Are your showers ticking time bombs? Despite builders best efforts, leaking showers are consistently listed in the BSA’s top ten defects. Sadly, sometimes this is due to substandard workmanship, but most of the time it is the design of the shower itself which is creating the potential for disaster. Most contractors are at a complete loss as to why, but detailed testing has shown how, by the action of expansion and contraction, water is “pumped” along glue cavities to escape the shower enclosure, no matter how well it is water-proofed. Make the call to stay safe A

fter the challenges of the past two years, it was amazing that we could finally attend two of our events in person and host our annual Building Excellence Awards at Crown Melbourne in late January. As we are sure many of you will understand, holding an event in 2021 was difficult – although we know that we don’t have to tell any of you just how challenging the past two years have been. Dealing with the impacts of COVID-19 has been frustrating and exhausting.

Nevertheless, we are so proud that our industry – collectively and with a great deal of discipline and commitment – has managed to stay COVIDSafe and, for the most part, open for business.

A New Year with new uncertainty Once again, our industry has started a New Year with new uncertainty. A phrase that resonates with us is ‘’predictably unpredictable”. Despite the challenges presented by the COVID-19 pandemic, MBV has continually asked the Victorian Government to trust our industry to get on with the job of building and constructing our great state of Victoria. Our sector has consistently demonstrated that it can be trusted to safely operate with hundreds of people on building and construction sites. We have continually followed the Government’s health advice and operated our worksites and offices in a COVIDSafe manner - and our awards nights were no different, which is why we decided to proceed with them. The Master Builders Awards nights were ground breakers for 2022 - and we are determined that this year will be very different to the previous two. And what an awesome couple of nights they were! In the lead up to these events, and as COVID-19 hospitalisations and cases continued to rise in Victoria, MBV undertook a thorough risk assessment and worked with Crown Melbourne to

implement a range of proportionate mitigation strategies designed to limit the spread of COVID-19.

response from more than 800 members, guests and stakeholders who attended both events.

This action was consistent with other events held in Victoria, such as the Australian Open, which included hospitality functions or people attending the theatre to see a show.

All our guests were fully vaccinated, with many having already received their booster shot.

Make the call This year, this is our COVID theme – as individuals, making the call. Make the call to get tested and wear a mask.

MBV has your back We were both extremely humbled by the number of attendees that thanked and congratulated MBV on hosting the awards, especially during these challenging times.

We’re learning to live with this terrible virus and get on with living our lives.

In addition to expressing their thanks for all the advocacy work undertaken by MBV over the past two years, many members mentioned their appreciation of being able to focus on their businesses, knowing that MBV “had their back”.

Maben Group crowned at 2021 Excellence in

M

aben Group Pty Ltd has been named Master Builders Victoria Commercial Master Builder of the Year for its stunning upgrade to the Highpoint shopping centre in Maribyrnong. The Highpoint shopping centre project involved the upgrade of more than 10,000sqm of public shopping malls over levels two and three. The judges were especially impressed by the elaborate floor finishes which consisted of a mix of bluestone and granite tiling incorporating a feature granite wave and decorative ‘possum tail swirl’. Other quality finishes included a feature timber-look ceiling which included recessed inserts of plasterboard and perforated timber panels to achieve the look of a ‘honeycomb’, plus decorative cork wallpaper to feature curved bulkheads with stainless steel ribbed Rimex. Meanwhile, the Regional Builder of the Year – Commercial was awarded to Rendine Constructions Pty Ltd for its work on the Marcus Oldham College Learning Centre in Waurn Ponds.

Easton crowned at 2021 Excellence

aston Pty Ltd has been named Master Builders Victoria Residential Master Builder of the Year for its stunning construction of a prestige Toorak property. The judges were especially impressed that the construction of the stunning five-bedroom, 10-bathroom awardwinning Toorak home was made up of 74 pre-cast panels installed via 130-tonne cranes. The home boasts a spa, lap pool, 3.4m high ceilings on the ground floor, a dual height art gallery, library, gymnasium, and home theatre, with 360-degree views from the roof terrace. Meanwhile, the Regional Builder of the Year – Residential was awarded to Scott James Builder for its East Albury project. The East Albury project offered a rare opportunity in a regional centre to collaborate with one of Australia’s leading architects on a home where size was not the driver, but rather craftsmanship, quality, innovation and sustainability. The Young Builder of the Year – Residential went to Rhyse Mazza from Construct Melbourne.         After completing a trade apprenticeship in carpentry in 2004, Rhyse worked as a residential contract carpenter in Queensland and a contract commercial carpenter in Perth, Western Australia.

