Property Show revives markets Buying a property requires knowledge and information, and given the magnitude of investment, one has to be well-aware of the important aspects related with a transaction. The 4th APREDA Property Show held in Hyderabad from 25th to 27th October, 2013 was an invaluable opportunity once again thrown open to those on the lookout for buying a property to empower them with a compendium of knowledge and information that will help them to arrive at a decision. The expo showcased a wide variety of projects from leading developers and enabled them to get first hand information on the latest products and services available from stalls of interior designing material suppliers, vendors, real estate consultants. There were a sizeable number of financial institutions and banks that helped the prospective buyers to know about the prevailing home loan rates, application procedure, prospects of getting loan on various projects of their choice, besides getting their loan eligibility assessed. Among other queries the visitors were engaged in trying to find out what other projects have been completed by the developer prior to this, if it was delivered on time, if he had delivered what he had promised. Some of them wanted to make a site visit to the project location and check the quality of construction and also the maintenance facilities in the project. While others said they would speak to a few home owners residing in the project regarding the support and services from the developer. Serious visitors also wanted to get a copy of the application form and agreement of sale before they finalised the deal.

The layout of stalls with elegantly decorated and well lit up spaces gave a spectacular view to the onlooker. Thoughtful banners, colourful buntings, lively model exhibits of flats and villas, informative leaflets, handy pamphlets, creatively crafted brochures, well dressed up hosts and officials at each stall, waiting to welcome the passing visitor, told it all. Anxious visitors each one with a varied query left with a contended feel, quite evident from their smiling faces at the exit. As the customers had to drive all the way to the venue, only serious buyers genuinely interested in buying a property came to the show.

And as time fleets by leaving its feathers behind, the voices of the closing ceremony at the property show on the 27th October faded into the background. The hustle and bustle of the visitors died down, the stall participants withdrew from their three days of hectic business meetings and the office bearers of APREDA beat a retreat with pride and elan as the curtains on the fourth APREDA property show fell. The overwhelming response from prospective customers made the event a grand success.

National Office space absorption to reach 132 million sqft by 2017

B

ullish on the revival of the economy after general elections, real estate consultancy firm Cushman & Wakefield expects nearly 132 million sqft of office space, across the eight major metros, to get absorbed by 2017. However, the report said the current year (2013) will see a 26 per cent fall in office space absorption to around 22.5 million sqft over the past year due to the ongoing slump in the economy. The supply of office space between 2013 and 2017 in the top eight cities-Delhi-NCR, Mumbai, Bangalore, Chennai, Hyderabad, Ahmedabad, Kolkata, and Pune is expected to be around 143 million sqft.

Of this 143 million sqft, around 90 million sqft are currently under various stages of construction and is expected to get completed by 2015, the report said. "The office market is expected to remain

attractive for occupiers with steady increase in absorption after a trend of decline in 2013. "With the economy expecting more stability in the post-election phase from 2015, the absorption trend is also expected to pick pace especially in established markets of Bangalore, Mumbai and Delhi-NCR," Cushman & Wakefield executive managing director for South Asia Sanjay Dutt said. The report said the absorption of office space will decline in 2013 over 2012, mainly due to the current economic slowdown, which has made many companies defer their leasing requirements.

Govt to push PPP disputes resolution bill in winter session

G

overnment will seek to push a bill to set up an institutional mechanism for resolving the disputes related to public contracts or PPP projects in the forthcoming winter session of the Parliament. The Planning Commission has finalised 'The Public Contracts (Settlement Of Disputes) Bill 2013 and submitted it to the Prime Minister's Office (PMO) according to a source. Now the bill would be placed before the Union Cabinet for discussion and approval. Once approved, it would be tabled for passage in the winter session of Parliament, he added. The PMO has directed

the Commission in May this year to draft the bill for setting up an institutional mechanism for resolving disputes in the public contracts which are holding back investment of hundreds of crores and discouraging investors. The government envisages an investment of one trillion dollars in the country's infrastructure sectors like road, telecom and power in the 12th Five Year Plan (2012-17) with half of it coming from the private sector. "We are very optimistic about the outcome of this because PMO has asked for the draft of the bill. We have already submitted

it to PMO. Now it is for the government to expedite it for further action. This law will help in kick-starting the investment cycle," said planning minister Rajeev Shukla. According to the draft bill, the government will constitute a 'Tribunal for Public Contracts' having the principal seat in New Delhi and benches in Chennai, Kolkata and Mumbai. The bill provides for the tribunal dealing with disputes in the public contracts exceeding Rs 5 crore. It will have jurisdiction over contracts executed by Central Government, State Government, Local or statutory authority or any corporation society or trust owned and controlled by the government.

