Message from the Attorney General The year 2016 was a year of grief and sorrow for all the Thai people with the passing of King Bhumibol Adulyadej. On behalf of all the staff of the Office of the Attorney General, I would like to express my profound condolences on this tragic and unwanted incident. Throughout his 70 - years reign, the monarch had unflaggingly dedicated himself for the benevolence of the Thai peoples. He reigned over Thailand in accordance with the ten royal virtues and was a prime example for the Thai people in many ways. In order to continue his legacy of commitment and to express our bereavement, I would like to encourage all of you to follow his teachings on a sufficient way of life. Since the entrance into ASEAN, the OAG has broadened and strengthened the international relationships with other ASEAN member countries. Even though the ASEAN Community Missions Centre has organized several activities to disseminate the knowledge to the OAGâ&#x20AC;&#x2122;s staffs, the challenges of entering into the ASEAN Community remain. We still need to expand and increase our legal expertise and our competence in order to be able to provide better prosecution services to the people of ASEAN. By the dawn of the coming New Year, I wish all of you and all the colleagues from the ASEAN Prosecutor Community good health, success at work and in life and a prosperous progress in everything and good luck all year through. 2

His Royal Highness Crown Prince Maha Vajiralongkorn was given his first name at birth as Somdej Phra Chao Luk Ya Tur Chaofa Vajiralongkorn Boromchakrayadisorn Santatiwong Thewetthamrongsuboribal Abhikkunupakornmahitaladulyadej Bhumibolnaretwarangkun Kittisirisombunsawangwat Boromkhattiyarajakumarn. HRH Crown Prince Vajiralongkorn is the only son of His Majesty the late King Bhumibol Adulyadej and Her Majesty Queen Sirikit. HIS MAJESTY PREAH BAT SAMDECH PREAH NORODOM SIHAMONI KING OF CAMBODIA His Majesty Norodom Sihamoni became the King of Cambodia on 14 October 2004. He is the eldest son of King Norodom Sihanouk and Queen Norodom Monineath. He was Cambodia’s ambassador to UNESCO and named by a ninemember throne council to become the next king after his father King Norodom Sihanouk abdicated in 2004. On 14 October 2004 he was selected by a special nine-member council. Sihamoni’s selection was endorsed by Prime Minister Hun Sen and National Assembly Speaker Prince Narodom Ranariddh. He was inaugurated and formally appointed as King on 29 October 2004. HIS MAJESTY SULTAN MUHAMMAD V KING OF MALAYSIA Sultan Muhammad V (previously known as Tengku Muhammad Faris Petra; born on 6 October 1969 in Kota Bharu) is the Sultan of the Malaysian stateof Kelantan. He was proclaimed Ruler in September 2010, succeeding his ill father - Sultan Ismail Petra. He attended St. Cross College, Oxford and the Oxford Centre for Islamic Studies and graduated in 1991. Yang Di-Pertuan Agong Sultan Abdul Halim of Kedah will end his five-year reign by the end of December since assuming the throne on 13 December 2011 after his election by the Conference of Rulers. Making the solemn vow to His Majesty King Bhumibol Adulyadej in my memory. In the past, to undertake their duties, public prosecutors did not have to make the solemn vow before the King. When the Regulation of Prosecutors Act was enacted in 2010, Section 37 provides that divisional public prosecutors or assistant provincial public prosecutors who will undertake duties shall make the solemn vow before the King. As the Assistant Public Prosecutors, Batch 45, my friends and I are the third generation of Assistant Public Prosecutors who had the greatest honor to make the solemn vow before the King since the abovementioned Act was enacted. One day, while my friends and I were carrying out our regular duty, we received a letter of the Department of Public Prosecutor Commission notifying us that the Assistant Public Prosecutors, Batch 45, should prepare to make the solemn vow before the King. Everyone felt excited and overwhelmed by this opportunity that finally came. For me, I had another duty which was to lead our friends to make the solemn vow. At that time, I had approximately a few months to remember all the sentence of the vow in order to make the solemn vow before the King. It was my highest honor to have a chance to meet our beloved King who has the Royal Compassion for all Thais. I tried to จุลสารประชาคมอัยการอาเซียน

memorize the whole vow. Finally, when the Department of Public Prosecutor Commission had sent another letter to us notifying that the Assistant Public Prosecutors Batch 45 would make the solemn vow before the King on Wednesday 12 December 2012, we felt really excited that we would finally had the greatest chance to meet our Father of the Nation and made the solemn vow before him to undertake our duties officially. On the day of making the solemn vow, the members of the Public Prosecutor Commission requested us to rehearse before we went to the Siriraj Hospital which was the place where we had this chance to make the solemn vow. Everyone had to rehearse different steps such as setting the row and rehearsing the vow. I could see the unity and willing of the friends in our class for such the important day. We were waiting in front of the meeting room on 14th floor, Chalermphrakiet Building. And when the time has come, Mr. Thavorn Panichpan, Deputy Attorney General at that time, put a note into the front pocket of my government official suit and told me that “If you forget the vow, just take this note and read it because once you stand before him, you will feel really excited.” At that moment, I felt confident and answered him that “I will do my very best for this opportunity.” My first impression when I stepped into the room and stood before the King Rama IX who had already sat on his throne was the warm and kindhearted atmosphere which seemingly came from our beloved King and made me feel stunned for a moment. When everyone entered the room, H.E.Chulasingh Vasantasingh, the Attorney General at that time, introduced all Assistant Public Prosecutors to make the solemn vow before the King. Then, we made the solemn vow with our willingness and kept it tightly in our heart. After we had finished our last word, the King Rama IX gave the Royal Guidance to us to fulfill our duties in maintaining justice and bringing peace to the nation as follows:

