Our focus is on improving supply and productivity in the industry

Areport from Master Builders Australia has shown that the country is not meeting its housing targets. Housing starts are currently below the required rate of 200,000 per year, with numbers expected to drop further in 2022-23. To meet its targets, NSW would need to build around 58,000 new homes annually, but the forecasts predict a dip to 45,000 in 2024-25 before a recovery to over 56,000 by 2026-27. The increase in housing will mainly come from higher-density building, driven by government stimulus. By 2026-27, detached houses are expected to make up just 45% of new homes in NSW.

Non-residential building in NSW has been declining in recent years, with a 1% drop in work volume in 2020-21 and a sharper 6.5% decline in 2021-22. Despite this, the forecasts predict that non-residential building will remain steady in the next few years before accelerating in the middle of the decade. Social, community, and recreational building is expected to perform well during this time. While industrial building has seen significant growth in NSW since the pandemic began, it is likely to see a slight decline in the coming years.

In making these proposals, the focus is on improving productivity in the industry and allowing for more favourable outcomes when it comes to the cost, quality and quantity of building and construction output.

Master Builders Australia has submitted their pre-budget proposal for 2023-24, considering the forecasts of the economic situation. However, the budget is facing challenges due to high inflation, which has been caused by labour shortages and cost pressures in the markets for raw materials.

The proposal offers solutions for important industry matters such as reducing costs, meeting Australia's housing goals, setting appropriate taxes, ensuring safety and compliance on construction sites, and increasing the workforce by enhancing apprentice training and retention strategies and lifting migration limits.

As this is my first column, I’d like to say I am thrilled to take on the role as President of this incredible organisation. As I step into the role, I am excited for what can be accomplished in our industry. Thank you for the warm welcome, and I look forward to a bright future ahead.

Priorities Policy 2023 for the New South Wales Building and Construction Industry

During the months of December 2022, January and February 2023 the Association undertook active discussion with the Building Industry in NSW to develop a “Policy Priorities Document” for the upcoming State Election.

The priorities for the building and construction industry in NSW were established through direct communication with building contractors, specialist contractors, and key industry stakeholders across all sectors. Additionally, an industry survey was conducted as part of the consultation process. Although there are favourable prospects in the industry, there are still unresolved concerns that must be tackled to promote greater unity and productivity. These issues include:

• The establishment of an independent, centralised authority to administer, regulate and oversee the building and construction industry (Independent Building Commission) in NSW.

The establishment of a single building industry regulator is a deserving response to the industry’s economic contribution to the State economy. A single building regulator will, over time, draw together the various government agencies currently overseeing our industry;

It should be noted the MBA recognises the work undertaken by the Office of the NSW Building Commissioner, and supports the continuation of this position.

• Architects, building designers and engineers should be accountable for the provision of their services, and be subject to a licensing structure.

The MBA views the licensing system as fundamental to the competency of practitioners, quality outcomes and consumer confidence in the building industry.

It provides a mechanism for consumer protection by qualifying persons seeking work in the industry. More importantly however, it provides a compliance process to address unacceptable practices and poor performance.

The MBA is concerned the key professional services of designers, architects and engineers, which are fundamental to the construction process, reside outside the current licensing regulatory system.

Consequently, there is little accountability in the delivery of design and specification documentation by these practitioners, which leads to a direct risk transfer to builders and certifiers.

The MBA acknowledges that part of the licensing/registration of these key professional services has commenced and is now covered by the Design and Building Practitioners Act 2020. This Act currently covers Class 2 buildings. The Association supports the extension of this Act into other classes of buildings.

• The need for a dedicated senior Cabinet Minister to oversee the building and construction industry.

The NSW building and construction industry contributes over $69 billion to the NSW economy and is a major job creator, with

the sector employing an estimated 395,000 people. The building and construction sector is integral to the NSW Government’s infrastructure renewal program.

• A specific building industry workplace relations agency should be established in NSW to act as a deterrent against unlawful industrial conduct and coercive behaviour.

• Subcontractors / specialist contractors should be subject to a ‘Continuing Professional Development’ (CPD) program; and

• The introduction of licensing regime for those who undertake work in the commercial sector.

Other issues identified through industry consultation and the survey concern Apprentices, cross border (various jurisdictions) construction, education and training as well as the establishment of a consolidated Building Act.