Govt for modernising land records

A

fter getting the new land acquisition law through Parliament, the rural development ministry is now nudging states to modernise land records that will help owners get fair compensation if their land is taken over. A road map prepared by the ministry, and reviewed by Mint, aims to triple the number of states that have modernised land records by 2016. Currently, only four of India’s 28 states-Tripura, Haryana, Gujarat and Karnataka-are in advanced stages of modernising such records.

This includes land surveys, updating of survey and settlement records, computerisation of land records and registration, modernising record rooms and imparting training to personnel in charge. Modernisation of records would ensure automatic mutation and facilitate a conclusive titling system to minimise land and property disputes, the review prepared by the ministry said. Andhra Pradesh, Bihar, Delhi, Goa, Maharashtra, Odisha, Rajasthan and Uttar Pradesh are placed in the second

India plans highway to Thailand via UP

U

ttar Pradesh to Thailand by road? It could be a reality soon. In what would reduce the cost and time spent on transportation of goods from India

to some Southeast Asian countries, a land route is being planned, from Uttar Pradesh to Thailand. The proposed Asian Highway 1, a first of its kind, is likely to be supported by the Asian Development Bank and the governments concerned. It will connect India to three other countries — Myanmar, Laos and Thailand — through a transborder road network. Anil Wadhwa, Indian ambassador to Thailand, said, "The trilateral highway between ThailandIndia-Myanmar will be a game changer

for our northeast region as well as for the other two countries. Movement of freight through containers along the highway will cut down the time taken for supplies to the northeast and vice versa by a number of days." India is one of the only two dialogue partners of Asean that shares land and maritime boundaries with the Asean countries. Connectivity within Asean in all its dimensions — physical, institutional and people-to-people — is a strategic priority for India.

Realty firms push sales with innovative ideas

T

he sluggish commercial market is prompting developers, occupiers and financiers to come up with innovative ideas to protect their business interests and get things moving. While developers are tweaking their offerings along with easier payment structures, including installment options, private equity players are opting for strata buys rather than acquiring entire projects for complete control. Developers are also using the time tested strategy of pushing sales through smaller houses amid high prices in commercial markets, as large floor plates are not finding many takers given that most corporate organisations have put their expansion plans on hold. Builders are now targeting professionals like lawyers, chartered accountants, traders and small business owners with

compact offices, lower prices and easier payment options to prop up their cash flows. Developers are also trying to attract prospective property buyers by offering various incentives or packages like monthly installments, 20:80 deferred payment schemes and even fully-furnished or readyto-move-in offices. "The commercial property market cycle is on a low and there's liquidity stress as residential sales are also stagnant. Smaller offices of 500-1, 000 sq ft size are selling the fastest as the ticket size is lower and both end users and investors are buying, given the attractive and low price points,

while high-net worth investors are buying pre-leased offices," says Ravi Ahuja, executive director at property consultancy firm Cushman & Wakefield. Buying commercial real estate in strata is a new phenomenon; it is already prevalent in developed market. Funds are buying proportionate equity to the extent of an area leased out and acquire the remaining stake as the project progresses in a creeping manner. The investors are also trying to pass the cash flow risk to the developer than assuming it straight away, while developers are trying to reduce this risk by tweaking their product and payment structures.

Maharashtra plans another city, 80 km off Mumbai

U

ran, a fishing village- turned special economic zone, will acquire a new status soon — that of a city. As a part of its plan to decongest Mumbai and Navi Mumbai, the Maharashtra government proposes to develop a third city in Uran, 80 km away from Mumbai in the Raigad district. The plan is still in the preliminary stages, but the state government wants to build the city over 100 sq km of land (10,000 hectares) with private sector participation. A beginning has already been made with the state run Maharashtra Housing & Area Development Authority (MHADA)

initiating a blueprint to build housing projects and other infrastructure over a 10 sq- km area (1,000 hectares of land). Uran, situated east of Mumbai across the Dharamtar Creek, is connected by road and a boat service. A project to link it with Navi Mumbai by rail has already been planned. Uran also houses the Jawaharlal Nehru Port, two private ports, a 672Mw gas- based power project of Maha Genco and an onshore terminal complex of ONGC. The proposed city will be one fourth the size of Mumbai and one- third of Navi Mumbai’s.

