A Bradford headteacher has been commended after turning a struggling primary school around and making it into one of the top 250 in the country for student progress. Multi-million pound settlement for girl’s glue injection COMPENSATION: Maisha Najeeb was awarded millions in compensation after she suffered brain damage following a mix-up in the hospital

A young girl, who has suffered permanent brain damage due to a hospital mix-up which saw glue injected into her brain, has been awarded a record £24million in compensation. Maisha Najeeb, 13, was admitted to the Children’s Clinic at Great Ormond Street in 2010 for treatment on a rare condition which had meant that her arteries and veins were tangled in her brain. The proposed surgery would see the girl injected with harmless dye, to allow doctors to see how well blood was flowing in her brain. Yet, when the doctors were performing the surgery, the syringe was mixed up with one containing glue, leading Maisha to suffer irreversible brain damage. Speaking outside London High Court, the now 13-yearold’s father, Sadir Hussain, said: “Her life is ruined. All her dreams have been broken. “I hope that by bringing this

case, lessons will have been learned to avoid this happening to other families. “We are grateful that agreement has been reached with Great Ormond Street to ensure that Maisha’s care needs are met.” Maisha will initially receive a lump sum of £2.8million from Great Ormond Street Hospital For Children NHS Trust, whilst Judge William Birtles also ruled that she would receive £383,000 a year until her 19th birthday, then £423,000 per year for as long as she lives - experts estimate she could be as old as 64. Her solicitor, Edwina Rawson, said Great Ormond Street could have avoided the tragic mix-up in June 2010 if the syringes for the treatment had been properly labelled. “What is so heartbreaking about this case is that the injury was so avoidable,” she told the court. “If the syringes had been marked-up so the hospital could see which contained glue and which contained dye, then Maisha would not have suffered what is an utterly devastating

brain injury.” Neil Block QC, representing Great Ormond Street Hospital For Children NHS Trust, added: “We can’t wind the clock back. We hope there are now systems and procedures in place to ensure such a tragic mistake cannot be made again. “While money can’t restore what Maisha has lost, we are sure a great burden has been lifted from the family by coming to the settlement we have.” Mr Block added that her parents should also be praised for their handling of the situation and engaging with the trust, saying this meant that the hospital could learn from what happened and make improvements. The compensation will be spent on care and accommodation for Maisha who now requires assistance with all basic daily tasks and has lost the majority of her bodily and cognitive abilities.

“When we came back from the winter break, we received a letter from David Laws (Minister of State for Schools in the DfE),” he explained. “It does obviously make you very proud to hear such news and recognition but it is done because we want the best outcome for the children. “Our aspirations are always to do the best for our children, and if it were not for our amazing staff and governing body we wouldn’t be where we are now.” Prior to Mr Zaman’s arrival an appointed governing body had been in place after the school had been placed in precautionary measures. Over the following three years, the school has been able to bring in new governors, and re-establish themselves as one of the top performing schools in the area. “For two years in a row now we have had fantastic results,” Mr Zaman continued. “In terms of the children, from Key Stage One to Two, the DfE measured progress and we were within the top one per cent nationally, as well as being the top 250 for progress of our pupil premium. “The year before last, we were in line with the national average in regard to results, and last year we were above that.” Despite the accomplishments Mr Zaman stressed that there have been, and always will be, challenges that need to be overcome explaining how his school always looks at ways of improving. He added: “Improving schools is not exactly rocket science; you just need to have dedicated staff that can help children achieve their potential. “Every time the school has an assessment or half-term, we sit down and assess who has made progress and who hasn’t and we are constantly rethinking what we do with the children. “It has had its challenges but I have never come in here and thought the staff aren’t up to it.”

The Jesus and Mohammed cartoon saga… UPROAR: LibDem PPC Maajid Nawaz defends himself saying that his tweet were his personal point of view

When Liberal Democrats parliamentary candidate Maajid Nawaz shared a cartoon earlier this month, he triggered widespread protests. The tweet of the cartoon which features the prophets Muhammed (PBUH) and Jesus greeting each other. Nawaz had commented: “This is not offensive and I’m sure God is greater than to feel threatened by it”. It has triggered a hot and aggressive debate from all quarters revolving around freedom of expression, freedom of speech and what counts as offensive. Some have said that as an individual standing for the position of MP, Nawaz’s tweet

was inappropriate behaviour. It’s common knowledge that visual depictions of the Prophet Muhammad (PBUH) are globally considered an absolute “no-no” amongst Muslims. So why did he do it? Some strong views which have come to the attention of Asian Express include concerns that Nawaz’s ploy was to encourage a flurry of social media activity and obtain virulent responses from mainstream press. Mr Nadeem Inayat, from Bradford and a dedicated reader of the Asian Express said: “He has promoted an image to his supporters and the media that the only people that are opposing him on this issue are people who have very extreme views, the rest of British Muslims think his actions are ok. “There is a very small minority

of Muslims that agree with him that this cartoon is innocuous.” Whilst the LibDem leader, Nick Clegg has defended Nawaz, saying that he upheld his right to express himself and confirmed that the party will not ditch him. Nawaz also says he has received death threats from some offended Muslims, despite the fact that he didn't draw the cartoon or wear the t-shirt that featured it. Defending himself Nawaz, this week, published a piece in the Guardian titled, “Why I'm speaking up for Islam against the loudmouths who have hijacked it." He explains: “My intention was to demonstrate that Muslims are able to see things we don't like, yet remain calm and pluralist, and to demonstrate that there are Muslims who care more about the thousands of deaths in Iraq,

Pakistan and Syria than we do about what a student is wearing. “My intention was to highlight that Muslims can engage in politics without insisting that our own religious values must trump all others' concerns, and to stand before the mob so that other liberal Muslim voices that are seldom heard, women's and men's, could come to the fore.”

A Sheffield mother sobbed and recalled her frantic search for her two-year-old daughter, before discovering that the child had plunged to her death from a block of flats in Sheffield. Little Ryaheen Banismuslem plunged from the fourth-floor of the North Bank apartments, in Sheffield city centre, on 27th June 2012, after a maintenance worker failed to replace a glass panel he had removed from a walkway barrier, the court heard. Maintenance worker Robert Warner, 45, is standing trial accused of manslaughter by gross negligence. Ryaheen’s mother - Ola Al Fatle broke down while giving evidence at the trial. She described how she and her two children were playing on the fourth floor communal garden at

the apartments. The toddler's mother broke down once more as she recalled the moment she realised her daughter had fallen. Asked by Jonathan Fuller QC, defending, how long her daughter was out her sight, she said: “I didn't let her out of my sight usually.” She explained how Ryaheen was only missing for a very short period of time. Warner, 45, of Shirehall Crescent, Shiregreen, Sheffield, denies a single charge of manslaughter by gross negligence. Bryan Cox QC, prosecuting, told Sheffield Crown Court, there was a gap in the barrier because a glass panel had been removed by Warner. Mr Cox said: “He created that very dangerous state of affairs, and he did nothing to warn of the obvious danger.” The court heard Warner submitted an invoice to ARIM (Allsop Residential Investment Management) - the firm which managed the building - claiming he had bought a new glass panel, which he never did. Mr Cox told jurors: “He stood to gain financially as you will see. He submitted an invoice to Arim on the basis he had incurred expenditure purchasing the glass panel. The fact is he did not.” Residents of the flats had reported seeing a panel missing

A fare report? Attacks on cabbies down but drivers say assaults going unreported

Official figures released have shown that violent attacks on taxi drivers in the Yorkshire area have fallen to their lowest level for the last five years. But while police say that

one attack is too many, many drivers believe that a substantial number of assaults are going unreported. A Freedom of Information request has revealed that there were 15 reports of taxi drivers

being robbed and 46 of violent crimes against cabbies last year. In 21 of those, race or religion was flagged as a factor. The figure is lower than the period between January 2009 and December 2010, when there were 71 assaults and robberies; between January 2008 and December 2009, when there was 87 and for between January 2007 and December 2008, when there were 82. However, Nasir Hussain, believes many crimes are going unreported as drivers would rather get it fixed so not to miss out on trade. “If a driver has a brick thrown at his car and it smashes the window, he would rather get it fixed quickly so he can get back out on the road making a living,” he said.