The Association believes that the priorities identified, as well as other industry issues could all be administered by an independent Building Commission.

We have forwarded our document to the various political parties for their responses. The Association will circulate their positions on our Document to all members prior to the election.

The Master Builders Association of NSW had discussions with the building industry in NSW from December 2022 to February 2023 to create a “Policy Priorities Document” for the upcoming State Election.

ESTABLISHMENT OF A BUILDING COMMISSION

Over the last two decades many reports and enquiries into the NSW building and construction industry advocate the establishment of an independent building commission.

In 2002 an inquiry into the Quality of Buildings in NSW (Campbell Report) reported there were a number of structural problems within the home building process, including the fragmentation of the regulatory regime. A key recommendation of the Campbell Report was for establishment of a Home Building Compliance Commission, independent of the State Department of Fair Trading. Master Builders supported the recommendation. However, the Association sought as a policy position that the establishment of a Building Commission should hold an overarching responsibility for all sectors of the NSW building and construction industry – and not just the residential sector.

Master Builders has, for over 15 years, continued to present this key policy position in order to consolidate the regulation and administration of the building and construction sector in NSW. More inquiries into the NSW building and construction sector have given support, and also made recommendations for establishment of a single state building regulator.

The 2013 independent Bruce Collins Inquiry into Insolvency in the NSW Construction Industry made the key recommendation that the NSW Government undertake a cost benefit analysis for the establishment of a separate autonomous statutory authority called the “NSW Building and Construction Commission”. (The Baird Government committed to undertake the cost-benefit analysis in 2015).

The NSW Independent Pricing and Regulatory Tribunal (IPART) has also given its support for establishment of a single building authority, to improve building compliance and enforcement. In 2014, the NSW IPART outlined its recommendation

to establish a single state building regulator in its draft report into Local Government Compliance and Enforcement.

The independent review of the Building Professionals Act, (2005) undertaken by Michael Lambert released his report in late 2015. The report, amongst other things, called for the establishment of Office of Building Regulation to consolidate building regulations in the state of NSW.

Other state and territory jurisdictions have for some time, taken a co-ordinated and consolidated approach in recognition of the significance of a vibrant building and construction industry. While there has been inquiries and reviews into the Victorian and Queensland Building Commissions, the outcome of these inquiries resulted in structural changes to the effect of establishing authorities which provide for a co-ordinated approach to building regulation and oversight. Further, ICARE has responsibility for the administration of the Home Building Compensation Fund which in effect acts as a de facto licensing scheme, by ensuring builders meet rigorous financial criteria for eligibility to procure Home Warranty Insurance coverage.

In recent years wide-ranging regulatory reform of building and building related legislation (e.g. planning, home building, strata) has provided clear evidence of the difficulties and lack of coordination where building and building related legislation is administered across different agencies. The establishment of the Office of the Building Commissioner (OBC) in August 2019 has seen significant reform in NSW. On the back of calling for a “reformed and modernised” NSW regulator rather than a Building Commission, the OBC has brought substantial changes to the NSW building landscape, including the Design and Building Practitioners Act (2020) and Residential Apartment Buildings Act (2020), and the establishment of NSW Government and Practice Standards for Registered Certifiers to name a few. The work required to reform all sectors of the industry needs to continue.

The Association believes the introduction of a consolidated “Building Act” (currently under discussion) would make future reforms across planning, strata and building easier and ensure consistency and co- ordination in all jurisdictions.

EXTEND LICENSING TO BUILDING DESIGNERS, ARCHITECTS AND ENGINEERS

Master Builders views a licensing system as fundamental to the competency of practitioners, quality outcomes and consumer confidence of the building industry. It provides a mechanism for consumer protection by qualifying persons seeking work in the industry but, most importantly, it provides a compliance process to address unacceptable practises and poor performance.

Master Builders is concerned the key professional services of designers, architects and engineers, which are fundamental to the building and construction process, continue to reside outside of the current licensing regulatory system. Consequently, there is little accountability in the delivery of design and specification services by these practitioners, which leads to a direct risk transfer to builders and certifiers.