National PE funds sign deals with big builders for stable returns

P

rivate equity firms with big appetites are increasingly tying up with reputed developers to build large asset portfolios and earn stable returns. While the overall number of real estate-private equity transactions have fallen over the last one year, funds are focusing more on tying up with reputed builders to create large asset portfolios. In recent deals, real estate firm Lotus Greens raised money from Red fort Capital while Mahindra Lifespace Developers entered into a joint venture with a unit of Standard Chartered Bank to develop residential projects. Similarly, US private

equity giant Blackstone formed a special purpose vehicle with Embassy Property Developers while sovereign wealth fund Qatar Investment Authorities agreed to back real estate firm RMZ to buy commercial assets. However, slowdown in construction activity in the country has left funds with fewer projects to invest in. According to data from Venture Intelligence, the first nine months of 2013 saw 28 deals with total disclosed value of $1,115 million, down about 6% from a year ago. "There has been lesser private equity investment as the proportion is falling

due to market dynamics and difficulties in exit. Majority of the funds are looking at building assets and are raising capital for 7-8 years, as the development cycle is longer in India," said Neeraj Bansal, head of real estate and construction at KPMG. The largest investment in the third quarter of 2013 was Standard Chartered's arm entering into a joint venture with Mahindra Lifespaces. "The investment plan of Rs 1,000 crore is to develop FDI compliant 1.55 million sq ft residential projects across key cities of India," said Anita Arjundas, MD and CEO of Mahindra Lifespace.

With rising footfalls, Multiplex companies witness growth

F

ootfalls at multiplexes increased 1.5 times over the last three fiscals as rising spending power in smaller cities saw more moviegoers flock to such entertainment outlets. This increase has fuelled expansion in the domestic exhibition industry through both organic and inorganic routes. According to reports analysis shows that between 2010-11 and 2012-13, most exhibition companies increased their penetration in tier-II and -III cities, pushing up the

total screen count in the country by 43%. About 90% of these screens were added in malls in the smaller cities. Revenues, too, rose for most companies due to higher average ticket price. Analysts say the trend is likely to continue, given the fast-spreading mall culture. Footfall is a measure of how successful a company is at drawing people in. A growing middle class and more disposable income generally drive up footfalls at malls and multiplexes, which are theatre complexes

with multiple screens. For multiplex chain operator and segment leader PVR, footfalls increased 2.7 times to 5.4 crore in FY13 from 1.9 crore in FY11. In the same period, its nearest listed rival, Inox Leisure, saw footfalls grow 2.1 times to 3.82 crore. Inox Leisure, which has expanded its screen capacity to 284 in FY13 from 102 in FY11, has 69% of its screen capacity in tier-II and -III cities. "In the last three years, there has been a 15-20% growth in screen capacity every year, as a result of which the industry has added 250-300 screens every year," said Nitin Sood, chief financial officer of PVR. "At PVR, 65% of screen expansion has been in tier-II and -III cities." The last three fiscals have also seen companies' revenues grow at an average CAGR (compounded annual growth rate) of 35.2%. Operating profits, too, have grown at a CAGR of 42.7%, reflecting the impact of increasing footfalls and the resultant increase in average ticket price.

REITs will push realty sector

T

he Securities and Exchange Board of India (SEBI) is preparing to allow public and private sector companies to start Real Estate Investment Trust (REIT) to enable retail investors to invest in the real estate sector. The minimum sum required for making investments in REIT,

as per the proposed guidelines, is Rs 2 lakhs. At present, a minimum sum of upwards of Rs 20 lakhs is required for investing in the real estate sector. This means that only the upper-middle income segment can invest and benefit

from the high returns that the sector provides. But REITs will open the gates for the middle income segment to also invest in the sector. But, this will also increase the responsibility upon the regulator to bring in transparency into the sector.