“All of you uttered the vow in order to fulfil your important duty. Your vow was very important and you must keep your word forever. Keeping your word will have a lot of benefit to the nation because you could bring the justice to the people. People will have trust for the rule of the nation. Please keep your duty for justice. Your duty will make the nation peaceful and people will have trust in the rule of the nation. You are the integral part of the administration of this nation. Please keep your vow firmly. If you can keep it well, you will satisfy with your work. Also, you will be pleased that you carry very important duty to keep the nation peaceful and helpful for all people. I wish you perform your duty well. This will help the nation peaceful. You will fulfil yourself with the work you have done. If you perform your duty well, I wish you successful and have happiness in your work. Also, please be consistent with your work for your entire working life.” After His Majesty the King finished his Royal Guidance, I was stunned for a while until all my superiors and my friends left the room. Realizing His Majesty the King’s Compassion, I always keep the Royal Guidance in mind to fulfill my duty as public prosecutor with my best ability and also as his people to whom has been granted this precious duty in order to maintain justice for all my life. Even though almost four years have passed, his Royal Guidance is still echo in my mind and will certainly be my spiritual anchor leading me to keep performing my duties at my best everyday. การเข้าถวายสัตย์ต่อพระบาทสมเด็จพระปรมินทรมหาภูมิพลอดุลยเดช ในความทรงจ�ำของข้าพเจ้า ในอดีตที่ผ่านมานั้น การเข้าปฏิบัติหน้าที่พนักงานอัยการจะไม่มีการเข้าถวายสัตย์ ต่อพระมหากษัตริย์ จนกระทัง่ มีพระราชบัญญัตริ ะเบียบข้าราชการฝ่ายอัยการ พ.ศ. 2553 ซึง่ ก�ำหนดให้ พนักงานอัยการผูด้ ำ� รงต�ำแหน่งอัยการประจ�ำกองหรืออัยการจังหวัดผูช้ ว่ ย ทีจ่ ะเข้ารับหน้าทีต่ อ้ งเข้าถวายสัตย์ปฏิญาณตนต่อพระมหากษัตริย์ ตามมาตรา 37 ข้าพเจ้า และเพือ่ นๆ นัน้ อยูใ่ นอัยการผูช้ ว่ ยรุน่ ที่ 45 ซึง่ จะได้รบั เกียรติอนั สูงสุดในการเข้าถวายสัตย์ ต่อพระมหากษัตริย์เป็นรุ่นที่ 3 นับตั้งแต่มีกฎหมายก�ำหนดไว้ ในวันที่ข้าพเจ้าและ เพือ่ นร่วมรุน่ ทุกคนก�ำลังปฏิบตั หิ น้าทีอ่ ยูน่ นั้ วันหนึง่ มีหนังสือจากส�ำนักงานคณะกรรมการ อัยการมาถึง แจ้งว่าให้อัยการผู้ช่วยรุ่นที่ 45 เตรียมตัวเข้าถวายสัตย์ปฏิญาณตนเพื่อเข้า ปฏิบตั หิ น้าที่ ทุกคนรูส้ กึ ตืน่ เต้นและยินดีถงึ โอกาสในครัง้ นีเ้ ป็นอย่างมาก ในส่วนข้าพเจ้านัน้ มีอกี หน้าทีห่ นึง่ ทีต่ อ้ งท�ำแทนเพือ่ นๆ ในรุน่ คือ ต้องเป็นผูน้ ำ� กล่าวถวายสัตย์ปฏิญาณตนต่อ พระมหากษัตริย์ ซึง่ ในขณะนัน้ ข้าพเจ้ามีเวลาประมาณ 2-3 เดือนในการจดจ�ำค�ำปฏิญาณ ให้ขนึ้ ใจ นับตัง้ แต่นน้ั เพือ่ ทีจ่ ะให้เพือ่ นในรุน่ ทุกคนรวมถึงข้าพเจ้ารูส้ กึ ภาคภูมใิ จกับโอกาส ทีจ่ ะได้เข้าเฝ้าทูลละอองธุลพี ระบาทในหลวงรัชกาลที่ 9 อันเป็นทีเ่ คารพรักอย่างยิง่ และมี พระมหากรุณาธิคณ ุ อย่างล้นพ้นอย่างหาทีส่ ดุ มิได้ตอ่ ปวงชนชาวไทย ข้าพเจ้าได้พยายาม