A growing concern remains building site thefts, with MBV again raising this issue in the media in December through the Surf Coast Times. It was only in November when brazen thieves stole a large 7m $14,000 fibre swimming pool from a construction site in Geelong.

December started with a story in the Future Victoria section of the Herald Sun encouraging students to learn a trade.

MBV committee member Stuart Allen spoke to the Ballarat Courier in December, warning locals to check their balconies for defects before socialising began over Christmas and the New Year.

MBV CEO Rebecca Casson told the paper that the state should prepare for a $300 billion building and construction blitz over the next five years as Melbourne

Mr Allen said many decks had collapsed in the past, causing serious injury, including people falling through noncompliant balustrades.

December also saw the Victorian Government introduce new female building and construction workers mandates. The Building Equality Policy (BEP) is an Australian first and aims to disrupt gender stereotypes in the country’s most male-dominated industry. MBV CEO Rebecca Casson was quoted in the Herald Sun on this important issue. We finished the year with a front-page story in The Age with builders driven to the wall as the cost of materials continues to skyrocket. The Warrnambool Standard also picked up our media release on new residential building approvals in early January after providing them with localised figures.

Extension of time claims What are they and when to use them? Luke McNally Legal Counsel

A

n extension of time (“EOT”) clause is a mechanism commonly found in building contracts, which allows a builder to claim additional time to complete the contract works. A builder’s claim under an EOT clause is often referred to as an “EOT claim”. An EOT claim is typically submitted to the client for their approval. If accepted, the clause usually operates by extending the “completion date” or “construction period” (as the contract dictates) by the amount of time requested in the claim. It is often the case that a builder who fails to complete their construction works on time will be liable to pay their client liquidated damages (“LD’s”). Therefore, a builder’s intention when issuing an EOT claim is usually to accrue more time and avoid paying their client LD’s.

What are LD’s, and how should they be calculated? LD’s are generally agreed to by the parties and inserted into the contract (before signing) as compensation for the builder failing to complete the contract works on time. LD’s are commonly incurred on a weekly basis and continue to accrue until the contract has reached completion. Often, a client can “offset” the LD amount against a builder’s final claim. If the LD’s exceed the final claim, then a client may apply to VCAT (or a Court in the case of a commercial building contract) seeking orders that the builder compensates the client an amount in addition to the final claim. VCAT and the Courts typically do not apply LD’s “punitively” when making such orders. This means that they often look to what a client has lost in consequence

of the builder exceeding the contract period/completion date, not simply what the contract says the client is entitled to. Similarly, builders should aim to calculate the LD figure to approximate what the client will lose when preparing and negotiating contracts. The calculation of LD’s commonly reflect such expenses as rent (e.g. what the client is paying towards renting a replacement property), loss of rental income (e.g. from an investment/rental/commercial property), and other expenses incurred in consequence of the builder failing to complete the contract works on time.

Am I entitled to an EOT claim? Builders claim EOT’s for several reasons, such as an inability to source materials, delays caused by clients, variations

(where the variation causes a delay to the completion of the works), inclement weather (outside of the ordinary contractual allowance), etc. However, whilst an EOT might appear necessary, the contract must also allow it. In other words, it must expressly state that an EOT is claimable under the relevant circumstance. Whether you are entitled to claim at all will largely depend on the type of contract you are using (and the special conditions contained therein). For example, the MBAV New Homes (HC-7; Edition 2 - 2018) and Home Improvement (HIC-6; Edition 2 - 2018) contracts (in their standard form) are rather liberal when allowing a builder to claim an EOT. This is particularly so, as a builder who uses said contracts