“I try to encourage drivers to report these crimes to the police but they don’t always because they need to get back on the road.” In May 2012, the Asian Express reported how a Halifax driver had his legs broken by two mindless thugs. The 29-year-old was left housebound after the cabbie was dragged from the driver’s seat and beaten up by the attacker and another man. He said: “I was very scared. Another man who was sitting on a wall came over and started kicking and punching me when I was on the floor. Then they used a crowbar to hit my leg.” West Yorkshire police have been working with the cabbies to make them safer with measures such as increased funding from the Home Office for cameras in cars. Mr Hussain said cameras can have helped drivers feel safer but, at a cost of around £1,600 to buy and another £150 to fit, not all can afford them. He urged drivers to make sure they report any attacks.

Superfast West Yorkshire announced last week that work has begun on the first phase of its expansion of high-speed fibre broadband, which is expected to help create jobs and boost connectivity in the region. Thousands of homes and businesses in 14 exchange areas are included in the first phase of Superfast West Yorkshire’s multimillion pound programme. The high-speed technology will be coming to Barwick in Elmet,

Hipperholme, Illingworth, Sowerby Bridge and Arthington for the first time. There will also be a substantial investment to make fibre more widely available in Halifax, Calder Valley, Brighouse, Hemsworth, Ilkley, Otley, South Elmsall, Royston and Sandal where many people can already get the technology. Engineering work to lay the new network in these areas has begun with local homes and businesses expected to be able to order fibre broadband by the end of June.

Hundreds braved the harsh weather conditions last weekend to commemorate the life of the Prophet Muhammad at a special celebratory event in Bradford. The first ever ‘Mawlid in the Park’ was staged in Centenary Square throughout Saturday 25th January, and despite the occasional downpour, more than 500 attendees turned up from all faiths and backgrounds. Organised by Save the Mother’s Trust (SMT) founder, Shaykh Mufti Qazi Hassan Raza, the day fell during the Islamic celebration of Eid Milad which commemorates the birth of the Prophet Muhammad. The day was meant as one of celebration to commemorate the important Islamic month, whilst also acting as a day for uniting the community and teaching the wider community about Islam Amongst the list of honoured guests was, the Dean of

year yet it was the idea of Shaykh Mufti Qazi Hassan Raza which really got us going onto this much bigger platform,” he explained. “He wanted to get people of all faiths involved on the day and that is why we held this very public ‘Mawlid in the Park’ event which turned out to be well received by everybody.” He added: “One of our main targets was to bring the concept forward regarding the true meaning of Islam, that being ‘peace, love and harmony’ and I think we did just that.” The first ever Mawlid in the Park event was a big success and, despite the sometimes testing weather conditions, similar events could be held again in the future.

Road restoration Residents unite to tackle tricky surface

After one back alley in Bradford was highlighted as not only dangerous for residents to walk down but hazardous for vehicles, a community in Bradford came together to tackle the problem head on. Following on from a number of community initiatives last year, Bradford Council, Associate Waste Management, and local Heaton residents took on their bumpiest challenge to date. The Alley behind the Jamia Shan-e-Islam Welfare and Education Centre provides a much needed entrance for visitors yet the surface has been uneven and difficult for elderly people to negotiate. Step up the local community action team. Last year the ‘Freshen Up Frizinghall’ campaign addressed a number of issues with ‘clean-up’ projects, organised between Frizinghall First volunteer

Mike Robisnon, of AWM explained: “Like all our sustainable projects, we aim to try to make not only the area but also the lives of residents better. Members of the Mosque highlighted a problem with the alley and asked for help. 24 hours later we had skips, a mini digger and our team on site to start the work. “11 tonnes of soil and rubble has been removed over the course of a day whilst a number of residents have helped lay the hardcore that the new concrete surface will be poured onto.” Money for the project was achieved via a grant approved by the ward

councillors, with matched funding from AWM to carry out the environmental improvements Mike added: “The grant from the ward councillors has enabled a partnership between residents, community organisations and AWM Ltd to achieve a lot more collectively and we are excited about tackling more outstanding issues in Frizinghall together.” Sajid Mahmood, of the Frizinghall First community group added his praise for the project. He said: “I’m proud to continually be part of work we do within the area with fellow residents and AWM. Working together has meant we’re able to achieve so much more. “Mike and I work together and encourage residents to engage and try to make a more connected community. It’s great to see neighbours, businesses and residents achieve so much together.”

After witnessing a rise in Bradford’s homeless population, a leading women’s group in the city launched a pioneering initiative last month, which continues to grow from strength to strength. The Curry Circle, set up by The Muslim Women’s Council, aims to help those less fortunate across the Bradford district by giving them access to a free hot curry on a weekly basis. Based at the Carlisle Business Centre every Thursday evening, warm food is dished out to visitors who may be struggling financially at that point in their lives. With shower facilities and hot drinks also on offer, it is an ideal

place for the homeless to escape the cold and not only enjoy a warm meal but also conversation in a safe environment. At the latest event, held on Thursday 23rd January, food was kindly donated by Mumtaz restaurant with almost 70 people visiting to receive their meals. Bana Gora, Curry Circle founder and Muslim Women’s Council founding member, was delighted to welcome so many diners to the latest event and explained why the work the volunteers were doing was vital for the community. “Since we set up it has been a case of so far so good to be honest,” she said. “We have been able to get a good insight into the minds of people who are struggling at this moment in their lives and it also helps create

awareness for the need of programmes like this. “The popularity is increasing on a weekly basis with people not only coming down for the food but also for conversation and warmth which they may also be missing.” She added: “Unfortunately, even in the 21st century here in England

‘Lose the suits and lace up your boots’ is the message being spread by a Leeds councillor who is fighting to give members of his community greater access to fitness facilities. Councillor Javaid Akhtar, representative for the Hyde Park and Woodhouse ward, spoke passionately at local council meetings as he tries to bring a healthy lifestyle to the residents of his represented area.