จดจ�ำค�ำปฏิญาณจนขึน้ ใจ ในวันทีค่ ณะกรรมการอัยการมีหนังสือแจ้งว่าอัยการผูช้ ว่ ยรุน่ ที่ 45 จะได้รับโอกาสเข้าถวายสัตย์ปฏิญาณตนในวันพุธที่ 12 ธันวาคม พ.ศ. 2555 ทุกคน ตื่นเต้นเป็นอย่างมากว่าจะได้พบกับพ่อหลวงของปวงชนชาวไทยและได้ถวายสัตย์เพื่อ ปฏิบัติหน้าที่ที่ตนได้รับต่อหน้าท่านแล้ว ในวันที่ต้องเข้าถวายสัตย์นั้น คณะกรรมการอัยการได้ก�ำหนดให้มีฝึกซ้อมก่อน เคลื่อนคณะไปยังโรงพยาบาลศิริราช ซึ่งเป็นสถานที่ที่พวกเราได้รับโอกาสในครั้งนี้ ทุ ก คนต้ อ งซ้ อ มขั้ น ตอนต่ า งๆ ไม่ ว ่ า จะเป็ น การตั้ ง แถว การซ้ อ มกล่ า วค�ำ ปฏิ ญ าณ ซึ่งซ้อมจนแทบนับครั้งไม่ได้ ข้าพเจ้าได้เห็นความสามัคคีและความตั้งใจของเพื่อนๆ ซึ่งรวมใจกันซักซ้อมเพื่อวันที่ส�ำคัญวันนี้ เมื่อถึงเวลาที่ต้องเข้าถวายสัตย์ปฏิญาณ ตนนั้น ทุกคนขึ้นไปรอหน้าห้องประชุมชั้น 14 อาคารเฉลิมพระเกียรติ ที่จะได้เข้าเฝ้า ทูลละอองธุลพี ระบาทในหลวงรัชกาลที่ 9 ด้วยความตืน่ เต้น เมือ่ ถึงคราวของคณะอัยการ ท่านถาวร พานิชพันธุ์ รองอัยการสูงสุดในขณะนั้น น�ำกระดาษบันทึกค�ำถวายสัตย์มาให้ ใส่กระเป๋าไว้แล้วบอกว่า “หากจ�ำไม่ได้หยิบขึ้นมาอ่านเลยนะ เพราะเมื่ออยู่ต่อหน้า พระพักตร์พระองค์ท่านแล้วจะตื่นเต้นมาก” ในตอนนั้น ข้าพเจ้ามั่นใจและตอบท่านไปว่า ส�ำหรับโอกาสในครั้งนี้ ผมจะท�ำให้ดีที่สุดครับ เมื่อถึงเวลาความรู้สึกแรกเมื่อเดิน ก้าวเข้าไป ยืนต่อหน้าพระพักตร์ในหลวงรัชกาลที่ 9 ซึ่งประทับนั่งรออยู่แล้ว ข้าพเจ้าได้ สัมผัสกับบรรยากาศรอบตัวของท่านที่เปี่ยมไปด้วยความเมตตา ข้าพเจ้ายืนนิ่งอยู่ ครู่ใหญ่ จนกระทั่งเพื่อนๆ ทุกคนเข้ามาพร้อมกันในห้อง ท่านจุลสิงห์ วสันตสิงห์ อัยการสูงสุดในสมัยนั้น จึงกล่าวน�ำอัยการผู้ช่วยเข้าถวายสัตย์ปฏิญาณตน พวกข้าพเจ้า ได้กล่าวค�ำปฏิญาณด้วยความตัง้ ใจและระลึกถึงค�ำปฏิญาณอยูใ่ นใจ เมือ่ กล่าวค�ำปฏิญาณ เรียบร้อยแล้วพระบาทสมเด็จพระเจ้าอยูห่ วั รัชกาลที่ 9 ได้พระราชทานพระบรมราโชวาท แก่พวกข้าพเจ้า เพือ่ เป็นแนวทางในการปฏิบตั หิ น้าทีร่ กั ษาความยุตธิ รรมสร้างความสงบสุข แก่ประเทศชาติ ความว่า “ท่านได้เปล่งค�ำปฏิญาณ เพือ่ ให้งานในหน้าทีส่ ำ� คัญอันนีบ้ รรลุผล อย่างแน่นอน การที่ท่านปฏิญาณมานี้ก็ถือว่าเป็นสิ่งที่ส�ำคัญ และท่านก็ต้องรักษาค�ำพูด นีใ้ ห้ดเี ป็นแน่นอน และให้มคี วามสามารถรักษาไว้ตลอดไป ถือว่าการรักษาค�ำพูดนีจ้ ะเป็น

ประโยชน์ตอ่ ประเทศชาติอย่างยิง่ เพราะว่าจะท�ำให้ความยุตธิ รรมเกิดขึน้ ในหมูช่ น คนก็จะ ไว้วางใจในการปกครองเรียบร้อยของประเทศ และก็ให้พงึ รักษาความยุตธิ รรมของหน้าที่ จะท�ำให้ประเทศชาติอยูเ่ ย็นเป็นสุขได้ ประชาชนได้มคี วามไว้วางใจในการปกครองประเทศ ขอให้ท่านมีส่วนส�ำคัญในการปกครองประเทศนี้ โดยรักษาค�ำปฏิญาณนี้อย่างเคร่งครัด อนึ่งถ้าท่านรักษาค�ำปฏิญาณอย่างเคร่งครัด ท่านจะมีความพอใจในงานของตัวได้ และ มีความพอใจโดยทีท่ า่ นจะได้ปฏิบตั หิ น้าทีส่ ำ� คัญให้บา้ นเมืองอยูเ่ ย็นเป็นสุข เป็นประโยชน์ ต่อประชาชนทั้งหลาย ขอให้ท่านท�ำงานนี้โดยความส�ำเร็จเรียบร้อย ถือว่าท่านได้ช่วย ให้ประเทศชาติอยูเ่ ย็นเป็นสุขได้ ท่านเองก็จะมีความสุขในงานการทีป่ ฏิบตั ิ ถือว่างานการนี้ ปฏิบัติดี ก็ขอให้ท่านได้สามารถปฏิบัติงานนี้ด้วยความส�ำเร็จเรียบร้อยและมีความสุข ความพอใจในงานของตน ขอให้ท่านมีความเจริญรุ่งเรืองในงานการ ขอให้มีความ สม�่ำเสมอในงานการนี้ตลอดช่วงเวลาที่มีหน้าที่” หลังจากนั้นข้าพเจ้าก็ยืนนิ่งอยู่ต่อ ชั่วครู่ใหญ่ จนผู้ใหญ่ของส�ำนักงานอัยการสูงสุดและเพื่อนๆ ทุกคนค่อยๆ เดินออกไป ด้วยส�ำนึกในพระมหากรุณาธิคุณ ข้าพเจ้าตั้งมั่นในใจว่าพระบรมราโชวาทของท่าน จะเป็นสิง่ ยึดเหนีย่ วจิตใจให้ปฏิบตั หิ น้าทีพ่ นักงานอัยการให้ดที สี่ ดุ เพือ่ ด�ำรงความยุตธิ รรม ในฐานะประชาชนคนหนึ่งของท่านที่ได้รับหน้าที่อันมีคุณค่านี้ให้ดีที่สุดตราบเท่าที่ชีวิต จะหาไม่ แม้วา่ จากวันนัน้ จนถึงวันนีจ้ ะผ่านไป 4 ปีแล้วแต่พระบรมราโชวาทของท่านยังคง ก้องอยู่ในใจและเป็นสิ่งที่ยึดเหนี่ยวจิตใจและเป็นแนวทางในการปฏิบัติหน้าที่ที่ได้รับ ในฐานะพนักงานอัยการเพือ่ แผ่นดินให้ดที สี่ ดุ ในทุกๆ วัน ข้าพเจ้าจะน้อมร�ำลึกถึงพระมหา กรุณาธิคุณตลอดไป และขอถวายความอาลัยพระบาทสมเด็จพระปรมินทรมหาภูมิพล อดุลยเดช (โดย ธีรัช ลิมปยารยะ อัยการประจ�ำส�ำนักงานอัยการสูงสุด)