National Govt may bring DTC bill this winter session

T

he government is likely to introduce the much delayed Direct Taxes Code Bill in Parliament in the winter session, finance minister P Chidambaram said recently. The Bill seeks to replace the Income-tax Act of 1961 with a completely new legislation. “We are trying to bring DTC in the next session,” Chidambaram told reporters here. The winter session of Parliament is expected to begin early December after the assembly elections in five states. He said: “It is my intention to take the DTC note on the official amendments to the Cabinet and introduce them in the winter session. But, that’s the call which ultimately the Cabinet has to take.” The

DTC that is under consideration has retained the income-tax exemption limit at 2 lakh. It proposes to introduce a new 35% slab on annual income of over 10 crore. At present, income in excess of 10 lakh is taxed at 30% while those earning in excess of 1 crore have to

pay a surcharge of 10%. The Bill also proposes to levy a 10% tax on dividend income exceeding 1 crore, a measure to tax those who receive income primarily by way of dividend. The corporate tax rate is proposed to be retained at 30% and the securities transaction tax will continue. At present, tax is levied on income of 2-5 lakh at 10% . 5-10 lakh at 20% and above 10 lakh at 30%. Further, those earning more than 1 crore have to pay a surcharge of 10%. The standing committee had suggested that income up to 3 lakh be exempt from tax, 3lakh to 10 lakh range be taxed at 10%, 10 lakh to 20 lakh at 20% and 30% on income over 20 lakh.

Market responds well to festive offers

T

he efforts of developers in promoting the sale of residential units this festival season—in large part through attractive discounts and freebies—seem to have paid off with the realty market responding well to their overtures. Many end users, who were sitting on the fence owing to high interest rates, have been lured into taking the plunge and buying that dream home on account of the attractive, festive discount offers. Several banks, too, have put in abeyance any increase in their lending rates. Manu Garg, director of Land-Craft Developers Pvt Ltd says: “The market has responded well to the festive-offer schemes that we launched, effective from Navaratra till Diwali, and more bookings are likely

to pour in as people generally go for bookings when the scheme is on. We are hoping that most of the pent-up demand for residential units is realised during the current period.” Consultants and large broking firms

like Investors Clinic and Re/Max India say that the festival season provides a fillip to the realty market. Sandeep Katiyar, CEO of Century 21, a global broking firm says, “The festive season hastens the buyer decision due to the attractive offers and discounts available in the market, which help revive the market.” However, he further said they do not contribute to the revival of the real estate market directly. He said property purchase is a well-deliberated process where, before buying, consumers engage in rigorous brainstorming, comparing, scrutinising, and obtaining consent from all family members—the festive season only accelerates their decision making process for a short time, he says.

Curbs on realty foreign direct investment below 50% may stay

T

he government may reject the urban development ministry's proposal to scrap all restrictions on foreign direct investment below 50% in real estate on the grounds that there can be no exemptions on rules such as minimum area norms. The suggestion was included in recommendations drawn up by the department of Industrial Policy

and Promotion, part of the ministry of commerce and industry, in order to encourage overseas investment in real estate, which has been hit by a weak economy and high interest rates. The ministry had also suggested that minimum carpet area be used in place of the prevailing measure of built-up area. "Foreign investment up to 49%

should be free from condition to attract foreign capital providers, which do not have long-term interest in construction assets," the urban development ministry said earlier. This will also enable real estate players to raise foreign capital at competitive rates and reduce dependency on the already strained domestic financial institutions.

State MMTS Phase II work is set to commence

he much-delayed MMTS Phase II work is set to commence in about a month as the Rail Vikas Nigam Limited (RVNL) has finalised Balfour BeattyKalindee Nirman joint venture as the successful bidder for taking up the work. RVNL had invited the MMTS phase-II tender work on April 11 this year and they were opened on May 22. RVNL had invited tenders in three separate packages for work worth Rs.389 crore, while the total project cost is estimated to be about Rs. 819 crore. MMTS phase II work are to be taken up in packages, including quadrupling of track for the

Foundation laid for the Samooha Aerospace Park at Adibatla

T

he chief minister Kiran Kumar laid the foundation Stone for the Samuha Aerospace Park, in the Aerospace SEZ at Adibatla recently. The country’s first aerospace SEZ is all set to take wings in Adhibatla on the outskirts of Hyderabad. About 20 small and medium enterprises (SMEs) and a few big players have committed an investment to the tune of Rs 1,500 crore. At least half a dozen companies began work on the day kick started the activity at a foundation laying function. The Aerospace & Precision Engineering SEZ venture can provide direct employment of 10,000 and indirectly to another 18,000 in the next