As a ward councillor, and branch secretary for GMB Yorkshire Professional Drivers, Mr Akhtar has witnessed firsthand the problems with access to fitness facilities in the city for all persons. With a moderate ethnic population, the Labour representative became concerned with the health of many of his local residents after hearing shocking figures in regard to heart problems and diabetes. He explained: “Basically it all started with the issue of high blood pressure in a lot of the Hyde Park residents and I

Mr Akhtar hopes to tackle this figure head on by providing a range of exercises for free to his local residents, and has already seen positive steps taken by community groups. “In my area, we have the Asian Women’s Association who have actually put in a bid with the area committee of match funding for 12 months, for free swimming sessions for local women,” he said. “This is positive as it is getting more people involved in exercise and gives all women the chance to swim for free.”

Also targeted by the healthy lifestyle scheme are elderly residents, who will be provided with sit-down exercises, in what Mr Akhtar would like to see as a pilot study for the whole city. As branch secretary for GMB Yorkshire Professional Drivers, Mr Akhtar also hopes to target taxi drivers who he feels need their own ‘body MOT’ to keep fit during working days. He said: “For the majority of the time taxi drivers will be sat down all day, go home, sleep eat and then back into the routine. “We need exercise for these people as well and it is crucial we encourage taxi drivers to do their own body MOT.” Meanwhile, wellbeing funding is spread throughout the city on a yearly basis by the approval of applications from different community groups. With only one organisation from the BME community previously applying, a new scheme may also be launched soon to encourage ethnic communities to step forward, by assisting with all paperwork and the application process.

‘The fight is not over’

Residents of the Hyde Park area were left disappointed by the news that their latest efforts to delay the demolition of the Royal Park School Building have failed, yet remain committed to saving the historic site. On Monday 20th January, Cllr Javaid Akhtar met Cllr Richard Lewis, Executive Board Member for Development to ask him to allow an extra three months reprieve so that talks could continue between Asset Management and Manni Hussain of Cubic Acquisitions. The latter two have offered to provide finances to refurbish and renovate the building as a Centre of Arts, Training and Enterprise yet the appeal for a further reprise was denied. However, the campaign to save the building continues. “The fight is not over,” said Pervez Akhtar, Chair of the

Eminent British scholars have challenged the government to release a cache of secret files dating back almost 400 years that they say could spur a reappraisal of some contentious episodes of British colonial history and the Cold War. The foreign ministry only publicly admitted the existence of the socalled "special collection" of some 600,000 dossiers in 2011, when an historian came across a 45-year-old memo that referred to it. The Foreign and Commonwealth Office (FCO) says it did not have the resources to sort through the files, despite laws requiring disclosure, but that it is now reviewing them to prioritise material of greatest public interest for release. But a group of 27 scholars from the British Academy used a letter to the Guardian newspaper to demand that in a free society all available records be released to ensure a full account of Britain's colonial past or the espionage mysteries of the Cold War. "The government must release these files," said Richard Evans, a professor of history at the University of Cambridge who is an expert in German history and one of the signatories to the letter. "A full and objective account of Britain's colonial past, involvement in the Cold War and many other important historical topics will only be possible when they are freely available," he told Reuters. "Of course, I can't say how they might change our view of the past since I don't know what's in them." From Britain's imperial past and the African slave trade to the betrayals of KGB double agents during the Cold War, the true historical worth of the documents is

unknown, historians said. "Because we haven't seen full listings of these documents, I don't want to speculate but the fact is that we do know these are very important materials," David Anderson, a professor of history at the University of Warwick, told Reuters. Held in six boxes, for example, could be important material related to slavery. Simply entitled "Slave trade reports", the boxes contain 18 files from the period 1662 to 1873. Three years ago, Anderson was an expert witness in a court case brought against the British government by 5,200 Kenyans who say they were tortured by Britain's colonial forces during the 1950s Mau Mau insurgency. Forced to make public documents on Kenya after Anderson found a 45year-old Whitehall memo which referred to the materials, the FCO also disclosed the existence of hundreds of thousands of other hidden files. Some parts of Britain's history could need to be revised in the light of the new files, Anderson said. The unexplained secrecy of such a large cache of documents has fuelled suspicions that they could contain surprises for those Britons with a benevolent view of British foreign policy. In Anderson's view, standout items in the trove could include nuggets to do with the Cold War, perhaps shedding new light on the activities of Guy Burgess and Donald Maclean, two spies acting for the Soviet Union. "The trouble is we don't know what's there," Margaret MacMillan, a professor of history at Oxford who is also part of the group, told Reuters. "Are there things tucked away in

there which would actually make me change my view on, for example, the British role at the Paris peace conference (after World War One), because I thought I'd seen everything that was there to be seen." The scholars contrasted the secrecy over the documents with the revelations triggered by fugitive U.S. spy contractor Edward Snowden about the power of Britain's GCHQ eavesdropping agency, which is overseen by the foreign secretary. "While the GCHQ story tells us that the government has wholly unexpected capacities to unearth information about its own citizens, the right of citizens to investigate UK foreign and colonial policy over the last 150 years and more is clearly being denied," the scholars said in the letter. "Those of us who work on the history of some other countries are used to government obstruction when it comes to researching official papers, but the UK is supposed to be a free society. The writing of full and impartial accounts of the Cold War, Britain's colonial past, and other key subjects depends on access to all the available records." When asked why the special collection had been held for so long, an FCO spokesman said: "These special collections have accumulated over time. They have been transferred into the FCO archive to ensure the records are preserved for potential selection and transfer to The National Archives. "Historically the FCO has concentrated on the release of files in the departmental series and resources have not been available to review and prepare the special collections for release."

Foodbank founder warns ‘there’s a great number of people in need’

As the public begins to feel the pinch from the festive period, a Bradford foodbank is appealing for more donations to help feed the city’s most deprived. In 2004, local resident Lashman Singh set up the Bradford Metropolitan Foodbank and in less than a decade, the charity has already helped feed tens of thousands of households across the city. Relying only on donations, and stock bought by the charity, the group has seen the number of food parcels double year-on-year since 2011, with 2014 predicted to be the biggest drive to date. After initially launching the Curry Project in Bradford in 1991, which fed people at set locations on a weekly basis, Mr Singh realised that there was still a great number of

people suffering because they could not travel to the site. This led to the launch of the Bradford Metropolitan Foodbank which has since acted as a hub, in Barkerend’s St Mary’s Church, for food parcel preparation. Mr Singh set up the charity to ensure everybody has access to food and drink, regardless of their situation, and wanted to thank the public for their support and urged people to continue giving whatever they can. “First and foremost I would like to thank everybody for all the support they have given us over the years because if it wasn’t for the generosity of the public we wouldn’t be able to carry out our task,” he said. “With the economy as it is, it looks like things will only get worse out there, especially with changes to the benefits system, so donations are needed more now than ever. “January and February are always