Young Southeast Asian Leaders Initiative Summit 2016 Barack Obama marked the first US President who made a historic visit to Laos PDR from 5-8 September 2016, and this also was expected to be his final trip to Asia as the President of United States. He participated in 4th ASEAN - U.S. Summit and 11th East Asia Summit in Vientiane. Also, he held a Young Southeast Asian Leaders Initiative (YSEALI) Town Hall on 7th September 2016 at Souphanouvong University, Luang Prabang. I am 2016 “image from yseali” Spring YSEALI professional alumni from Thailand who had a chance to attend YSEALI Summit 2016 and met President Obama in Town Hall. What is YSEALI? Young Southeast Asian Leaders Initiative (YSEALI) is United State Government’s signature program launched in 2013 by President Obama. This initiative is to strengthen leadership and to tie a network between U.S. and Southeast Asia to solve regional and global challenges.1 YSEALI empowers young emerging leaders from ten ASEAN nations aged between 18-35 years to make a difference to their societies. The program promotes youth’s capacity-building through a wide variety of schemes and 1

involvement including U.S. educational and cultural exchanges, regional exchanges, and seed funding. There are four main areas identified by youth namely, civic engagement, environment and natural resources management, and entrepreneurship and economic development. The fellowship programs offer both academic and professional fellows to spend five weeks in United States in order to experience American culture and to shape their global perspectives on which applicable to their communities when the fellows return their home countries. For more information please see https://asean.usmission.gov/yseali/ YSEALI Summit 6 - 8 September 2016 The YSEALI Summit is an annual meeting of YSEALI alumni from the YSEALI Fellows Program. This year the YSEALI Summit was held for three days from 6 to 8 September 2016 in Luang Prabang, Laos PDR. More than 200 emerging leaders from ten ASEAN nations joined the program. The main theme of YSEALI Summit was â&#x20AC;&#x153;Sustainable Development in ASEAN and Beyondâ&#x20AC;?. Participants were encouraged to address the development gap in ASEAN as well as to discuss challenges facing rural areas and to find innovative solutions for sustainable development in line with SDGs.2 Thematic sessions focused on education, civic engagement, economic development and environment and natural resource for rural development. This forum opened the room for all participants to discuss the development gap and challenges in their communities and to learn promising practices for leveraging local 2

economy and finding its effective solutions such as community-based tourism, sustainable agriculture and food security, and inclusive schooling for diverse societies. These experiences shaped the attendees’ ideas that can turn into actions adaptable to their respective communities. Remarks by President Obama at YSEALI Town Hall On September 7, 2016 President Obama flew to Luang Prabang while the ASEAN Summit was underway in Vientiane. He hosted YSEALI alumni at Souphanouvong University and gave them his opening remarks. In Southeast Asia almost two third of populations were born after 1980. He envisaged these young peers would play more powerful role in shaping the future than any generation since they are the most educated and have passion-driven energy to develop their communities. Therefore, to connect with young ASEAN leaders becomes an important America’s foreign policy. Accordingly, YSEALI was launched to empower young people with skills and resources by which welcome them to United States to experience state and local government, and to intern in some organizations. Two role models of YSEALI Summit President Obama admired two young ladies as the exemplars of their dedication for those who are lack of economic opportunity in societies. First lady is Amema Saeju who dedicates her life to Lisu hill tribe, the indigenous people in Northern Thailand. Amema grew up in Lisu village and has passion to preserve her people’s culture and heritage. She found the Lisu Cultural Heritage Center in Chiang Mai to preserve the indigenous history and culture