LEGAL is entitled to make an EOT claim for any delay that is caused “beyond the reasonable control of the Builder”. Additionally, if a claim is made and subsequently rejected by a client, then the builder might still be entitled to a fair and reasonable extension of time (see Clause 15.1). In this sense, the LD’s are acting as a kind of “placeholder” under the contract. Whilst the client is entitled to reject an EOT claim and offset the appropriate LD amount from the final claim; the builder may still apply to VCAT, seeking orders that the offset amount is reduced (given the effect of Clause 15.1); even where the client previously rejected the claim. On the other hand, the ABIC (SW 2018 H Vic) Simple Works Contract for Housing in Victoria (“Simple Works”) is significantly more restrictive. Instead of leaving an open “catch-all” provision (mentioned above), it limits a builder’s entitlement to claim only certain, predetermined events as outlined under clause L1. Further, the Simple Works contract does not outright allow VCAT to

take an authoritative position regarding delays. Instead, it leaves the Architect with a discretionary right to reject an EOT claim, with limited grounds for appeal. Suppose you are intending use a Simple Works contract in the future. In that case, you might consider including additional allowances for delay (under Item 21) or inserting a special condition into the contract (under Schedule 2a), effectively allowing VCAT to take a more discretionary role or by restricting the Architect’s discretion.

In other contracts (such as the Simple Works contract), the contract might require a builder to make the EOT claim within a set amount of time. Then if a builder exceeds that set timeframe, the builder might lose their entitlement to make their claim at all.

When should I make an EOT claim?

Disclaimer

This varies greatly from contract to contract. There is no set timeframe under some contracts (such as the HC-7 and HIC-6). Instead, the contract might require you to make the EOT claim “within a reasonable time” of the builder becoming aware of the delay. In this sense, the calculation of “reasonable time” is left to the discretion of the client (or VCAT if the client’s assessment is not accepted).

Nevertheless, regardless of which contract is used, it is always best practice for the builder to make their EOT claim as soon as they become aware of the delay (or potential for delay as the case may be).

This is general advice only. If you are considering making an EOT claim, have had an EOT claim rejected, or have any other query in respect to EOT’s, LD’s, or otherwise, we strongly encourage you to contact the Master Builders Victoria Legal Department for additional advice that might be adapted to suit your circumstances. Additionally, we strongly advise you to seek a solicitor’s advice before including any special conditions in your contract.

nce again, this year’s entries were all excellent examples of projects able to push the boundaries in construction quality to deliver on a whole range of sustainability objectives. These included energy efficiency, occupant comfort and waste reduction. Best Sustainable Home – Winner Lonsdale Building Group Project: West Melbourne Photographer: Jose Calix The eight entrants in this category ranged from bespoke new homes to renovated warehouses and terrace houses. The winner, a renovation of an inner Melbourne 1870s townhouse in West Melbourne, provides an excellent

blueprint for how the thousands of inner-city terrace houses can be brought to life for the new century. While the focus is constantly on improving the energy efficiency of new houses, thousands of these houses could use an upgrade to reduce their energy use and improve occupant comfort and amenity. Sustainability starts with reducing materials use and waste. The original structure and features that reflect the history and neighbourhood character were maintained. Careful attention to detail has increased comfort and light while reducing energy use. The 7 Star NatHERS rating was achieved by adding double-glazed windows and doors and adding insulation and northfacing windows. Other features include recycled timber, reused window frames and solar panels. This difficult renovation has brought the house from the 19th to the 21st century. Best Sustainable Project – Winner Becon Constructions Project: McDonald’s Melton

Designer: Richmond + Ross Pty Ltd Photographer: Sarah Louise Photography Becon Constructions has gone beyond the delivery of a building that is just energy efficient. The careful choice of materials to include recycled content reflects a move to the circular economy where solutions for reuse are found. From wheel stops made from recycled coffee cups, clever design to reduce waste and improve recycling outcomes, and education displays to bring consumers along the journey. This building is a step to reduce the environmental footprint of it and its use. The challenge for the builder, in this case, was to source and use materials not commonly in use. As a model for other stores, there is the potential here to significantly reduce the environmental footprint of McDonald’s Australia wide and at the same time expose consumers to these ideas.

Putting mental health first Addressing suicide issue requires industry-led solution Rebecca Casson CEO

E

very two days, an Australian builder or construction worker takes their own life.