Operation Viper bites in Bradford Deadly haul of weapons seized during raids Crossbows, swords, knives and a revolver were just some of the lethal weapons found during a day of raids by West Yorkshire Police in Bradford as Operation Viper struck again. Specialist entry teams carried out 10 warrant searches throughout the city, as the haul of weapons were seized and seven people were arrested. Working alongside neighbourhood police officers, CID teams and Viper officers, the team completed the first day of an intensive week of searching on Tuesday 28th January. Following a search of a property on Allison Lane, Bolton Woods, a 28-year-old man was arrested on firearms offences after a number of air weapons were recovered. A 49-year-old man and a 55-yearold woman were also arrested from a property on Sewell Road, Laisterdyke, after suspected Class A crack cocaine, with an estimated street value of £800, was found in a kitchen cupboard. Further arrests included a 45year-old man from Elsdon Grove, Little Horton, who was taken into

custody on suspicion of possession with intent to supply Class B drugs after officers uncovered around a kilogram of cannabis at the property. Two other people have also been arrested in connection with three burglaries and one man was taken into custody on suspicion of cannabis possession. Chief Superintendent Dickie Whitehead, who leads Operation Viper, said: “This week is just one of a number of proactive tactics we are employing as we aim to turn the fear of crime onto criminals themselves. “The week of action in Bradford follows on from a similar operation in Leeds that helped to reduce incidents of burglary by over 20 per cent. “The seizure of Class A and B drugs removes them from the local market place and recovery of the cache of weapons is something that makes the streets of

astonishing eight per cent of the Upper Sixth’s population, and will all now have extra motivation to succeed in their A2 Levels, which begin later this year. Out of all the students offered places at the two institutions, half were from Oxford whilst the other eight came from their near neighbours, Cambridge. One student, offered a conditional place at the latter, was Trina Seal who is hoping to study Natural Sciences (Biology) following her time at GSAL. After visiting the institution last year for a tour of the facilities, the aspiring teenager says she instantly ‘loved’ the place and is now targeting her place amongst the elite. “On receiving the offer, I was thrilled and slightly in shock as competition for places was very high,” she said. “The offer has motivated me to continue working hard in all my subjects and attain the necessary grades to meet the conditions of my offer.” If successful Trina will begin her University education in September and it is the appeal of the natural sciences course which really interests the keen learner. “The challenge of the natural sciences course really appealed to me, as well as the opportunity of learning from professors at the forefront of their field,” she said. “In addition, the course allows the study of many different areas of science in depth which results in a wide base of knowledge that will be useful later in life. She added: “The school (GSAL) has been a massive help in the application process, from reading several drafts of my personal statement to running sessions at lunchtime to help extend knowledge beyond the subject syllabuses.” This year Oxbridge attracted a record level of applications, with five students chasing each place and for GSAL’s head of student development, Christine Jagger, to see her school so well represented in the offers was amazing. She said: “In the face of such stiff competition our students should be extremely proud that they have come through this tough selection process. “While we work closely with senior students to guide them through those allimportant decisions about the courses and institutions that will be right for them, it is their own hard work and determination that ultimately impresses the admissions tutors.” The seven other students conditionally accepted by Cambridge University include Elinor Clapson, Jacob Gibbs, Christopher Schofield, Vandan Parmar, Jennifer Shaw, Yasmin Khan and Yash Singh. • What is conveyancing? Conveyancing is the term given to the process of transferring legal ownership of land and property. Conveyancing can include sale, purchase, and remortgaging.

• How long does conveyancing take? The conveyancing process does not have a fixed duration. Much depends on whether or not there is a mortgage, the co-operation of all parties involved etc. A straightforward conveyance where there are no major problems can be completed within 6-12 weeks. However please note this is a guide only; some conveyances may take longer and some may be completed sooner. • How much does conveyancing cost? There are two costs – one is the legal fee and one is a fee for disbursements (see below). The legal fee will depend on the purchase/sale price of the property and whether a mortgage is involved. Disbursements are expenses paid to third parties and which are incurred in the conveyancing process (e.g. property searches, Land Registry fees etc). U.S. & British spy agencies piggyback on ‘leaky’ apps for intel OUTRAGEOUS: GCHQ documents its use of the popular ‘Angry Birds’, which was reportedly downloaded more than 1.7bn times

U.S. and British intelligence agencies have plotted ways to gather data from Angry Birds and other smartphone apps that leak users' personal information onto global networks. It was citing previously undisclosed intelligence documents made available by fugitive American spy agency contractor Edward Snowden. The U.S. National Security Agency (NSA) and its British counterpart, the Government Communications Headquarters (GCHQ), have been taking advantage of increasing volumes of personal data that spill onto networks from new generations of mobile phone technology. They’ve been developing capabilities to piggyback onto ‘leaky’ smartphone apps, such as the wildly popular ‘Angry Birds’ game, that transmit users' private information across the internet, according to top secret documents.

The U.S. and British agencies were working together on ways to collect and store data from smartphone apps since 2007. The agencies have traded methods for collecting location data from a user of Google Maps and for gathering address books, buddy lists, phone logs and geographic data embedded in photos when a user posts to the mobile versions of Facebook, Flickr, LinkedIn, Twitter and other services. Snowden, who is living in asylum in Russia, faces espionage charges in the United States after disclosing the NSA's massive telephone and Internet surveillance programs last year. His revelations and the resulting firestorm of criticism from politicians and privacy rights activists prompted U.S. President Barack Obama to announce intelligence-gather reforms on 17th January, including a ban on

eavesdropping on the leaders of close allies and limits on the collection of telephone data. The report said the scale of the data collection from smartphones was not clear but the documents showed that the two national agencies routinely obtained information from certain apps, including some of the earliest ones introduced to mobile phones. The agencies also made use of their mobile interception capabilities to collect location information in bulk, from Google and other mapping apps. One basic effort by GCHQ and the NSA was to build a database geolocating every mobile phone mast in the world – meaning that just by taking tower ID from a handset, location information could be gleaned. A more sophisticated effort, though, relied on intercepting Google Maps queries made on smartphones, and using them to collect large volumes of location

information. Scooping up information the apps are sending about their users allows the agencies to collect large quantities of mobile phone data from their existing mass surveillance tools – such as cable taps, or from international mobile networks – rather than solely from hacking into individual mobile handsets. Exploiting phone information and location is a high-priority effort for the intelligence agencies, as terrorists and other intelligence targets make substantial use of phones in planning and carrying out their activities, for example by using phones as triggering devices in conflict zones. The NSA has cumulatively spent more than $1bn on its phone targeting efforts. The disclosures also reveal how much the shift towards smartphone browsing could benefit spy agencies' collection efforts.

Bollywood Bustup t is established in law that a Claimant in a breach of contract claim can recover only those losses which arise naturally from the breach and which could reasonably be supposed to have been in the contemplation of the parties at the time the contract was entered into. Any further losses would be too remote and irrecoverable. A recent Court of Appeal case has considered the extent to which property-related losses are recoverable and has held that losses arising from a fall in the market value of property are not too remote and are therefore recoverable. In the case of John Grimes Partnership Ltd –v- Gubbins [2013] the Defendant obtained planning permission to develop a field for residential purposes and engaged the Claimant, an engineer, to make arrangements for a road and drainage on the site. It was expressly agreed that such work would be completed by the Claimant by March 2007. The deadline was not met and in April 2008 the Defendant engaged another engineer to complete the work. The Claimant brought a claim against the Defendant for just under £3,000 of unpaid invoices. The Defendant disputed the claim and brought a counterclaim for almost £20,000 of fees that he had previously paid to the Claimant, claiming that the work had not been completed properly. The Defendant also claimed damages for the losses he suffered due to the work not having been completed by March 2007 as agreed. The Defendant’s losses caused by the delay were a reduction in

