drop in funds for Government housing and irrigation projects. This has led to increase in prices, which are hovering around Rs 300 per 50 kg bag and simultaneous cut in production (average of 50-60 per cent of capacity).

Hyderabad GHMC proposes massive development

T

he Greater Hyderabad Municipal Corporation (GHMC), which bagged several projects under the phase-I (2005-2012) of the Jawaharlal Nehru National Urban Renewal Mission (JNNURM), has proposed projects costing about Rs 870 crore under its transition phase. The works proposed under the transition phase include construction of a flyover at Tolichowki, solid waste management, rail under bridge (RUB) at Uttamnagar, remodelling of nalas, laying of link road from Raj Bhavan to Begumpet, widening of roads like Yellammabanda road, Botanical Garden Road and development of JNTU (Kukatpally-Mind Space) road. The state-level committee on JNNURM works cleared the proposals

for these projects recently and they would be sending them to the Union ministry for urban development soon. The projects are slated to be completed in three years of the Centre giving clearance. The JNNURM scheme was launched by the Union government in 2005, mainly to improve infrastructure in cities. The

yderabad is a centre of initiatives, especially for home buyers. The city is converting land records— one of the severe pain areas while authenticating ownership rights— into digital form. As reported earlier the property registration procedure would also be online. Recently, the city administration provided digital tablets, popularly called tabs, to tehsildars of 16 mandals. The devices will be used to update land records. They are equipped with customised software applications and all tehsildars are instructed to feed land-related

Hyderabad Integrated building approvals to check graft

I

n a bid to bring in transparency, avoid delays and check corruption the GHMC has decided to integrate online building approvals with occupancy certificates and property tax assessment. An experimental study of accepting online applications was started a couple of days ago by the GHMC’s town planning wing. Full-fledged implementation of online clearance would begin in a month as the municipal administration and urban

development (MA&UD) department is expected to issue the relevant GO in the next couple of weeks for the initiative. GHMC officials said once the online application and approval system for building application starts, building permissions would be cleared in 15 days at circle and zonal-level (for buildings up to ground and four floors) and highrise applications would be cleared in 30 days at the head office-level.

Map-based search engine makes your house hunt easier

H

ousing.co.in, a map-based real estate search portal, offers this approach to buyers who go house hunting for either buying or renting the flat. Slow down pushes Lanco to cut 4,000 employees

H

urt by subdued markets and economic slowdown, Lanco Group, which has interests in infrastructure, power and realty segments, has retrenched about 50 per cent of its 8,000 workforce during the last 15 months. The Group has cut down its workforce to 4,000 by the end of March this year and around 400 employees so far in the current fiscal. The Group currently has 4,100 to 4,200 employees, sources said. Most of the employees were taken in anticipation of various projects taking off, which has not happened. When contacted, T Adi Babu, Lanco CFO, merely said: “The headcount of the company, including international business, will be 5,100.” According to the latest annual report of the company, Lanco had trimmed its employee expenses, including recruitment and training, to Rs 632 crore during 2012-13 as against Rs 736 crore in the previous fiscal.

Is realty coming out of log jam?

A

fter being hesitant for many years, Congress Working Committee finally gave in to endorse the division of Andhra Pradesh and grant of statehood to Telangana on 30 July 2013. It was followed by agitation in coastal Andhra and Rayalseema regions and the strikes by the government staff against the division that led the state administration and the industry to slip into “a state of pause� in the last two months and delaying the whole process. This period of transition witnessed i n t e n s i v e politicking b e t w e e n various political parties and within the leadership some against the decision, while others for it. Finally the dust appears to be settling down with Union Cabinet endorsing the bifurcation of Andhra Pradesh, giving its approval to the formation of Telangana state and the ongoing strikes by the government staff being called off. The Group of Ministers (GOM) appointed by the union cabinet to prepare the draft Telangana bill is looking into the legal, administrative and other aspects in consultation with all concerned quarters and has had a couple of meetings so far. Efforts are on to prepare the bill and send it to AP assembly by November end to go ahead with the process. The terms of reference are yet to be framed by the Centre for the administration of the two new states and

The people are clueless whether it will be declared as the capital of Telangana with Article 258(A) of the Constitution invoked, where functions like police, public order and land management are entrusted to the Union government on the lines of the present set up of National Capital Region (Delhi). According to the second option it becomes the combined capital of the two states for a period of 10 years, subsequently it would be the permanent capital of Telangana while a new capital would be carved out for