The Association supports the introduction of the Design and Building Practitioners Act 2022 which clearly introduces a licensing regime for the design and engineering sector for Class 2 buildings. The Association believes that such licensing requirements should be considered for other classes of buildings. Many complaints received by Master Builders are concerned with inadequate design and specification, and architectural designs not fulfilling the design brief, in particular, within the client’s budget brief. Consequently, builders are reluctantly positioned as de facto designers and specifiers in order to fill gaps in design detail, or amend designs and specifications in order to satisfy the client’s budget.

M aster Builders recognises Continuing Professional Development (CPD) as an investment in building success, leading to better quality in building practice. The Master Builders’ industry survey identified a strong view that CPD should be extended to licensed trade contractors (sub-contractors).

HOME BUILDING COMPENSATION

(HOME WARRANTY INSURANCE)

The Home Building Compensation Fund (HBCF) or Home Warranty Insurance as it is known, remains one of the most prominent issues for members and the wider building industry.

The overall cost of the home warranty system must be reduced and must be reviewed with a holistic industry approach. The system can be positively impacted in the short to medium term by:

• Providing better support for builders — less builders become insolvent

• Introducing new system of building practices for ‘wet areas’

• Introducing a quality inspection regime for medium density buildings

FUND

• Disallowing individuals entry to the system who phoenix

• Reviewing and enhance claims management.

• Providing client training in ‘assessing a quote’ (don’t just accept the lowest)

• Rewarding builders with good building practices and history

Better support for builders involves:

• Transparent and clear eligibility criteria

• Safe haven when experiencing financial difficulties

• Less administration – use KPIs (not only financial)

• Training in financial management

Anumber of Royal Commissions into the Building and Construction industry have documented the misuse of Right of Entry Permits, particularly in matters relating to alleged safety breaches.

Master Builders advocates for greater accountability on Right of Entry Permit Holders when entering a workplace for WHS purposes.

Consequently, Master Builders advocates that Right of Entry Permit Holders provide 24 hours written notice before entering

a workplace for WHS purposes. Permit Holders must provide the PCBU (Person Conducting a Business or Undertaking) and the Regulator with a written report outlining the nature of the visit within seven days of visiting the workplace.

LICENSING OF COMMERCIAL CONTRACTORS MASTER BUILDERS POLICY

To carry out construction work in the commercial sector of the building industry in NSW requires no formal licence.

In fundamental terms contractors who construct multi-storey office buildings are not subject to a formal licence regime. This is not the case in other jurisdictions across Australia.

A recent survey of MBA members indicated strong support for the

introduction of a licensing regime for those contractors who undertake work in the commercial sector.

Master Builders advocates for the establishment of a Government and industry working groups to examine the licensing requirements of commercial contractors in NSW.

CROSS BORDER CONSTRUCTION MASTER BUILDERS POLICY

NSW is in a unique position with state borders with four jurisdictions, namely Queensland, Australian Capital Territory, Victoria and South Australia.

Contractors who conduct work in crossborder regions continue to face a myriad of variances in legislative and technical procedures when working in a number of cross-border regions. This “red tape” often

leads to delays in projects which can often cause cost increases for all involved. Differences in Home Warranty Insurance, licencing requirements — (both in the commercial and residential sectors), and continuing professional development are but a few.

Master Builders recommends that a detailed study of the various cross border jurisdictions be undertaken to identify and remove impediments to timely construction.

EDUCATION AND TRAINING MASTER BUILDERS POLICY

Master Builders’ industry surveys clearly reveal that the building and construction industry has an aging work force.

The main feeder to replenish licensed builder numbers is through the apprenticeship system which, at the current rate, will only be able to replace half of the retiring tradespeople and/or those who leave our industry.

Industry studies indicate that over the next four to five years the amount of building and construction work to be undertaken in NSW is substantial. The industry, as a whole, needs to embrace the training of young people through apprenticeships and traineeships, so that we have the necessary skills to meet this demand.

In order to attract new entrants to the building and construction industry, the NSW government should apply mechanisms to reduce the cost of living for apprentices that offset the impediment of lower apprenticeship ages. This could include exemptions from NSW toll charges, discounts on vehicle registration and vouchers to purchase starter Personal Protective Equipment (PPE) and tool kits.

WORKPLACE RELATIONS

With a changing approach to workplace relations at a national level, the commercial sector of the building and construction industry in NSW believes an industry specific regulatory framework should be established to ensure a strong and disciplined approach to the rule of law. Such a framework will ensure that responsible behaviour of industry parties continues to be encouraged.