the market value of the residential properties and an increase in building costs. The Defendant was successful and the Claimant appealed but his appeal was dismissed. The Claimant argued that the losses claimed due to a decrease in market value were too remote. It was held by the Court of Appeal that the losses were not too remote as, when entering into the contract, the Claimant knew that a delay would bring with it the risk that the property market may rise or fall and therefore the loss was reasonably foreseeable. The Court of Appeal also did not uphold the Claimant’s case that such loss would be disproportionate compared to the contract price. It was held that this was not sufficient to escape responsibility. The Court of Appeal did note that there may be circumstances where the general rule may not be followed, and this would be in such a case where the particular circumstances show that the parties when entering into the contract did not intend for the Defendant to be liable for a particular type of loss (even though that loss was reasonably foreseeable). It follows therefore that contracting service providers should take particular care to carefully consider and ensure that any contract expressly excludes liability for particular types of loss. Otherwise they may become liable for ‘foreseeable losses’ which they did not foresee or contemplate at all. BSkyB reaffirm position in sports market British Sky Broadcasting PLC sought on Thursday to secure its base against its insurgent rival BT PLC by securing some sports rights and a long-term deal with US pay-TV network Home Box Office. The London-headquartered satellite broadcaster, whose biggest shareholder is Rupert Murdoch's 21st Century Fox Inc. said it had secured six long-term rights deals in six sports, including the 2017 rugby tour to New Zealand by the British

Lufthansa head to India The head of Lufthansa said the German airline plans to begin flying Airbus A380 superjumbo jets on routes to India later this year. On Monday, India lifted a ban on landing the aircraft in the country, enabling carriers such as Singapore Airlines, Lufthansa and Emirates airline to fly the jets into the world's second-most populous nation. Lufthansa had earlier said it had no immediate plans to use the jet on those routes. Yet, during an interview with Reuters earlier this week, the airline’s CEO, Christoph Franz, confirmed his belief that Lufthansa’s A380 fleet will be India-bound soon. He said: “We are interested to use the A380 also for the major Indian markets.”

An Edinburgh grandfather ,sentenced to death in Pakistan for blasphemy, is in urgent need of mental health treatment. According to campaigners at Reprieve, they have serious concerns about the mental wellbeing of Mohammed Asghar, who has been diagnosed with paranoid schizophrenia. He has been convicted of blasphemy in Pakistan and faces the death penalty. Prime Minister David Cameron has said that he is “deeply concerned” and that the UK was taking the case “very seriously”. Lawyers for Mr Asghar finally gained access to their client this week and as a result, were able to get the necessary documents signed so that he can file his appeal against the sentence. But they told the charity they have concerns for his mental health and say that, despite his diagnosis of paranoid schizophrenia, prison medical staff remain unaware of his serious psychiatric illness and are not giving him the appropriate medication. During their visit, it was “clear” he was in very poor health and they have stressed it is crucial he receives the expert medical treatment he urgently needs and said he appeared “pale, dehydrated, shaking and barely lucid”. Maya Foa, director of Reprieve’s death penalty team, said: “We are extremely worried about Mr Asghar’s mental health, which appears to have seriously deteriorated. “We are also extremely

concerned by the reports that he is not being given the correct medication for his illness, putting him in a perilous position. “We hope that the authorities in Pakistan and the UK will take all necessary steps to ensure that he gets the expert treatment he needs without delay.” The Pakistan High Commission in London has said the mental health of Mr Asghar should be taken into account when his appeal against the death sentence for blasphemy is heard. It issued a statement as his family pleaded that he not be allowed to “die in jail”. The Commission said it had received “messages of concern” as Mr Asghar’s family in Edinburgh said they were growing increasingly desperate over the plight of the 68-year-old retired city shopkeeper who has already spent three years in prison in Pakistan. Mr Asghar was condemned to death by a court in Rawalpindi

last week after he wrote letters, which were never posted, which he signed as “prophet” Mohammad. The court was not told of warnings from a leading Edinburgh psychiatrist that Mr Asghar, who lived in the Capital for more than 30 years, has a diagnosis of paranoid schizophrenia and has previously experienced delusions that he is a “holy man”. The High Commission said it had received “pleas for leniency from UK residents and politicians, including senior Foreign Office minister Baroness Sayeeda Warsi. Mr Asghar’s family called on the British Government to help to bring him home, where he could be treated for his mental illness. The family have launched a petition calling on Prime Minister David Cameron and First Minister Alex Salmond to “intervene in the strongest possible terms to help save the life of a vulnerable British man”. The family said he had already attempted suicide unsuccessfully. Labour’s Douglas Alexander has written to Foreign Secretary William Hague, asking him to make immediate representations to Pakistan’s government over the case. Lawyers fear they will not be able to see him in prison until it is too late to get him to sign a secondary power of attorney and lodge an appeal. Under Pakistan law this must be lodged with the court seven days after conviction. Baroness Warsi said she was “deeply concerned” by the case, adding: “I am personally raising this in the strongest possible terms with the Pakistani government, as are officials here and in Islamabad.”

Hundreds of Syrian refugees may soon be arriving in Britain after Deputy Prime Minister Nick Clegg announced the decision to soften the government’s stance on the matter. Many of Syria’s most vulnerable, including rape and torture victims, will be welcomed to the shores as they seek refuge from the war-torn country which has seen more than 130,000 killed in the last three years. Mr Clegg added that the government had been given United Nations backing to accept Syrian refugees on a case-by-case basis, but was stopping short of agreeing to take in a quota under a UN

scheme to resettle 30,000 of the most vulnerable cases. “Sadly we cannot provide safety for everyone who needs it, but we can reach out to some of those who need it most,” Mr Clegg said. According to Home Secretary, Theresa May, there are approximately 3,500 Syrian refugee asylum seekers currently in the UK. Speaking in front of MPs on Wednesday, Prime Minister David Cameron reiterated the country’s commitment to providing asylum for Syrians adding that the UK has been working closely with the country for a long time. Mr Cameron said: “We will act with the greatest urgency because, when it comes to Syria, we have acted with the greatest urgency throughout.

“We have made available £600m, which makes us the second largest humanitarian donor, we provided food for 188,000 people, clean water for almost a million and medical consultations for almost a quarter of a million. “We will be coming forward with a scheme to help the most needy people in those refugee camps and offer them a home in our country.” The three-year Syrian civil war has pushed around 2.4 million people out of Syria and into refugee camps in neighbouring states. In the last year the UK has accepted around 1,500 Syrian asylum seekers who had made their way to Britain, but had previously resisted taking in refugees direct from the region.