GHMC to handover some roads under AMC

T

he Greater Hyderabad Municipal Corporation (GHMC) is planning to handover some roads under annual maintenance contract, commissioner Somesh Kumar informed recently. Contractors would be responsible for repairing and recarpeting of roads during the contract period, he added. Speaking to the media he said the corporation

cannot take up all road repairing works at once. GHMC will carry out repairing works based on importance and convenience of the public. He said he had directed all deputy commissioners and zonal commissioners to give details of the badly-damaged roads within three days so that road repairs could be taken up shortly and completed by

December end.The commissioner said he had observed that most shop keepers were throwing waste and debris on main roads and residents were dumping building debris and keeping the construction materials on roads causing much inconvenience to citizens. Hyderabad Luxury space gaining in Hyderabad

L

uxury is gaining greater significance in India and hence witnessing the need of the hour, retail space available for them is also gaining attraction. According to a recent report by Cushman & Wakefield, the reach of luxury brands in the prominent main streets of the top seven cities in the country was led by Mumbai and NCR each having 30 per cent reach, followed by Hyderabad with 16 per cent reach. Hyderabad emerged as an exception in wake of low vacancy and limited mall supply in the city, thus resulting in increased presence of luxury retailers on its main street. Fast growth in India’s luxury retail space will push up the total retail market size to $650 billion by 2017. Over 50 percent of the total income in India is earned by the top 20 percent of the population and their monthly expenditure is twice that

of the next lower bracket. By FY’17, this population bracket’s earnings will increase by about 10 percent and they will control 60 percent of the income. Luxury in India will acquire 1.44 per cent of the total retail market by 2015 as against one per cent currently, while the

total retail malls stock is set to increase by 27 per cent by 2015. The total current operational mall space in the organised retail sector across the top seven cities of India is estimated at 66 million (approx.) sq. ft. of which luxury retail space is only 770,000 sq. ft.

City’s 15% heritage buildings on verge of collapse

A

round 15 per cent of the nearly 140 heritage buildings in Hyderabad and its outskirts are in a dilapidated condition and require immediate intervention of the authorities lest they collapse, heritage conservationists have warned. Activists said that much like the City Light Hotel which collapsed on account of unchecked structure strength, at least 15 buildings require partial demolition so that they do not take the entire structure down. One such building is the Erum Manzil built by Fakhrul Mulk, a noble in the Nizam’s court, which now houses the office of the roads and buildings department. “Portions of the building could collapse anytime. Even the R&B staff isn’t using them. A proposal

for restoration and renovation at an estimated cost of around Rs 12 crore was sent to the government around nine months ago, but we are yet to receive a reply,” said conservation architect A Suryanarayana Murthy. He also said that around 10 per cent of the famed Moazzam Jahi Market (MJM) structure needed restoration. “The rear portion of MJM, which houses meat and fish shops, could collapse. Such problems could have been avoided had the authorities taken minor maintenance works such as removing debris on rooftops and clearing water spouts,” Murthy added. Another conservationist, who requested anonymity, said the Old Jail complex in Monda Market had given away and

Development works worth Rs 545 crore by March, says GHMC chief

HMC commissioner Somesh Kumar said recently that the corporation will complete 6,732 civil and development works worth about Rs 545 crore, which were sanctioned in the current financial year, before March 2014.The commissioner held a review meeting on engineering works here and

Also a Rs 1,000-crore project by the Andhra Pradesh Housing Board to develop affordable housing in urban centres is underway,” he added. Q. What are your priorities?

A: Our top priorities: HUDCO’s priority is to increase lending towards affordable housing and infrastructure. Supply of affordable housing needs to be scaled up as bulk (96%) of the shortage is in EWS and LIG categories. Infrastructure lending includes both utility and social infrastructure so as to give and enhance quality of life of the citizens. Many of the urban local bodies (ULBs) lack the capacity for providing basic infrastructure facilities such as drinking water, sewerage, drainage, roads and other such facilities. HUDCO would like to extend consultancy services as well as long-term funding to urban local bodies to improve the housing and infrastructure facilities across the country. Q. How are you going about promoting affordable housing?

A: HUDCO has launched HuNNY for small towns and cities: The 8000 odd towns and cities in India are witnessing unplanned development. HUDCO will extend mortgage-based financial assistance to the planning authorities in the country for promoting organised growth and development. HUDCO Nava Nagar Yojana (HuNNY) focuses on planned development by assisting local planning authorities through technical consultancy support, financial and marketing assistance across the country. The scheme will support urban development authorities set up new townships and residential development. We will extend all help to authorities from designing to funding, including land acquisition costs.