Furthermore, construction workers are six times more likely to die from suicide than an accident at work and one in five Australian workers is likely to be experiencing a mental health issue at any one time – that figure rises to one in four among construction workers. These confronting facts are both deeply disturbing and preventable. Master Builders Victoria (MBV) urges builders, contractors, and tradespeople to make their physical and mental health a priority. Maintaining physical and mental wellbeing should be the priority of all participants in the Victorian building and construction industry. It is a shared responsibility and employers, and employees should all play their part. The Victorian building and construction industry may be booming, but it’s also facing a mental health crisis. MBV remains deeply concerned by reports that the building and construction industry has the highest rate of suicide of any industry. Those working in the construction industry are more than 50 per cent more likely to take their own lives.

HELP YOUR STAFF

Check-in regularly. Ask how they’re going and if there’s anything stressing them. Be responsive to their needs and suggestions. Establish clear processes. For example, make sure your workers know about site hygiene and social distancing, how to report issues, and what to do if they can’t make it to work. See Revision 13 of the COVID-19 Industry Guidelines. Stay informed. Help your workers to be informed by sharing the (reliably sourced) information you’re getting. Know about entitlements. Let your workers know about their entitlements and what to do if they are unable or unfit to work or have caring responsibilities. Support those at risk. If you have workers that are at a heightened risk of COVID-19 or may struggle with mental health, proactively engage and support them. Help team members get help. There are support services available for those who need it. For example, your workplace may have an employee assistance program, or you could assist a worker to reach out to one of the organisations on page 51.

And male construction workers aged 15-24 are more than twice as likely to take their own lives than the general population. Our industry must work together to support the mental health of our people. Suicide in our industry is a significant issue that requires an industry-led solution. Claims involving mental injuries are shown to lead to above-average timeoff work and higher-than-average claim costs. Mending broken bones is different to mending broken people. The growth in workplace mental injury remains a challenge for WorkSafe and it’s expected that mental health-related claims will continue to rise as it has done over the three previous financial years. By 2030, it is predicted that they will account for a third of all workers’ compensation claims. Currently, the well-being of those working in the building and construction

industry is being impacted by a range of factors including the pressures of COVID-19, supply chain shortages, banks not releasing funds, and employers and small businesses overwhelmed by regulatory changes – to name but a few. During this time of uncertainty and change, it’s natural to feel a range of emotions, such as stress, worry, or anxiety. Many people in our industry are dealing with huge business-related stress and anxiety right now and this may be flowing through to their teams and families. Our members have highlighted the importance of mental health in our industry and asked for MBV’s help, compelling us to recognise our role in that support network. As the leading voice in the building and construction industry, we have a range of ‘touch points’ with builders, tradespeople, manufacturers, suppliers and stakeholders, enabling us to open that imperative dialogue on mental health awareness.

Automatic Mutual Recognition arrives in state Victoria Giddens MBV Policy Advisor

utomatic Mutual Recognition (AMR) is a national scheme that enables registered or licensed practitioners who hold a registration or licence to work in another state or territory without having to pay for an added registration or licence. This scheme sits under the Commonwealth Mutual Recognition Act 1992 (MRA) and is implemented and administered by each state and territory government and regulators. AMR aims to increase national occupational mobility to boost economic recovery from the coronavirus (COVID-19) pandemic and disasters

Victorian practitioners seeking to work interstate should check whether AMR has commenced for their occupation in the state they wish to work in via the Commonwealth Government’s website: Improving occupational mobility. such as floods and bushfires whilst improving Australia’s economic productivity. AMR commenced in Victoria for architects and most building occupations on 1 January 2022. Workers registered in a building or architectural occupation in another state can use

AMR to work in Victoria from 1 January. AMR for plumbing work, building surveyors, and building inspectors will commence later. AMR differs from the existing mutual recognition scheme; people can use their home state occupational registration or licence to work under AMR in participating jurisdictions. Under the existing mutual recognition scheme, you need to apply and pay for a new occupational registration or licence in each jurisdiction.