Lee Rigby killer makes appeal bid

Michael Adebolajo, who was found guilty of the murder of British soldier Lee Rigby, has lodged an application to appeal against his conviction, the Judicial Office has confirmed. Fusilier Rigby was killed on 22nd May 2013 in Woolwich, south-east London. Adebolajo, 29, from Romford, east London, and Michael Adebowale, 22, from Greenwich, south-east London, are currently awaiting sentencing. Mr Justice Sweeney said he would pass sentence on the two men after a key Appeal Court ruling on the use of whole-life terms, with the decision due at a later date. In December, an Old Bailey jury of eight women and four men took approximately 90 minutes to find the men guilty of murdering Fusilier Rigby. They were found not guilty of attempting to murder a police officer at the scene. The jury had heard that Adebolajo and Adebowale drove a car into Fusilier Rigby at 30-40mph, before dragging him

into the road, attacking him with knives and attempting to decapitate him with a meat cleaver. In court, Adebolajo - a married father-of-six - admitted killing Fusilier Rigby, 25, but denied murder and described the killing as a ‘military operation’. As the guilty verdict was declared and the defendants

were taken out of the courtroom, Adebolajo kissed his Koran and raised it in the air. In a previous police interview, Adebolajo had said he and Adebowale decided to lie in wait near Woolwich barracks and targeted Fusilier Rigby because he was wearing a Help for Heroes hooded top and carrying a camouflage rucksack. As a police vehicle approached, the men rushed towards it, waving the meat cleaver and a firearm. They were both shot, but denied attempting to kill police, saying they had wanted armed officers to shoot them dead so they could ‘achieve martyrdom’. An investigation by the Independent Police Complaints Commission (IPCC) later concluded the police officers who shot the men ‘acted appropriately to the immediate threat’. The Judicial Office, which reports to the Lord Chief Justice and supports the judiciary in its work upholding the rule of law, confirmed on Thursday that Adebolajo wished to appeal against his conviction.

136 law firms forced to close Leeds and Bradford solicitors publically named by the Solicitors Regulation Authority By Anush Ansari anush@asianexpress.co.uk

The Solicitors Regulation Authority (SRA) has taken the unusual action of publishing the names of 136 firms that are being forced to close. The companies are being shut down as a result of failing to secure professional indemnity insurance (PII) by the October 1st deadline and did not obtain new cover during the Extended Policy Period (EPP). The EPP was introduced for the first time this year and gave firms an extended period of indemnity insurance for 90 days. Firms that did not obtain new indemnity cover during the EPP, namely by 29th December 2013, had to close their practice and are not insured to practise after that date. In early January, brokers raised concerns over the SRA’s handling of the PII renewal process after the regulator admitted it had lost track of some uninsured firms (8th January 2014). The SRA does not normally publish the names of closed firms because firms have an obligation to inform clients and

others that they are closing down. Their decision on this occasion to publish the names in the interests of protecting consumers and third parties. Publishing the names adds an extra layer to the protection already in place. The regulator said most of the firms involved have co-operated with the forced wind-down process the SRA imposes when insurance is not secured, but that there were a “small number of firms that failed to close properly and they are subject to ongoing robust action”. There has been some confusion over how claims arising from firms that have failed to shut down as the SRA has prescribed would be handled. It is thought that the SRA’s discretionary compensation fund would kick in but the SRA’s rules state that the maximum grant that may be made from the fund is £2m, which would cover sole practitioners but represents a £1m shortfall on the statutory cover required for ABSs and LLPs. Among the firms on the SRA’s list are Leeds-based Rafique Partnership Solicitors Co Ltd, Devers & Co Solicitors, Kelly & Co, Richardson & Co Solicitors

and Bradford-based Megsons Personal Injury Ltd. The SRA is carrying out a full analysis of all those firms that entered the EPP and the way the legal profession is insured will be examined in the High Court this year in a major test case that could have implications for how all firms obtain indemnity cover. Firms are aware that they should not undertake work without insurance, although clients have protection in these circumstances. If anyone has concerns that these firms are continuing to practise, they should inform the SRA via report@sra.org.uk and disciplinary action will be taken if that is the case. If clients believe these firms are continuing to progress their matters, they should contact a new solicitor immediately to take over the case.

Doctors making moves to bring Schumacher out of coma

Michael Schumacher's sedation is being reduced to allow the ‘waking up process’ to start, his manager says. Bringing the Formula 1 legend out of his coma could take a long time, Sabine Kehm said in a statement. Schumacher suffered a severe head injury in a skiing accident in the French Alps on 29th December. He was put into a medically induced coma by his doctors at a clinic in Grenoble after operations to remove blood clots from his brain. Doctors have kept the 45-year-old German asleep to help reduce the swelling. Ms Kehm was approached by the media for comment on Schumacher's condition on Wednesday - exactly a month after his crash. She said his condition remained ‘stable’. In her statement on Thursday, she said it had been agreed to communicate details of his sedation ‘only once this process was consolidated’. The statement again included an appeal

by Schumacher's family for privacy for them and for his doctors, while at the same time expressing ‘sincere appreciation for the world wide sympathy’. At his bedside since the accident, the family have received hundreds of letters and gifts from around the world. Earlier this month, investigators probing the accident said Schumacher had been going at the speed of ‘a very good skier’ at the time of his crash in the resort of Meribel. He had been skiing 8m off-piste when he fell, they added. Experts reconstructed events leading up to the crash after examining Schumacher's skiing equipment and viewing footage filmed on a camera attached to his helmet. Schumacher retired from racing in 2012 after a 19-year career. He won two titles with Benetton, in 1994 and 1995, before switching to Ferrari in 1996 and going on to win five straight titles from 2000.

Section 377 to stay

After weeks of protest, India’s Supreme Court ruled earlier this week that a month-old ruling, that banned gay sex in the world's largest democracy, would remain in place. The government and seven human rights groups had filed petitions asking the court to review its decision, in the hope it would be overturned. “The Supreme Court has turned a cold shoulder to these groups and their suffering,” said Arvind Narrain, one of the lawyers who brought the rights' groups petitions. “The court had an opportunity to correct itself today. This is a court that is meant to be for all human beings.” On 11th December, the Supreme Court reinstated a colonial-era ban on gay sex, following a four-year period of decriminalisation that had helped bring homosexuality

out into the open in the socially conservative country. The Supreme Court ruled that only parliament could change Section 377 of India's penal code, which prohibits "carnal intercourse against the order of nature with any man, woman or animal", and is widely interpreted to refer to homosexual sex. A lower

court had overturned this section of the code in 2009. Violation of the law can be punished with up to 10 years in jail. The rights groups will now submit a ‘curative petition’, where they apply for the Supreme Court's ruling to be reviewed by a panel of five judges, Narrain added.

Nawaz Sharif still wants peace talks with Talibans Despite a wave of deadly attacks, Pakistan's Prime Minister Nawaz Sharif has said he still wants to hold peace talks with the Taliban and said that a fourmember team will pusue negotiations with the militants. In a rare address to the National Assembly, he said ‘terrorism’ must be defeated, either by talks or force, and he was giving peace a last chance. Pakistan's Taliban vowed more attacks after their leader was killed last year but say they are considering the offer. Hakimullah Mehsud died in a US drone strike in November - his successor, Mullah Fazlullah, ruled out peace talks and promised revenge. To many people in Pakistan the country's political leaders appear impotent in the face of the militant threat as the attacks have soared, correspondents say. Mr Sharif, who was elected last May, is under mounting pressure to try to bring the violence under control. “I am sure the whole nation would be behind the government if and when we launch a military operation against the terrorists - but I want to give peace a final chance,” he told members of parliament in a televised speech. He said he, too, was tired of the attacks

and he would do everything possible to bring peace. Veteran journalists Rahimullah Yusufzai and Irfan Siddiqui, former ambassador Rustam Shah Mohmand and a retired major in the ISI intelligence service, Amir Shah, will lead dialogue efforts and report back to the interior minister. No timeframe was set for the talks to be held - and the prime minister stopped short of announcing any tough preconditions for negotiations. Pakistan Taliban (TTP) spokesman Shahidullah Shahid welcomed the move by Mr Sharif and said the militants' central shura, or council, was meeting to consider the talks offer. “We are ready for meaningful negotiations provided the government shows sincerity of purpose,” he said, the AFP news agency reports. Mr Sharif's call for talks seems to have exposed divisions within the Taliban. The militants' leader in Punjab province, Asmatullah Muawiya, was quick to say he would take part in talks. “We trust the negotiators nominated by the Pakistani government. We will participate in these talks, and also consult with other groups and persuade them to join the talks,” he told BBC