A: On promoting affordable housing: HUDCO is offering long term lending at very competitive rates to state government housing boards, state corporations, urban local bodies and

How can HuNNY be availed by the private sector? A: On the availability of HuNNY by the private sector: A private sector company will have to take up projects in the affordable housing segment with due approvals from the central and state governments as more than 95 per cent of shortage in housing is in the EWS and LIG cataegories. Q. What are the other interesting initiatives HUDCO is planning? A: Other interesting initiatives planned by HUDCO: The innovation cell has been constituted in the HUDCO corporate office and appointed innovation officers in every region of the country. We have already trained them into thinking laterally and to come out with a large number of suggestions and ideas. A large number of suggestions have already come up and we have implemented many of them, the rent-to-own scheme is a product of our innovation cell. Q. Why have you signed a memorandum of understanding (MOU) with National Building Construction Corporation Limited (NBCC) recently? A: The MOU has been signed between HUDCO and NBCC to develop the lands/ plots of various Government bodies to increase housing stock and office space in various cities of the country. The strength of both the public sector undertakings will be complemented to each other under this MOU. he fourth APREDA Annual Conference 2013 on ‘Staying Ahead in Real Estate- Innovative Construction and Understanding Taxation’ held recently at the HICC was a grand success. The conference focused on providing insights on internationally acclaimed innovative construction techniques which is about to revolutionise the conventional construction practices prevalent in India. It also dwelled on understanding critical issues and challenges faced by the developers and landlords in the area of service tax and value added taxes. An eminent panel of speakers shared their expertise with more than 200 participants at the conference. It was a unique platform for knowledge sharing and networking. The first session of the conference on ‘Innovative Construction Technologies’ focused on various innovative construction technologies such as aluminium formwork, steel formwork, precast concrete and use of these technologies in projects. There were four audiovisual presentations in this session where they discussed on how these innovative construction technologies can revolutionise conventional construction techniques. The panel of speakers were from Shapoorji Pallonji, Kumkang Kind, PERI and Dutt Design India. Sridhar Vishwanath, vice president, Shapoorji Pallonji Engineering & Construction, one of leading construction giants of India and abroad addressed a session on use of innovative construction technologies in affordable housing project. Beginning the session with a brief introduction of Shapoorji Pallonji Group, Vishwanath quoted various successful projects undertaken by their company recently. He drew the attention of the delegates on the shortage of housing in India and the need for affordable housing in the country. He said that there is a minimum investment requirement of Rs.7,50,000 crores to cater to the affordable housing in India. This segment is catered to primarily by the government. However private players realising the immense untapped potential in this segment are stepping into it. He discussed about the two key projects

Shukho Brishti is largest mass housing project in India and known for its affordability. 150 acres mass housing project comprises of 20,000 LIG and MIG apartments with all amenities. The first phase of the project is delivered where time and quality of construction was managed by efficient and innovative construction methods. Another project which he mentioned is under construction using precast concrete technologies for design efficiency, precision, time and quality management in a G+14 floor residential tower for Tata Housing at Bangalore. The project is expected to develop 80 flats a month and deliver the project in nine months from the signing of the letter of intent. After giving the above useful insights Vishwanath concluded by saying that “there is no way but to adopt technology if one has to survive as a builder or a contractor”. The next two presentations were on aluminium formwork which is a key component of any construction activity. Sang Won Jeon, sales manager- India region, Kumkang Kind Co ltd, an aluminium formwork specialist, started the presentation with facts on shortage of housing in India. He said, “India currently needs about 3.4 million houses per year out of which only 2.4 million houses are being constructed each year, leaving a deficit of 1 million houses each year. Form work being a very essential part of construction would play a defining role in bridging this gap. As compared to traditional formwork, which