Master Builders advocates for the establishment of a well-resourced building and construction industry specific agency in NSW.

This industry specific regulatory agency would also need to be equipped with sufficient statutory powers and penalty

The cost, liabilities and exposure of workers compensation to employers training apprentices and/or trainees is a major barrier to their engagement. Master Builders’ survey clearly identifies that builders would rather forego training apprentices than confront this inherent risk.

WORKERS COMPENSATION –DEEMED WORKER

Industry surveys have consistently rated workers compensation as a major issue confronting building businesses.

The definition of a deemed worker continues to be a major issue, particularly for the residential building sector, which is heavily reliant upon small contracting entities – often single operators –undertaking specialised trade work.

Master Builders believes simply adopting the common law definition does not deliver the desired clarity or certainty.

Master Builders advocates that in order to give added incentive to employers to engage young people in apprenticeships and traineeships, the workers compensation premium and the cost of any claim, should not be borne by the employer, regardless of the size of the employer, for the duration of the apprenticeship.

T he cost of claims borne by employers of employees for non-specific work incidents — for example, loss of hearing and bad backs is high.

In many instances, these non-specific incident injuries can greatly impact on a company’s ability to continue trading.

Results for 2021–22 indicate that just over 56,000 new homes were commenced in New South Wales, a modest reduction (–4.8 per cent) on the previous year. New detached house starts were almost completely static during the year (–0.7 per cent) while other dwelling commencements such as new apartments and units dropped by 9.0 per cent. As a result, the detached house share of new home building starts in NSW rose from 50.8 per cent in 2020–21 to 53.0 per cent in 2021–22.

Master Builders Australia forecasts of total new dwelling starts for New South Wales to 2026–27

Latest building approvals data indicate that the pipeline of work is still reasonably stable in NSW. Over the three months to October 2022, the total number of new home building approvals in NSW slipped by 1.5 per cent compared with a year earlier. This was driven by a 7.0 per cent reduction in detached house approvals, while medium/high density approvals rose slightly over the same period (+1.5 per cent).

Home lending indicators suggest that the short–term outlook is challenging. Over the three months to October 2022, there was a 12.7 per cent drop in the number of home construction loans across NSW while loans for residential land purchase

declined by 21.0 per cent over the same period. Interestingly, the number of home construction loans granted to investors has increased (+2.5 per cent) over this period. When it comes to home construction loans, NSW tops the pile in terms of average loan size ($653,500).

Another curious feature of the NSW market right now is that housing investors are typically borrowing more ($478,500) then owner occupiers ($439,900) for residential land purchases.

At the end of June 2022, there were about 13,000 homes across NSW awaiting commencement. In addition, 20,100 new homes were approved over the period to October 2022.

Master Builders Australia forecasts of total non-residential building activity for New South Wales to 2026–27 (millions of 2019–20 dollars)

This means that about 33,000 new home starts are already ‘locked in’ for commencement in NSW during 2022–23. When we add into account those homes likely to be approved from November onwards and start work by the end of June, our expectation is that a total of around 55,380 new home commencements will take place in NSW during 2022–23, a small reduction (–1.4 per cent) on the year before. However, medium/high density home starts are anticipated to rise by 10.9 per cent during the year while detached house starts suffer a 12.3 per cent reverse.

Our forecasts see new home building starts in NSW bottom out around 45,000 during 2024–25 before a solid recovery propels activity

new home commencements up above 56,000 in 2026–27. Higher density home building is likely to account for a disproportionately large share of the expansion in activity, with government–led stimulus being one of the main drivers of this. By 2026–27, we project that detached houses will make up just 45 per cent of all new homes started in NSW.

Non–residential building in NSW has spent the past two years in reverse gear: the volume of work dipped by 1.0 per cent in 2020–21 with a sharper decline (–6.5 per cent) following in 2021–22. Over the next few years, we anticipate that non–residential building will remain rather flat but it will eventually accelerate towards the middle of the decade. Our projection is for a

6.0 per cent increase in 2025–26 followed by growth of 3.8 per cent the following year. Social, community and recreational building will return quite a strong performance over this period. Industrial building has been gaining substantially in NSW since the pandemic started but it is likely to lose a little bit of ground as we move towards the middle of the decade. One of the most significant projects relates to the new Western Sydney Airport which is due for completion in 2026 at a total cost of $5.3 billion.