Urdu's Asif Farooqi. He promised his fighters would end attacks once talks started, and added: “I am confident that the reaction of the TTP and Maulana Fazlullah will not be any different from us.” Scores of people have been killed this month alone, many of them soldiers, as the militants attacked military and civilian targets across the country. The death toll has called into question Pakistan's strategy for dealing with militancy. Some observers say a lack of concerted military action meant that an opportunity to take advantage of apparent militant divisions following Hakimullah Mehsud's death in early November was missed. There is now a limited military operation in the North Waziristan tribal area. But correspondents doubt the government and military in Islamabad want to launch a larger offensive at this stage in the militants' main sanctuary near the Afghan border. Analysts believe Pakistan sees many of the militants based in North Waziristan as a ‘strategic asset’ in a year when foreign combat forces are leaving its neighbour.

This isn’t just a C7-Corvette Stingray with a few extra bodywork bits n bobs – this ‘Vette has more power than a McLaren F1, and tech to blow your mind away. Meet the Corvette C7 Z06, which makes its predecessor look limp-wristed and its output pathetic. This beautiful beast boasts 6.2-litre V8, by a 1.7-litre boosted supercharger which spins its turbine at 20,000rpm. Though finalised power figures are yet to be revealed, Chevrolet promises the Z06 will develop ‘at least 625 horsepower’ - that’s more than the twin-turbo V8 in the back of a McLaren 12C produces. This is a serious piece of kit. What’s more, this monstrous beauty’s engine is being offered for the first time in its history as an automatic. The ’box in question is an eightspeed torque-converter with paddleshifters, which GM claims is lighter than Porsche’s benchmark PDK dual-clutcher, and can swap cogs even faster. The aluminium spaceframe is retained from the C7 Stingray, and will go racing in the new Corvette C7.R later in 2014. The structure is so stiff that Chevy has been able to make this the first targa-top Z06 – the removable roof panel is carbonfibre, as is the bonnet. Even with the roof removed, Chevy claims the Z06 is 20% stiffer than the strictly fixedhead C6 ZR1. Clip the roof back in and you’re 60% more rigid than the best last-gen ‘Vette. There’s a major chassis overhaul too. The Z06 is 56mm wider across the front axle than a C7 Stingray, and a whopping 80mm wider across the back. The stretch means the Z06 actually has a bespoke rear fasica, which pushes the

taillight clusters further apart than on the standard car’s rump, to maintain the right proportions. The body is also covered in extra vents, intakes and aero addenda. Inside, you get a choice of comfort-biased ‘GT’ seats, or bolstered aggressively ‘Competition’ buckets. Both use magnesium frames to shave yet more grams from the (unknown) kerbweight, while other surfaces in the C7’s vastly improved cabin get the suede Carbon and treatment. aluminium cockpit trim is available too. Chevy has gone to town on driver tech too. You get an limited slip electronic differential (a la Jaguar F-type R coupe), and a three-stage driver assistance setting. Toggle between mild terror and almost certain death as the safety nannies are dialled down and eventually off on your 625hp American missile. Plus, launch control and a specific ‘Track mode’ make this the fastest road-going Corvette ever around Chevy’s test circuits. Though pricing is yet to be confirmed, indicators suggest that it’ll be around the £75,000 mark and will arrive in US showrooms in early 2015 – and hopefully in Europe soon after.

Nisan unveils revolutionary petrol engine The Nissan ZEOD RC will become the first entry at Le Mans to complete a lap of the Circuit de la Sarthe under nothing but electric power in June. A single lap of each stint (a fuel “stint” lasts approximately one hour) will be electric powered, then the new Nissan DIG-T R 1.5 litre threecylinder turbo engine will take

over. The incredibly small engine weighs only 40 kilograms (88 pounds) but produces an astonishing 400hp. The base engine is only 500mm tall x 400mm long x 200mm wide (19.68” x 15.74” x 7.78”). A fantastic 1992 Honda NSX, owned by legendary three times Formula One World Champion Ayrton Senna, is set to go under the hammer at Silverstone Auctions’ Race Retro & Classic Car Sale on the 22nd and 23rd February. The car was originally purchased by Antonio Carlos de Almeida Braga, close personal friend, manager and mentor of Senna, for the driver to use when he visited his home in Portugal. Following Senna’s tragic death at Imola in 1994, the car remained in the garage at Braga’s home where it was not allowed to be touched or driven by anyone. After two years it was eventually sold to a buyer who kept it only a short time before being purchased by the current owner seventeen years ago. Nick Whale, managing director, Silverstone Auctions, said: “Very rarely does a car with such pedigree and provenance come to market, especially with such a powerful and personal link to arguably the greatest F1 driver of all time, and as such, we’re incredibly excited to offer it for auction.” The car, offered with an estimate of between £75,000 to £85,000, is presented in black with a black leather interior, manual gearbox and has covered just 31,800 miles. When choosing the car Braga made sure it was set to the same specification that Senna chose for his own NSX and is regarded as the ultimate combination for the car. This year sees the 20th anniversary of the death of the racing icon and the car could prove a great investment for buyers with heightened interest in the much admired model as the 25th anniversary of its introduction approaches next year.

Another defeat for hapless England VICTORIOUS: England slumped to a 4-1 series defeat at the hands of a resilient Australian side in their ODI series, with the hosts now looking to make it a series hat-trick in the upcoming Twenty20 series

It wasn’t a whitewash but it wasn’t exactly good. England’s One Day International series with Australia finally came to an end last weekend as the hosts marched to yet another convincing victory, to seal a 4-1 series win. Electing to bat first, Michael Clarke’s men notched up a score of 217-9 runs in their 50 overs, a target which, at moments, did look attainable for the visitors yet like much of their time down under this winter, it simply wasn’t. Falling five runs short, with two balls remaining, England were bowled out for 212 after James Tredwell was the final man dismissed, going for a duck off Shane Watson, caught by Matthew Wade. Joe Root topscored for the visitors, claiming the side’s only half-century (55) yet it was the dismissal of Eoin Morgan for 39

Further anguish for English cricket that signaled the beginning of the end of the series. Four wickets were taken for just 39 runs after the Middlesex batsman’s dismissal, as yet another batting collapse cost England the chance of a second victory in the ODI series. A 4-1 defeat in the ODI series, following on from the Winter Ashes Whitewash, was not exactly the plan for England who had comfortably defeated their Australian counterparts in the Summer Ashes 3-0. Speaking after the final ODI, England captain Alastair Cook said: “We should have got over the line, we got into some good positions, credit to Australia as they held their nerve better than

we did but there were some poor shots. “Two of the three other games we could have won but ‘could have’ is wrong. You get confidence from winning games of cricket, Australia have had a great summer and have managed to win. “It's been a tough couple of months, we've got a lot of things we can work on, there's a lot of talent and in 12 months’ time we should be in better shape for the World Cup.” England will now face the Australians three more times in the Twenty20 format before finally calling an end to their tour down under, at the beginning of February.