of her tribe. Handicraft made by Lisu women are also sold in the Center to help them earn a living and ensure that Lisu heritage will pass to future generations.3 The second lady is Dissa Syakina Ahdanisa from Indonesia who founded the Deaf Café Fingertalk to provide job opportunities and workshop training to the people with hearing impairment. Deaf people are lack of employment opportunities in Indonesia. Therefore, her effort is to address such a challenge through awareness-raising campaign on economic empowerment and the rights of deaf people. She hopes to open more cafes across her country to create more jobs not only for the deaf but also people with other disabilities.4 After his remarks, President Obama allowed the participants from each country to ask any query. One interesting question was raised by Mr.Putthisak Panomsarnnarin from Thailand that in next 10 year what does Mr. President expect ASEAN people think about U.S.A.? Obama hopes that the next President will continue his foreign policy with ASEAN leaders. And, ASEAN people will look back the engagement that he began in this region has developed and go deeper and maturely in all areas. การประชุมสุดยอดผู้น�ำเยาวชนอาเซียน ระหว่างวันที่ 6 - 8 กันยายน พ.ศ. 2559 การประชุมนีไ้ ด้จดั ขึน้ ทุกปีสำ� หรับศิษย์เก่าทีไ่ ปแลกเปลีย่ นในประเทศสหรัฐอเมริกา โดยการประชุมครัง้ นีจ้ ดั ขึน้ ระหว่างวันที่ 6 - 8 กันยายน พ.ศ.2559 ทีเ่ มืองหลวงพระบาง โดยมีเยาวชนจาก 10 ประเทศในภูมิภาคอาเซียนเข้าร่วม การประชุมกว่า 200 คน โดยหัวข้อการประชุมมีชื่อว่า “การพัฒนาอย่างยัง่ ยืนในอาเซียนและรอบนอก” มุง่ หมาย ให้ผู้เข้าร่วมระดมความคิดเห็น ข้อท้าทาย ช่องว่างของ การพัฒนาในอาเซียน รวมถึงการพัฒนาชนบทที่ห่างไกล ตลอดจนหาวิธีแก้ไขปัญหาอย่างยั่งยืนโดยสอดคล้องกับเป้าหมายการพัฒนาที่ยั่งยืน (Sustainable Development Goals) ซึง่ การพัฒนาทีย่ งั่ ยืนต้องเปิดโอกาสให้คนทุกกลุม่ มีสว่ นร่วมในการพัฒนาชุมชน การพัฒนาด้านการศึกษา การอนุรกั ษ์สงิ่ แวดล้อม และการ ยกระดับเศรษฐกิจในท้องถิ่นด้วยวิธีการที่ยั่งยืน เช่น การพัฒนาแหล่งท่องเที่ยวชุมชน การท�ำเกษตรแบบยั่งยืน การจัดระบบการศึกษาส�ำหรับชุมชนที่หลากหลาย การประชุม ครัง้ นี้ เป็นการเปิดวิสัยทัศน์ของเยาวชนรุ่นใหม่ในการแก้ไขปัญหาที่เกิดขึ้นในชุมชนของ ตนโดยน�ำเอาวิธีการแก้ไขเหล่านี้ไปปรับใช้ให้เกิดประโยชน์ต่อไป การกล่าวปราศรัยโดย นายบารัค โอบามา เมื่อวันที่ 7 กันยายน 2559 นายบารัค โอบามาในฐานะประธานาธิบดีของ สหรัฐอเมริกาและผู้ก่อตั้งโครงการ YSEALI ได้มากล่าวปราศรัยให้กับผู้เข้าร่วม การประชุมสุดยอดผู้น�ำเยาวชนอาเซียน ณ มหาวิทยาลัยสุภานุวงศ์ เมืองหลวงพระบาง ในค�ำกล่าวปราศรัยนัน้ นายโอบามา กล่าวถึงความส�ำคัญกับเยาวชนอาเซียนซึง่ มีจำ� นวนถึง 2 ใน 3 ของประชากรทั้งหมดในภูมิภาค เยาวชนคนรุ่นใหม่เหล่านี้จะมีบทบาทส�ำคัญ ในอนาคตเพราะคนกลุ ่ ม นี้ เ ติ บ โตในยุ ค ที่ ไ ด้ รั บ การศึ ก ษามากกว่ า คนรุ ่ น ก่ อ นและมี ความตั้งใจอย่างแรงกล้าอยากเห็นสังคมเกิดการเปลี่ยนแปลง ด้วยเหตุนี้ อเมริกาจึงได้ สานนโยบายการต่างประเทศกับเยาวชนอาเซียน โดยการก่อตัง้ โครงการ YSEALI ขึน้ มา 20