Going by the normal course of constitutional process it may take at least 7 to 8 Months for the formal creation of Telangana state. It could take much more time if the stake holders are not able to arrive at a suitable formula for addressing issues related to sharing of water and other natural resources, revenue, infrastructure, and other concerns over long-term investments, administrative issues and the conduct of upcoming general elections scheduled to be held early next year. According to an estimate, Hyderabad alone generates over `75,000 crore (IT and ITES services contribute `42,000 crore to state government) through various taxes and fees contributing over 50 per cent of the total revenue for the state government and therefore poises as a formidable bone of contention for the two states. Despite competitive capital values compared to other metros, the ambiguity surrounding the status of Brand Hyderabad has hit the realty market with hardly any registration of property or sales taking place. back projects and property buyers largely in a wait and watch mode. Home loans have dropped by 20 per cent. Global property consultant Knight Frank, in a recent report, stated of 118,000 housing units launched by developers over the past three to four years, 33,000 homes have remained unsold. Residential sales volume went up 11 per cent in the first half of FY13, compared with the same period in FY12. About 8,100 residential units were absorbed during this period, while 69,800 were in various stages of construction. Approximately 70 per cent of this is expected to be ready for possession by the end of 2014. Since the end of 2008 global recession slowed Hyderabad’s pace of growth too. The slowdown in IT developments and the corporates consolidating and reducing head counts lead to a drastic fall in commercial office space and corresponding residential and retail demand too. As the macro economics of

the country started improving from the mid of 2009 the real estate market sentiments in city too rebounded. However, by the end of the year markets were again pushed back by the Telangana agitations. And since then spurt of political agitations have continued to mar the growth of realty in the city intermittently for a couple of months on several occasions until they again start looking upwards. On all such occasions including the ongoing one the investments in the city have come to a standstill. Although, the city still continued to witness a ray of hope as companies like United Health Group, JP Morgan Chase and Facebook forayed into the city to start their corporate offices. In addition to this companies like TCS, Infosys, Accenture, Wipro etc geared up their expansion plans in the city and leased large spaces in 2010. But as such there has not been any phenomenal growth since then. The markets have maintained a steady path

A large number of real estate projects coming up along the major growth corridors of ORR, NH -7 and NH – 9, the biotech hub at Shamirpet, the manufacturing hub on the southern part of the city along the Srisailam Highway with presence of the Gems and Jewellary Park, Hardware Park and Fab City talks volumes about the meteoric emergence of a global metropolis over the last decade.


Cover Story Now to add another feather in the cap, centre’s recent announcement of declaring the city as Information Technology Investment Region (ITIR) at a total investment of Rs.2.19 lakh crores, of which the IT/ITES is to attract investments of Rs.1.18 lakh crore and the Electronic Hardware Manufacturing (EHM) sector of Rs.1.01 lakh crore. The ITIR is expected to generate direct employment of 14.8 lakh and indirect employment of 55.9 lakh to be implemented in two phases, phase I from 2013 to 2018 and Phase II will be from 2018 to 2038. Upgradation of three radial roads and extension of the Metro Rail from Falaknuma to Shamshabad International airport at a total cost of Rs 3,275 crore has been proposed as a part of this project. People are going to stay put in Hyderabad, division or otherwise. The real estate demand will continue and the prices touching their rock bottom compared to other metros are only expected to rise once the clouds of uncertainty are cleared and stability prevails. Crisil expects residential capital values to grow at a faster pace of 8-9 percent in 2013 and 2014 vis-à-vis 6-7 percent envisaged earlier. Commercial lease rentals are likely to increase only marginally in 2013 and 2014 due to a large planned supply of commercial office space. It is unlikely that end-user demand will increase immediately. However, within the next 7-8 months once the position is clear, demand will pick up leading to better appreciation in many areas. The locations which will see the fastest off take include those on and around Outer Ring Road, the CBD area of Banjara Hills and Jubilee