The outlook for civil and engineering construction in NSW is quite positive over the forecast horizon. The volume of activity

dropped by 4.1 per cent during 2020–21 and was largely stable (+0.4 per cent) in 2021–22. Over the coming years, consistent growth is looking likely particularly when it comes to projects in the transport and utilities space. By 2026–27, we anticipate that the volume of civil and engineering construction in NSW will have reached $27.42 billion, compared with $23.67 billion in 2021–22. The pipeline of transport projects has been significantly augmented by the Sydney Metro project which is expected to total $15.5 billion in value by the time of its completion sometime next year.

Not all studs are created equal

Steel studs are one of the most widely used products when it comes to wall and ceiling construction. Knowing how to identify quality light gauge steel products and their use can ensure compliance, superior workmanship and overall project efficiencies that positively affect the bottom line.

Are your Steel Studs the real deal?

Available in the Australian light gauge steel stud market are lower quality, cheaper alternatives. Those imported from overseas don’t have manufacturing processes that are as regulated as the controls we have here in Australia and whilst this may reduce the initial cost, it also increases the risk of not receiving a highquality, compliant product.

For steel stud systems to be compliant they must be designed for structural integrity in accordance with the National Construction Code (NCC), Volume 1, Part B1 Structures, which can be achieved by following the deemed to satisfy provisions B1.1, B1.2 and B1.4.

Sometimes, a manufacturer can reduce coating thickness, and increase base metal thickness to reduce costs, which makes the product feel stronger and give the illusion of higher quality than it is.

Samples of several imported steel products were sent to an independent laboratory, and we found the zinc coating in the steel studs was equivalent to Z100. Unlike the imported steel studs, Rondo’s steel studs have a zinc coating of Z275 (275 grams of zinc per m2) which ensures the steel has an optimum zinc coating that will continue to sacrifice itself in order to protect the base metal.

How can a cleverly designed steel stud improve project efficiencies and the bottom line?

A well-engineered and manufactured stud possesses superior features that provide

additional protection, efficiency, and peace of mind.

Steel studs manufactured by Rondo are made in Australia, featuring:

1. Folded hems, for added protection and strength — the edges are folded along the entire length of the steel stud, protecting hands from potentially serious cuts and injury, improving site safety. The hemmed stud profile also increases stiffness of the stud, preventing unwanted rotation.

2. Knurls, for better control and efficiency — knurls cradle the needlepoint of the screw, minimising slipping and

sliding of the screw when pressure is applied. This allows for faster installation and helps to prevent damage to nearby plasterboard and potential injury.

3. Boxed Stud Arrangements — The Rondo stud profile has been designed to perfectly lock into each other, creating the best boxed stud profile for door and window openings.

4. Bellmouth service holes — punched into all 0.5-0.75 BMT Rondo Steel Studs, bellmouth service holes ensure that cables and pipes can be fed through without risk of cuts or injury to installers, also eliminating the need for the labourintensive process of installing grommets. Further protection is provided postconstruction, where the bellmouth’s smooth finish prevents cables and pipes from being damaged during building movement, preventing dangerous electrical damage or costly water leaks in walls.

5. An appropriate zinc coating for protection — Rondo’s steel studs have a zinc coating of Z275 (275 grams of zinc per m2) which ensures the steel has an optimum zinc coating that will continue to sacrifice itself to protect the base metal. PERMALITE® GIVES COASTAL DWELLERS THE PERFECT WAVE

The holy grail of building materials is one that can deliver aesthetic appeal and inspire creative design, while offering the functional benefits of longevity and low maintenance qualities, even in the most demanding environments.

For the owners of a new residential build in the coastal town of Middleton, South Australia, it was PERMALITE WAVELINE® cladding from Lysaght that helped meet all areas of this brief. From 27 – 30 November 2023, Australia will host the 23rd World Congress at Sydney’s International Convention Centre. New Design Compliance Declaration forms: start using them now!

The NSW Government have introduced new compliance forms that are compulsory and came into effect on 6 March 2023.

Design Practitioners need to stay on top of this to comply with the Design and Building Act 2020.

Updated Design Compliance Declaration forms and accompanying guidance material are now available on the NSW Fair Trading website.