เป็นโครงการแลกเปลี่ยนศึกษาดูงานของรัฐบาลสหรัฐอเมริกาทั้งในส่วนกลางและมลรัฐ ตลอดจนให้ฝึกงานกับองค์กรส�ำคัญๆ ในสหรัฐอเมริกา ระหว่างการกล่าวปราศรัย นายโอบามาได้กล่าวยกย่องผู้นำ� เยาวชนสตรี จ�ำนวน 2 คน ผู้เป็นแบบอย่างในการช่วยเหลือผู้ด้อยโอกาสทางเศรษฐกิจ คนแรกคือ น.ส.อมีมา แซ่จู จากประเทศไทย น.ส.อมีมาเติบโตในหมู่บ้านชาวเขาเผ่าลีซูและเป็นผู้ก่อตั้งศูนย์ มรดกชาติพันธุ์ลีซูเพื่ออนุรักษ์ประวัติศาสตร์และวัฒนธรรมของชนกลุ่มน้อยของเธอ ไม่ให้สูญหายไป นอกจากนี้ในศูนย์วัฒนธรรมดังกล่าวยังวางขายงานหัตถกรรมของ ผู้หญิงลีซูเพื่อเป็นการสร้างรายได้ให้กับผู้หญิงชาวเขาเผ่าลีซู และสืบทอดวัฒนธรรม เผ่าลีซูไปยังคนรุ่นต่อไป คนที่สองคือ นางดิซซา อาห์ดานิซา จากประเทศอินโดนีเซีย ผู้ก่อตั้ง Deaf Café Fingertalk หรือคาเฟ่ภาษามือส�ำหรับผู้พิการทางการได้ยิน เพื่อสร้างโอกาสในการท�ำงานและฝึกอบรมให้กับผู้พิการทางการได้ยิน นอกจากนี้ นางดิซซายังรณรงค์เพื่อสร้างความตระหนักถึงสิทธิคนพิการทางการได้ยิน และการ เสริมสร้างบทบาททางเศรษฐกิจแก่คนกลุ่มนี้ เธอมีเป้าหมายจะก่อตั้งคาเฟ่ทั่วประเทศ อินโดนีเซียเพื่อการจ้างงานคนพิการทางด้านอื่นๆ หลังจากการกล่าวปราศรัย นายโอบามาได้เปิดโอกาสให้ผู้เข้าร่วมประชุมจาก แต่ละประเทศถามค�ำถาม หนึง่ ในค�ำถามทีน่ า่ สนใจเป็นค�ำถามของนายพุฒศิ กั ดิ์ พนมสารนรินทร์ จากประเทศไทย ซึ่งถามว่าใน 10 ปีข้างหน้านายโอบามาคาดหวังให้คนอาเซียน คิดอย่างไรต่อสหรัฐอเมริกา? นายโอบามาตอบว่า ตนคาดหวังว่าประธานาธิบดีคนถัดไปจะ สานต่อนโยบายการต่างประเทศกับผูน้ ำ� อาเซียน และหวังว่าใน 10 ปีขา้ งหน้าคนอาเซียน จะมองย้อนกลับไปถึงความสัมพันธ์ระหว่างสองภูมภิ าคทีน่ ายโอบามาเป็นผูร้ เิ ริม่ นัน้ ได้รบั การพัฒนาและก้าวไปสู่ทุกพื้นที่ แต่นโยบายการต่างประเทศของสหรัฐอเมริกาของ นายโอบามาจะได้สานต่อหรือไม่นั้น คงต้องจับตาดูนโยบายของนายโดนัล ทรัมป์ ประธานาธิบดีสหรัฐอเมริกาคนต่อไป (โดย ชวลิดา ภิรมย์วงศ์ อัยการประจ�ำส�ำนักงานอัยการสูงสุด)

Thai Public Prosecutor to Join the 1 Joint Training Programme with Indonesian Public Prosecutors st

During 14 - 27 September 2016, delegation of Thai public prosecutors led by Mr.Thapana Jaiklom Deputy Director General, Department of Corruption Litigation, Mr.Mana Weraarchakun, Mr.Naris Chamnanchanan, Mr.Narong Srisasan and Mr.Kulachai Thonglongya visited Jakatar, the capital city of Indonesia, to officially join the first joint training program hosted by the Indonesian Attorney General’s Office at Educational and Training Board (BADIKLAT). The joint training program is conducted under the MOU between the Office of The Attorney Thailand and Attorney General’s Office of Indonesia. The course of this training is “Integrated Handling of Corruption Cases”. There were 30 participants for this course including Indonesian public prosecutors, Indonesian National Armed Forces prosecutors and Thai public prosecutors. All of lecturers are famous and skillful persons in the field of handling corruption cases in Indonesia, for instance, Dr.Yudi Kristiana, Dr.M.Yusuf and Dr.Chairul Huda. The language used in the training is Indonesian language and simultaneously translated into English for Thai visitors particularly. Apart from training in the class, the program also included visiting Attorney General’s Office of Indonesia and the Financial Transaction Reports and Analysis Center. คณะพนักงานอัยการไทย เข้าร่วมการฝึกอบรมร่วมกันระหว่าง พนักงานอัยการไทยและพนักงานอัยการอินโดนีเซีย เมือ่ วันที่ 14 - 27 กันยายน 2559 ทีผ่ า่ นมา คณะพนักงานอัยการจากประเทศไทย น�ำโดย นายฐาปนา ใจกลม รองอธิบดีอัยการ ส�ำนักงานคดีทุจริตและประพฤตมิชอบ นายมานะ วีระอาชากุล อัยการผู้เชี่ยวชาญพิเศษ นายนริศ ช�ำนาญชานันท์ อัยการผูเ้ ชีย่ วชาญ นายณรงค์ ศรีระสันต์ อัยการผูเ้ ชีย่ วชาญ และนายกุลชัย ทองลงยา อัยการประจ�ำส�ำนักงานอัยการสูงสุด ได้เข้าร่วมการฝึกอบรม ร่ ว มกั น ระหว่ า งพนั ก งานอั ย การไทยและพนั ก งาน อัยการอินโดนีเซีย ภายใต้หลักสูตรการด�ำเนินคดีทุจริต ชัน้ สูง ณ สถาบันฝึกอบรมพนักงานอัยการกรุงจาการ์ตา ประเทศอินโดนีเซีย โดยการฝึกอบรมร่วมกันครั้งนี้เป็นไปตามบันทึกความเข้าใจระหว่างส�ำนักงาน อัยการสูงสุดแห่งประเทศไทยกับส�ำนักงานอัยการสูงสุดแห่งประเทศอินโดนีเซีย ผูเ้ ข้าร่วม อบรมนั้น นอกจากพนักงานอัยการไทยและพนักงานอัยการอินโดนีเซียแล้ว ยังมีอัยการ ทหารอินโดนีเซียเข้าอบรมด้วย ซึง่ มีทงั้ อัยการทหารบก อัยการทหารเรือ และอัยการทหาร อากาศ ในการอบรมนัน้ จะอบรมในห้องเรียนมีผเู้ ข้าอบรมทัง้ หมดรวม 30 คน โดยแต่ละวัน จะมีวทิ ยากรทีม่ คี วามรูค้ วามสามารถทีม่ คี วามเชีย่ วชาญ ในการท�ำคดีทจุ ริตเป็นผูใ้ ห้ความรู้ การอบรมจะใช้ภาษา อินโดนีเซียเป็นหลัก โดยมีล่ามแปลภาษาอังกฤษให้แก่ ผู้เข้าร่วมอบรมจากประเทศไทยโดยเฉพาะ นอกจากนี้ ระหว่างผู้เข้าอบรมยังมีโอกาสได้ไปเยี่ยมชมส�ำนักงาน อัยการสูงสุดแห่งประเทศอินโดนีเซีย และส�ำนักงานวิเคราะห์ธุรกรรมทางการเงิน แห่งประเทศอินโดนีเซียอีกด้วย (โดย กุลชัย ทองลงยา อัยการประจ�ำส�ำนักงานอัยการสูงสุด) จุลสารประชาคมอัยการอาเซียน