Hills, and areas such as Gachibowly, HiTec City, Kukatapally, Miyapur, LB Nagar, Uppal and Kompally.” Prime residential locations of Jubilee Hills and Banjara Hills have already seen an increase of about 7-10% during FY13 due to limited supply. Shamshabad, localities along the stretch from Kukatpally to airport and Srisailam Highway and Aadibatla are also expected to witness a hike from their current prices. Land prices are expected to triple along Outer Ring Road from the current average of Rs 1 to Rs 3 crores per acre. If Hyderabad becomes the capital of Telangana the realty prices are expected to fall momentarily for a few months till they stabilise post general elections. If it becomes a joint capital for 10 years and later a part of Telengana there will be a gradual rise. In the third case if it is declared as a union territory and joint capital for the duo, there will an outright surge, followed by stabilised good growth. In the second and third cases there will be no sudden pull outs; hence the market will only move up. Additional infrastructure will be built to take care of the requirement of two states. This will boost up land and residential demand. Even in case one the shifting of people and offices out of Hyderabad will be gradual with unnoticeable impact, as the strength of Telangana state staff will fill the gap over a period. Also during the next decade the city will further develop commercially with more employment and influx of people from outside in the natural course which will nullify the gradual exit of serving government staff. There will also be flow of people from Telangana districts to take up jobs created by the new government. Demand for real estate is definitely going to be on an upswing. A Step towards empowering the underprivileged The Land acquisition Act will change how land is acquired and owners are compensated in India, reports Jydip Mukherji. eeding the demands of the civil society an updated Bill was required to replace H the antiquated 1894 legislation on land

acquisition that allowed governments to acquire increasingly scarce land for a pittance from their owners. The 'Right to Fair Compensation and Transparency in Land Acquisition, Resettlement and Rehabilitation (LARR) Bill, 2013' recently passed by both the houses of parliament became a law with President Pranab Mukherjee giving assent to it. It replaces the old act and is expected to ensure a fair market value for India’s land owners and farmers, while the realty sector cries foul in the name of appreciation in basic land input costs. Meanwhile, the Rural Development Ministry is in the process of framing rules for the new Act. Objective of the ACT: The social and political objective of the Act is to ensure that the people who lose land are adequately compensated and to ensure that the acquirers of the land are assured of the acquisition process. Consequently, the Actl is expected to rule out problems of unwarranted claims and issues of inadequate compensation. The Bill makes it mandatory to seek farmers' consent before the acquisition of land and will be applicable in cases of acquisition of 50 acres in urban areas or 100

acres in rural areas. Land owners will also get special benefits by way of small portions of developed land for commercial use adjoining the upcoming projects. Consent-process of acquisition: T Narasimha Rao, president Greater East Zone Builders Association and CMD, TNR Constructions says, “The provision on mandatory consent of at least 70 per cent of the landowners for acquiring land for public-private partnership projects and 80 per cent for private companies acquiring land for a public purpose based on the number of land owners and not on the total area of the land to be acquired, a large number of marginal land owners could hold a project to ransom." Multiple checks and balances: “The Act enshrines a ‘comprehensive,

participative and meaningful’ process involving participation of local Panchayati Raj institutions prior to the start of any acquisition proceeding with special safeguards for tribal communities and other disadvantaged groups. Before any process of acquisition is initiated, there must first be a Social Impact Assessment to be scrutinised by an ‘Expert Group’ which reviews the SIA and submits recommendations as to whether the project is worth pursuing given the social and economic cost of displacement. It is only after the Government submits report in favour of the acquisition and the consent of those whose land is about to be acquired has been determined that a preliminary notice for acquisition shall be issued,” says Shamalabai of Andhra Pradesh Agricultural Workers Union who has been actively involved in the Sompeta movement in the North Srikakulam district of AP, where farmers have stood up against their land being acquired for construction of a power plant.

Special Report Long process may escalate costs: This study will have to outline how the acquiring parties intend to use the land and how the original inhabitants or owners will be rehabilitated. “The Act puts very definite timelines on project completion and entire land utilisation process. The other provisions like rehabilitation of affected projects, social impact assessments, ecological impact assessment and environment impact assessment for projects, etc., will create complications and delays instead of easing the execution of infrastructure projects. Rather such studies can be carried out as a parallel activity to acquisition and not as a condition precedent. Otherwise, the whole process will take a very long time and the purpose of acquisition shall be defeated, as project costs will shoot up," says advocate, C Prabhakar Rao, president Andhra Pradesh Builders’ Federation. Lop sided says industry: MV Narendranath Reddy, member APREDA Advisory Board and Chairman, Grand Ville Realtors says, “It is a boon for the farmers and a bane for industrial growth. Proper balancing has not been done. It is a fact that the previous act was totally loaded against the land owners and the new act has taken the other extreme. But good sense has prevailed as some key issues have been left to the discretion of the state governments. In the past land owners used to go behind the politicians to have their lands exempted from acquisition but now on the contrary they will go round to get their lands acquired as the compensation is very lucrative, more so because the present values fixed by the government are more or less at par with the market rates.” Compensation: The Act proposes that farmers and landowners be paid up to four times the market value of land acquired in rural areas and two times the market value in urban areas. T Narasimha Rao says, “The Bill addresses the core issue of resistance to land acquisition and the discontent among the public seen in recent years, by multiplying the compensation many folds and making the dispossessed a beneficiary in economic development. The higher compensation is certainly a welcome move; however there could be issues relating to the use of the market value in determining the compensation, as the officially reported and transacted prices always tend to be a fraction of the ongoing prices.”