Important things to know if you are going to work under AMR When using AMR, host state laws apply equally to all people carrying out the activity irrespective if the person is a local practitioner or comes from interstate. In the Victorian building industry, this means that people from interstate

Project Manager Brodie Fraser of MBB Consulting said working on Victoria’s cladding rectification program had given her a unique professional experience. “The cladding rectification program first appealed to me as it utilises technical knowledge and stakeholder management skills while enhancing community safety and reducing risk,” Brodie said. “There’s a lot of emotion involved for owners, and many have been under a lot of emotional and financial stress, so relationship management is crucial on these projects.” Before overseeing cladding rectification works, Ms Fraser was a project engineer specialising in facades. he MBV Employment and Industrial team frequently receive questions about CoINVEST. To help our members better understand CoINVEST, we have provided our common questions, and answers below about our industry’s long service leave scheme.

What is CoINVEST? CoINVEST is the portable long service leave scheme for the construction industry in Victoria. The scheme ensures workers in the construction industry have access to long service leave, even if they don’t remain with one employer for seven years. It is a legal obligation for many businesses and workers in the construction industry in Victoria to register with CoINVEST.

Who is covered by CoINVEST? The scheme covers most on-site building and construction work. The scheme also covers renovation, maintenance, installation work, and some repair work. Examples of work covered include carpentry, labouring, bricklaying, plastering, painting and concreting. The scheme covers employees and extends to working directors and some independent contractors.

So, how does it work? Employers must complete a Workers’ Days, and Wages form every three months. Employers record how many days their employees worked in the quarter and their wages for the work performed. CoINVEST will then issue an invoice to be paid, currently based on 2.7% of the total gross wages reported on the form. Workers will be eligible to claim long service leave once they have seven years of continuous service with CoINVEST. Continuous service can come from multiple employers, including gaps between the employment of up to four

years. Every year of recorded service accounts for 1.3 weeks of long service leave; 9.1 weeks will be available at seven years.

I only do domestic work. Do I still have to pay? Yes - CoINVEST applies to the residential/ domestic building sector. Regardless of sector, businesses performing construction work in trades covered by the scheme must be registered. If work in covered trades exceeds five days in a month for any worker, you will also likely have a contribution obligation.

Do I have to pay for my apprentice? Yes - Apprentices are also covered by the CoINVEST scheme. Although you do not have to pay contributions for apprentices, you must ensure they are registered with the scheme and that their working days and school days are reported.

What obligations do I have for my casual employees? You are legally required to record the service of casual employees performing more than five days of covered work in any month.

I’m the director of my company. Do I need to pay CoINVEST for myself? If you operate under a company ABN and perform covered work, you will be classed as a working director. Though you may be the business owner, a working director is an employee of the business and therefore legally subject to the employee entitlement of portable long service leave from CoINVEST. This means that the company must report service and pay contributions for working directors and be subject to penalties for non-compliance. This can also apply to some Trustee directors too.

Are there penalties for not complying? Yes – Non-compliance with the scheme can result in financial penalties and

statutory interest being charged on contribution back payments for workers. The statutory interest is 10% on all unpaid contributions and, if imposed, can amount to several thousands of dollars.

I have not been paying into CoINVEST. What should I do now? MBV members can call the Employment and Industrial Relations team for a confidential discussion regarding their situation. We can provide advice about your situation and assist you with becoming compliant with the scheme. If you must make back payment contributions, MBV has an interest waiver arrangement with CoINVEST. The waiver arrangement only applies to members unaware of their obligations and who have never been registered with the scheme. Please note that interest waiver applications are determined on a case-by-case basis at the discretion of CoINVEST. Teretek® Repairs and Strengthens Foundations of Aged Care Building Seabrook is a large aged care residence operated by the McKenzie Aged Care Group. The residence comprises a single building, with several wings that accommodate 1,700 residents. A 125m long section at the back of the building had experienced settlement of up to 180mm, affecting approximately 2500m2 spanning three separate wings, a shed and connecting pathways. Mainmark was required to fill voids to maximise ground support, and where possible, re-level the facility’s three rear wings and apron slabs. The work had to be undertaken with minimal disturbance to residents and within strictly mandated guidelines due to COVID-19 pandemic. Mainmark identified its proprietary Teretek® resin injection solution as the most suitable product as it increases ground bearing capacity, fills voids and re-levels existing structures. The project was successfully completed on time, under budget, and allowed the residents to remain in their rooms. The client was extremely satisfied with the outcome,