â&#x20AC;&#x153;Sustainable development cannot be achieved without access to justice for all and without the creation of accountable and inclusive criminal justice institutionsâ&#x20AC;? Above is the extract from the keynote address given by Her Royal Highness Princess Bajrakitiyabha Mahidol of Thailand at the First ASEAN Conference on Crime Prevention and Criminal Justice (ACCPCJ). It is presumably that most of people are not familiar with ACCPCJ just like the author. Fortunately, with support from the Office of the Attorney General, the author had privilege to attend the first ever ACCPCJ which was held during 9-11 November 2016 in Bangkok, Thailand. 24

The purpose of this article is to introduce ASEAN Prosecutor Community with an overview of ACCPCJ so that we are aware of the newest platform for ASEAN member countries to share and learn about tendency of crimes threatening ASEAN Community. This is to ensure that the ten member countries shall be able to work together closely to combat serious transnational crimes occurred in the region. Following the proposal made by Thailand, in 2015, the ASEAN Senior Law Officials and the ASEAN Law Ministers set up an inter-governmental Consultative Group to coordinate the organization of the Conference. Subsequently, the theme of the first ACCPCJ was reached. It was accepted that ASEAN must Enhance Crime Prevention and Criminal Justice Institutions for Sustainable Development of the ASEAN Community. The member states have given priority to three thematic topics to be discussed in the first ACCPCJ. The first topic is “tackling the emerging threats of wildlife and timber trafficking in ASEAN”. Because Southeast Asia is one of the most abundance natural resources area, ASEAN countries, therefore, face similar threats concerning depletion of natural resources due to illegal wildlife and timber trafficking. This session aims to enhance regional cooperation in monitoring, investigation system, data collection and knowledge management. Various speakers including environmental academia and highly experienced officers in the environmental field presented their views and exchanged experiences in combatting illegal trafficker. The conference agreed that ASEAN countries face difficulty in combatting wildlife and timber trafficking partly because we adopted different legal framework such as level จุลสารประชาคมอัยการอาเซียน

of penalty, dissimilar of criminal offences related to environmental law etc. Therefore, the conference concluded that ASEAN members should review their existing legal framework so that ASEAN members are able to harmonize legal framework for environmental issues. The second topic focuses on “crime prevention strategies aimed at children and youth in urban areas”. This is to strengthen youth crime prevention cooperation including collecting and analyzing youth crime data as well as sharing best practice derived from national crime prevention policies. The last and highlight of the conference is the topic on “effective offender rehabilitation and prison reform for vulnerable groups”. In this session, the Conference received the highest honour as Her Royal Highness Princess Bajrakitiyabha Mahidol delivered a keynote remark on the topic. Her Royal Highness emphasized the need to provide special treatment for vulnerable prisoners, for example, juvenile offenders, elderly prisoners, women prisoners as well as foreign national prisoners. Because ASEAN is a unique community and member countries share common challenges, it is believed that ACCPCJ could be a new platform for the ASEAN countries to exchange views, experiences as well as others information in order to enhance crime prevention and criminal justice institutions for sustainable development of the ASEAN community as it was initially aimed. “การพัฒนาที่ยั่งยืนไม่สามารถเกิดขึ้นได้หากปราศจากซึ่งการเข้าถึงความ ยุติธรรมของคนทุกคน ตลอดจนการสร้างสถาบันด้านกระบวนการ ยุติธรรมที่ครอบคลุม และมีความรับผิดชอบ” ข้างต้น คือส่วนหนึง่ ของพระด�ำรัสของพระเจ้าหลานเธอ พระองค์เจ้าพัชรกิตยิ าภา ซึ่งทรงมีปาฐกถาพิเศษในการประชุมอาเซียนว่าด้วยการป้องกันอาชญากรรมและ ความยุติธรรมทางอาญา ครั้งที่ 1 คงไม่ใช่เรื่องแปลกหากท่านผู้อ่านจะสงสัยว่า ACCPCJ คืออะไร ทั้งนี้เพราะ ACCPCJ (ASEAN Conference on Crime Prevention and Criminal Justice) หรือที่เรียกในภาษาไทยว่า การประชุมอาเซียนว่าด้วยการป้องกันอาชญากรรมและ ความยุติธรรมทางอาญา เกิดขึ้นเป็นครั้งแรกที่ประเทศไทย ระหว่างวันที่ 9 -11 พฤศจิกายน 2559 ณ โรงแรมดุสิตธานี กรุงเทพมหานคร การประชุมอาเซียนว่าด้วยการป้องกันอาชญากรรมและความยุติธรรมทางอาญา ครั้งที่ 1 เกิดขึ้นโดยความริเริ่มของประเทศไทย โดยได้รับการสนับสนุนจากเจ้าหน้าที่ อาวุโสอาเซียนด้านกฎหมายและรัฐมนตรีกฎหมายอาเซียน ทั้งนี้ หัวข้อหลักของการ ประชุมครั้งนี้คือ “การยกระดับมาตรการป้องกันอาชญากรรมและสถาบันยุติธรรม ทางอาญาเพื่อการพัฒนาที่ยั่งยืนของประชาคมอาเซียน” การประชุ ม ครั้ ง นี้ ไ ด้ ห ยิ บ ยกปั ญ หาเร่ ง ด่ ว นที่ ท ้ า ทายประชาคมอาเซี ย น ขึ้นมาพิจารณาเพื่อแลกเปลี่ยนมุมมอง ประสบการณ์ในเบื้องต้น 3 หัวข้อด้วยกัน คือ (1.) การป้ อ งกั น และการปราบปรามภั ย คุ ก คามด้ า นการลั ก ลอบค้ า สั ต ว์ ป ่ า และไม้ ผิดกฎหมายในอาเซียน (2.) การป้องกันอาชญากรรมในกลุ่มเด็กและเยาวชนในพื้นที่ เขตเมือง (3.) การฟื้นฟูผู้กระท�ำความผิดอย่างมีประสิทธิภาพและการปฏิรูปเรือนจ�ำ ส�ำหรับกลุ่มเปราะบาง ต้องขอขอบคุณคณะผู้จัดการประชุมและบุคคลที่มีส่วนส�ำคัญในการริเริ่มให้เกิด การประชุมครั้งนี้ ต่อจากนี้ไปอาเซียนซึ่งมีอัตลักษณ์เฉพาะ และเผชิญปัญหาลักษณะ เดียวกันก็จะมีพื้นที่ส�ำหรับแลกเปลี่ยนประสบการณ์ และข้อมูลต่างๆ โดยมีวตั ถุประสงค์ สูงสุดเพื่อการพัฒนาที่ยั่งยืนของอาเซียนของพวกเรา (โดย รองรัฐ พุ่มคชา อัยการประจ�ำส�ำนักงานอัยการสูงสุด) จุลสารประชาคมอัยการอาเซียน