is rudimentary and risky, steel formwork, which is bulky and cumbersome, aluminium formwork suits construction of residential and commercial projects in India because of its light weight and ease of use. Kulkarni addressed the first question to Padmasri on service tax applicable in JD. She replied that in a JD the landlord share is taxable. However, the main argument is when there is a JV. In such a case also service tax will be charged as the landlord is considered to be the recipient of the developer’s service which he is paying by land. When she was asked from the date when the service tax will be charged, she replied saying it depends on the transaction type. Then Kulkarni addressed a question to Sudhir asking when the taxes are applicable. He said that taxes are applicable from 1st July, 2012 and not applicable prior to 1st July, 2010. However, the argument on taxes applicable between 1st July, 2010 and 1st July, 2013 is still to be decided based on the decision pronounced in few cases contested in the court. When Prashant Bhat was asked if the developer can collect the service tax from the landlord, he said yes. However,

he added that the main question is how to collect the tax, how much to collect and when to collect. He answered these questions telling that these depend on many aspects, such as how they are accounted, what is being accounted, if it is on area sharing basis or revenue sharing basis etc. Sunil Chandra Reddy was asked if it is easy to collect service taxes from landlord. His view was that the land values being most among others, developers are opting for joint development to block less capital. This is creating immense competition amongst developers to do joint development on prime lands. As such it becomes extremely difficult to collect service tax from the landlords. Prashant presented the panel with a court case in which the indirect tax was collected from landlord, which could be contested. Then Dwarkanath was asked to elaborate on the case of LCS City Makers (P) Ltd, which is being disputed in the court and will hold an important decision. He said that any tax is a matter of interpretation. He was then asked on when is it liable to service tax and at what point should the tax be collected. He replied saying, whenever there is a service provided there is a liability of service tax. Further points were discussed that enhanced the understanding of the service tax in real estate development for the participants of the conference. Ltd were the panel of speakers for the session moderated by Sridhar Rao, APREDA governing council member. Lakshmi Prasad started the panel discussion by dwelling on section 4 (7) (d) of the A.P. VAT Act, 2005 and references being made to the two cases namely, Madhu Collections Case and the case of Maytas Constructions. In both the cases the facts and figures were two different perspectives and the ruling in these cases by the advance ruling committee was taken positively by the government of AP. Subba Rao drew the attention of the delegates to the Madhu Collections case, where there were different agreements for different works, post the registration. In the Maytas case, the entire value of the flat was mentioned in the mother deed and hence the authority ruled that since the entire sum was mentioned, the tax can be paid at the rate of 1.25% directly. One more aspect was discussed namely Replying to the date of VAT calculation for under construction projects, he said it would either be the date of registration of the property or the date of possession of the property given to the buyer whichever is earlier. The next aspect that was discussed was the effect of Goods and Service Tax on real estate. On this point, Subba Rao, advised the developers/contractors/ builders to ensure that all items that they want to procure from other states should

Lakshmi Prasad during his talk clearly outlined that in case a developer is selling a property which has already got Occupancy Certificate (a pure sale of immovable property) then VAT is not applicable. Srinath from a pan – India perspective threw light on the different types of practices followed across India regarding VAT applicability on real estate. He mentioned that with respect to VAT taxation on immovable property under construction, there are only two states which have simplified the collection of taxes in this aspect, one is Maharashtra, where it is 1% including the land value and the other is AP, where it is 1.25% including the land value. However, the recent judgement in the case of L & T by the Supreme Court has created some more questions which are still unanswered and need to be redressed again by the Supreme Court. Chalapathi Rao echoing the sentiments of the developer community said that inspite of the recent rulings, there has been no change in the state of things as

The interpretations of the rulings have been made in order to suit the actions of the government body and this situation has to change to give respite to the developer community. The final session for the day was on ‘Emerging Building Materials and Technologies in Real Estate’ by Dr. Shailesh Kumar Agrawal, executive director, Building Materials and Technology Promotion Council (BMPTC), ministry of housing and urban poverty alleviation, government of India. NAREDCO governing council meeting

O

n the heels of the start of the 4th APREDA Property Show, a meeting of the NAREDCO governing council members from all over the country was held at HICC, chaired by Sunil Mantri, president NAREDCO. Minutes of the 89th and 90th NAREDCO governing council meeting, representation on the Regulatory bill to be presented to the parliamentary standing committee, proposal for NAREDCO office at Gurgaon, approval of new memberships were some of the items on the agenda of the meeting. A presentation was also made by Ashok Chhajer, one of the

members on the NAREDCO convention, awards and exhibition to be held in New Delhi in January 2014.Col (retd) Prithvi Nath another member presented his plan on taking up of the NAREDCO magazine

Land pooling ushers in a new era

Land Pooling Scheme could be the game changer in AP, more so in Hyderabad where cuisine is married to the culture and adds value to real estate and town planning, says M. Sridhar Rao.