Wonderful Wawrinka Shock defeat for Nadal in Australian Open final

With less than four weeks gone in 2014, Stanislas Wawrinka is already celebrating his most successful year in tennis after clinching his first ever Grand Slam title last weekend at the Australian Open. The Swiss national defeated 2009 winner Rafael Nadal in four sets to walk away as champion on his 36th attempt at claiming an elusive Grand Slam. Nadal came into the match with question marks surrounding his fitness, yet nothing can be taken away from the new Swiss number one, who overtook Roger Federer in the World rankings. Defeating the Spaniard, 6-3, 6-2, 3-6, 6-3, Wawrinka flew out of the traps to take a twoset lead before play was stopped momentarily for Nadal to receive treatment to a back injury. With the underdog looking likely to pull off a straightforward three-set win, Nadal showed why he is number one in the world and put in a gutsy performance, to win the third 6-3.

“I never expected to win a Grand Slam because, for me, I was not good enough to beat those guys,” said Wawrinka. “To win a Slam, to be number three [in the rankings], both for me is a big surprise. “But I think more so to win a Slam, because in the ranking you can be number three without winning a Slam. But now both are happening, so it's a big surprise. “It’s an amazing feeling. I saw Roger winning so many Grand Slams in the past, so now it’s my turn to win one. “If you look at the 10 past years, except Del Potro, it’s only the top four guys who were winning all the Grand Slams.” The 28-year-old’s road to the final included a five set victory over reigning champion for the past three years, Novak Djokovic, and he is the first man since 1993 to defeat the two top seeds at a Grand Slam.

With fewer than 100 laps completed by all drivers earlier this week at the first day of the Jerez test, Force India’s new VJM07 car will have to wait to be tested to its full potential. The F1 sleeping giants were just one of the teams who were made to wait on the first test day of the new turbo era, with Sergio Perez only completing 11 laps in total. Nico Hulkenberg was forced to wait until Thursday before trying out his new wheels, whilst Perez got to grips with the model throughout Wednesday’s session. Speaking after a long, drawn out day one, Sergio Perez said: “As expected it has been quite a slow day

for everybody in Jerez. “The main job was to learn as much as possible each time the car went out so that we could identify and solve any issues. It was not really possible to get a feeling for the car because we only did a small number of laps, but the important thing is that the car is up and running.” The former McLaren driver recorded a best lap time of 1:33.161, notching up a total of just over 48km throughout the whole day. Andrew Green, Technical Director for Force India explained how, despite only managing a few laps, the constructors have been able to take away a lot of lessons from the day. He said: “Tuesday’s laps were a key

first step for the development of the VJM07. “There’s still a long way to go, but we have been able to start checking all the new systems on the car, especially the power unit and the gearbox. There have been a few teething problems, which is to be expected with a new car, but we’ve already learned a great deal in just one day. The plan for tomorrow is more of the same as we continue to get miles on the car.” Nico Hulkenberg is set to have his first drive on Thursday whilst Daniel Juncadella will get behind the wheel on Friday.

Yorkshire bowler travels down under for pre-season training

Big season ahead for Ashraf Moin Ashraf has joined Yorkshire’s winter exodus to the Southern Hemisphere in an attempt to start the new season strongly and become an established first team player. The 22-year-old seamer from Bradford has added his name to the long list of other Yorkshire players who are supplementing their preseason training by playing overseas this winter to try and boost their chances of success this summer. As competition hots up to make the starting line-up for Yorkshire’s opening match in Division One of the Championship, starting at Taunton on the 13th April, Ashraf has responded to the challenge of breaking into that side by agreeing to his longest ever stint away from England, with six weeks playing cricket in Australia. He has called on the contacts of Yorkshire coach Jason Gillespie, who has helped fix him up with cricket at East Torrens District CC in the

Adelaide suburbs. The Yorkshire bowler hopes his time in a new country will help him start the season strongly and force his way back into Yorkshire’s championship side having played only one match in Division One last summer. “I’ve never been abroad for that period of time in pre-season before and I’m looking forward to getting some cricket, getting stronger out there by doing my gym work and just having a change of scenery – it will be very competitive cricket out there,” he explained. “I was looking to play cricket overseas in Australia and my initial thought was maybe the Darren Lehmann Academy, but East Torrens came in and were happy to take me on and I’m looking forward to playing competitive cricket.” Yorkshire seemed particularly keen for their young bowler to take advantage of the opportunity after

struggling in recent years to begin new seasons strongly. Although a consistent member of Yorkshire’s youthful YB40 line-up last summer, Ashraf’s only taste of Championship action was the drawn match against Nottinghamshire at Scarborough in June. “I’m honest to admit that I’ve been a notoriously slow starter in previous seasons because I haven’t actually started in the team in the last two or three seasons and when I have had good seasons, I’ve come into the team mid-way through the summer,” he added. “I’m hoping that the six weeks I spend in Adelaide and a further two weeks in Sri Lanka with the Yorkshire squad in pre-season will help me start strongly. “It’s going to be a challenge in the heat and the conditions and tough cricket but I’m excited for the challenge and I think it will help my cricket massively.”

British Asian Rugby Association set for big year in 2014

The British Asian Rugby Association (BARA) has been breaking down barriers for a decade now and to celebrate the important milestone, a special tour of India is set to be held later this year. Leading a cross-section of Lords and MPs, the squad is set to embark on an August tour, nine years on from their last trip to the South Asian country. A number of other celebratory events will also be held throughout the year, including a match with the Spanish Rugby League national side in Valencia, as well as BARA Tag Time tournaments for young people across the country in the summer. 2014 will be capped off with a celebratory dinner in recognition of the ten years hard work, and for BARA founder, and former

England international, Ikram Butt, it will be one of the biggest years to date for the governing body. Speaking to the Asian Express, he said: “It’s quite an exciting year for BARA, not just in terms of our 10 years anniversary but because we have some new and exciting projects that we have been invited to be involved in, both in the UK and abroad. “Rugby has always been a sport for everybody, yet there are communities and cultural groups that are under-represented. “We want to break down whatever barriers, real, or perceived that are getting in the way. Our campaign is going to reach out across the social and cultural spectrum across the board, and BARA is a statement of intent.” Throughout their ten years of existence, BARA has made considerable progress on and off the field, with particular focus on

engaging under-represented demographics in rugby, such as the South Asian community. Although rugby governing bodies, professional and amateur clubs & local authorities have been striving to attain multicultural diversity within the game, they have had limited success in tapping into the untapped potential within the South Asian and wider communities. BARA was created to attempt to redress the balance, working alongside rugby bodies and other relevant organisations. As an inclusive organisation the body has acted as positive role models, breaking down cultural and religious barriers, as well as promoting community integration, personal development, educational attainment, health and well-being and encouraging participation in sport and physical activity especially in rugby.