NSW Fair Trading have redesigned these documents to make it easier to meet legislative requirements and better support design and building practitioners.

Since 1 July 2021, under the Design and Building Practitioners Act 2020, all regulated designs and compliance declarations for Class 2 building work must be completed by a registered design practitioner or principal design practitioner.

What are the changes to the new forms?

The updated forms include additional information fields and details of the regulated design(s), including:

• the building address(es)

• the design practitioner’s Class of Registration applicable to the declaration

• a unique identifier number specific to the design practitioner, including:

» Design Compliance Declaration (DCD) number

» Certificate of Design Compliance (CoDC)

• questions about the type of regulated design

• clarification of the ‘revision’ number on the plans, drawings, specification, schedules and/or reports.

Older versions of the declaration forms will not be accepted after 5 March 2023.

Design practitioners should download and start using the updated forms as soon as possible.

The previous Design Compliance Declaration – “multiple regulated

designs form” has been removed from the NSW Fair Trading website because it didn’t allow clarification of what was being declared. Practitioners must now prepare and complete a separate design compliance declaration form for each regulated design.

New compliance declaration requirements for building practitioners

Building practitioners must now lodge a copy of the fire safety certificate on the NSW Planning Portal when submitting a building compliance declaration under the Design and Building Practitioners Act 2020.

To support this new requirement, building owners must now also provide the fire safety certificate to their building practitioner as soon as possible after the fire safety certificate is issued.

These new requirements are part of a package of reforms introduced by the NSW Government in December 2022 that aim to reduce life safety risks, damage to property and the incidence and cost of fire safety defects. They incorporate feedback from the public consultation. The reforms will begin in stages to make it easier for industry and property owners to comply. More information about each stage and when it will come into effect is available on the NSW Fair Trading website.

How to upload the fire safety certificate?

From 13 February to May 2023, building practitioners can upload the fire safety certificate using the “Other Regulated designs” document type during the Building Compliance Declaration lodgement process.

From May 2023, the Planning Portal will allow the upload of the fire safety certificate as a “Fire Safety Certificate” document type.

NEW NATIONAL CONSTRUCTION CODE

The Australian Building Codes Board (ABCB) has advised that the new National Construction Code (NCC) 2022 is available.

The NCC incorporates the Building Code of Australia (Volumes One and Two) and the Plumbing Code of Australia (Volume Three).

Most of the changes to the NCC come into effect on 1 May 2023.

Some of the major changes in NCC 2022 include:

• Consistent structure and clause referencing system across all three volumes,

• New Housing Provisions Standard to support the new NCC structure,

• Amended provisions for the fire safety of external walls, including requirements that bonded laminate panels be mechanically fixed,

• Enhanced waterproofing and weatherproofing provisions,

• Enhanced provisions for residential energy efficiency and condensation management,

• New requirements to facilitate the future installation of electric vehicle charging infrastructure in carparks.

• Adoption of the latest edition, or updated editions, of a range of Australian Standards and other referenced documents.

Livable Housing

NCC 2022 contains new requirements for livable housing, however, these provisions will not apply in NSW. Volumes One and Two of NCC 2022 include a variation that specifies that the livable housing provisions do not apply in NSW.

Residential Energy Efficiency

In NSW, the energy efficiency and thermal performance of new residential buildings is regulated by the Building Sustainability Index (BASIX). Increased BASIX standards will apply from 1 October 2023.

Transitional Arrangements

Certain provisions of NCC 2022 will be subject to the following transitional arrangements:

• New energy efficiency and condensation mitigation requirements commence on 1 October 2023,

• New lead-free plumbing product requirements commence on 1 September 2025.

These transitional arrangements will allow practitioners to continue using the relevant provisions in NCC 2019 Amendment 1 until the end of the relevant transition period.

Supervising Your Apprentice

Taking on an apprentice is an exciting opportunity for you. Not only will you contribute to the development of a future tradesperson but you will support the future of our industry. However, there are a number of supervisory responsibilities that are required of you. These responsibilities will ensure the health and safety of your new apprentice.

To help you meet your supervisory requirements, Master Builders have developed these guidelines.