Safeguards against displacement: R&R to be completed in all aspects for irrigation projects within a period of six months prior to submergence of the lands proposed to be so acquired and the possession by the collector upon fulfillment of conditions under the Act. The components that relate to infrastructural entitlements shall be provided within a period of eighteen months from the date of the award. The acquiring authority must also ensure the provision of various infrastructural amenities including schools, roads, medical centres, post offices in the displacement area i.e. the area in which all the displaced and affected families are being resettled. Dr. G B K Rao, CMD Pragati Group says, “The proposal of the new Act entails monetary gains and would be beneficial and practical in the long run. Every time, till date whenever land is acquired from poor people for infrastructure development projects – public and private, no proper compensation is paid. At the time of acquisition, government promises that the compensation for the acquired land will be released within no time but hardly is it implemented. How do you think people will believe and allow the government to acquire their land? Atleast now onwards we can expect that compensation, employment and resettlement will happen in just 18 months. A more practical Act could have been obtained with wider consultation with eminent personalities to arrive at a broader consensus.” Amendments made to include Retrospective operation: “After the amendments were approved by

the cabinet prior to it being tabled in parliament to address historical injustice the Act applies retrospectively to cases where no land acquisition award has been made. Also in cases where the land was acquired five years ago but no compensation has been paid or no possession has taken place then the land acquisition process will be started afresh in accordance with the provisions of this act. This is a welcome move to salvage the interests of the poor farmers who have lost their land without adequate compensation being given in the past,” says R Chalapathi Rao, Vice President NAREDCO- AP. Other highlights of The Bill: To safeguard food security and to prevent arbitrary acquisition, the Act directs states to impose limits on the area under agricultural cultivation that can be acquired. In case land remains unutilised after acquisition, the new Act empowers states to return the land either to the owner or to the State Land Bank. No income tax shall be levied and no stamp duty shall be charged on any amount that accrues to an individual. Where the acquired land is sold to a third party for a higher price, 40% of the appreciated land value (or profit) will be shared with the original owners. The government may need to bear the cost of land acquisition since user charges may not be able to bear the cost in all cases. However the battles of Singur and Sompeta have proved once again that ultimately people’s power prevails. While the new Act is expected to bring in more transparency and ensure that the affected land owners get their due, it has definitely not augured well with the industry on grounds of financially viability of projects. The government does a tightrope balancing act trying to satisfy both objectives- fair compensation to land owners and economic progress of the nation. Jydip.mukherji@gmail.com

officials from all over India lead by the union minister for housing and urban poverty alleviation and chief patron of NAREDCO Dr Girija Vyas visited Dubai from 7th Sept to 9th Sept 2013 to explore the possibility of bringing in new construction technologies, foreign direct investments, including investments by NRIs, speed up construction and financing of housing and real estate projects in India, besides studying their Real Estate Regulation Act and project approval procedures. The delegation comprising central and state government officials, top Indian real estate developers, bankers had interaction with investors, real estate developers, public and private sector entrepreneurs, consultants and manufacturers of Dubai. These bilateral

interactions were held in association with Indian Business and Professional Council, (IBPC), Dubai. R. Chalapathi Rao, chief convener NAREDCO- AP and executive vicepresident, APREDA, Hari Babu Advisor, APREDA, M.V.Choudhary, vice-president, APREDA along with other APREDA members and state government Officials from AP joined the delegation. Emphasising on the need for the builders to pay 1% of the total cost of the project excluding the cost of land for labour welfare and to enhance their awareness on the various provisions of the labour law, he welcomed cooperation from APREDA for training of workers and for arranging mid-day meals for workers. He said that the department has sufficient funds for the welfare of the workers and imparting training to them. Training of workers will indirectly benefit the builders. It is important to register the workers with the labour department as they will have many benefits. About the labour cess, he said that the rates must be realistic and APREDA can think of taking up the matter for rationalisation of the cess with the government so that it does not become a burden for the builders and benefit the workers as well. He concluded saying that awareness is important, cooperation with the department will benefit the workmen.