H

yderabad is a very large city, one of the finest in our country. The geographical terrain, climate and cosmopolitan culture are its USP. In the last 10 years the growth pattern and the infrastructure of the city has expanded leaps and bounds. As a result land in Hyderabad is now available at a premium, not so affordable, though many pockets of plain lands are available in and around the city. Town

In order to cope with the dynamics of urban planning in the changing scenario the government of Andhra Pradesh is planning to introduce Land Pooling Scheme (LPS) in Hyderabad on the lines of Maharashtra and Gujarat. In Gujarat, the government and the society have reaped the benefits of LPS by joining their neighborhood, to submit a common approved plan towards subdivision and development. It seems the local revenue authorities like Tahasildar has the power to displace or reallocate the land owner involved in LPS without subjecting the person to registration department. Even the small plot owners join together, follow the master plan readily available, continue the road pattern and get the approval. The key aspects of land pooling in the Indian context include equal contribution of land needed for public purpose from all owners; all owners to get proportionate land developed with all infrastructure facilities and amenities back with a yield of much higher value; authority/private developer makes

expenditure on infrastructure, amenities cost; leading to planned development of newer areas, instilling a sense of elevated kind of living be it commercial or residential spaces or could be a judicious mix of both leading to a new way of life and habitat paving the way to a different level of urban living where all the amenities thus created is shared and equally enjoyed- the roads, parks, infrastructure in a big way. After its phenomenal success primarily in Gujarat, LPS is in a take off stage with the developments in and around HMDA limits. Nirabh K Prasad, metropolitan commissioner HMDA says that the A P government is keen to take up LPS. To introduce the scheme in AP a meeting was convened by HMDA along with the stakeholders recently inviting letter of interest and expression. HMDA is asking for commonly available 185 acres of land, where neighbors are willing to share the larger proposed growth. HMDA also admits the impending difficulties to put such a large chunk together. Hence, has planned to appoint a panel to receive proposals with atleast

Chief minister N Kiran Kumar Reddy, who is also the chairman of HMDA board, chaired the 5th meeting of the authority recently at the Secretariat. He directed the HMDA to speed up ongoing projects and initiatives like land pooling schemes within specific time-frame. The board also approved the Land Pooling Scheme (LPS) initiated by the authority. LPS is being taken up by the HMDA under pilot project at two places Edulanagulapally-Kollur and Pratapsingaram-Gowrelli. two third of 185 acres for submission. The final call will be taken up by the civic body for acquiring one third of the neighborhood.

To begin with, HMDA is eying areas in its jurisdiction along the Outer Ring Road Growth Corridor. Here HMDA would act as the developer and appoint a contractor by itself. The regular developer has no role to play. The land is submitted as a proposal, the rest is taken care by HMDA themselves. The landowners need not pay a single rupee from their pockets. In a broader sense below are the LPS stipulations in HMDA area. The private LPS could also be undertaken by a group of landowners through a licensed developer.

The role and responsibility of the developer would be: (i) Mobilise the owners (ii) Land to be surveyed and demarcated as per revenue survey numbers. (iii) Pattern of preparation to be taken up in such a way that all the land owners get accommodated proportionately after deducting roads, open spaces and other mandatory reservations. (iv) Mortgage the areas prescribed by HMDA regulation to public domain areas like parks, etc. (v) Demarcation of private LPS pattern and plots. (vi) Facilitate the sale or allotment of the final plots to the owners. (vii) Estimation of development works to HMDA and undertake the development works. This entire operation of development work can be categorised into three main divisions. l Plans at the approval stage: preparation of drawings, allocation of plots and areas under public domain. l At the first level implementation stage: demarcation of area approved for private and public domain, circulation network, allocation of final plots to owners as per approved private LPS and also undertake leveling of site and completion of the road work. l At the second level implementation stage: undertake and complete

other infrastructure development works, infrastructure facilities within the approved private land pooling scheme. HMDA should not waste time to initiate LPS. Since Section (24), (25) & (26) of HMDA Act 2008, allows private developer to enter into a development agreement, pool 123.5 acres and submit for LPS. The invitation to pilot project necessarily opens the door to the would be ‘Golden Era’ for large developments unheard, unseen in Hyderabad. This can be a third floor view of so called layout.