Your Requirements

To supervise an apprentice, you must meet the following requirements:

• Hold a valid Australian Business Number

• Not be deemed a Prohibited Employer as defined in the Apprenticeship and Traineeship Act (2001), Section 14.3

• Be suitably qualified to employ a person who holds a qualification equal to or greater than the qualification the Apprentice or Trainee is learning. For example, for a carpentry apprentice, the supervisor of the apprentice must hold a Carpentry qualification (Certificate III in Carpentry), or higher-level qualification in the same field.

Master Builders recommends the following guide for the minimum level of supervision of your apprentice: (Fig 2)

Direct Supervision: means the apprentice must be supervised at all times. This is on a direct and constant basis with visual contact and with the apprentice within audible range. The supervision is one-on-one and provides specific and constant guidance to the apprentice while keeping them in line of sight.

General Supervision: means the apprentice does not require the constant attendance of the Supervisor but is under the instruction and direction of the Supervisor for the tasks being performed. The Supervisor will provide

Design and Building Practitioners Act and Regulation: Insurance Requirements deferred to 1 July 2024

The requirement for indemnity insurance for Class 2 and Mixed Class 2 has been deferred from 1 July 2023 to 1 July 2024.

This means that on and from 1 July 2024 a registered building practitioner under the Design and Building Practitioners Act 2020 (the Act) will need to be adequately insured to perform building work.

Master Builders Association of NSW applied to the NSW Government to extend the requirement for indemnity insurance that was due to commence on 1 July 2023 should be deferred to 1 July 2024 on the basis there were insufficient suitable products in the market place.

Registered building practitioners will need to ensure that they are adequately insured for any work referred to in a compliance declaration given on and from 1 July 2024. This will include any work done before that date relating to that declaration.

Section 24(1) of the Act states:

(1) A registered building practitioner must not -

a) Provide a building compliance declaration to do related building work, or

b) Hold out that the practitioner is adequately insured with respect to the provision of the declaration or doing the work, unless the practitioner is adequately insured with respect to the declaration and work.

Clause 75 of the Design and Building Practitioners Regulation 2021 states:

(1) For the purposes of section 24(2)(a) of the Act, a registered building practitioner must be indemnified under an insurance policy, whether a professional indemnity policy or otherwise, that complies with this clause.

(2) An insurance policy must, in the reasonable opinion of the registered building practitioner concerned, provide for an adequate level of indemnity for the liability that could be incurred by the practitioner during the practitioner’s work.

(3) In determining whether a policy provides for an adequate level of indemnity, the practitioner must consider the following matters:

a) the nature and risks associated with the work typically carried out by the practitioner,

b) the volume of the work typically carried out by the practitioner,

c) the length of time that the practitioner has been registered,

d) a reasonable estimate of claims that could be brought against the practitioner based on paragraphs (a)–(c),

e) the financial capacity of the practitioner,

f) any limits, exceptions, exclusions, terms, or conditions of the policy

Whilst this was a requirement in the original legislation, it has been deferred since 2020 one year at a time since. Master Builders Association of NSW has requested the NSW Government to have further discussions about the ongoing lack of suitable insurance products especially given that any work that reaches completion after 1 July 2024 will require insurance for all work done prior to that date. We recommend that you consult with your insurance broker. Otherwise, you can contact Master Builders Insurance Brokers for further questions.

Update to the Exemptions under the Design and Building Practitioners Regulation 2021

Section 13 of the Design and Building Practitioners Regulation 2021 regulates certain work that is excluded from being building work under the Design and Building Practitioners Act 2020.

The following additional exemptions have been added to Section 13:

(1) work to install the following, but only if the work is the subject of a development consent that primarily relates to the installation—

(i) an awning, blind or canopy over a window or door,

(ii) a roofed structure over a balcony, deck, patio, or terrace, whether open or enclosed, unless the roofed structure is installed above the existing topmost roof of the building,

(2) work that—

(i) is the subject of a development consent that primarily relates to the work, and

(ii) is not—

(A) work for a building element for building work, or

(B) work for a performance solution for building work, including a building element.

Metal Roofing and Cladding Association Awards of Excellence 2022

The Metal Roofing and Cladding Association of Australia (MRCAA) conducted its Awards of Excellence for 2022 on Friday 18 November 2022 at the Hyatt Regency, Sydney with 345 in attendance. Twenty-one Contractor Members submitted 135 entries over the 17 categories. The Judges commented on the outstanding craftsmanship being undertaken by members.