The Central Authorities of Indonesia and Thailand strengthened their cooperation on criminal matters related to human trafficking. From 26 to 28 September 2016 at the Anantara Hotel, Hua Hin, Thailand, the Australia-Asia Program to Combat Trafficking In Persons (AAPTIP) by Mrs.Anne Gallagher, International Legal Cooperation (ILC) Adviser; Mr.Perry Kendall, Regional Prosecutorial Adviser organized a bilateral consultation between Indonesia and Thailand on international legal Cooperation and joint review of the draft ASEAN Training Program on International Legal Cooperation in Trafficking in Persons Cases. As part of AAPTIP’s on-going AAPTIP’s capacity development activities in Southeast Asia, including in Cambodia and Myanmar, this bilateral consultation is funded by the Australian Government in relation to its aid programme to counter human trafficking. A team of four high level Thai practitioners and experts were leading the development of ASEAN regional resources and contributing to the AAPTIP’s capacity building focusing on strengthening the legal framework and practice on mutual legal assistance and extradition with its neighboring countries. Since Thailand’s Central Authority is highly motivated to continue and expand its network of international cooperation on criminal matters, it is therefore relevant for the Thai Central Authority to aim to play central role in relation to transnational cooperation. It is widely accepted that in terms of international cooperation in criminal matters, Thailand is in a strong position to continue its leadership in the region. This bilateral consultation is 28

key for both Indonesia and Thailand, who are considered to be in the fore front of fighting transnational crime in the region. According to AAPTIP’s intention, this activity is to strengthen relationships between key practitioners in both Indonesia and Thailand with a view to improving international legal cooperation on human trafficking cases between the two countries. It is also to provide Indonesia and Thailand with a potential opportunity to ‘test’ cooperation in relation to one or more cases where such cooperation (MLA or extradition) is needed. In addition, AAPTIP aimed to have this event as an opportunity for practitioners from both countries to jointly review and pilot parts of the draft ASEAN Training Program on International Legal Cooperation in Trafficking in Persons cases. Inputs from both countries will also be taken into account for the proposed review of the ASEAN Handbook on International Legal Cooperation in Trafficking in Persons Cases. Participants from Thailand comprised the four practitioners who are leading AAPTIP’s ILC Program: Wanchai Roujanavong, Senior Consultant Prosecutor; Chatchom Akapin, Deputy Director General of the International Affairs Department; Intranee Sumawong, Deputy Director General of the Trafficking in Persons Unit and Deputy Director General of the International Affairs Department; and Vipon Kititasnasorchai, Senior Public Prosecutor, Trafficking in Persons Unit. The Indonesia delegation comprised eight officials: seven practitioners from the Ministry of Law and Human Rights (including the Deputy Director of Extradition and the Deputy Director of Mutual Legal Assistance in Criminal Matters), as well as a prosecutor from the Office of the Attorney---General (Task Force on Terrorism and Transnational Crimes). จุลสารประชาคมอัยการอาเซียน

Participants from both countries benefited from this consultation in various aspects, including enhancing mutual understanding of each other policy, legal system and practice. Indonesian participants noted a number of areas for possible future cooperation with Thailand including discussion on a possible future bilateral MLA treaty, study exchange programme as an opportunity to observe more closely the work of Thailand’s Central Authority, initiating an actual MLA requests in human trafficking cases, as well as establishing systems to communicate with the Thai Central Authority. Indonesian participants also noted the potential value of initiating regular meetings between ASEAN Central Authorities, which one such meeting was held before. Welcome to the 2 nd year of Thailand edition of the ASEAN Prosecutor Community (APC) newsletter and the new board of editors. This 1st issue of the APC Newsletter will be distributed at the beginning of the year 2017 to celebrate the New Year festival. The main theme of this issue is Kings of all ASEAN countries: Brunei, Cambodia, Malaysia and Thailand. We congratulate on the new Kings of Thailand and Malaysia.
